📜 The text of the Shulchan Arukh — 7 seifim (excerpts)

Four fragments, taken from seif 1 and seif 7, to set the two ends of the siman: what makes the packing material movable, and what may be done with a sealed oven. Each is given as Sefaria carries it, without the parenthetical glosses the edition inserts.

summary: the seven seifim come down to three questions — what makes the material packed around the pot movable (seifim 1–2), how to take the pot out when that material is not movable (seifim 3–5), and what may be done with a sealed oven (seifim 6–7). The seifim are given here as excerpts; the full text, clause by clause, is at level 1.

1. Opening of the sugya — Shabbat 48a–50a and the baraita of the mokhin

The question is born of a very brief exchange. Rav Ada bar Matana asks Abaye what becomes of the mokhin — any soft material: flock, combings, worn rags — in which the pot was buried before Shabbat: may they be moved the next day?

Abaye’s answer is neither a yes nor a no: it is a common-sense objection put as a question. Burying a pot in mokhin is not abandoning them; a man who has no basket of straw does not therefore stand up and declare a basket of flock ownerless.

The gemara then looks for support in a baraita, and it is that baraita which gives the list of packing materials — fleeces of wool, flocks of wool, tongues of purple wool, mokhin — concluding that they are not moved.

The mishna, a little further on, rules differently according to the material: hides are moved, fleeces of wool are not, and it states the procedure — one takes the cover and they fall.

On that mishna Rava is reported in two versions, and the gap between them is the whole issue of the siman. First version: what releases the fleeces is the burying itself.

The gemara refutes that reading — the mishna says “they are not moved” precisely about fleeces in which one has buried — and corrects it: what releases them is not the act but the designation.

Ravina keeps the first version and explains the mishna otherwise: it speaks of fleeces held in store, set aside for sale. A baraita supports him.

Root of the sugya: the dichotomy is set — designated, one moves; not designated, one does not. Everything that follows turns on who falls on which side. The Beit Yosef here reports the Rosh — וכתב הרא״ש ע״ז — who states the difficulty the gemara leaves behind: if Abaye and Rava do not disagree, one must say either that mokhin are held to be like fleeces, or that the mishna speaks of fleeces held in store.

The Shulchan Arukh, in seif 1, carries both sides: mokhin buried by chance — forbidden to move; mokhin designated — permitted; fleeces of wool — permitted even without designation; fleeces laid up in store for sale — subject to designation again.

2. חקירה on the gader of ייחוד

A threefold חקירה on ייחוד:

The Shulchan Arukh writes in seif 1 “and if he designated them for this” with no further word, and in seif 2 “he must designate them for this לעולם”. The lamdan’s question is whether that word, absent from the first seif, is implied there. The Magen Avraham answers in four words: he reads it there.

The Mishnah Berurah gives the full answer, and it settles all three branches at once: permanence is required (branch ג), an act is not (against branch ב), and thought alone suffices (branch א).

The Admur HaZaken reads the seif the same way, and glosses the word “designate” with a formula that leaves no doubt: it is an inner resolve, and it bears on “for ever”.

The Beit Yosef, on seif 2, infers from the Tur’s wording that the designation must hold for ever, and ties that reading to a responsum of the Rashba.

The Ran, as the Beit Yosef reports him, opens another door: where burying alone suffices — that is, for fleeces not held in store — perhaps it holds only for that Shabbat, and not for another.

A third path remains, which the Mishnah Berurah opens on the words “by chance” in seif 1: one who is in the habit of burying in those mokhin has removed the name מוקצה from them without ever designating anything explicitly — and the Bayit Chadash holds that twice suffices.

נפקא מינה: a family that wraps its pot, every Friday, in the same blanket, without ever having decided that this blanket would serve “for ever” for that. On the reading of the Magen Avraham and of the Mishnah Berurah at ס״ק ה, there has been no ייחוד. On what the Mishnah Berurah reports at ס״ק ב in the name of the Bayit Chadash, regularity by itself removes the name מוקצה. The Mishnah Berurah reports the Bayit Chadash without deciding the matter; we report, and we do not rule.

3. What separates mokhin from fleeces of wool — the root of the distinction

חקירה: why do fleeces of wool require no ייחוד?

The Acharonim take here a road the second branch did not expect: it is not the importance of the fleeces that frees them, it is the lack of importance. The Magen Avraham says it in three words.

The Mishnah Berurah develops the point: fleeces are indeed מוקצה in themselves, destined for spinning and weaving, but they are not held to be as important as mokhin — and that is why the mere fact of having buried in them counts as designation.

The reasoning therefore assumes the opposite for mokhin: they are too important for an occasional use to carry them along. The Mishnah Berurah gives the technical reason — they are מוקצה מחמת חסרון כיס, a man values them and refuses to put them to any other use.

The Admur HaZaken states both sides in the same seif: as for mokhin, they are מוקצים because they stand to be made into felt; as for fleeces, they are not so important, and a single burying establishes them.

The clause about the merchant’s store — fleeces laid up for sale — does not contradict this: it adds a condition which the Magen Avraham specifies, and which is that of מקפיד.

The Mishnah Berurah gives the motive: since they are with him for sale, he means to return them afterwards to the store, and so he does not nullify them to the burying.

4. Stones and bricks —

קושיא: why does the word לעולם appear only here, in seif 2, and not in seif 1? Section 2 showed that the Acharonim read it into seif 1 as well. What then is left that is proper to stones?

תירוץ: what changes is not the duration required, but what can take its place. For fleeces, the act of burying is itself designation (section 3); for mokhin, habit can take its place (מ״ב רנ״ט:ב); for stones, nothing takes its place, because after use the practice is to throw them outside. The Shulchan Arukh says so itself in the continuation of the seif — “as long as he has not designated them they are not important to him and he throws them away” — and the Mishnah Berurah spells it out.

The Admur HaZaken extends the seif to a second case, the firewood with which one stops the mouth of the oven, and he sets the same requirement.

And he at once sets the limit: the stones that rest permanently on the stove need no express designation, since they are of themselves set aside for a use. The Magen Avraham had written it, and the Mishnah Berurah repeats it.

נפקא מינה: two stones, one lying on the stove since always, the other picked up outside on Friday to prop this week’s pot. The first requires nothing; the second, according to seif 2, requires a designation for ever, and having wanted it for this Shabbat alone does not suffice.

5. The gader of the גומא — putting back, or a new הטמנה?

חקירה: what is the gader of the גומא, the hollow the pot leaves in the packing material?

This is no speculation: the Shulchan Arukh puts both into the same seif, and the Beit Yosef names both reasons. On the first opinion — Rashi’s and the Tur’s — the prohibition lies in one’s moving the fleeces, which are מוקצה: that is why the seif speaks only of a basket of fleeces that may not be moved. The Mishnah Berurah says so.

On the יש אומרים — the Rambam, in his commentary on the mishna — the reason is quite different: the pot would have to dig itself a place, and one would then be burying on Shabbat. That reason holds whatever the material, and this is what the seif says.

מחלוקת and נפקא מינה: a material that is not מוקצה — blankets, designated cloths. On the first opinion, a collapsed גומא changes nothing, since nothing מוקצה is moved. On the יש אומרים, one does not put back, because the problem is not מוקצה but הטמנה. The Shulchan Arukh brings both without deciding between them.

The Magen Avraham adds a piece that ties this section to the next: here the prohibition is graver than the טלטול מן הצד permitted elsewhere, because one must push the material this way and that.

And the Mishnah Berurah recalls why putting back is in itself permitted: חזרה is permitted on Shabbat in something that does not add heat, as was set out in siman 257.

6. טלטול מן הצד — the חקירה on “he shakes the cover”

חקירה: what is a “טלטול מן הצד”?

The condition the seif adds — “that part of it be uncovered” — is understood on branch א, and the Mishnah Berurah says so explicitly: a free space is needed to grasp the cover, so that one need not move the mokhin directly.

The Magen Avraham draws the consequence: if nothing is uncovered, the spindle remains — one may push it in and shake, which is still an indirect movement.

The Admur HaZaken names the thing in so many words in his seif 2, referring to siman 311 where the gader is set out.

The Taz’s קושיא (ס״ק ב): why require that part be uncovered? In siman 309, about the stone lying on the mouth of the barrel, the Taz recalls that when one needs the place, it is permitted to move the barrel.

The Taz’s תירוץ: there the case is of one who forgot the stone; here he placed it with his hands, and what carries it becomes a בסיס לדבר איסור.

And the Taz does not let himself off: he observes that his own answer follows one of the opinions in siman 309 — the one that treats a man as מניח even when he means to take the object back that same day — and not that of the Baal HaTerumot, for whom there is מניח only if one means to leave the object in place the whole Shabbat. Yet in seif 7 of this very siman, about the oven, the Shulchan Arukh rules like the Baal HaTerumot. He ends on a צריך עיון, and we leave it open.

7. The matrix of combinations — seifim 4–5

Packing materialCover of the potDin
movablemovableno question arises (a case the seifim do not treat)
not movable (seif 4)movablehe uncovers the cover, takes hold of the pot and brings it out
not movable (seif 5)not movable — part of the pot is uncoveredhe takes and puts back
not movable (seif 5)not movable — nothing is uncoveredhe does not take

A fifth combination is missing from the table because the seifim do not state it, and the Magen Avraham supplies it: buried in what is movable, covered with what is not. One then clears the surroundings, takes hold of the pot and brings it out — the pot not having become a בסיס for what covers it. The Mishnah Berurah adds that one then shakes the pot and the non-movable falls off by itself.

יסוד of the matrix: everything turns on physical access — can the pot be taken without laying a hand on the מוקצה? If the cover is movable, one goes by the cover. If everything is מוקצה but part of the pot is uncovered, one goes by the uncovered part. If everything is closed, no road remains, and the Shulchan Arukh writes “he does not take”. The Magen Avraham’s spindle (section 6) is the last resort before that.

8. Yom Tov falling on the eve of Shabbat — seif 6

Two opinions, and the Beit Yosef brings both from the Shibolei HaLeket:

The Mishnah Berurah sharpens the issue and removes a confusion: the difficulty is not מוקצה — even if the stones were designated long ago, the question remains. It is that of בנין עראי, forbidden מדרבנן on Yom Tov.

The reason of those who permit is given by the Magen Avraham: for the honour of Shabbat no decree was made — and he adds the limit, which the Mishnah Berurah takes up: if one can bury in another way, it is forbidden according to all.

As to practice, the Mishnah Berurah reports the Eliyahu Rabba — the מנהג follows those who permit — and notes that the Admur HaZaken writes likewise.

The Admur HaZaken, in his own Shulchan Arukh, writes both limbs in a single seif: the prohibition first, then the permission when one has nothing else.

9. Sealing the oven — seif 7

קושיא: the oven is attached to the ground, and one does not demolish a building attached to the ground. Why should breaking the clay that closes its mouth be permitted?

תירוץ: this is no סתירת בנין, not even מדרבנן, because that sealing was never made to last. The Mishnah Berurah sets it down in one line, and the Taz brings the same reason in the name of the Mordechai, as the Beit Yosef gives it.

The Admur HaZaken unfolds the reasoning in two steps: first the general rule — by Torah law the prohibition bears only on the body of the building, not on its opening; then the application — the oven’s plastering, made to hold the heat for a few hours and to be broken the next day, does not fall under the decree.

The Rama’s gloss does not overturn the permission, it bounds it: one should not break the clay-plastered sealing oneself if it can be done by a non-Jew, nor by an adult if a child can, and failing that one does it with a slight change. The Mishnah Berurah gives the motive: perhaps, the clay being there, there is a little of סתירת בנין in it.

There remains the clause of the glowing coals, and it must be taken by the right end: the permission “through a non-Jew” in seif 7 bears on sealing, and the fear is of extinguishing. The Mishnah Berurah says so plainly — אבל ע״י ישראל אסור לסתום דמכבה הגחלים ואע״פ שאין מתכוין לכך אסור משום פסיק רישא אבל באמירה לא״י לא קפדינן כולי האי (משנה ברורה רנ״ט ס״ק כ״א) — and refers to the end of siman 253. The point about opening, where the incoming air fans the coals, is derived: the Magen Avraham introduces it with ומשמע בת״ה דה״ה לפותחו, and the Mishnah Berurah places it at the end of the same ס״ק. The Mishnah Berurah further notes, on the words “and to seal it again”, that this is a distinct point: one need not fear that the sealing would extinguish coals that might be inside.

10. גורם בישול — the Rama’s chiddush, night / day

יסוד of the chiddush: גורם בישול — indirectly causing the cooking. The Rama distinguishes two moments:

The Mishnah Berurah specifies the mechanism, and it is wider than one would think: it is the closing of the oven’s mouth, even without the clay plastering, that adds heat and makes the food cook faster.

It also specifies how far the prohibition reaches — it does not stop at the deed: the food itself is forbidden afterwards, as for one who cooks on Shabbat, and for that the Mishnah Berurah refers to siman 318 seif 1 — עיין לקמן בסימן שי״ח ס״א. It is to the restriction that follows that it attaches the Rama's responsum 102: this holds only if the cooking had not yet reached

And as to the non-Jew, it separates the a priori from the accomplished fact: the prohibition stands, because the sealing really brings the cooking nearer; but if the non-Jew has sealed it, the food is not forbidden, since it would have finished cooking in any case.

The Admur HaZaken devotes his eighth seif to this — the siman has eight seifim in his work, seven in the Mechaber’s — and the formulation there is the same.

11. Modern practical

What follows is not a line of conduct: these are the questions the preceding sections put to objects of today, with the seif or the commentary entry they belong to. Level 2 reports and does not rule; halakha lema‘aseh is to be asked of the Rav.

1. Is a blanket laid on the pot מוקצה? A household blanket is a garment, carrying תורת כלי all year round: the question of ייחוד, which arises because mokhin are מוקצה מחמת חסרון כיס (מ״ב רנ״ט:ג), does not present itself in the same terms. What remains is whether the blanket has become a בסיס for what it carries — that is the closing clause of seif 1 (מ״ב רנ״ט:ט).

2. Kitchen aluminium foil. It is not meant to be laid up in store for sale; the clause of seif 1 about the fleeces of the warehouse, of which the Magen Avraham says it assumes one is מקפיד about them (מג״א רנ״ט ס״ק ד), does not reach it.

3. The insulated hot bag. An object made for this use alone: the question is whether one is in the case of mokhin — a material that calls for designation — or in that of a כלי that already carries תורת כלי. Both sides are in seif 1.

4. The pot taken off the plata. Two distinct gedarim cross here and must not be confused: חזרה, which the Mishnah Berurah recalls here by referring to siman 257 (מ״ב רנ״ט ס״ק י״ג), and the גומא of seif 3, which presupposes a הטמנה — the pot buried in a material. A bare plata is no הטמנה.

5. The “Shabbat mode” oven, in the morning. This is the case the Rama declares permitted: all the pots are fully cooked The Mishnah Berurah adds that the question of closing is not limited to the clay plastering

6. The “Shabbat mode” oven, at night. This is the case the Rama forbids, and even through a non-Jew. The Mishnah Berurah attaches to it a consequence after the fact regarding the food (מ״ב רנ״ט:כה) and a reservation for the case of the non-Jew (מ״ב רנ״ט:כו).

7. The lid of a slow cooker. The question splits in two: is the lid מוקצה — and if it is not, does taking it off and putting it back fall under the Rama’s גורם בישול when the contents are not yet fully cooked.

8. Yom Tov falling on the eve of Shabbat. Seif 6 deals with stones that one arranges, and the Mishnah Berurah names the reason — it is Whether an appliance that one sets down falls under the same gader is not stated by the seif, and we do not add it.
