1. הדין העולה — the line of psak of the siman

The line of psak. The siman comes down to three decisions. (1) A man on whom another imposes a vow and who answers amen is bound on the same footing as if he had vowed himself: the seif opens with אחד … או. (2) What binds is the acceptance, not the word: any formula of the same force does the same, and Rambam expressly adds בכל לשון. (3) But when the thing forbidden is not his, no acceptance is required — and it is there, and nowhere else, that the Acharonim divide.
This siman is short, and its variables are facts: what was said, by whom, about whose property, and at what moment. None of these is established from memory. For your own situation, ask your Rav.

2. עניית אמן — what a word of acceptance binds

What is decided. An amen answered to a vow or oath another man lays upon you produces the same prohibition as if you had uttered it. Rambam takes the rule to its edge: even a man adjured by a non-Jew or a minor, if he answered amen, is liable.
In practice attention falls on one point: was there an adjuration aimed at him, and was his answer an acceptance? That is a question of fact, and it belongs before a Rav.

What is decided. “Yes”, “I am bound by this oath”, “I have accepted this oath upon myself” — and any formula of the same force, in any language. The Shach, in his first ס״ק, refers to three other places in Yoreh De‘ah where the same mechanism applies: the rule is not peculiar to this siman.
The seif therefore asks for no ritual word. It asks that he have accepted. A polite answer and an acceptance do not always tell themselves apart: this is exactly the kind of case one does not settle alone.

4. מתפיס — one who adheres without having been adjured

The distinction, and it is practical. A man who says “I too, like you” after another’s oath, without having been adjured, is פטור — exempt from lashes and from a sacrifice. But Rambam adds at once that it remains forbidden for him to eat what he attached in this way. Exempt and permitted are not the same thing.
Keep the rule in its working form: an adjuration received and a spontaneous adherence do not have the same effect — but a spontaneous adherence is not without effect at all.

5. אוסר נכסיו — the point of open disagreement

What is settled, and what is not. Settled: no acceptance is required in the case of clause c. Not settled: whose property is meant. The Beit Yosef, the Shach and the Nekudot HaKesef read it as the speaker’s property, and conclude that the prohibition holds בעל כרחו — against the other man. The Taz reads it as the property of the man addressed, and his objection bears on the Mehaber’s drafting. The Ba’er Hetev reports both and notes that the Nekudot HaKesef answered the Taz.
The practical consequence is sharp: may a man render his property forbidden to someone who refuses aloud? On the first reading, yes. This is an open disagreement among Acharonim: it goes to a Rav; it is not settled here.

6. עד היכן — the limit of ownership

What is decided. The power to forbid one’s property to another assumes it is still his. The Pitchei Teshuva reports, in the name of a responsum, that a man may render his fruit forbidden to his fellow and that it is then כהקדש to him — but only so long as the fellow has not acquired it. Once lifted, it has left his domain, and his word no longer reaches it.
And the other side of the rule is harsher than one might think: forbidden in time, whoever disregards it has eaten a forbidden thing, and needs סליחה וכפרה even if he pays. Payment settles the theft; it does not settle the prohibition.

An amen answered to a public resolution

The rule of the seif does not ask for an intention to be bound; it asks for acceptance. Whether the answer was one remains to be established: a question of fact, to be put to a Rav.

An “agreed” on the telephone

Rambam says expressly בכל לשון, and gives “yes” as his first example. There is no protected formula.

Someone who joins another man’s undertaking of his own accord

Nobody adjured him: he is a מתפיס, exempt — yet Rambam still forbids him what he attached.

An owner forbidding his property to a particular person

No acceptance is required; the exact reach of that power is the dispute of § 5.

A thing already taken

The Pitchei Teshuva’s case: said too late, the word does not carry; said in time, it binds, and payment does not erase it.
