The preceding siman fixed the hours of Mincha; this one asks what becomes of the man who wants them both. Two seifim, one distinction — what is owed and what is offered — and a question that never leaves the page: what makes a prayer acceptable? Hebrew text, English translation and explanation of the ב׳ seifim, with a section of practical cases.

The siman rests on one plain distinction and one severe warning. The distinction: of the two Minchas a man may pray, only one is owed — the one that falls in Mincha’s proper time; the other is no more than an offering. The warning: that offering is brought only on condition that one hold his mind from one end of the prayer to the other, failing which it joins the sacrifices of which the prophet says they are too many. The Rama adds the threshold of Mincha — the אשרי that carries the Kaddish and is therefore said only with ten, and the פרשת התמיד that precedes it. Then seif 2 turns to the man who prayed nothing at all, and gives him back his Mincha in the evening. We study here at the level of principle; for personal practice, one follows the ruling of one’s Rav.

A. חובה ורשות — which of the two Minchas is owed
מִנְחָה גְּדוֹלָה וּמִנְחָה קְטַנָּה — the great Mincha and the small Mincha. These are not two prayers but two windows for one: the first opens at six and a half hours of the day, the second at nine and a half. The Rambam gives their limits:
« הָא לָמַדְתָּ שֶׁזְּמַן מִנְחָה גְּדוֹלָה מִשֵּׁשׁ שָׁעוֹת וּמֶחֱצָה עַד תֵּשַׁע שָׁעוֹת וּמֶחֱצָה. וּזְמַן מִנְחָה קְטַנָּה מִתֵּשַׁע שָׁעוֹת וּמֶחֱצָה עַד שֶׁיִּשָּׁאֵר מִן הַיּוֹם שָׁעָה וּרְבִיעַ » (רמב״ם הלכות תפלה פרק ג הלכה ד)

Seif 1: one who wishes to pray Mincha Gedola and Mincha Ketana — it is not fitting for him to pray as a voluntary prayer any but the great one; and if he prays the great one as the obligation, he shall pray the small one only as voluntary. But it is not fitting to pray a voluntary prayer unless he recognizes in himself that he is scrupulous, diligent and confident in his mind to hold his intention in his prayer from beginning to end without his mind wandering; but if he does not hold his intention well in it, we apply to him: “why do I need the multitude of your sacrifices?”. Gloss of the Rama: one does not say the Ashrei that precedes Mincha except when there is a minyan in the synagogue, so that they may say over it the Kaddish before the Mincha prayer. Some have written that the custom is to say Parashat HaTamid before the Ashrei of the Mincha prayer, corresponding to the tamid of the afternoon — and it is a fine custom.
Only one of the two is owed. The Mechaber opens the siman with the rule:
« הרוצה להתפלל מנחה גדולה ומנחה קטנה אין ראוי לו להתפלל רשות אלא הגדולה » (שו״ע או״ח רל״ד:א); and he adds the case of one who has already decided otherwise:
« ואם יתפלל הגדולה חובה לא יתפלל הקטנה כי אם רשות » (שו״ע או״ח רל״ד:א). summary: it is not quantity that matters but the label — one of the two bears the name of obligation, the other of offering, and one must know which
Where this rule comes from. The Mechaber follows the Rambam almost word for word, and the Rambam gives the reason:
« נָהֲגוּ אֲנָשִׁים הַרְבֵּה לְהִתְפַּלֵּל גְּדוֹלָה וּקְטַנָּה וְהָאַחַת רְשׁוּת. וְהוֹרוּ מִקְצָת הַגְּאוֹנִים שֶׁאֵין רָאוּי לְהִתְפַּלֵּל רְשׁוּת אֶלָּא הַגְּדוֹלָה. וְכֵן הַדִּין נוֹתֵן מִפְּנֵי שֶׁהִיא כְּנֶגֶד דָּבָר שֶׁאֵינוֹ תָּדִיר בְּכָל יוֹם. וְאִם הִתְפַּלֵּל הַגְּדוֹלָה חוֹבָה לֹא יִתְפַּלֵּל קְטַנָּה אֶלָּא רְשׁוּת » (רמב״ם הלכות תפלה פרק ג הלכה ג). summary: the offering corresponding to Mincha Gedola is not the daily one, and a prayer set against a less regular korban is the lighter — it is that one that is offered voluntarily
How can the voluntary precede the obligatory? The Mishnah Berurah raises the difficulty and resolves it:
« דאף דלעולם מתפללין החוב מקודם ואח״כ הרשות הכא קודם תשע ומחצה לא הגיע עוד עיקר זמן מנחה שעיקר זמנה לכתחלה הוא מט׳ ומחצה ולמעלה שהיה זמן הקרבת התמיד בכל יום » (משנה ברורה, מ״ב רל״ד:ב); the Aruch HaShulchan puts the same thing while showing how sharp the question is:
« ואין לתמוה איך יקדים הרשות קודם החוב, הא אפילו בתשלומי תפלה שהיא חובה אין להקדימה קודם החיובית » (ערוך השלחן או״ח סימן רל״ד); and he concludes:
« כל שכן שאין להקדים נדבה לחובה, דיש לומר דהכא כיון דעיקר החיוב הוא בזמן מנחה קטנה » (ערוך השלחן או״ח סימן רל״ד). summary: as long as nine and a half hours have not come, the proper time of the obligation is not yet here — so the voluntary is not being placed ahead of it
And if one prayed the first without thinking about it? The Mishnah Berurah settles the ordinary case:
« ובסתמא [שלא כוון בהדיא לשם נדבה] נמי נראה דעולה לשם חובה ויתפלל השניה לשם נדבה אם ירצה » (משנה ברורה, מ״ב רל״ד:ג); and at the outset she recalls what is being discussed:
« מנחה גדולה - הוא משש שעות ומחצה ומנחה קטנה הוא מתשע ומחצה ולמעלה ורוצה להתפלל שניהם אחת לחיוב ואחת לנדבה » (משנה ברורה, מ״ב רל״ד:א). summary: without explicit intent the first prayer discharges the obligation — the second, from then on, can only be an offering
The question that gave rise to this siman. The Beit Yosef reports the query addressed to the Rosh:
« אנשים מהקהל התנדבו להתפלל בכל יום מנחה גדולה עד החג ונסתפקנו בענין מנחה קטנה אם היא חובה כנגד המנחה גדולה או איזה מהם רשות » (בית יוסף או״ח סימן רל״ד); and the Tur gives the answer, which reverses the Rambam’s order:
« ואתם שאתם נוהגין כמותו מסתבר כיון שהגיע שש שעות ומחצה שהוא זמן מנחה הראשונה חובה והשנייה נדבה » (טור או״ח סימן רל״ד) — the Aruch HaShulchan notes the gap without disguising it:
« וזהו שלא כדברי הרמב״ם שפסק שיתפלל הראשונה נדבה » (ערוך השלחן או״ח סימן רל״ד). summary: the Rambam makes the great one the voluntary, the Rosh makes the first one the obligation — and the Mechaber followed the Rambam
B. תפלת נדבה — the prayer one offers in addition
תְּפִלַּת נְדָבָה — a voluntary prayer. The Rambam gives the principle: the three prayers are a floor, not a ceiling, and whatever one adds is of the order of a gift:
« תְּפִלּוֹת אֵלּוּ אֵין פּוֹחֲתִין מֵהֶן אֲבָל מוֹסִיפִין עֲלֵיהֶם. אִם רָצָה אָדָם לְהִתְפַּלֵּל כָּל הַיּוֹם כֻּלּוֹ הָרְשׁוּת בְּיָדוֹ. וְכָל אוֹתָן הַתְּפִלּוֹת שֶׁיּוֹסִיף כְּמוֹ מַקְרִיב נְדָבוֹת. לְפִיכָךְ צָרִיךְ שֶׁיְּחַדֵּשׁ דָּבָר בְּכָל בְּרָכָה וּבְרָכָה מִן הָאֶמְצָעִיּוֹת מֵעֵין הַבְּרָכוֹת » (רמב״ם הלכות תפלה פרק א הלכה ט)
Seif 1 (continued) — תנאי תפלת הרשות
The permission and its condition, in the same sentence. No sooner has the Mechaber admitted the voluntary prayer than he closes it again:
« אבל אין ראוי להתפלל תפלת רשות אא״כ מכיר בעצמו שהוא זהיר וזריז ואמיד בדעתו לכוין בתפלתו מראש ועד סוף בלא היסח הדעת » (שו״ע או״ח רל״ד:א); and he draws the consequence:
« אבל אם אינו מכוין בה יפה קרינן ביה למה לי רוב זבחיכם » (שו״ע או״ח רל״ד:א). summary: three qualities are demanded — vigilance, promptness, and a true estimate of one’s own powers; whoever lacks them brings an offering of which the prophet says it is too much
The same demand, at siman 107. Siman 107 is the proper place of the voluntary prayer, and it says the same:
« הרוצה להתפלל תפלת נדבה צריך שיהא מכיר את עצמו זריז וזהיר ואמוד בדעתו שיוכל לכוין בתפלתו מראש ועד סוף אבל אם אינו יכול לכוין יפה קרינן ביה למה לי רוב זבחיכ׳ והלואי שיוכל לכוין בג׳ תפלו׳ הקבועות ליום » (שו״ע או״ח ק״ז:ד); it adds a second condition there, that of renewal:
« חדוש זה שאמרנו הוא שיחדש איזה דבר בכל ברכה מהאמצעיות מעין הברכות ואם חידש אפי׳ בברכה אחת דיו כדי להודיע שהיא נדבה ולא חובה » (שו״ע או״ח ק״ז:ב). summary: wanting to pray more is not enough; one must have something new to ask, and say it in one of the middle blessings
Are both conditions required together? The Mishnah Berurah raises the question and leaves it open:
« ובריש סימן ק״ז משמע דבעינן ג״כ שיחדש בה דבר ואפשר דהיכא שהוא מכיר בעצמו שיכוין היטב ותפלה טובה היא לא בעינן חידוש אבל מלישנא דטור לא משמע הכי » (משנה ברורה, מ״ב רל״ד:ד); the Tur, for his part, required them together:
« אבל נ״ל שיש לאדם ליזהר שלא יתפלל תפלת נדבה אם לא שיוכל לחדש בה דבר וגם צריך שיהא מכיר עצמו זהיר וזריז ואמיד בדעתו לכוין בתפלתו מראש ועד סוף בלא היסח הדעת » (טור או״ח סימן רל״ד). summary: for the Tur both renewal and concentration are needed; the Mishnah Berurah suggests that a prayer held from end to end might suffice, but concedes that the Tur’s language does not say so
The talmudic root of the debate. Rabbi Yochanan turns it into a wish:
« וְרַבִּי יוֹחָנָן אָמַר: וּלְוַאי שֶׁיִּתְפַּלֵּל אָדָם כׇּל הַיּוֹם כּוּלּוֹ » (ברכות כ״א ע״א); but the same page sets the condition that will become that of siman 107:
« הִתְפַּלֵּל וְנִכְנַס לְבֵית הַכְּנֶסֶת וּמָצָא צִבּוּר שֶׁמִּתְפַּלְּלִין, אִם יָכוֹל לְחַדֵּשׁ בָּהּ דָּבָר — יַחְזוֹר וְיִתְפַּלֵּל, וְאִם לָאו — אַל יַחְזוֹר וְיִתְפַּלֵּל » (ברכות כ״א ע״א). summary: praying all day is a fine thing, but a prayer repeated with nothing new is not an additional prayer — it is the same prayer said again
What the Acharonim say for our own time. The Aruch HaShulchan shuts the door without ceremony:
« ובאמת מימינו לא שמענו זה, והלואי שנעמוד בתפלת חובה. ולכן בזמן הזה חלילה להתפלל תפלת נדבה, וכן יש להורות » (ערוך השלחן או״ח סימן רל״ד); the Tur had already sensed it:
« והלואי שיוכל לכוין בג׳ תפלות שתיקנו חכמים » (טור או״ח סימן רל״ד); and a congregation never had this option at all:
« אין צבור מתפללין תפלת נדבה כלל » (שו״ע או״ח ק״ז:ג). summary: the voluntary prayer was not abolished; it became impracticable — and the Acharonim would rather one spend his strength on the three prayers he owes. For practice, follow your Rav
C. אשרי שקודם מנחה — the psalm, the minyan and the Kaddish
אַשְׁרֵי שֶׁקּוֹדֶם מִנְחָה — the Ashrei before Mincha. The Aruch HaShulchan first gives its reason for being: one does not enter a prayer with nothing said before it —
« כיון שתפלת המנחה אין שום דבר לפניה ואינו מדרך ארץ לבוא ולהתפלל תיכף » (ערוך השלחן או״ח סימן רל״ד)
Seif 1 — הגהת הרמ״א: אשרי במנין
The Ashrei is not there for its own sake. The Rama rules:
« אין לומר אשרי שקודם מנחה אלא כשיש מנין בב״ה כדי שיאמרו עליו הקדיש שלפני תפלת המנחה » (שו״ע או״ח רל״ד:א); the Aruch HaShulchan explains the mechanism:
« ואף על גב דאין קדיש בלא אמירת דבר לפניו, אך הלא בכאן יש דבר לפניה, והיינו אמירת ׳אשרי׳ » (ערוך השלחן או״ח סימן רל״ד); and he draws the practical conclusion:
« ולכן יזהרו לומר ׳אשרי׳ בעשרה, דעל אמירת קדיש צריכין עשרה שיאמרו דבר » (ערוך השלחן או״ח סימן רל״ד). summary: the Kaddish requires that a text have been said before ten men; the Ashrei is that text — without a minyan it has no office left to fill
What is done if the minyan arrives afterwards. The Mishnah Berurah gives the remedy:
« ואם אמרו בלא מנין ואח״כ בא מנין יאמרו מזמור א׳ ואח״כ יאמרו קדיש » (משנה ברורה, מ״ב רל״ד:ה); the Magen Avraham is the source, and he extends the rule to study as well:
« ואם אמר אשרי בלא מנין ואח״כ באו למנין יאמרו מזמור א׳ ואחר כך יאמרו קדיש ונ״ל דה״ה כשלומדים בב״הכ וליכא מנין ואחר כך קוראין י׳ לומר קדיש לא יאות עבדי וק״ו הוא » (מגן אברהם או״ח סימן רל״ד); and the Mishnah Berurah spells out the reason:
« דהא עיקר טעם קדיש על הלימוד הוא משום שנתקדש השם ברבים וא״כ בעינן שיהיו עשרה בבהמ״ד בעת הלימוד » (משנה ברורה, מ״ב רל״ד:ה). summary: the Kaddish sanctifies the Name in public; the text itself must therefore have been said in public, and not merely recited alone before the ten arrived
The Taz disagrees about the reason. He gives a different explanation of the gloss:
« עמ״ש בסי׳ נ״ה ס״ג ע״ז דהטעם משום שלא יפסיק לכתחלה בין אשרי להקדיש אבל אין הטעם דא״ל קדיש על מה שאמר בלא מנין » (ט״ז או״ח סימן רל״ד). summary: for the Taz, what the Rama fears is not a Kaddish without a text, but a break between the Ashrei and the Kaddish that follows it
What the Ashrei must never cost. The Mishnah Berurah sets the limit:
« וטוב ג״כ לומר פטום הקטורת אך כ״ז אם לא יעבור זמן תפלה אבל אם יש חשש שיעבור זמן תפלה אפילו אשרי ידלג ובעו״ה יש אנשים שנכשלין בזה » (משנה ברורה, מ״ב רל״ד:ו); and the Aruch HaShulchan says the same of one who arrives late:
« אך הבא לבית הכנסת והציבור עומדים בתפלה יעמוד בתפלה מיד, כדי להתפלל בציבור » (ערוך השלחן או״ח סימן רל״ד); and of one whom the hour presses:
« ודע דאם אירע סיבה שאיחר עד קרוב להשקיעה, יעמוד בתפלה מיד ולא יאמר לא ׳אשרי׳ ולא פרשת התמיד והקטרת, ואין דוחין העיקר מפני הטפל » (ערוך השלחן או״ח סימן רל״ד). summary: the Ashrei is the threshold of the prayer, not the prayer; one does not lose the Amidah in order not to lose its threshold
D. פרשת התמיד — before the Ashrei, or after?
פָּרָשַׁת הַתָּמִיד — the section of the perpetual offering. This is the second custom cited by the Rama, and the Beit Yosef gives its provenance:
« וכ׳ הרד״א בשם הר״י שמצוה לומר קודם אשרי פרשת את קרבני לחמי וכן נהגו וגם נוהגין לומר גם כן מזמור מה ידידות משכנותיך » (בית יוסף או״ח סימן רל״ד)
Seif 1 — הגהת הרמ״א: פרשת התמיד קודם אשרי
The Rama’s custom. The Rama adopts it and praises it:
« יש שכתבו שנהגו לומר פרשת התמיד קודם אשרי של תפלת המנחה נגד תמיד של בין הערבים ומנהג יפה הוא » (שו״ע או״ח רל״ד:א); the Aruch HaShulchan gives its full reason:
« ויש נוהגים לומר פרשת התמיד וקטרת קודם ׳אשרי׳, ומנהג יפה ונכון הוא, שהקריבו תמיד של בין הערבים וקטרת כמו בשחרית, ולמה לא נשלם פרים שפתינו, ולכן המדקדקים נוהגים לאומרם בכל יום קודם המנחה » (ערוך השלחן או״ח סימן רל״ד). summary: in the Temple, the afternoon had its offering as the morning had its own; so one reads its section before the Amidah, in place of the words that stand for bulls
The Taz and the Magen Avraham want the reverse. The Taz reasons from the order of the Temple service:
« ול״נ שי״ל אחר אשרי כי פ׳ זו היא במקום שחיטתו וזריקתו של התמיד ותפלת י״ח היא במקום הקטרתו על המזבח לשרפו » (ט״ז או״ח סימן רל״ד); the Magen Avraham reports an opinion in the name of the Zohar:
« ומ״ע בתשו׳ סימן י״ד כתב בשם הזוהר לאומרה אחר אשרי » (מגן אברהם או״ח סימן רל״ד). summary: if the section stands for the slaughtering and the sprinkling, and the Amidah for the burning, then the Temple order would require it to come just before the Amidah — that is, after the Ashrei
What custom retained. The Mishnah Berurah records:
« ט״ז ומ״א כתבו לומר אחר אשרי אבל אין המנהג כן » (משנה ברורה, מ״ב רל״ד:ז); the Aruch HaShulchan rules the same way:
« ויש רוצים לומר דפרשת התמיד היא אחר ׳אשרי׳ » (ערוך השלחן או״ח סימן רל״ד); and he removes the premise of the Taz’s reasoning:
« ובאמת ׳אשרי׳ אינה תפלה אלא שבחו יתברך » (ערוך השלחן או״ח סימן רל״ד). summary: the Ashrei is not a prayer but a praise; the argument from the Temple order therefore does not touch it, and custom followed the Rama
E. שכח ולא התפלל מנחה — the evening make-up
תַּשְׁלוּמִין — make-up. The Gemara raised the question and weighed both sides:
« אֲבָל הָכָא תְּפִלָּה בִּמְקוֹם קׇרְבָּן הִיא, וְכֵיוָן דְּעָבַר יוֹמוֹ בָּטַל קׇרְבָּנוֹ. אוֹ דִילְמָא כֵּיוָן דִּצְלוֹתָא רַחֲמֵי הִיא, כׇּל אֵימַת דְּבָעֵי מְצַלֵּי וְאָזֵיל » (ברכות כ״ו ע״א)
Seif 2 — אם שכח ולא התפלל מנחה
אם שכח ולא התפלל מנחה מתפלל ערבית שתים ואומר אשרי קודם תפלה שהיא תשלומין לתפלת המנחה (וע״ל סימן ק״ח):
Seif 2: if one forgot and did not pray Mincha, he prays Arvit twice, and says Ashrei before the prayer that is the make-up for the Mincha prayer (and see above siman 108).
The din of the seif. The Mechaber sets the rule and the custom that goes with it:
« אם שכח ולא התפלל מנחה מתפלל ערבית שתים ואומר אשרי קודם תפלה שהיא תשלומין לתפלת המנחה » (שו״ע או״ח רל״ד:ב); the Gemara had already ruled it:
« טָעָה וְלֹא הִתְפַּלֵּל מִנְחָה — מִתְפַּלֵּל עַרְבִית שְׁתַּיִם, וְאֵין בָּזֶה מִשּׁוּם דְּעָבַר יוֹמוֹ בָּטַל קׇרְבָּנוֹ » (ברכות כ״ו ע״א). summary: the missed Mincha is not lost with the day; it is repaid in the evening, as a second Amidah after that of Arvit
The order is not to be reversed. Siman 108 gives the general rule:
« טעה או נאנס ולא התפלל שחרית מתפלל מנחה שתים הראשונה מנחה והשני׳ לתשלומין ואם היפך לא יצא ידי תפלה שהיא תשלומין וצריך לחזור ולהתפלל אותה » (שו״ע או״ח ק״ח:א); the Aruch HaShulchan applies it to our case:
« אם שכח מלהתפלל מנחה - מתפלל ערבית שתים, הראשונה לחובה והשנייה לתשלומין, ואם היפך - לא יצא » (ערוך השלחן או״ח סימן רל״ד). summary: the first Amidah is that of the evening, obligatory in its hour; only the second is the make-up — reversing the two forfeits the make-up
Why Ashrei is said in the evening. The Beit Yosef reports the opposing opinion:
« כתוב בכתבי מהר״י סימן נ״ט שאם עבר זמן המנחה ורוצה להתפלל ערבית שאין אומר אשרי דהואיל וכבר עבר זמן המנחה א״כ היום כלה והולך לו ולא מצינו תשלומין לאשרי » (בית יוסף או״ח סימן רל״ד); then the one the Mechaber adopted:
« והריב״ש כתב בתשובה שנכון הדבר. לומר אשרי אחר תפלת ערבית קודם תפלה שהיא תשלומין לתפלת המנחה כדי שיהא בזה היכר שהתפלה היא תשלום תפלת המנחה ואין בזה משום עבר יומו כמו שאין כן בתפלה עצמה » (בית יוסף או״ח סימן רל״ד). summary: for the Maharai the day has passed and its Ashrei with it; for the Rivash the Ashrei is there to make visible that this Amidah is a Mincha — and the Mechaber followed him
Forgotten — or omitted on purpose? The seif speaks only of forgetting, and the Tur says why:
« שכח ולא התפלל מנחה מתפלל ערבית שתים הראשונה של ערבית והשניה לתשלומי מנחה ודוקא שכח אבל הזיד ולא התפלל אין לו תשלומין » (טור או״ח סימן רל״ד); but he immediately reports a broader opinion:
« וגאון כתב אפי׳ הזיד אם רוצה להשלים אותה בתפלת ערבית הרשות בידו אלא שאין לו שכר תפלה בזמנה » (טור או״ח סימן רל״ד); the Gemara had made the same distinction:
« אָמַר רַבִּי יִצְחָק אָמַר רַבִּי יוֹחָנָן: הָכָא בְּמַאי עָסְקִינַן — שֶׁבִּטֵּל בְּמֵזִיד » (ברכות כ״ו ע״א); and it had measured what is lost in any case:

Practical cases
Case 1 — I prayed Mincha at half past noon, and I find a minyan at six
Situation: I prayed Mincha as soon as Mincha Gedola opened; in the evening the congregation prays Mincha and I would like to join them.
Conduct: The seif settles precisely this case:
« ואם יתפלל הגדולה חובה לא יתפלל הקטנה כי אם רשות » (שו״ע או״ח רל״ד:א); and the Mishnah Berurah spells out the effect of a prayer said with no particular intent:
« ובסתמא [שלא כוון בהדיא לשם נדבה] נמי נראה דעולה לשם חובה ויתפלל השניה לשם נדבה אם ירצה » (משנה ברורה, מ״ב רל״ד:ג); but the second remains subject to all the conditions of the voluntary:
« אבל אין ראוי להתפלל תפלת רשות אא״כ מכיר בעצמו שהוא זהיר וזריז ואמיד בדעתו לכוין בתפלתו מראש ועד סוף בלא היסח הדעת » (שו״ע או״ח רל״ד:א) — and the Aruch HaShulchan holds them beyond reach today:
« ובאמת מימינו לא שמענו זה, והלואי שנעמוד בתפלת חובה. ולכן בזמן הזה חלילה להתפלל תפלת נדבה, וכן יש להורות » (ערוך השלחן או״ח סימן רל״ד). summary: my first prayer discharged the obligation; joining the minyan would be a voluntary prayer, and the Acharonim do not encourage it — one may answer Kaddish and Kedushah without repeating the Amidah. Case 2 — I pray Mincha alone at home: should I say Ashrei?
Situation: there is no minyan, and I open my siddur at Ashrei out of habit.
Conduct: The Rama rules on the Ashrei before Mincha:
« אין לומר אשרי שקודם מנחה אלא כשיש מנין בב״ה כדי שיאמרו עליו הקדיש שלפני תפלת המנחה » (שו״ע או״ח רל״ד:א); the Aruch HaShulchan explains its link to the Kaddish:
« ולכן יזהרו לומר ׳אשרי׳ בעשרה, דעל אמירת קדיש צריכין עשרה שיאמרו דבר » (ערוך השלחן או״ח סימן רל״ד); and the Mishnah Berurah recalls that the Ashrei never comes before the hour:
« וטוב ג״כ לומר פטום הקטורת אך כ״ז אם לא יעבור זמן תפלה אבל אם יש חשש שיעבור זמן תפלה אפילו אשרי ידלג ובעו״ה יש אנשים שנכשלין בזה » (משנה ברורה, מ״ב רל״ד:ו). summary: the Ashrei before Mincha exists to carry the Kaddish; where there will be no Kaddish it has no function left — and where the hour presses it yields to the Amidah. Case 3 — I forgot Mincha and I arrive at Arvit
Situation: night has fallen and I have not prayed Mincha; I enter the synagogue for Arvit.
Conduct: Seif 2 gives the exact order:
« אם שכח ולא התפלל מנחה מתפלל ערבית שתים ואומר אשרי קודם תפלה שהיא תשלומין לתפלת המנחה » (שו״ע או״ח רל״ד:ב); the Aruch HaShulchan warns that it is not to be reversed:
« אם שכח מלהתפלל מנחה - מתפלל ערבית שתים, הראשונה לחובה והשנייה לתשלומין, ואם היפך - לא יצא » (ערוך השלחן או״ח סימן רל״ד); and the Rivash explains why Ashrei is said before the second:
« והריב״ש כתב בתשובה שנכון הדבר. לומר אשרי אחר תפלת ערבית קודם תפלה שהיא תשלומין לתפלת המנחה כדי שיהא בזה היכר שהתפלה היא תשלום תפלת המנחה ואין בזה משום עבר יומו כמו שאין כן בתפלה עצמה » (בית יוסף או״ח סימן רל״ד). summary: first Arvit in its time, then Ashrei, then the second Amidah as the make-up of Mincha — and one should let a short interval pass between them, as taught in siman 108.
