1. The axiom: when the majority (רוב) no longer nullifies — דבר חשוב and קבוע

The starting point:

Siman 110 is the founding siman of the rules of doubt. The general rule is that a forbidden item mixed into permitted ones nullifies in the majority (or in sixty). But the siman sets out two great exceptions and one great permission: (1) a דבר חשוב (important item) never nullifies, even among a thousand — "דָּבָר חָשׁוּב אוֹסֵר בְּמִינוֹ בְּכָל שֶׁהוּא" (seif 1); (2) a forbidden item fixed in its place (קבוע) is not nullified by the majority — "כָּל קָבוּעַ כְּמֶחֱצָה עַל מֶחֱצָה דָּמֵי" (seif 3); but (3) two independent doubts form a ספק ספיקא (double doubt) that permits — even a Torah prohibition (seif 4, 8, 9).

💡 The marker: this siman no longer speaks of "taste / sixty" but of count (רוב), fixity (קבוע) and doubt (ספק). Always ask first: is the forbidden item important (then it does not nullify)? is it still in its place (קבוע = 50/50) or separated (פירש = majority)? and are there two doubts that combine (ספק ספיקא)?

2. The 3 reflex questions

■ IS IT IMPORTANT? (דבר חשוב / דבר שבמנין) — is the forbidden item one of the 7 things, a live animal (בעלי חיים), or (Rama) a דבר שבמנין (always sold by count)? If yes → it does not nullify, even among a thousand. But this is דרבנן: in doubt (is it really a דבר חשוב?) → ספיקו לקולא (seif 1).

■ IS IT FIXED? (קבוע / פירש) — is the forbidden item still in its fixed place (the nine shops, the מקולין before the discovery) → כל קבוע כמחצה על מחצה, the majority does not help. Has it separated שלא לפנינו (meat found in the market) → כל דפריש מרובא פריש, we follow the majority, permitted (seif 3, 5).
↓ we look at the number of doubts
■ ARE THERE TWO DOUBTS? (ספק ספיקא) — are there two independent doubts about the existence of the prohibition, known together? → ספק ספיקא, permitted, even דאורייתא. But one true doubt + a mere mixture is not a ספק ספיקא (seif 4, 8, 9).

⚖ The conditions of the ספק ספיקא (seif 4, 8, 9)

For a double doubt to permit, one needs: two genuinely independent doubts about the existence of the prohibition (not a doubt + a mere mixture); that it be one body / one same question (בגוף אחד מענין אחד); and that the two doubts be known together (Shach s.k. 63). It does not combine when the 1st doubt is בגופו (in the very body of the item — seif 9) or בקבוע (a Torah prohibition in its fixed place — seif 4). A "doubt of mixture" alone is not a second doubt.

3. The master grid: קבוע vs פירש, and the ספק ספיקא

An absolute must to memorize. Basis: Mehaber seifim 1-10, read with the Rama, the Taz and the Shach (notably s.k. 63 on the rules of the ס״ס).

📌 Key reading: for קבוע, ask is it still in its place (לפנינו) or separated (שלא לפנינו). For the ספק ספיקא, ask are there really two doubts about the existence of the prohibition — or only a doubt followed by a mixture. And the doubt בגופו (in the body) is never saved by the doubt of the mixture (seif 9).

4. The 5 golden rules

  1. "דָּבָר חָשׁוּב אוֹסֵר בְּמִינוֹ בְּכָל שֶׁהוּא". The 7 things, the בעלי חיים, and (Rama) every דבר שבמנין do not nullify, even among a thousand. But this is דרבנן → in doubt, אזלינן בספיקו לקולא (Mehaber + Rama seif 1).
  2. "כָּל קָבוּעַ כְּמֶחֱצָה עַל מֶחֱצָה דָּמֵי". A forbidden item fixed in its place is not nullified by the majority — it counts as 50/50 (the nine shops, Mehaber seif 3).
  3. "כָּל דְּפָרִישׁ מֵרֻבָּא פָּרִישׁ". Once separated שלא לפנינו, we follow the majority → permitted; but separated לפנינו = still קבוע (Mehaber + Rama seif 3).
  4. פירש במתכוין vs ממילא. From a known mixture of important items, what separates intentionally stays forbidden (גזירה שמא יקח מן הקבוע); what separates by itself is permitted (Mehaber + Rama seif 6).
  5. The ספק ספיקא permits, but under conditions. Two independent doubts, one body, known together — then even a Torah prohibition is permitted; but not if the 1st doubt is בגופו or בקבוע (Mehaber + Rama seif 4, 9; Shach s.k. 63).

6. The 4 classic pitfalls

❌ Pitfall 1 — Thinking the דבר חשוב forbids by full law: the דבר חשוב does not nullify, but this stringency is only דרבנן; so, in doubt (is it really a דבר חשוב? is it really in the mixture?) we are lenient — "אזלינן בספיקו לקולא" (Rama seif 1, Shach s.k. 10). The importance is moreover local and temporal: according to its importance in this place and time.
❌ Pitfall 2 — Confusing קבוע and פירש: as long as the forbidden item is in its place (the nine shops), it counts as half-and-half and the majority does not nullify it ("כל קבוע כמחצה על מחצה"). But once it has separated שלא לפנינו, we follow the majority ("כל דפריש מרובא פריש") and it is permitted. Beware: פירש לפנינו (separated before our eyes, or the non-Jew we see taking it) stays קבוע (cross-ref siman 63).
❌ Pitfall 3 — Calling "ספק ספיקא" a doubt + a mixture: according to the Rama (seif 4), when the first doubt is already forbidden מן התורה, the fact that it then mixes does not add a second doubt — it is only a mixture, and this is not a ספק ספיקא; and such is the custom. One needs two true doubts about the existence of the prohibition. Likewise, a doubt בגופו (in the very body) is not saved by the doubt of the mixture (seif 9).
❌ Pitfall 4 — Eating it all, or one by one: in the case of one eaten / fallen into the sea (seif 7), one eats the rest only two by two (מִמַּה נַּפְשָׁךְ: there is necessarily one permitted), never one by one. And even two by two, a single person may not eat them all, nor two people at once (Rama seif 7, Shach s.k. 47-49). Likewise for the ספק ספיקא of dilution (seif 8): one person does not eat it all.

An egg of a טריפה hen → we follow the majority, permitted.
