1. The axiom: the חזקת כשרות and the one who loses it
The starting point:
Siman 119 does not ask what is forbidden, but whom one may rely upon. The baseline presumption is that every Jew stands בחזקת כשרות — the Shach puts it plainly, summary: apart from the ḥashud, every person is presumed kosher enough to eat with him (ש״ך יו״ד קי״ט ס״ק א). The siman deals with the person for whom that presumption has fallen — the ḥashud (חשוד) — and measures exactly how far the fall reaches: what the suspicion covers, what remains permitted, and what it costs. The Mehaber opens (seif 1): «החשוד לאכול דברים האסורים» — whether he is suspected on a Torah prohibition or on a rabbinic one — «אין לסמוך עליו בהם».

💡 The marker: this is not a siman about mixtures, nor about seals — it is the siman of the trustworthiness of people. Three words sum it up: חזקה (what we presume), חשד (what makes the presumption fall), חילוף (what we concretely fear). Everything else follows from them.
2. The 3 reflex questions
■ IS HE ḤASHUD, OR MERELY UNKNOWN? — an ordinary Jew keeps his חזקת כשרות; only one known to be ḥashud loses it (ש״ך יו״ד קי״ט ס״ק א). The Rama (seif 1) nonetheless brings a וי״א: even from one who is simply not known as מוחזק בכשרות, «אסור לקנות ממנו יין או שאר דברי׳ שיש לחוש לאיסור»; and the Taz (ס״ק ב) upholds that stringency, «ולא אכשר דרי».
↓ and if he is ḥashud —
■ ABOUT WHAT, AND FOR WHOM? — regarding his own food we do not rely on him in the matters he is suspected of (seif 1), and not even under oath (seif 8). But regarding another's food he remains נאמן, even about that very prohibition, to say that it is permitted (seif 7). And if he is suspected only of selling, not of eating: «מתארח אצלו ואוכל עמו» (seif 2).
↓ and in practice —
■ DO WE FEAR A SWAP (חילוף)? — not by default: one may hand him one's own food to cook, «כיון שאינו חשוד על הגזל» (seif 3). We fear it in three cases: one who has a stake in my welfare (the mother-in-law, the innkeeper — seif 3), one who is חשוד על הגזל (seif 19), and one who is suspected on things the public is not accustomed to be lenient about (seif 20).
⚖ The basic grid (seifim 1-2)
Suspected of eating forbidden things — Torah or rabbinic, the distinction changes nothing here — we do not rely on him for those things, and as a guest in his home one does not eat of his own food in the matters he is suspected of (seif 1). Suspected only of selling — one may lodge with him and eat with him, and what he sends to his own home is permitted: «דחזקה שממה שהוא אוכל משגר לו» (seif 2). The Shach gives the reasoning in the name of Rashi and the Ran: he is careless about לפני עור, but he himself does not eat forbidden food (ש״ך יו״ד קי״ט ס״ק ה). Rama: «עובר עבירה לתיאבון לא מקרי חשוד» — and the Shach specifies that he is ḥashud only if he transgresses שלא לתיאבון, that is, if the forbidden and the permitted were set before him and he would choose the forbidden (ש״ך יו״ד קי״ט ס״ק ו).
3. Master grid: the perimeter of the suspicion (seifim 1-8)
The first grid to memorize. Its basis: Mehaber and Rama seifim 1 to 8, read with the Shach (ס״ק א-כ״ב) and the Taz (ס״ק א-י׳).

📌 The key reading: the suspicion is targeted, not contagious. It spreads downward (to the lighter prohibition, seif 5) and to the means (whatever serves that prohibition, seif 4), never sideways to unrelated prohibitions (seif 4). And it never touches his word about another person's food (seif 7) — only about his own, where he has something to gain.
4. Special statuses: convert, מסור, מומר, אנוסים (seifim 9-12)

💡 The common thread: these four seifim separate what a person is from what he displays. The coerced Jew remains ישראל גמור (seif 9); the מומר of circumstance is still a Jew as regards wine (seif 11) but not as regards נאמנות; and the אנוסים are judged by their private practice (seif 12).
5. The seller of forbidden food: money, removal, repentance (seifim 13-18)
Here the siman moves from the ground of נאמנות to that of ממון and of communal sanction. Three distinct questions: what is returned? who is removed? how does one come back?

⚠ Do not conflate the two planes: the seller returns the money (seif 13); the removed butcher, however, does not pay the owners for the animal (seif 16). One is restitution plus a קנס, the other a question of proof: money is not extracted from a holder on the strength of a mere doubt.
6. The 6 golden rules
- The חזקה first, the חשד second. Every Jew is presumed kosher; only one known to be ḥashud loses that presumption (ש״ך יו״ד קי״ט ס״ק א). The Rama adds a stringency about buying from an unknown person, and the Taz upholds it (Rama seif 1; ט״ז יו״ד קי״ט ס״ק ב).
- Eating is not selling. Suspected of eating → we do not rely on him (seif 1); suspected only of selling → «מתארח אצלו ואוכל עמו» (seif 2). And one who transgresses לתיאבון is not called ḥashud (Rama seif 2).
- The suspicion is targeted. «החשוד לדבר אחד אינו חשוד לדברים אחרים»; it extends only to what serves that prohibition (seif 4) and to the prohibition lighter in punishment — unless the public takes the latter more seriously (seif 5).
- His own is not another's. On his own he is not believed, not even בשבועה (seif 8); on another's he is believed, even about that very prohibition (seif 7). The Shach notes that in matters of ממון the rule reverses: there, one suspected on one thing is disqualified as a witness even on another (ש״ך יו״ד קי״ט ס״ק י״ח, referring to חושן משפט סימן ל״ד).
- A swap is feared only where there is a motive. The ḥashud is not suspected of theft, so one entrusts him with one's food (seif 3) — unless he has a stake in my good (seif 3), or he is חשוד על הגזל (seif 19), or he is suspected on what the public is not lenient about (seif 20).
- The seller's repentance is paid in money. Going where he is unknown, returning a valuable lost object or declaring his own animal טריפה: the proof of repentance is that «אינו חס על ממונו» (seif 15).
7. Mnemonic — the memory aid חשוד
The four letters of the word חשוד
- ח — חזקה: every Jew is בחזקת כשרות; only the established ḥashud loses it (ש״ך יו״ד קי״ט ס״ק א).
- ש — שאר דברים: «החשוד לדבר אחד אינו חשוד לדברים אחרים» — except what serves that prohibition (seif 4) and the lighter one (seif 5).
- ו — ובשל אחרים: on another's food he remains נאמן, even about that prohibition (seif 7); on his own, not — not even under oath (seif 8).
- ד — דמים: the seller of forbidden food returns the money (seif 13), and his repentance is measured by what it costs him (seif 15).
The ladder of the חילוף — when is a swap really feared?
- אינו חשוד על הגזל → one entrusts him with one's own food to cook (seif 3)
- יש לו טובה בדבר — mother-in-law, innkeeper → forbidden: she swaps bad for good (seif 3)
- מאיש פלוני מומחה קניתי → believed, since he fears they will ask that מומחה (ש״ך יו״ד קי״ט ס״ק ל״ה)
- חשוד על הגזל → «כ״ש שהוא חשוד על החליפין» (seif 19)
- שאין הרבים רגילים להקל → חשוד להחליף, and וי״א: a deposit only «בשני חותמות» (seif 20)
8. The 5 classic pitfalls
❌ Pitfall 1 — Treating every stranger as a ḥashud: the baseline remains the חזקת כשרות (ש״ך יו״ד קי״ט ס״ק א). What the Rama adds (seif 1) is not that the stranger is suspected, but that one does not buy from him wine or goods that raise concern — and he himself concludes: «מיהו אם נתארח אצלו אוכל עמו». The Taz (ס״ק ב) upholds the stringency in view of the state of the generations; the Shach maintains the חזקה.
❌ Pitfall 2 — Confusing “suspected of eating” with “suspected of selling”: these are two distinct statuses. One who sells without minding לפני עור yet eats no forbidden food himself → we eat at his table (seif 2; ט״ז יו״ד קי״ט ס״ק ג). Likewise one who transgresses לתיאבון: he is ḥashud only if he would choose the forbidden while the permitted lies before him (ש״ך יו״ד קי״ט ס״ק ו).
❌ Pitfall 3 — Extending the suspicion to everything: «החשוד לדבר אחד אינו חשוד לדברים אחרים» (seif 4). The extension runs in two directions only: toward the means (the butcher's nuts — «קנסיה רבא לזבוני אפילו אמגוזי», ט״ז יו״ד קי״ט ס״ק ז, from בכורות פרק עד כמה דף ל׳) and toward the lighter prohibition (seif 5) — which the Beit Yossef, as cited by the Taz (ס״ק ח), further limits to one and the same מין.
❌ Pitfall 4 — Forgetting “his own” versus “another's”: on another's food he is נאמן even about the prohibition he is suspected of, to say that it is permitted (seif 7); on his own he is not, even בשבועה (seif 8), «שכבר חשוד הוא לעבור על השבועה שמושבע ועומד הוא מהר סיני» (ש״ך יו״ד קי״ט ס״ק כ״א). And note: this leniency holds for איסור only — for ממון the Shach recalls the opposite rule (ש״ך יו״ד קי״ט ס״ק י״ח).
❌ Pitfall 5 — Thinking that removal entails payment: the butcher whose acts betray his intent is removed, and yet «ומכל מקום פטור מלשלם דמי הבהמה לבעלים» (seif 16): the animal is only a ספק טריפה. Conversely, the seller of forbidden food returns the money (seif 13). Sanction and restitution follow two different logics.

⚖ The reflex in 3 questions
- חזקה or חשד? As long as he is not known to be ḥashud, his חזקת כשרות stands; the Rama's stringency bears on buying, not on the presumption.
- His own or another's? On his own, nothing — not even under oath; on another's, he remains נאמן even about that very prohibition.
- Is there a motive to swap? Personal stake, suspicion of theft, or suspicion on what the public is not lenient about → a swap is feared; otherwise not.
