1. Introduction to the sugya — three foods in one siman

↩ Detailed explanation (level 1)

The frame of the siman — milk, cheese, butter

The siman gathers three foods that all come out of the same animal and all pass through the hand of a non-Jew; yet each carries its own decree and its own reason. Milk (seif 1) is forbidden out of a fear — שמא עירב בו חלב טמא, lest he mixed into it the milk of a non-kosher animal — and it is permitted by sight, or by what stands in the place of sight, the מרתת. Cheese (seif 2) was forbidden by an ancient decree taken במנין, and it does not have the ordinary nullification. Butter (seif 3) is the lightest of the three: it depends on the custom of the place and on boiling. The root of all three is in tractate Avodah Zarah, and the whole modern discussion of חלב ישראל and חלב סתם is born out of the chakira into the basis of the milk prohibition.
Three degrees of stringency: notice the ladder — cheese is heavier than milk (a decree taken במנין, no nullification in sixty, forbidden even when set with herbs), and butter is lighter than milk (it does not forbid the vessels, nor its admixture). So although all three come from the same milk, their din is not the same — and the difference does not lie in the substance but in the geder of the decree the Sages placed on each one.

2. The underlying chakira — why was the milk forbidden?

↩ Detailed explanation (level 1)

This is the decisive chakira: the entire contemporary discussion of חלב סתם hangs upon it.

The chakira — the reason for the milk prohibition: the Mechaber writes that it is forbidden Is this (a) a plain doubt — an actual fear that the milk of a non-kosher animal (a camel, a she-camel) was mixed in? Or (b) a fixed decree taken by the Sages במנין, like everything counted by vote, which no longer depends at all on whether the fear still exists?
Two ways of understanding the basis of the prohibition:
ShitaGeder of the prohibitionSource
The Radbaz and the Pri Chadash a doubt of admixture and nothing more — where there is no non-kosher milk to fear, the fear lapses and there is no reason to forbid reported (in order to be rejected) in פתחי תשובה ס״ק ג; and see the end of the Rama’s gloss, “nowadays … it is permitted”
The Chasam Sofer the milk was forbidden במנין like יין נסך — the prohibition stands even without the fear, so long as no Jew sees חתם סופר יו״ד סימן ק״ז, brought in פתחי תשובה ס״ק ג
The yesod — “a thing forbidden במנין”:
This is a general rule: something the Sages forbade במנין — in assembly and by count of votes — can be released only by another count, before a greater beis din, even if the reason for which it was forbidden has disappeared. The mishna states it in so many words, and the gemara returns to it inside our own sugya.
The root of the matter for practice: the entire discussion of חלב ישראל and חלב סתם hangs on this chakira. If one holds like the Pri Chadash, then where public supervision makes an admixture of non-kosher milk impossible in fact, the fear is gone and there is no reason to forbid. If one holds like the Chasam Sofer, the sight of a Jew — or something that counts as that sight — is required, and failing that the prohibition remains in place. From here the poskim of our time set out: some treat state supervision as the equivalent of sight, others require חלב ישראל in fact; the discussion is gathered, among other places, in אגרות משה יו״ד ח״א סימנים מ״ז–מ״ט. The Pischei Teshuva notes, moreover, that another question in the siman — is a child who watched the milking believed? — likewise depends on this very chakira. And for practice — ask your Rav.

3. מרתת — “lest he stand up and see him”

↩ Detailed explanation (level 1)

The mechanism of the heter

The Mechaber builds three degrees of heter. (a) The Jew sits outside and there is no non-kosher animal in the herd — permitted even if he sees nothing at all during the milking, since there is nothing to fear. (b) There is a non-kosher animal in the herd and the non-Jew is milking for the Jew’s need — permitted only if he could see him were he to stand up; the non-Jew is then מרתת, afraid that he will stand and see him. (c) And all of this on condition that the non-Jew knows that non-kosher milk is forbidden to a Jew: if he does not know, he fears nothing, and there is no מרתת at all.
The yesod — מרתת is sight in potential:
Actual sight is not required; the possibility of sight is enough, because it instils fear. So long as the non-Jew knows that a Jew may rise and look, he is afraid to mix and refrains. This is the pattern that runs through the whole siman: the maidservant milking in the Jew’s house, the child standing by — all of them work by force of מרתת, not by continuous watching. The beraisa the gemara brings is the source of the Mechaber’s case.
The Taz’s distinctions in the basis of the heter:
What the Taz establishesReference
ס״ק א whether he milked לצרכו or לצורך ישראל, both are forbidden without sight; one might have thought that milking for himself he would not spoil his own milk, and even so it is forbidden ט״ז ס״ק א; and likewise ש״ך ס״ק א in the name of the Tur
ס״ק ב sitting anywhere is not enough — in the words of the beraisa he must sit outside, beside the herd, such that he could see if he stood ט״ז ס״ק ב
ס״ק ג going in and out suffices — continuous presence is not required, just as with the shechita of a Kuti ט״ז ס״ק ג; ש״ך ס״ק ד
The analogy of the Kuti’s shechita: the Taz (ס״ק ג) holds the din of milk to be the din of shechita — there too a Jew who goes in and out renders the Kuti’s shechita fit, for מרתת does not demand a continuous stand but the fear of a sudden appearance. From here a great yesod: מרתת works even when attention is intermittent, provided that surprise remains possible. Against that, the Taz (ס״ק ב) requires at the very least that he sit outside beside the herd: if he is altogether far off and unable to rise and see, מרתת is abolished.
A limit the Shach sets (ס״ק ג): in his view this whole mechanism of מרתת applies only when the non-Jew is milking for the Jew’s need. When he milks for himself, and there is a non-kosher animal in his herd, the Shach requires actual sight, at the very time of the milking.

4. The Rama’s ruling — maidservants, a child, and “nowadays”

↩ Detailed explanation (level 1)

In the Rama’s gloss to seif 1 lie the seeds of the whole discussion of חלב סתם.

The text of the Rama (gloss to seif 1)

What the gloss adds:
The dinThe reasonSource /
Maidservants milking in a Jew’s house — permitted לכתחילה with no Jew present since it is in the Jew’s house or in his neighbourhood, there is no reason to fear a non-kosher animal; but if a non-Jew’s house intervenes, a Jew must be there Rama, in the name of the שערי דורא, Rabbenu Tam and the Mahara’i
A child, boy or girl, suffices the non-Jew is מרתת even before a child Rama; ט״ז ס״ק ה, who specifies the age of nine in the name of the או״ה
“Nowadays” — permitted non-kosher milk is not found at all, and the fear has lapsed Rama, in the name of the
The Taz’s distinction (ס״ק ו): the Taz reads the Rama’s clause about a partial milking as speaking of milking the Jew’s own animals, in the enclosure behind his house; there it is permitted, because nothing non-kosher is present. But as for milk the non-Jew draws from his own animal, the Taz brings in the name of the Mahara’i that we permit nothing at all unless a Jew sees him. At bottom: where the place itself carries a presumption of permission (a Jew’s house), מרתת works on its own; a non-Jew’s house carries a presumption of concern, and there sight is required.
The seed of the חלב סתם discussion: the end of the gloss — “nowadays … it is permitted” — appears at first sight to support the Radbaz and the Pri Chadash: the prohibition rests on the fear, and once the fear is gone the prohibition is gone. The Chasam Sofer rejected this: even if the local fear has vanished, the prohibition was taken במנין and stands until a Jew sees. It must be added that the Rama’s “בדיעבד אין לחוש” was not received without reservation: the Taz concludes for halakha that one should be stringent even בדיעבד so long as the Jew did not see the beginning of the milking, and the Shach, after a long examination of the או״ה, comes to say that even בדיעבד we require that the Jew first looked into the vessel. And for practice — ask your Rav.

5. Vessels, admixture, and turning the milk into cheese

↩ Detailed explanation (level 1)

The text of the Rama (end of seif 1)

The yesod — a doubt that forbids like a certainty:
A considerable chiddush: although the prohibition of the milk is only a ספק — perhaps he mixed — it nevertheless renders the vessels forbidden like any established prohibition; once forbidden, it is treated as a full prohibition with all its stringencies. Opposite it stands butter — even in a place where the custom is to refrain — which renders neither the vessels in which it was cooked nor its admixture forbidden: if it became mixed into permitted food, the whole is permitted, as with the bread of a non-Jew, and the Rama refers for this to siman 112.
“It remains in its prohibition” — a change of form does not release: one whose milk became forbidden and who then made cheese or butter from it has gained nothing: it is all forbidden. From here we learn that a change of form does not permit what is absorbed — the prohibition adheres to the substance, not to its shape. And this does not contradict the heter of seif 2 for one who watched the cheese being made: there the heter comes from its being established that no non-kosher milk was mixed in, and not from a change of form.

6. The cheese of a non-Jew —

↩ Detailed explanation (level 1)

The text of the Mechaber and the Rama (seif 2)

Chakira — the reason for the decree on cheese: the amoraim differed in the gemara over the reason for the prohibition — Rabbi Chanina says that cheese cannot be made without a residue of milk, and Shmuel says it is because they set it with the skin of the stomach of an animal they slaughtered, which is a נבלה. And if everything turns on the rennet, why is it that “even if he set it with herbs, it is forbidden”, where there is no נבלה at all?
The Taz’s answer (ס״ק י) — לא פלוג: the Taz explains that the cheese of a non-Jew is named in the mishna explicitly as forbidden; the Sages therefore did not distinguish according to what sets it — לא פלוג רבנן — all the more so since there are still those today who set it with the skin of a נבלה. This is the opposite of גילוי (siman 116), which rested on the danger of snakes: since reality changed, it is permitted today. Cheese, by contrast, belongs to a decree that does not follow its reason, and it was never released.
Cheese against גילוי: here is the sharp point — גילוי was forbidden out of danger, and once the fear ceased it was permitted. Cheese was forbidden by a decree that covers the whole species; the reason of the rennet does not apply to herbs, and yet לא פלוג, it remains in its prohibition. The difference is not in the reason but in the גדר: a danger depends on reality, a decree does not. The Taz adds further, in the name of the Beis Yosef citing the Semak, that according to Rabbenu Tam — who holds the prohibition of cheese to be a case of גילוי — it remains forbidden even today. Hence cheese always requires certification, even when set by a microbial or vegetable coagulant.

7. Why the cheese is not nullified in sixty

↩ Detailed explanation (level 1)
The kashya — the rennet is a negligible minority: if the cheese was forbidden because of the small amount of נבלה rennet skin that sets it — but the rennet is nullified in sixty by the cheese! Why then does it forbid, instead of being nullified in the majority of permitted matter, like every absorbed prohibition?
The Taz’s answer (ס״ק ט), in the name of Rabbi Yosef Ibn Migash: the rule is that a thing forbidden because it imparts taste is nullified in sixty, since at sixty its taste is no longer perceptible. But this cheese is not forbidden by the taste of the rennet: the rennet is what sets it, and a מעמיד forbids in any quantity whatsoever. The Taz further explains that there is no Torah-level בשר בחלב here, because the rennet acts cold; the whole prohibition is therefore rabbinic, and it rests on the מעמיד. He also brings a second answer, that of the Raavad: whatever the Sages forbade in what belongs to non-Jews, nullification in the majority does not help, so that people should not break through the fence.
The yesod — מעמיד against נותן טעם:
Two entirely distinct ways in which a prohibition acts within a mixture:

• נותן טעם — the prohibition acts through its taste; once the taste is nullified in sixty, so is the prohibition.
• מעמיד — the prohibition acts through its setting power, not through taste; and since the whole cheese stands by that power, there is no nullification.

This is why cheese is unlike the mixtures treated in the laws of nullification (see siman 134): those are nullified in sixty on account of taste, while this one is not nullified, on account of what sets it.

8. The Rama’s ruling on cheese — Rabbenu Tam

↩ Detailed explanation (level 1)
The degrees the Rama’s gloss distinguishes:
The caseThe dinThe reason
He saw the milking and the making of the cheese permitted, and such is the widespread custom nothing remains to fear — the sight is complete
He saw the making but not the milking permitted בדיעבד non-kosher milk does not set, and certainly he mixed nothing in, since his intention was to make cheese
That very milk, to be eaten as it is forbidden — although the cheese was permitted the Rama says so in plain words and does not give the reason here
The Taz’s objection (ס״ק י״א): the basis of the heter “he saw the making and not the milking” is the sevara of Rabbenu Tam — non-kosher milk does not set — so that since cheese came out of it, it was pure milk. The Taz writes that he did not reach the bottom of the Rama’s thinking, and he objects: the Beis Yosef and the Shulchan Aruch ruled like the Rambam that even if it was certainly set with herbs it is forbidden, by לא פלוג — and here too it should be forbidden, since he was not present at the milking; moreover, one will come to permit eating the milk itself, for who will be able to tell the difference; moreover, in milk there is the fear of an admixture of non-kosher milk, which is a Torah prohibition; and the Rama himself wrote, close by, that one should not break through the fence. The Taz does not resolve the difficulty: he concludes that in his humble opinion one should not be lenient here either, and that one permits only if a Jew was present at the milking, following the view of the Rambam.
The Noda BiYehuda’s ruling (פ״ת ס״ק ו): the Pischei Teshuva reports that the Noda BiYehuda decided like the words of the Rama — and not like the Shach, the Taz and the Pri Chadash — ; that the Minchas Yaakov and the Pri To’ar taught the same; and that he wrote that such is the widespread custom. He further reports: if the rennet belongs to a Jew, even when it is the non-Jew who places it into the milk, it is permitted in the opinion of all, and even לכתחילה. All of this in a place where the permission was held from of old; where the custom is to refrain, the Rama wrote at seif 2 that one should not break through the fence.

9. Butter — the reason for the leniency and the stringencies of the place

The yesod — why butter is lighter:
The Taz (ס״ק י״ב) unfolds his explanation in several steps, and the last is the most decisive. (a) As for non-kosher milk, it is obvious that there is nothing to fear, since it does not set. (b) And even supposing non-kosher milk was mixed in at the start, since the butter is boiled the residues of milk go off, and what did not go off and remained is nullified in its minority. (c) And if one objects that with cheese we forbid even where everything was done permissibly — butter is different: it was never included in the decree of the mishna at all, and so there is no room here to say
Boiling and rinsing: where no custom is established, the Mechaber permits butter that has been boiled until the residues of milk have gone, and the Rama adds that it may be boiled לכתחילה for that purpose. The Pri Chadash, for his part, took issue with the Mechaber and holds that it is permitted even where a custom to refrain does exist. The Pischei Teshuva reports that the Noda BiYehuda rejected his words; he further reports, in the same place, that a certain rav permitted a non-Jew’s butter in a place where the custom is to refrain, by means of rinsing three times — and that the Noda BiYehuda found the reasoning sound, yet refused to rely on it, having found this sevara nowhere. Boiling done by the non-Jew himself is no obstacle, since their vessels are presumed not to have been used that day.

The stringencies of the place, for one who travels
The caseThe din
He goes from a place where they do not eat it to a place where they do he eats it there with them — and the Taz explains that the stringencies of the place he left do not apply here, since there they make it in full kashrus
He goes from a place of permission to a place where they refrain he may not eat it there
Bringing butter into a place where they refrain forbidden — unless it bears a היכר showing that it comes from a place where it is permitted; and there are those who say that even with a היכר it is forbidden, and such is the practice
A nafka mina between butter and cheese (פ״ת ס״ק ז): the Pischei Teshuva brings the Chasam Sofer (יו״ד סימן ע״ט), who was asked about butter made from the cheese residues left in the vat — what is called צווארי״ך. His answer distinguishes: if the cheeses were set with rennet skin, this butter too is forbidden; if they were not, then although the cheeses are forbidden as a thing forbidden במנין, butter itself was not forbidden במנין, and where the custom is to permit butter, this too is permitted. The Pischei Teshuva (ס״ק ט) deals in the same chapter with one who carries butter from place to place, and brings the objections of the Beis Efraim. The root of it all: butter belongs to the din of custom — חומרי המקום — and not to a full prohibition, and that is why it changes from place to place.

10. Chakira and nafka mina for practice

↩ Detailed explanation (level 1)
The chakira that embraces the whole siman: what is the geder of each of the three prohibitions, and what depends on it?
Nafka mina for practice (as it emerges from the sources cited above):
  1. Milk drawn by a non-Jew unseen is forbidden; the heter runs through sitting outside beside the herd, through מרתת, or through a maidservant or a child in the Jew’s house (Rama, seif 1).
  2. The question of חלב סתם hangs on the underlying chakira: treating public supervision as the equivalent of sight, or requiring חלב ישראל in fact.
  3. A non-Jew’s cheese is forbidden even when set with herbs (לא פלוג), and it is not nullified in sixty (the din of מעמיד); cheese therefore always requires certification.
  4. As for butter, we do not protest against those who hold it permitted; where no custom is established, boiling suffices; and the stringencies of the place bear on the traveller and on what he brings with him, with the question of the היכר.
And for practice — ask your Rav.

↩ Detailed explanation (level 1)

Table — the three foods and their din

The food The reason for the prohibition The heter / the stringency Where to read it
Milk (seif 1) lest he mixed in non-kosher milk sight / מרתת / maidservant / “nowadays”; forbids the vessels Mechaber and Rama seif 1; ט״ז ס״ק א–ו; ש״ך ס״ק א–ח
Cheese (seif 2) the skin of the stomach of a נבלה — and a decree taken במנין forbidden even with herbs (לא פלוג); not nullified in sixty Mechaber seif 2; ט״ז ס״ק ט–י
Butter (seif 3) residues of milk — and a custom, nothing more we do not protest; boiling / nullification in the minority; stringencies of the place Mechaber and Rama seif 3;
Milk that became forbidden and was made into cheese or butter it remains in its prohibition — a change of form does not release all of it is forbidden Rama, end of seif 1
He saw the cheese being made but not the milking non-kosher milk does not set (Rabbenu Tam) the cheese is permitted בדיעבד; the milk, to be eaten as it is, stays forbidden Rama seif 2; ט״ז ס״ק י״א; פ״ת ס״ק ו

Table — the central machlokos of the siman

Subject Shita א Shita ב
The basis of the milk prohibition Radbaz and Pri Chadash — a doubt of admixture; once the fear is gone, the prohibition is gone Chasam Sofer — the milk was forbidden במנין like יין נסך (פ״ת ס״ק ג)
Did he milk for himself or for the Jew? ש״ך ס״ק ג — for his own need, actual sight is required ט״ז ס״ק א — in both cases it is forbidden without sight
The Rama’s “בדיעבד אין לחוש” Rama — בדיעבד there is no reason to be concerned for all this ט״ז ס״ק ד and ש״ך ס״ק ח — more is required, even בדיעבד
Cheese even when set with herbs the reason is the rennet of a נבלה ט״ז ס״ק י — לא פלוג, a decree covering the species (against גילוי, siman 116)
Why cheese is not nullified in sixty what imparts taste is nullified in sixty Ri Ibn Migash, brought by the ט״ז ס״ק ט — the din of מעמיד, which forbids in any quantity; and the Raavad gives another reason
He saw the cheese being made but not the milking Rama — permitted בדיעבד; so ruled the Noda BiYehuda (פ״ת ס״ק ו) ט״ז ס״ק י״א — he did not reach the bottom of the Rama’s thinking and concludes stringently; likewise the Shach and the Pri Chadash
Butter where the custom is to refrain Pri Chadash — permitted even where a custom exists (פ״ת ס״ק ח) Noda BiYehuda — he rejects his words, and does not rely on rinsing three times either
