The preceding siman spoke of a man’s intentions in what he does; this one opens the laws of the Minha prayer — and opens them by guarding that prayer from whatever might make him miss it. Three seifim, five occupations, one threshold of time and one line: at what point does an occupation become a danger to prayer? A prayer that falls in the middle of the day is a prayer one may forget: the whole siman is built on that fear. When time is already short, one shortens — מגן ומחיה through האל הקדוש, so as not to lose the Kedushah. When time remains but is counted, one does not begin what may run long: a haircut, the bath, the tannery, a court case, a meal. And once begun, one does not interrupt — unless there will not be enough left to pray. We study here at the level of principle; for personal practice, one follows one’s Rav’s ruling.

A. אם השעה דחוקה — when time is already short
אִם הַשָּׁעָה דְּחוּקָה — if the hour is pressed. The siman opens not on a prohibition but on a rescue: what is to be done when the day is drawing to its close and there is no longer room for the silent Amidah followed by its repetition? The Beit Yosef gives the Gaonic answer:
« ותקנתייהו דמצלי כולהו בלחש במצות תפלה והדר נחית ש״ץ ואומר מגן ומחיה וענו קדושה ומסיים האל הקדוש אם אין שהות ביום למיגמר י״ח ברכות והכי נהוג רבנן במתיבתא כד דחיקא להו שעתא וכן ראוי לעשות » (בית יוסף או״ח סימן רל״ב)
Seif 1 — אם השעה דחוקה
אם השעה דחוקה יתפללו בלחש ואח״כ יאמר ש״ץ מגן ומחיה ויענה קדושה ומסיים האל הקדוש אם אין שהות ביום לגמור י״ח ברכות: הגה וי״א שמתפלל השליח צבור עם הקהל בקול רם וכן נוהגים וע״ל סי׳ קכ״ד סעיף ב׳:
Seif 1: if the hour is pressed, they shall pray silently, and afterwards the reader will say “Magen” and “Mechayeh”, and they will answer Kedushah, and he concludes with “HaEl HaKadosh” — if there is not enough time in the day to complete the eighteen blessings. Gloss of the Rama: and some say that the reader prays together with the congregation aloud, and so is the custom; and see above siman 124, seif 2.
What “the hour is pressed” means.
« דהיינו שאין שהות ביום שיתפללו מתחלה הצבור בלחש ואח״כ גם חזרת הש״ץ כראוי » (משנה ברורה, מ״ב רל״ב:א). summary : this is not mere lateness but a calculation: the remaining day no longer holds both the silent Amidah and a full repetition
Why the congregation does not rely on the reader’s loud prayer.
« היינו שלא יסמכו הצבור מפני הדחק לצאת רק בתפלת הש״ץ שיתפלל בקול רם דעיקר תפלה בלחש הוא ורק הש״ץ יקצר בתפלתו שבקול ולא יאמר כ״א ג׳ ראשונות להוציאן ידי חובתן בקדושה » (משנה ברורה, מ״ב רל״ב:ב); and the Aruch HaShulchan says it in one line:
« ולמה לא יתפללו כולם בשוה, הציבור בלחש ושליח הציבור בקול רם, משום דמצות תפלה היא בלחש ואין שליח הציבור יוצא כשיתפלל רק בקול רם » (ערוך השלחן או״ח סימן רל״ב). summary : the mitzvah of the Amidah is to say it silently; the reader therefore cannot discharge the congregation by saying it aloud, which is why the usual order is reversed
The Gaonic source of this seif. The Beit Yosef brings it from the Shibbolei HaLeket, who had it from Rabbenu Ephraim in the name of Rav Hai Gaon:
« ותקנתייהו דמצלי כולהו בלחש במצות תפלה והדר נחית ש״ץ ואומר מגן ומחיה וענו קדושה ומסיים האל הקדוש אם אין שהות ביום למיגמר י״ח ברכות והכי נהוג רבנן במתיבתא כד דחיקא להו שעתא וכן ראוי לעשות » (בית יוסף או״ח סימן רל״ב). summary : this is no late expedient: it is what the masters of the Babylonian academy did when the hour pressed them
The Rama’s gloss, and how it is carried out. The Rama writes:
« וי״א שמתפלל השליח צבור עם הקהל בקול רם וכן נוהגים » (שו״ע או״ח רל״ב:א); and the Mishnah Berurah gives its practice:
« היינו שהש״ץ אומר מיד בקול רם והקהל יאמר עמו בלחש מלה במלה עד לאחר האל הקדוש וטוב שיהיה עכ״פ אחד שיענה אמן על ברכת הש״ץ » (משנה ברורה, מ״ב רל״ב:ד). summary : for the Rama the reader begins aloud at once while the congregation follows him word by word in silence, and one takes care that at least one person be able to answer amen
How far does “the day” run?
« עיין לקמן בסימן רל״ג ס״א בהג״ה מתי נגמר היום לענין תפלת המנחה ועיין במ״ב שם » (משנה ברורה, מ״ב רל״ב:ג). summary : the measure of the time remaining is not given here: it is taken from the next siman, which fixes the end of Minha’s time
The custom described by the Aruch HaShulchan — and the Arizal’s insistence.
« אבל מנהגינו באופן אחר, והוא הדרך המעולה, והיינו שאם השעה דחוקה עומד שליח הציבור ואומר חצי קדיש אחר ׳אשרי׳, ומברך ג׳ ראשונות בקול רם והציבור שותקין ועונין ג׳ אמנין אלו ועונין קדושה » (ערוך השלחן או״ח סימן רל״ב); but:

סָמוּךְ לַמִּנְחָה — as Minha approaches. The Mishnah of the first chapter of Shabbat is the source of the whole seif:
« לֹא יֵשֵׁב אָדָם לִפְנֵי הַסַּפָּר סָמוּךְ לַמִּנְחָה עַד שֶׁיִּתְפַּלֵּל. לֹא יִכָּנֵס אָדָם לַמֶּרְחָץ, וְלֹא לַבּוּרְסְקִי, וְלֹא לֶאֱכוֹל, וְלֹא לָדִין, וְאִם הִתְחִילוּ — אֵין מַפְסִיקִין. » (שבת ט׳ ע״ב). And the Tur says why this prayer in particular needs guarding:
« אבל של מנחה שהיא באמצע היום בעוד שהוא טרוד בעסקיו צריך לשום אותה אל לבו ולפנות מכל עסקיו ולהתפלל אותה ואם עשה כן שכרו הרבה מאד » (טור או״ח סימן רל״ב)
Seif 2 — חמשה דברים שאין מתחילין בהם

Seif 2: a man should not sit down for a haircut as Minha approaches until he has prayed; nor should he enter the bathhouse, nor the tannery (the place where hides are tanned), nor a court case, nor sit down to eat — even a small meal — as Minha Gedola approaches. And if he began any one of these, he does not interrupt, even though he began in a forbidden manner — provided there remains time in the day to pray after he finishes his meal or his work; but if there is no time to pray afterwards, he must interrupt at once. And from when is there a beginning? For a haircut, from when the barbers’ cloth is placed on his knees; for the bath, from when he removes his outer garment; for the tannery, from when he ties the cloth between his shoulders in the manner of tanners; for a court case, if they were already engaged in it, from when the litigants begin to plead, and if they were not engaged in it, from when the judges wrap themselves — and for us, from when they sit down with the intention of judging; and for the meal, from when he washes his hands. Gloss of the Rama: and some disagree and hold that a small meal is permitted, and that only a wedding or circumcision meal is forbidden (Tur in the name of Rabbenu Tam); and some say that even a large meal is permitted as Minha Gedola approaches (Baal HaMaor and Hagahot Mordechai, first chapter of Shabbat); and some say that a small meal is permitted even as Minha Ketana approaches (Tur in the name of the Ri). And the custom has become to be lenient according to both views, that is: a large meal as Minha Gedola approaches, and a small meal as Minha Ketana approaches; and the reason is perhaps that nowadays they call people to the synagogue, so we no longer fear that he will be negligent and not pray (Agudah, first chapter of Shabbat) (and see above siman 89). However, for a large meal one should be stringent even as Minha Gedola approaches; and even if he began before that, when Minha Ketana arrives and the hour is passing, he must rise and pray (Tur and Beit Yosef in the name of the Poskim).
Which Minha is meant? The Gemara asks:
« הֵי ״סָמוּךְ לַמִּנְחָה״? אִילֵּימָא לְמִנְחָה גְּדוֹלָה — אַמַּאי לָא? הָאִיכָּא שְׁהוּת בַּיּוֹם טוּבָא! אֶלָּא סָמוּךְ לְמִנְחָה קְטַנָּה. » (שבת ט׳ ע״ב) — but the halakhah took Minha Gedola, and the Mishnah Berurah gives its measure:
« היינו חצי שעה קודם דהוא תחלת שעה שביעית שהוא מחצי היום ומעלה ואין חילוק בין היום ארוך או קצר לעולם חשבינן לדעה זו סמוך למנחה אחר חצי היום » (משנה ברורה, מ״ב רל״ב:ז). summary : the prohibition opens half an hour before Minha Gedola, that is, from solar midday — and that half hour neither stretches nor shrinks with the length of the day
The shears that break.
« האי סמוך למנחה היינו סמוך למנחה גדולה כאשר כתב המחבר בסוף דבריו ואכולהו קאי ואף שעד סוף זמן המנחה יש שהות הרבה אפ״ה חיישינן שמא ישבר הזוג ויחזר אחר אחרת ויעבור המנחה » (משנה ברורה, מ״ב רל״ב:ו); the Magen Avraham had said it before her:
« שמא ישבר הזוג ויחזור אחר אחרת ויעבור המנח׳ ואפשר שאם יש לו ב׳ או ג׳ זוגים שרי » (מגן אברהם או״ח סימן רל״ב). summary : it is not the haircut itself that is feared but the mishap: a broken tool, and one runs after another until the hour has gone
The bathhouse and the tannery.
« אפילו להזיע בעלמא… לכולא מלתא דמרחץ » (משנה ברורה, מ״ב רל״ב:ח); and for the tannery:
« אפילו לעיוני בעלמא שמא יראה שנתקלקלו העורות ויצטער ויהיה טרוד בצערו ולא יתפלל » (משנה ברורה, מ״ב רל״ב:ט) — whence a modern application:
« ולכן אותם היוצאים לירידים שטרודים בקניית ומכירת סחורה לא יתחילו לכתחלה סמוך לזמן מנחה גדולה עד שיתפללו מקודם » (משנה ברורה, מ״ב רל״ב:ט). summary : the fear is not the same in each: in the bath it is fainting, in the tannery the loss he may discover there and that swallows his mind — and the Mishnah Berurah extends the rule to fairs and to business
Even the closing of a case.
« אפילו שמעו טענותיהם מכבר ועתה ראו לישב בשביל גמר דין אסור שמא יראו טעם ויסתרו הדין וימשך הענין » (משנה ברורה, מ״ב רל״ב:י). summary : one might have thought that a case already argued takes no more time; but a reason seen at the last moment undoes the verdict and starts it over
Small meal, large meal.
« היינו סעודת כל אדם [וסעודה גדולה הוא של נישואין ומילה] והטעם דחיישינן שמא ימשך » (משנה ברורה, מ״ב רל״ב:יא); and a large meal is defined by the number of guests:
« וה״ה פדיון הבן שיש שם הרבה בני אדם מסובין יחד ועי״ז רגיל הדבר להמשך וסעודת שבת ויו״ט לא מקרי סעודה גדולה » (משנה ברורה, מ״ב רל״ב:כד). summary : the “small meal” is a man’s ordinary meal at home — Shabbat and festival included; the “large meal” is that of a wedding, a brit or a redemption of the firstborn, where the crowded table makes it run long
Why Minha and not Shacharit. The Rambam gives the reason for the decree:
« וּמֻתָּר לְהִסְתַּפֵּר וְלִכָּנֵס לַמֶּרְחָץ סָמוּךְ לְשַׁחֲרִית מִפְּנֵי שֶׁלֹּא גָּזְרוּ אֶלָּא סָמוּךְ לַמִּנְחָה שֶׁהוּא דָּבָר הַמָּצוּי שֶׁרֹב הָעָם נִכְנָסִין שָׁם בַּיּוֹם. » (רמב״ם הלכות תפלה פרק ו הלכה ז). summary : the Sages decreed only where the risk is common: one enters the bath and the barber’s during the day, not at dawn

« ונהגו להקל כשתי הסברות דהיינו בסעודה גדולה סמוך למנחה גדולה ובסעודה קטנה סמוך למנחה קטנה ואפשר הטעם משום דעכשיו קוראין לבה״כ לא חיישינן דלמא יפשע ולא יתפלל » (שו״ע או״ח רל״ב:ב); but:
« מיהו בסעודה גדולה יש להחמיר אפי׳ סמוך למנחה גדולה ואפי׳ אם התחיל קודם לכן כשמגיע מנחה קטנה והשעה עוברת צריך לקום ולהתפלל » (שו״ע או״ח רל״ב:ב) — and the Mishnah Berurah gives the reason:
« היינו שלא לסמוך על קריאת השמש להתחיל אז הסעודה דשכיח שכרות ובשכרות לא מהני הקריאה » (משנה ברורה, מ״ב רל״ב:ל). summary : the beadle’s call to the synagogue serves as the safeguard: forgetting is no longer feared; but a man in his cups no longer hears the call, and that is why the large meal remains under the strict rule

Seif 2 (continued) — אם התחיל אינו מפסיק, ומאימתי התחלה
Once begun, one does not interrupt.
« ואם התחיל באחת מכל אלו אינו מפסיק אף ע״פ שהתחיל באיסור והוא שיהא שהות ביום להתפלל אחר שיגמור סעודתו או מלאכתו » (שו״ע או״ח רל״ב:ב); and the Mishnah Berurah broadens it:
« אפילו התחיל אחר שהגיע כבר זמן מנחה גדולה ואפילו אחר כך כל שלא הגיע עדיין החצי שעה שקודם מנחה קטנה » (משנה ברורה, מ״ב רל״ב:יג);
« היינו אפילו התחיל סעודה גדולה או שנכנס לבורסקי גדולה וכה״ג בשארי דברים כאשר הזכרנו בפתיחה דבודאי יש לחוש בהו שמא ימשך הרבה אפ״ה אינו מפסיק כיון שיש שהות להתפלל אחר שיגמור סעודתו או מלאכתו » (משנה ברורה, מ״ב רל״ב:יד). summary : the rule holds even for one who began in transgression and even for a large meal — the only condition is that time will remain to pray afterwards
And when time will run out.
« אבל אם אין שהות להתפלל אחר כך צריך להפסיק מיד » (שו״ע או״ח רל״ב:ב); the Mishnah Berurah notes that this is judged in advance:
« היינו אפילו עוד היום גדול כל שיודע שתמשך סעודתו או מלאכתו עד שתחשך צריך להפסיק מיד שמא ישכח ויעבור הזמן לגמרי » (משנה ברורה, מ״ב רל״ב:טז); and the Aruch HaShulchan repeats it:
« ודווקא כשישאר שהות להתפלל אחר כך, אבל אם לא ישאר שהות - אפילו התחילו בהיתר צריכין להפסיק, ואפילו עוד היום גדול כל שיודע שתמשך סעודתו עד הלילה - צריך להפסיק » (ערוך השלחן או״ח סימן רל״ב). summary : one does not wait for nightfall to discover it is too late: as soon as he knows the matter will run until evening, he stops at once, even while the day is still long
Three thresholds, three gestures.
« ומאימתי התחלת תספורת משיניח סודר של ספרים על ברכיו והתחלת מרחץ משיפשוט לבושו העליון והתחלת בורסקי משיקשור בגד בין כתפיו כדרך הבורסקים » (שו״ע או״ח רל״ב:ב) — the Gemara had set them so:
« מֵאֵימָתַי הַתְחָלַת תִּסְפּוֹרֶת? אָמַר רַב אָבִין: מִשֶּׁיַּנִּיחַ מַעְפּוֹרֶת שֶׁל סַפָּרִין עַל בִּרְכָּיו. » (שבת ט׳ ע״ב). summary : each trade has its opening gesture: the barber’s cloth on the knees, the outer garment removed at the bath, the cloth tied between the tanner’s shoulders
The court and the table.
« והתחלת דין אם היו עסוקים בו משיתחילו בעלי דינין לטעון ואם לא היו עסוקים בו משיתעטפו הדיינים ולדידן משישבו אדעתא לדון והתחלת אכילה משיטול ידיו » (שו״ע או״ח רל״ב:ב); the Gemara gave two views on the meal:
« וּמֵאֵימָתַי הַתְחָלַת אֲכִילָה? — רַב אָמַר: מִשֶּׁיִּטּוֹל יָדָיו. וְרַבִּי חֲנִינָא אָמַר: מִשֶּׁיַּתִּיר חֲגוֹרוֹ. » (שבת ט׳ ע״ב) — and the Mishnah Berurah reconciles them:
« ומי שרגיל להתיר איזורו בשעת אכילה מקרי התחלה מישתיר איזורו אף קודם נטילה » (משנה ברורה, מ״ב רל״ב:כ). summary : in our day judges no longer wrap themselves: the beginning is sitting down with intent to judge; and for the meal, the washing of the hands — or, for one accustomed to it, loosening the belt, even before
May one interrupt out of scruple? The Magen Avraham quotes the Yerushalmi:
« וכל הפטור ומפסיק נקרא הדיוט » (מגן אברהם או״ח סימן רל״ב); but the Aruch HaShulchan distinguishes:
« ומכל מקום יראה לי דאין זה אלא בהתחיל בהיתר, אבל בהתחיל באיסור - רשאי להפסיק כיון שהתחיל באיסור » (ערוך השלחן או״ח סימן רל״ב). summary : one who is exempt and acts anyway is called a boor — but that applies only to one who began permissibly; one who began in transgression may stop
D. קבע וטעימה — settling down, or tasting
קֶבַע — settling down. It is not the quantity that makes the forbidden meal but the decision to sit down to it. The Tur had already written so:
« ונ״ל דאף לר״ת שאוסר סעודה קטנה סמוך למנחה קטנה דוקא כשקובע עצמו לסעודה אבל אם אוכל כביצה כדרך שאדם אוכל מעט בלא קבע מותר כמו אכילת פירות » (טור או״ח סימן רל״ב)
Seif 3 — קובע לסעודה, ומה שמותר לטעום
והא דאסור לאכול סעודה קטנה היינו כשקובע לסעודה אבל לטעום דהיינו אכילת פירות מותר וה״ה לאכול פת כביצה כדרך שאדם אוכל בלא קבע מותר:
Seif 3: and this that it is forbidden to eat a small meal refers to one who settles himself down to a meal; but to taste, that is, to eat fruit, is permitted. And likewise to eat bread the volume of an egg, in the way a man eats without settling down: that is permitted.
Tasting is not settling down.
« והא דאסור לאכול סעודה קטנה היינו כשקובע לסעודה אבל לטעום דהיינו אכילת פירות מותר » (שו״ע או״ח רל״ב:ג); the Tur had already given the reason:
« ודוקא לאכול אסור סמוך למנחה קטנה אבל לטעום פירות מותר דאין הלכה כרבי יהושע דאמר כיון שהגיע זמן תפלת המנחה אסור לטעום עד שיתפלל » (טור או״ח סימן רל״ב). summary : the halakhah did not follow Rabbi Yehoshua ben Levi, who forbade even the smallest taste: what is forbidden is the meal one settles into
Bread, the volume of an egg.
« וה״ה לאכול פת כביצה כדרך שאדם אוכל בלא קבע מותר » (שו״ע או״ח רל״ב:ג); the Mechaber took it from the Tur:
« ונ״ל דאף לר״ת שאוסר סעודה קטנה סמוך למנחה קטנה דוקא כשקובע עצמו לסעודה אבל אם אוכל כביצה כדרך שאדם אוכל מעט בלא קבע מותר כמו אכילת פירות » (טור או״ח סימן רל״ב); and the Mishnah Berurah closes the measure:
« ולא יותר וכתב המ״א דבשתיה יותר מכביצה נמי אסור » (משנה ברורה, מ״ב רל״ב:לה). summary : an egg’s worth of bread eaten on the go, without settling down, is not a meal — but an egg, and no more

« אפילו כבר הגיע זמן מ״ק ואפילו אם אוכל הרבה פירות דזה לא מקרי סעודה. ותבשיל העשוי מחמשת המינים ג״כ מותר אם אינו קובע עלייהו » (משנה ברורה, מ״ב רל״ב:לד). summary : fruit is permitted in quantity, because it does not make a meal; and a cooked dish of the five grains follows the same rule, so long as one does not settle down over it

« דוקא ולא יותר ול״נ דלשתיה יותר מכביצ׳ אסור אף על גב דגבי סוכה מקרי עראי מ״מ הכא טעמא דלמא ממשך וזה שייך יותר בשתיה דמשכר » (מגן אברהם או״ח סימן רל״ב). summary : an ordinary drink may be taken without measure; what intoxicates, however, draws one on — and being drawn on is precisely what the siman fears

« והנה התיר פת כביצה, ומשמע אפילו פת דצריך נטילת ידים והמוציא וברכת המזון. והוא דבר תימא, דמי יכריחו שלא יאכל יותר » (ערוך השלחן או״ח סימן רל״ב); and his practical conclusion:
« וכן פירות - מותר אפילו הרבה, וכן גלוסקאות שברכתן ׳מזונות׳ מותר אפילו יותר מכביצה, דכל הני מקרו אכילת עראי » (ערוך השלחן או״ח סימן רל״ב). summary : bread that requires washing the hands and Birkat HaMazon, called “incidental”? — the Aruch HaShulchan wonders at it, and holds that the measure is not the blessing but the settling down
The siman in one sentence: Minha falls in the midst of a man’s affairs, and the whole siman guards it — shortening when time is short, forbidding one to begin what may run long, not interrupting what is already begun so long as time will remain, and leaving free what is not a meal.
Practical cases
Case 1 — The afternoon meal
Situation: I sit down to a meal after midday, before praying Minha. Is it permitted?
Conduct: The Mechaber’s letter is strict:
« ולא לדין ולא לאכול אפי׳ סעודה קטנה סמוך למנחה גדולה » (שו״ע או״ח רל״ב:ב) — and the “small meal” is indeed the ordinary meal:
« היינו סעודת כל אדם [וסעודה גדולה הוא של נישואין ומילה] והטעם דחיישינן שמא ימשך » (משנה ברורה, מ״ב רל״ב:יא). The Rama brings the broader custom:
« ונהגו להקל כשתי הסברות דהיינו בסעודה גדולה סמוך למנחה גדולה ובסעודה קטנה סמוך למנחה קטנה ואפשר הטעם משום דעכשיו קוראין לבה״כ לא חיישינן דלמא יפשע ולא יתפלל » (שו״ע או״ח רל״ב:ב); and the Aruch HaShulchan states the difficulty without hiding it:
« ולשיטה זו לא מצאנו ידינו ורגלינו בדורינו ובדורות הקודמים, ורוב אכילתינו הוא אחר חצות, ולהדיא נראה דכל ישראל לא קבלו עליהם חומרת שיטה זו וכמעט שאי אפשר לעמוד בה » (ערוך השלחן או״ח סימן רל״ב). He gives the practical key:
« ולכן מי שאינו מתפלל מנחה בציבור וודאי מחוייב להתפלל מנחה קודם אכילתו בזמן סמוך למנחה קטנה, וכל שכן אחר זמן זה, אבל המתפלל בציבור יכול לסמוך על ההתירים שכתבנו » (ערוך השלחן או״ח סימן רל״ב). summary : the real question is not the hour but the safeguard: one who prays with a minyan, which will come and call him, may rely on the leniencies; one who prays alone at home must pray before he eats. Case 2 — A haircut or a bath on Friday afternoon
Situation: on Friday afternoon I go to the barber or to the bathhouse before praying Minha.
Conduct: Seif 2 names them both:
« לא ישב אדם להסתפר סמוך למנחה עד שיתפלל ולא יכנס למרחץ ולא לבורסקי » (שו״ע או״ח רל״ב:ב). The Mishnah Berurah gives the fear about the haircut:
« האי סמוך למנחה היינו סמוך למנחה גדולה כאשר כתב המחבר בסוף דבריו ואכולהו קאי ואף שעד סוף זמן המנחה יש שהות הרבה אפ״ה חיישינן שמא ישבר הזוג ויחזר אחר אחרת ויעבור המנחה » (משנה ברורה, מ״ב רל״ב:ו); and about the bath:
« אפילו להזיע בעלמא… לכולא מלתא דמרחץ » (משנה ברורה, מ״ב רל״ב:ח). She records the pious custom:
« אמנם אנשי מעשה נוהגין להתפלל מקודם שהולכין לבית המרחץ » (משנה ברורה, מ״ב רל״ב:כט); and recalls that one relies on the beadle’s call only for a small meal:
« ודע דדוקא סעודה קטנה סומכין על קריאת השמש לבהכ״נ אבל סעודה גדולה אין סומכין על קריאה לבהכ״נ להתיר להתחיל סמוך למ״ק » (משנה ברורה, מ״ב רל״ב:כט). summary : the practice of careful men is to pray Minha before going to the bath rather than count on the reminder. For practice, follow your Rav.
Case 3 — A wedding meal that runs long
Situation: I am at a wedding meal begun before midday, and Minha Ketana arrives.
Conduct: The Rama rules:
« מיהו בסעודה גדולה יש להחמיר אפי׳ סמוך למנחה גדולה ואפי׳ אם התחיל קודם לכן כשמגיע מנחה קטנה והשעה עוברת צריך לקום ולהתפלל » (שו״ע או״ח רל״ב:ב). The Mishnah Berurah specifies which beginning he means:
« דהיינו שהתחיל הסעודה גדולה קודם חצות דאז עדיין זמן היתר לכו״ע » (משנה ברורה, מ״ב רל״ב:לא); what “the hour is passing” means:
« כיון שמשער שימשך סעודתו עד הלילה צריך לקום ולהתפלל תיכף כשיגיע זמן מנחה קטנה » (משנה ברורה, מ״ב רל״ב:לב); and why here one does not wait:
« נראה דדוקא בסעודה גדולה ומשום דשכיחא שכרות דלא סמכינן על קריאת השמש לביהכ״נ וכנ״ל לכך פוסק מיד » (משנה ברורה, מ״ב רל״ב:לג). The Beit Yosef had already dismissed the contrary argument:
« כתוב בת״ה על האוכלים בסעודת נישואין והשעה עוברת לתפלת המנחה שיש מן הגדולים שסוברים שאין עומדין להתפלל משום דחשבינן להו עוסקין במצוה ופטורה מן התפלה עכ״ל ואין ממש בסברא זו » (בית יוסף או״ח סימן רל״ב). summary : a meal of mitzvah does not exempt one from Minha; and where drink is flowing the beadle’s reminder no longer suffices — one rises and prays.
