The neighbouring simanim settled the meal and what surrounds it. This one no longer settles an act: it settles an intention. It has but one seif, and six things stand within it: the nap, its measure, the Rema's gloss, the verse, the five domains, and the closing rule. Hebrew text, translation and explanation, with a section of practical cases.

A siman of a single sentence, which begins with a nap and ends with the whole of a life. The Mechaber first permits what one would not expect a book of law to permit: « אם אי אפשר לו ללמוד בלא שינת הצהרים יישן » (שו״ע או״ח רל״א:א) — one who cannot study in the afternoon without sleeping a little, let him sleep. Then he sets the measure, taken from the Gemara: « אמר רב אסור לאדם לישן ביום יותר משינת הסוס וכמה שינת הסוס שיתין נשמי » (סוכה כ״ו ע״ב). And out of that small permission he draws, in one breath, the widest rule in all of Orach Chayim: « וכן בכל מה שיהנה בעוה״ז לא יכוון להנאתו אלא לעבודת הבורא יתברך כדכתיב בכל דרכיך דעהו » (שו״ע או״ח רל״א:א). summary: if sleep can become service because it serves study, then nothing lies outside. We study here at the level of principle; for personal practice, one follows the ruling of one's Rav.

📑 Plan of the study

A. הכלל — לשון הסעיף — the text, its translation, and the hinge of the siman
B. שינת הצהרים — the nap permitted, and on what condition
C. שתין נשמי — the measure, and the Arukh haShulchan's astonishment
D. הגהת הרמ״אאלהי נשמה on waking, ויהי נועם before sleeping
E. בכל דרכיך דעהו — the verse that changes the scale
F. חמש הדרכים — the five domains, and כללו של דבר
1-3. Practical cases — and review questions

A. הכלל — the seif and its hinge

לְשֵׁם שָׁמַיִם — "for the sake of Heaven". Here this is not an added layer of piety on an action already good: it is the qualification of the action itself. The siman is about to show that one and the same act — sleeping, eating, walking, speaking — changes its nature according to the end a person gives it, and that this end lies in his hands.

The seif —

That all one's intentions be for the sake of Heaven. And it contains one seif: if it is impossible for him to study without the afternoon nap, let him sleep. Gloss (Rema): and when he wakes from his sleep he need not recite the blessing אלהי נשמה (Beit Yosef); and some say that he should read ויהי נועם before sleeping (Kol Bo). Provided that he does not prolong it, for it is forbidden to sleep by day more than the sleep of a horse, which is sixty breaths. And even in that little, let his intention not be the pleasure of his body, but to strengthen his body for the service of Hashem. And likewise with everything he enjoys in this world: let him not aim at his own pleasure but at the service of the Creator, blessed be He, as it is written, ‘in all your ways know Him’. And the Sages said: let all your deeds be for the sake of Heaven — for even optional matters, such as eating, drinking, walking, sitting, rising, marital relations and conversation, and all the needs of your body, should all be for the service of your Creator or for what brings about His service. For even if he was thirsty and hungry, if he ate and drank for his own pleasure it is not praiseworthy; rather let him intend to eat and drink according to what sustains his life, in order to serve his Creator. And likewise, even to sit in the counsel of the upright, to stand in the place of the righteous and to walk by the advice of the wholehearted: if he did so for his own enjoyment and to fulfil his desire, it is not praiseworthy, unless he did so for the sake of Heaven. And likewise with lying down: needless to say, at a time when he can occupy himself with Torah and mitzvot he should not indulge in sleep for his own delight; but even at a time when he is exhausted and needs to sleep to rest from his weariness, if he did so for the pleasure of his body it is not praiseworthy; rather let him intend to give sleep to his eyes and rest to his body for the need of health, so that his mind not be confused in Torah for lack of sleep. And likewise with marital relations: even at the time prescribed by the Torah, if he did so to fulfil his desire or for the pleasure of his body, it is unseemly; and even if he intended to have children who would serve him and take his place, it is not praiseworthy; rather let him intend to have children for the service of his Creator, or to fulfil the mitzvah of onah like a man paying his debt. And likewise with conversation: even to speak of matters of wisdom, his intention must be the service of the Creator or what brings about His service. The rule of the whole matter: a person is obliged to set his eyes and his heart upon his ways and to weigh all his deeds in the scales of his understanding; and when he sees a thing that will bring him to the service of the Creator, let him do it; and if not, let him not do it. And one who conducts himself thus serves his Creator continually.
Where are we? The Tur opened this passage as the continuation of the order of the day: « אחר שגמר סעודתו יחזור ללמוד » (טור או״ח סימן רל״א) — after he has finished his meal he returns to study. The Be'er haGolah notes the sources in a word: « לשון הטור » (באר הגולה או״ח רל״א), and for the measure of the nap, סוכה כ״ו (באר הגולה או״ח רל״א).
The hinge of the siman Everything turns on one clause of the seif: « ואף בזה המעט לא תהא כוונתו להנאת גופו אלא להחזיק גופו לעבודת הש״י » (שו״ע או״ח רל״א:א). summary: even in that little sleep the intention must be to keep the body standing for service — and that is precisely the reasoning the seif will now apply to everything else.
Where the second half comes from It is not the Mechaber's own: it comes from Rabbeinu Yonah on Pirkei Avot, by way of the Tur. The Tur says so himself: « וכן סדר ה״ר יונה הענין בפרקי אבות » (טור או״ח סימן רל״א), and the Be'er haGolah puts it in three words: « טור בשם רבי יונה בפרקי אבות » (באר הגולה או״ח רל״א).

B. שינת הצהרים — the nap, and on what condition

The ruling « אם אי אפשר לו ללמוד בלא שינת הצהרים יישן » (שו״ע או״ח רל״א:א). summary: the permission is not granted to the tired man, it is granted to the student — it is the study that follows which makes the sleep legitimate.
The Tur's wording « ואם אי אפשר לו ללמוד בלא שינת הצהרים יישן ובלבד שלא יאריך בה הרבה » (טור או״ח סימן רל״א). summary: the Tur does not say ‘it is forbidden’, he says ‘provided he does not prolong it much’. That difference stands at the centre of Level 2.
Where the Mishnah Berurah sends us « עיין לעיל בסימן ד׳ סט״ז ובמשנה ברורה שם » (משנה ברורה, מ״ב רל״א:א) — she refers back to siman 4, where daytime sleep has already been discussed. There the seif reads: « דוד היה נזהר שלא לישן שיתין נשמין » (שו״ע או״ח ד׳:ט״ז), and the Rema adds: « ובגמרא פ׳ הישן משמע דדוקא ביום היה נזהר » (שו״ע או״ח ד׳:ט״ז).
And one who works? The Arukh haShulchan explicitly widens the permission: « ואף גם מי שצריך לפרנס אשתו ובניו במלאכה או במסחור וצריך לנוח ביום כדי לעמול בפרנסתו גם כן רשאי » (ערוך השלחן רל״א:ד). summary: one who must support his wife and children and needs to rest by day in order to labour at his livelihood is likewise permitted — for that livelihood itself serves the very same end.

C. שתין נשמי — the measure

The ruling « ובלבד שלא יאריך בה שאסור לישן ביום יותר משינת הסוס שהוא שתין נשמי » (שו״ע או״ח רל״א:א). summary: sixty breaths — the measure of a horse's sleep.
The talmudic source « אמר רב אסור לאדם לישן ביום יותר משינת הסוס וכמה שינת הסוס שיתין נשמי » (סוכה כ״ו ע״ב). And the Gemara at once gives the chain of that measure: « שנתיה דמר כדרב ודרב כדרבי ודרבי כדדוד ודדוד כדסוסיא ודסוסיא שיתין נשמי » (סוכה כ״ו ע״ב).
And yet Abbaye slept longer « אביי הוה ניים כדמעייל מפומבדיתא לבי כובי קרי עליה רב יוסף עד מתי עצל תשכב מתי תקום משנתך » (סוכה כ״ו ע״ב). summary: Abbaye would sleep the time it takes to go from Pumbedita to Bei Kuvei, and Rav Yosef applied to him the verse about the sluggard. The Arukh haShulchan leans on this passage to say that the measure is not an absolute figure.
The Arukh haShulchan's astonishment He first notes that the Rambam did not cite this measure at all: « והנה הרמב״ם לא הביא זה כלל וטעמו פשוט » (ערוך השלחן רל״א:א); then he raises the difficulty on the Mechaber's own word: « וקשה מנא לן איסור זה דהרמב״ם לא הביא זה כלל וגם הטור לא כתב איסור על זה » (ערוך השלחן רל״א:ג); and he concludes: « ובוודאי בענין כזה הכל לפי מה שהוא אדם » (ערוך השלחן רל״א:א), adding what he himself had seen: « וכן ראינו לגדולי עולם שהיו ישנין ביום כשעה או שתים דכך הוצרכו לפי חלישותם ולפי הנהגתם » (ערוך השלחן רל״א:א). In practice, one follows one's Rav.
The Eliyah Rabbah's question « קשה דלעיל סימן ד׳ סעיף ט״ו משמע שאינו אלא ממדת חסידות וליכא איסור » (אליה רבה רל״א:א) — in siman 4 it was only a measure of piety, with no prohibition; and the reason there was different: « גם כתב שם הטעם משום שטועם טעם מיתה והכא כתב כדי שלא יתבטל » (אליה רבה רל״א:א). summary: there, daytime sleep is avoided because it gives a taste of death; here, because it costs one's study.

On waking, one does not repeat The reason, according to the Mishnah Berurah: « אפשר הטעם דנתקנה ברכה זו על מנהגו של עולם שהקב״ה מחזיר הנשמות לבני האדם בבוקר » (משנה ברורה, מ״ב רל״א:ב). summary: the blessing was instituted upon the order of the world — the return of souls in the morning — and not upon every waking.
But not everyone held so The Beit Yosef reports the opposite: « כתב האגור בסי׳ ג׳ בשם רבינו יהודה משפייר״א שכאשר נעור משנתו של שינת היום צריך לברך אלהי נשמה » (בית יוסף או״ח סימן רל״א), and adds: « וכ״כ בשבלי הלקט בשם רבינו שמחה וה״ר אביגדור הכהן ולא נהגו כן » (בית יוסף או״ח סימן רל״א). summary: the Agur in the name of Rabbeinu Yehudah of Speyer, and the Shibbolei haLeket in the name of Rabbeinu Simchah and Rabbi Avigdor haKohen, held that one does repeat the blessing — but the custom did not follow them.
The Kaf haChaim sums up the position « האגור בסי׳ ג׳ כתב בשם ר״י משפירא שכאשר נעור משנתו של שינת היום צריך לברך אלהי נשמה » (כף החיים רל״א:א), then: « וכ״פ הב״ח דא״צ לברך אלהי נשמה » (כף החיים רל״א:א), and he adds the reason of the kabbalists: « וכ״נ לפי דברי המקו׳ שאין מקום לברכה זו ביום » (כף החיים רל״א:א).
And the blessing over Torah? The Ateret Zekenim joins a second case to it: « וכשנעור משנתו אין צריך לברך אלהי נשמה כו׳ וכן אין צריך לברך ברכת התורה » (עטרת זקנים או״ח רל״א). The Tur had set it down at the end of the siman: « ואם ישן שינת עראי מיושב על אצילי ידיו א״צ לברך ברכת התורה כשיחזור ללמוד » (טור או״ח סימן רל״א), and the Beit Yosef refers elsewhere: « ואם ישן שינת עראי וכו׳ עד סוף הסימן נתבאר בסימן מ״ז » (בית יוסף או״ח סימן רל״א). In practice, one follows one's Rav.
The motive, according to the Magen Avraham: « ויהי נועם משום סכנת המזיקין » (מגן אברהם רל״א:א); and the Mishnah Berurah adds the actual custom: « ויהי נועם משום סכנת מזיקין וכתב הלבוש שאין נוהגין כן » (משנה ברורה, מ״ב רל״א:ג). The source is the Kol Bo: « והר״מ היה נוהג כששכב עצמו לישן ביום לקרא ויהי נועם » (כל בו סימן כ״ט). The Arukh haShulchan concludes likewise: « ויש אומרים שיקרא קודם שישן ביום ויהי נועם משום מזיקין » (ערוך השלחן רל״א:ג), « וגם בזה אין אנו נוהגים » (ערוך השלחן רל״א:ג).

E. בכל דרכיך דעהו — the verse that changes the scale

From the particular to the whole « וכן בכל מה שיהנה בעוה״ז לא יכוון להנאתו אלא לעבודת הבורא יתברך כדכתיב בכל דרכיך דעהו » (שו״ע או״ח רל״א:א), and then: « ואמרו חכמים כל מעשיך יהיו לש״ש » (שו״ע או״ח רל״א:א). summary: the very rule just stated about sleep is now stated about everything a person enjoys in this world.
The verse « בכל דרכיך דעהו והוא יישר ארחתיך » (משלי ג׳:ו׳). And the Gemara makes it the key to the whole Torah: « דרש בר קפרא איזוהי פרשה קטנה שכל גופי תורה תלויין בה בכל דרכיך דעהו והוא יישר ארחתיך » (ברכות ס״ג ע״א) — which is the short passage on which all the bodies of Torah depend? And Rava adds a formidable line: « אמר רבא אפילו לדבר עבירה » (ברכות ס״ג ע״א).
The mishnah quoted « רבי יוסי אומר יהי ממון חברך חביב עליך כשלך והתקן עצמך ללמד תורה שאינה ירשה לך וכל מעשיך יהיו לשם שמים » (משנה אבות ב׳:י״ב) — the closing clause is the one the Mechaber invokes. The Vilna Gaon gives both references in a single stroke: « וכן בכל כו׳ כדכתי׳ כו׳ ברכות ס״ג א׳ ובאבות דר״נ פי״ז » (ביאור הגר״א או״ח רל״א).
The Rambam had made a chapter of this « צריך האדם שיכון לבו וכל מעשיו כלם לידע את השם ברוך הוא בלבד ויהיה שבתו וקומו ודבורו הכל לעמת זה הדבר » (רמב״ם הלכות דעות פרק ג הלכה ב); and for food: « אלא ישים על לבו שיאכל וישתה כדי להברות גופו ואיבריו בלבד » (רמב״ם הלכות דעות פרק ג הלכה ב); and for the body: « ישים על לבו שיהא גופו שלם וחזק כדי שתהיה נפשו ישרה לדעת את ה׳ » (רמב״ם הלכות דעות פרק ג הלכה ג).
A safeguard in that same chapter The Rambam had opened the chapter by rejecting asceticism: « לפיכך צוו חכמים שלא ימנע אדם עצמו אלא מדברים שמנעתו התורה בלבד » (רמב״ם הלכות דעות פרק ג הלכה א). summary: intention is not won by depriving oneself of the permitted, but by directing the permitted.

F. חמש הדרכים — the five domains

The announcement « שאפילו דברים של רשות כגון האכילה והשתיה וההליכה והישיבה והקימה והתשמיש והשיחה וכל צרכי גופך יהיו כולם לעבודת בוראך או לדבר הגורם עבודתו » (שו״ע או״ח רל״א:א). summary: five domains are named, and together they cover a person's entire day.
The Mishnah Berurah reports a practice: « וראיתי לאנשי מעשה שקודם אכילה היו אומרים הנני רוצה לאכול ולשתות כדי שאהיה בריא וחזק לעבודת הש״י » (משנה ברורה, מ״ב רל״א:ה) — men of deed would say before eating that they wish to eat and drink so as to be healthy and strong for the service of Hashem.
The Mishnah Berurah softens this: « ומ״מ טוב הוא דמתוך כך בא לשמה » (משנה ברורה, מ״ב רל״א:ו) — it is not praiseworthy, yet it is good, for through it one comes to act for its own sake. The Magen Avraham had written it before her: « בסוד ישרים וכו׳ אינו משובח ומ״מ טוב הוא דמתוך כך בא לשמה » (מגן אברהם רל״א:ב).
3. שכיבה — lying down « וכן בשכיבה אין צריך לומר שבזמן שיכול לעסוק בתורה ובמצות לא יתגרה בשינה לענג עצמו » (שו״ע או״ח רל״א:א), « אלא יתכוין לתת שינה לעיניו ולגופו מנוחה לצורך הבריאות שלא תטרף דעתו בתורה מחמת מניעת השינה » (שו״ע או״ח רל״א:א). summary: here the siman returns to its opening, except that sleep is now only one instance of a general rule.
The Mishnah Berurah refers elsewhere for further intentions: « ועיין עוד כונות אחרות בסימן ר״מ ס״א ואחר כונת הלב הן הדברים ורחמנא לבא בעי » (משנה ברורה, מ״ב רל״א:ז) — and the essential thing, she adds, is the intention of the heart.
And the Mishnah Berurah extends it as far as commerce: « וכ״ש אם סיפורו הוא בעניני משא ומתן צריך שתהיה כונתו לשם מצוה דהיינו שיהיה לו במה להתפרנס כדי שלא יבוא ליד גזל » (משנה ברורה, מ״ב רל״א:ח), and further: « או שכונתו ליקח עסקים תחת רשותו כדי להמציא מלאכה לעניי ישראל שישתכרו להחיות נפשם שכל זה הוא בכלל צדקה ומעולה ממנה כמו שכתב הרמב״ם » (משנה ברורה, מ״ב רל״א:ח) — providing work for the poor of Israel is included in tzedakah and is higher than it, « שהמחזיק ביד ישראל שמך ונותן לו מלאכה כדי שישתכר ולא יצטרך לבריות לשאול » (משנה ברורה, מ״ב רל״א:ח). The Eliyah Rabbah had already warned about speech: « צריך אדם ליזהר בדיבור כמו במעשה גם אל יצא דבר מגונה מפיו » (אליה רבה רל״א:ב).
Rabbeinu Yonah wrote it thus: « כללו של דבר חייב אדם לשום עיניו ולבו על דרכיו ולשקול את כל מעשיו במאזני שכל » (רבינו יונה על פרקי אבות ב׳:י״ב); and the Tur adds the example of Rabbi: « ועל הדרך הזה זקף רבינו הקדוש אצבעותיו למעלה בשעת מיתתו ואמר גלוי וידוע לפניך שלא נהניתי מהם אלא לש״ש » (טור או״ח סימן רל״א), whose words the Gemara reports: « בשעת פטירתו של רבי זקף עשר אצבעותיו כלפי מעלה אמר רבונו של עולם גלוי וידוע לפניך שיגעתי בעשר אצבעותי בתורה ולא נהניתי אפילו באצבע קטנה » (כתובות ק״ד ע״א).
The siman in one sentence: a nap permitted to one who cannot study without it, measured and not prolonged, becomes the model for all of ordinary life — בכל דרכיך דעהו — because a permitted act is worth exactly what the end given to it is worth. In practice, one follows one's Rav.

Practical cases

Case 1 — A nap after the midday meal

Situation: one has a fixed study session in the afternoon, but after the meal the eyes close and nothing is retained. May one go and sleep for a while?
Conduct: This is exactly the case of the seif: « אם אי אפשר לו ללמוד בלא שינת הצהרים יישן » (שו״ע או״ח רל״א:א). Here the nap is the condition of the study, not its opposite — but it remains bounded: « ובלבד שלא יאריך בה שאסור לישן ביום יותר משינת הסוס שהוא שתין נשמי » (שו״ע או״ח רל״א:א). And the Arukh haShulchan recalls that the measure follows the person: « ובוודאי בענין כזה הכל לפי מה שהוא אדם » (ערוך השלחן רל״א:א). In practice, one follows one's Rav.

Case 2 — On waking from the nap

Situation: one wakes from an hour's sleep, mind as clouded as in the morning. Does one repeat
Conduct: No, according to the Rema: « וכשנעור משנתו א״צ לברך אלהי נשמה » (רמ״א או״ח רל״א:א), and the Mishnah Berurah gives the reason: « אפשר הטעם דנתקנה ברכה זו על מנהגו של עולם שהקב״ה מחזיר הנשמות לבני האדם בבוקר » (משנה ברורה, מ״ב רל״א:ב). The Beit Yosef notes that other Rishonim held the opposite: « כתב האגור בסי׳ ג׳ בשם רבינו יהודה משפייר״א שכאשר נעור משנתו של שינת היום צריך לברך אלהי נשמה » (בית יוסף או״ח סימן רל״א) — but he concludes: « וכ״כ בשבלי הלקט בשם רבינו שמחה וה״ר אביגדור הכהן ולא נהגו כן » (בית יוסף או״ח סימן רל״א). The Arukh haShulchan rules likewise: « ואחר שיעור משנתו אין צריך לברך ברכת אלקי נשמה דאין זה רק בבוקר » (ערוך השלחן רל״א:ג). In practice, one follows one's Rav.

Case 3 — A whole day of work

Situation: the day is spent at work, in business, far from any study. Has this siman anything to say about those hours?
Conduct: It says the essential thing about them. The Mishnah Berurah states it explicitly: « וכ״ש אם סיפורו הוא בעניני משא ומתן צריך שתהיה כונתו לשם מצוה דהיינו שיהיה לו במה להתפרנס כדי שלא יבוא ליד גזל » (משנה ברורה, מ״ב רל״א:ח), and goes further: « או שכונתו ליקח עסקים תחת רשותו כדי להמציא מלאכה לעניי ישראל שישתכרו להחיות נפשם שכל זה הוא בכלל צדקה ומעולה ממנה כמו שכתב הרמב״ם » (משנה ברורה, מ״ב רל״א:ח). The Arukh haShulchan had already said it of the nap itself: « ואף גם מי שצריך לפרנס אשתו ובניו במלאכה או במסחור וצריך לנוח ביום כדי לעמול בפרנסתו גם כן רשאי » (ערוך השלחן רל״א:ד), and of the rest: « וכן בכל מה שיהנה בעולם הזה לא תהא העיקר בשביל הנאת גופו שזהו מעשה בהמה » (ערוך השלחן רל״א:ד). In practice, one follows one's Rav.
