A first approach to Siman 157: the three seifim of the Mehaber and the long glosses of the Rama, Hebrew text and a fluent English translation. The preceding simanim governed ordinary contact with the non-Jew — the physician, the midwife, the barber. This one changes the order of magnitude entirely: it asks what a Jew does when he is left to choose between transgressing and dying. Three seifim only, and one of the densest commentaries in all of Yoreh De‘ah: nineteen ס״ק of the Shakh, eighteen of the Pit’hei Teshuva, eleven of the Taz, fifteen of the Ba’er Hetev.

1. The text of the Mehaber — the three seifim

The siman counts only three seifim, but the first is a treatise in itself. It lays down a rule — one transgresses and is not killed — excepts three transgressions from it, and then varies the rule along four parameters: the setting (private or public), the persecutor’s intent (to make him abandon the religion, or his own benefit), the hour (ordinary or a decree), and the kind of commandment (negative or positive). The Rama’s glosses add money, act and passivity, the handing over of a man singled out, and the standing of one who has transgressed.

The reading below takes seif 1 in five blocks, in the exact order of the Shulchan Arukh; their concatenation is the whole seif, word for word. The two following seifim are given whole.

Seif 1 (a) — The rule, the three exceptions, and the right to be stringent

על איזה עבירות יהרג ואל יעבור. ובו ג׳ סעיפים:

Title of the siman: for which transgressions one is killed and does not transgress; and it contains three seifim.

All the transgressions of the Torah — apart from star-worship, the uncovering of nakedness and the shedding of blood — if a man is told to transgress them or be killed: if it is in private, let him transgress and not be killed. And if he wishes to be stringent upon himself and be killed — he is permitted, if the idolater intends to make him abandon the religion.

Gloss of the Rama: and if he can save himself with all that he has, he must give everything and not transgress a negative commandment (Ran, chapter Lulav HaGazul, and Rashba, and Raavad, and Rivash siman 387). And where they said that whoever has it in his power to protest and does not protest is caught in that sin — nevertheless, in a matter where there is fear of danger, he need not spend his money on it (Mahari Weil siman 156).
The rule is leniency, and it comes from a verse. The starting point is not firmness but life: « וָחַי בָּהֶם וְלֹא שֶׁיָּמוּת בָּהֶם » (רמב״ם הלכות יסודי התורה פרק ה׳ הלכה א) — “and he shall live by them, and not that he die by them.” Only three transgressions leave that rule. Then comes the most debated word of the seif: « ואם ירצה להחמיר על עצמו וליהרג רשאי » (שו״ע יו״ד קנ״ז:א). The Mehaber writes that he is permitted; the Rambam, in the very place the Mehaber has just cited, writes the opposite — see section 5.
The Rama’s two money clauses do not say the same thing. The first concerns my transgression: to avoid transgressing a negative commandment I must give all that I have. The second concerns another’s transgression: the duty to protest does not extend to spending my money where there is risk. The Shakh at once bounds the first:
« אבל מצות עשה אפילו מצוה עוברת א״צ לבזבז יותר מחומש » (ש״ך יו״ד קנ״ז ס״ק ג)
— for a positive commandment, even one about to lapse, one does not spend more than a fifth.

Seif 1 (b) — The public, the persecutor’s intent, and the hour of the decree

ואם הוא בפרהסיא דהיינו בפני עשרה מישראל חייב ליהרג ולא יעבור אם העובד כוכבים מכוין להעבירו על דת (אפילו על ערקתא דמסאנא) (ב״י) אבל אם אינו מכוין אלא להנאתו יעבור ואל יהרג ואם הוא שעת הגזיר׳) (על ישראל לבדם) (ב״י בשם נ״י) אפילו אערקתא דמסאנא (פירוש רצועת המנעל) יהרג ואל יעבור:
And if it is in public — that is, before ten of Israel — he is bound to be killed and not to transgress, if the idolater intends to make him abandon the religion (even over a shoe-strap) (Beit Yosef). But if he intends only his own benefit, let him transgress and not be killed. And if it is the hour of the decree (against Israel alone) (Beit Yosef in the name of the Nimukei Yosef) — even over a shoe-strap (explanation: the thong of the shoe) — he is killed and does not transgress.
Three dials, not one. The seif does not make severity depend on the gravity of the sin but on what the act means. In public the same gesture becomes a desecration of the Name; hence the Gemara’s measure:
« אֵין פַּרְהֶסְיָא פְּחוּתָה מֵעֲשָׂרָה בְּנֵי אָדָם » (סנהדרין ע״ד ע״ב)
And the Shakh strips “before” of its material sense:
« דוקא ואין ר״ל בפניהם ממש אלא שיודעין מהעבירה » (ש״ך יו״ד קנ״ז ס״ק ד)
It is enough that the ten know.
The words ערקתא דמסאנא — the strap of the shoe — are the Gemara’s extreme example:
« אֲפִילּוּ לְשַׁנּוֹיֵי עַרְקְתָא דִּמְסָאנָא » (סנהדרין ע״ד ע״ב)
It is not a commandment but a custom. Three readings contend, and the Shakh brings them one after another at ס״ק ה: Rashi sees a custom bearing a Jewish mark and modesty; the Rif, the colour of the straps, black for Jews and red for the others; and the Beit Yosef ascribes to the Rambam a reading that makes it an actual negative commandment — not to wear the garb of the non-Jew.

Seif 1 (c) — Gloss of the Rama: the negative and the positive commandment

הגה ודוקא אם רוצים להעבירו במצות לא תעשה אבל אם גזרו גזרה שלא לקיים מצות עשה אין צריך לקיימו ושיהרג (ר״ן פרק במה טומנין ונ״י פרק סורר ומורה) מיהו אם השעה צריכה לכך ורוצה ליהרג ולקיימו הרשות בידו (מהרי״ק שורש פ״ח בשם הר״ן)
Gloss of the Rama: and this precisely if they wish to make him transgress a negative commandment; but if they decreed a decree not to fulfil a positive commandment, he need not fulfil it and be killed (Ran, chapter Bameh Tomnin, and Nimukei Yosef, chapter Sorer uMoreh). However, if the hour requires it and he wishes to be killed and fulfil it — the permission is in his hand (Maharik shoresh 88 in the name of the Ran).
Why is the positive commandment treated differently? The Taz gives the reason in one line:
« דהא גם העובדי כוכבים יכולים לבטלו ממנו כגון שישימוהו בתפיסה וממילא יבטל מההיא מצות עשה » (ט״ז יו״ד קנ״ז ס״ק ד)
They can prevent him from fulfilling the mitzvah without his doing anything — it is enough to lock him up. There is thus no act on his part, and nothing that claims his life.

Seif 1 (d) — The three transgressions, without any of the preceding distinctions

ובעבודת כוכבים ג״ע ש״ד אפילו בצינעה ושלא בשעת הגזרה ואפי׳ אין העובד כוכבים מכוין אלא להנאתו יהרג ועל יעבור:
And for star-worship, the uncovering of nakedness and the shedding of blood — even in private, and not at the hour of the decree, and even if the idolater intends only his own benefit — he is killed and does not transgress.
Here the siman divides in two. All the distinctions of the previous block — private, public, intent, hour — fall away at once. The Beit Yosef gives the reason in the name of the Nimukei Yosef, and it is the yesod of the whole siman:
« דטעמא משום דהני לאו משום חלול השם הוא דאסירי אלא מפני חומר עצמן הלכך בכל ענין אסירי » (בית יוסף יו״ד קנ״ז)
The other transgressions are weighed by the desecration of the Name, which depends on who sees, on intent and on the hour; these three are forbidden for their own gravity, and nothing lightens them.

Seif 1 (e) — Gloss of the Rama: act and passivity, the periphery of the prohibition, the handing over of a man, and one who has transgressed

Gloss of the Rama: and this precisely when he is told to perform an act — for instance, that a man be told to uncover a nakedness or be killed; but if they force a woman that she be come upon, or they wish to throw him upon the infant to kill it, or he is already aroused and they wish to force him to the ervah — he need not be killed (Beit Yosef in the name of the Tosafot and the Ran, chapter Kol Sha’ah). And every prohibition of star-worship, of the uncovering of nakedness and of the shedding of blood — although it carries no death penalty but a bare negative commandment — one must be killed and not transgress; but for the negative commandment of “before the blind you shall not place a stumbling block,” let him transgress and not be killed (Ran, chapter Kol Sha’ah and chapter Ben Sorer uMoreh). And an idolater who comes upon a daughter of Israel is not included in the uncovering of nakedness (Beit Yosef in the name of the Ramban and the aforementioned decisors).

Idolaters who said to Jews: give us one of you and we shall kill him — they shall not give them one of them (mishnah, chapter 8 of Terumot, and the Rambam, chapter 5 of the Laws of the Foundations of the Torah), unless they singled him out and said: give us so-and-so (Beit Yosef in the name of Rashi and the Ran). And some say that even in such a case he is not to be handed over, unless he is liable to death like Sheva ben Bichri (Rambam, the chapter mentioned). And likewise women to whom idolaters said: give us one of you and we shall defile her — let them all be defiled, and let them not hand over one soul of Israel.

Everywhere it is said “let him be killed and not transgress”: if he transgressed and was not killed — although he desecrated the Name, he is nevertheless called compelled, and he is exempt. And this precisely where he could not flee; but if he can flee and does not, he is like a dog returning to its vomit, and he is called a deliberate transgressor (Beit Yosef in the name of the Rambam, chapter 5 of the Foundations of the Torah).
Doing and being done to are not the same. The gloss opens with the distinction that governs all the rest: « ודוקא כשאומרים לו לעשות מעשה » (רמ״א יו״ד קנ״ז:א). Where the Jew is the object of the act and not its author, the rule of the three transgressions does not apply — this is what the Gemara calls קרקע עולם regarding Esther:
« אֶסְתֵּר קַרְקַע עוֹלָם הָיְתָה » (סנהדרין ע״ד ע״ב)
The same gloss applies the distinction to the man thrown upon the infant: he does not kill, he is used.
אביזרייהו — the periphery of the prohibition. The gloss extends the three transgressions to what borders them, even without a death penalty: « אע״פ שאין בו מיתה רק לאו בעלמא צריך ליהרג ולא לעבור » (רמ״א יו״ד קנ״ז:א). It at once excepts one case: « אבל אלאו דלפני עור לא תתן מכשול יעבור ואל יהרג » (רמ״א יו״ד קנ״ז:א). The Shakh gives the concrete instance:
« כגון שאנסו להשאיל דבר לעובד כוכבים וכיוצא בו » (ש״ך יו״ד קנ״ז ס״ק י״א)
The Jew does not serve the idol; he lends an object to one who will.
The mishnah the Rama cites is that of Terumot, chapter 8; the Rambam restates it in פרק ה׳ of the Foundations of the Torah, in the very terms of the gloss:
« נָשִׁים שֶׁאָמְרוּ לָהֶם עוֹבְדֵי כּוֹכָבִים תְּנוּ לָנוּ אַחַת מִכֶּן וּנְטַמֵּא אוֹתָהּ וְאִם לָאו נְטַמֵּא אֶת כֻּלְּכֶן יִטָּמְאוּ כֻּלָּן וְאַל יִמְסְרוּ לָהֶם נֶפֶשׁ אַחַת מִיִּשְׂרָאֵל » (רמב״ם הלכות יסודי התורה פרק ה׳ הלכה ה)
From it the Rama takes the rule of the women; the Yerushalmi extends it to men, and there the disagreement over the man singled out is born — see section 5.

Seif 2 — What one does not say, what one may wear, and what one may let them believe

אסור לאדם לומר שהוא עובד כוכבי׳ כדי שלא יהרגוהו אבל אם כדי שלא יכירוהו שהוא יהודי משנה מלבושו בשעת הגזר׳ מותר כיון שאינו אומר שהוא עובד כוכבי׳: הגה ואפי׳ לובש כלאים (נ״י פרק הגוזל בתרא) ואע״ג דאסור לומר שהוא עובד כוכבים מכ״מ יוכל לומר להם לשון דמשתמע לתרי אפין (נמוקי יוסף פ׳ הגוזל) והעובדי כוכבים יבינו שהוא אומר שהוא עובד כוכבי׳ והוא יכוין לדבר אחר וכן אם יוכל להטעותם שהם סוברים שהוא עובד כוכבים שרי (ת״ה סי׳ קצ״ז) וכן בדרך זה מי שלבו העלה טינא וחושק באשת איש אם תוכל אשתו לבא אליו ושיסבור שבא על הערוה שרי (שם בנ״י) וכל זה לא שרי רק במקום סכנה אבל שלא במקום סכנה כגון שילבש בגדי עובד כוכבים שלא יכירוהו שהוא יהודי ויעבור מכס או כדומה לזה אסור. It is forbidden for a man to say that he is an idolater so that they not kill him; but if it is so that they not recognise him as a Jew, he changes his garment at the hour of the decree — that is permitted, since he does not say that he is an idolater.

Gloss of the Rama: and even if he wears kilayim (Nimukei Yosef, chapter HaGozel Batra). And although it is forbidden to say that he is an idolater, he may nevertheless say to them a phrase that bears two meanings (Nimukei Yosef, chapter HaGozel) — and the idolaters will understand that he says he is an idolater, while he intends something else. And likewise, if he can mislead them so that they think he is an idolater — it is permitted (Terumat HaDeshen siman 197). And likewise, in this way, one whose heart has raised a sickness and who desires a married woman — if his wife can come to him and he will think he has come upon the ervah — it is permitted (there, in the Nimukei Yosef). And all this is permitted only in a place of danger; but not in a place of danger — such as wearing the garments of an idolater so that they not recognise him as a Jew and so evade the toll, or the like — it is forbidden (Ashiri, Nimukei Yosef chapter HaGozel Batra, Terumat HaDeshen siman 196, and the other decisors).
The exact line of seif 2 runs between speech and silence. What is forbidden is to say: « אסור לאדם לומר שהוא עובד כוכבי׳ כדי שלא יהרגוהו » (שו״ע יו״ד קנ״ז:ב). What is permitted is not to be recognised, and the reason is given in the seif itself: « כיון שאינו אומר שהוא עובד כוכבי » (שו״ע יו״ד קנ״ז:ב). The Rama’s gloss pushes the line to its edge: an ambiguous phrase, a mistake one lets stand. And it closes at once: « וכל זה לא שרי רק במקום סכנה » (רמ״א יו״ד קנ״ז:ב).

Seif 3 — Fleeing into a house of worship to save one’s life

מי שנתחייב מיתה מותר לברוח לבית עבודת כוכבים ולהציל את עצמו (וי״א דבשעת הגזרה אסור (כל בו) ועיין לעיל סימן ק״נ):
One who has become liable to death is permitted to flee into a house of idolatrous worship and save himself. (And some say that at the hour of the decree it is forbidden (Kol Bo); and see above, siman ק״נ · 150.)
Why this is not an act of worship. The Taz cites the Rosh and gives two reasons: it is not like healing oneself with the wood of an asherah, for there the cure depends on the tree, whereas here the rescue depends on no virtue ascribed to the place; and because a building not itself worshipped does not bear the name of the cult:
« ועוד דבית שאינו נעבד עצמו לא מקרי עבודת כוכבי » (ט״ז יו״ד קנ״ז ס״ק י״א)
He adds the limit: it is permitted only because he does nothing there —
« משא״כ כאן שיהיה שם שב ואל תעשה אין זה אלא הרחקת הנזק ומותר בפקוח נפש » (ט״ז יו״ד קנ״ז ס״ק י״א)

2. Context — the sugya of Sanhedrin, the mishnah of Terumot, and the Rambam

The ruling in the upper chamber of Lod

The whole siman issues from a single passage, at the end of the chapter Ben Sorer uMoreh. There Rabbi Yohanan reports in the name of Rabbi Shimon ben Yehotzadak a vote taken at Lod:

« נִימְנוּ וְגָמְרוּ בַּעֲלִיַּת בֵּית נַתְּזָה בְּלוֹד, כׇּל עֲבֵירוֹת שֶׁבַּתּוֹרָה אִם אוֹמְרִין לָאָדָם ״עֲבוֹר וְאַל תֵּהָרֵג״ – יַעֲבוֹר וְאַל יֵהָרֵג, חוּץ מֵעֲבוֹדָה זָרָה וְגִילּוּי עֲרָיוֹת וּשְׁפִיכוּת דָּמִים » (סנהדרין ע״ד ע״א)

The source of the rule is the verse — וָחַי בָּהֶם — and the source of the public exception is another verse:

« תַּלְמוּד לוֹמַר ״וָחַי בָּהֶם״ – וְלֹא שֶׁיָּמוּת בָּהֶם » (סנהדרין ע״ד ע״א)
« יָכוֹל אֲפִילּוּ בְּפַרְהֶסְיָא? תַּלְמוּד לוֹמַר: ״וְלֹא תְחַלְּלוּ אֶת שֵׁם קׇדְשִׁי וְנִקְדַּשְׁתִּי » (סנהדרין ע״ד ע״א)

Then come the two statements that seif 1 takes up one after the other — that of רב דימי on the hour of the decree, and that of רבין on the public:

« לֹא שָׁנוּ אֶלָּא שֶׁלֹּא בִּשְׁעַת הַשְּׁמָד, אֲבָל בִּשְׁעַת הַשְּׁמָד, אֲפִילּוּ מִצְוָה קַלָּה – יֵהָרֵג וְאַל יַעֲבוֹר » (סנהדרין ע״ד ע״א)
« אֲפִילּוּ שֶׁלֹּא בִּשְׁעַת הַשְּׁמָד, לֹא אָמְרוּ אֶלָּא בְּצִינְעָא, אֲבָל בְּפַרְהֶסְיָא אֲפִילּוּ מִצְוָה קַלָּה – יֵהָרֵג וְאַל יַעֲבוֹר » (סנהדרין ע״ד ע״א)

The shedding of blood, and the reasoning that founds it

For idolatry and forbidden unions the Gemara finds verses. For murder it finds none, and says expressly that the source is a reasoning — the one Rabbah gave the man who came to ask whether he must kill on command:

« לִקְטְלוּךָ וְלָא תִּיקְטוֹל. מִי יֵימַר דִּדְמָא דִּידָךְ סוּמָּק טְפֵי? דִּילְמָא דְּמָא דְּהוּא גַּבְרָא סוּמָּק טְפֵי » (סנהדרין ע״ד ע״א)
It is not a verse, and that is what gives it its reach. A rule drawn from a verse holds for those the verse addresses. A reasoning — “who says your blood is redder?” — holds wherever there are two lives. That is why this limb of the siman is not confined to a persecutor’s order: it also governs the handing over of a man in seif 1, where no one asks anyone to kill.

The Rambam, הלכות יסודי התורה פרק ה׳

The Rambam to which this siman refers is not הלכות עבודה זרה but הלכות יסודי התורה — and the Rama names it twice in the gloss of seif 1 alone. פרק ה׳ there is the matrix of the whole siman: the rule and its verse (הלכה א׳), the three exceptions and the distinction of intent (הלכה ב׳), the hour of the decree (הלכה ג׳), the standing of one who transgressed and the image of the dog (הלכה ד׳), the handing over of a man singled out (הלכה ה׳).

« אֲבָל שָׁלֹשׁ עֲבֵרוֹת אֵלּוּ אִם יֹאמַר לוֹ עֲבֹר עַל אַחַת מֵהֶן אוֹ תֵּהָרֵג. יֵהָרֵג וְאַל יַעֲבֹר » (רמב״ם הלכות יסודי התורה פרק ה׳ הלכה ב)

Two of these four lines are the seat of the siman’s two greatest disputes. הלכה ד׳ — one whose law was to transgress and who let himself be killed מתחייב בנפשו — contradicts the Mehaber’s word רשאי. And הלכה ה׳ — the man singled out is handed over only if he is liable to death — is the view the Rama reports as יש אומרים. Both are set out in section 5, and taken up again at level 2.

3. The key concepts

Ten words suffice to read the siman. None translates without loss, and each is the name of a distinction, not of a thing.

שעת הגזרהThe hour of the decree. The Rama adds two bounds: the decree must target Israel alone, and it must bear on a negative commandment.
ערקתא דמסאנאThe strap of the shoe. The Gemara’s example for “even a light mitzvah” — and, according to Rashi, even a mere custom.
קרקע עולםThe ground of the world. One acted upon without acting; the Gemara says it of Esther, and from it the Rama draws the clause “precisely when he is told to do an act.”
אביזרייהוWhat surrounds the prohibition. The adjacent clauses of the three transgressions, even without a death penalty — with the express exception of לפני עור.
אנוסThe compelled. One who transgressed under compulsion is exempt, though he desecrated the Name — unless he could have fled.
מסירת יחידThe handing over of a man. One does not hand over; if he was singled out, two views; and in any case, writes the Rambam, one does not so instruct in advance.

5. The Taz and the Shakh — the entries that decide

Nineteen ס״ק of the Shakh and eleven of the Taz for three seifim: the ratio is among the highest in Yoreh De‘ah. Not all are read here; those that decide are, and those that show where the siman does not decide.

Shakh ס״ק א — the word רשאי, and the Rambam who says the opposite

The first ס״ק of the siman opens at once upon its greatest difficulty. The Mehaber writes that one who wishes to be killed where the law tells him to transgress is permitted; the Ba’ch rules like the Rambam, who writes that he answers with his life, and the Shakh adds the Beit Yosef and the Ramban. He then brings the Terumat HaDeshen, hesitating between two lines — ספק נפשות להקל on one side, the singularity of קידוש השם on the other — and concludes with a phrase that is not a rule but a way of instructing: according to the case, and according to what one discerns of the man’s intent.

Shakh ס״ק ב — when the persecutor seeks only his own benefit, stringency is forbidden

The permission to be stringent, which the seif grants, has a condition written into the seif itself: that the persecutor seek his apostasy. Where he seeks only his own benefit, Rabbenu Yeruham writes that letting oneself be killed is not piety — it is wounding oneself. The Shakh then brings the disagreement of the Ba’ch and the Perishah about the public case, and after it an exception that belongs not to the law but to the person: a great man, pious and God-fearing, who sees his generation loose in that very point.

Shakh ס״ק ג — the fifth, and the open question of a limb in danger

The Rama wrote that one must give everything so as not to transgress a negative commandment. The Shakh first bounds that duty to the negative — for a positive commandment, even one about to lapse, a fifth is enough — and then raises the question the siman does not settle: does the loss of a limb count as money, or as life? He leaves it in צ״ע and inclines to leniency.

Shakh ס״ק ה — the three readings of ערקתא דמסאנא

Three readings, and they do not carry equal weight. For Rashi there is no mitzvah at all: a mere custom, but one bearing a Jewish mark and modesty. For the Rif, the colour of the straps distinguished the one from the other. And on the reading the Beit Yosef ascribes to the Rambam, the example is extreme only in appearance: there is already an actual negative commandment — not to wear the garb of the non-Jew.

Shakh ס״ק ו and ס״ק ז — what is not a שעת השמד, and the refusal of the Ba’ch’s stringency

Two bounds set one after the other. The first rests on the seif’s own parenthesis — על ישראל לבדם: a decree striking the whole kingdom is not an hour of decree, even if Jews are included in it. The second is aimed at the Ba’ch, who held that at the hour of the decree the rule applies even when the persecutor seeks only his own benefit. The Shakh answers that Rashi does not hold so, that the proofs do not compel, and that since lives are at issue the doubt inclines to leniency. The Taz writes the same, independently, at ס״ק ג.

Shakh ס״ק ט — the objection to Rabbenu Yeruham, and קרקע עולם

The Rama wrote that a woman compelled need not let herself be killed. Rabbenu Yeruham, cited in the Bedek HaBayit, added a condition: unless it is in public. The Shakh asks whence this comes. The Tosafot and the Rosh, he writes, raise the question of the public only at the sugya’s first stage; once the answer of קרקע עולם is given, it holds in public too. He offers a way to save Rabbenu Yeruham — that Rava disputes Abaye — but does not adopt it, and the Rif, the Rosh and the Ran give both answers together.

Shakh ס״ק י — לא תקרבו: the Rambam, the Ramban, and the measure of חיבת ביאה

This is the longest ס״ק of the Shakh on this siman, and it explains the Rama’s clause about what borders the three transgressions. The story of the man sick with desire shows that one dies rather than do what is not the union itself. The Shakh concludes that the clause rests on the negative commandment of לא תקרבו, and that one must therefore follow the Rambam against the Ramban. He closes with two limits: the Rambam speaks only of a gesture done דרך חיבת ביאה, and an ervah forbidden only rabbinically falls outside the rule by all views.

Shakh ס״ק י״ב and ס״ק י״ד — who is included in גילוי עריות

The Rama’s gloss says that a non-Jew coming upon a daughter of Israel is not included in גילוי עריות. The Shakh closes both its sides. On the one hand the converse — a Jew coming upon a non-Jewish woman — is included. On the other, the gloss holds only of an unmarried woman: a married woman is גילוי עריות proper. And he notes that Rabbenu Tam extends the Rama’s position even to that case, though not all the decisors hold so.

Shakh ס״ק ט״ו — “one does not instruct so in advance,” and the duty to exhaust every side

Here the Shakh places the clause that prevents the Rama’s second view from becoming a procedure. Even where the Rambam does not forbid it, he writes that one does not instruct so in advance; and the Darkhei Moshe, in the name of the Hagahot Maimoniot, adds that one must first go over every side of every side. The Shakh mentions the Ba’ch’s many distinctions here, says they do not seem to him compelling, and adds that he did not object since the Ba’ch attests to having established them elsewhere by a clear proof.

Shakh ס״ק י״ז, י״ח and י״ט — the garment, the phrase, and the road

The last three ס״ק bear on seif 2, and they draw its boundary. The change of garment is permitted only where the decree targets the name of Jew; if the decree bears precisely on the garment, the garment becomes the very object of the coercion and the rule reverses. The double-meaning phrase is permitted only before danger to life, not for money — the Shakh joins the Maharshal here. And the third is a report of practice rather than a ruling: the roads are held to be dangerous, and the practice followed.

Taz ס״ק ג — the Rambam against the Ba’ch’s reading

The Taz opposes the same thesis as the Shakh, but by another road: not through doubt, through the text. The Rambam, in פרק ה׳ of the Foundations of the Torah, writes expressly that the hour of the decree presupposes a king who rises to abolish the religion — that is, an intent of apostasy. The Taz adds that his father-in-law wished to infer the contrary from the order of the Tur’s words, and answers that the Tur himself writes this distinction elsewhere for the hour of the decree as well.

Taz ס״ק ז — the Yerushalmi, Rabbi Yehoshua ben Levi, and “this is not the mishnah of the pious”

This is the longest ס״ק of the siman, and the only one that tells a story. The Yerushalmi reports that Rabbi Yehoshua ben Levi handed over a man who had taken refuge with him, and that Elijah ceased to appear to him. The Taz asks what he had done wrong, since the mishnah permitted it. His answer: the fault was not the handing over but his doing it himself. He concludes on the halakhah, and it is the Rama’s second view: one does not hand over, unless he is liable to death like Sheva ben Bichri.

Taz ס״ק ח — why “like Sheva ben Bichri,” and what he infers from it

The Taz first observes that Sheva ben Bichri was not liable to death by Torah law but by the law of the kingdom, and he draws wide consequences. Then he adds, in the other direction, an extension of stringency: where one does not hand over, there is no difference between handing over to death, to suffering, or even to a loss of money. He rests it on Rav’s saying — אילמלי נגדוה לחנניה מישאל ועזריה — which shows that suffering can be harder than death.

Taz ס״ק י״א — the flight of seif 3, and what distinguishes it

The Taz explains why the flight is not an act of worship, but he does not turn it into an unqualified permission. According to the view cited at siman 155 seif 3, which forbids even an unspecified cure on the strength of לא ידבק בידך, there would be ground to forbid here too. Seif 3 is thus read together with siman 155 — and the Rama adds on his side the view of the Kol Bo for the hour of the decree.

6. The glosses of the Rama (הגה) and the Pit’hei Teshuva

What the glosses add, and in what order

The Rama glosses only seif 1 and seif 2, but his glosses there are longer than the text they comment on. They add four things the Mehaber had not said: money, the distinction of the positive commandment, the distinction between doing and undergoing, and the handing over of a man. The fourth is the only one where the Rama brings two views without deciding between them.

It is worth noting what the Rama does not touch. He does not touch the Mehaber’s word רשאי, though the Rambam he cites twice in the same gloss writes the opposite. It is the Shakh who will have to note it at ס״ק א.

The Pit’hei Teshuva — eighteen entries, and what they show

Eighteen entries on three seifim: nearly as many as the Shakh, and the distance of centuries changes the nature of the questions. The Shakh argues with the Rishonim; the Pit’hei Teshuva brings cases — an officer demanding young men, a toll-keeper demanding a kiss, a man offered the loss of a limb to save another.

Pit’hei Teshuva ס״ק א — “one” or “all together”

The Rambam writes “one of all the commandments.” The Ma‘aseh Rokeach observes that the word is not restrictive: the rule holds even if all the mitzvot together are demanded of him. The Pit’hei Teshuva adds at once that a responsum of the Radbaz does not appear to hold so.

Pit’hei Teshuva ס״ק ב — when the persecutor demands nothing at all

The seif assumes a persecutor who sets an alternative. The Mishnat Chakhamim asks what the law is when they wish to kill him for some other reason, and he could save himself by transgressing of his own accord: is that still אונס? Or does the principle of פיקוח נפש apply in any case? The Pit’hei Teshuva brings the question and notes that it is left unresolved there.

Pit’hei Teshuva ס״ק ד — how far “all that he has” extends

This is the longest ס״ק of the Pit’hei Teshuva on this siman, and it gathers half a dozen authors around one question: does the Rama’s money clause cover every negative commandment? The Teivat Goma distinguishes a negative that requires an act from one that does not; the Mishnat Chakhamim leans the same way and applies the distinction symmetrically to the positive; the Chomat Yerushalayim reasons the other way; and the Radbaz writes that one gives all his money to find permitted food, down to the rabbinic prohibition.

Pit’hei Teshuva ס״ק ז — the ten: himself, women, converts

The seif fixes the number; it does not say who counts. The Pit’hei Teshuva refers to what he wrote at siman 2 on three open questions: whether the man himself is among the ten, whether women join, and whether converts are included. On the last he inclines to exclude on the strength of בני ישראל, then holds back: perhaps here too there is some inclusion.

Pit’hei Teshuva ס״ק ח — must one flee rather than die?

The question was put to the Shevut Yaakov during a decree: those who could flee, were they to flee, or to remain with the community? His answer comes in two stages. In law, where both can be fulfilled — not transgressing and living — that is preferable; the words of the Tosafot that seem to say otherwise can be explained. Yet one who chooses to remain and give his life before all is not on that account called one who destroys himself deliberately.

Pit’hei Teshuva ס״ק י״ב — the Noda BiYehuda against the Shakh’s reading

The Noda BiYehuda sets the bound of what borders the prohibition: the rule extends only to what remains forbidden by the Torah, not to what is forbidden only rabbinically. He then points to a tension within the Shakh himself — between his ס״ק י, which follows the Rambam and makes לא תקרבו an actual negative commandment, and his ס״ק י״ב, which cites the Nimukei Yosef.

Pit’hei Teshuva ס״ק ט״ו — a limb for another’s life

« והשיב שאינו מחוייב זולת ממדת חסידות. אולם אם יש ספק סכנת נפשות הרי זה חסיד שוטה דספיקא דידיה עדיף מודאי דחבריה » (פתחי תשובה יו״ד קנ״ז ס״ק ט״ו)

The case is brought in the name of the Maharam Recanati and decided by the Radbaz: may a man let one of his limbs be cut off — without danger to life — to spare the life of another Jew? The Radbaz answers that he is not obliged, save out of piety; and that if the amputation carries a doubt of danger to life, one who accepts it is a “pious fool,” for his own doubt outweighs another’s certainty.

Pit’hei Teshuva ס״ק ט״ז — the woman already defiled

The Maggid Mishneh, in the name of the Rashba, writes that even if one of them had already been profaned, they shall all be defiled and she shall not be handed over. The Dagul MeRevava objects: the Yerushalmi in Terumot appears to say the opposite. The Pit’hei Teshuva refers on this point to a responsum of the Noda BiYehuda.

The Ba’er Hetev, for his part, does no independent work on this siman: he abridges the Shakh and the Taz, ס״ק by ס״ק. His use to the reader is to give in one line what the Shakh gives in twenty — thus, on the woman compelled:

7. Where this siman arises today — and why it is not decided alone

This page is a page of study, and nothing else. Siman 157 does not lend itself to application by a reader alone: it does not classify objects, it qualifies situations — and the qualification (is this a case of compulsion, what is the persecutor’s intent, are there ten, is there danger) is precisely what a reader cannot establish from a text. No line of this page says what to do. A real question goes to a Rav; and where a life is at stake, it goes to the authorities and to emergency services as well.

The places where studying this siman is genuinely useful

Reading a responsum

Modern decisors constantly refer to this siman and its categories: אונס, פרהסיא, אביזרייהו, חילול השם. Without them a contemporary responsum is unreadable.

Understanding what was done

The decisions taken in times of persecution were taken from here. To understand why one generation stood and another fled, one must know what the siman calls an hour of decree, and what it does not.

The measure of what one may demand of oneself

The siman contains as many limits upon stringency as demands: the fifth for a positive commandment, the doubt that inclines to leniency, the reminder that one who transgressed under compulsion is exempt, and the duty to flee when one can.

What does not belong here

A professional difficulty, an administrative pressure, a schooling choice or a labour conflict are not cases of this siman merely because they cost something. The siman speaks of an alternative set between transgressing and dying — and it is the Rav, not the reader, who says whether a given situation belongs here.
