Siman 102 — Something That Has a Way to Become Permitted (דבר שיש לו מתירין) Is Not Nullified

A דבר שיש לו מתירין — something that, without needing nullification, will become permitted anyway later (the egg laid on Yom Tov, permitted the next day) — is not nullified, even in a thousand, and even in doubt; but only within its own kind (מין במינו): mixed with another kind it is nullified in 60; a utensil forbidden by absorption, whose kashering costs an expense, is not a דשיל"מ; and only a prohibition in substance (בעין) is not nullified — a mere absorbed taste, or a prohibition that is not by itself, is nullified (Shulchan Aruch, Yoreh De'ah 102 — 4 se'ifim)

כָּל דָּבָר שֶׁיֵּשׁ לוֹ מַתִּירִין — כְּגוֹן בֵּיצָה שֶׁנּוֹלְדָה בְּיוֹם טוֹב שֶׁרְאוּיָה לְמָחָר — אִם נִתְעָרְבָה בַּאֲחֵרוֹת, בֵּין שְׁלֵמָה בֵּין טְרוּפָה, אֵינָהּ בְּטֵלָה אֲפִלּוּ בְּאֶלֶף. וַאֲפִלּוּ סָפֵק אִם נוֹלְדָה בְּיוֹם טוֹב וְנִתְעָרְבָה בַּאֲחֵרוֹת — אֲסוּרוֹת. וְאִם נִתְעָרְבָה בְּשֶׁאֵינָהּ מִינָהּ — בְּטֵלָה בְּשִׁשִּׁים.

Anything that has a way to become permitted — such as an egg laid on Yom Tov, fit the next day — if it becomes mixed with others, whether whole or beaten, is not nullified even in a thousand. And even in doubt whether it was laid on Yom Tov and became mixed with others, they are forbidden. But if it became mixed with another kind, it is nullified in sixty.

What is a דבר שיש לו מתירין and why is it not nullified?

According to the Shulchan Aruch (YD 102:1), a davar sheyesh lo matirin is something that, without resorting to nullification, will become permitted anyway later — for example an egg laid on Yom Tov (ביצה שנולדה ביום טוב), permitted the very next day. If it becomes mixed with others, whether whole or beaten, it is not nullified, even in a thousand (אינה בטלה אפילו באלף), and even in doubt. The reason (Taz sk1): by Torah law חד בתרי בטל, but the Sages were stricter — as long as you will be able to eat it permitted later, do not eat it now forbidden through nullification. For practical halacha, consult your Rav.

Is a דשיל"מ not nullified in any quantity?

It remains forbidden only within its own kind (מין במינו) — there it is not nullified even in a thousand. But if it becomes mixed with another kind (שאינה מינה), it is nullified in sixty (בטלה בששים). Reason (Shach sk4): the "importance" does not come from the prohibition itself but from the heter to come; with another kind the heter does not "bear the name" of the prohibition. The Rama adds (se'if 1) that what is placed to improve the pot (לתקן הקדרה), such as stuffing a fowl with the egg, is considered מין במינו and so is not nullified. For practical halacha, consult your Rav.

Are a ספק טריפה egg or a forbidden utensil a דשיל"מ?

No. Se'if 2 sets two conditions for the matir: either it will certainly come (עתיד לבוא על כל פנים), or it is in his power to bring about without loss (בידו בלא הפסד). An egg of a doubtful-טריפה (ספק טריפה) has no certain matir and is therefore not a דשיל"מ: it is nullified. Likewise (se'if 3) a utensil forbidden by absorption that becomes mixed in is nullified in the majority (בטל ברוב), because kashering (הגעלה) costs an expense. For practical halacha, consult your Rav.
