📜 The text of the Shulchan Arukh — 7 seifim

The siman has seven seifim. The first carries the principle together with the two exceptions that bound it; it is the one most of the pilpul below works on.

1. Opening of the sugya — the mishna of Shabbat 17b and the baraita of 18a

Siman 252 is the halakhic shaping of a mishna and a baraita from the first chapter of Shabbat. The mishna lists, in five “Beit Shammai say” clauses, the cases in which one begins a labour on the eve of Shabbat and it completes itself during Shabbat: soaking ink, dyestuffs and vetch, putting bundles of flax into the oven, wool into the vat, spreading nets, selling to a non-Jew — and loading or lifting with him — handing hides to the tanner and garments to a non-Jewish launderer, which is precisely the case seif 2 develops. In each one, Beit Shammai forbids and Beit Hillel permits. It opens thus:

The baraita on the following page places those same permissions among the things that are done — water is opened to the garden on the eve and runs all day, incense is set under the clothes, salve upon the eye — and then it holds back one case, and one only:

That reserved case is what opens the whole pilpul, since the mishna did not have it. Why should the mill be anything other than the net or the vat? The gemara asks, and receives two answers, which are not the same:

What the two reasons do not share. For Rabba the trouble is the noise: the millstone is heard, and people will say that so-and-so’s mill is grinding on Shabbat. For Rav Yosef the trouble is that the vessel is working — a duty of rest borne by the object itself, which the gemara derives from a verse. The first reason is a matter of public appearance; the second, a matter of status. The whole siman turns on that choice, and the Rama’s machloket at seif 5 will restate it word for word in the Taz.

2. The חקירה on שביתת כלים — Shabbat 18a

Rav Yosef’s reason rests on a derasha, and the gemara quotes it: the verse that yields it is not the one that commands rest, but It then assigns the position:

The underlying chakira. On whom does the duty to rest fall?

How the gap may be read — and what follows is a reading, not a source:

What makes that reading tenable is the gemara’s own formulation: for Beit Shammai the prohibition holds even where the object performs no act at all. The disagreement is therefore not about the strength of a concern, but about the object of the command.

3. The halakha as ruled — like Beit Hillel

The Rambam opens his Hilkhot Shabbat on this principle, and gives the reason in a single line: שֶׁלֹּא נֶאֱסַר עָלֵינוּ לַעֲשׂוֹת מְלָאכָה אֶלָּא בְּעַצְמוֹ שֶׁל יוֹם (רמב״ם הלכות שבת פ״ג ה״א) — the prohibition bears on the day itself alone, not on what completes itself within it.
The Mehaber opens the siman with the same permission — מותר להתחיל במלאכה בערב שבת סמוך לחשיכה אף על פי שאינו יכול לגומרה מבעוד יום והיא נגמרת מאליה בשבת (שולחן ערוך אורח חיים רנ״ב:א) — and at seif 5 he names the principle instead of assuming it: ואפי׳ מוגמר מונח בכלי דאין אדם מצווה על שביתת כלים (שולחן ערוך אורח חיים רנ״ב:ה). That is Beit Hillel’s position, stated as a rule and not merely as the outcome of a machloket.
The Magen Avraham notes that the Mehaber’s wording is not neutral: אבל למ״ד דמצווה אסור כ״ה בהדיא (מגן אברהם אורח חיים רנ״ב ס״ק ט״ז) — for the view that a person is bound by the rest of his vessels, the matter would be forbidden, and the gemara says so explicitly. The permission of seif 5 is thus a stand taken, not a self-evident point.

4. שמא יחתה — a rabbinic concern

Once the rest of vessels is set aside, two reservations remain, and they are of an altogether different order: no longer the object’s status, but what the person may come to do. The first is שמא יחתה — lest he stir the coals.

The Rambam supplies the key, and it repays slow reading: In other words: what is forbidden is not forbidden because the melakha takes place on Shabbat — that has just been settled — but solely under a gezera.

Chakira: what is the gader of this concern?

What settles part of it, and what stays open. The Mishnah Berurah rules a case that bears directly on the second limb: Even where there was time enough before nightfall, the concern holds — because one may always want it better, not merely sufficient. The decree therefore does not let itself be bounded by a calculation of bare necessity.

Yet it does not become indifferent to the facts either: a few lines earlier the Rambam lays down a general rule that cuts the other way — וְכֵן כָּל דָּבָר שֶׁהָרוּחַ מַפְסֶדֶת אוֹתוֹ אֵין גּוֹזְרִין עָלָיו שֶׁמָּא יְגַלֵּהוּ וְיַחְתֶּה (רמב״ם הלכות שבת פ״ג הי״ד): whatever the air would spoil falls outside the gezera. The nafka mina one might draw from this — the pot that is not the Jew’s, and for which he has no interest in stoking — is settled by neither of those texts. It remains to be put.

5. שמא יגיס — מבשל even off the fire

The second reservation is שמא יגיס: lest he stir the contents. It is not a variant of the first, and the Mehaber underlines this by giving it its own reason within seif 1 itself:

The decisive words are the ones the Mehaber takes care to add — ואפי׳ אינה על האש (שולחן ערוך אורח חיים רנ״ב:א): the prohibition does not depend on the fire. Rashi says it in glossing the gemara’s מגיס:

The Rambam grounds the matter in a broader principle, that of shared liability in cooking: The one who stirs adds no fire — he performs one of the acts cooking requires, and that is enough.

Kashya. Rashi writes ובמבושל הוי בישול: even in what is already cooked, stirring is cooking. Yet the Magen Avraham reads the opposite in the Mehaber: If it is fully cooked there would be no prohibition left — and if Tosafot and the Rosh forbid nonetheless, it is no longer as מבשל but as צובע.

What the Mishnah Berurah answers, and it is the lamdanic heart of the section: The pot and the dyer’s vat do not fall under the same measure. In the pot, cooking has an end — once fully cooked, stirring no longer cooks. In the vat, dyeing has no end of that kind: the colour can always be made to take better. Rashi’s formulation and the Magen Avraham’s then cease to collide, provided one states which vessel is in view — and that is precisely what the Mishnah Berurah holds against the Mehaber’s unified wording.

The underlying reason is given one ס״ק further on: דע״י הגסה בקדירה רותחת מתקרב הבישול במהרה (משנה ברורה אורח חיים רנ״ב ס״ק ו). The Taz, for his part, comments no differently: he refers to siman 318 — והמגיס בקדירה כו׳. עסי׳ שי״ח בסופו: (ט״ז אורח חיים רנ״ב ס״ק א) — that is, to the very place where the question of already-cooked food is settled.

6. The חקירה on טוחה בטיט

The permission of seif 1 for a vat removed from the fire hangs on a material condition: that its mouth be sealed with clay. The gemara raises the question and answers in two words:

Chakira: what is a טוחה בטיט?

Rashi does not choose between the two: he ties them together. וטוחה - מכוסה בכיסוי שלה וטוחה בטיט סביב דכולי האי לא טרח ומידכר: (רש״י שבת י״ח: ד״ה וטוחה) — covered with its lid and sealed with clay all around, for no one will take that much trouble, and he will remember. The material obstacle does not act alone: it acts because it compels an effort, and that effort by itself reminds the person what day it is. The first limb is the means, the second is the end.

The Rambam holds to the same requirement of matter: וְאִם טָח פִּי הַתַּנּוּר בְּטִיט מֻתָּר (רמב״ם הלכות שבת פ״ג הי״ג) — an oven sealed with clay is permitted. And where he states the general rule, he says no less:

7. קציצה with the non-Jewish launderer

Seif 2 shifts ground: no longer a vessel working by itself, but a person working — one who is not a Jew. The Mehaber lays down four conditions in a single stroke:

Why קציצה — a fixed price — permits. The Mishnah Berurah says it plainly: The price being settled, the non-Jew no longer works for the Jew but for himself, to finish his own task as fast as he can.
And why its absence forbids. The Magen Avraham supplies the counter-test: One who hopes for a wage without having stipulated it works with the Jew in view — and for this the Magen Avraham refers to siman 247.
The Rama draws the same thread: The cross-reference to siman 247 is his, and it bears on the case of טובת הנאה — work done without money, in return for a favour: the Mehaber places it on the permitted side, and the Rama notes that this is disputed.

A remark of the Magen Avraham that moves the question into the modern age: Where a rate is a matter of common knowledge, there is no further need to stipulate it each time: the קציצה is treated as made. The same logic will govern, in the chapter on machines, how the new questions are to be put.

And seeing him work. Within the same seif the Mehaber adds a reservation that is not a condition of the handing over but a duty arising afterwards: The Magen Avraham attaches a discussion to it, and each voice must be returned to its author. He reports from the Beis Yosef and the Bayis Chadash that where the non-Jew receives a wage no protest is required even without a fixed price — ואם עושה בשכר אפי׳ לא קצץ א״צ למחות (ב״י וב״ח) — then sets a צ״ע against it, since a wage without a fixed price is graver than a free service; and he concludes for himself, with the Rokeach, that the dispensation holds only where a price was fixed: ולכן נ״ל דצדקו דברי הרוקח דדוקא בקצץ א״צ למחות (מגן אברהם רנ״ב ס״ק ט).

8. The חקירה on מראית עין — seif 3

Chakira: is the טוב להחמיר of seif 3 a prohibition, or only counsel?

The Magen Avraham reads the first limb and draws a practical consequence from it: פי׳ שאם רואהו עושה בשבת צריך למחות בידו אפי׳ קצץ (מגן אברהם אורח חיים רנ״ב ס״ק י) — a duty to protest, even where a price was fixed. The טוב להחמיר therefore generates an obligation, which is the mark of a prohibition rather than of counsel.

The Mishnah Berurah gives the reason, and it is entirely public: אבל אם היתה המלאכה ידוע שהוא של ישראל וגם הוא עושה אותה במקום גלוי לכל צריך למחות בידו שלא לעשות בשבת דהרואה אינו יודע שקצץ ואתו למחשדיה בשכיר יום וכנ״ל (משנה ברורה אורח חיים רנ״ב ס״ק כ״ד) — the onlooker does not know that a price was fixed, and he will suspect a day labourer.

But the Mishnah Berurah at once reports that this is disputed: The Tosefet Shabbat sets the suspicion aside where nothing shows whose linen it is, and the Chayei Adam is lenient on a further ground. The chakira therefore stays open, and the Acharonim do not close it with one voice.

9. Mehaber and Rama — wearing the garment completed on Shabbat

Seif 4 draws the consequence of seif 2, and it is there that the Mehaber and the Rama part.

PositionThe non-Jew finished during Shabbat — may the Jew wear it?Reason
The MehaberPermitted, on Shabbat itselfאדעתא דנפשיה קא עביד: the fixed price makes the non-Jew the author of his own work
The Rama (יש אוסרין)Forbidden; one must wait, after Shabbat, בכדי שיעשהקציצה removes the attribution of the act, not the benefit drawn from work done on Shabbat
The Rama himself
Where it is neededThe Rama is lenient — אם לא שצריך אליו בשבת שאז יש להקל (רמ״א שולחן ערוך אורח חיים רנ״ב:ד)The Rama himself, further on in the same gloss

The yesod this machloket lays bare. קציצה answers one question: for whom is the non-Jew working? It does not settle a second: may the Jew enjoy what was done during Shabbat? The Mehaber holds that the first answer carries the second; the Rama holds that it does not. The Magen Avraham and the Mishnah Berurah show where the line runs, by setting our case against that of a lamp lit by a non-Jew: דהכא אע״ג שהישראל נהנה בלבישתו ממלאכת שבת מ״מ א״י לא עבד בשבת בשביל הנאת ישראל רק אדעתיה דנפשיה למהר להשלים פעולתו (משנה ברורה אורח חיים רנ״ב ס״ק כ״ז) — here the non-Jew did not work on Shabbat for the Jew’s benefit, but on his own account, to finish his task as quickly as he could.

10. השמעת קול at the mill — the machloket of Tosafot and the Rosh

Here we return to the starting point. The Mehaber permits putting wheat into the water mill close to nightfall; the Rama reports that not everyone permits it:

The machloket, and its exact spring. The Taz names it, and he does so in the very terms of the gemara of section 1:

That is: the permissive position — the Mehaber’s, which the Rama restates — follows Rav Yosef, for whom the reason of the baraita was the rest of vessels — a reason we do not hold, since the halakha is like Beit Hillel; the permission therefore follows of itself. Those who forbid follow Rabba, for whom the reason was the noise — and that one does not depend on Beit Shammai: it holds even for Beit Hillel, because what is now at stake is not the vessel’s status but זלותא לשבת, the cheapening of the day.

The Rama lists those who forbid: the Tur, Tosafot and the Rosh in the third chapter of Shabbat, the Semag, the Sefer HaTeruma, the Hagahot Maimoniyot, the responsum of מהרי״ו — a siglum the gloss does not expand — and the Agur.

The practice the Rama fixes, and it has two levels: The Magen Avraham explains why loss is enough to tip the scale: כיון דאיכא פלוגתא מקלינן במקום פסידא (מגן אברהם אורח חיים רנ״ב ס״ק כ״א) — it is the very existence of a machloket that opens the leniency, not a reasoning peculiar to mills. And at the next ס״ק he adds a practical course — יש להקל. או להשכיר׳ לעכו״ם (מגן אברהם רנ״ב ס״ק כ״ב): to rent the mill to the non-Jew.

The Magen Avraham marks one further limit the page should not lose: ואיכא זילותא דשבת ואם הרחיים של עכו״ם פשיטא דשרי ליתן לתוכה מבע״י (מגן אברהם אורח חיים רנ״ב ס״ק כ) — if the mill belongs to the non-Jew, the question does not arise.

The weight-driven clock — the זייגר. The Rama permits it expressly, and his reason is of a different order from the preceding ones: it rests on what the public already knows — ומותר להעמיד כלי משקולת שקורין זייגר מע״ש אע״פ שמשמיע קול להודיע השעות בשבת כי הכל יודעים שדרכן להעמידו מאתמול (רמ״א שולחן ערוך אורח חיים רנ״ב:ה). There is no מראית עין because everyone knows such clocks are wound the day before. The rule to be drawn is clear in principle: what removes the suspicion is not the device’s silence but the common knowledge of how it works.

11. The needle and the quill close to nightfall

Kashya. The reason given is שמא ישכח ויוציא — lest he forget and carry out. But then why are tefillin, which he bears just as much, permitted? One does not forget one object less readily than another merely because it is holy.

The Mehaber answers in a brief aside — לפי שאינו שוכחן — and the Magen Avraham shows that this answer is not a petitio principii but the consequence of a rule already laid down elsewhere: הואיל ואסור לנהוג בהן קלות ראש מדכיר דכיר ומסלקו קודם שבת (מגן אברהם אורח חיים רנ״ב ס״ק כ״ה). Since it is forbidden to treat tefillin lightly, a person necessarily keeps them in mind, and removes them before Shabbat.

And the Magen Avraham sets the boundary exactly where it belongs: On the head they are not forgotten, for one may not turn his thought from them; in the hand they are forgotten — and the exception falls. It is therefore not the object’s holiness that permits, but the continuous attention that holiness imposes.

12. Modern

What follows is not a ruling: these are the questions the preceding sections allow one to put properly. Each is to be brought before a rav.

1. The washing machine started before Shabbat. The rest of vessels does not reach it — that is the halakha of seif 5. שמא יחתה and שמא יגיס do not apply either: nothing is cooking, and nothing calls for the hand. What remains is השמעת קול, and that is exactly the Rama’s machloket about the mill — so the question is one of noise audible outside, not one of machinery.

2. The programmed cooking robot. Here the parallel with the mill no longer holds, for there is cooking and there is a motion that stirs. Both questions of section 5 arise together: is that stirring a הגסה, and is the food מבושל כל צרכו at the moment it occurs? The machloket of the Magen Avraham and the Mishnah Berurah does not transpose without a ruling.

3. The oven on a timer. If everything was placed while it was still day and nothing calls for the hand, the question is that of שמא יחתה in the sense of section 4. If, on the other hand, the ignition itself occurs on Shabbat, the question has changed in kind and is no longer that of this siman.

4. Automatic heating. The rest of vessels does not stand against it, for the same reason as the washing machine.

5. The electronic alarm clock. This is the Rama’s זייגר, and the Rama’s reason applies to it in principle: the sound raises no suspicion once everyone knows the device is set in advance.
