Daas HaRav — The Alter Rebbe on Siman 322 (Nolad / an egg laid on Shabbos)
Subject of siman 322: ביצה שנולדה בשבת — an egg laid on Shabbos, nolad, and the resulting muktzeh status. Honest note: the Shulchan Aruch HaRav (of the Alter Rebbe) does not contain a siman 322 — the Alter Rebbe treats these matters in other simanim of his Shulchan Aruch (see below).
Why a Level 4 on siman 322? Our editorial commitment requires multilingual coherence and halachic transparency. The subject of siman 322 (Nolad / egg laid on Shabbos) is essential in Hilchos Shabbos, and the Chabad reader deserves to know where the Alter Rebbe codifies it in his Shulchan Aruch HaRav (שלחן ערוך הרב).
For Chabad, the Alter Rebbe is the final posek. This page gathers what can be said rigorously about the Alter Rebbe's shitah on this subject, relying exclusively on the simanim he actually composed.

Editorial honesty note
⚠ The Shulchan Aruch HaRav does NOT contain a siman 322
Established fact. The Shulchan Aruch of the Alter Rebbe (Kehot edition) closes with siman 321 and resumes at siman 324. Siman 322 was not composed by the Alter Rebbe.
This is documented in the Kehot editorial tradition: the Alter Rebbe completed certain simanim and left others incomplete (חסר). This can be verified on Sefaria — the list of SHHaRav simanim skips from siman 321 to siman 324.
This finding is already recorded in the site's source code (see scripts/audit-simanim.py, line 29: NO_LEVELS = {304, 322}) and in the Level 1 base: "This siman has no Level 4 (Daas HaRav): the Alter Rebbe did not compose it."
Editorial consequence. This page is not an ordinary Daas HaRav: it is a bridge page which (a) honestly acknowledges the absence of siman 322 in the SHHaRav, and (b) routes the reader to the simanim of the SHHaRav where the Alter Rebbe does effectively treat the topics of our siman 322.

Siman 322 as it exists — the Mechaber's text
Since the Alter Rebbe did not compose this siman, we recall here the text of the Mechaber (Rabbi Yosef Karo) — he defines the perimeter of siman 322 in the Shulchan Aruch, Orach Chayim. Level 1 of the present siman covers the full text with translation; here we cite only the opening seif — the one that lays down the rule of the laid egg (nolad).
The law of nolad on Shabbos. 6 seifim. An egg laid on Shabbos — forbidden even to move (it is muktzeh); and even if mixed in a thousand [permitted eggs], all become forbidden — because it is a davar she-yesh lo matirin (a thing that will become permitted at the end of Shabbos) and is not nullified, even in a thousand. One may invert a vessel over it so that it does not break, provided one does not touch it. [Note: cited here from the Mechaber — the Shulchan Aruch HaRav does not cover siman 322.]

Where does the Alter Rebbe treat the subjects of siman 322 in his Shulchan Aruch?
The conceptual perimeter of siman 322 — nolad, muktzeh, laid egg, egg of Yom Tov, davar she-yesh lo matirin, tikkun keli, fragrant woods, goral — is in fact distributed across several simanim that the Alter Rebbe actually composed. Here is the routing map for the Chabad reader.
| Topic of 322 | Where in the Alter Rebbe | Reason for the routing |
|---|---|---|
| Muktzeh (general framework) — basis of the prohibition on the laid egg | SHHaRav OC siman 310 (ש"י) | The Alter Rebbe codifies the doctrine of muktzeh (categories, nolad, machmas issur, machmas chissaron kis) in siman 310. This is the theoretical framework governing the laid egg. |
| Tiltul muktzeh (moving / inverting a vessel over the egg) | SHHaRav OC simanim 308-309 (ש"ח-ש"ט) | The whole mechanism of kefiyas keli (inverting a vessel to protect without touching) and tiltul min ha-tzad (indirect moving) is codified in these simanim. |
| Animal food and tikkun keli (seif 4 of the Mechaber) | SHHaRav OC siman 314 (שי"ד) | Siman 314 in the Alter Rebbe addresses making a utensil (tikkun keli) on Shabbos — precisely the framework of the wood-chip / toothpick. |
| Fragrant woods / molid rei'ach (seif 5 of the Mechaber) | SHHaRav OC siman 511 (תקי"א) on Yom Tov, and indications in 308 on tiltul of besamim | The Alter Rebbe addresses the prohibition of molid rei'ach (creating a new scent) in the Yom Tov context. For Shabbos, by kal va-chomer. |
| Goral on Shabbos (seif 6 of the Mechaber + Rema's hagahah) | SHHaRav OC siman 307 (ש"ז, laws of speech on Shabbos) and siman 324 | The casting of lots belongs to the prohibitions of commerce / kubia on Shabbos — the Alter Rebbe codifies them mainly in 307. |
| An egg laid on Yom Tov (parallel case) | SHHaRav OC siman 513 (תקי"ג) — dedicated siman | The Alter Rebbe devotes an entire siman to the egg of Yom Tov. Primary reference for understanding the doctrine of nolad in the Rav's shitah. |
| Shabbos adjacent to Yom Tov (seif 2 of the Mechaber) | SHHaRav OC simanim 495-497 (תצ"ה-תצ"ז) — general Yom Tov laws | The status of an egg between Shabbos and Yom Tov requires the combined doctrine of Yom Tov (495-497) and the egg of Yom Tov (513). |
⚠ Methodological precision. This table maps the thematic routing; precise references (seifim and paragraphs in the SHHaRav) must be verified in the Kehot edition before any halachic application.

What can be cautiously stated of the Rav's shitah on nolad / muktzeh
In the absence of a dedicated siman, one relies on the passages of the SHHaRav where the Alter Rebbe explicitly treats the concept of nolad and the status of the egg — primarily OC 310 (general muktzeh) and OC 513 (egg of Yom Tov).
Principle 1 — Nolad as an autonomous category of muktzeh
Shared position of the Mechaber and the Rav: an egg laid on Shabbos is nolad — something newly come into existence that did not exist before the entry of Shabbos. It had not been prepared (lo huchan / לא הוכן) the day before for this use. This results in a strict rabbinic muktzeh status.
Possible contribution of the Rav: in his passages on nolad in OC 310, the Alter Rebbe tends to articulate the reason (ta'am) of the prohibition — faithful to his method of unifying halachah + ta'am.
Practical consequence: one does not invert a vessel over the egg while touching the egg; one does not move it, even indirectly for a utilitarian purpose. See SHHaRav OC 308 on tiltul min ha-tzad.
Principle 2 — Davar she-yesh lo matirin and non-nullification in a thousand
Classical position (Mechaber, seif 1): mixed in a thousand, all forbidden — it is a davar she-yesh lo matirin (will be permitted at the end of Shabbos), so it does not become nullified.
The Rav's contribution (in OC 513): the Alter Rebbe develops the doctrine of davar she-yesh lo matirin in the context of the egg of Yom Tov — that is his main codification of the topic.
Practical consequence: in case of doubt (an egg found near the nest), one waits for the end of Shabbos rather than seeking to nullify in a majority (bittul be-rov), because the halachah is clear: davar she-yesh lo matirin lo batil.
Principle 3 — Egg found before dawn in the nest (borderline case)
Position of the Mishnah Berurah (siman 322, s.k. 2): if one rises before amud ha-shachar and finds the egg in the hen's nest — presumed laid the day before, permitted.
Position of the Alter Rebbe: this borderline case finds its framework in the general doctrine of huchan me-etmol (prepared from the day before) that the Rav codifies in OC 513.
Practical consequence for the Chabad chassid: in a concrete case of doubt, consult your Rav; the Rav's doctrine favors stringency in matters of muktzeh.

Sichos and igros of the Rebbe on nolad / muktzeh / the egg on Shabbos
| Reference (to verify) | Subject | Connection with 322 |
|---|---|---|
| Likkutei Sichos — various sichos on Hilchos Yom Tov | An egg laid on Yom Tov; concept of nolad | The Rebbe regularly cites SHHaRav OC 513 on these questions; illuminates the Shabbos status by analogy. |
| Sha'arei Halachah u-Minhag — Orach Chayim section | The Rebbe's psakim by siman | The most direct source for the Rebbe's psakim on Hilchos Shabbos topics — to be consulted for 310, 513 and related matters. |
| Igros Kodesh — responses on practical cases of muktzeh | Concrete cases of chassidic life | The Rebbe's responses to chassidim on the handling of objects in case of doubt on Shabbos. |
⚠ Validation: the references above are research leads to be validated against the physical volumes of the Kehot edition. For the Rebbe's psakim by siman, the most direct source remains Sha'arei Halachah u-Minhag.

The Chabad practical conduct on the subject of siman 322
Conduct synthesis — knowing that the Rav's practical shitah, on these matters, relies on OC 310 (muktzeh), OC 513 (egg), and the general doctrine of the SHHaRav.
For the Chabad Chassid — subjects of Siman 322
- ① An egg found under a hen on Shabbos. Do not move it, do not touch it. To protect it, one may invert a vessel over it without touching it. Framework: SHHaRav OC 310 (muktzeh) + 308 (kefiyas keli).
- ② An egg mixed with other already-permitted eggs. All eggs become forbidden for this Shabbos — davar she-yesh lo matirin does not become nullified. Wait until after Shabbos. Framework: doctrine reprised in SHHaRav OC 513.
- ③ An egg found before dawn in the nest. Presumed laid the day before (before the entry of Shabbos) — permitted. In a concrete case of doubt: consult your Rav.
- ④ Shabbos following a Yom Tov (or preceding). An egg laid in one is forbidden on the other. Framework: SHHaRav OC 495-497 + 513.
- ⑤ Fruit fallen from the tree on Shabbos. Forbidden during the day; permitted at the end of Shabbos immediately (without waiting bichdei she-ya'asu, since no melachah was performed). Framework: general muktzeh, SHHaRav OC 310.
- ⑥ Picking the teeth. Toothpicks prepared before Shabbos — permitted; carving a wood-chip on Shabbos — forbidden. Framework: SHHaRav OC 314 (tikkun keli).
- ⑦ Casting lots on Shabbos. In family with equal portions: permitted. With others, or unequal portions: forbidden (kubia). Even via a non-Jew: forbidden (Rema). Framework: SHHaRav OC 307.
⚠ This section presents the Chabad practical conduct as it derives from the simanim the Alter Rebbe actually composed. For any concrete question: consult your Rav.
סיכום — שכ"ב והרב
Summary — Siman 322 and the Rav's shitah
1. Siman 322 does not exist in the Shulchan Aruch HaRav — the Alter Rebbe did not compose it.
2. The topics of siman 322 (nolad, laid egg, muktzeh, davar she-yesh lo matirin, tikkun keli, fragrant woods, goral) are distributed across other simanim of the SHHaRav: principally OC 308, 309, 310, 314, 307, 513, 495-497.
3. To study the laid egg and nolad in the Alter Rebbe, the principal entry point is SHHaRav OC 310 (categories of muktzeh) combined with OC 513 (egg of Yom Tov).
4. For the Chabad chassid: practical halachah remains the Mechaber + Mishnah Berurah doctrine taught in Level 1 of the present siman, seen through the conceptual framework of the SHHaRav recalled above.
5. For any concrete question: consult your Rav.
