The Base level read the five seifim. Here we open what is disputed in them — and the discussion of siman 206 is peculiar in that it often bears on the text itself: the Taz holds that a gloss of the Rama is missing and restores it; the Shach doubts and flags it; the Bach reads the silence the other way round. Three Acharonim, one and the same blank on the page.

📑 Plan of study

1. ידים מוכיחות — the central ma'hloket of the siman, and the missing gloss
2. The Taz emends, the Shach doubts, the Bach reverses: three ways of reading one silence
3. What a man cannot do: forbid himself by a נדר
4. לך against ממך — one letter, two regimes
5. The Shach's צ״ע on the Mehaber at seif ג
6. כנדרי רשעים: why an observation of custom becomes a rule of law
7. Seif ה and the pivot of the block: when the utterance belongs to the register of the oath
8. Recapitulation of the positions

1. ידים מוכיחות — the central ma'hloket of the siman

The Shulchan Arukh sets the condition in its very first line: a יד holds only if it is מוכחת קצת. Then, a few lines later, it treats the case where the man did not finish his sentence — and gives it an effect. The Tur treats the same case and gives it the opposite effect:

« ידות נדרים כנדרים והוא שיהיו מוכיחות קצת על הנדר » (טור יו״ד ר״ו)
« אבל אם אומר שאני אוכל לך לבד או שאומר מודרני ממך או מופרשני ממך או מרוחקני ממך ולא סיים דבריו שאיני אוכל לך אינו כלום » (טור יו״ד ר״ו)

The Mehaber here follows the Rambam, who gives each unfinished formulation the effect of its root:

The ma'hloket, in two lines. (א) The Rambam, followed by the Mehaber: “מודרני ממך” without a sequel is a יד — and the sense of the root says what it applies to (speaking, trading, four cubits). (ב) The Rosh, the Tur and the Ran: so long as the sentence is unfinished, the utterance may mean this or that — it is therefore not מוכחת, and it is no vow at all. The Taz (ס״ק א) gives exactly this reason.
« וטעמו דכל שאמר מודרני ממך בלא סיום יש להסתפק אם לדבר עמו קאמר אם לאיסור הנאה וכיון שאין מוכיח לא הוי יד » (ט״ז יו״ד ר״ו ס״ק א)
חקירה. What exactly does מוכיחות mean? (א) That the utterance designates a determinate thing — in which case “מודרני ממך” fails, for one does not know which prohibition he means (Taz). (ב) That the utterance shows a vow was made, without needing to know which — in which case “מודרני ממך” succeeds, and its object is determined by the sense of the word (Rambam, Mehaber). The first reading demands a proof of the content; the second, a proof of the act.

2. The Taz emends, the Shach doubts, the Bach reverses

Here is one of the most instructive passages in the corpus, because three Acharonim do three different things with one and the same silence: the Rama did not report the Rosh's view at seif א, yet he refers back to it at seif ג by writing “וכבר נתבאר” — and it has already been explained. Explained where?

(א) The Taz: a text is missing, and here it is

« נראה שיש כאן חסרון וכן צ״ל הג״ה וי״א דכל שלא סיים שאיני אוכל או שאני אוכל לאו כלום הוא והיינו דעת הרא״ש בטור » (ט״ז יו״ד ר״ו ס״ק א)

The Taz does not merely note the absence: he writes the missing gloss, word for word, and concludes that his emendation at last makes the reference at seif ג intelligible. It is a textual conjecture, avowed as such.

(ב) The Shach: the same hypothesis, but with a צ״ע

« צ״ע על הרב שלא הביא דעת הרא״ש וטור והר״ן דס״ל דכל שלא סיים דבריו אינו נדר כלל כיון דמשמע הכי ומשמע הכי לא הוי ידים מוכיחות » (ש״ך יו״ד ר״ו ס״ק ג)
« ונראה דחסר כאן הגהת הרב » (ש״ך יו״ד ר״ו ס״ק ג)

The Shach reaches the same conclusion — a gloss is missing — but formulates it as an observation, not as a restoration. And he adds a remark worth noting: on the Mehaber there is no difficulty, for “it is his way to tread the path of the Rambam”; the difficulty is on the Rama, whose role is precisely to report the other view.

(ג) The Bach: the silence means the opposite

« והב״ח מחמיר ביותר דידים שאינן מוכיחות הויין ידים והלכך אפילו לא סיים דבריו אסור אפילו לאכול עמו ואין זה עיקר בש״ס ופוסקים » (ש״ך יו״ד ר״ו ס״ק ג)
Three readings of a silence. The Taz: the text is corrupt, and here is what it carried. The Shach: the text is probably defective, but I do not restore it — I flag it. The Bach: the text is intact, and the silence means that the Rama holds the view opposite to the Rosh's — more stringent still: even ידים שאינן מוכיחות are ידים, and even unfinished the utterance forbids even eating with him. The Shach replies that this is not the principal view in the Talmud or among the decisors.
נפקא מינה, and a very concrete one. A man says “מודרני ממך” and stops. Rosh/Tur/Ran (and Taz): nothing at all. Rambam/Mehaber: he may no longer speak with him. Bach: he may not even eat with him. Three different conducts for three words. The Shach, at ס״ק ו, concludes for halakha: there is no room to be lenient.
« ונראה דלענין הלכה אין להקל מטעם שכתבתי » (ש״ך יו״ד ר״ו ס״ק ו)

3. What a man cannot do: forbid himself by a נדר

The Shach's ס״ק ב is the longest entry in the siman, and from it one may extract a rule that governs everything else. It bears not on the length of the sentence but on its direction:

« ואם אמר שאיני אוכל אפילו אמר מודרני ממך או שאר הלשונות אינו כלום דאין לך יד לנדר אלא דוקא כשאוסר החפץ בנדר » (ש״ך יו״ד ר״ו ס״ק ב)
« דכל זמן שאוסר עצמו על החפץ לא הוי יד לנדרים » (ש״ך יו״ד ר״ו ס״ק ב)
יסוד. A יד is the handle of a נדר; it can therefore exist only where a נדר could exist. But a נדר forbids the thing to the man. It follows that any formulation running the other way — one that forbids the man with respect to the thing — cannot be a יד, whatever its length. The Shach shows it to the extreme: even a complete נדר, if said in that direction (“הרי עלי שלא אוכל ככר זה כקרבן”), is nothing.

From this he draws a criticism of the Rama's gloss — and a sharp one. The Rama had written that “even if he said שאני אוכל לך” it is forbidden, as though this were a chidush. The Shach replies that it is the reverse:

« וגם להורות שמ״ש הרב וי״א דאפילו אמר שאני אוכל לך כו׳ אינו מדוקדק כלל דאדרבה טפי אסור לכ״ע » (ש״ך יו״ד ר״ו ס״ק ב)
Why the reverse? Because שאני אוכל לך — “that I shall eat of what is yours” — posits the object as what is aimed at: let what I eat at your house be קונם. Whereas שאיני אוכל לך — “that I shall not eat” — puts the subject at the centre. The first therefore runs in the direction of the נדר, the second in that of the שבועה. The Shach relies on the Tosafot at the beginning of Nedarim, who set out the same hierarchy.

4. לך against ממך — one letter, two regimes

« משמע כלומר נכסי אסורים לך ומשמע משלך מה שאין כן בממך » (ט״ז יו״ד ר״ו ס״ק ב)
The mechanism, unfolded. “מודר אני ממך” designates an origin: what comes from you is forbidden to me. The prohibition has one direction, and the fellow is untouched. “מודר אני לך” designates an addressee: the Ran, cited by the Taz, explains that the formulation is understood in two senses at once — my goods are forbidden to you, and also what is yours [is forbidden to me]. It is this double reading that makes both men forbidden to each other.

The Shach, at ס״ק ד, draws from this seif the consequence that separates the Tur from the Mehaber — and it refers back exactly to the ma'hloket of seif א:

« ואם לא הזכיר לא אכילה ולא הנאה לא הוי נדר כלל עכ״ל טור והוא לשיטתו דלעיל אבל להרמב״ם והמחבר הוי נדר שאינו רשאי לדבר עמו » (ש״ך יו״ד ר״ו ס״ק ד)
נפקא מינה. A man says “מודר אני ממך” without mentioning food or benefit. For the Tur (consistent with his position at seif א): nothing at all. For the Rambam and the Mehaber: it is a vow, and he may no longer speak with him — exactly the effect given at seif א to the unfinished formulation. The Shach notes that the Mehaber deliberately omitted the end of the Tur's words: the two texts do not contradict each other by accident.

5. The Shach's צ״ע on the Mehaber at seif ג

Seif ג sets out three words. The gemara had already settled two of them:

« אָמַר רַב פָּפָּא: בִּ״נְדִינָא מִינָּךְ״ — דְּכוּלֵּי עָלְמָא לָא פְּלִיגִי דְּאָסוּר. ״מְשַׁמַּתְנָא מִינָּךְ״ — לְכוּלֵּי עָלְמָא שְׁרֵי » (נדרים ז׳ ע״א)

The Rambam, for his part, writes this:

« אָמַר לוֹ מְנֻדֶּה אֲנִי לְךָ שֶׁלֹּא אֹכַל לְךָ אֵינוֹ אוֹכֵל לוֹ וְאִם אָכַל אֵינוֹ לוֹקֶה. אָמַר לוֹ נָדִינָא מִמְּךָ הֲרֵי זֶה אָסוּר לֵהָנוֹת » (רמב״ם הלכות נדרים פרק א׳ הלכה כ״ד)
קושיא of the Shach. The Mehaber, at seif ג, writes two things that do not hold together. If he thinks מנודה אני לך is not a formulation of vow — which explains why, finished, it permits everything — then all the more so, unfinished, it should permit everything: why does it forbid the four cubits? And if he thinks it is a formulation of vow, then even finished it should forbid eating with him. The Shach sums up: the Mehaber grants the deed to both litigants.
« דהמחבר מזכה שטרא לבי תרי דבאומר מנודה אני לך שאני אוכל לך פסק דמותר בכל » (ש״ך יו״ד ר״ו ס״ק ה)
« ואי ס״ל להמחבר דמנודה אני לך לשון נדר הוא א״כ בסיים דבריו שאני אוכל לך נמי אסור לאכול עמו » (ש״ך יו״ד ר״ו ס״ק ה)

The Shach then examines several paths — the Beit Yosef's distinction between מנודה and משמתינא, the Raavad's reading which equalises them, Rabbeinu Yeruham's formulation — and he concludes that one may answer, but with difficulty, and on a וצ״ע. The Taz had decided otherwise, in one line: מנודה is not a formulation of vow at all, unlike נדירנא.

« דזה אינו לשון נדר לגמרי מה שאין כן בנדירנא שהוא לשון נדר » (ט״ז יו״ד ר״ו ס״ק ג)

6. כנדרי רשעים: from an observation of custom to a rule of law

Seif ד is built on a premise that is not juridical: the wicked are wont to vow, the upright to give. The Taz sets it out, then gives its underlying reason:

The Rambam gives the same premise in a still more moral formulation:

« אָמַר כְּנִדְרֵי כְּשֵׁרִים לֹא נִתְחַיֵּב בִּכְלוּם שֶׁאֵין הַכְּשֵׁרִים נוֹדְרִים בְּדֶרֶךְ אִסּוּר וָכַעַס » (רמב״ם הלכות נדרים פרק א׳ הלכה כ״ו)
יסוד. An התפסה requires a real anchor (siman 204). “כנדרי רשעים” has one: the vows of the רשעים exist, and the Shach (ס״ק ז) goes so far as to write that it is like saying “this loaf is upon me like a קרבן”, for an ordinary רשע is liable to a קרבן. “כנדרי כשרים” has none: the class aimed at is empty. This is therefore no moral severity toward the רשעים; it is a question of whether the object of reference exists.
« דהוי כאומר ככר זה עלי כקרבן דסתם רשע חייב בקרבן » (ש״ך יו״ד ר״ו ס״ק ז)
And here is the finest point of the seif. What happens if the man says “כנדרי כשרים this loaf is upon me קונם”? He has pronounced explicitly the strongest word in the language of vows. And yet it does not bind. Why? חקירה: (א) the first words explain the קונם — they say what sort of קונם is meant, and it turns out that sort does not exist; (ב) or they revoke the קונם — the man first said he did not mean to vow, and what follows can no longer do anything. The Shach (ס״ק ח) writes בטל את הקונם, the Taz (ס״ק ה) מבטל — both use the verb of the second reading.
« דמה שתלה בכשרים בטל את הקונם דכשרים לא נדרי כלל אלא נודבין » (ש״ך יו״ד ר״ו ס״ק ח)
« לפי שמה שאמר תחילה כנדרי כשרים מבטל מה שאמר אחר כך לשון קונם » (ט״ז יו״ד ר״ו ס״ק ה)

7. Seif ה and the pivot of the block 204-206

Three texts say the same thing in the same terms — the Shach, the Taz, and behind them the Rambam. This is the moment when the whole tractate sums itself up in one sentence:

The pivot, stated one last time. The נדר forbids the object to the man; the שבועה forbids the man with respect to the object. To say “I vow that I shall not eat with you” is therefore to use the grammar of an oath in an act of vowing. The result: it is not a נדר (wrong direction), and it is not a שבועה either (he did not swear). The Shach says it in so many words, in the Rosh's name — and that is why the siman concludes that it is not even a יד.
« דוקא באומר מודרני ממך אסר על עצמו הנאת חבירו ואע״פ שלא התפיס בדבר הנדור יד מיהא הוי » (ש״ך יו״ד ר״ו ס״ק ט)
קושיא. If this is nothing at all, why does the Shulchan Arukh require a התרה? One does not release what does not exist.
תירוץ. The Shulchan Arukh gives the reason itself, and it is not of the same order as the rest of the seif: כיון דהאידנא מרגלא בפומייהו דאינשי למינדר בהאי לישנא — since nowadays it is common in people's mouths to vow in this formulation. It is therefore not the utterance that is released, it is usage that is protected: were this formulation let through, people would learn that a formulation of vow can be without effect. This is exactly the motive of siman 205 — שלא ינהגו קלות ראש בנדרים.

Two reservations close the siman, and they run in opposite directions. The first widens: there is one who says that a נדר expressed in a formulation of שבועה, and the reverse, are effective under the head of ידות. The Pitchei Teshuva at once restricts it, in the name of the Noda BiYehuda:

« שכתב דפלוגתא זו דוקא אם היה בדבר שיש בו ממש כמו לא אוכל שהמאכל יש בו ממש » (פתחי תשובה יו״ד ר״ו ס״ק ב)
« שומעין להקל כדעת הרא״ש ואפי׳ להרמב״ן עכ״פ במקום קצת מצוה מתירין אפי׳ ע״ד רבים » (פתחי תשובה יו״ד ר״ו ס״ק ב)

The second reservation runs the other way, and it is the siman's last word: regarding נזירות expressed in a formulation of oath, all agree that it binds. The Shach (ס״ק י) gives the reason, and it closes the circle of the block:

« דנזירות לכ״ע אם הוציאו בלשון שבועה חל דעיקרו לשון שבועה הוא דהא אתפוסי גברא הוא כמו שבועה » (ש״ך יו״ד ר״ו ס״ק י)
Why נזירות is an exception. Because it is not, at bottom, of the register of the נדר: one who says “הריני נזיר” binds his own person, exactly as one who says “הריני נשבע”. Its foundation is therefore already a formulation of oath. To use it in a formulation of שבועה is not a grammatical error — it is its own grammar. The Shach proves it from the beginning of Nedarim, in the very place where the gemara opposes מיתסר חפצא and קאסר נפשיה. He also notes that this point does not appear in the Beit Yosef, and that the Mabit himself contests it — we report this without deciding.

8. Recapitulation of the positions

The questionPositionWhoConsequence
“מודרני ממך” without a sequelNo vow at all — these are not ידים מוכיחותRosh, Tur, Ran; the Taz restores them in the gloss (ס״ק א)No prohibition

“מודר אני ממך” mentioning neither אכילה nor הנאהIt is a vow: he may no longer speak with himRambam, Mehaber, Bach, Prisha (Shach ס״ק ד)Forbidden to speak
The Mehaber's seif גIncoherent position — צ״עShach ס״ק הOne does not lean on it to permit
The Mehaber's seif גמנודה is not a formulation of vow, נדירנא isTaz ס״ק גThe distinction is of vocabulary
“כנדרי כשרים … קונם”The first words nullify the קונםShach ס״ק ח, Taz ס״ק הNothing took hold
“הנודר שלא אוכל”Not even a יד — it is a formulation of שבועהShach ס״ק ט, Taz ס״ק ו, RoshBut a התרה is required
A נדר in a formulation of שבועה, and the reverseEffective under the head of ידותthe “יש מי שאומר” of seif הBinds
The sameOnly for a דבר שיש בו ממשNoda BiYehuda, in the Pitchei Teshuva ס״ק בOtherwise one listens to the lenient view
נזירות in a formulation of שבועהBinds, by all opinionsRadbaz, in the Shach ס״ק י — and the Mabit contestsThe Shach adheres to it
Siman 206 closes the block by returning to its beginning. 204 said: the נדר forbids the thing. 205 said: and it attaches only to what a word could have produced. 206 says: and it is enough to have begun saying it, provided the direction is right. That is why the siman's longest formulation — “I vow that I shall not eat with you” — does not bind, while the three words “מודרני ממך” may bind. It is not the quantity of speech that counts, but its orientation.
