1. The axiom: not an absorption, but a גזירה

The starting point:

Siman 97 deals neither with a mixture nor with a real absorption of a forbidden substance: it lays down a גזירה (rabbinic safeguard). One does not knead dough with milk (אין לשין עיסה בחלב), "שֶׁמָּא יָבוֹא לְאָכְלָהּ עִם בָּשָׂר" — lest one come to eat it with meat. The bread becomes forbidden by decree, not by a real taste: "if one kneaded → all the bread is forbidden, even to eat it alone" (אֲפִלּוּ לְאָכְלָהּ לְבַדָּהּ). Only two היכרים lift the גזירה: a small quantity, enough to eat in one sitting (כְּדֵי אֲכִילָה בְּבַת אַחַת), or a changed shape of the bread (שִׁנָּה צוּרַת הַפַּת).

💡 The marker: this siman does not ask "how much taste / how much to nullify," but "could one err and eat it with meat?". As long as there is a היכר (little bread, or a recognizable shape), no confusion is possible → permitted. Without a היכר, the bread is forbidden even alone.

⚖ The customs of the year (Rama, seif 1)

This is why the custom is to knead bread with milk on Shavuot, and with fat (שומן) in honor of Shabbat: all this is considered a small quantity and their shape differs from other breads. All the more so פלאד״ן (a cheese pastry) or פשטיד״א (a meat pie) are permitted. But one does not bake any bread with a fladen/pashtida in an oven, lest the fat ooze (יזוב) onto the bread; and if it oozed beneath it (תחתיו) → it is as if kneaded with it. The custom is to place the tofela (טפילה, the rim of dough) at the mouth of the oven; and even in a pan (מחבת), the custom is to be stringent le-chatchila.

An absolute must to memorize. Basis: Mehaber seifim 1-3, read with the Rama, the Taz (s.k. 1-5) and the Shach.

📌 Key reading: for the dough with milk, first ask is there a היכר (quantity or shape) — and check its two limits (home only, baking only, no dividing after the fact). For the smeared oven, see whether the fat is בעין (→ ליבון). For joint cooking, look at the size of the oven and whether there is covering (ריחא).

4. The 5 golden rules

  1. "אין לשין עיסה בחלב שמא יבוא לאכלה עם בשר". This is a גזירה: if one kneaded, all the bread is forbidden even eaten alone (Mehaber seif 1, Shach).
  2. Two היכרים lift the גזירה. A small quantity (כדי אכילה בבת אחת) or a recognizable distinct shape (שינה צורת הפת) → permitted (Mehaber seif 1).
  3. The shape היכר has two limits. It works only at home (not to sell at the market) and only at the time of baking; one does not divide a bread already נבילה (Pithei Teshuva s.k. 3, Mahari"t).
  4. Fat בעין → ליבון, not קינוח. An oven smeared with אליה cannot be wiped clean; one must heat it "עד שיתלבן". Even a בוכיא has no היתר by an external heating (Mehaber seif 2, Taz s.k. 4-5).
  5. ריחא in joint cooking. Bread + roast, fish + meat in an oven → forbidden with milk. Mitigated by a large open oven (12 esronim) or by covering (Mehaber seif 3, cross-ref siman 108).

6. The 4 classic pitfalls

❌ Pitfall 1 — Thinking it is an absorption: bread kneaded with milk is not forbidden because it "contains" milk nor by a taste computation. It is a גזירה of confusion (Shach). That is why 60 does not help to permit it when the decree applies, and it is forbidden even eaten alone — unlike a real mixture. Do not reason "ביטול בס׳" here.
❌ Pitfall 2 — Extending the shape היכר without its limits: changing the shape of the bread helps only at home — bread made for the market remains forbidden, since buyers will not recognize the mark (Mahari"t, Pithei Teshuva s.k. 3). Moreover the שינוי must be made at the time of baking: a shape / a פשטיד״א made after the bread is already forbidden does not help, and one does not divide a bread already נבילה.
❌ Pitfall 3 — Confusing fat בעין with a mere בליעה: an oven smeared with אליה keeps the fat בעין (a present substance, not wipeable) → היתר only by ליבון (heating until it whitens), not by קינוח (Taz s.k. 4). By contrast, bread that has only an absorbed taste (without fat בעין) remains נ״ט בר נ״ט → bedieved permitted even with milk, and with meat permitted even le-chatchila (Pithei Teshuva s.k. 4, link siman 95).
❌ Pitfall 4 — Underestimating "זב תחתיו" and ריחא: one does not bake bread with a fladen/pashtida in an oven, lest the fat ooze onto the bread; it need not be visible beneath the bread — once it overflows and soaks into the oven, one suspects it reached it (Taz s.k. 2). And the ריחא (bread + roast, fish + meat) forbids with milk, except in a large open oven or with covering.
