The preceding siman settled particular blessings; this one gathers a whole family: what is said over what returns and over what astonishes. Ten seifim, four formulas, and a single question governing them all — what is new to the one who is looking? Hebrew text, English translation and explanation of the י׳ seifim, with a section of practical cases.

Four formulas, and a single question to divide them: what is new here? A beloved face unseen for thirty days — שהחיינו; after twelve months — מחיה מתים. Fruit that comes only once a year — שהחיינו again. An unusual creature — משנה הבריות, or דיין האמת if the change came after birth. And before beauty — שככה לו בעולמו. We study here at the level of principle; for personal practice, one follows one’s Rav.

A. ראיית חבירו — seeing a face again

רְאִיַּת חֲבֵרוֹseeing one’s fellow. The siman opens not on a thing but on a face. The Gemara sets both thresholds in a single sentence: « אמר רבי יהושע בן לוי: הרואה את חבירו לאחר שלשים יום, אומר: ״ברוך … שהחיינו וקיימנו והגיענו לזמן הזה״. לאחר שנים עשר חדש, אומר: ״ברוך … מחיה המתים״. » (ברכות נ״ח ע״ב). And the Rambam repeats them in the same order: « וכן הרואה את חברו לאחר שלשים יום מברך שהחינו » (רמב״ם הלכות ברכות פרק י הלכה ב).

Seif 1 — לאחר שלשים יום, ולאחר י״ב חודש

הרואה את חבירו לאחר שלשים יום אומר שהחיינו ואחר י״ב חודש מברך מחיה מתים והוא שחביב עליו הרבה ושמח בראייתו:
Seif 1: one who sees his fellow after thirty days says “Shehecheyanu”; and after twelve months he blesses “Mechayeh metim”. And this applies when he is very dear to him and he rejoices at seeing him.
Why twelve months. The Gemara supplies the measure immediately afterwards: « אמר רב: אין המת משתכח מן הלב אלא לאחר שנים עשר חדש. שנאמר: ״נשכחתי כמת מלב הייתי ככלי אובד״. » (ברכות נ״ח ע״ב); and the Aruch HaShulchan ties it explicitly to our seif: « ושיעורא די״ב חדש נראה משום דאין המת משתכח מן הלב עד י״ב חדש » (ערוך השלחן או״ח סימן רכ״ה). summary : thirty days measure an absence, twelve months measure a forgetting — which is why the second formula no longer speaks of time granted but of the dead who live again
Which “fellow” is meant? « ואין חילוק בין איש לאשה והיינו אם רואה אשתו ואמו בתו ואחותו כיון שהוא שמח ונהנה בראייתם » (משנה ברורה, מ״ב רכ״ה:א); and the Aruch HaShulchan likewise: « ואין חילוק בדין זה בין זכרים לנקבות, ורק אם שמח מאוד בראייתם » (ערוך השלחן או״ח סימן רכ״ה). summary : the word חבירו is limited neither by sex nor by friendship in the narrow sense: the measure is the real gladness of the one who sees
These are full blessings. « וכל אלו הברכות הוא בשם ומלכות ואפילו ברכת מחיה מתים » (משנה ברורה, מ״ב רכ״ה:ג). summary : they are said with the Name and Kingship — including מחיה מתים, which one might have taken for a mere exclamation
Why “who revives the dead”. « וטעם ברכה זו כתב בחידושי אגדות לפי שבכל שנה האדם נידון בר״ה ויוה״כ אם למות אם לחיים » (משנה ברורה, מ״ב רכ״ה:ד). summary : twelve months mean a Rosh Hashanah and a Yom Kippur passed through; the man now seen has come through the judgment of life and death, and the formula says so
And if news of him had come meanwhile? « ואם קיבל ממנו כתב או שאנשים הודיעוהו משלומו יש דעות באחרונים וספק ברכות להקל » (משנה ברורה, מ״ב רכ״ה:ב). summary : a letter received in the interval throws the blessing into doubt, and a doubt about a blessing is resolved by refraining
The Tur’s wording, almost the Mechaber’s. « הרואה חבירו לאחר ל׳ יום אומר שהחיינו ואחר י״ב חדש מברך מחיה המתים והוא שחביב עליו הרבה ושמח מאד בראייתו » (טור או״ח סימן רכ״ה). summary : the Mechaber followed the Tur very closely; he only dropped the word מאד, writing ושמח בראייתו

Seif 2 — מי שלא ראה את חבירו מעולם

מי שלא ראה את חבירו מעולם ושלח לו כתבים אע״פ שהוא נהנה בראייתו אינו מברך על ראייתו: הגה יש אומרים מי שנעשה בנו בר מצוה יברך בא״י אמ״ה שפטרני מעונשו של זה (מהרי״ל בשם מרדכי ובר״ר פ׳ תולדות) וטוב לברך בלא שם ומלכות (דעת עצמו):
Seif 2: one who has never seen his fellow and has sent him letters — although he takes pleasure in seeing him, he does not bless upon seeing him. Gloss of the Rama: some say that one whose son becomes bar mitzvah blesses “Blessed are You, Hashem our God, King of the universe, who has exempted me from the punishment of this one” (Maharil in the name of the Mordechai and Bereshit Rabbah, parashat Toldot); and it is good to bless without the Name and Kingship (the Rama’s own view).
Why one never seen does not count. « ר״ל אע״פ שהריצו כתבים מזה לזה ועי״ז נעשו אוהבים מ״מ כיון שלא נתחבר עמו פנים אל פנים אין מעולה האהבה כ״כ עד שיהיה נהנה ושמח בראייתו » (משנה ברורה, מ״ב רכ״ה:ה); the Magen Avraham said it in five words: « דכיון דלא ראה אינו אוהבו כ״כ » (מגן אברהם או״ח סימן רכ״ה); and the Aruch HaShulchan repeats it: « ומי שלא ראהו מעולם אף על פי שידע ממנו, כגון ששלח לו מכתבים ונהנה בראייתו, מכל מקום אינו מברך על ראייתו » (ערוך השלחן או״ח סימן רכ״ה). summary : the blessing follows an affection tested face to face; a correspondence, however warm, does not suffice
The father’s blessing on the day of the bar mitzvah. The Rama adds it here, and the Mishnah Berurah fixes its moment: « היינו כשנעשה בן י״ג ויום אחד ועכשיו נהגו שלא לברך עד שעה שהנער מתפלל בצבור בתורת ש״ץ או שהוא קורא בתורה בשבת ראשונה שאז נודע לרבים שהוא בר מצוה » (משנה ברורה, מ״ב רכ״ה:ו). It also gives its sense: « פי׳ דעד עכשיו נענש האב כשחטא הבן בשביל שלא חנכו למצות התורה ועכשיו שנעשה איש מחוייב הוא להתחזק בעצמו למצות הש״י » (משנה ברורה, מ״ב רכ״ה:ז). summary : the father ceases to be answerable for the sins of a son he failed to train; that is what he declares himself free of, not of his son
With the Name or without? The Rama writes וטוב לברך בלא שם ומלכות; the Mishnah Berurah gives the reason and the contrary view: « אמנם דעת הגר״א בביאורו דמאחר שהוזכרה ברכה זו במדרש ומהרי״ל עשה כן הלכה למעשה יש לברך בשם ומלכות » (משנה ברורה, מ״ב רכ״ה:ח). summary : the blessing is not found in the Gemara — hence the Rama’s caution; but the Vilna Gaon finds it in the Midrash and says it in full
And the meal of that day. « מצוה על האדם לעשות סעודה ביום שנעשה בנו בר מצוה כיום שנכנס לחופה » (משנה ברורה, מ״ב רכ״ה:ו). summary : the bar mitzvah meal is a seudat mitzvah, no less than a wedding feast

B. פרי חדש — the new fruit

פְּרִי הַמִּתְחַדֵּשׁ מִשָּׁנָה לְשָׁנָהfruit that renews itself from year to year. The Rambam places it on sight: « הרואה פרי המתחדש משנה לשנה בתחלת ראיתו מברך שהחינו » (רמב״ם הלכות ברכות פרק י הלכה ב). And the Gemara ranks it among the optional blessings, as against the blessing of the festivals: « כי אתאי בי רב יהודה, אמר: אנא אקרא חדתא נמי אמינא זמן. אמרי ליה: רשות לא קא מיבעיא לי, כי קא מיבעיא לי חובה מאי? » (עירובין מ׳ ע״ב).

Seif 3 — הרואה פרי חדש

הרואה פרי חדש מתחדש משנה לשנה מברך שהחיינו אפילו רואהו ביד חבירו או על האילן ונהגו שלא לברך עד שעת אכילה: הגה ומי שבירך בשעת ראייה לא הפסיד (טור) ואין לברך עד שנגמר תשלום גידול הפירי (תשובת רשב״א סי׳ ר״נ וכל בו) ואם לא בירך בראייה ראשונה יכול לברך בראייה שניה (אגור):
Seif 3: one who sees a new fruit that renews itself from year to year blesses “Shehecheyanu” — even if he sees it in his fellow’s hand or on the tree; and the custom has become not to bless until the moment of eating. Gloss of the Rama: and one who blessed at the time of seeing has lost nothing (Tur); and one should not bless until the fruit’s growth is entirely complete (responsum of the Rashba §250, and Kol Bo); and if he did not bless at the first sight, he may bless at the second (Agur).
What this blessing was instituted upon. « דעיקרה נתקן על שמחת הלב שמשמח על צמיחת פרי חדש » (משנה ברורה, מ״ב רכ״ה:י); and the Biur Halachah draws a consequence: « כתבו האחרונים דלברכה זו אין צריך שיעור דהיא על שמחת הלב שרואה שנגמר פרי » (ביאור הלכה סימן רכ״ה). summary : this is not a blessing of enjoyment but a blessing of gladness — hence it has no minimum measure
How custom moved it to the meal. « דמי שאין לבו שמח בראייתו רק באכילתו לכו״ע מברך רק אאכילתו ולכך נהגו תמיד בזה משום לא פלוג » (משנה ברורה, מ״ב רכ״ה:יא); the Magen Avraham had already said it: « דמי שאינו נהנה בראייתו רק באכילתו מברך באכילתו » (מגן אברהם או״ח סימן רכ״ה); and the Beit Yosef reports the custom in the name of the Rosh: « ונהגו העולם לקבוע הברכה בשעה שאוכל ממין חדש כמו שהחיינו דעשיית לולב וסוכה שקובעים בשעת קידוש היום » (בית יוסף או״ח סימן רכ״ה). summary : for many, the gladness is born only in eating; rather than split the community in two, one moment was fixed for all
Why could a custom move a blessing at all? Because it is not an obligation: « ואינה אלא רשות דאי לא מברך לא מיענש. ומ״מ ראוי ליזהר שלא לבטלה » (משנה ברורה, מ״ב רכ״ה:ט); and the Beit Yosef learns as much from the same passage: « משמע מהתם שברכת שהחיינו על פרי המתחדש אינו חובה אלא רשות וכמו שכתבתי בשם הרשב״א » (בית יוסף או״ח סימן רכ״ה). The Aruch HaShulchan notes what practice has made of it: « ומיהו בפירות חדשות קבלוה כחובה וכולם נזהרים בזה » (ערוך השלחן או״ח סימן רכ״ה). summary : optional in law, it has become in fact a practice no one forgoes — and that soft standing is what let custom set its hour
The Aruch HaShulchan explains the change of generations. « מה שאין כן אנחנו, אין השמחה והכרת טובה ניכרת אצלינו אלא בשעת הנאת הגוף בעת האכילה, ולכן אי אפשר לנו לברך על הראייה » (ערוך השלחן או״ח סימן רכ״ה). summary : the blessing has not changed its nature: it is our way of rejoicing that has moved from the eye to the palate
In what order to bless. « דלכתחלה נכון לברך שהחיינו קודם ואח״כ יברך ברכה הראויה לה » (משנה ברורה, מ״ב רכ״ה:יא); and the Aruch HaShulchan gives a second reason: « ועוד דבכל ברכת הנהנין צריך שלא יהא הפסק בין הברכה להאכילה » (ערוך השלחן או״ח סימן רכ״ה). summary : one says שהחיינו first and then the blessing on the fruit — so that nothing intervenes between it and the first bite
On what fruit. « בין פרי העץ או פרי האדמה כגון דלעת וכיו״ב » (ביאור הלכה סימן רכ״ה). summary : the rule is not confined to tree fruit: produce of the ground that comes only once a year falls under the same heading
At what ripeness. The Rama writes ואין לברך עד שנגמר תשלום גידול הפירי, and the Mishnah Berurah draws the consequence: « הכא לענין שהחיינו אין לברך עד שיהיה נגמר תשלום גידולו שיהיה טוב למאכל ואפילו בדיעבד אם בירך מקודם שנגמר ברכתו היא לבטלה » (משנה ברורה, מ״ב רכ״ה:יב). The Beit Yosef gives the source: « וכתוב בכלבו דהא דמברך שהחיינו כשרואה פרי המתחדש דוקא כשרואה אותו בתשלום ברייתו » (בית יוסף או״ח סימן רכ״ה). summary : fruit whose growth is not finished is not yet the renewal one blesses — and a blessing said too early is said in vain
And if he sees it on Shabbat? « נראה דאף אם רואה בשבת שאין יכול לתלשו ולאכלו אפ״ה יברך דבאמת כבר נגמר הפרי אלא דארי׳ הוא דרביע עלה » (ביאור הלכה סימן רכ״ה). summary : the blessing is on the completion of the fruit, not on the ability to pick it; the Shabbat prohibition changes nothing
If the first time was missed. The Rama rules: « ואם לא בירך בראייה ראשונה יכול לברך בראייה שניה » (שו״ע או״ח רכ״ה:ג); but the Mishnah Berurah clarifies how it stands for us: « ואם לא בירך בשעת אכילה ראשונה שוב לא יברך על אכילה שניה וכ״ש שלא יברך על אותה אכילה עצמה אף שעדיין לא נתעכל הפרי » (משנה ברורה, מ״ב רכ״ה:יג). summary : the Rama’s allowance concerns sight; since we bless at eating, it is the first eating that counts, and there is no making it up at the second

Seif 4 — שני מיני גודגדניות

אם בירך שהחיינו על שיריזא״ש כשיאכל גינדא״ש חוזר ומברך שהחיינו: הגה והם כשני מיני גודגדניות כגון ווינקש״ל וקירש״ן וכל כיוצא בזה:
Seif 4: if he blessed “Shehecheyanu” over shirizash, when he eats gindash he blesses “Shehecheyanu” again. Gloss of the Rama: and these are like two kinds of cherries, such as weichsel and kirschen, and anything similar.
Two varieties, two joys. « ר״ל אע״פ שכולם נכנסים תחת סוג מין אחד מ״מ כשני מינים הם לענין ברכת זמן כי שתי שמחות הן » (משנה ברורה, מ״ב רכ״ה:יד); the Magen Avraham broadens it: « אפי׳ אין חלוקין בשמן אם חלוקין בטעמן כגון תאנים לבנים ותאנים שחורות ב׳ מינים הן » (מגן אברהם או״ח סימן רכ״ה). The source is the Terumat HaDeshen: « וכן שמעתי מאחד מהגדולים שהורה כענין זה כגון שאם אכל ובירך כבר על הגודגדניות שקורים קירש״ן חוזר ומברך זמן על אותו שקורין ווייכשל״ן » (תרומת הדשן חלק א סימן ל״ג). summary : the question is not botanical but inward: two distinct tastes are two distinct joys, and each calls for its own blessing

Seif 5 — ענבים ויין חדש

אם בירך שהחיינו על ענבים כשישתה יין חדש אינו חוזר ומברך:
Seif 5: if he blessed “Shehecheyanu” over grapes, when he drinks new wine he does not bless again.
Why new wine does not begin again. « מ״מ הכל שמחה אחת היא דבעת שראה אז שאכל הענבים ידע שהיין יצא מהם » (משנה ברורה, מ״ב רכ״ה:טו); but the Mishnah Berurah sets a limit: « וכ״ז דוקא כששותה את היין כשהוא תירוש שהוא ניכר שהוא יין חדש » (משנה ברורה, מ״ב רכ״ה:טו). summary : the wine was already contained in the gladness of the grapes; conversely, wine no longer recognisable as new carries no blessing at all

Seif 6 — פרי שאינו מתחדש

פרי שאינו מתחדש משנה לשנה אפילו אם יש ימים רבים שלא אכל ממנו אינו מברך שהחיינו: הגה פרי שמתחדש ב״פ בשנה מברכין עליו שהחיינו (ב״י) אבל שאין לו זמן קבוע לגדולו אין מברכין עליו (ב״י בשם הר״ר מנוח) לכן אין מברכין שהחיינו על ירק חדש דעומד כל השנה בקרקע (מהרי״ל):
Seif 6: a fruit that does not renew itself from year to year — even if many days have passed since he last ate of it — he does not bless “Shehecheyanu” over it. Gloss of the Rama: a fruit that renews twice a year, one blesses “Shehecheyanu” over it (Beit Yosef); but something with no fixed season of growth, one does not bless over it (Beit Yosef in the name of Rabbenu Manoach); therefore one does not bless “Shehecheyanu” over a new vegetable, since it stands in the ground all year (Maharil).
What does not renew itself. « ר״ל שאפילו בימות החורף אינו משתנה ממראיתו כגון אתרוג וכה״ג שדר באילנו משנה לשנה שכיון שעומד בירקותו כל השנה אין הנאה נרגשת בחידושו » (משנה ברורה, מ״ב רכ״ה:טז); « וכן דבר שאינו גידולי קרקע כגון עופות ודגים שנזדמנו לו אפילו אותן שלא טעם ממינן מעולם אפ״ה אין מברך עליהם שהחיינו » (משנה ברורה, מ״ב רכ״ה:טז); and the Magen Avraham: « פי׳ דבר שאינו גדולי קרקע כגון עופות ודגים אינו מברך דאע״פ דהוא לא אכל ממנו ימים רבים אחרים אכלו ממנו » (מגן אברהם או״ח סימן רכ״ה). summary : it is not the time elapsed since my last mouthful that counts, but whether there is a renewal in the world
Two crops a year — and the new vegetable. « בכל פעם ופעם כיון דעכ״פ בא מזמן לזמן » (משנה ברורה, מ״ב רכ״ה:יז); but « ובשם של״ה כתבו האחרונים דאין לברך שהחיינו על שום ירק חדש וכן על לחם חדש דאין ניכר בין חדש לישן » (משנה ברורה, מ״ב רכ״ה:יח); and the Aruch HaShulchan states the rule: « כיון דמתחדש מזמן לזמן, דשנה לאו דווקא, אבל כל דבר שאין זמן קבוע לגידולו - אין מברכין עליו » (ערוך השלחן או״ח סימן רכ״ה). summary : what the eye cannot tell from the old is no renewal to bless; what returns at a fixed season, even twice a year, is one

Seif 7 — הבוסר

אינו מברך שהחיינו על הבוסר אלא כשהבשילו האשכולות ענבים וכן בכל פרי אחר גמרו:
Seif 7: he does not bless “Shehecheyanu” over unripe grapes, but only once the clusters have ripened into grapes; and likewise with every fruit, after it is complete.
The measure of completion. « ר״ל שיהיה נגמר לגמרי וטוב למאכל » (משנה ברורה, מ״ב רכ״ה:יט); and the Beit Yosef, in the name of the Rashba, gives the reason: « מסתברא שהעיקר הם הענבים שאין הכל הולך אלא אחר שבח הפרי וגמרו » (בית יוסף או״ח סימן רכ״ה). summary : without this rule one would bless on the blossom, then on the unripe grape, then on the grape, then on the must — one blesses once, at completion
And the custom of tasting each new kind. « כתבו האחרונים בשם הירושלמי דמצוה לאכול מעט מכל מין חדש בשנה והטעם כדי להראות שחביב עליו בריאתו של הקב״ה » (משנה ברורה, מ״ב רכ״ה:יט); the Aruch HaShulchan gives the motive: « והטעם פשוט, כדי לתת שבח והודיה להשי״ת שמחדש הפירות משנה לשנה כדי ליהנות בהם בני אדם » (ערוך השלחן או״ח סימן רכ״ה). summary : to taste is to acknowledge; and it is for that acknowledgment that the blessing was instituted

C. משנה הבריות ודיין האמת — before the unusual

מְשַׁנֶּה הַבְּרִיּוֹתwho varies the creatures. The Aruch HaShulchan explains in one line why these seifim belong in this siman: « כשם שמברכין על פירי חדשה כך מברכין על בריה משונה, שהוא גם כן עניין חדש » (ערוך השלחן או״ח סימן רכ״ה). The Gemara opens the matter thus: « אמר רבי יהושע בן לוי: הרואה את הבהקנים, אומר: ״ברוך … משנה הבריות״. » (ברכות נ״ח ע״ב).

Seif 8 — הרואה כושי וגיחור

הרואה כושי וגיחור דהיינו שהוא אדום הרבה והלווקן דהיינו שהוא לבן הרבה והקפח דהיינו שבטנו גדול ומתוך עוביו נראית קומתו מקופחת והננס והדרקונה דהיינו מי שהוא מלא יבלת ופתויי הראש שכל שערותיו דבוקות זה בזה ואת הפיל ואת הקוף מברך בא״י אמ״ה משנה הבריות:
Seif 8: one who sees a kushi, a gichor — that is, someone very red —, a lavkan — that is, someone very white —, a kipeach — that is, one whose belly is large so that, through its bulk, his stature appears stunted —, a dwarf, a darkona — that is, one covered with warts —, a patuyei harosh — whose hairs are all matted together —, and also the elephant and the monkey: he blesses “Blessed are You, Hashem our God, King of the universe, who varies the creatures”.
The braita from which the two lists come. « מיתיבי: ראה את הכושי, ואת הגיחור, ואת הלווקן, ואת הקפח, ואת הננס, ואת הדרניקוס, אומר: ״ברוך … משנה את הבריות״. את הקטע, ואת הסומא, ואת פתויי הראש, ואת החגר, ואת המוכה שחין, ואת הבהקנים, אומר: ״ברוך … דיין אמת״! » (ברכות נ״ח ע״ב). summary : one and the same list carries two different blessings in the two braitot — and it is out of that contradiction that the next seif’s distinction is born
The elephant and the monkey. « תנו רבנן: הרואה פיל, קוף וקפוף, אומר: ״ברוך … משנה את הבריות״. ראה בריות טובות, ואילנות טובות, אומר: ״ברוך … שככה לו בעולמו״. » (ברכות נ״ח ע״ב). summary : the very same braita joins the siman’s two blessings: the one over the strange and the one over the beautiful
A word on the קפח. The Mechaber explains it as a large belly; the Magen Avraham notes another reading: « ובבכורות פ״ז איתא קפח היינו דאריך וקטין וכן פירש״י לחד לישנא » (מגן אברהם או״ח סימן רכ״ה). summary : the Rishonim do not agree on the exact build the word denotes — tall and thin, or thick and stunted

Seif 9 — החיגר, הקטע והסומא

הרואה את החיגר ואת הקטע ואת הסומא ומוכה שחין והבהקנין והוא מי שמנומר בנקודות דקות אם הם ממעי אמם מברך משנה הבריות ואם נשתנה אח״כ מברך דיין האמת ויש מי שאומר דדוקא על מי שמצטער עליו אבל על עכו״ם אינו מברך ואינו מברך אלא פעם ראשונה שהשינוי עליו גדול מאוד: הגה וי״א משלשים יום לשלשים יום (טור):
Seif 9: one who sees a lame man, an amputee, a blind man, one stricken with boils, or the bohakanin — that is, one speckled with fine spots —: if they are so from their mother’s womb, he blesses “who varies the creatures”; and if the change came afterwards, he blesses “the true Judge”. And there is one who says that this applies specifically to someone over whom he grieves, but over a gentile he does not bless; and he blesses only the first time, when the change appears very great to him. Gloss of the Rama: and some say: from thirty days to thirty days (Tur).
The Gemara’s answer, and the dividing line. « לא קשיא: הא ממעי אמו, הא בתר דאיתיליד. דיקא נמי, דקתני דומיא דקטע. שמע מינה. » (ברכות נ״ח ע״ב). The Mishnah Berurah repeats it: « ונולד כך ממעי אמו דאי נעשה לו זה אח״כ אומר דיין האמת » (משנה ברורה, מ״ב רכ״ה:כא); and it fixes the scope: « קאי אכולהו לבד אקיטע » (משנה ברורה, מ״ב רכ״ה:כה). summary : from birth, it is a variety within creation — משנה הבריות; arising later, it is a loss — דיין האמת
What the seif’s qualification applies to. The Mechaber writes « ויש מי שאומר דדוקא על מי שמצטער עליו » (שו״ע או״ח רכ״ה:ט); the Taz explains that it bears on only one of the two blessings: « ונראה דקאי על ברכת דיין האמת דאינו שייך אלא למי שמצטער ומצדיק הדין אבל ברכת משנ׳ הבריות ל״ש לומר במצטער דוקא » (ט״ז או״ח סימן רכ״ה); the Mishnah Berurah follows him: « קאי על ברכת דיין האמת דאינו שייך אלא למי שמצטער ומצדיק הדין אבל ברכת משנה הבריות לא שייך במצטער דוקא מידי דהוי אפיל וקוף » (משנה ברורה, מ״ב רכ״ה:כז); and so does the Magen Avraham: « קאי אברכת דיין האמת וכ״כ רי״ו בהדיא אבל אם הם ממעי אמן מברך משנה הבריות מידי דהוה אפיל וקוף » (מגן אברהם או״ח סימן רכ״ה). summary : one says דיין האמת only where there is grief — but משנה הבריות requires no grief at all, else the elephant and the monkey would not be included
The gentile in the seif. « מילתא דפסיקא נקט וה״ה לכל מי שאינו מצטער עליו » (משנה ברורה, מ״ב רכ״ה:כח). summary : the Mechaber named a clear-cut case; the rule is in truth general — it covers anyone over whom the viewer does not grieve
Once only, or every thirty days? The Mechaber: « ואינו מברך אלא פעם ראשונה שהשינוי עליו גדול מאוד » (שו״ע או״ח רכ״ה:ט), and the Mishnah Berurah gives the reason: « והטעם דעל שינוי אין שייך לברך רק פעם ראשון שרואה הדבר והשינוי גדול בעיניו » (משנה ברורה, מ״ב רכ״ה:כט); the Aruch HaShulchan likewise: « מפני שבפעם הראשון נראה השינוי גדול מאוד והוה דבר התמוה, ולא כן פעם שני » (ערוך השלחן או״ח סימן רכ״ה). The Rama reports the other custom: « וי״א משלשים יום לשלשים יום » (שו״ע או״ח רכ״ה:ט), on which the Mishnah Berurah rules in practice: « ולמעשה יש להורות דיברך אחר ל׳ בלא שם ומלכות » (משנה ברורה, מ״ב רכ״ה:ל) — provided that « פי׳ שלא ראה אחר כיוצא בו תוך ל׳ יום » (משנה ברורה, מ״ב רכ״ה:לא). summary : astonishment is not repeated; hence the first time only, and, for the contrary view, a blessing without the Name after thirty days
When one does not know. « ואם הרואה אותו אינו יודע אם נולד כן או לא צ״ע אם יברך דיין אמת » (ביאור הלכה סימן רכ״ה). summary : not knowing whether the condition is from birth or came later, one cannot choose between the two formulas — and Rabbi Akiva Eiger leaves the question open
What the בהקנין are. « היינו שיש לו נקודות כעדשים אדומים קצת אלא שבין עדשה לעדשה יש לובן צח ומבהיק ועל שם אותו הלובן נקרא בהקנין » (משנה ברורה, מ״ב רכ״ה:כד). summary : the name comes from the bright whiteness between the spots, not from the spots themselves

D. שככה לו בעולמו — before beauty

שֶׁכָּכָה לוֹ בְּעוֹלָמוֹthat it is thus for Him in His world. The Rambam: « הרואה בריות נאות ומתקנות ביותר ואילנות טובות מברך שככה לו בעולמו » (רמב״ם הלכות ברכות פרק י הלכה יג). The blessing does not praise the creature: it says that He who made the world put such a thing in it.

Seif 10 — אילנות טובות ובריות נאות

הרואה אילנות טובות ובריות נאות אפילו עכו״ם או בהמה אומר בא״י אמ״ה שככה לו בעולמו ואינו מברך עליהם אלא פעם ראשונה ולא יותר לא עליהם ולא על אחרים אלא אם כן היו נאים מהם:
Seif 10: one who sees goodly trees and beautiful creatures — even those of a gentile, or an animal — says “Blessed are You, Hashem our God, King of the universe, that it is thus for Him in His world”. And he blesses over them only the first time and no more: neither over them nor over others, unless the latter are more beautiful than they.
Even an animal, even a gentile’s. The Beit Yosef gives the source: « ומ״ש אפילו עו״ג או בהמה כך הוא בירושלמי אפי׳ פרה נאה וחמור נאה מברך שככה לו בעולמו » (בית יוסף או״ח סימן רכ״ה); and the Aruch HaShulchan sharpens it: « והרואה אילנות טובות שאינן מצויות ובריות נאות שמצויינין ביופיין הרבה, בין איש בין אשה » (ערוך השלחן או״ח סימן רכ״ה). summary : this is not a blessing over a person but over a beauty — hence its indifference to whose it is
To see, without staring. « היינו ראיה בעלמא דמותר אבל להסתכל בו ביותר ולהתבונן בדמותו אסור » (משנה ברורה, מ״ב רכ״ה:לג); the Magen Avraham said it: « ומ״מ נראה דדוקא להסתכל בו ביותר ולהתבונן בצלמו ודמותו אסור אבל ראיה בעלמא מותר » (מגן אברהם או״ח סימן רכ״ה). And one limit of speech: « ואסור לומר כמה נאה כותי זה משום לא תחנם » (משנה ברורה, מ״ב רכ״ה:לג). summary : the blessing presupposes a glance, not a scrutiny; and admiration must not turn into a compliment paid to the one looked at
Today’s practice. « בין זכרים בין נקבות. ועכשיו לא נהגו כלל לברך ברכה זו » (משנה ברורה, מ״ב רכ״ה:לב); but « ומ״מ נכון לברך בלא שם ומלכות » (משנה ברורה, מ״ב רכ״ה:לב). summary : the Mishnah Berurah records that the blessing has fallen out of use, and directs that it be said without the Name rather than lost altogether
Once only. The Mechaber: « ואינו מברך עליהם אלא פעם ראשונה ולא יותר לא עליהם ולא על אחרים אלא אם כן היו נאים מהם » (שו״ע או״ח רכ״ה:י); the Mishnah Berurah specifies: « אפילו לאחר שלשים יום » (משנה ברורה, מ״ב רכ״ה:לד); and the Aruch HaShulchan gives the motive: « ואינו מברך עליהם רק פעם ראשונה ולא יותר, לא עליהם ולא על אחרים, משום דלבד פעם הראשון אין בזה התפעלות » (ערוך השלחן או״ח סימן רכ״ה). summary : here thirty days reopen nothing: only a beauty greater than the first reopens the blessing
The siman in one sentence: four blessings for four kinds of newness — a face returned, a fruit returned, a creature that astonishes, a beauty that stops you; and two measures governing them all: what is truly new, and the first time.

Practical cases

Case 1 — I see a close relative again after several months

Situation: I meet again a brother, a relative, a dear friend I have not seen for a long time. What do I say?
Practice: everything depends on the interval and on the gladness. Seif 1: « הרואה את חבירו לאחר שלשים יום אומר שהחיינו ואחר י״ב חודש מברך מחיה מתים והוא שחביב עליו הרבה ושמח בראייתו » (שו״ע או״ח רכ״ה:א). Thirty days: שהחיינו; twelve months: מחיה מתים, and then one no longer says שהחיינו. The person is not restricted: « ואין חילוק בין איש לאשה והיינו אם רואה אשתו ואמו בתו ואחותו כיון שהוא שמח ונהנה בראייתם » (משנה ברורה, מ״ב רכ״ה:א). But if news of him had come, « ואם קיבל ממנו כתב או שאנשים הודיעוהו משלומו יש דעות באחרונים וספק ברכות להקל » (משנה ברורה, מ״ב רכ״ה:ב). And these are full blessings: « וכל אלו הברכות הוא בשם ומלכות ואפילו ברכת מחיה מתים » (משנה ברורה, מ״ב רכ״ה:ג). summary : look first at the interval, then at the real gladness, then at what was known of him in the meantime. Case 2 — The first fruit of the season

Situation: the first apricot of the year is on the table. When and how does one bless?
Practice: seif 3: « הרואה פרי חדש מתחדש משנה לשנה מברך שהחיינו אפילו רואהו ביד חבירו או על האילן ונהגו שלא לברך עד שעת אכילה » (שו״ע או״ח רכ״ה:ג). One therefore blesses at the meal, and in this order: « דלכתחלה נכון לברך שהחיינו קודם ואח״כ יברך ברכה הראויה לה » (משנה ברורה, מ״ב רכ״ה:יא). The fruit must have reached completion: « הכא לענין שהחיינו אין לברך עד שיהיה נגמר תשלום גידולו שיהיה טוב למאכל ואפילו בדיעבד אם בירך מקודם שנגמר ברכתו היא לבטלה » (משנה ברורה, מ״ב רכ״ה:יב). And if that first meal was missed: « ואם לא בירך בשעת אכילה ראשונה שוב לא יברך על אכילה שניה וכ״ש שלא יברך על אותה אכילה עצמה אף שעדיין לא נתעכל הפרי » (משנה ברורה, מ״ב רכ״ה:יג). summary : a fruit that comes only once a year, ripe, eaten for the first time this season — that is where the blessing falls. Case 3 — I pass someone whose appearance is markedly unusual

Situation: I pass a person whose body or face is plainly out of the ordinary. Is there a blessing?
Practice: two formulas, and birth is what divides them: « אם הם ממעי אמם מברך משנה הבריות ואם נשתנה אח״כ מברך דיין האמת » (שו״ע או״ח רכ״ה:ט). The seif’s qualification bears only on the second: « קאי על ברכת דיין האמת דאינו שייך אלא למי שמצטער ומצדיק הדין אבל ברכת משנה הבריות לא שייך במצטער דוקא מידי דהוי אפיל וקוף » (משנה ברורה, מ״ב רכ״ה:כז). And it is said only once: « ואינו מברך אלא פעם ראשונה שהשינוי עליו גדול מאוד » (שו״ע או״ח רכ״ה:ט); the Rama reports the other custom, « וי״א משלשים יום לשלשים יום » (שו״ע או״ח רכ״ה:ט), on which the Mishnah Berurah rules: « ולמעשה יש להורות דיברך אחר ל׳ בלא שם ומלכות » (משנה ברורה, מ״ב רכ״ה:ל).
