The text of the Shulchan Arukh — selected passages
The siman has only six seifim — its own heading says so: “ ישראל ועכו״ם שותפין איך יתנהגו בשבת. The whole first seif turns on two clauses, and the pilpul of this level is born from their opposition.
Then the Rama’s gloss — which is the Rama and not the Mechaber: Sefaria prints it inside a small tag within the seif, and that is where it lives:
1. Where the sugya starts —
The root of the sugya. Ravina raises this braisa against Rava, who had just permitted the case reported immediately before — the non-Jew took Shabbos, the Jew took Sunday:
Rava was embarrassed; then it emerged that those men had stipulated at the outset — לְסוֹף אִיגַּלַּאי מִלְּתָא דְּהִתְנוּ מֵעִיקָּרָא הֲווֹ (עבודה זרה כ״ב.). Everything therefore turns on when the division of days was agreed. Divide the days after the work has fallen on both, and the Jew makes the non-Jew his agent for Shabbos; agree it before, and Shabbos never fell on him at all.
The gemara then raises its own question, and does not resolve it:
The opening clause and the closing clause pull in opposite directions, and the gemara concludes that nothing can be derived. It is this בעיא דלא אפשיטא (בית יוסף או״ח סימן רמ״ה) that governs the whole bedi’eved of the siman; section 3 shows that the Rishonim part company over which way an unresolved rabbinic doubt is decided.
2. Chakira on תנאי מעיקרא — structural or dispositional?
Why does a condition made at the outset change anything, when the very same sentence spoken the next day changes nothing?
- First side — structural. The condition builds the partnership: on Shabbos the Jew simply has no share in the field. It is not his intention that changed, it is what he owns.
- Second side — dispositional. The condition merely strips the Jew of any claim to the Shabbos profit. It bears on what he wants and on what he shows himself to want — so later conduct can belie it.
“ דכיון דמעיקרא התנו ה״ל כאילו אין לישראל חלק בשדה כלל ביום השבת אלא כולו של עכו״ם בשבת וכולו של ישראל ביום החול ונמצא שלא הוטלה מלאכת שבת על ישראל כלל מאחר שאין השדה שלו ביום ההוא ” (בית יוסף או״ח סימן רמ״ה)He supports this from the Semag and the Sefer HaTerumah, who require the stipulation before the purchase — yet he refuses to demand those exact words: saying “take Shabbos, I shall take a weekday” before the acquisition counts as stipulating that the Jew has no share on Shabbos.
“ אם התנו מתחלה קודם שקנו השדה שלא יהיה לישראל חלק בו ביום השבת ” (בית יוסף או״ח סימן רמ״ה)The Ra’avad, brought by the Ran, holds the other side — and the Beis Yosef expressly rejects him: for the Ra’avad, if after stipulating the partners come to an accounting and divide equally, that retroactively reveals the stipulation to have been mere הערמה.
What the chakira yields, and where to test it. The split is not ornamental: it governs seif 2. If the condition is structural, nothing that follows can touch it; if it is dispositional, a later accounting undoes it.
The Taz reads the Mechaber as structural, and takes it to the end: once stipulated, everything is permitted — including, he says, the explicit accounting that the Teshuvos HaGe’onim forbade.
The Magen Avraham holds the other end, with the Ra’avad, and forbids the accounting:
The Mishnah Berurah records both and does not decide: it gives the Magen Avraham’s view, then those who are lenient since they stipulated at the outset, and refers to the Eliya Rabba, who leaves the matter in צ״ע.
The question therefore stays open, and it is open among the Acharonim themselves; it is not for the reader to close it.
3. When nothing was stipulated at the outset — bedi’eved
Two situations, not to be confused:
- Saying it afterwards. Saying, once already partners, “ טול אתה חלקך בשבת ” (בית יוסף או״ח סימן רמ״ה) repairs nothing: that is precisely the case the braisa forbids. The Mishnah Berurah adds that the Mechaber’s prohibition does not even depend on that sentence — not having stipulated beforehand is itself enough.
The remedy is therefore not a late stipulation but dissolving and re-forming the partnership, which the Mechaber sets out in seif 3.“ היכא שלא התנו בתחלה יש תיקון ע״י שיחזיר המוכר להם דמי הקרקע או ימכרוהו לאיש אחר ויחזרו ויקנוהו בשותפות ויתנו בשעת הקניה ” (שולחן ערוך או״ח רמ״ה:ג)
That is exactly what Rabbeinu Tam ruled in the case of the oven taken as a pledge: take back the debt, lend again, and stipulate from the start.“ שצוה ר״ת לקבל החוב מן העכו״ם ולחזור ולהלוות ולהתנות מתחלה ” (בית יוסף או״ח סימן רמ״ה)
- Nothing was said at all, and they divide סתם. This is the gemara’s unresolved בעיא, and the Rishonim part company over which way a rabbinic doubt is decided. The Rosh goes to leniency, the Rambam and the Rif to stringency; the Beis Yosef rules with the latter.
The Mechaber then writes סתם like the Rambam, and the Rama adds in his gloss those who permit bedi’eved, with his own measure — where the loss would be great.“ ואם לא התנו מתחלה ובשעת חלוקה חלקו סתם בשוה זהו בעיא בגמרא ולא אפשיטא ופסק הרמב״ם לחומרא והרא״ש לקולא והמחבר סתם כהרמב״ם והרמ״א פסק בהג״ה כהרא״ש במקום הפסד גדול ” (משנה ברורה או״ח רמ״ה ס״ק א)
The Admur HaZaken follows the stringency and says so in his own words, with the same reservation:“ וְכֵן עִקָּר.
4. Mar’is ayin in commerce
If a stipulation made at the outset settles everything, why does siman 243 forbid, in certain places, renting a non-Jew a bathhouse — and an oven, which follows the bathhouse — for fear of mar’is ayin? The mill is not forbidden there: the seif closes with ותנור דינו כמרחץ ורחיים דינו כשדה, and the field is permitted. And what of the shop that stays open on Shabbos under a sign bearing the Jew’s name?
There are two layers, and they do not overlap:
- The stipulation settles the question of the right to the profit and of שליחות: Shabbos does not fall on the Jew, and the non-Jew is not his agent. That is the ta’am the Mechaber himself gives in seif 4.
- Mar’is ayin is a separate layer — but the sources of this siman, far from upholding it, set it aside in a genuine partnership, and for a precise reason: everyone knows the non-Jew has a share. The Ran, brought by the Beis Yosef on the bathhouse, writes:
The Magen Avraham and the Mishnah Berurah take this up, and the Admur HaZaken carries it to the end: in a partnership with a non-Jew there is no mar’is ayin, even in public.“ ולא חיישינן משום מראית העין שיאמרו לצורך ישראל הוא עושה כיון שידוע שיש לא״י חלק בו ” (משנה ברורה או״ח רמ״ה ס״ק א)
Mar’is ayin therefore does not return against the partnership as such: it returns where the non-Jew’s share is not visible and the business is called by the Jew’s name. The Mishnah Berurah draws the line in exactly those terms:
Independently of mar’is ayin, the rule of הבלעה remains: the Rama and the Ran want the Shabbos share taken absorbed within the other days, failing which it looks like Shabbos wages.
5. The shittos of the Rishonim — Rashi, Tosfos, Rambam
| Shittah | תנאי מעיקרא | Without a stipulation · mar’is ayin | Repair bedi’eved |
|---|---|---|---|
| רש״י (ע״ז כ״ב., brought by the ב״י) |
It works because the Shabbos labour was never laid on the Jew: “ לפי שנעשה שלוחו על חצי היום המוטל עליו ואם התנו מתחלה קודם שהוטלה עליו מותר דהא לא קיבל עליה ישראל עבודה בשבת ואין העכו״ם שלוחו ” (בית יוסף או״ח סימן רמ״ה) | For Rashi, “ וְאִם בָּאוּ לְחֶשְׁבּוֹן — אָסוּר ” (עבודה זרה כ״ב.) refers to the סתם case and not to one where they stipulated; the Taz concludes: “ ורש״י ג״כ כרמב״ם ס״ל ” (ט״ז או״ח רמ״ה ס״ק ב) | He does not treat it here; it comes from the Mechaber in seif 3. |
| תוס׳ · ר״ת (against ר״י, who retracted) |
It works, and without distinguishing an oven from a field: “ דאין חילוק בין תנור לשדה ” (בית יוסף או״ח סימן רמ״ה) | Rabbeinu Elchanan limits it: when the oven is entirely the Jew’s, the stipulation is of no use — “ דאפי׳ התנו מתחילה לא יועיל כיון שכל התנור של ישראל ” (בית יוסף או״ח סימן רמ״ה) | Take it back, then re-form it with a stipulation: “ שצוה ר״ת לקבל החוב מן העכו״ם ולחזור ולהלוות ולהתנות מתחלה ” (בית יוסף או״ח סימן רמ״ה) |
(Hilkhot Shabbat ch. 6) |
It works; but without a stipulation he goes to stringency, and the Beis Yosef rules with him: “ ולענין הלכה כיון דהרי״ף והרמב״ם מסכימים לאסור הכי נקטינן ” (בית יוסף או״ח סימן רמ״ה) | His ta’am, taken up by the Mechaber in seif 4, joins the two: no שליחות, and no recognisable business — “ מפני שאין מלאכה זו מוטלת על ישראל לעשותה שנא׳ שהעכו״ם עושה שליחותו וכן אין העסק ניכר ממי הוא ” (שולחן ערוך או״ח רמ״ה:ד) | Without a stipulation the non-Jew takes the profit of all the Shabbosos, and if it is unknown, a seventh: “ ואם לא היה שכר השבת ידוע יטול העכו״ם לבדו שביעית השכר וחולקים השאר ” (שולחן ערוך או״ח רמ״ה:א) |
It works only if the non-Jew has a share in the body of the thing: “ שֶׁאֵין הַתְּנַאי מוֹעִיל אֶלָּא כְּשֶׁיֵּשׁ לְהַנָּכְרִי חֵלֶק בְּגוּף הַדָּבָר שֶׁעוֹשֶׂה בּוֹ הַמְּלָאכָה ” (שולחן ערוך הרב רמ״ה:י״א) | No mar’is ayin in a partnership, even in public: “ בְּכָל מָקוֹם שֶׁהִתִּירוּ בְּשֻׁתָּפוּת נָכְרִי — הִתִּירוּ אֲפִלּוּ עוֹשֶׂה בְּפַרְהֶסְיָא, וְאֵין חוֹשְׁשִׁין לְמַרְאִית הָעַיִן ” (שולחן ערוך הרב רמ״ה:י״ג) | With those who forbid, except where the loss would be great: “ וְכֵן עִקָּר.
The Taz thus reads Rashi with the Rambam on the first point — but the order of time runs the other way. The Beis Yosef died in 1575, the Taz in 1667: it is not the Taz’s reading that makes the Beis Yosef write anything; it is the Taz who, in ס״ק ב, quotes this passage of the Beis Yosef and draws his conclusion from it. And he quotes it while marking the phrase as the end of words of the Mahari Abohav, the עכ״ל falling after it:
From that reading the Taz draws his own conclusion, and only from there does he bring Rashi together with the Rambam:
In the Beis Yosef the phrase itself reads:
One point stays open, and this page does not settle it: in the Beis Yosef himself no עכ״ל comes before the ולענ״ד, so that what he opens with “ וכתב הגאון מהרי״א ז״ל ” (בית יוסף או״ח סימן רמ״ה) can also be read as having closed earlier — the continuation, and hence the phrase, then being the Beis Yosef’s own. The Taz, for his part, places the עכ״ל after it and gives it to the Mahari Abohav. Both readings hold; we report both, and choose neither.
What really separates the shittos is not the force of the תנאי, on which they all agree, but two distinct questions: what is required for there to be a stipulation at all, and what silence is worth.
6. A jointly held shop on Shabbos — what the Beis Yosef brings
“ וגם ליכא מפני שהיא נקראת על שמו דכיון שהכל יודעין שמרחץ זה יש לעכו״ם חלק בו ” (בית יוסף או״ח סימן רמ״ה)It is this case that the Rama carries into his gloss on seif 1, drawing from it the general form: where both work together all week and on Shabbos the non-Jew works alone, the Jew shares all the profit.
But the Rama goes further in seif 3, and there the Taz stops him: the Rama permits renting the Jew’s own share to the non-Jew for Shabbos. The Taz does not know where that heter comes from.
“ ונראה שאין לסמוך על היתר זה להשכיר לו לשבתות לחוד ” (ט״ז או״ח רמ״ה ס״ק ג)The Mishnah Berurah reports that both the Magen Avraham and the Taz stumbled over this passage — עיין במג״א וט״ז שנתקשו בזה מאד — and it is the Magen Avraham who resolves it: ותירץ המג״א במסקנא דהכא איירי שמשכיר לו את חלקו בשבת בהבלעה. The Taz reaches the same point for the halakhah — וכן הט״ז מסיק לדינא דאינו מותר בזה אלא בהבלעה — and the Mishnah Berurah adds after him that one should refrain from discussing the business with the non-Jew on Shabbos (משנה ברורה או״ח רמ״ה ס״ק ט״ו). For a shop that stays open on Shabbos, it is that reservation — not mar’is ayin — that carries the weight.
7. The “automatic” partnership of today
Does a partnership in a business that runs with nobody present on Shabbos — an online shop, a scheduled campaign — still call for a תנאי מעיקרא?
- First side — yes. What the braisa addresses is not the act on Shabbos but the burden: once the work of the business is laid on both partners, the Shabbos profit comes to one on the other’s account. The Mishnah Berurah puts it in those general terms, without speaking of any particular act:
- Second side — no. Seif 4 permits handing money to a non-Jew to trade with and sharing the profit equally, even though he trades on Shabbos: the melakhah is not laid on the Jew, and the business is not recognisable as his. If nobody acts on Shabbos, one would be closer to that case than to the field.
Both sides contest one and the same point: does the תנאי bear on the act, or on the burden? The question is not decided here, and seif 5 shows that another factor enters — what is said to the non-Jew: “ מות׳ לישראל ליתן סחורה לעכו״ם למכור אם קצץ לו שכר ובלבד שלא יאמר לו מכור בשבת ” (שולחן ערוך או״ח רמ״ה:ה). The Mishnah Berurah draws from it a consequence that bears directly on modern commerce: if the market day is Shabbos, then even saying nothing is as though it had been said.
8. Practical contemporary nafka minos
1. A restaurant held with a non-Jewish partner. A stipulation in the partnership agreement: the Shabbos profit to the non-Jew alone, the profit of one weekday to the Jew alone — that is the very form of seif 1. And the Jew does not work there on Shabbos, the stipulation bearing only on the share, never on the act.
2. Online trade with a non-Jewish partner. The stipulation at formation is what is most often missing, since the articles are signed before anyone thinks of it. To this add seif 5: do not ask the non-Jew to sell on Shabbos.
3. Shares, funds, holdings in a listed company. This is not an operating partnership; seif 4 gives the reason — the melakhah is not laid on the Jew, and the business is not recognisable as his.
4. A start-up with a non-Jewish investor. Everything depends on the structure. If the Jew runs it and works in it, one is in the case of seif 1; if he only brings capital, one is nearer seif 4. It is the burden of the work, not the percentage held, that the sugya looks at.
5. A physical shop with a non-Jewish partner, open seven days a week. Two distinct questions, not to be merged: the stipulation on the one hand, and on the other the Taz’s reservation on seif 3 — do not rent out your share for Shabbos alone, but בהבלעה. On mar’is ayin the sources of this siman are on the contrary lenient, once the non-Jew’s share is known
6. Letting a property held in partnership. The same form: the stipulation at formation, and the Shabbos bookings going to the non-Jew. The Jew does not intervene.
7. Business-to-business electronic trade. To the stipulation add the warning of ס״ק כ״א: if the bulk of the activity falls on Shabbos, silence no longer protects.
8. Property management in partnership. Depending on whether the partnership is active — collecting rent, maintenance — or merely patrimonial, one stands on the side of seif 1 or on the side of seif 4. And the warning of seif 6 applies here as elsewhere: “ אם אפו עכו״ם בתנורו של ישראל בשבת על כרחו ונתנו לו פת בשכר התנור אסו׳ ליהנות ממנו ” (שולחן ערוך או״ח רמ״ה:ו).
Going further
Level 3 — Synthesis: recap, the
Level 4 — Daat HaRav: the shittah of the Admur HaZaken across the nineteen seifim of his own Shulchan Arukh — “ יִשְׂרָאֵל וְנָכְרִי אֵיךְ יִתְנַהֲגוּ בְּשֻׁתָּפוּת וּבוֹ י״ט סְעִיפִים ” (שולחן ערוך הרב רמ״ה:א) — on commerce, investment and partnership.
