A forbidden piece not worthy of being served, mixed with others of its kind while dry — it does not dissolve but stays unidentifiable — is nullified in the majority (חד בתרי בטיל), without 60; eaten one by one (מִמַּה נַּפְשָׁךְ), not all three together. But שלא במינו → 60, and cooking the mixture → 60.

1. The axiom: an unidentifiable prohibition is nullified in the majority (חד בתרי)

The starting point:

Siman 109 deals with a dry mixture, where the forbidden item stays whole without dissolving — yet is no longer recognizable. The question is no longer "taste + 60" as in meat/milk, but: is the prohibition of the same kind, and is it dry or cooked? The Mehaber (seif 1) rules: a piece not worthy of being served (אינה ראויה להתכבד), mixed with others of its kind, dry-in-dry (מין במינה יבש ביבש), one in two is nullified (חד בתרי בטיל) — by the majority (אחרי רבים להטות), without needing 60.

💡 The marker: this siman no longer speaks of "cold / hot / taste" but of majority (רוב) while dry. The logic is מִמַּה נַּפְשָׁךְ: when eating one — "this is the permitted"; even the last — "the forbidden one was already eaten". So each on its own is permitted, but all three together is forbidden (one would surely eat the forbidden one). And all this assumes one neither cooked the mixture (else 60) nor mixed a different kind (else 60).

■ SAME KIND? (מין במינו / שלא במינו) — is the prohibition mixed with permitted of its own kind? If yes → חד בתרי (majority, no 60). Different kind and unrecognizable → 60 is required, since with שלא במינו taste matters and we fear cooking (seif 1).

■ DRY OR COOKED? (יבש / cooked) — as long as it is dry, the majority suffices. Cooked all together → the juice (רוטב) diffuses the taste and is absorbed into the pieces: 60 is required, even to eat them each on its own (seif 2).

■ HOW MANY PIECES? (מִמַּה נַּפְשָׁךְ) — one forbidden in two permitted → nullified. One may eat them each on its own, or two-and-one, but never all three together (else one surely eats the forbidden one) — seif 1.

⚖ Cooking the mixture and the remedy (seif 2)

If one cooked all together without 60 → forbidden, for the juice gives taste and is absorbed into the pieces. To be able to cook them: one may add more (להרבות עליהם) until reaching 60, and there is no transgression of "nullifying a prohibition (מבטל איסור)" — since each is already permitted on its own. And (Rama, יש אומרים) if the mixture was known before they were cooked together → everything is permitted (already nullified while dry, it does not revert to being forbidden — Tour in the name of the Rosh, R. Yerouham in the name of the Tossefot, וכן עיקר); and in case of loss, one relies on the lenient.

An absolute must to memorize. Basis: Mehaber seifim 1-2, read with the Rama, the Taz (s.k. 1-2) and the Shach (s.k. 3-4).

📌 Key reading: in the dry case, first ask same kind or not (otherwise 60). For cooking, look at cooked or not, and known before or after. And everywhere, the prohibition stands on its own (עומד בעצמו) as long as it is dry; one needs a majority among the pieces (otherwise all forbidden even with 60 — Shach sk4).

4. The 5 golden rules

  1. "חד בתרי בטיל". מין במינו, dry, unidentifiable → one in two is nullified in the majority (אחרי רבים להטות), without 60 (Mehaber seif 1).
  2. "מִמַּה נַּפְשָׁךְ". Eat each on its own, or two-and-one, never all three together; and יש מחמירין not to eat them even one after another (Mehaber + Rama seif 1).
  3. שלא במינו = 60. Different kind, even dry and unrecognizable → 60 is required, lest one cook them (Tour in the name of the Sefer HaTerouma, Rama seif 1).
  4. De-rabbanan like de-oraita. No difference: one always requires the majority (חד בתרי), not חד בחד (Beit Yossef, Rama seif 1).
  5. Cooking → 60; one may "marbeh alav". Cooked together without 60 → forbidden (the juice diffuses); remedy: add up to 60, without מבטל איסור; known before → all permitted (Mehaber + Rama seif 2).

6. The 4 classic pitfalls

❌ Pitfall 1 — Eating all three together: the din is חד בתרי בטיל, but this only permits eating each on its own (or two-and-one). All three together, one would surely eat the forbidden one → forbidden. And there is one who forbids even eating them one after another, and the Rama writes that there are מחמירין to discard one or give it to a non-Jew — but this is only a mere stringency (Mehaber + Rama seif 1).
❌ Pitfall 2 — Confusing מין במינו and שלא במינו: while dry, same kind → חד בתרי, no 60 (since מין במינו is already nullified by Torah law in the majority, even לח בלח, cross-ref siman 98). But different kind (where by Torah law 60 is needed לח בלח, taste mattering) → even dry it needs 60, lest one cook them and reach a Torah-level prohibition (Ran — Rama seif 1).
❌ Pitfall 3 — Forgetting the majority among the pieces: the prohibition stands on its own (עומד בעצמו) even cooked in water: it stays "dry" (Shach sk4). But once cooked, one needs 60 (pieces + water) against the prohibition and a majority among the pieces — otherwise all forbidden, even with 60. And קמח בקמח (flour in flour) is treated as לח בלח (dissolved), not as dry (Shach sk3).
