📜 The text of the Shulchan Arukh — 2 seifim
summary: the heading of the siman and seif 1. Marital relations are among the delights of Shabbos; hence the עונה of healthy talmidei chachamim is set from one Shabbos night to the next.
summary: seif 2. The first union with a virgin is permitted on Shabbos לכתחילה; there is here neither חובל — inflicting a wound — nor צער caused to her.
1. Opening of the sugya — Kesubos 62b
The siman runs to two lines, but those two lines come from two different places in Maseches Kesubos, and they do not ask the same question. The first comes from perek אף על פי, where the gemara asks when the עונה of talmidei chachamim falls.
The gemara then ties that same practice to a verse, and it is this tie that gives the practice its weight: the righteous man is compared to the tree "that yields its fruit in its season."
The sugya. The one who states the rule is רב יהודה in the name of שמואל — an Amora, not the Tanna ר׳ יהודה: the distinction is worth keeping, since it places the rule in the Babylonian layer of the sugya and not in the mishnah. The gemara itself gives no reason; it records the practice and anchors it in a verse.
Secondary source. The Talmud elsewhere describes the home that receives Shabbos by three signs, one of them the bed made ready:
That passage speaks of receiving Shabbos, not of the meaning of the זיווג; the kabbalistic reading that associates the union of Shabbos night with a higher יחוד belongs to another literature and is not found on that daf. It is therefore mentioned as such, without being anchored to Kesubos or to Shabbos 119b.
The talmudic yesod. Siman ר״פ establishes two distinct things, and they must be kept apart: (1) relations on Shabbos are not merely permitted, they are positive — they are מתענוגי שבת, which places them on the side of עונג and not on the side of the merely tolerated; (2) they run into neither חובל nor צער, two obstacles one might have thought decisive for the first union on Shabbos. The first point comes from Kesubos 62b, the second from Kesubos 5b–7a: two sugyos, which the Shulchan Arukh joins into two seifim.
2. The underlying chakira — is the first union a חובל?
The chakira is not a construction of the Acharonim: the gemara poses it itself, in so many words, at the beginning of Kesubos. Is the blood of בתולים deposited in a receptacle, or bound to the walls, so that one must wound them to bring it out?
The gemara does not stop there. Even granting that the blood is deposited — so that there is no חבורה — the opening itself remains: is it the blood one wants, or the פתח?
Three positions emerge from those three lines, and they do not overlap:
- א — חבורי מיחבר: the blood is bound to the walls; drawing it out is a חבורה, and one is back at חובל.
- ב — the פתח: even if the blood is deposited, the opening made is still an act. It is then examined under two headings, מלאכה שאינה צריכה לגופה — this opening is not needed for its own sake — and מקלקל אצל הפתח.
- ג — דם מיפקד פקיד: the blood is simply stored there, like a deposit in a vessel; opening it is not wounding, and חובל does not arise at all.
What the commentaries take. To explain the ואין בו משום חובל of seif 2, the Mishnah Berurah takes the third route, and only it:
The other layers — those of the פתח — are not treated by the Mishnah Berurah here. It is the Shulchan Arukh HaRav who takes them up and stacks them, in seif 3 of his own siman ר״פ: he removes חובל by מיפקד פקיד, then removes the opening by מלאכה שאינה צריכה לגופה, then, for those who hold one is liable even for such a מלאכה, by מקלקל, and finally by the rule of מקום מצוה.
נפקא מינה of the chakira. If the heter rests on מיפקד פקיד alone, it covers the blood and leaves the question of the opening untouched. If one adds the layer of מקלקל and that of מקום מצוה, the heter holds even for one who would reject the first branch. The difference does not change the psak of seif 2 — permitted either way — but it changes what that psak rests on, and therefore how firmly it stands against a contrary מנהג. See on this the seventh section.
3. Shitas Rashi — a night of תענוג
The detail is not a small one. Rashi explains the fixing of the עונה by the nature of the night — rest, delight, bodily pleasure — that is, by the very three words that the Rambam, and after him the Shulchan Arukh, will compress into מתענוגי שבת הוא. Siman ר״פ is therefore tied to Shabbos not through a motive of קדושה but through the chapter of עונג; which is why it is housed in hilchos Shabbos and not in hilchos ishus.
4. Shitas the Rambam — תשמיש המטה as עונג שבת
The Rambam returns to the עונה of talmidei chachamim in hilchos ishus, and there he gives its reason — that study wears down their strength:
A textual difficulty, to be flagged and not resolved. The Tur, and after him the Beis Yosef, quote the Rambam in the form תשמיש המטה מתענוגי שבת הוא — and it is this form that the Shulchan Arukh will reproduce word for word. The text of the Rambam as we have it reads מֵעֹנֶג שַׁבָּת. The two say the same thing, but they are not the same words: either the Tur had a different version before him, or he is quoting from memory while preserving the sense. The point remains open; it is worth knowing, because the wording of the Shulchan Arukh comes from the Tur and not from the printed Rambam.
5. Shitas the Beis Yosef and the Shulchan Arukh — 2 seifim
Hence the shape of the siman: two seifim, the first reproducing the Rambam's language as the Tur gives it, the second reproducing the heter of the first union. The Shulchan Arukh writes מותר לבעול לכתחלה בתולה בשבת — and the word לכתחלה is not filler: it rules out in advance the reading that would make the heter a בדיעבד, which is precisely what will be at stake in the seventh section.
6. Shitas the Rama — silence
That silence must nonetheless be read for what it is. The Rama does not gloss — it does not follow that no restrictive Ashkenazi practice regarding the first union on Shabbos ever existed. Such a practice is documented among the Acharonim, and it is the ט״ז who reports it and opposes it (see the seventh section). The Rama's silence is therefore a silence about the דין, not a survey of the מנהגים.
7. The sugya of the Rishonim — the machlokes over the first union on Shabbos
The gemara at the beginning of Kesubos does not merely pose the chakira: it reports Amoraim who ruled in opposite directions. Rabbi Yochanan, in Tzaidan, forbade; Rabbi Ami and Rav Zvid permitted in practice; Rav Pappa in the name of Rava distinguished Shabbos from Yom Tov, while Rav Papi, in the name of that same Rava, refused the distinction. The conclusion is plain:
Tosafos there comment on that permissive conclusion without raising any restriction against it — their dibur hamas'chil is the conclusion itself. The difficulty therefore does not come from the Rishonim of the daf; it comes from two works that add a condition, and it is the ט״ז who transmits them to us.
The ט״ז first sets down that the heter is the conclusion of the Talmud and of the poskim, then reports that the אגודה requires that the union be בהטיה, and that the הגהות אשרי write the same.
Against them the ט״ז cites מו״ח — that is, his father-in-law, the Bayis Chadash, and not the ט״ז himself: the abbreviation מו״ח denotes the writer's father-in-law, and in the ט״ז that is the Bayis Chadash. The Bayis Chadash sets aside the condition of the אגודה, and he sets it aside on the strength of the conclusion of the sugya in Kesubos itself — that of מיפקד פקיד and of מקלקל אצל הפתח.
A third view is reported in the same place: that of Rabbi Yeshaya HaLevi of Jerusalem, in a printed letter. His reasoning does not bear on the דין but on the מנהג — since the practice is not to have the first union on Shabbos, the matter falls under the category of what is permitted but which others have taken upon themselves as forbidden, and one should not teach a heter that would abolish the practice.
The ט״ז's answer. The ט״ז rejects the argument from מנהג, and on two grounds. First on the facts: he has it on good authority that eminent masters themselves followed the heter. Then on the inference: if people do not have the first union on Shabbos, it is out of modesty — the bride is not yet at ease with him — and one cannot draw from a practice that has another cause the proof of a prohibition.
What remains open. The ט״ז decides for himself; the Mishnah Berurah, for its part, still reports the view of those who, where the restrictive practice has spread, refuse to be lenient for those communities — before citing the ט״ז and concluding with him. The siman therefore does not close on unanimity: it closes on a psak and on a local practice that may outlive it. Nothing is decided here for any particular reader.
8. The psak of the Acharonim —
The ט״ז thereby refers to the episode brought in Kesubos 62b: Yehudah, son of Rabbi Chiya and son-in-law of Rabbi Yannai, who would come home every erev Shabbos, failed to do so once because the learning had held him back. The Tur turns it into a practical warning — יהא זהיר לקיים עונתו (טור או״ח ר״פ) — and the ט״ז stresses that the severity of the account attaches to a single lapse.
The second part of the ס״ק is something else entirely: there the מג״א reports a question put to the Gaon in the ספר ברכת הזבח about what the Sages who ate their ordinary food in a state of purity would eat on Shabbos, discusses the answer he received, writes that he did not understand it, and offers his own. The discussion does not bear on the psak of our siman; it is flagged here so that a reader opening the מג״א does not take it for a comment on the עונה.
ס״ק ב carries more weight than its brevity suggests: the word הבריאים in the seif is not ornamental, it restricts. The weekly עונה set for Shabbos night addresses the healthy; those whose strength is diminished are bound only according to their strength. ס״ק ד closes, finally, on a cross-reference the practical reader should not miss:
9. Practical nafka minos
נפקא מינה א — the foods of erev Shabbos. ס״ק א of the Mishnah Berurah starts from the Tur — ויהיה זהיר לקיים עונתו — and goes on to the dietary practice, citing the ספר חסידים at siman ש״ץ.
- Garlic as such nullifies desire; it is roasted garlic that increases seed. The distinction is in the source itself and must not be flattened:
- Everything salted diminishes, and so do קטניות; it is cooked lentils, unsalted, that increase. The Mishnah Berurah gives this last point in the name of the א״ר.
- The מג״א states the same mitzvah regarding garlic and refers, for the other foods, to siman תר״ח.
נפקא מינה ב — the night of טבילה. The seif sets the עונה of talmidei chachamim "from one Shabbos night to the next." ס״ק ג adds three words that change its reach: היינו לבד ליל טבילה.
- The עונה of the night of טבילה is not absorbed into the weekly Shabbos עונה: it is additional to it. The rhythm of the seif therefore holds only for the ordinary course of the week.
- The same ס״ק brings from the ב״ח a requirement that is not dietary but marital, and that bears on the hours before nightfall: וצריך להזהר שקודם שיגיע הלילה חייב להראות חבה יתירה ואהבה עם אשתו (מ״ב ר״פ ס״ק ג) — and all the more so, that he stir up no quarrel on erev Shabbos.
נפקא מינה ג — what the Shulchan Arukh HaRav adds. The Alter Rebbe divides the material into 3 seifim where the Shulchan Arukh has 2. The intervening seif carries Ezra's תקנה concerning garlic, and a warning that neither the Mechaber nor the Mishnah Berurah states at this place: not to annul the עונה, failing which one transgresses a לא תעשה of the Torah, unless the wife forgoes it.
10. Summary of the shitos and the halakhic conclusion
The final yesod. Siman ר״פ invents nothing: it transcribes the Rambam, whom the Tur had already quoted word for word, and it anchors its two clauses in two sugyos of Kesubos — 62b for the timing of the עונה, 5b–7a for the heter of the first union. Its place in hilchos Shabbos rests on the chapter of עונג, and Rashi gives the reason in a few words: a night of תענוג, of שביתה and of הנאת הגוף.
What is decided, and what is not:
- The דין: the Mechaber meets no gloss of the Rama on this siman; there is here no divergence between the two traditions at the level of the Shulchan Arukh itself.
- The מנהג: it is there, and only there, that the divergence lives. The Mishnah Berurah reports the view of those who, where the restrictive practice has spread, refuse to be lenient, then cites the ט״ז and concludes with him — והמחמיר אינו אלא מן המתמיהין (מ״ב ר״פ ס״ק ד).
- Chabad: the Shulchan Arukh HaRav gives 3 seifim, adds Ezra's תקנה and the warning about ביטול עונה, and develops for seif 2 the successive layers of the heter — מיפקד פקיד, מלאכה שאינה צריכה לגופה, מקלקל, מקום מצוה. His contribution is halakhic and analytical; Level 4 sets it out in full.
