The previous siman dealt with the blessings said over a miracle — one seen, and one whose place is seen again. This one steps down to the level of ordinary life: a man has crossed a sea, an illness, a prison — and has come out of it. What does he say then? The Oral Torah answers with a list of four and a single blessing. Hebrew text, English translation and an explanation of the ט׳ seifim, with a section of practical cases.

This siman does not ask whether one may give thanks — one always may. It asks something else: when does gratitude become an obligation, with a fixed wording and a public? The answer is a list of four situations, all drawn from one psalm in which the refrain יודו לה׳ חסדו returns four times. The Aruch haShulchan named what the four have in common: neither an open miracle nor the ordinary course of things, but the middle ground — ויש עוד מין שלישי והוא ממוצע בין הנסיות ובין הטבעיות, והיינו שהעניין הולך בטבע אבל יוצא מעט מגדר הטבע אל טבע הנסיות (ערוך השלחן או״ח סימן רי״ט). We study here at the level of principle; for personal practice, one follows the ruling of one’s Rav.

A. ארבעה צריכים להודות — the four who must give thanks

אַרְבָּעָה צְרִיכִין לְהוֹדוֹת — “four must give thanks”. It is not an invitation but an obligation, and it comes from a teaching of Rav Yehuda in the name of Rav: אמר רב יהודה אמר רב: ארבעה צריכין להודות: יורדי הים, הולכי מדברות, ומי שהיה חולה ונתרפא, ומי שהיה חבוש בבית האסורים ויצא (ברכות נ״ד ע״ב). The Gemara anchors each of the four in a verse of Psalm 107, where the same refrain returns four times — thus for the sea: יורדי הים מנלן? — דכתיב: ״יורדי הים באניות וגו׳ המה ראו מעשי ה׳״ (ברכות נ״ד ע״ב).

Seif 1 — ארבעה צריכים להודות

ארבעה צריכים להודות יורדי הים כשעלו ממנה והולכי מדברות כשיגיעו ליישוב ומי שהיה חולה ונתרפא ומי שהיה חבוש בבית האסורים ויצא וסימנך וכל החיי״ם יודוך סלה ״חולה ״יסורין ״ים ״מדבר:
Seif 1: four must give thanks — those who go down to the sea, when they have come up from it; those who travel the deserts, when they reach a settled place; one who was ill and was healed; and one who was confined in prison and came out. And your mnemonic: “and all the living (החיי״ם) shall thank You, selah” — חoleh (the sick), יissurin (the sufferings of prison), יam (the sea), םidbar (the desert).
The source: four, and a single psalm. The Mechaber copies the baraita: אמר רב יהודה אמר רב: ארבעה צריכין להודות: יורדי הים, הולכי מדברות, ומי שהיה חולה ונתרפא, ומי שהיה חבוש בבית האסורים ויצא (ברכות נ״ד ע״ב). The four are no arbitrary choice: the Gemara shows for each a passage of Psalm 107 where one cries out to Hashem and then gives thanks — thus יורדי הים מנלן? — דכתיב: ״יורדי הים באניות וגו׳ המה ראו מעשי ה׳״ (ברכות נ״ד ע״ב). summary: the list is not a taxonomy of dangers; it is a reading of a psalm that describes four distresses and one same deliverance.
The Rambam says “roads”, the Gemara says “deserts”. ארבעה צריכין להודות. חולה שנתרפא. וחבוש שיצא מבית האסורים. ויורדי הים כשעלו. והולכי דרכים כשיגיעו לישוב (רמב״ם הלכות ברכות פרק י הלכה ח). The Beit Yosef notes the changed word and draws a consequence from it: אלא דממה ששינה הולכי מדברות האמור בגמרא וכתב במקומה בפ״י הולכי דרכים משמע דבכל הולך דרך קאמר ומינה למד רבינו דחולה ונתרפא בכל חולי קאמר (בית יוסף או״ח סימן רי״ט). summary: one displaced word in the Rambam opens the two customs that will collide in seif 7 — to bless only on leaving a desert, or on leaving any road at all.
When exactly? A stopover is not an arrival. ודוקא כשעלו ממנה לגמרי ואין בכלל זה מה שעומדים עם הספינה כשבאה לנמל (משנה ברורה, מ״ב רי״ט:א); and likewise וה״ה בהולכי מדבריות ובדרך הליכתם עוברים דרך איזה עיר ג״כ אין מברכין (משנה ברורה, מ״ב רי״ט:א). For the sick: ונתרפא - והולך כבר על בוריו (משנה ברורה, מ״ב רי״ט:ב). The Aruch haShulchan sums up all four: ואינו מברך עד שיצא מהצרה לגמרי: יורדי הים עד שיעלה ליבשה, הולכי מדבריות עד שיגיע לתוך הישוב, ומי שהיה חולה ונתרפא עד שיצא לשוק (ערוך השלחן או״ח סימן רי״ט). summary: one does not bless in the middle of the danger, nor at the first relief, but once fully out of it.
The prisoner: held on what charge? The Magen Avraham narrows it: חבוש. על עסקי נפשות (מגן אברהם או״ח סימן רי״ט) — that is, on a capital matter. The Mishna Berura reports the objection: דעת מ״א דמיירי בחבוש על עסקי נפשות דוקא והרבה חולקים עליו (משנה ברורה, מ״ב רי״ט:ג), and the Biur Halacha spells it out: והנה הא״ר וברכ״י ועוד אחרונים חלקו עליו והוכיחו מהרבה ראשונים דאפי׳ חבוש מחמת ממון ולא היה שום סכנה ג״כ מברך כיון דעכ״פ היה כלוא ולא היה מושל בנפשו (ביאור הלכה סימן רי״ט). The Aruch haShulchan rules the same way: ואין חילוק בין אם היה חבוש מחמת ממון ובין מחמת נפשות (ערוך השלחן או״ח סימן רי״ט). summary: for the Magen Avraham it is mortal peril that obligates; for many others, the loss of liberty is enough.
Who blesses, and how many times. כתבו האחרונים דמי שנתחייב ארבעתן אינו מברך כ״א ברכה אחת לכולן (משנה ברורה, מ״ב רי״ט:ג). On the minor and the woman: עוד כתבו דקטן אינו מחוייב להודות (משנה ברורה, מ״ב רי״ט:ג), and וגם נשים מנהג העולם שאין מברכין ברכה זו וכתבו האחרונים הטעם משום דסדר ברכה זו הוא בפני עשרה וכדלקמיה ולא אורח ארעא לאשה (משנה ברורה, מ״ב רי״ט:ג); but ויש שכתבו דמ״מ נכון הוא שתברך בפני עשרה עכ״פ בפני נשים ואיש אחד (משנה ברורה, מ״ב רי״ט:ג). The Aruch haShulchan is blunter: וקטן אין לו לברך ברכה זו, ונשים נהגו שלא לברך, ואין בזה שום טעם (ערוך השלחן או״ח סימן רי״ט). summary: one blessing covers several deliverances that fall together; as for women, the widespread custom of abstaining rests on the public setting, and several authorities hold it better to bless. In practice, follow your Rav.

B. נוסח הברכה — the wording of the blessing

הַגּוֹמֵל לְחַיָּבִים טוֹבוֹת — “who bestows good upon the indebted”. The Beit Yosef unfolds the wording word by word: כלומר אפי׳ לאותם שהם חייבים דהיינו שהם רשעים דתרגום רשע חייבא עכ״ז גומל להם טובות וגם אני כאחד מהם שאף על פי שאיני הגון גמלני בכל טוב (בית יוסף או״ח סימן רי״ט). The one just saved therefore does not present himself as a righteous man rewarded, but as someone who received more than was owed him.

Seif 2 — ומה מברך

ומה מברך בא״י אמ״ה הגומל לחייבים טובות שגמלני כל טוב והשומעים אומרים מי שגמלך כל טוב הוא יגמלך כל טוב סלה:
Seif 2: and what does he bless? “Blessed are You, Hashem our G-d, King of the universe, who bestows good upon the indebted, who has bestowed upon me every good.” And those who hear say: “May He who bestowed upon you every good bestow upon you every good, selah.”
The wording, and its version in the Gemara. The Gemara gives a shorter formula: מאי מברך? אמר רב יהודה: ״ברוך גומל חסדים טובים״ (ברכות נ״ד ע״ב). The Beit Yosef explains that the Mechaber followed another reading, that of the Rif, the Rambam and the Rosh; and he unfolds the difficult word: כלומר אפי׳ לאותם שהם חייבים דהיינו שהם רשעים דתרגום רשע חייבא עכ״ז גומל להם טובות וגם אני כאחד מהם שאף על פי שאיני הגון גמלני בכל טוב (בית יוסף או״ח סימן רי״ט). summary: “indebted” does not point at others but at the one blessing — he acknowledges having received what he had not earned.
The congregation’s answer is not in the Gemara. ומ״ש והשומעים אומרים אשר גמלך כל טוב וכו׳ אינו בגמרא אלא שהרמב״ם כתבו בפ״י (בית יוסף או״ח סימן רי״ט); it is indeed the Rambam’s language: וכל השומעין אומרים שגמלך טוב הוא יגמלך סלה (רמב״ם הלכות ברכות פרק י הלכה ח). And if they do not answer? ואם לא אמרו אינו מעכב (משנה ברורה, מ״ב רי״ט:ה). The Aruch haShulchan says what that answer is: וזהו כעין תנחומין וברכה לנפש שסבלה יסורין (ערוך השלחן או״ח סימן רי״ט). summary: the congregation’s reply is a consolation addressed to one who has suffered — beautiful, but not indispensable.
Standing, and without straining over the words. ונוסח זה אינו מעכב כל שאמר ענין הברכה (משנה ברורה, מ״ב רי״ט:ד), and כתב הרמב״ם המברך צריך שיהיה עומד בשעת ברכה ובדיעבד יצא אף בישיבה (משנה ברורה, מ״ב רי״ט:ד) — this is the Rambam’s language: וכיצד מודה וכיצד מברך. עומד ביניהן ומברך (רמב״ם הלכות ברכות פרק י הלכה ח). The Aruch haShulchan explains why the custom of blessing after the aliya to the Torah answers both demands at once: ומטעם זה נראה דנהגו לברך ברכה זו אחר שעולה לתורה, דאז וודאי יש בין העשרה איזה לומדים והוא מעומד (ערוך השלחן או״ח סימן רי״ט). summary: one stands, among ten — and the wording counts by its substance, not by its letter.

C. בפני עשרה — before whom one blesses

בִּפְנֵי עֲשָׂרָה וּתְרֵי מִינַּיְיהוּ רַבָּנַן — “before ten, and two of them scholars”. This is Abaye’s statement, refined by Mar Zutra: אביי אמר: וצריך לאודויי קמי עשרה, דכתיב: ״וירוממוהו בקהל עם וגו׳״ (ברכות נ״ד ע״ב); מר זוטרא אמר: ותרין מינייהו רבנן, שנאמר: ״ובמושב זקנים יהללוהו״ (ברכות נ״ד ע״ב). The verse invoked — וירוממוהו בקהל עם ובמושב זקנים יהללוהו — is the last of that same Psalm 107 from which the four deliverances were drawn.

Seif 3 — בפני עשרה ותרי מינייהו רבנן

צריך לברך ברכה זו בפני י׳ ותרי מינייהו רבנן דכתיב וירוממוהו בקהל עם ובמושב זקנים יהללוהו ואם לא שכיחי רבנן לא יניח מלברך ונהגו לברך אחר קריאת התורה לפי שיש שם עשרה ואם בירך בפחות מעשרה יש אומרים שיצא ויש אומרים שלא יצא וטוב לחזור ולברך בפני י׳ בלא הזכרת שם ומלכות:
Seif 3: he must say this blessing before ten, and two of them scholars, for it is written: “they shall exalt Him in the assembly of the people, and in the session of elders praise Him”. And if scholars are not to be found, let him not refrain from blessing. The custom has been to bless after the reading of the Torah, since ten are present there. And if he blessed before fewer than ten — some say he has fulfilled his duty and some say he has not; and it is good to repeat the blessing before ten, without mentioning the Name and the Kingship.
Where ten, and the two scholars, come from. אביי אמר: וצריך לאודויי קמי עשרה, דכתיב: ״וירוממוהו בקהל עם וגו׳״ (ברכות נ״ד ע״ב); מר זוטרא אמר: ותרין מינייהו רבנן, שנאמר: ״ובמושב זקנים יהללוהו״ (ברכות נ״ד ע״ב). The verse invoked is the last of Psalm 107, the very psalm that supplied the four deliverances. The Mishna Berura adds two details: בפני עשרה - עם בעל הנס (משנה ברורה, מ״ב רי״ט:ו), and ואין זקן אלא מי שקנה חכמה וכתב מ״א דבעינן הני דתנו הלכתא (משנה ברורה, מ״ב רי״ט:ז). summary: ten counting the one who blesses; and “elder” does not mean aged but learned.
Ten, or twelve? The Gemara itself hesitates: מתקיף לה רב אשי: ואימא כולהו רבנן?! — מי כתיב ״בקהל זקנים״? ״בקהל עם״ כתיב. ואימא בי עשרה שאר עמא, ותרי רבנן! קשיא (ברכות נ״ד ע״ב). The Beit Yosef reports the division: והתוספות סוברים דבעינן י׳ ועוד תרי רבנן דה״ל תריסר כיון דאותיבנא לרב הונא ואסיקנא בקשיא וכ״נ שהוא דעת הרא״ש (בית יוסף או״ח סימן רי״ט), against והרי״ף והרמב״ם וסמ״ג סוברים דכיון דמידי דרבנן הוא נקטינן לקולא (בית יוסף או״ח סימן רי״ט). The Tur followed the first path: וכתבו כיון דלא אפשיטא עבדינן לחומרא ובעינן תרווייהו (טור או״ח סימן רי״ט). summary: the Gemara leaves the matter at קשיא. For Tosafot and the Rosh one rules stringently — ten, plus two scholars, that is twelve; for the Rif and the Rambam, whom the Mechaber followed, the two scholars are part of the ten.
And if there are no scholars? The Mechaber makes no obstacle of it: ואם לא שכיחי רבנן לא יניח מלברך (שו״ע או״ח רי״ט:ג). The Beit Yosef had the source: וכתוב בא״ח נהגו להודות אחר קריאת התורה לפי שיש שם י׳ (בית יוסף או״ח סימן רי״ט) — whence the custom written into the seif: ונהגו לברך אחר קריאת התורה לפי שיש שם עשרה (שו״ע או״ח רי״ט:ג). The Biur Halacha explains why the two scholars do not hold up the blessing: ולכן אף שפסקינן דבעינן תרי רבנן אעפ״כ אי לא שכיחי רבנן מסתברא שאינו מעכב (ביאור הלכה סימן רי״ט). summary: the quorum is the condition; the two scholars are the adornment — and the aliya to the Torah ordinarily gathers both.
If he blessed without ten: has he fulfilled his duty? The Tur inferred from the word צריך that this is only an initial requirement: ואם בירך אפילו בפחות מי׳ א״צ לחזור ולברך דלישנא וצריך לאודויי באנפי י׳ משמע דוקא לכתחלה (טור או״ח סימן רי״ט). The Beit Yosef rejects the inference: זו היא סברת רבינו דדייק מלישנא דגמרא ואין הדיוק נראה בעיני דאדרבה לישנא דצריך משמע שיש עיכוב בדבר (בית יוסף או״ח סימן רי״ט), and the Turei Zahav adds an objection: וגם אני תמהתי ע״ד הטור דהא גם בעיקר חיוב ההודאה נאמר לשון צריכים דהא אמרו ד׳ צריכים להודות (ט״ז על שולחן ערוך אורח חיים, סימן רי״ט). The Mechaber therefore leaves both views standing and concludes gently: ואם בירך בפחות מעשרה יש אומרים שיצא ויש אומרים שלא יצא וטוב לחזור ולברך בפני י׳ בלא הזכרת שם ומלכות (שו״ע או״ח רי״ט:ג) — בלא הזכרת שם ומלכות - משום דספק ברכות להקל (משנה ברורה, מ״ב רי״ט:ט). summary: the word “must” is also used of what is indispensable — hence the hesitation; and in doubt one does not repeat the Name.
What if he knows he will not have ten? דכל עיקר עשרה אינו אלא למצוה ולפ״ז אם יודע שלא יזדמנו לו עשרה יברך בלא עשרה אפי׳ לכתחלה (משנה ברורה, מ״ב רי״ט:ח); and conversely ועיין בהלכות הרא״ה שכתב דימתין עד שלשים יום פן יזדמן לו עשרה שיוכל לקיים המצוה כהלכתה ויותר לא ימתין (משנה ברורה, מ״ב רי״ט:ח). The Biur Halacha warns: ואמנם לכתחלה יש ליזהר שלא לברך בלא עשרה אפילו דרך שבח והודאה (ביאור הלכה סימן רי״ט). summary: on the first view he blesses without waiting; on the cautious view he waits for a minyan — up to thirty days, and no longer. In practice, follow your Rav.

Seif 4 — אם בירך אחר, and the gloss

אם בירך אחר ואמר בא״י אמ״ה אשר גמלך כל טוב וענה אמן יצא וכן אם אמר בריך רחמנא מלכא דעלמא דיהבך לן וענה אמן יצא: הגה ואין זה ברכה לבטלה מן המברך אע״פ שלא נתחייב בברכה זו הואיל ואינו מברך רק דרך שבח והודאה על טובת חבירו שמשמח בה: (טור)
Seif 4: if another blessed and said “Blessed are You, Hashem our G-d, King of the universe, who bestowed upon you every good”, and this one answered Amen — he has fulfilled his duty. Likewise if he said “Blessed is the Merciful One, King of the universe, who has given you back to us”, and he answered Amen — he has fulfilled his duty. Gloss: and this is no blessing in vain on the part of the one who blesses, although he was not obligated in this blessing, since he blesses only by way of praise and thanksgiving over the good done to his fellow, in which he rejoices (Tur).
The story from which the seif comes. רב יהודה חלש ואתפח. על לגביה רב חנא בגדתאה ורבנן. אמרי ליה: ״בריך רחמנא דיהבך ניהלן ולא יהבך לעפרא״. אמר להו: פטרתון יתי מלאודויי (ברכות נ״ד ע״ב), and the Gemara then asks how that discharged him: והא אמר אביי בעי אודויי באפי עשרה! — דהוו בי עשרה. והא איהו לא קא מודה! — לא צריך, דעני בתרייהו ״אמן״ (ברכות נ״ד ע״ב). summary: Rav Yehuda, healed, is discharged by his students’ blessing — because they were ten and because he answered Amen.
Why the Amen is indispensable here. ואי לא ענה אמן לא יצא ומיירי ששמע הברכה מתחלתה ועד סופה וכוון נמי לצאת בה ידי חובת ברכת הגומל שנתחייב (משנה ברורה, מ״ב רי״ט:יא). The Tur gives the reason in the name of the Rosh: ולא חשיב ברכה לבטלה כיון שהם לא נתחייבו בה שהם נתנו שבח והודאה למקום כדרך בני אדם שמשבחים למקום על הטובה שמזמין להם (טור או״ח סימן רי״ט). summary: elsewhere “one who hears is as one who says” and the Amen is not required; here the one blessing was under no obligation himself — so it is the Amen that makes the blessing his own.
The Rama’s gloss, and the Acharonim’s reservation. ואין זה ברכה לבטלה מן המברך אע״פ שלא נתחייב בברכה זו הואיל ואינו מברך רק דרך שבח והודאה על טובת חבירו שמשמח בה (רמ״א או״ח רי״ט:ד). The Magen Avraham reads it as a broad permission: משמע דס״ל דכל מי ששמח בו רשאי לברך וכ״ש על אשתו שילדה (מגן אברהם או״ח סימן רי״ט), and the Mishna Berura describes the custom: וכ״ש על אשתו שהיא כגופו דרשאי לברך ומזה נוהגים קצת אנשים שכשיולדות נשותיהם וחוזרות לבורין עומדים ומברכים ברכת הגומל (משנה ברורה, מ״ב רי״ט:יז), with the wording to say: ונוסח הברכה יאמר הגומל לחייבים טובות שגמלך כל טוב (משנה ברורה, מ״ב רי״ט:יז). But the Beit Yosef opposed it: ולענין הלכה כיון דלדברי הכל אינו חייב לברך לא יברך ואם בירך גוערין בו דדילמא ברכה לבטלה היא (בית יוסף או״ח סימן רי״ט), the Turei Zahav sets a condition of the heart: משמע דוקא ששמח בלבו על שזה נתרפא או ניצול אבל אם אינו שמח בלבו כ״כ אלא שאומר כן מפני השלום (ט״ז על שולחן ערוך אורח חיים, סימן רי״ט), and concedes: ועל אביו ועל רבו מותר לכ״ע לברך על רפואתו דבזה גם הרשב״א מודה (ט״ז על שולחן ערוך אורח חיים, סימן רי״ט). The Biur Halacha concludes: וע״כ נראה דבלא אביו ורבו אינו נכון לברך אפילו באב על בנו וכדומה (ביאור הלכה סימן רי״ט), and the Mishna Berura likewise: וע״כ מהנכון ליזהר לכתחלה שלא לברך ברכת הגומל אפילו על קרובו ואוהבו כ״א על אביו ורבו לבד (משנה ברורה, מ״ב רי״ט:יח). summary: blessing for another presupposes real joy; custom extended it to a wife who has given birth, but the Acharonim advise keeping to one’s father and one’s teacher. In practice, follow your Rav.

Seif 5 — נתכוין להוציא את חבירו

אם בירך אחד הגומל לעצמו ונתכוין להוציא את חבירו ושמע חבירו וכוון לצאת יצא אפילו בלא עניית אמן: (כיון שהמברך גם כן חייב יצא האחר בלא עניית אמן) (טור):
Seif 5: if one blessed haGomel for himself and intended to discharge his fellow, and his fellow heard and intended to be discharged — he has fulfilled his duty, even without answering Amen. (Since the one who blesses is himself obligated, the other is discharged without answering Amen.) (Tur).
The exact difference from the previous seif. כיון שהמברך גם כן חייב יצא האחר בלא עניית אמן (שו״ע או״ח רי״ט:ה). The Aruch haShulchan sets the two seifim face to face: ואינו דומה להדין הקודם שיצא גם בלא ׳אמן׳ לפי שהמברך נתחייב בה, מה שאין כן כאן שמברך בעדו בהכרח שיענה ׳אמן׳ (ערוך השלחן או״ח סימן רי״ט), and the Beit Yosef had already brought Rabbenu Yona: וכתב ה״ר יונה על האי עובדא למדנו מכאן שאם יש שם י׳ וברכו ברכה זו וענה החולה אמן א״צ לברך ברכה אחרת ואם אין שם י׳ צריך לברך (בית יוסף או״ח סימן רי״ט). summary: two people equally obligated, one blessing and the other listening — the ordinary rule applies, and the Amen becomes optional.
The two intentions. The Mishna Berura sets the condition on both sides: וה״ה דלכתחלה יכול לפטור עצמו בכך. ודוקא שיש שם עשרה הא אי ליכא עשרה בודאי אין לו לכוין לפטור עצמו (משנה ברורה, מ״ב רי״ט:יב). The Magen Avraham shows what hangs on it: כלומר דאם הוי ברכה לבטלה לא יצא חבירו בברכתו (מגן אברהם או״ח סימן רי״ט). summary: the first must intend to discharge and the second to be discharged; and one relies on this route only where there are indeed ten.

D. זמן הברכה — when to bless

תַּשְׁלוּמִין — “making up”. The word says the blessing is not lost if it was not said at once. The Tur already wrote: ואם איחר מלברך יש לו תשלום לברך כ״ז שירצ׳ (טור או״ח סימן רי״ט); yet the Beit Yosef reported a received limit in the name of the Ramban: אבל בא״ח כתוב בשם רמב״ן דעד ג׳ ימים מברכין (בית יוסף או״ח סימן רי״ט).

Seif 6 — אם איחר, יש לו תשלומין

אם איחר יש לו תשלומין לברך כל זמן שירצה ונכון שלא לאחר שלשה ימים:
Seif 6: if he delayed, he has a make-up and may bless whenever he wishes; and it is right not to put it off beyond three days.
An unlimited make-up, and a customary limit. The Tur wrote: ואם איחר מלברך יש לו תשלום לברך כ״ז שירצ׳ (טור או״ח סימן רי״ט), and the Beit Yosef reported the measure received in the name of the Ramban: אבל בא״ח כתוב בשם רמב״ן דעד ג׳ ימים מברכין (בית יוסף או״ח סימן רי״ט). The Mishna Berura gives the reason for the three days: דעד זמן זה קרוי בא מן הדרך (משנה ברורה, מ״ב רי״ט:כ). summary: the blessing is not lost; but after three days one is no longer “coming from the road”, and the impulse of thanksgiving has cooled.
When the minyan and the three days pull against each other. ר״ל שלא בירך בשעה שעלה מן הים או בשעה שחזר לבוריו ממחלתו (משנה ברורה, מ״ב רי״ט:יט), and here is the concrete case: אעפ״כ אל יאחר יותר משלשה ימים כגון אם יצא ביום ב׳ לאחר שכבר קראו יברך בעשרה בלא ס״ת ואל ימתין עד יום ה׳ (משנה ברורה, מ״ב רי״ט:כ). The Aruch haShulchan sums up and adds a caveat: וכבר כתבנו שלא להתעכב בברכה זו יותר מג׳ ימים, אמנם בדיעבד אם איחר יש לו תשלומין כל זמן שירצה (ערוך השלחן או״ח סימן רי״ט), yet ונראה לי דאם הפליג זמן רב עד שנשכח העניין, אין לו לברך עוד ואבד הברכה (ערוך השלחן או״ח סימן רי״ט). summary: better to bless before ten without a Sefer Torah than to wait for the next Monday or Thursday. In practice, follow your Rav.

E. גדרי הסכנה — how far danger reaches

בְּחֶזְקַת סַכָּנָה — “presumed dangerous”. The whole divergence of seifim 7 and 8 turns on the reach of that presumption: is a discernible danger required, or is it enough that the situation generally carries one? The Tur had already set the two readings against each other for illness: וכן לענין חולה כתב הר״ר יוסף דוקא חולה שנפל למטה אבל חש בראשו או במעיו א״צ לברך (טור או״ח סימן רי״ט), against אבל הרמב״ם ז״ל כתב דבכל דרך ובכל חולי צריך להודות (טור או״ח סימן רי״ט).

Seif 7 — באשכנז וצרפת, ובספרד

באשכנז וצרפת אין מברכין כשהולכין מעיר לעיר שלא חייבו אלא בהולכי מדברות דשכיחי ביה חיות רעות ולסטים ובספרד נוהגים לברך מפני שכל הדרכים בחזקת סכנה ומיהו בפחות מפרסה אינו מברך ואם הוא מקום מוחזק בסכנה ביותר אפי׳ בפחות מפרסה:
Seif 7: in Ashkenaz and France they do not bless when going from town to town, since the obligation was laid only upon those who travel the deserts, where wild beasts and brigands are commonly found. In Sefarad the custom is to bless, because all roads are presumed dangerous. However, for less than a parsa one does not bless; and if the place is particularly known to be dangerous, even for less than a parsa.
Two customs, one underlying divergence. The Tur gives the northern custom and its reason: אבל ברכת הגומל במקום תודה איתקן (טור או״ח סימן רי״ט). The Beit Yosef gives the southern one: כתב הרד״א עתה נהגו העולם לברך ברכת הגומל ואפילו כשהולכים מעיר לעיר (בית יוסף או״ח סימן רי״ט). The Mishna Berura shows where the divergence lies: דס״ל דברכה זו שוה לענין ברכת תפלת הדרך לעיל בסימן ק״י עי״ש (משנה ברורה, מ״ב רי״ט:כב). summary: on the Sephardic custom, haGomel is measured like the traveller’s prayer — every road falls under it; on the Ashkenazi custom, only a truly perilous road obligates.
The measure of a parsa. ומיהו בפחות מפרסה אינו מברך ואם הוא מקום מוחזק בסכנה ביותר אפי׳ בפחות מפרסה (שו״ע או״ח רי״ט:ז); the Beit Yosef gives the source: ולענין הלכה נראה דפחות מפרסה אינו מברך הגומל כדברי בה״ג לענין תפלת הדרך (בית יוסף או״ח סימן רי״ט), and the Mishna Berura the reason: דבמקום קרוב כזה בודאי לאו בחזקת סכנה הוא (משנה ברורה, מ״ב רי״ט:כג). The Turei Zahav draws a consequence for the traveller’s prayer: דהא כתב הטור במילתא אחרית׳ דבתפל׳ הדרך צריך אדם לבקש רחמי׳ טפי מברכ׳ הגומל לפי שברכת הגומל היא במקום תודה (ט״ז על שולחן ערוך אורח חיים, סימן רי״ט). summary: under a parsa there is no “road”; beyond it, or in a notoriously dangerous place, there is — and the Turei Zahav notes in passing that haGomel is more demanding than the traveller’s prayer, since it stands in place of a thanksgiving offering.
And in our own day? the Aruch haShulchan wrote in his day that the blessing no longer applies אפילו בנסיעות רחוקות, אם לא דרך הים ומדבריות (ערוך השלחן או״ח סימן רי״ט), and that ורק תפלת הדרך שבסימן ק״י יש חיוב לאומרה בכל מקום (ערוך השלחן או״ח סימן רי״ט). The Biur Halacha recalls in the other direction a rule that does not change: ודע עוד דפשוט דלכו״ע בין בים ובין במדבר מברכין אפילו לא קרה לו שום סכנה (ביאור הלכה סימן רי״ט), אלא כיון שעלול לו לקרות מקרים כאלה צריך לאודויי שניצל מזה (ביאור הלכה סימן רי״ט). summary: one does not bless because a mishap occurred, but because one was exposed to its occurring; what remains is to know which roads still are. In practice, follow your Rav.

Seif 8 — בכל חולי, and the gloss

בכל חולי צריך לברך אפילו אינו חולי של סכנה ולא מכה של חלל אלא כל שעלה למטה וירד מפני שדומה כמי שהעלוהו לגרדום (פי׳ מעלות שעושין דיינים לשבת כשדנין) לידון אין הפרש בין שיש לו מיחוש קבוע ובא מזמן לזמן ובין שאינו קבוע: הגה ויש אומרים דאינו מברך רק על חולי שיש בו סכנה כגון מכה של חלל (טור בשם הראב״ד והר״ר יוסף וכן נוהגין באשכנז):
Seif 8: for any illness one must bless, even if it is not an illness with danger, nor an internal wound, but so long as he took to his bed and got up again — because he resembles one brought up on the platform (explanation: the steps judges set up to sit on when they judge) to be judged. And there is no difference between one who has a fixed ailment that returns from time to time and one whose ailment is not fixed. Gloss: and some say that he blesses only over an illness that carries danger, such as an internal wound (Tur in the name of the Raavad and Rabbi Yosef; and such is the custom in Ashkenaz).
The image of the platform. בכל חולי צריך לברך אפילו אינו חולי של סכנה ולא מכה של חלל אלא כל שעלה למטה וירד מפני שדומה כמי שהעלוהו לגרדום (שו״ע או״ח רי״ט:ח). The Mishna Berura unfolds the comparison: שאין אנו יודעים איך יצא דינו כמו כן בחולה כיון שנפל למשכב אין אנו יודעים סופו שכמה פעמים אע״פ שתחלתו לא היה סכנה לבסוף מתגברת המחלה ובא לידי סכנה (משנה ברורה, מ״ב רי״ט:כה). The Beit Yosef had the source: דלאו דוקא בחולי שיש בו סכנה ולא במכה של חלל דוקא אלא כל שעלה למטה וירד צריך להודות שדומה כמי שהעלוהו לגרדום לידון (בית יוסף או״ח סימן רי״ט). summary: one who takes to his bed does not know how his trial will end — that is what makes his recovery a deliverance, not the physician’s prognosis.
But he must have taken to his bed. אבל אם לא עלה למטה כלל רק שיש לו איזה מיחוש בעלמא בראשו או בגרונו וכה״ג אינו מברך אפילו לדעה זו (משנה ברורה, מ״ב רי״ט:כד); and אלא בכל גוונא כל שעלה למטה מחמתו בזמן שחשש בו חייב לברך אח״כ (משנה ברורה, מ״ב רי״ט:כז). On the chronic ailment, the Magen Avraham: ואף על פי שפעמי׳ רבות נתרפא ממנו מ״מ לאו בכל יומא מתרחיש ניסא (מגן אברהם או״ח סימן רי״ט), and the Mishna Berura in the name of the Rashba: ואדרבה כל שהוא קבוע הוא יותר מתחזק ואע״פ שנעשה לו נס פעמים רבות וניצול ממנו מן השמים רחמוהו ולאו כל שעתא מתרחיש ניסא (משנה ברורה, מ״ב רי״ט:כו). summary: a headache is not enough; but familiarity with an ailment does not make it harmless — on the contrary, one is not owed a miracle every time.
The gloss, and what it means. ויש אומרים דאינו מברך רק על חולי שיש בו סכנה כגון מכה של חלל (רמ״א או״ח רי״ט:ח); the Mishna Berura widens it: או שאר חולי שיש בו סכנה כגון קדחת של כל הגוף (משנה ברורה, מ״ב רי״ט:כח), and reports that the custom is not uniform: וכתב המ״א דקצת נוהגין כסברת המחבר וכן דעת הא״ר לדינא (משנה ברורה, מ״ב רי״ט:כח). The Turei Zahav proposes a measure of time: וה״ה בחולה שמוטל במטה יותר מג׳ ימים כנ״ל דהא צריך לבקשת רחמים מאחרים (ט״ז על שולחן ערוך אורח חיים, סימן רי״ט), taken up by the Aruch haShulchan: וכן החולה שמוטל במטה יותר מג׳ ימים צריך לברך (ערוך השלחן או״ח סימן רי״ט). summary: on the gloss a real danger is needed; on the Turei Zahav’s measure, three days in bed amount to danger, because then others are asked to pray for him. In practice, follow your Rav.

F. הני ארבעה לאו דוקא — is the list closed?

לָאו דַּוְקָא — “not strictly”. The last seif asks the question every closed list invites: are the four a definition or examples? The Rivash, quoted by the Beit Yosef, decides by an a fortiori argument: תשובה נראה שצריך לברך שהרי הולכי מדברות שצריכים להודות זהו מפני סכנת אריה וגנבים המצוים בדרכים (בית יוסף או״ח סימן רי״ט).

Seif 9 — הני ארבעה לאו דוקא

הני ארבעה לאו דוקא דה״ה למי שנעשה לו נס כגון שנפל עליו כותל או ניצול מדריסת שור ונגיחותיו או שעמד עליו בעיר אריה לטרפו או אם גנבים באו לו אם שודדי לילה וניצל מהם וכל כיוצא בזה כלם צריכים לברך הגומל: ויש אומרים שאין מברכין הגומל אלא הני ארבעה דוקא וטוב לברך בלא הזכרת שם ומלכות:
Seif 9: these four are not strictly exclusive, for the same applies to one for whom a miracle occurred — for example if a wall fell upon him, or he was saved from being trampled by an ox and from its goring, or a lion stood over him in the city to tear him apart, or thieves came upon him, or night robbers, and he was saved from them — all of these must bless haGomel. And some say that haGomel is blessed only over these four specifically, and it is good to bless without mentioning the Name and the Kingship.
The Rivash’s argument: the four are examples. תשובה נראה שצריך לברך שהרי הולכי מדברות שצריכים להודות זהו מפני סכנת אריה וגנבים המצוים בדרכים (בית יוסף או״ח סימן רי״ט), and he adds: ולא הוזכרו הד׳ בכתוב אלא מפני שהם מצוים תמיד בדרך מנהגו של עולם ברוב האנשים (בית יוסף או״ח סימן רי״ט). The Vilna Gaon says it in three words: ס״ט הני כו׳. שהרי סכנות מדברות הוא מפני אריה וגנבי (ביאור הגר״א על שולחן ערוך אורח חיים סימן רי״ט). summary: if one gives thanks on leaving the desert, it is because of the lions and the brigands — so lion and brigand obligate anywhere, and the list of four was only a description of what happens most often.
The opposing view, and its answer. ויש אומרים שאין מברכין הגומל אלא הני ארבעה דוקא וטוב לברך בלא הזכרת שם ומלכות (שו״ע או״ח רי״ט:ט); its source is in the Beit Yosef: י״א שד׳ בלבד צריכין להודות אבל אחרים שבירכו הויא ברכה לבטלה (בית יוסף או״ח סימן רי״ט), וכן פסק ה״ר שם טוב פלכו בשם התוס׳ דאלו הד׳ דוקא (בית יוסף או״ח סימן רי״ט). The Mishna Berura gives the reasoning: משום שמצויים ביותר תקנו עליהם ברכת הגומל משא״כ אינך שאינם שכיחים כלל אין לברך עליהם הגומל (משנה ברורה, מ״ב רי״ט:לא), and the Vilna Gaon likewise: וי״א כו׳. מדנקט הני דוקא וס׳ הראשונה ס״ל דנקט הני מפני שהן מצויין יותר ברוב (ביאור הגר״א על שולחן ערוך אורח חיים סימן רי״ט). summary: it was not the gravest dangers that were listed but the commonest — and a rabbinic enactment does not stretch past what it was enacted for; for the rest there is the blessing over a miracle.
What custom has done. והאחרונים כתבו דהמנהג כסברא ראשונה וכן מסתבר (משנה ברורה, מ״ב רי״ט:לב); the Turei Zahav the same way: אבל ראיתי נוהגין הרבה כסברא ראשונ׳ שהיא דעת ריב״ש ומסתבר כן דכל סכנות נכללו בהולכי מדבר דנקט בגמרא (ט״ז על שולחן ערוך אורח חיים, סימן רי״ט), the Magen Avraham too: ועכשיו נהגו לברך כל מי שנעשה לו נס וכ״כ בלבוש (מגן אברהם או״ח סימן רי״ט), and the Aruch haShulchan rules: והאחרונים כתבו שיש לברך על כל דבר סכנה כשניצול הימנה, וכן המנהג הפשוט ואין לשנות (ערוך השלחן או״ח סימן רי״ט) — after observing that the middle course is no course at all: ובאמת בלא הזכרת שם ומלכות אינה ברכה כלל (ערוך השלחן או״ח סימן רי״ט). And the Mishna Berura adds the case on which all agree: ומי שהלך בדרך אפילו שלא במקום סכנה ובאו עליו לסטים להרגו וניצול לכו״ע מברך ברכת הגומל (משנה ברורה, מ״ב רי״ט:לא); as well as the complement: ואעפ״כ כשיגיע למקום שנעשה בו הנס יברך גם שעשה לי נס במקום הזה (משנה ברורה, מ״ב רי״ט:ל). summary: the widespread custom follows the first view and blesses over every deliverance; and when one passes again by the place of the danger, one adds the blessing over the miracle. In practice, follow your Rav.
The siman in one sentence: whoever comes out of one of the four distresses of Psalm 107 — the sea, the desert, illness, prison — stands before ten people and publicly acknowledges having received more than was owed him: הגומל לחייבים טובות שגמלני כל טוב; and the whole discussion of the siman concerns the edges of that obligation — the time limit, the degree of danger, and the deliverances the list of four did not name.

Practical cases

Case 1 — I am back from a long flight

Situation: I have returned from a ten-hour flight. Must I say haGomel?
Conduct: It depends on the custom one follows and on how the flight is classed. Seif 7 sets the two traditions against each other: באשכנז וצרפת אין מברכין כשהולכין מעיר לעיר שלא חייבו אלא בהולכי מדברות דשכיחי ביה חיות רעות ולסטים (שו״ע או״ח רי״ט:ז), against ובספרד נוהגים לברך מפני שכל הדרכים בחזקת סכנה (שו״ע או״ח רי״ט:ז). The Mishna Berura shows the logic of the second: דס״ל דברכה זו שוה לענין ברכת תפלת הדרך לעיל בסימן ק״י עי״ש (משנה ברורה, מ״ב רי״ט:כב). The Aruch haShulchan wrote in his day that the blessing no longer holds אפילו בנסיעות רחוקות, אם לא דרך הים ומדבריות (ערוך השלחן או״ח סימן רי״ט). And the Biur Halacha recalls that one does not bless because an incident occurred: ודע עוד דפשוט דלכו״ע בין בים ובין במדבר מברכין אפילו לא קרה לו שום סכנה (ביאור הלכה סימן רי״ט). summary: the question is not “was I afraid?” but “does this road belong to those presumed dangerous?” — and the answer depends on one’s community’s custom. Case 2 — I have come out of hospital

Situation: I spent four days in bed with an infection that carried no danger, and I am better. Should I bless?
Conduct: The Mechaber says yes: בכל חולי צריך לברך אפילו אינו חולי של סכנה ולא מכה של חלל אלא כל שעלה למטה וירד מפני שדומה כמי שהעלוהו לגרדום (שו״ע או״ח רי״ט:ח); the Rama’s gloss asks for more: ויש אומרים דאינו מברך רק על חולי שיש בו סכנה כגון מכה של חלל (רמ״א או״ח רי״ט:ח). But the Mishna Berura first sets the common condition: אבל אם לא עלה למטה כלל רק שיש לו איזה מיחוש בעלמא בראשו או בגרונו וכה״ג אינו מברך אפילו לדעה זו (משנה ברורה, מ״ב רי״ט:כד); and the Turei Zahav gives a measure that brings the two views closer: וה״ה בחולה שמוטל במטה יותר מג׳ ימים כנ״ל דהא צריך לבקשת רחמים מאחרים (ט״ז על שולחן ערוך אורח חיים, סימן רי״ט). Finally, one blesses only once restored: ונתרפא - והולך כבר על בוריו (משנה ברורה, מ״ב רי״ט:ב). summary: taking to one’s bed is the minimum condition; beyond it, the Ashkenazi custom asks for a real danger, which three days in bed may constitute. In practice, follow your Rav.

Case 3 — My wife has just given birth: do I bless?

Situation: My wife has given birth and is well. May I say haGomel for her?
Conduct: This is exactly the case the gloss builds on: ואין זה ברכה לבטלה מן המברך אע״פ שלא נתחייב בברכה זו הואיל ואינו מברך רק דרך שבח והודאה על טובת חבירו שמשמח בה (רמ״א או״ח רי״ט:ד), and the Mishna Berura describes it: וכ״ש על אשתו שהיא כגופו דרשאי לברך ומזה נוהגים קצת אנשים שכשיולדות נשותיהם וחוזרות לבורין עומדים ומברכים ברכת הגומל (משנה ברורה, מ״ב רי״ט:יז), with the wording: ונוסח הברכה יאמר הגומל לחייבים טובות שגמלך כל טוב (משנה ברורה, מ״ב רי״ט:יז) — and she must answer Amen: ואי לא ענה אמן לא יצא ומיירי ששמע הברכה מתחלתה ועד סופה וכוון נמי לצאת בה ידי חובת ברכת הגומל שנתחייב (משנה ברורה, מ״ב רי״ט:יא). The Beit Yosef nevertheless opposed it: ולענין הלכה כיון דלדברי הכל אינו חייב לברך לא יברך ואם בירך גוערין בו דדילמא ברכה לבטלה היא (בית יוסף או״ח סימן רי״ט), and the Mishna Berura concludes: וע״כ מהנכון ליזהר לכתחלה שלא לברך ברכת הגומל אפילו על קרובו ואוהבו כ״א על אביו ורבו לבד (משנה ברורה, מ״ב רי״ט:יח). The Aruch haShulchan attests to the same division: וקטן אין לו לברך ברכה זו, ונשים נהגו שלא לברך, ואין בזה שום טעם (ערוך השלחן או״ח סימן רי״ט). summary: the custom exists and has solid support, but several Acharonim prefer that the woman bless for herself before ten. In practice, follow your Rav.
