📜 The text of the Shulchan Arukh — 9 se‘ifim (extracts)
1. Opening of the sugya — Shabbat 18b and roasting
The basic division between siman 253 and siman 254. Siman 253 dealt with cooking in a pot: indirect heat, carried by a liquid. Here we deal with roasting: direct heat, with no liquid in between. Roasting is quicker, and the heat of the coals enters the meat directly. Hence concerns that did not arise with a pot.
2. Kid and fowl against ox and goat — the root of the distinction
Chakira on the distinction. Why are kid and fowl permitted where ox and goat are forbidden?
- First branch — objective, technical: tender meat (kid, fowl) cooks fast, and stoking would char it; tough meat (ox) needs time, and stoking would help it. The distinction lies in the nature of the meat itself. This is the reason the Shulchan Arukh states outright — שאם יחתה בגחלים יתחרך.
- Second branch — subjective, through the turning away of attention: one who leaves a kid by the fire takes no further interest in how fast it cooks, because he knows it will be done; one who leaves an ox does take an interest, because the ox will not be done. The distinction then lies in the state of mind of the one who set it to cook — what the Rishonim call הסח דעת.
« ברחא - איל גדול לא קשיא ליה זיקא ואתי לגלויי פי התנור ליטול כיסויו לחתות » (רש״י שבת י״ח ע״ב ד״ה ברחא)This is the gemara’s own reason, which states the general rule from which the distinction follows.
« מִפְּנֵי שֶׁכְּבָר הִסִּיחַ דַּעְתּוֹ מִמֶּנּוּ וְאֵינוֹ בָּא לַחְתּוֹת בָּגֶחָלִים » (רמב״ם הלכות שבת פ״ג ה״ח)The Taz reads the structure of the Shulchan Arukh as the Rambam’s, following the Maggid Mishneh, and notes that the Tur does not divide the cases the same way.
Nafka minot.
- A large kid, covered: on the first branch it stays permitted, since the nature of the meat decides. On the second the question reopens: does the one who set it to cook truly turn his attention away?
- Tender meat, but whole and not cut up: the Shulchan Arukh requires, for kid and fowl, that they be מנותחים לאברים. The Rama, in the name of the Hagahot Mordekhai, takes a broad definition of a whole animal — which pulls toward the first branch.
3. Chakira on טוח בטיט — a sign or a reality
Chakira. What exactly drives the leniency of “טוח בטיט”, an oven whose mouth is sealed with clay?
- First branch — a reality: opening a sealed oven really does cool the oven and spoil the roast. There is therefore, in fact, no wish to stoke.
- Second branch — a sign: sealing is an act of closure; the man who seals declares thereby that he is finished. The turning away of attention is born of that act, not of its consequences.
« שאם בא לפתוח התנור ולחתות תכנס הרוח ויצטנן התנור ויתקשה הבשר ויפסיד » (שו״ע או״ח רנ״ד:א)The Taz takes up that same driver and measures it: the clay helps because cold air is harmful, even to ox meat, once the oven cools.
« ובטיט מועיל משום דרוח קשה אפי׳ לשור כיון שהתנור מצטנן » (ט״ז או״ח רנ״ד ס״ק א)The Magen Avraham draws the consequence, and it is the consequence that makes this branch a demanding reading: where there is nothing to harden, the sealing no longer helps.
« שריק - פי התנור בטיט סביב כיסוי אינו מוכן לחתות » (רש״י שבת י״ח ע״ב ד״ה שריק)The Magen Avraham, explaining the second view the Rama brings, says the same without passing through damage: even for a pot — where nothing hardens — all is permitted, since the man is not disposed to stoke, the oven being closed.
What the chakira leaves open. Each reading has its support in the commentaries on this very siman: Magen Avraham ס״ק ג and ס״ק י״ט measure the sealing by its real effect, his ס״ק ה measures it by the disposition of the one who seals. The question is not decided here, and it matters: it governs what one will say of a modern oven, where sealing spoils nothing. The Rama, for his part, closes se‘if 1 by stating which practice was adopted.
4. Se‘if 2 — the roast set on the coals: the kid’s leniency falls away
Kashya. Why does the kid’s leniency fall away on the coals, if that leniency rested on an objective property of the meat — the first branch of §2?
Terutz. What decides is not the nature of the meat alone but the intention of the one who leaves it there. One who sets a kid beside the fire means to protect the meat; one who sets it on the coals accepts in advance the risk of charring it — the se‘if says so: The leniency therefore no longer applies. This is support for the second branch. And the se‘if at once adds the limit in the other direction: once the stage of מאכל בן דרוסאי has been reached, there is no fear even with ox meat, since stoking would only spoil what is already edible.
And when the transgression has already occurred? Se‘if 3 rules in a word, without distinguishing the deliberate from the forgotten.
5. Fruit that is eaten raw — se‘if 4
« דחשיבי כמו שנתבשלו כמב״ד דהרי ראוין לאוכלן חיין » (מג״א או״ח רנ״ד ס״ק י״ג)Two reservations, and they are in the se‘if itself — not to replace the cover if it has come off once night has fallen, and not to add anything until they are cooked. The motive the Shulchan Arukh gives for both is one and the same: The Magen Avraham extends the reservation a step further.
6. The boundary of קרימת פנים — se‘if 5
Chakira. What exactly is קרימת פנים, the forming of a crust?
- First branch — a threshold: the sign that the bread has begun to bake in a way that cannot be undone. Its measure is, for bread, the equivalent of what מאכל בן דרוסאי is for a cooked dish.
- Second branch — a physical barrier: the crust keeps the bread from taking in more heat; once it has formed, the bread no longer needs stoking.
The Rambam states the requirement on the face stuck to the oven or to the fire — he does not demand two faces.
« אֵין נוֹתְנִין אֶת הַפַּת בַּתַּנּוּר עִם חֲשֵׁכָה וְלֹא חֲרָרָה עַל גַּבֵּי הַגֶּחָלִים אֶלָּא כְּדֵי שֶׁיִּקָּרְמוּ פָּנֶיהָ שֶׁהֵם מֻדְבָּקִים בַּתַּנּוּר אוֹ בָּאֵשׁ » (רמב״ם הלכות שבת פ״ג הי״ח)The Magen Avraham reads the Shulchan Arukh in that lighter sense: whichever face crusts is enough — and he adds that this is also the Rambam’s view.
7. פשטיד״א and פלאדי״ן — three conditions
« ופשטיד״א או פלאדי״ן צריך שיקרום פניו למעלה ולמטה ויתבשל מה שבתוכה כמאכל בן דרוסאי » (רמ״א או״ח רנ״ד:ה)The reason: a פשטיד״א is a composite — a shell, which is bread, and a filling, which is a cooked dish. Two natures, two regimes: that of bread and that of a dish. Both are therefore needed together, and the bread on both sides.
Here the Magen Avraham stops on a צריך עיון: the requirement of two faces does not sit with the position of the Beit Yosef, for whom one face suffices — this is the tension between §7 and §6, and the commentaries leave it open.
8. רדייה and the intention to eat — se‘if 5 expanded
Three questions in this se‘if:
- Why exactly three meals, and no more?
- Why exactly in the case of forgetfulness?
- Why exactly with a knife, and not with the baker’s peel?
Answers, resting on the commentaries:
- Three meals. The Beit Yosef gives the motive: no penalty was imposed where the three Shabbat meals are at stake, out of regard for the honour of Shabbat. The Magen Avraham specifies that this leniency is the leniency of bread, because it is bread one is obliged to eat on Shabbat. And the Ran, quoted by the Beit Yosef, bounds the leniency: it holds only for one who has nothing else to eat.
- Forgetfulness. In the deliberate case the penalty stands and nothing is permitted before Shabbat goes out. In forgetfulness, and only for three meals.
- With a knife. A departure from the ordinary manner, so that the act should not look like the way bread is taken out on a weekday. The Rambam writes it in just those terms.
And when the bread was put in with time to spare, no transgression occurred: the se‘if says so — one takes it out in the ordinary manner; but whatever is not for the needs of the day is forbidden, even with a departure.
The Rama closes the se‘if on the case of the sealed oven and on the case where one is not baking for Shabbat: there, the fear of stoking is not decreed.
9. The sugya of סקילה and רדייה — se‘if 6
Yesod. A light transgression is here permitted in order to avoid a grave one: רדייה, which is rabbinic, is permitted to prevent the finished baking of the bread, which is a Torah melakha. The gemara puts the question in these terms, and the Shulchan Arukh takes up its conclusion.
Kashya. Why not apply here the principle the gemara raises elsewhere — that one does not tell a man to commit a sin so that another should gain merit?
Terutz. Here it is he himself who brought the situation about: it is therefore for him to extricate himself. Were it someone else, the leniency would not apply — and that is exactly what the Magen Avraham writes, in the name of Rabbenu Yeruham: only the one who put the bread in takes it out; others do not.
10. “Our ovens” and the look of a weekday act — se‘if 7
« בתנורים שלנו שאין בהם רדייה מותר להוציא יותר משלש סעודות בסכין או בשום דבר שיתחוב בו ומכל מקום לא יוציא ברחת משום דמחזי כעובדין דחול » (שו״ע או״ח רנ״ד:ז)The Beit Yosef says why the peel, and it alone, is set aside: it is the equivalent of the מרדה with which bread was drawn from their ovens.
« אבל ברחת שמוציאין בה הפת נראה שאסור כי היא כעין המרדה שהיו רודים בה הפת בתנורים שלהם » (ב״י או״ח רנ״ד)A note on reading: the word פאל״ה found in se‘if 5 is not a further implement — it is the printer’s gloss on מרדה, the French word “pelle” transcribed into Hebrew letters.
11. עססיות ותורמסין — se‘if 8 and the chiddush “לאכלם לאלתר”
The heart of the chiddush. There is no mechanical formula “wholly raw = permitted”. The leniency of the wholly raw dish, in siman 253, rests on הסח דעת: a man will not try to hurry a cooking he knows will take the night. But if his intention is to eat them at once, no turning away of attention takes place: he is expecting a quick cooking, and will be ready to stoke. The עססיות and the תורמסין then count as a dish begun and not finished — and it is forbidden to leave them on the fire. The se‘if says so itself.
What this se‘if governs today. It is the source of the requirement to make sure the appliance was started early enough before Shabbat. It is not enough to rely on the dish being “wholly raw”: if the cook’s intention is to eat that night or early in the morning, the concerns return. The Rama limits the se‘if to an oven neither raked out nor banked; and the se‘if itself adds that the penalty here runs until Shabbat goes out, even where it was forgotten.
12. Practical nafka minot today
1. Rotisserie, or an oven on Shabbat mode with poultry. Poultry is on the kid’s side for this siman. An oven that can no longer be adjusted is of the order of טוח בטיט: nothing in it can be changed on Shabbat. The leniency holds as long as the oven stays shut — it is from opening it that the concern is reborn.
2. An oven on Shabbat mode with beef. Beef is on the side of the שור. The sealing remains what permits; but if the need to open arises on Shabbat, one falls back exactly on the chakira of §3 — and according to Magen Avraham ס״ק י״ט, the Beit Yosef’s position does not extend the leniency where nothing is spoiled. The question stays open and calls for a ruling.
3. Taking food out of the oven on Shabbat. With a knife or a fork: se‘if 7 permits it in so many words. With a peel: the se‘if sets it aside, because that is the look of a weekday act.
4. A slow cooker with lentils or lupins. Se‘if 8 applies directly: these are the very עססיות ותורמסין. They must have reached at least the stage of מאכל בן דרוסאי before Shabbat. Siman 253 treats the neighbouring case of the slow cooker.
5. Frozen bread or pastries put in the oven before Shabbat. קרימת פנים must be reached before Shabbat: that is the measure of se‘if 5. An appliance that reheats without forming a crust does not bring one within the leniency, since it is the crust, not the heat, that is the threshold. The way to proceed is to put them in early enough for the face to take.
6. Pizza, or פלאדי״ן. A double difficulty — the crust, above and below, and the filling at the stage of Without a crust formed before Shabbat, se‘if 5 according to the Rama does not permit leaving it in the oven; and we saw at §7 that the Magen Avraham leaves the question of the second face on a צריך עיון.
7. A kettle or urn that only comes to the boil after Shabbat has begun. Se‘if 9 applies directly.
The Magen Avraham explains why water is not compared to the fruit of se‘if 4: drinkable raw it may be, but not as fittingly as fruit.
