Simanim 204 and 205 asked to what a word may attach. This one asks something else, and more formidable: how much must be said? A man begins to vow, stops on the way — and the Shulchan Arukh teaches that this may suffice. The word that gives the siman its title, ידות, means handles: one holds a vow as one holds a vessel by its handle. These are rules למעשה, and the last seif itself draws the consequence: a התרה is needed — and that is done before a Rav.

1. What is this siman about? The word begun and not finished

The two preceding simanim asked to what a word may attach. This one asks something else: how many words must be pronounced? A man begins to vow and stops on the way — “I am vowed away from you…” and nothing more. Has he bound anything? The Shulchan Arukh answers in five seifim, and its answer is one of the subtlest in the tractate.

The word of the siman. The Shulchan Arukh uses it without explaining it, but the Sefaria edition carries at seif א a gloss defining it — we give it here as it stands there, for it is the best definition possible: ידות — “that he began to vow and did not finish the utterance, and despite this he is forbidden as though he had vowed the whole utterance; like a man who holds the handle (יד) of a vessel and thereby uses the vessel as though he had grasped it himself”.

But at once the Shulchan Arukh sets the condition: והוא שיהו מוכיחות קצת על הנדר — provided they indicate the vow somewhat. The whole siman turns on that “somewhat”: how much speech suffices to make what was meant guessable?

Five seifim, a single question: where does the binding word stop? (א) The handle-formulations — מודרני ממך, מופרשני ממך, מרוחקני ממך — and what they do, finished or not. (ב) The difference of a single letter: לך against ממך. (ג) מנודה, משמתינא, נדינא — three close words, three different regimes. (ד) כנדרי רשעים against כנדרי כשרים. (ה) And the case where the word does not bind at all, because it belongs to the register of the שבועה and not of the נדר.

2. The mishna that opens the tractate

Siman 206 is the halakhic shaping of the very first lines of tractate Nedarim. The mishna there sets out the same formulations, in the same order:

The gemara at once explains that the mishna must be read as saying two things — the כינויים (substitute words) and the ידות:

« כָּל כִּינּוּיֵי נְדָרִים כִּנְדָרִים, וִידוֹת נְדָרִים כִּנְדָרִים » (נדרים ב׳ ע״ב)

And it is in these same lines that one finds the sentence which will govern seif ה of our siman — the difference between נדר and שבועה:

« אַיְּידֵי דִּתְנָא נְדָרִים דְּמִיתְּסַר חֶפְצָא עֲלֵיהּ, תְּנָא נָמֵי חֲרָמִים, דְּמִיתְּסַר חֶפְצָא עֲלֵיהּ. לְאַפּוֹקֵי שְׁבוּעָה, דְּקָאָסַר נַפְשֵׁיהּ מִן חֶפְצָא » (נדרים ב׳ ע״ב)

Finally, seif ג rests on a passage of folio ז׳, where Rav Papa precisely separates the three words the Shulchan Arukh sets out there:

« אָמַר רַב פָּפָּא: בִּ״נְדִינָא מִינָּךְ״ — דְּכוּלֵּי עָלְמָא לָא פְּלִיגִי דְּאָסוּר. ״מְשַׁמַּתְנָא מִינָּךְ״ — לְכוּלֵּי עָלְמָא שְׁרֵי » (נדרים ז׳ ע״א)

3. The text of the Shulchan Arukh, seif by seif

Seif א — the three formulations, finished and unfinished

The ידות of vows are like vows (gloss: ידות means that he began to vow and did not finish the utterance, and despite this he is forbidden as though he had vowed the whole utterance, like a man who holds the handle of a vessel and thereby uses it as though he had grasped it himself) — provided they somewhat indicate the vow. How? One who says to his fellow “מודרני ממך [I am vowed away from you] that I shall not eat of what is yours”, or “מופרשני ממך [I am separated from you] that I shall not eat of what is yours”, or “מרוחקני ממך [I am distanced from you] that I shall not eat of what is yours” — he is forbidden to eat with him. (Gloss: and some say that even if he said שאני אוכל לך in these formulations, he is forbidden to eat with him — the Ran in the name of יש גורסין, and see ס״ק ב.) But if he says “שאיני אוכל לך” alone, without מודרני ממך, it is not a יד. And if he said מודרני ממך, or מופרשני ממך, or מרוחקני ממך, and did not finish his words with “שאיני אוכל לך”: with מודרני ממך he is forbidden to speak with him; with מופרשני ממך he is forbidden to do business with him; with מרוחקני ממך he is forbidden to stand within his four cubits.

Seif ב — “לך” or “ממך”: one letter that changes everything

אמר לחבירו מודר אני לך מאכילה או מהנאה שניהם אסורים לאכול או ליהנות זה מזה אבל אם אמר מודר אני ממך מאכילה או מהנאה הוא אסור בחבירו וחבירו מותר בו:
He said to his fellow “מודר אני לך — from eating or from benefit”: both are forbidden, each to eat or to benefit from the other. But if he said “מודר אני ממך — from eating or from benefit”, he is forbidden with respect to his fellow, and his fellow is permitted with respect to him.

Seif

He said “מנודה אני לך” or “משמתינא ממך”: if he finished his words with “שאני אוכל לך”, it is not a vow and everything is permitted to him. And if he did not finish his words — he is forbidden to stand within his four cubits. But if he said “נדינא ממך” and finished his words with “שאיני אוכל לך”, he is forbidden to eat with him; if he did not finish his words with “שאיני אוכל לך”, he is forbidden to benefit from him. Gloss of the Rama: and it has already been explained that some disagree and hold that so long as he did not say “שאיני אוכל לך” or “שאני אוכל לך”, it is nothing.

He said “כנדרי רשעים [like the vows of the wicked] this loaf is upon me”, or he said “כנדרי רשעים הימנו” while a loaf lay before him — it is forbidden to him. But if he said “כנדרי כשרים [like the vows of the upright] upon me”, or “כנדרי כשרים this loaf is upon me”, it is nothing; and even if he said “כנדרי כשרים this loaf is upon me קונם” (gloss: קונם is one of the substitutes for the word קרבן). But if he said “כנדבת כשרים [like the freewill offerings of the upright] upon me”, or “כנדבת כשרים this loaf is upon me” — it is a vow.

Seif ה — when the utterance belongs to the register of the oath

One who vows “that I shall not eat” or “that I shall eat with you” — it is not even a יד, for this formulation is a formulation of שבועה and not of נדר; unless he vowed to perform a mitzva. However, since nowadays it is common in people's mouths to vow in this formulation, one should not be lenient, and a התרה is needed so that vows not be treated lightly. And there is one who says that a נדר expressed in a formulation of שבועה, and a שבועה expressed in a formulation of נדר, are effective under the head of ידות. However, regarding נזירות expressed in a formulation of שבועה, all agree that it is forbidden.

What these five seifim say

The handle and the vessel. The word יד means hand, but also handle. A handle-utterance is not a whole vow: it is that by which a vow is held. And just as one lifts a pot by its handle, one may bind by the beginning of a sentence — provided that beginning lets the rest be guessed.
Three formulations, three different effects when unfinished. The Mehaber does not treat them as one block. מודרני ממך unfinished forbids speaking; מופרשני ממך forbids doing business; מרוחקני ממך forbids standing within his four cubits. Each word is taken in the sense its root indicates: “vowed away”, “separated”, “distanced”.
One letter. At seif ב, everything hangs on the difference between לך (“to you”) and ממך (“from you”). To you: I place my goods out of your reach — and since he says “from eating”, reciprocity operates and both are caught. From you: I forbid myself what is yours — I alone am caught. The Taz (ס״ק ב) formulates it in one line in the Ran's name.
Three neighbouring words, and the gemara separates them. At seif ג, מנודה and משמתינא are words of excommunication, not of vow; נדינא comes from the root of נדר. Rav Papa already said it: for נדינא ממך all agree it is forbidden; for משמתנא ממך all agree it is permitted.
The wicked vow, the upright give. Seif ד rests on an observation of custom: one who says “like the vows of the רשעים” has attached himself to something real, for the רשעים do vow — and a vow binds. One who says “like the vows of the כשרים” has attached himself to nothing, for the כשרים do not vow: they give (נדבה). The Taz (ס״ק ד) gives the underlying reason: a נדר creates a liability (אחריות) and hence a risk of fault; a נדבה does not.
And the pivot of the whole block, in the last seif. “That I shall not eat” is not even a יד — because that formulation binds the person, and that is the language of the שבועה, whereas the נדר forbids the thing. The Taz (ס״ק ו) and the Shach (ס״ק ט) write the same sentence. And yet the Shulchan Arukh concludes that a התרה is required, because people speak that way.

4. The key concepts of the siman

ידות נדרים — “The handles of vows”. A word begun and not finished, which binds nonetheless — like a vessel held by its handle. The very title of the siman.
מוכיחות — “Which indicate”. The condition set by seif א: the utterance must let the vow be guessed. This is what the whole ma'hloket between the Mehaber and the Rosh turns on.
ידים מוכיחות — “Hands that indicate”. The technical expression. Those who require the utterance to be finished say that without this there are no ידים מוכיחות. The Bach, conversely, holds that even ידים שאינן מוכיחות are ידים (Shach ס״ק ג).
מודרני · מופרשני · מרוחקני — The three formulations of seif א. “I am vowed away from you”, “I am separated from you”, “I am distanced from you”. Unfinished, each produces a different effect, modelled on the sense of its root.
מנודה · משמתינא · נדינא — The three words of seif ג. The first two belong to the vocabulary of excommunication; the third to that of the vow. The Taz (ס״ק ג) writes that מנודה is not a formulation of vow at all, unlike נדינא.
כנדרי רשעים — “Like the vows of the wicked”. This binds, for the רשעים really do vow — the Shach (ס״ק ז) explains: it is like saying “this loaf is upon me like a קרבן”, since an ordinary רשע is liable to a קרבן.
כנדרי כשרים — “Like the vows of the upright”. This does not bind, for the כשרים do not vow. And the Shach (ס״ק ח) adds a remarkable point: these words, placed at the head, nullify even the word קונם that follows them.
נדבה — The freewill offering. As opposed to the נדר. The Taz (ס״ק ד) gives the underlying difference: the נדר is said “הרי עלי” and places a liability on the one who vows; the נדבה is said “הרי זו” and places none.
קונם — Konam. One of the substitutes (כינויים) for the word קרבן — the Shulchan Arukh itself supplies the definition in seif ד.
נזירות — Naziriteship. The vow to abstain from wine, from cutting the hair, and from corpse impurity. The siman's last word is devoted to it: expressed in a formulation of שבועה, all agree that it binds.

5. The apparatus of the Shach (ש״ך) — the ten ס״ק

Ten entries, one of which — ס״ק ב — is among the longest in all of Yoreh De'ah: there the Shach copies out Rabbeinu Yeruham in full, “because of the many distinctions of dinim he explains there”, as he himself says. We give five extracts from it.

ס״ק א — ויש אומרים דאפילו אמר שאני אוכל לך

« בלא י׳ באלו לשונות אסור דה״ק מודרני ממך כשאוכל לך » (ש״ך יו״ד ר״ו ס״ק א)

The Shach explains the Rama's gloss: even without the yod — that is, שאני and not שאיני — the formulation forbids, for it must be read as saying “מודרני ממך when I eat of what is yours”.

The longest entry in the siman. There the Shach sets out, following Rabbeinu Yeruham, every combination: the formulation alone, the formulation with “אם אוכל” without “לך”, the formulation with “שאיני אוכל” — and he lays down in passing the rule that governs the siman: so long as a man forbids himself with respect to the object, there is no יד for vows, for the vow forbids the object. He relies on the Rosh and on the Tosafot at the beginning of Nedarim, and concludes that the Rama's formulation is not exact at all — for that case is more forbidden, and by all opinions.

The Shach is astonished: the Rama did not report the view of the Rosh, the Tur and the Ran, for whom so long as he has not finished his words it is no vow at all — since the formulation may mean this or that, and then they are not ידים מוכיחות. He adds that a gloss of the Rav is probably missing here — the same hypothesis the Taz will make at ס״ק א. And he reports the Bach, who goes the opposite way.

ס״ק ד — וחבירו מותר

« ואם לא הזכיר לא אכילה ולא הנאה לא הוי נדר כלל עכ״ל טור והוא לשיטתו דלעיל אבל להרמב״ם והמחבר הוי נדר שאינו רשאי לדבר עמו » (ש״ך יו״ד ר״ו ס״ק ד)

The Tur added that if he mentioned neither food nor benefit, it is no vow at all — but that is the consistency of his own position. For the Rambam and for the Mehaber it is a vow: he may not speak with him (as in seif א). The Shach notes that the Mehaber deliberately omitted that ending of the Tur.

ס״ק ה — אמר מנודה

« דהמחבר מזכה שטרא לבי תרי דבאומר מנודה אני לך שאני אוכל לך פסק דמותר בכל » (ש״ך יו״ד ר״ו ס״ק ה)
« ואי ס״ל להמחבר דמנודה אני לך לשון נדר הוא א״כ בסיים דבריו שאני אוכל לך נמי אסור לאכול עמו » (ש״ך יו״ד ר״ו ס״ק ה)

A צ״ע on the Mehaber himself. The Shach finds the position of seif ג incoherent — he grants the deed to both litigants: if מנודה is not a formulation of vow, then even unfinished it should permit everything; and if it is one, then even finished it should forbid eating. He examines the view of the Rambam, of the Raavad, of Rabbeinu Yeruham, and concludes with a וצ״ע.

ס״ק ו — וכבר נתבאר

« הא הכא גרע טפי וכמ״ש התוס׳ בשם ר״י דהכא במנודה ונדינא ממך אפילו לא סיים דבריו אסור ליהנות » (ש״ך יו״ד ר״ו ס״ק ו)
« ונראה דלענין הלכה אין להקל מטעם שכתבתי » (ש״ך יו״ד ר״ו ס״ק ו)

The Shach replies to the Bach, who had not understood what the Rama's “וכבר נתבאר” referred to; and he adds a substantive objection: here it is worse, for according to the Tosafot in the name of the Ri, even without finishing the sentence, מנודה and נדינא forbid benefit. He concludes: as to halakha, there is no room to be lenient.

ס״ק ז — אסור בו

« דהוי כאומר ככר זה עלי כקרבן דסתם רשע חייב בקרבן » (ש״ך יו״ד ר״ו ס״ק ז)

Why “כנדרי רשעים” binds: because it is like saying “this loaf is upon me like a קרבן” — an ordinary רשע is indeed liable to a קרבן. The attachment therefore bears on something real.

ס״ק ח — כנדרי כשרים קונם

« דמה שתלה בכשרים בטל את הקונם דכשרים לא נדרי כלל אלא נודבין » (ש״ך יו״ד ר״ו ס״ק ח)

A surprising mechanism: having suspended it on the כשרים nullifies the קונם that follows — for the כשרים do not vow at all, they give. The first words thus defuse the strongest word in the language of vows.

ס״ק ט — הנודר

« דוקא באומר מודרני ממך אסר על עצמו הנאת חבירו ואע״פ שלא התפיס בדבר הנדור יד מיהא הוי » (ש״ך יו״ד ר״ו ס״ק ט)
« כלומר דלשון נדר היינו שאוסר החפץ עליו ולשון שבועה היינו שאוסר עצמו על החפץ » (ש״ך יו״ד ר״ו ס״ק ט)

Here the Shach gives, in the Rosh's name, the clearest definition in the whole block 204-206: a formulation of נדר is one that forbids the thing to the man; a formulation of שבועה is one that forbids the man with respect to the thing. And “I vow that I shall not eat with you” is of the second register — hence neither נדר nor שבועה (since he did not swear).

ס״ק י — ומיהו בנזירות

« דנזירות לכ״ע אם הוציאו בלשון שבועה חל דעיקרו לשון שבועה הוא דהא אתפוסי גברא הוא כמו שבועה » (ש״ך יו״ד ר״ו ס״ק י)

The siman's last word. The Shach notes that this point does not appear in the Beit Yosef, and that he found it in a responsum of the Mabit in the name of the Radbaz: נזירות, if expressed in a formulation of oath, binds according to all — for its foundation is a formulation of oath, since it binds the person, like the שבועה. The Shach adheres to this and proves it from the beginning of Nedarim.

6. The apparatus of the Taz (ט״ז) — the seven ס״ק

The Taz opens the siman with an emendation: he holds that a piece is missing from the Rama's gloss, and writes what it should carry — and some say that so long as he did not finish with שאיני אוכל or שאני אוכל, it is nothing, which is the Rosh's view in the Tur. And he gives the reason: “מודרני ממך” without a sequel is ambiguous — does he speak of the prohibition of speaking, or of the prohibition of benefit? — and ambiguity removes the character of a יד. He adds that his emendation at last makes sense of the “וכבר נתבאר” the Rama writes at seif ג.

ס״ק ב — אני לך

« משמע כלומר נכסי אסורים לך ומשמע משלך מה שאין כן בממך » (ט״ז יו״ד ר״ו ס״ק ב)

One line, in the Ran's name, and it explains the whole of seif ב: “לך” means: my goods are forbidden to you, and it is understood also of what is yours; which is not so with “ממך”. Hence reciprocity in the first case and its absence in the second.

ס״ק ג — מנודה אני

« דזה אינו לשון נדר לגמרי מה שאין כן בנדירנא שהוא לשון נדר » (ט״ז יו״ד ר״ו ס״ק ג)

Three words that split seif ג in two: מנודה is not at all a formulation of vow; נדירנא is.

The Taz first gives the observation: the רשעים are wont to vow, the כשרים to give. Then he gives the underlying reason, and it is a fine one: a נדר is said “הרי עלי” — the thing remains the charge of the one who vows, hence a liability and a risk: if the object set aside is lost, he will not give another. A נדבה is said “הרי זו”: no liability rests on him.

ס״ק ה — ככר זה עלי קונם

« לפי שמה שאמר תחילה כנדרי כשרים מבטל מה שאמר אחר כך לשון קונם » (ט״ז יו״ד ר״ו ס״ק ה)

The same mechanism as the Shach (ס״ק ח), said otherwise: what he said first — כנדרי כשרים — nullifies what he said afterwards, the formulation קונם. Word order decides.

ס״ק ו — לשון שבועה הוא

« דלשון נדר הוא שאוסר החפץ עליו ולשון שבועה הוא שאוסר את עצמו על החפץ » (ט״ז יו״ד ר״ו ס״ק ו)

The pivotal sentence, in the Taz's hand: a formulation of נדר forbids the thing to the man; a formulation of שבועה forbids the man with respect to the thing. It is identical to the Shach's at ס״ק ט, and it explains why “that I shall not eat” is not even a יד.

ס״ק ז — ויש מי שאומר

« ונראה דהרמב״ם כתב זה דרך פירוש על הפסוק לאסור איסר על נפשו » (ט״ז יו״ד ר״ו ס״ק ז)

The last entry, and it is exegetical. The Taz stops on the Rambam cited by the Tur: why add “and likewise if he says: this is upon me איסור”? It seems superfluous. The answer: the Rambam is commenting on the verse לאסור איסר על נפשו, which one might have read as speaking of attachment to a forbidden thing — and he teaches that it must be read otherwise.

7. The Baer Hetev — the nine ס״ק — and the Pitchei Teshuva

The Baer Hetev here follows the Shach step by step: of nine entries, seven expressly carry the mention ש״ך or עכ״ל הש״ך. For this siman it is a digest of the Shach rather than a commentary of its own.

ס״ק א — שאני

« דה״ק מודרני עמך כשאוכל לך » (באר היטב יו״ד ר״ו ס״ק א)

Taking up Shach ס״ק א.

ס״ק ב — לדבר

« ונראה דחסר כאן הגהת הרב דעה א׳ דס״ל דכל שלא סיים דבריו לא הוי נדר כלל כיון דמשמע הכי ומשמע הכי לא הוי ידים מוכיחות » (באר היטב יו״ד ר״ו ס״ק ב)

The digest of the Shach's ס״ק ג, with mention of the Taz and the Bach, then a long summary of ס״ק ב.

ס״ק ג — מאכילה

« ואם לא הזכיר לא אכילה ולא הנאה לא הוי נדר כלל. טור. אבל להמחבר הוי נדר שאינו רשאי לדבר עמו » (באר היטב יו״ד ר״ו ס״ק ג)

The Shach's ס״ק ד, condensed — including the remark on the Levush.

ס״ק ד — מנודה

« כתב הש״ך דדברי המחבר צ״ע דאי ס״ל דמנודה או משמתינא לאו לשון נדר הוא » (באר היטב יו״ד ר״ו ס״ק ד)

The Shach's צ״ע on the Mehaber, brought to its briefest form.

ס״ק ה — נתבאר

« אלא שנראה שהרב נמשך אחר דברי הטור דמשוה לגמרי מנודה ונדינא למרוחקני » (באר היטב יו״ד ר״ו ס״ק ה)

The Shach's ס״ק ו, down to its conclusion: there is no room to be lenient.

ס״ק ו — אסור

« דהוי כאומר ככר זה עלי כקרבן דסתם רשע חייב בקרבן » (באר היטב יו״ד ר״ו ס״ק ו)

The Shach's ס״ק ז, word for word.

ס״ק ז — קונם

« דמה שתולה בכשרים בטל את הקונם דכשרים לא נדרי כלל אלא נודבין » (באר היטב יו״ד ר״ו ס״ק ז)

The Shach's ס״ק ח, word for word.

ס״ק ח — נדר

« דלשון נדר היינו שאוסר החפץ עליו ולשון שבוע היינו שאוסר עצמו על החפץ » (באר היטב יו״ד ר״ו ס״ק ח)

The pivotal sentence, transmitted a third time — after the Shach (ס״ק ט) and the Taz (ס״ק ו). The edition here carries שבוע without the final hé; we reproduce it without correcting.

ס״ק ט — מצוה

« האומר הרי אני נודר רביע גופי הוה כאלו אמר הריני נודר לתת רביעית גופי וחייב צדקה » (באר היטב יו״ד ר״ו ס״ק ט)

An addition proper to the Baer Hetev, found neither in the Shach nor in the Taz: in the Ralbach's name, one who says “behold I vow a quarter of my body” is as though he had said “behold I vow to give [the value of] a quarter of my body” — and he is liable for צדקה.

The Pitchei Teshuva — the two ס״ק

ס״ק א — לעשות מצוה

« עבה" ט בשם רלנ״ח » (פתחי תשובה יו״ד ר״ו ס״ק א)

A one-line entry: the Pitchei Teshuva refers to the Baer Hetev, who cites the Ralbach — this is the ס״ק ט entry we have just read, on the vow of a quarter of one's body — and he adds a reference to another place where he again reports the same author. The point attached is the exception seif ה reserves: unless he vowed to perform a mitzva.

ס״ק ב — מהני מדין ידות

« שכתב דפלוגתא זו דוקא אם היה בדבר שיש בו ממש כמו לא אוכל שהמאכל יש בו ממש » (פתחי תשובה יו״ד ר״ו ס״ק ב)
« שומעין להקל כדעת הרא״ש ואפי׳ להרמב״ן עכ״פ במקום קצת מצוה מתירין אפי׳ ע״ד רבים » (פתחי תשובה יו״ד ר״ו ס״ק ב)

The substantial entry of the Pitchei Teshuva, in the name of the Noda BiYehuda. It restricts the divergence reported in seif ה: it holds only if the thing in view has substance (ממש) — as in “I shall not eat”, where the food has it. But if the thing has none, then even in a complete vow there would be no Torah prohibition — and one listens to the lenient view, that of the Rosh. He adds that even according to the Ramban, where some mitzva is at stake, one releases, even a vow taken על דעת רבים.

The Nekudot HaKesef. They are the Shach's reply to the Taz, and siman 206 might have lent itself to that — the Taz emends the Rama's gloss there, and the Shach for his part writes that a gloss is missing. They do not comment on siman 206: no entry is available to us for this siman. We therefore make them say neither yes nor no, and no column in this study bears their name.

9. Practical cases

These cases illuminate the mechanism; they do not conclude. And this siman has a lesson of its own: what one did not finish saying counts too. All the more reason not to judge for oneself what one said.

He says, in anger: “מודרני ממך that I shall not eat of what is yours”.
This is the typical case of seif א: the utterance is finished, and it forbids eating with him. The question is not whether he “meant it”: the siman judges the form of the utterance.
He says only “מודרני ממך”, and stops there.
This is the heart of the ma'hloket. For the Mehaber (following the Rambam), this forbids speaking with him. For the Rosh, the Tur and the Ran — whom the Shach (ס״ק ג) and the Taz (ס״ק א) hold to be missing from the Rama's gloss — it is no vow at all. The Bach is more stringent still. A real case is brought to the Rav.
He says “מודר אני לך from eating” — with the lamed, not the mem.
Seif ב: here both are caught, each with respect to the other. The Taz (ס״ק ב), in the Ran's name, explains why: “לך” is understood also of what is yours. A single letter separates this case from the next.
He says “כנדרי כשרים this loaf is upon me קונם”.
Seif ד: although he pronounced the strongest word in the language of vows — קונם —, it does not bind, for the first words nullify it (Shach ס״ק ח, Taz ס״ק ה). Word order decides, and intention does not rescue the form.
He says: “I vow that I shall not eat at your house”.
Seif ה: it is not even a יד, because it is the language of the oath and not of the vow (Shach ס״ק ט, Taz ס״ק ו). And yet the Shulchan Arukh concludes that a התרה is required, because people commonly speak that way. It is the siman's clearest example: “it does not bind” never amounts to “there is nothing to do”.

10. Synthesis and comprehension questions

Five seifim, one question: how much must be said to be bound? (א) A word begun binds if it lets the vow be guessed — and the Mehaber gives each unfinished formulation the effect its root indicates (speaking, doing business, standing within four cubits), while the Rosh, the Tur and the Ran hold that unfinished it binds nothing. (ב) לך binds both men, ממך binds only one. (ג) מנודה and משמתינא are words of excommunication; נדינא is a word of vow — and the Shach (ס״ק ה) finds the Mehaber's position difficult. (ד) One attaches to the vows of the רשעים (who vow) and not to those of the כשרים (who give) — to the point that those words nullify a קונם that follows them. (ה) And the formulation that binds the person is not even a יד — yet it still requires a התרה, because people speak that way.
  1. What is a יד, and where does the image of the handle come from?
  2. What does מוכיחות קצת mean, and why is that condition the heart of the siman?
  3. Why does מודרני ממך unfinished forbid speaking, and מרוחקני ממך standing within four cubits?
  4. What is the difference between “מודר אני לך” and “מודר אני ממך”, and how does the Taz explain it?
  5. Why does the Shach (ס״ק ה) find the Mehaber's position at seif ג incoherent?
  6. Why does “כנדרי רשעים” bind while “כנדרי כשרים” does not?
  7. How can the words “כנדרי כשרים” nullify a קונם pronounced after them?
  8. Why is “I vow that I shall not eat” not even a יד — and why is a התרה nonetheless required?
