Siman 237 — סדר תפלת ערבית — settled the evening service. This one leaves prayer for study, and speaks of nothing but the night. We first read the two seifim, then why night outweighs day, what the greater punishment means, how much a man must sleep, the fixed quota and its making up, and the question of the vow, with practical cases.

Two sentences, and a whole regimen of life. The Mechaber writes: « צריך ליזהר בלמוד הלילה יותר מבשל יום והמבטלו עונשו מרובה » (שו״ע או״ח רל״ח:א), and then: « אם יש לו חק קבוע ללמוד כך וכך ליום והיה טרוד ביום ולא השלימו ישלימנו בלילה מיד » (שו״ע או״ח רל״ח:ב). The Tur gives the reason for the first: « הלכך כיון ששעות הלילה נוחין ורצויין ללמוד המבטלן עונשו מרובה » (טור או״ח סימן רל״ח), and the model for the second: « רב אחא בר יעקב יזיף ביממא ופרע בליליא » (טור או״ח סימן רל״ח). summary: this siman fixes no quantity of study; it says which hour is worth the most, and at what hour what has been missed is settled. We study here at the level of principle; for personal conduct, one relies on one's Rav's ruling.

📑 Plan of the study

A. הסעיפים — the two seifim, their translation, and what binds them
B. למוד הלילה — why night demands more care than day
C. והמבטלו עונשו מרובה — the severity, and where it comes from
D. שיעור השינה — the measure of sleep, and the seasons of the year
E. חק קבוע — the fixed quota, and the force of the word מיד
F. בלי נדר — when regularity becomes a vow
1-3. Practical cases — and questions of comprehension

A. הסעיפים — the two seifim and their ruling

קְבִיעוּת עִתִּים לַתּוֹרָה — “fixing times for Torah”. This is no pious recommendation: it is one of the questions a man is asked at his judgment, as the Gemara teaches — « אמר רבא בשעה שמכניסין אדם לדין אומרים לו נשאת ונתת באמונה קבעת עתים לתורה » (שבת ל״א ע״א). The Shulchan Arukh laid down the general rule at siman 155: « אחר שיצא מבית הכנסת ילך לבית המדרש ויקבע עת ללמוד וצריך שאותו עת יהיה קבוע שלא יעבירנו אף אם הוא סבור להרויח הרבה » (שו״ע או״ח קנ״ה:א). Our siman does not repeat that rule: it takes it up for the night alone.

Seif 1 — night comes before day

לקבוע עתים לתורה בלילה. ובו ב סעיפים:
צריך ליזהר בלמוד הלילה יותר מבשל יום והמבטלו עונשו מרובה:
Fixing times for Torah at night. And it contains two seifim: one must take care with the study of the night more than with that of the day, and the one who annuls it, his punishment is great.

Seif 2 — the missed quota is made up at night

אם יש לו חק קבוע ללמוד כך וכך ליום והיה טרוד ביום ולא השלימו ישלימנו בלילה מיד:
If he has a fixed rule to study such and such an amount each day, and he was occupied during the day and did not complete it — let him complete it at night, at once.
Where are we? Siman 237 — « סדר תפלת ערבית » (שו״ע או״ח רל״ז:א) — described the evening service. Here the Mechaber leaves the synagogue: what follows the evening prayer is study. The title says so: « לקבוע עתים לתורה בלילה. ובו ב סעיפים » (שו״ע או״ח רל״ח:א). summary: the siman speaks neither of the content of study nor of its quantity, but of its hour.
What the Tur had already written The Mechaber compresses here a whole passage of the Tur, which addresses the reader in the second person: « ובענין לימוד הלילה יותר ויותר מבשל יום בני הזהר כמו שאמרו חז״ל אין רינה של תורה אלא בלילה שנאמר קומי רוני בלילה » (טור או״ח סימן רל״ח). The Beit Yosef gives its exact source: « ובענין לימוד הלילה יותר ויותר מבשל יום בני הזהר כמו שאמרו חכמים ז״ל אין רינה של תורה אלא בלילה במדרש רבה » (בית יוסף או״ח סימן רל״ח), and then: « על פסוק קווצותיו תלתלים והביאו הרמב״ם בפ״ג מה׳ ת״ת » (בית יוסף או״ח סימן רל״ח). summary: the phrase « אין רינה של תורה אלא בלילה » (טור או״ח סימן רל״ח) — “there is no song of Torah but at night” — is a midrash on the Song of Songs, which the Rambam had already cited.
The link between the two seifim The first states the worth of the hour; the second draws from it a reckoning. The Tur joins them in a single movement: « כ״ש שאם יארע לאדם מקרה שלא השלים חוקו בלימוד היום שישלימנו מיד בו בלילה ולא ידחהו כלל » (טור או״ח סימן רל״ח). summary: since the hours of the night are the best, it is there that what the day did not pay is paid.

B. למוד הלילה — why night outweighs day

The ruling « צריך ליזהר בלמוד הלילה יותר מבשל יום » (שו״ע או״ח רל״ח:א). summary: the care required is not the same by day and by night — night requires more.
The root in the Gemara Two statements follow one another in tractate Eruvin. The first: « אמר רב יהודה לא איברי ליליא אלא לשינתא » (עירובין ס״ה ע״א). The second: « אמר רבי שמעון בן לקיש לא איברי סיהרא אלא לגירסא » (עירובין ס״ה ע״א). summary: night was created for sleep, but the moon for study aloud — these two sentences stand together, and the whole discussion of the Acharonim turns on how to divide between them.
The Mishnah Berurah's formulation « כדאמרינן לא איברי לילא אלא לגירסא וכיון דלכך נברא הלילה ע״כ צריך ליזהר בה יותר » (משנה ברורה, מ״ב רל״ח:א). summary: since the night was created for this, it is in it that one must redouble one's care.
The promises attached to night study The Mishnah Berurah gathers three. The first: « ואיתא בגמרא כל העוסק בתורה בלילה הקב״ה מושך עליו חוט של חסד ביום » (משנה ברורה, מ״ב רל״ח:א) — that is the statement of Reish Lakish: « אמר ריש לקיש כל העוסק בתורה בלילה הקדוש ברוך הוא מושך עליו חוט של חסד ביום » (חגיגה י״ב ע״ב). The second: « ת״ח העוסקים בתורה בלילה מעלה עליהן הכתוב כאלו עסוקין בעבודה » (משנה ברורה, מ״ב רל״ח:א) — that is the statement of Rabbi Yochanan: « אמר רבי יוחנן אלו תלמידי חכמים העוסקים בתורה בלילה מעלה עליהן הכתוב כאילו עסוקים בעבודה » (מנחות ק״י ע״א). The third: « כל העוסק בתורה בלילה שכינה כנגדו שנאמר קומי רוני בלילה » (משנה ברורה, מ״ב רל״ח:א) — that is the teaching of Rabbi Chiya: « תנא רבי חייא כל העוסק בתורה בלילה שכינה כנגדו שנאמר קומי רוני בלילה » (תמיד ל״ב ע״ב).
The underlying reason, in the Rambam « אף על פי שמצוה ללמד ביום ובלילה אין אדם למד רב חכמתו אלא בלילה » (רמב״ם הלכות תלמוד תורה פרק ג הלכה יג). And from it he draws the conduct: « לפיכך מי שרצה לזכות בכתר התורה יזהר בכל לילותיו ולא יאבד אפלו אחד מהן בשנה ואכילה ושתיה ושיחה וכיוצא בהן אלא בתלמוד תורה ודברי חכמה » (רמב״ם הלכות תלמוד תורה פרק ג הלכה יג). The Mishnah Berurah cites it here: « הרוצה לזכות בכתרה של תורה יזהר בכל לילותיו ולא יאבד אפילו אחת מהן בשינה ואכילה ושתיה ושיחה » (משנה ברורה, מ״ב רל״ח:א). summary: it is not that the day is worthless; it is that the greater part of a man's wisdom comes to him at night.
The same text in Yoreh Deah The Shulchan Arukh restates it in the laws of study: « מי שרוצה לזכות בכתרה של תורה יזהר בכל לילותיו ולא יאבד אפי׳ אחת מהן בשינה באכילה ושתיה ושיחה וכיוצא בהם אלא בדברי חכמה ותלמוד תורה » (שו״ע יו״ד רמ״ו:כ״ג). And the Rema adds: « כי אין אדם לומד רוב חכמתו כי אם בלילה » (רמ״א יו״ד רמ״ו:כ״ג). summary: what siman 238 says in two lines, siman 246 of Yoreh Deah develops.

C. והמבטלו עונשו מרובה — the severity, and where it comes from

The sanction « והמבטלו עונשו מרובה » (שו״ע או״ח רל״ח:א). summary: the same negligence weighs more heavily at night than by day.
The Tur's reasoning « הלכך כיון ששעות הלילה נוחין ורצויין ללמוד המבטלן עונשו מרובה » (טור או״ח סימן רל״ח). summary: the severity does not come from an additional obligation, but from the quality of the hours lost — it is the most convenient hours that were let slip.
The talmudic source The Mishnah Berurah supplies it: « כל בית שאין ד״ת נשמעין בו בלילה אש אוכלתו » (משנה ברורה, מ״ב רל״ח:ב). That is the statement of Rabbi Elazar: « ואמר רבי אלעזר כל בית שאין דברי תורה נשמעים בו בלילה אש אוכלתו » (סנהדרין צ״ב ע״א). The Rambam had already written it: « וכל בית שאין נשמעים בו דברי תורה בלילה אש אוכלתו » (רמב״ם הלכות תלמוד תורה פרק ג הלכה יג).
The promise on the other side The Tur also cites the positive counterpart: « א״ר ירמיה בן אלעזר כל בית שנשמעין בו ד״ת בלילה אינו חרב » (טור או״ח סימן רל״ח), which is the statement of Rabbi Yirmiyah ben Elazar: « ואמר רבי ירמיה בן אלעזר כל בית שנשמעין בו דברי תורה בלילה שוב אינו נחרב » (עירובין י״ח ע״ב). summary: the house in which words of Torah are heard at night is not destroyed; the house in which they are not heard, fire consumes.
The Arukh HaShulchan He restates the two halves of the seif in one stroke: « ולכן צריך ליזהר בלימוד הלילה יותר מביום, והמבטלו עונשו מרובה » (ערוך השלחן רל״ח:ב). The Kaf HaChaim likewise copies the Tur's reasoning: « הלכך כיון ששעות הלילה נוחין ורצויין נלמוד המבטלן עונשו מרובה » (כף החיים רל״ח:א).
What the Vilna Gaon adds in the margin On the words והמבטלו he refers not to a halakhic tractate but to the Mishnah in Avot: « נגד שמא אבד שמה ודלא מוסיף יסף ודלא יליף קטלא חיב » (אבות פרק א משנה יג). summary: “he who does not add, passes away” — the phrase from Avot that the Acharonim apply to night study from the fifteenth of Av onward. The Rema writes it explicitly: « ויש לאדם להתחיל ללמוד בלילה מט״ו באב ואילך ומאן דלא מוסיף יסיף » (רמ״א יו״ד רמ״ו:כ״ג).

D. שיעור השינה — the measure of sleep, and the seasons

The starting point The Magen Avraham opens with the other statement in Eruvin: « אמרינן בפ׳ הדר לא אברי לילה אלא לשינת׳ ופי׳ התוס׳ כגון בלילי תקופת תמוז » (מגן אברהם רל״ח:א). summary: “night was created only for sleep” — and Tosafot restrict its force to the shortest nights of summer.
The Acharonim's mnemonic The Bach gives it: « האחרונים קבלו לומר משכבי עד קומי שכבי ומקומי עד שכבי קומי » (ב״ח או״ח סימן רל״ח). The Magen Avraham sums it up: « והב״ח כתב שהאחרונים קבלו משכבי עד קומי פי׳ משבועות עד ט״ב שכבי ומקומי עד שכבי פי׳ מט״ב עד שבועות קומי פי׳ ללמוד בלילה » (מגן אברהם רל״ח:א). The Ateret Zekenim reports it likewise: « ואחרונים קבלו לומר משכבי עד קומי שכבי ומקומי עד שכבי קומי » (עטרת זקנים או״ח רל״ח).
The key to the wordplay The Machatzit HaShekel spells it out: « פי׳ משבועו׳ ר״ל בשבועות קורין מגלת רות דכתיב בה שכבי עד הבקר ובט״ב קורין מגלת איכה דכתיב בה קומי רני בלילה » (מחצית השקל על אורח חיים רל״ח:א). summary: on Shavuot one reads Ruth, where it says שכבי, “lie down”; on the 9th of Av one reads Eikhah, where it says קומי, “arise” — each festival gives its watchword to the half-year that follows.
A limit in the short nights The Machatzit HaShekel adds: « וכתבו האחרונים דעכ״פ קודם שיישן ילמוד עכ״פ מעט » (מחצית השקל על אורח חיים רל״ח:א). summary: even in summer, when one is not required to rise before dawn, one does not go to bed without having learned a little.
How many hours? The Magen Avraham reports a figure: « ובע״ש כתב מט״ו באב עד ט״ו באייר וי״א דזמן שינה הוא ח׳ שעות וסי׳ ישנתי א״ז יניח לי » (מגן אברהם רל״ח:א). But he refuses to make it a measure: « ונ״ל דהכל לפי מה שהוא אדם וכמ״ש סי׳ רל״א ע״ש » (מגן אברהם רל״ח:א). The Mishnah Berurah follows him: « דלשינת האדם בלילה אין לזה שיעור קבוע אלא תלוי בכל אדם לפי כח בריאותו ועכ״פ לא ישתקע בשינה יותר מדאי » (משנה ברורה, מ״ב רל״ח:ב), and recalls the Mishnah: « שינה לצדיקים רע להן ורע לעולם ופירש״י מפני שאינם עוסקין בתורה » (משנה ברורה, מ״ב רל״ח:ב) — that is the text of Sanhedrin: « יין ושינה לרשעים הנאה להן והנאה לעולם ולצדיקים רע להן ורע לעולם » (סנהדרין ע״א ע״ב).
The Arukh HaShulchan's conclusion He first reports the Maharsha's explanation of the moon: « ולכן בזמן שהוא לילה חשך ממש הוי זמן לישן, וכשהלבנה מאירה הוי זמן לימוד » (ערוך השלחן רל״ח:ב), then he rules: « והאמת הכל לפי חולשתו וגבורתו ולפי מספר ימיו, והכל לשם שמים » (ערוך השלחן רל״ח:ב). summary: there is no scale — there is each man's strength, and the intention.
What the kabbalists add The Kaf HaChaim places the heart of study after midnight: « הלימוד צריך לקבוע מאחר חצות הלילה ואילך » (כף החיים רל״ח:ג), but does not cancel the first part of the night: « דעיקר הלימוד הוא אחר חצות מ״מ גם בתחלת הלילה צריך ללמוד כדי לישן מתוך ד״ת » (כף החיים רל״ח:ד). He even disputes the Bach's seasonal division: « אמנם מדברי הזוה״ק הנז׳ משמע דאין חילוק בין לילות ארוכים ללילות קצרים אלא בכל לילה ולילה חייב ללמוד » (כף החיים רל״ח:ה), and proposes a practice: « וע״כ בלילות הקצרים יש ללמוד מעט בתחלת הלילה כפי יכלתו » (כף החיים רל״ח:ה). He finally notes two customs: « כי טוב הוא לזהר שלא יישן האדם תיכף אחר תפלת ערבית אלא ישהא עד שיעברו ג׳ שעות מן הלילה ואח״כ יישן » (כף החיים רל״ח:ט), and: « ויהרהר בתורה ובמצות עד שישן ואל ירבה באכילה גסה שהוא מרבה שינה » (כף החיים רל״ח:יב). For practice, one follows one's Rav.

E. חק קבוע — the fixed quota, and the force of the word מיד

The ruling « אם יש לו חק קבוע ללמוד כך וכך ליום והיה טרוד ביום ולא השלימו ישלימנו בלילה מיד » (שו״ע או״ח רל״ח:ב). summary: this is not a general obligation to study at night, but a precise debt — that of a man who had fixed himself a measure and did not reach it.
The talmudic model The Tur names it: « רב אחא בר יעקב יזיף ביממא ופרע בליליא » (טור או״ח סימן רל״ח), and explains: « פירוש היה לו חק קבוע ללמוד כך וכך ליום ופעמים שהיה טרוד ביום ולא היה יכול להשלימו והיה משלימו מיד בלילה » (טור או״ח סימן רל״ח). In the Gemara the wording is shorter: « אמר רב נחמן בר יצחק אנן פועלי דיממי אנן רב אחא בר יעקב יזיף ופרע » (עירובין ס״ה ע״א). summary: Rav Acha bar Yaakov borrowed from the day and repaid at night — the image is that of a loan.
The general rule, at siman 155 The Mishnah Berurah already writes our very ruling there: « ואם אירע לו אונס שלא היה יכול להשלים הקביעות שלו ביום יהיה עליו כמו חוב וישלימנו בלילה » (משנה ברורה, מ״ב קנ״ה:ד), and cites the same passage: « רב אחא בר יעקב יזיף ביממא ופרע בלילא » (משנה ברורה, מ״ב קנ״ה:ד).
What מיד means — first reading The Mishnah Berurah: « כלומר אפילו בלילות הקצרים מחוייב להיות ניעור בלילה כדי להשלים חוקו ולא יאחר זה עד יום מחר כי יום של אחריו מחוייב בפני עצמו ונמצא דיום זה לא השלים חוקו והוי מעוות לא יוכל לתקון » (משנה ברורה, מ״ב רל״ח:ד). summary: “at once” means “in that very night”, and not the next day — for tomorrow already carries its own obligation, and what has been lost cannot be repaired.
What מיד means — second reading The Arukh HaShulchan rejects too literal a reading: « אין הכוונה מיד שתכנס הלילה, דמנא לן לומר כן » (ערוך השלחן רל״ח:ג), and concludes: « אלא הכוונה שישלים מיד בלילה ולא יניח למחר, וכן משמע בטור ע״ש » (ערוך השלחן רל״ח:ג). summary: “at once” does not mean from nightfall, but before the night is out.
The Kaf HaChaim He takes up the first reading: « ואפילו בלילות הקצרים מחויב להיות ניעור בלילה כדי להשלים חוקו » (כף החיים רל״ח:ז), and: « ואם לא השלים בלילה מעוות לא יוכל לתקון כי ביום שלאחריו מחיוב בפ״ע » (כף החיים רל״ח:ז). Then he proposes an underlying reason: « ונראה לי הטעם משום דהתורה מכפרת כמו הקרבנות » (כף החיים רל״ח:ח), and: « ובקרבנות הלילה משלים ליום שלפניו וע״כ גם בעסק התורה הלילה משלים ליום שלפניו » (כף החיים רל״ח:ח). summary: the night completes the day before it, as the evening offerings completed their day in the Temple.

F. בלי נדר — when regularity becomes a vow

The Magen Avraham's warning On the word ישלימנו he writes: « דהוי נדר ולכן יתנה בתחלה שלא יהיה עליו נדר » (מגן אברהם רל״ח:א). summary: what one has fixed for oneself is not merely a good habit — it binds like a vow.
The source in the Gemara The Mishnah Berurah supplies it: « האומר אשנה פרק זה נדר גדול נדר לאלהי ישראל » (משנה ברורה, מ״ב רל״ח:ה). That is the statement of Rav Gidel in the name of Rav: « ואמר רב גידל אמר רב האומר אשכים ואשנה פרק זה אשנה מסכתא זו נדר גדול נדר לאלהי ישראל » (נדרים ח׳ ע״א).
The rule in Yoreh Deah The Mishnah Berurah reports it: « דאם נהג לעשות דבר טוב אם היה דעתו לנהוג כן לעולם הוי נדר וטוב שיתנה בתחלה שלא יהיה עליו דבר זה בנדר פן יזדמן איזה פעם שלא יוכל להשלים » (משנה ברורה, מ״ב רל״ח:ה). The Machatzit HaShekel details it: « דאם נהג לעשות דבר טוב אפי׳ פעם א׳ אם היה דעתו לנהוג כן לעולם הוי נדר וצריך התרה ויפתח בחרט׳ שקבלו בשם נדר » (מחצית השקל על אורח חיים רל״ח:א), and gives the remedy: « דטוב להתנות כן לכתחלה שאין דעתו לנהוג כן לעולם כ״א כל זמן שירצה » (מחצית השקל על אורח חיים רל״ח:א).
The Arukh HaShulchan « והנוהג לעשות דבר טוב ודעתו לעשות כן תמיד, הוי כנדר » (ערוך השלחן רל״ח:ג). summary: hence the widespread custom of adding בלי נדר whenever one takes on a new fixed practice. For practice, one follows one's Rav.

Practical cases

Case 1 — A working day that runs over

Situation: a man has undertaken to study a page a day. Today work kept him until evening and he managed nothing. Must he make it up, and when?
Conduct: This is exactly the second seif: « אם יש לו חק קבוע ללמוד כך וכך ליום והיה טרוד ביום ולא השלימו ישלימנו בלילה מיד » (שו״ע או״ח רל״ח:ב). The Mishnah Berurah defines the urgency: « כלומר אפילו בלילות הקצרים מחוייב להיות ניעור בלילה כדי להשלים חוקו ולא יאחר זה עד יום מחר כי יום של אחריו מחוייב בפני עצמו ונמצא דיום זה לא השלים חוקו והוי מעוות לא יוכל לתקון » (משנה ברורה, מ״ב רל״ח:ד). The Arukh HaShulchan, however, does not require beginning at nightfall: « אלא הכוונה שישלים מיד בלילה ולא יניח למחר, וכן משמע בטור ע״ש » (ערוך השלחן רל״ח:ג). For practice, one follows one's Rav.

Case 2 — The short nights of summer

Situation: it is the month of Tammuz; the night is very short and one rises early for work. Must one nevertheless rise before dawn to study?
Conduct: The Acharonim have a rule of season. The Magen Avraham: « והב״ח כתב שהאחרונים קבלו משכבי עד קומי פי׳ משבועות עד ט״ב שכבי ומקומי עד שכבי פי׳ מט״ב עד שבועות קומי פי׳ ללמוד בלילה » (מגן אברהם רל״ח:א). But the Machatzit HaShekel does not leave the night empty: « וכתבו האחרונים דעכ״פ קודם שיישן ילמוד עכ״פ מעט » (מחצית השקל על אורח חיים רל״ח:א). And the Kaf HaChaim disputes the division: « אמנם מדברי הזוה״ק הנז׳ משמע דאין חילוק בין לילות ארוכים ללילות קצרים אלא בכל לילה ולילה חייב ללמוד » (כף החיים רל״ח:ה). For practice, one follows one's Rav.

Case 3 — A resolution taken one night of Selichot

Situation: someone decides to study one mishnah every evening before sleeping. He keeps it for three months, then a night of travel prevents him. Has he transgressed a vow?
Conduct: The question is a real one. The Magen Avraham warns: « דהוי נדר ולכן יתנה בתחלה שלא יהיה עליו נדר » (מגן אברהם רל״ח:א). The Machatzit HaShekel notes that even a single time may suffice: « דאם נהג לעשות דבר טוב אפי׳ פעם א׳ אם היה דעתו לנהוג כן לעולם הוי נדר וצריך התרה ויפתח בחרט׳ שקבלו בשם נדר » (מחצית השקל על אורח חיים רל״ח:א). That is why one takes on any new resolution saying בלי נדר. For practice, one follows one's Rav.

Questions of comprehension

Check your understanding:
  1. What are the two rulings of this siman, and what binds them together?
  2. Two statements follow one another in tractate Eruvin — one about sleep, one about study. How do the Acharonim reconcile them?
  3. Where does the severity of והמבטלו עונשו מרובה come from: from a new obligation, or from something else?
  4. What does מיד mean in the second seif? Give both readings and name their authors.
  5. Why is one advised to say בלי נדר when fixing a rule of study for oneself?
