📜 The text of the Shulchan Arukh — 1 seif
Translation: That it is permitted to place, on Shabbat eve, a cold thing on a hot pot. And it contains one seif: it is permitted to place, while it is still day, a vessel containing a cold thing upon a hot pot, for this is not like burying in something that adds heat.
The siman is one sentence long, and that sentence is negative: it creates no new heter, it removes one case from the prohibition of burying (hatmana) laid down in siman 257. The whole pilpul consists in asking on what grounds it is removed — and the Acharonim do not answer alike.
1. The sugya — Shabbat 51a–51b and the Rambam
Two Talmudic threads meet here. The first is the discussion about burying something cold: Rav Yehuda in the name of Shmuel permits it, and the mishnah at the end of perek Bameh Tomnin records the opposite position together with Rabbi's permission.
The second thread is the beraita that is the direct source of our seif — and it is the one to keep in view, since the whole siman depends on it:
Two things are said there. First what is placed: a hot vessel upon a hot vessel. Then why: not so that they should heat up, but so that they should be kept. The beraita therefore does not speak of our case at all — ours is a cold thing, placed precisely so that it should warm up.
« אֲבָל אֵין מַנִּיחִין כְּלִי שֶׁיֵּשׁ בּוֹ דָּבָר צוֹנֵן עַל גַּבֵּי כְּלִי חַם בְּשַׁבָּת שֶׁהֲרֵי מוֹלִיד בּוֹ חֹם בְּשַׁבָּת וְאִם הִנִּיחוֹ מִבָּעֶרֶב מֻתָּר וְאֵינוֹ כְּטוֹמֵן בְּדָבָר הַמּוֹסִיף » — (רמב״ם הל׳ שבת פ״ד ה״ו)The last clause is, word for word, our siman: on Shabbat one does not place the cold upon the hot because one generates heat in it (molid chom); but if he placed it the evening before — permitted, and it is not like burying in something that adds heat.
A textual variant, and it matters. Our editions of the Talmud forbid the meicham upon the pot; the Beit Yosef notes that the girsa followed by the Tur is another one, and that it has authority behind it:
Root of the sugya. Rashi, as the Beit Yosef reports him, reads the beraita as speaking even of Shabbat, and above all as excluding any intent to warm:
A methodological note, to avoid a common confusion: the sugya of Beitza 22a, often cited alongside this one, deals with burying done on a festival for Shabbat (eruv tavshilin). It does bear on hatmana, but it is not the source of our seif; the source is the beraita of Shabbat 51b and the halakhah of the Rambam quoted above.
2. Chakira on the gader of hanacha — what separates placing from burying?
A three-branched chakira. The seif says "this is not like burying". It remains to be determined on what grounds the act escapes hatmana:
- Branch A — geometry. What makes hatmana is enclosure: the thing is taken in on every side. Here the cold vessel is merely set down, open to the air; there is therefore no hatmana at all, and the question whether the pot adds heat never even arises.
- Branch B — the enclosing material. What makes hatmana is the nature of what one buries in — gefet, dung, salt, sand. A pot does not belong to that family.
- Branch C — the thermal regime. There is indeed hatmana, but upon a support that adds nothing: the pot's heat keeps diminishing. The act is removed from the prohibition not because it is not a burying, but because that in which one buries is not a mosif hevel.
These three branches are not a reconstruction: the Alter Rebbe's Kuntres Acharon himself states the opposition between the first and the third, and says which belongs to whom.
The Taz, for his part, places the essential reason on the geometric side:
The Rama, in siman 253, had already laid down the criterion of being uncovered:
The Kuntres Acharon names the machloket. It is he who explains why the Beit Yosef needed the thermal reason — because, for the Tur and the Mechaber, even an uncovered pot is called hatmana:
In other words: branch C belongs to the Tur and the Mechaber; branch A is the one "we" hold — Rama in siman 253, the Taz here, the Rambam and the Maggid Mishneh at the end of perek 4. And the Alter Rebbe adds that the ruling holds true on either reading, his own case being the one where the pot is covered on top.
Nafka minot.
- A pot left open on top. Branch A: the question of mosif hevel does not arise, since there is no burying. Branch C: it arises entirely, and it is the decline of the heat that saves the case.
- A short span, the pot staying hot throughout. The Taz — who nonetheless holds branch A — withholds the heter here, which shows that in his eyes the geometric branch does not settle every case (see section 3).
- The practice reported by the Kuntres Acharon of burying kinds of dough before Shabbat in a small pot set inside a large one: there hatmana is present in the full sense, and it is our siman that justifies it.
3. Is a hot pot a mosif hevel?
Chakira. Siman 257 forbids burying in what adds heat. Is a hot pot such a thing?
- Branch A — no. It produces nothing: it gives back a heat it already holds, and that heat declines.
- Branch B — yes, for as long as it is of use. So long as it is actually hot, it does add heat to whatever is set upon it.
- Branch C — it depends on the source. A pot standing on an active fire is no longer judged in its own right; the fire is what is at issue, and one moves to another siman.
The Alter Rebbe gives the same reason in his seif:
The Taz does not stop there, and this is the most lamdanic point of the siman: he limits the heter to what one means to leave for many hours, the pot being liable to cool before the end. For a short while, where one takes the object back while the pot is still hot, he forbids it — and in those terms the pot is indeed a mosif hevel:
How does the Taz hold together? He holds branch A (the act is no burying, since the object is only set upon it) and he holds that a hot pot adds heat. The two do not contradict: the first answers "is there hatmana?", the second answers "upon what?". His heter therefore rests entirely on the first, and he withdraws it the moment the case becomes a genuine burying — which is exactly what he says of the winter practice reported in section 9.
The Magen Avraham shifts the question rather than answering it: if the lower pot is on the fire, it is no longer hatmana that judges the case but the shehiyah of siman 253.
And it is precisely this line that the Alter Rebbe chose not to carry over — see section 6.
4. The shitot of the Rishonim and the reach of the heter
| Authority | What it establishes | Where it is read |
|---|---|---|
| Rambam, Hilkhot Shabbat 4:6 | All four combinations of vessels are permitted, even on Shabbat, so long as the aim is to keep and not to warm; cold upon hot is forbidden on Shabbat (molid chom) and permitted from the evening before.
| Rif and Rosh (as the Beit Yosef reports them) | The same girsa as the Rambam, against our editions; it is the one the Tur follows.
| Rashi (as the Beit Yosef reports him) | The beraita speaks even of Shabbat, and only of the case where both were hot, so that the heat should be kept.
| Maggid Mishneh (as the Beit Yosef reports him) | The lower vessel was hot enough to warm the cold one, not merely to take the chill off — otherwise it would be permitted even facing the fire.
| Ran (as the Beit Yosef reports him) | Warming a fully cooked dish on the pot is permitted, even where the hand recoils from the heat, since that is not the way of cooking; but burying under the cloths laid on the vessel is certainly forbidden.
| Rabbeinu Yeruham (as the Beit Yosef reports him) | Two readings where the lower vessel stands on the fire; the second forbids in every case.
| Alter Rebbe | Permits from the evening before, without distinguishing a hot dish from a cold one, upon a boiling pot.
Where the disagreement runs, and where it does not. On the case of the seif itself — a cold vessel placed the evening before on a hot pot that is not on the fire — the authorities gathered in the table above permit. The disagreement lies elsewhere, and it is real:
- on the gader: is this a hatmana that is permitted, or no hatmana at all (section 2);
- on the case where the lower vessel is on the fire, where the Beit Yosef reports two readings and where the Shulchan Arukh rules in siman 318:
- and on the reading of the kuza case: the Alter Rebbe explicitly sets aside the explanation of Rabbeinu Yonah reported by the Ran, in favour of that of Tosafot, the Rosh, the Tur and the Shulchan Arukh in siman 318.
5. The heter as the Beit Yosef explains it
« שהרי אין הקדרה חמה מוספת הבל אדרבה חומה מתמעט והולך » — (ב״י או״ח רנ״ח)Nothing in that sentence says the act would not be a burying. It says that that upon which one buries adds no heat: the pot is a finite body, its heat keeps diminishing. The prohibition of siman 257 — burying in what adds heat — therefore does not apply, for want of a mosif hevel.
What the Taz adds on top of it. The Taz quotes this reason of the Beit Yosef, then places the heart of the matter elsewhere: for him the essence of the heter lies in the object's not being buried inside, only set upon. The two reasons do not exclude one another — but they do not cover the same ground, and that shows the moment a case sets them against each other: in a genuine burying (a vessel plunged into another), the Taz's reason falls away, while the Beit Yosef's would still stand.
Kashya. If the Beit Yosef's reason suffices, why does the Taz look for another? And if the Taz's suffices, why does the Beit Yosef not give it, writing as he does upon the Tur?
Terutz of the Kuntres Acharon. The answer is not to be invented: the Alter Rebbe supplies it. The Tur and the Mechaber follow their own shitah, on which an uncovered pot is already called hatmana; the Beit Yosef, explaining them, was therefore bound to fall back on the thermal reason — the Taz's reason was not available to him.
6. The chidush of the Alter Rebbe in the Kuntres Acharon
« לְפִי שֶׁאֵין הַקְּדֵרָה הָרוֹתַחַת נִקְרָא מוֹסִיף הֶבֶל, שֶׁהֲרֵי חֻמָּהּ הוֹלֵךְ וּמִתְמַעֵט » — (שו״ע הרב רנ״ח:א)Two things follow. First, he does not distinguish a hot dish from a cold one. Second, he takes it that the act is a burying, and makes the whole heter rest on the nature of the support.
The chidush of the Kuntres Acharon. It amounts to this: the ruling holds on both sides of the machloket about the gader. For the Tur and the Mechaber it needs the thermal reason; for "us" — Rama 253, the Taz here, the Rambam and the Maggid Mishneh — there is not even hatmana when the pot is uncovered on top, and the seif then speaks of the case where it is covered.
And the explicit refusal of the Magen Avraham. This is the most striking passage of the Kuntres Acharon on this siman: the Alter Rebbe states in so many words that he has not carried over what the Magen Avraham writes here, and he says why.
The reason given is that the Shulchan Arukh in siman 318:8 ruled leniently, setting aside the comparison with a kirah. The divergence is therefore head-on and located: the Magen Avraham sends one to the shehiyah of siman 253 as soon as the lower pot is on the fire; the Alter Rebbe refuses that referral and rests on 318:8. Both positions are reported here, not arbitrated.
Nafka mina. The every-Friday case — a cold dish set on a pot that is itself on the plata — is exactly the one these two lines share. On the Magen Avraham's line one judges it by siman 253; on the Kuntres Acharon's line one judges it by 318:8. Practical conduct is a matter for one's rav, not for this page.
7. The question of time — only before nightfall, or on Shabbat as well?
Kashya. The seif specifies "while it is still day". Is that specification a mere description of the usual case, or does it lay down that on Shabbat it would be forbidden — and, if so, forbidden on what count?
Terutz. The Mishnah Berurah answers, and her answer is finer than the question. She separates two situations and gives them two different grounds.
First situation: the pot is covered with cloths and one slips the cold thing underneath, on Shabbat. There the prohibition is that of hatmana, and it does not depend on the cooking threshold:
Second situation: the pot is not covered with cloths. There, there is no prohibition of hatmana at all, and what remains is the question of cooking, referred to siman 318:
Yesod. One often reads that on Shabbat it would be forbidden because of cooking and not because of hatmana. The Mishnah Berurah says the opposite in the first case: under the cloths it is indeed hatmana that forbids, and precisely because one generates heat instead of merely taking the chill off — which is the Rambam's own wording, sheharei molid bo chom beShabbat. The ground of cooking appears only once the pot is uncovered.
« ואפילו הוא דבר חי ויתבשל עתה ע״י חום הקדירה שתחתיה ג״כ שרי כיון שמניח מבע״י » — (מ״ב רנ״ח:א)Which shows in passing that the words "while it is still day" are not an added caution: they are what carries the whole heter.
8. The distinction between a cold thing and a hot thing
Chakira. Our seif speaks of a cold thing. What of a hot thing placed on a hot pot — the same rule, or another?
- Branch A — the same rule: the act is the same, only the object changes.
- Branch B — another rule: upon the hot, the intent is to keep the heat, which is the very definition of hatmana; upon the cold, it is to warm.
The yesod of the distinction, and it is Rashi's as the Beit Yosef reports him: upon the hot one maintains (okumei mokim), upon the cold one generates (oludei molid).
But the distinction does not lie on our siman's axis. The two axes must be kept apart, failing which one seems to read a contradiction where there is none:
- on the axis of hatmana — that of siman 258 — what counts is the support and the enclosure, not the temperature of what is placed;
- on the axis of cooking — that of siman 318 — what counts is precisely the state of the object placed, and that is where hot and cold part ways.
This is why the Beit Yosef himself refers the condition to siman 318:
And this is why the Alter Rebbe, writing here on the hatmana axis, can permit מֻתָּר לְהַטְמִין מִבְּעוֹד יוֹם, בֵּין תַּבְשִׁיל חַם בֵּין תַּבְשִׁיל קַר, עַל גַּבֵּי קְדֵרָה רוֹתַחַת (שו״ע הרב רנ״ח:א) without distinguishing: on that axis there is nothing to distinguish.
9. Practical modern nafka minot
The cases below are tied to their sources; they describe the state of the discussion and are not a psak.
- A cold dish placed before Shabbat on a hot pot. This is the case of the seif itself, and it is permitted:
- A raw food, which will cook from the pot's heat. The Mishnah Berurah permits it expressly, provided it was placed before nightfall (מ״ב רנ״ח:א).
- The lower pot stands on the plata. Two lines, set out in section 6: the Magen Avraham refers one to the shehiyah of siman 253; the Kuntres Acharon refuses that referral and rests on 318:8. A question for one's rav.
- On Shabbat, under the cloths covering the pot. The Mishnah Berurah forbids it on the count of hatmana, even below the threshold where the hand recoils (מ״ב רנ״ח:ב).
- On Shabbat, pot not covered with cloths. No prohibition of hatmana; what remains is cooking, per 318:6 (מ״ב רנ״ח:ב).
- Plunging a vessel of cold drink into a vessel of hot water, on Shabbat. The Taz calls the practice ill-done, and the Mishnah Berurah reports the Acharonim to the same effect: it is a burying in the full sense, since the vessel is wholly inside.
- A jug set at a distance from the fire to take the chill off. The Shulchan Arukh permits it on condition that it be far enough not to reach the threshold where the hand recoils
- A barrel of water put into the oven on Friday at dusk. A case distinct from ours — there the water is heated inside the oven — and the Shulchan Arukh forbids it
- Dough buried before Shabbat in a small pot set inside a large one. A practice reported and justified by the Kuntres Acharon, who acknowledges that there hatmana is present in the full sense.
