📜 The text of the Shulchan Arukh — 15 seifim
The siman has fifteen seifim, and this page gives them all, in the order of the Shulchan Arukh, before reading them. Each Hebrew block is followed by an English summary, which condenses and does not quote.
summary: the siman's heading and seif 1. One does not sift straw in a sieve so that the chaff should fall out, nor set the sieve in a high place so that the chaff should come down; but one may take the straw up in the sieve and pour it into the trough — the chaff then falls of itself, and that is permitted, since one does not intend it.
summary: seif 2. One does not measure out barley to set before one's animal: one estimates by eye.
summary: seif 3. One does not knead bran for cattle or for fowl; but one may pour water onto it and pass a ladle or a stick through it crosswise — so long as one does not stir it by hand and does not turn the utensil, it is permitted — and one shakes it from vessel to vessel so that it mix. One may mix it this way in one vessel and divide it among several, even a כור, even two. And there are those who forbid pouring the water onto the bran on Shabbos at all: for them the crosswise pass was permitted only where the water had been poured on before nightfall. A gloss refers to siman 321 seif 16, on garlic and mustard, for how people conduct themselves.
summary: seif 4. Sheaves of grain tied in two or three places: one may untie them so that the animal may eat. Gloss of the Rama: some permit untying only a knot that is not meant to last (הגהות אלפסי). But it is forbidden to rub them by hand in the way it is usually done with animal fodder, so that the beast may eat more easily — for making a non-food into a food is permitted, whereas taking pains over what is already fit to be eaten, in order to improve it, is not.
summary: seif 5. Branches cut from a tree that are given to cattle while still moist: one unties them and rubs them (מפספסין, a word for rubbing), for without that they are not fit.
summary: seif 6. One may cut up gourds before an animal, provided they were plucked the day before.
summary: seif 7. One may cut up a neveilah before dogs, even if it died that same day, whether it had been ailing or sound. And this applies only to a hard neveilah, which they cannot eat without cutting; but if it were fit for them without cutting, no — for over what is already fit, one does not take pains. [And see above, siman 321, whether it is permitted to cut it very fine before fowl.]
summary: seif 8. One does not cut שחת [that is, the greens of grain reaped before the grain has ripened] or carobs before an animal, small or large, because without cutting too it is fit to be eaten.
summary: seif 9. One does not stuff the camel — feeding it by hand until its innards are widened like a trough — nor force-push food down its throat to a place from which it cannot bring it back; but one may do הלעטה. One does not do המראה to calves, but one may do הלעטה. Which is המראה and which is הלעטה: the first goes to a place from which the beast cannot bring it back, the second to a place from which it can. Gloss of the Rama: the law of hens and geese is that of calves (מהרי״ל).
summary: seif 10. It is permitted to place food into the mouths of hens.
summary: seif 11. One does not set water or food before bees, before dovecote or loft pigeons, or before a pig; but one does set it before geese, hens, house pigeons, and likewise before a dog whose sustenance is upon you.
summary: seif 12. It is permitted to feed the silkworm.
summary: seif 13. A man may stand his animal over grasses that are attached to the ground, and we do not fear that he will pluck from them; but not over muktzeh, because its prohibition is light and we fear that he will hand her some of it. And this refers only to standing her over it; but standing in front of her so that she can only turn that way is permitted.
summary: seif 14. One takes food from before the donkey to set before the ox, but one does not take from before the ox to set before the donkey, because it has become repugnant from the ox's slaver and is no longer fit for the donkey. Gloss of the Rama: some are stringent for the other kinds of animals as well, to take from before one and give to another that is not of its kind (מרדכי perek תולין, סמ״ג and ספר התרומה).
summary: seif 15. It is forbidden to rake out the trough before an ox being fattened, even a trough that is a vessel — a decree on account of one made of earth, because one would come to level the hollows. And it is likewise forbidden to push the straw aside before it.
1. Opening the sugya — the source and the mishnayos
The Talmudic source
Siman 324 deals with preparing food for animals on Shabbos. Its starting point is not a prohibition but an obligation: a man must give his animal to eat, and before he eats himself. Two dicta, both of them רב יהודה אמר רב, say so — one in Berakhos, the other at the end of Gittin.
« אָסוּר לָאָדָם שֶׁיֹּאכַל קוֹדֶם שֶׁיִּתֵּן מַאֲכָל לִבְהֶמְתּוֹ » (ברכות מ׳ ע״א)
« אָסוּר לוֹ לְאָדָם שֶׁיִּטְעוֹם כְּלוּם עַד שֶׁיִּתֵּן מַאֲכָל לִבְהֶמְתּוֹ » (גיטין ס״ב ע״א)
Shabbos does not suspend that obligation. The question of the whole siman therefore lies elsewhere: not whether one feeds, but in what manner one may prepare what one gives.
The mishnayos from which the siman is drawn. There are three of them, and they are not all in the same chapter of Shabbos — which is worth holding on to, since the two chapters do not ask the same question. The first is in perek תולין, and it is the one that seif 1 restates:
The other two are in perek מי שהחשיך, at the end of the tractate. The first carries the two opposing rules on which the whole siman will live — it is a single mishnah, given here in two pieces:
And the mishnah after it gives the regime of force-feeding, and then that of the animals whose sustenance is or is not upon a man:
« אֵין אוֹבְסִין אֶת הַגָּמָל וְלֹא דּוֹרְסִין, אֲבָל מַלְעִיטִין. וְאֵין מַאֲמִירִין אֶת הָעֲגָלִים, אֲבָל מַלְעִיטִין » (שבת קנ״ה ע״ב — משנה)
The sugya of kneading bran, finally, runs from שבת קנ״ה ע״ב to שבת קנ״ו ע״א; it is the subject of section 4.
An attribution that had to be corrected. The Hebrew variant of this page attached the mishnah of כוברין to שבת קנ״ה, and gave it a wording in which the sieve is set upon muktzeh — which would be an entirely different halachah. The Beis Yosef himself says where it comes from: אין כוברין את התבן בכברה וכו׳ משנה בפרק תולין (בית יוסף או״ח שכ״ד). The real text is the one quoted above, at שבת ק״מ ע״א, and what it rules out is setting the sieve in a high place so that the chaff should come down. The faulty wording is not carried over here.
2. The underlying chakirah — שווי אוכל against מטרח באוכלא
The yesod of the siman
Chakirah: what is the criterion that separates the permitted preparation of an animal's food from the forbidden one?
The gemara sets the two terms against each other. Rav Chisda explains Rav Huna's premise, Rava explains Rav Yehudah's — and the two Amoraim divide the two terms between them exactly, each one the reverse of the other:
- שווי אוכל — making a food out of something that is not a food: permitted. Thus cutting a hard gourd, or rubbing branches: without it there is no food at all.
- מטרח באוכלא — taking pains over what is already fit to be eaten, to arrange it and improve it: forbidden. Thus cutting שחת and carobs, which are fit without cutting.
It is this second division that the Shulchan Arukh adopts, and he writes it in seif 4 in the gemara's own words: דשווי אוכל בדבר שאינו אוכל מותר לעשותו אוכל אבל מטרח באוכלא בדבר שהוא ראוי לאכילה לא טרחינן ביה (שו״ע או״ח שכ״ד:ד). The ט״ז states it as the accepted principle — דהא כאן קי״ל כר״י דאשוויי אוכל מותר ומטרח באוכל אסור (ט״ז או״ח שכ״ד ס״ק ד׳); the abbreviation ר״י is not expanded there, and we do not expand it either.
The yesod. The heter therefore does not turn on how laborious the act is, but on a question: does my act make the food, or does it merely improve it? That is the axis of the whole siman, and every seif falls somewhere along it.
Of what order is this prohibition? On the שווי/מטרח axis, the Mishnah Berurah says it outright about force-feeding: כ״ז משום טרחא טרחא יתירה (מ״ב שכ״ד ס״ק כ״ד) — needless exertion, and therefore a rabbinic prohibition. But the siman borders elsewhere on genuine מלאכות: seif 1 is כמרקד — like one who sifts, hence rabbinic — while לש in seif 3, טוחן in seifim 7 and 8, and in seif 15 the fear of levelling hollows, put the מלאכות themselves in play. That ס״ק כ״ד speaks about its own seif, not about the whole siman.
A note on the text: in the edition followed here, this ס״ק carries the word טרחא twice over. We copy it as it stands and do not restore it.
3. The Rishonim on the גדר of כוברין and of מרקד
רש״י — his comment on this mishnah is at שבת ק״מ ע״א, where the mishnah stands, and not at קנ״ה. He first explains what מוץ is: מוץ - הוא מזקן השבולת העליון ואינו ראוי למאכל וכוברין אותו בכברין שיפול המוץ (רש״י שבת ק״מ ע״א ד״ה מוץ). He then gives the reason for the heter, and it is not that handling the sieve would be some other act — it is a
The Shulchan Arukh takes that very reason into seif 1, in the words
הרמב״ם — he files the matter under מלאכה and not under טרחה, and that is the force of his לפיכך:
« הַמְרַקֵּד מֵאֲבוֹת מְלָאכוֹת. לְפִיכָךְ אֵין כּוֹבְרִין אֶת הַתֶּבֶן בִּכְבָרָה » (רמב״ם הלכות שבת כ״א:ל״ב)
He closes that same halachah on the word that sets the whole measure: מִפְּנֵי שֶׁהוּא כִּמְרַקֵּד (רמב״ם הלכות שבת כ״א:ל״ב) — like one who sifts, and not one who sifts. The Mishnah Berurah opens his commentary on that very word, אין כוברין - מפני שהוא כמרקד (מ״ב שכ״ד ס״ק א׳), and at once draws the consequence in the other direction: וכ״ש דאין לרקד התבואה מפסולת שלהן דזה הוא מרקד ממש וחייב (מ״ב שכ״ד ס״ק ב׳). On kneading, the Rambam draws the same line for וּמֻתָּר לְגַבֵּל אֶת הַקָּלִי מְעַט מְעַט (רמב״ם הלכות שבת כ״א:ל״ג) — and for bran, which is not even a substance one kneads:
« הַמֻּרְסָן אַף עַל פִּי שֶׁאֵינוֹ רָאוּי לְגִבּוּל אֵין גּוֹבְלִין אוֹתוֹ שֶׁמָּא יָבוֹא לְגַבֵּל הֶעָפָר וְכַיּוֹצֵא בּוֹ » (רמב״ם הלכות שבת כ״א:ל״ד)
And on force-feeding, his reason is not exertion but the fear of a
הרא״ש, הרי״ף והמרדכי — on the ties of the sheaves, the Rishonim's disagreement is not first of all about the reasoning but about the reading of the text, and it is the Biur Halachah who points it out: כן הוא גירסת רש״י והרא״ש דאף בתלתא מותר להתיר וגירסת הרי״ף ולא להתיר (ביאור הלכה שכ״ד ד״ה מותר להתירן). He adds that the Gaon of Vilna's glosses say שדבריו נכונים מאד (ביאור הלכה שכ״ד ד״ה מותר להתירן), and that the פירוש רבנו חננאל we have appears to read like the Rif; to whom that pronoun refers the text does not say, and we do not decide it. As for the Mordechai, the Shulchan Arukh names him himself — but in seif 14, where the Rama's gloss is sourced The gloss of seif 4, by contrast, is sourced הגהות אלפסי (שו״ע או״ח שכ״ד:ד): these are two distinct sources, not one.
4. The sugya of kneading bran — the machlokes of Rabbi and Rabbi Yose bar Yehudah
The beraisa. The gemara first tries to confine the disagreement to flour, which is a substance one kneads, and to exclude bran, which is not; an explicit beraisa cuts that off:
« אֵין נוֹתְנִין מַיִם לַמּוּרְסָן, דִּבְרֵי רַבִּי. רַבִּי יוֹסֵי בַּר יְהוּדָה אוֹמֵר: נוֹתְנִין מַיִם לַמּוּרְסָן » (שבת קנ״ה ע״ב)
The same division exists over flour, and there it carries a חיוב:
« אֶחָד נוֹתֵן אֶת הַקֶּמַח וְאֶחָד נוֹתֵן לְתוֹכוֹ מַיִם — הָאַחֲרוֹן חַיָּיב, דִּבְרֵי רַבִּי. רַבִּי יוֹסֵי בַּר יְהוּדָה אוֹמֵר: אֵינוֹ חַיָּיב עַד שֶׁיְּגַבֵּל » (שבת קנ״ה ע״ב)
The yesod of the disagreement. Is pouring water onto bran already the beginning of לישה — in which case there is לש from the pouring — or is there no לישה until one has worked it by hand? For Rabbi, pouring the water is its kneading; for Rabbi Yose bar Yehudah, nothing has happened until one kneads.
How the Rishonim rule, and why it is not simple. The Biur Halachah lays out the whole difficulty: there is an anonymous mishnah in the last chapter of Shabbos that goes like Rabbi Yose bar Yehudah, and one in the first chapter that goes like Rabbi. Two anonymous rulings that contradict each other — and then, does one follow the later one, or return to the general rule
ודעת הרי״ף והרמב״ם והרא״ש לפסוק כסתמא בתרא להקל (ביאור הלכה שכ״ד ד״ה אין גובלין) — that is, on the lenient side; others, he writes, return to the general rule, and he names them: הרא״ם, בעל התרומות, סמ״ג, סמ״ק, as brought in the הגהות מיימוניות and in the מרדכי. And he adds what accounts for the shape of seif 3: ודעת המחבר בעצם הדין להקל בנתינת מים ותפס הדעה האחרונה רק בשם י״א (ביאור הלכה שכ״ד ד״ה אין גובלין).
The Mishnah Berurah names the second camp the same way: הוא דעת בעל התרומות וסייעתו דפוסקין כרבי (מ״ב שכ״ד ס״ק י׳). The ט״ז, for his part, names the first: בעל דיעה זאת הוא הרי״ף ורמב״ם ורא״ש וטור שזכרנו בסימן שכ״א סט״ו שפוסקין כר״י בר יהודה (ט״ז או״ח שכ״ד ס״ק א׳); and in the next ס״ק he assigns the second view to the Tur: הוא דעת הטור דפוסק שם כרבא דבנתינת מים לחוד הוה גיבול (ט״ז או״ח שכ״ד ס״ק ב׳). The Tur thus appears on both sides in two neighbouring ס״ק; we flag it without deciding it.
The ט״ז's question to the Beis Yosef. The Beis Yosef had written that a prohibition nevertheless remains against pouring water onto flour, since flour is not needed for Shabbos, whereas bran, which serves to feed beast and fowl, was not included in the decree. The ט״ז does not accept the distinction, and says so in words better quoted than paraphrased: ותמהתי על פה קדוש יאמר כן (ט״ז או״ח שכ״ד ס״ק א׳). His argument is twofold — flour too is given to animals, and the water is poured for that very purpose; and the gemara itself, in trying to confine the view to קמח דבר גיבול, shows that it was looking for an explicit heter. Here the one who speaks is the ט״ז, and the one he addresses is the Beis Yosef.
What remains permitted, and at what price. Once the division is settled, the gemara still asks in what manner one proceeds, and every answer is a שינוי:
« אָמַר רַב יֵימַר בַּר שֶׁלֶמְיָא מִשְּׁמֵיהּ דְּאַבָּיֵי: שְׁתִי וָעֵרֶב » (שבת קנ״ו ע״א)
« אָמַר רַב יְהוּדָה: מְנַעֲרוֹ לִכְלִי » (שבת קנ״ו ע״א)
The Rambam takes up both, and gives the reason for the prohibition of working it by hand: On קלי, the beraisa carries a parallel disagreement — תָּנוּ רַבָּנַן: אֵין גּוֹבְלִין אֶת הַקָּלִי. וְיֵשׁ אוֹמְרִים: גּוֹבְלִין (שבת קנ״ה ע״ב) — and there the שינוי is of another kind, אָמַר רַב חִסְדָּא: עַל יָד עַל יָד (שבת קנ״ו ע״א), that is, a little at a time.
The Shulchan Arukh closes seif 3 with the second view: ויש אוסרים ליתן מים על גבי מורסן בשבת ולא אמרו שמוליך בו שתי וערב אלא כשהיו המים נתונים עליו מבעוד יום (שו״ע או״ח שכ״ד:ג).
נפקא מינה. This is where practice is settled — the order of Chabad and the poskim's ruling on בלילה רכה and בלילה עבה, the thin and the thick mixture, which siman שכ״א treats in its own right. The division between the two does not belong to this siman: we name it and refer to it, without settling it.
5. The shitah of the Beis Yosef and the Shulchan Arukh — the halachic ruling
בית יוסף — he gathers the mishnayos and the Rishonim, and the Shulchan Arukh rules in fifteen seifim. The main headings: the sieve is forbidden, taking up in the sieve is permitted (seif 1); one does not use a measuring vessel — the Mishnah Berurah gives the reason, היינו בכלי המדה מפני שנראה כאלו הוא מודד למכור אבל ליקח בכלי אחר ולשער קב או קביים מותר (מ״ב שכ״ד ס״ק ד׳) — but one estimates (seif 2); one may pour water onto bran without working it (seif 3); and cutting is permitted only where the thing is not fit without it (seifim 6 to 8). On that last point the Mishnah Berurah is precise on both sides: ודוקא כשהם קשים שאינם ראויים לאכול בלא חיתוך אבל כשהם רכים הוי בכלל מטרח באוכלים ואסור (מ״ב שכ״ד ס״ק ט״ו) for the gourds, and ומוכח מזה דמיירי ברכין אבל בחרובין קשין שאינם ראויים בלתי חיתוך מותר דבכלל שווי אוכלא הוא (מ״ב שכ״ד ס״ק כ״ג) for the carobs.
On מזונותיו עליך (seif 11), the Mechaber follows the gemara's division — הָנֵי מְזוֹנוֹתָן עָלֶיךָ, וְהָנֵי אֵין מְזוֹנוֹתָן עָלֶיךָ (שבת קנ״ה ע״ב) — and excludes bees, dovecote and loft pigeons, and the pig, while permitting אבל נותנין לפני אווזין ותרנגולים ויוני בייתות וכן לפני כלב שמזונותיו עליך (שו״ע או״ח שכ״ד:י״א). The Mishnah Berurah gives the reason for each: אפילו הם שלו מ״מ אין מזונותיהן עליו דשכיחי להו בדברא וטרחא שלא לצורך היא (מ״ב שכ״ד ס״ק כ״ט) for the first, דאין מזונותיו עליו לפי שאסור לגדלו (מ״ב שכ״ד ס״ק ל׳) for the pig, and for the dog he notes on the contrary דמצוה קצת ג״כ ליתן לו מזונות (מ״ב שכ״ד ס״ק ל״א). And on the trough (seif 15): אסור לגרוף האבוס לפני שור של פטם אפי׳ אבוס של כלי גזירה אטו של קרקע דאתי לאשווי גומות (שו״ע או״ח שכ״ד:ט״ו).
6. The shitah of the Rama — three restrictive glosses
הרמ״א sets three glosses in this siman, and the Shulchan Arukh marks all three with the word הגה — at seifim 4, 9 and 14. None of them is lenient.
Seif 4 — the gloss opens with a וי״א and permits untying the tie only בקשר שאינו של קיימא (שו״ע או״ח שכ״ד:ד), a knot that is not meant to last. The concern is מתיר. The Mishnah Berurah reports that the תוספת שבת and the בית מאיר hold that all agree, and that the חידושי רע״א, in the name of the מהריק״ש — an abbreviation the source does not expand, and neither do we — holds that the Rambam disputes it; but he concludes that ומ״מ לדינא אין להקל דדעת רש״י והרמ״ך ג״כ דיש קושר ומתיר אף באוכלי בהמה (מ״ב שכ״ד ס״ק י״ב).
Seif 9 — ודין תרנגולים ואווזים כדין עגלים (שו״ע או״ח שכ״ד:ט): the law of hens and geese is that of calves. The Mishnah Berurah gives its content, דהיינו שאסור לתחוב בגרונם המאכל עד שלא יהיו יכולין להחזירו (מ״ב שכ״ד ס״ק כ״ז), and then raises a difficulty with the gloss itself in ס״ק כ״ח — which is set on seif 10, not on this one: וקצת פלא על רמ״א מה הוסיף בזה אחרי שנזכר בשו״ע בהדיא (מ״ב שכ״ד ס״ק כ״ח) — the Shulchan Arukh had already said it, and the Rama adds nothing; perhaps, he suggests, so that one should not mistake the Mechaber's intent.
Seif 14 — ויש מחמירים ג״כ בשאר מיני בהמות ליקח מלפני א׳ וליתן לפני אחרת שאינה מינה (שו״ע או״ח שכ״ד:י״ד): the stringency extends to the other kinds. But the Acharonim do not impose it: the מג״א writes ואין למחות ביד הנוהגין היתר (מג״א או״ח שכ״ד ס״ק ח׳), in the name of the ב״ח, and the Mishnah Berurah follows, וכתבו האחרונים דאין למחות ביד הנוהגין היתר דיש להם על מי לסמוך (מ״ב שכ״ד ס״ק ל״ח).
7. The machlokes of the Rishonim on the גדר of אבסה and הלעטה
The division in the mishnah (seif 9). אובסין and דורסין are forbidden; מלעיטין is permitted; מאמרים is forbidden for calves. What remains is to say what each of these words denotes, and that is where the gemara divides.
For Rav Yehudah the criterion is the place: can the animal bring the food back? For Rav Chisda both go to the place from which it cannot bring it back, and the criterion is the instrument: המראה is done with a vessel, הלעטה by hand. A beraisa is taught in support of Rav Yehudah, and it is his criterion that the Shulchan Arukh keeps: איזו המראה למקום שאינה יכולה להחזיר הלעטה למקום שהיא יכולה להחזיר (שו״ע או״ח שכ״ד:ט). The Mishnah Berurah adds the observation that makes the criterion workable: ומשמע בגמרא דכל שאינו מרביץ את הבהמה אין יכול לתחוב כ״כ בעומק ומקום שיכול להחזיר הוא (מ״ב שכ״ד ס״ק כ״ו). The Biur Halachah notes, however, that בחידושי מאירי משמע קצת דדוקא ביד ולא בכלי (ביאור הלכה שכ״ד ד״ה למקום שהיא יכולה להחזיר) — the instrument criterion, then, has not wholly disappeared.
The Rishonim's machlokes on אובסין, and what drives it. The Biur Halachah puts it plainly: הנה מרש״י משמע דג״ז מיירי שתוחב בגרונו למקום שאינו יכול להחזיר (ביאור הלכה שכ״ד ד״ה דהיינו שמאכילה בידו); but אבל מרמב״ם משמע דכיון שמאכילו הרבה כמאכל שלשה ימים אפילו לא תחב בגרונו כלל ג״כ אסור (ביאור הלכה שכ״ד ד״ה דהיינו שמאכילה בידו). In other words: for Rashi, אובסין too is a pushing down the throat; for the Rambam the sheer quantity suffices — לֹא יַאֲכִיל הַגָּמָל בְּשַׁבָּת מַאֲכַל שְׁלֹשָׁה אוֹ אַרְבָּעָה יָמִים (רמב״ם הלכות שבת כ״א:ל״ה) — even with no pushing at all. And the Biur Halachah gives the reason for the shift: if אובסין were already the pushing, what would the mishnah's ולא דורסין be adding?
The root. What lies underneath is the question of what one is afraid of. The Mishnah Berurah assigns it to exertion — כ״ז משום טרחא טרחא יתירה (מ״ב שכ״ד ס״ק כ״ד) — while the Rambam assigns it to the fear of a מלאכה: שֶׁמָּא יָבוֹא לִידֵי כְּתִישַׁת קִטְנִיּוֹת אוֹ לִידֵי לִישַׁת קֶמַח וְכַיּוֹצֵא בּוֹ (רמב״ם הלכות שבת כ״א:ל״ה). The two reasons do not coincide, and the question stays open here as it is in the sources.
8. The psak of the Acharonim — מג״א, ט״ז and משנה ברורה
המג״א — nine ס״ק on this siman. In ס״ק א׳ he reports a heter, and one must read exactly what it says: כתב הרמב״ן במלחמות לסברא קמייתא דאם מגבל מעט מעט שרי בלא שינוי (מג״א או״ח שכ״ד ס״ק א׳) — that is, for the first view, without a שינוי when one proceeds little by little. The Biur Halachah does not follow him: he holds that the מלחמות says this only of קלי, ולא הותר מעט מעט כ״א בקלי (ביאור הלכה שכ״ד ד״ה מורסן), and notes that the קרבן נתנאל reached the same conclusion. In ס״ק ב׳ the מג״א sets a limit the seif had not stated: דודאי לכ״ע אסור להכין יותר מהצריך ליום (מג״א או״ח שכ״ד ס״ק ב׳). In ס״ק ד׳ he broadens the licence to cut instead: אפי׳ נאכלין ע״י הדחק בלא חתיכה שרי (מג״א או״ח שכ״ד ס״ק ד׳), in the name of the Beis Yosef. In ס״ק ה׳ he gives the reason for the prohibition of fine cutting: דדבר שהיא מלאכה כגון טחינה אסור לעשות לבהמה אפי׳ בי״ט (מג״א או״ח שכ״ד ס״ק ה׳). In ס״ק ז׳ he writes of the wheat given to birds on שבת שירה: יש נוהגין לתת חטין בשבת שירה לפני העופות ואינו נכון שהרי אין מזונתן עליך (מג״א או״ח שכ״ד ס״ק ז׳). And in ס״ק ט׳ he explains clearing away the straw in the name of Rashi: מפני שיש שנמאס ואינו ראוי לאכילה, רש״י (מג״א או״ח שכ״ד ס״ק ט׳).
הט״ז — seven ס״ק. Two on seif 3, to say who holds what (see section 4), and two that carry the weight of the siman.
In ס״ק ד׳ the ט״ז attacks head-on the psak the רמ״א laid down in siman 321, following a teshuvah that the ט״ז himself identifies as תשו׳ מהרא״י בת״ה סי׳ נ״ו (ט״ז או״ח שכ״ד ס״ק ד׳), that one does not cut raw meat very fine before fowl: ודברי רמ״א שכ׳ דא״א לאכלו בלא״ה הוא קשה מאוד דמן ההיתר עושה איסור (ט״ז או״ח שכ״ד ס״ק ד׳). His argument is the very rule of our siman — if the fowl cannot eat without it, that is a שווי אוכל, and therefore permitted. From the Rambam's own distinction — the ריסוק of שחת on one side, cutting up the נבלה on the other — he then draws this consequence: ש״מ דחותך דק דק דבלא״ה לא יוכל לאכלה אין שייך טוחן כלל (ט״ז או״ח שכ״ד ס״ק ד׳). And he stops at a He also notes that The Biur Halachah unties it differently: וע״כ ברור דהרמ״א רק אבשר חי הנ״ל בשכ״א קאי וקיצר בלשונו (ביאור הלכה שכ״ד ד״ה וע״ל סימן שכ״א) — the Rama was speaking only of raw kosher meat, which is destined for fowl alone, and not of נבלה.
In ס״ק ה׳ the ט״ז brings the Rambam on אין חותכין שחת and the question the כסף משנה reports: it had been put to the רשב״א, and the רשב״א conceded that it was a difficulty — וכתב הכ״מ ששאלו להרשב״א למה נתן הרמב״ם טעם שנרא׳ כטוחן דהא בגמ׳ נתנו טעם משום מיטרח באוכל׳ והודה הרשב״א שהי׳ קושיא (ט״ז או״ח שכ״ד ס״ק ה׳). He answers that the Rambam did not mean to give the ground of the prohibition there but its measure, and offers his own reading of the words
המשנה ברורה — forty-one ס״ק, and they draw the siman from end to end. The sieve is כמרקד and true sifting is חייב (ס״ק א׳ and ס״ק ב׳); bran is forbidden to knead by decree, אף דאינו בר גיבול מ״מ גזרו רבנן שמא יבוא לגבל קמח דחייב משום לש (מ״ב שכ״ד ס״ק ה׳), and he adds that ודעת הרבה ראשונים דאף במורסן חייב משום לש (מ״ב שכ״ד ס״ק ה׳); the quantity prepared does not exceed the day's need, והוא ששיעור זה צריך לו לחלק לפניהם באותו יום השבת דאל״ה אסור לטרוח טרחא דלא צריכא (מ״ב שכ״ד ס״ק ט׳); one cuts only what is not fit as it stands (ס״ק ט״ו, ס״ק י״ח and ס״ק כ״ג) — and even barely fit is enough to permit, ואפילו אם איננה קשה לגמרי שראוי להם לאכילה ע״י הדחק ג״כ בכלל שווי אוכלא הוא ושרי (מ״ב שכ״ד ס״ק י״ח); the heter to turn a non-food into a food rests on לעשותו אוכל - משום צערא דבהמה (מ״ב שכ״ד ס״ק י״ג); and ס״ק ל״ג traces the rule of seif 13 back to the מכילתא, דאיתא במכילתא למען ינוח יכול לא יניחנו תולש ועוקר כתיב למען ינוח ואין זה נוח אלא צער (מ״ב שכ״ד ס״ק ל״ג).
On seif 15 it is he — and not the ט״ז, who has no ס״ק on that seif — who gives the ground of the decree, in the name of the תוספות: היינו דשם רגילות הוא שמכוין לאשויי כדי שלא יפלו השעורים בהגומות (מ״ב שכ״ד ס״ק מ׳), ולכן גזרינן גריפה אפילו באבוס שבכלי אבל מותר לגרוף תיבה בשבת מן הפסולת הנמצא בה (מ״ב שכ״ד ס״ק מ׳). He first explains why one would rake, שגורפין אותו שלא יתערב העפרורית שבאבוס בתבן ובשעורים שנותנין לפניו ויקוץ במאכלו (מ״ב שכ״ד ס״ק ל״ט), and why one would push the straw aside, דכשהוא רב רוצה לסלקו כדי שלא ידרסנו השור ברעי (מ״ב שכ״ד ס״ק מ״א).
9. Practical nafka minos
What the sugya yields in practice:
- שווי אוכל: one may cut a hard gourd, a hard נבלה, rub branches — none of it is fit without that act (seifim 5, 6, 7).
- מטרח באוכלא: one does not cut שחת or carobs, and does not rub the sheaves — all of that is already fit as it stands (seifim 4, 8).
- Fine cutting: even where cutting is permitted, fineness runs into טוחן; the מג״א assigns it to that מלאכה, דדבר שהיא מלאכה כגון טחינה אסור לעשות לבהמה אפי׳ בי״ט (מג״א או״ח שכ״ד ס״ק ה׳), and the Biur Halachah limits the scope of the Rama's restriction to raw kosher meat, וע״כ ברור דהרמ״א רק אבשר חי הנ״ל בשכ״א קאי וקיצר בלשונו (ביאור הלכה שכ״ד ד״ה וע״ל סימן שכ״א).
- Measuring: one does not measure barley with a measuring vessel, one estimates —
- Kneading: water is poured onto bran with a שינוי, a crosswise pass and shaking from vessel to vessel; and preparing the day before remains preferable, since the second view in seif 3 permits the crosswise pass only in that case.
- Quantity: no more than the day's need —
- מזונותיו עליך: one feeds the animals that depend on a man, not bees, dovecote and loft pigeons, or the pig; as for the dog, there is even something of a mitzvah, דמצוה קצת ג״כ ליתן לו מזונות (מ״ב שכ״ד ס״ק ל״א).
- The trough: one does not rake it, even a trough that is a vessel, by decree — but
10. Review of the sugya and the halachic conclusion
The yesod of the sugya. Siman 324 is built on a single principle: the duty to feed animals licenses the act of feeding them, but restricts the act of preparing. Every act is measured by the question — does it make the food (שווי אוכל: permitted) or does it merely improve a food that already exists (מטרח באוכלא: forbidden) — and, secondly, by whether it touches a מלאכה (מרקד, לש, טוחן, or the fear of levelling hollows).
- Melachos: the sieve is כמרקד (rabbinic), true sifting is חייב; kneading bran goes through a שינוי.
- Feeding: מלעיטין and not אובסין; and only the animals whose sustenance is upon you.
- The trough: one does not rake it, by decree, on account of levelling hollows.
Where the sugya leaves a question open — the Tur's place between the two views of seif 3, the ט״ז's צריך עיון on siman 321, the root of the prohibition of force-feeding — this page leaves it open. For practice: according to one's community's custom and one's Rav's ruling.
