Translation. The laws of a woman who sees blood on account of marital relations; it contains fourteen seifim. A woman who saw blood on account of relations — immediately, within the time it takes her to reach her hand under the pillow or under the bolster, take a bedika cloth to examine herself and wipe herself — has relations three times. If on all three consecutive times she saw blood (and all the more so if she found blood three times on his cloth — Mordechai, and so wrote the Beis Yosef in the name of the Terumas HaDeshen and the Semag, and so it is evident from Shas), she is forbidden to have relations with this husband; rather she must be divorced and marry another. If she married another and saw blood on account of relations three consecutive times, she is forbidden to have relations with that husband as well; rather she shall be divorced and marry a third. And if with the third as well she saw blood on account of relations three consecutive times, she shall not marry another: she is forbidden to all until she performs the bedika. Gloss (Rama): and there are those who say that we are no longer expert in what qualifies as "on account of relations", for we are not expert in the measure mentioned; therefore, for us, any woman who sees three times close to relations falls under "on account of relations", and she becomes forbidden to her husband (Beis Yosef in the name of the Raavad, who wrote so in the name of the "there are those who say"). And these three times must be consecutive; if they were not consecutive, she is not forbidden to her husband (Beis Yosef in the name of the Rambam; so wrote the Rashba, responsum 839, and the Mahari Weil 53, and so the author writes further on). And there is no difference between one who saw three times from the moment she married and one who became disordered afterwards and saw three times (Mordechai at the beginning of the laws of nidda, responsum of the Rashba 839, and Tosafos). And all of this applies only to one who saw close to relations; but if she did not see close to relations she is not forbidden to her husband and remains permitted to him after her purification, always (Beis Yosef in the name of the Sefer HaTeruma and the Semag, and it is obvious in Shas and among the poskim); and her status is that of a woman who has no veses.

1. Introduction to the sugya — what a "ro'ah machmat tashmish" is

↩ Detailed explanation (level 1)

The foundation — two fears in a single sighting

A woman who sees blood on account of relations places two distinct fears before us, not one. The first, immediate: since she saw blood, she is a nidda like any woman who sees. The second, remote and graver: that this blood comes from the makor (the womb), and that to nidda is added the kilkul — that is, that every time she has relations with this husband she will see again, so that she would be forbidden to him forever. The entire work of the siman is to distinguish blood that comes from the makor from blood that comes from the tzedadin (the walls) or from a maka (a wound), and to be lenient wherever the distinction allows.

פלפול — "immediately, within the time it takes to reach her hand". Not every sighting close to relations counts as "on account of relations": the Mechaber requires that she see מיד בכדי שתושיט ידה, within the time needed to take a cloth from under the pillow and wipe herself. The Shach measures what this boundary decides: within that span, even though one might argue she saw after relations, she is a ro'ah machmat tashmish — and his reason is the husband's liability.

Beyond that span, however, the Shach is blunt, and his wording is stronger than a mere exemption.

And he adds a boundary that runs the other way, and which is easily forgotten: an examination made immediately after relations that finds nothing closes the question even if she then sees within the span.

The Rama's gloss (seif 1). The Rama does not dispute the Mechaber's measure: he says we can no longer gauge it, and he draws a consequence that widens the category rather than narrowing it.

In other words: unable to measure immediacy, we can no longer use it to take a case out of the category; every sighting close to relations falls within it. But the Rama at once sets two boundaries, and they run the other way. The first: the three times must be consecutive.

The second: all of this concerns only one who sees close to relations — outside of that, nothing is established against her.

And the gloss closes on a qualification worth keeping, because it is what governs seifim 10 and 11: ודינה כמי שאין לה וסת (שולחן ערוך יורה דעה קפ״ז:א) — her status is that of a woman who has no veses.

2. The chazaka of three times and the kilkul — why three consecutive

↩ Detailed explanation (level 1)

The whole structure of the siman rests on one number — three — and on the order in which the husbands follow one another.

חקירה — what is a chazaka here? Why do one or two sightings not suffice to forbid? And why must there be precisely three consecutive times? The general rule of chazakos is stated in two examples set side by side, the veses and the ox: an accident becomes a fixed fact only at the third time.

One or two sightings therefore build no chezkas kilkul, and she is forbidden to her husband only at the third. What remains is to know what "consecutive" means exactly — and the Shach defines it in a way that is lenient: what breaks the series is a permitted union in between, not the spacing of the nights.

And the Shach notes, in the preceding ס״ק, that the first union counts among the three: דהיינו עוד ב' פעמים (ש״ך יו״ד קפ״ז ס״ק ב) — so two remain after the one in which she saw.

פלפול — changing husbands, and "not all fingers are alike". The Taz explains in five words why the prohibition upon the first husband is not yet a verdict against the woman herself.

The reading is this: as long as the kilkul has appeared with one husband only, nothing proves that the defect lies in her; it may lie with this husband, whose manner reaches a wound or a wall that another would not reach. Hence: let her be divorced and marry another. Only after the second and then the third does the chazaka close upon her, and she becomes forbidden to all until the bedika.

The Pischei Teshuva brings, in the name of the Noda BiYehuda, the full form of the reasoning as the Semag gives it: the heter for the second husband is a sfek sfeka, and the Taz's argument is its second doubt.

Hence the consequence the Noda BiYehuda draws, and it is a stringency: when the blood comes down abundantly the first doubt collapses, for it is then certain that it comes from the makor.

יסוד — chezkas heter against chezkas kilkul. As long as the kilkul has not been established over three husbands, the woman remains in her presumption of permission toward the husband who comes next; only after three husbands of three times each is that presumption uprooted and she is held to be a ro'ah machmat tashmish, forbidden to all until she performs the bedika. This explains why the bedika — the shefoferes, below — remains the key even after a full chazaka: there is no prohibition attached here to her person, but a fear about the origin of the blood, and that can be clarified.

מחלוקת — what the Pischei Teshuva brings, and does not decide.

The point at issueWhat the sources sayReference
A fixed veses established afterwards The Noda BiYehuda proposes a heter where, at the time she saw machmat tashmish, she had no fixed veses at all, and a fixed veses was established later — since the prohibition of the ro'ah machmat tashmish itself derives from a veses, and from a veses that is not fixed
Pregnancy and nursing The Chavas Daas holds she is forbidden even during pregnancy and nursing; the Noda BiYehuda Tinyana writes on the contrary that if she conceived from the third union she waits until the pregnancy is recognizable and returns to being permitted to her husband throughout the pregnancy and nursing
Abundant blood Where the blood comes down abundantly, the Noda BiYehuda refuses to permit her to another husband, the sfek sfeka being broken — and he even casts doubt on the bedikas ha-shefoferes in such a case

And in practice — ask your rav.

3. Makor or tzedadin — the bedikas ha-shefoferes

↩ Detailed explanation (level 1)

The text of the Mechaber and the Rama (seif 2)

Translation. How does she examine herself? She takes a shefoferes (meaning: a hollow tube) of lead, whose mouth is flush inward; she places within it a michol at whose head there is moch, and inserts it into that place up to the point that relations reach. If blood was found at its head, it is established that it comes from the makor, and she is forbidden; and if not, it is established that it comes from the tzedadin, and she is permitted. (Beis Yosef from the Rambam.) Gloss (Rama): and even nowadays one may rely on this bedika (Tur and Beis Yosef according to the view of the Rambam, the Rosh, the Rashba and the Rif; so wrote the Ran and the Maharam Padua, responsum 10).

יסוד — isolating the makor from the tzedadin. The mechanism is one of isolation, and the gemara builds it in two steps. First the baraisa, which describes the instrument.

Then an objection: a tube inserted this way would injure her, and the blood found would come from the injury itself — אַפְסוֹדֵי מַפְסְדָא (נדה ס״ו ע״א). It is to that objection that Shmuel answers, and his answer is precisely what the Mechaber copies word for word into the seif.

Lead is soft and a flush mouth lets nothing pass: the tube holds the walls apart without breaching them. If the blood is found on the moch, it came from the depth, from the makor → forbidden; if the moch stayed clean, the blood was on the walls → permitted. There is therefore no ruling here on the prohibition itself, but a diagnosis of the place the blood comes from.

פלפול — the mechanics of the bedika according to the Taz (ס״ק ה). The Taz comments on the word michol and not on the word shefoferes: פירוש קיסם (ט״ז יו״ד קפ״ז ס״ק ה) — it is a thin sliver. From this follows his reading of the whole, which gives the tube and the moch two distinct roles.

The tube, then, separates the sliver from the walls: without it, the sliver alone would tell us nothing. And the moch carries two functions, the second of which answers the gemara's objection.

The Pischei Teshuva brings from the Toras HaShlamim a precision about the order of the acts, which he derives from the Rambam's wording: the tube goes in first as far as it can, and only then is the sliver pushed inside the tube.

The measure of the tube — eiver beinoni (Emunas Shmuel, cited by the Pischei Teshuva). The Pischei Teshuva, commenting on the words "up to the point that relations reach", brings in the name of the Emunas Shmuel the measure to be given to the tube itself.

A note on reading: the Pischei Teshuva speaks of making the tube — that it be made to the measure of an average member. That this measure is exactly the depth of insertion follows naturally from the Mechaber's words ("up to the point that relations reach"), but it is not what the Pischei Teshuva writes; we do not put it in his mouth.

מחלוקת — nowadays, does one rely on this bedika?

ShitaThe bedikas ha-shefoferes todayReference
Rama, following the Rambam, the Rosh, the Rashba, the Rif, the Ran and the Maharam Padua One relies on it: ואף בזמן הזה יש לסמוך אבדיקה זו — the diagnosis distinguishes makor from tzedadin and permits רמ״א שולחן ערוך יורה דעה קפ״ז:ב
The Noda BiYehuda, cited by the Pischei Teshuva Once she has been forbidden after the third husband, no bedika helps her any longer — but he expressly distinguishes the bedika made after the first husband, where a remedy remains

נפקא מינה — from the shefoferes to medical diagnosis. The principle of the siman does not move: the point is to establish where the blood comes from. Once this was done with a tube and a sliver, by an expert woman's hand; today the diagnosis is a physician's (a gynecologist), who examines the cervix and the walls — a wound, a polyp, an erosion — and distinguishes them from the makor. It is the same question, asked with other instruments. A woman never examines and decides for herself: the halacha belongs to the rav, the diagnosis to the physician.

4. The first sevara and the second — examining oneself under the first husband

↩ Detailed explanation (level 1)

The text of the Mechaber and the Rama (seif 3)

Translation. If she wishes to examine herself while still under the first husband, after having had relations three times — she is entitled to, and she remains permitted to him. And there are those who say that she is forbidden to the first from the third union onward, even with a bedika. Gloss (Rama): one should rely on the first sevara to be lenient (Tur and Beis Yosef in the name of the consensus of the poskim and the Hagahos Maimoniyos); and if she felt distress and pain at the time of relations, according to all opinions one may rely on the bedika with the first husband (ibid. in the gloss, in the name of the Ritzva).

מחלוקת — does the bedika help with the first husband?

ShitaThe bedika under the first husbandReference
First sevara — and it is the one held for leniency She may examine herself under the first after the three times; if the blood proves to come from the tzedadin, she remains permitted to him
Yesh omrim She is forbidden to the first from the third union on, even with a bedika

פלפול — distress and pain: the Ritzva's ruling, cited by the Rama. The Rama adds a case in which the machlokes dissolves: if she felt distress and pain during relations, according to all opinions one relies on the bedika, even with the first husband.

The reason is subtle, and it meets what seif 7 will say in another way: pain is a witness as to place. Bleeding from the makor that wells up of itself does not hurt; localized pain points toward a wound or an injury to the walls. It is an indication, not a proof — the Rama does not say she is permitted because of the pain, he says the pain suffices to remove the objection against the bedika.

5. What the blood may be attributed to — veses, wound, and the Rama's sfek sfeka

↩ Detailed explanation (level 1)

The text of the Mechaber and the Rama (seifim 4-5)

Translation (seif 4). If she had relations close to her veses, we attribute her sighting to her veses, and we do not count her as one who sees on account of relations.

Translation (seif 5). If there is a wound in that place, we attribute the blood to the blood of her wound; and if the blood of her wound is different from the blood of her sighting, we do not attribute it to the blood of her wound. Gloss (Rama): all of this applies to a woman who has a fixed veses, and one may then attribute to her wound what she sees outside the time of her veses, even though she does not know with certainty that her wound produced blood (so it is implied in the Piskei Mahari, responsum 47, and in the Hagahos Shaarei Dura). Likewise, if she has no fixed veses and there is a doubt whether the blood came from the makor or from the tzedadin, we attribute it to the wound by force of a sfek sfeka: perhaps it is from the tzedadin; and if you say it is from the makor, perhaps it is from the wound. But if it is known that it came from the makor — even though she has a wound in the makor — she does not attribute it to the wound, if she has no fixed veses, unless she knows with certainty that her wound produces blood (so it is implied in the Mordechai and in the Hagahos Maimoniyos, and see ס״ק כ״ב). And in any event, at the time of her veses, or from thirty days to thirty days, she does not attribute to her wound, for otherwise she would never be temei'a (idem, and Beis Yosef in the name of the Semag and the Semak); as for stains, she attributes them to it in every circumstance (Mordechai).

יסוד — two attributions that move a sighting away from kilkul. Two forces remove a sighting from the category "on account of relations", and the gemara sets them side by side in a single sentence.

The first is the veses: if she had relations close to her veses, the blood is charged to the veses that is coming, not to the relations — and the sighting does not enter the count of the chazaka.

The second is the wound, on condition that the blood of the wound not be of another aspect than that of her sighting. That reservation is already in the gemara.

פלפול — the standard for "blood of a wound that is different" (ט״ז ס״ק ט). Who must establish what? The Taz brings the Tur in the name of the Rosh: by default one attributes — and it is the difference that must be reached, not the resemblance.

The Beis Yosef objects that the Tur contradicts himself, having first written that there is no need to compare the two bloods at all. The Taz brings the Perisha's answer, and it is the one he adopts: the distinction bears on what is within our reach.

In other words: where both bloods are before us and comparison is possible, we do not go to leniency without having made it; where it is impossible, we attribute by default. The Taz likens this to siman 1 in matters of shechita, where we do not rely on the presumption of competence when the shochet is before us.

חקירה — the Rama's sfek sfeka: how the two doubts stack. When she has no fixed veses and there is a doubt as to where the blood came from, the Rama builds a sfek sfeka in order to permit. Here are his words, and the order of the two doubts is essential.

From two lenient doubts, we attribute to the wound and she is permitted. But let the first doubt be removed — let it be established that the blood comes from the makor — and the structure collapses: one doubt remains, and a single doubt does not permit.

The role of the fixed veses — and the boundary the Rama sets immediately after. A woman who has a fixed veses attributes more broadly: she may charge to the wound what she sees outside the time of her veses, even without knowing with certainty that the wound produced blood.

The reason is that a fixed veses attests that her natural blood comes out at its hour; a sighting outside that hour therefore leans toward the wound. But the Rama at once closes the door for the time of the veses itself, and his reason is the plainest in the seif: without that boundary she would never be temei'a.

A last line of the Rama, often omitted, broadens instead: for stains, attribution to the wound holds in every circumstance — וכתמים תולה בה בכל ענין (שולחן ערוך יורה דעה קפ״ז:ה). The Rama himself refers the reader to ס״ק כ״ב of the Shach on this seif.

6. The credence of "maka yesh li" — and the bedika in every crevice

↩ Detailed explanation (level 1)

The text of the Mechaber and the Rama (seifim 6-7)

Translation (seif 6). A woman is believed when she says: "I have a wound in the place from which the blood comes out of me." Gloss (Rama): likewise, if she says "it is clear to me that this blood does not come from the makor" — she is believed and she is tehora (Mahari Weil, responsum 25).

Translation (seif 7). If, whenever she examines herself in all the crevices and cracks, she finds stains in only one place on the walls — one may attribute the blood to a wound on that side. And all the more so if she feels, at the time of the bedika, that when she touches beside that place it hurts her a little, while in the other crevices and cracks she feels no pain at all.

יסוד — where this credence comes from, and what it covers. The credence given to the woman is no invention of the poskim: it is Rebbi's position in the baraisa, against which Rabban Shimon ben Gamliel rises.

The Mechaber holds like Rebbi — but the shift of wording must be noticed: the gemara says a wound in the makor, while the Mechaber writes נאמנת אשה לומר מכה יש לי באותו מקום שהדם יוצא ממנה (שולחן ערוך יורה דעה קפ״ז:ו), "in that place". The Taz points out that this very point is disputed: The Rama adds a second formula, broader still, since it names no wound at all.

פלפול — a single place, and pain as an indication. Seif 7 is the practical application of the tzedadin mechanism: if, examining everywhere, she finds blood in one lateral place only, it stands to reason that it comes from a wound on that side and not from the makor, which would spread.

And the seif adds a further degree: localized pain, felt only on contact with that place, strengthens the attribution.

We meet again here what seif 3 had established through the Ritzva's gloss: pain does not permit by itself, it designates a place. Seif 3 used it to remove the objection against the bedika; seif 7 uses it to support an attribution. It is the same indication put to two different uses — and the siman never grants it more than the role of an indication.

The limits of this credence, in practice. This credence covers what the woman can testify to: her sensations, and the place where she finds the blood. It does not cover a medical diagnosis, which the siman does not ask of her. Today, "I have a wound" or "it is clear to me that this is not from the makor" rest on a physician's examination having found a lateral cause — cervix, polyp, lesion — that accounts for the blood. The credence and the halacha belong to the rav; the diagnosis, to the physician. A woman does not decide for herself.

7. Medicine and "nowadays" — a Jewish physician and a non-Jewish one

↩ Detailed explanation (level 1)

The text of the Mechaber and the Rama (seifim 8-9)

Translation (seif 8). If she wishes to be healed, it must be before the chazaka is established; but after it is established, there are those who doubt whether it is permitted to rely on the treatment to have relations afterwards. And there is one who permits if a Jewish physician told her "you are healed". And if the woman sees that her veses blood and her sightings have ceased through the treatments, and it is evident that they helped, one may rely even on a non-Jew.

Translation (seif 9). They frightened her suddenly and a clot of blood fell from her and she was healed — she is permitted to her husband; and if she went back to seeing on account of relations even once, it is established that she was not healed. And nowadays we do not permit by this treatment (the Ramban and the Raavad in Sefer Baalei HaNefesh); nevertheless we do not remove her from her husband after this treatment, until she has relations and returns to her disorder (Raavad, ibid.).

יסוד — treatment before the chazaka and after it. The seif draws a dividing line rather than granting a general permission: the worth of a treatment depends on when it comes.

Before the chazaka is established there is as yet nothing to uproot. Afterwards, the chazaka does not yield on its own, and the seif no longer sets a treatment against it but a testimony.

מחלוקת — degrees of credence in medical matters (seif 8).

The witnessWhat the seif says of himWhat it rests on
A Jewish physician saying "you are healed" "There is one who permits" — an opinion reported as such, not the author's own ruling The physician's word itself
A non-Jew One relies on him when a visible sign is added: the veses blood and the sightings have ceased and the effect is evident The sign, which the seif states expressly; the text says nothing of a credence attaching to the physician himself

פלפול — "nowadays we do not permit", and what the seif nonetheless concedes. Seif 9 first brings the case of the gemara: the fright, the clot expelled, the healing.

Then the Shulchan Aruch sets that remedy aside for our era, in the name of the Ramban and the Raavad.

And it at once adds a reservation that is lenient, and must be read exactly: not permitting lechatchila is not the same as removing the wife from her husband.

The siman therefore distinguishes three states and not two: permitted, forbidden, and "we do not remove her so long as the disorder has not recurred". It is this third position that carries the practical weight of the seif.

נפקא מינה — "nowadays", both ways. The "nowadays" of seif 9 runs toward stringency: we do not rely on the remedy of fright. But the main change of our era runs the other way: medicine today identifies the origin of the bleeding — cervix, polyp, ectropion — and often treats it; and it is through that, not through an ancient remedy, that the siman's heter passes, since it brings the question back to the one seif 2 already asked: wound and walls, or makor. And all of this with a rav muvhak, together with a competent physician (gynecologist); never by self-diagnosis.

8. Establishing a veses on a machmat tashmish sighting

↩ Detailed explanation (level 1)

The text of the Mechaber and the Rama (seifim 10-11)

Translation (seif 10). One who sees blood at the time of relations is permitted to have relations a second time once she is purified; nevertheless we are concerned for one occasion after her sighting. For example: she saw once, or twice, on the night of her tevila — when another tevila comes (she must separate) on the night of her tevila; and there is no need to separate on the night of the third tevila, for with anything that has not established a veses we are concerned only once. Gloss (Rama): and if she saw three times, each time at the first union after her tevila, she is forbidden to her husband, as though she had seen three consecutive times, since it is impossible for her to immerse and have relations with him, for she sees each time after her tevila (responsum of the Rashba 839, brought by the Beis Yosef). And if it happened that she saw three times at the first union after her childbirth, or that she saw after each childbirth three times with nothing seen in between, some have written to be lenient and permit her to her husband, for we attribute the sighting to the weakness still left from her childbirth, the walls having been bruised by the birth — which is why she sees close to the birth and not afterwards — and we attribute it to the birth as we attribute to a wound (Hagahos Shaarei Dura, responsum 47, and the responsum of Rabbi Yochanan). And all of this if she had already had relations between the earlier births, so that permitted unions followed forbidden ones; but if she saw three consecutive times after a birth, we do not attribute it to the birth and she needs the bedikas ha-shefoferes (so it is implied there). However, wherever a bedika is required, if she went ahead and had relations and did not see, she is permitted, for such a union in which she did not see is better than the bedikas ha-shefoferes (the glossator's own view).

Translation (seif 11). A woman who saw on account of relations and who, half a year later, again saw on account of relations — she is permitted to her husband, for she has established neither by three equal vestos nor by progression; nevertheless she is concerned for the last one once, and when half a year has passed from the day of the last sighting of blood she is forbidden for one ona. And if she established a veses for seeing blood on account of relations, three times at an equal interval — she is permitted to have relations from one veses to the next, but on the days of the veses she separates, until it is uprooted three times.

יסוד — a machmat tashmish sighting behaves like a veses. Seif 10 applies here the general rule of vestos: one or two sightings bind only to a single concern, not to an establishment.

Seif 11 draws the favourable consequence: one sighting and another six months later establish nothing.

And if a veses has nonetheless been established on that sighting, that turns out to be a leniency and not a severity: she is not forbidden forever, she separates on the days of the veses.

This is exactly what the Pischei Teshuva lays down as a principle at ס״ק א: the prohibition of the ro'ah machmat tashmish itself derives from a veses — כיון שנקבע לה וסת קבוע שוב אינה חוששת לוסת שאינו קבוע כלל (פתחי תשובה יו״ד קפ״ז ס״ק א).

פלפול — the first union after tevila: the Rama's chiddush (in the name of the Rashba). If she saw three times, each time at the first union following tevila, the Rama forbids her as though the three times had been consecutive.

His reason is sharp: it is impossible for her to immerse and have relations with him without seeing. The test of "consecutive" is therefore not a count but the impossibility of a pure union — which matches exactly the definition the Shach gave of the word retzufim at ס״ק ג: what breaks the series is a permitted union in between, and here there can never be one.

The Rama at once sets down the neighbouring case, which runs the other way: a sighting following childbirth is attributed to the childbirth, exactly as one attributes to a wound.

And the gloss closes on a remark that inverts the hierarchy of proofs: an actual union without a sighting is worth more than the bedika itself.

9. Keeping the wife, the virgin, and one who cannot immerse

↩ Detailed explanation (level 1)

The text of the Mechaber and the Rama (seifim 12-14)

Translation (seif 12). One who sees on account of relations three times — it is forbidden to keep her, even if he does not wish to come to her, unless he wishes to keep her by means of a third party, and he shall not go to her except in the presence of witnesses.

Translation (seif 13). One who has relations with a virgin several times and she saw blood on account of relations — we always presume it to be blood of virginity, until she has relations once and does not see blood on account of relations; and if thereafter she sees three times on account of relations, she is established as one who sees blood on account of relations. Gloss (Rama): and even if she did not stop seeing a single time, if she has no distress at all at the time of relations, she is like all women and we do not attribute it to blood of virginity (responsum of the Maharam Padua, 10). One from whom blood comes out through the urinary passage and who had relations — the woman attributes it to him (Beis Yosef in the name of a responsum of the Rashba). And see above, siman 190 (seif 20).

Translation (seif 14). A woman who has wounds and sores such that she cannot immerse — she leaves her husband, so that he not be prevented from the mitzva of procreation.

מחלוקת — the virgin: blood of virginity or a machmat tashmish sighting?

ShitaThe virgin who seesReference
Mechaber We presume blood of virginity until she has relations once without seeing; only then do three sightings build a chazaka
Rama, in the name of the Maharam Padua (responsum 10) Even without that pause: if there is no distress at the time of relations, she is like all women and one does not attribute it to blood of virginity

The hinge is therefore pain, for a third time in this siman: blood of virginity comes with pain; without it the attribution falls. Note that pain here serves to refuse an attribution, whereas at seifim 3 and 7 it served to support one. This is no contradiction: in all three, pain points to the mechanical origin of the blood.

פלפול — "one from whom blood comes out": attributing to the husband (Rashba, in the Rama). The Rama adds a case in which the origin of the blood is not in her at all.

The principle of the siman appears here in its barest form: whatever allows the blood to be attributed to a lateral source — even the husband himself — removes the chezkas kilkul. For this the Rama refers to siman 190, seif 20.

Keeping her by means of a third party (seif 12) — and the harshness of seif 14. Although it is forbidden to keep her, the seif opens a narrow path: the custody of a third party, and the prohibition of going to her except in the presence of witnesses.

Seif 14 closes the siman on a case that is no longer that of the ro'ah machmat tashmish but shares its logic — the lasting impossibility of a permitted union.

These two seifim bear on the status of the marriage itself. Nothing in them is put into practice other than through a beis din and a rav muvhak.

10. Chakira and nafka mina for practice

↩ Detailed explanation (level 1)

חקירה — the question the whole siman pursues. How does one distinguish blood of the makor, which forbids and disorders, from blood of the tzedadin or of a wound, which does not? And on what conditions is the chezkas kilkul uprooted? The siman answers with five instruments, and they are not of one kind:

What the siman does not settle, and must be left open: the exact scope of the credence of seif 6 — a wound "in that place" or "in the makor" — on which the Taz himself refers to the machlokes of seif 5; and the worth of a bedika made after the prohibition has taken hold, where the Noda BiYehuda is markedly stricter than the Rama of seif 2.

נפקא מינה — what changes according to the shita held.

  1. The scope of "on account of relations": the Mechaber's measure of immediacy, or the Rama's widened definition — וי"א שאין אנו בקיאין איזה מיקרי מחמת תשמיש כי אין בקיאין בשיעור הנזכר ולכן כל שרואה ג"פ סמוך לתשמיש מקרי לדידן מחמת תשמיש ונאסרה על בעלה (שולחן ערוך יורה דעה קפ״ז:א) — on condition that the three times be consecutive.
  2. The worth of the bedika for establishing the origin of the blood: the Rama relies on it even today (שולחן ערוך יורה דעה קפ״ז:ב); the Noda BiYehuda refuses it once the prohibition has taken hold (פתחי תשובה יו״ד קפ״ז ס״ק י״ד).
  3. With no fixed veses and a doubt makor / tzedadin: the Rama's sfek sfeka attributes to the wound (שולחן ערוך יורה דעה קפ״ז:ה) — but it falls as soon as the origin is established.
  4. Distress and pain during relations: according to all opinions one relies on the bedika with the first husband (Ritzva, cited by the Rama,
  5. The woman's credence when she says "I have a wound" or "it is clear to me that this is not from the makor" (שולחן ערוך יורה דעה קפ״ז:ו).

And in practice — ask your rav, and in this sugya also a competent physician (gynecologist); never by self-diagnosis.

The point Shita א Shita ב
The scope of "machmat tashmish" — the measure of immediacy Mechaber — one who sees immediately, "within the time it takes to reach her hand" (seif 1) Rama — we can no longer gauge that measure, and every sighting close to relations falls within it (gloss, seif 1)
The bedika under the first husband First sevara — she may examine herself and become permitted to him again (held for leniency) Yesh omrim — forbidden to him from the third union on, even with a bedika
The bedika once the prohibition has taken hold Rama — one relies on this bedika even nowadays (seif 2) Noda BiYehuda — after the third husband no bedika helps any longer, but after the first a remedy remains
