The preceding siman settled the blessings of the evening Shema. This one carries the widest title in the series — the whole order of the service — and retains from it a single seif, which says one thing only: the chazzan does not repeat. We then follow what custom changed, the order the Tur describes, the verse that opens it and the Rema's gloss, with practical cases.

A siman whose title announces a whole service, and whose body contains a single sentence. The Mechaber writes:
« אין ש״צ חוזר התפלה בתפלת ערבית » (שו״ע או״ח רל״ז:א), and the Rema's parenthesis adds:
« ואין נופלין על פניהם לאחר ערבית » (רמ״א או״ח רל״ז:א). The entire reason rests on one line of the Rambam:
« ואינו חוזר להתפלל בקול רם ערבית לפי שאין תפלת ערבית חובה » (רמב״ם הלכות תפילה וברכת כהנים פרק ט הלכה ט). summary: what the siman settles is not how one prays in the evening, but what the evening lacks compared with the morning. We study here at the level of principle; for personal conduct, one relies on one's Rav's ruling.

A. הסעיף — the seif and its single ruling
תְּפִלַּת עַרְבִית רְשׁוּת — “the evening prayer is reshut”. This does not mean optional in the modern sense: it is a halakhic category that fixes the prayer's place within the system of obligations. From that single qualification the whole siman follows — because a prayer nobody is obligated in needs no chazzan to discharge anyone.
The seif — סדר תפלת ערבית
סדר תפלת ערבית. ובו סעיף אחד:
אין ש״צ חוזר התפלה בתפלת ערבית (ואין נופלין על פניהם לאחר ערבית):
The order of the evening prayer. And it contains one seif: the chazzan does not repeat the Amidah at the evening prayer. (And one does not fall upon the face after Arvit.)
Where are we? The preceding siman settled the blessings of the evening Shema; this one carries a wider title —
« סדר תפלת ערבית. ובו סעיף אחד » (שו״ע או״ח רל״ז:א) — and yet it decides only one point. The Tur, for his part, describes the whole service, from its opening verse to the congregation's departure:
« סדר תפלת ערבית אומר והוא רחום ותיקנו לאומרו לפי שבשחרית ומנחה יש תמידין שמכפרין אבל ערבית שאין תמיד לכפר תקנו לומר והוא רחום » (טור או״ח סימן רל״ז). The Be'er haGolah, beneath the seif, refers to the Rambam, the Tur and the Rashba.
The hinge of the siman A title announcing a whole order, and a seif that says only one thing:
« אין ש״צ חוזר התפלה בתפלת ערבית » (שו״ע או״ח רל״ז:א). summary: the Mechaber is not legislating the body of the evening service here — he has done so elsewhere — he retains only what distinguishes Arvit from Shacharit and Minchah.
Where this ruling comes from From the Rambam, by way of the Tur:
« וכתב הרמב״ם ז״ל הטעם לפי שאינה חובה ואומר קדיש ונפטרין לבתיהן לשלום » (טור או״ח סימן רל״ז). And in the Rambam himself:
« ואינו חוזר להתפלל בקול רם ערבית לפי שאין תפלת ערבית חובה » (רמב״ם הלכות תפילה וברכת כהנים פרק ט הלכה ט), and then:
« לפיכך לא יברך ברכות לבטלה שאין כאן אדם שנתחיב בהם כדי להוציאו ידי חובתו » (רמב״ם הלכות תפילה וברכת כהנים פרק ט הלכה ט). The Vilna Gaon notes it in a line:
« שאין תפלת ערבית חובה לפיכך לא יברך לבטלה שאין כאן אדם שנתחייב בהם כדי להוציאו י״ח » (ביאור הגר״א או״ח רל״ז).
B. תפלת ערבית רשות — why there is no חזרת הש״ץ
The ruling
« אין ש״צ חוזר התפלה בתפלת ערבית » (שו״ע או״ח רל״ז:א). summary: at Shacharit and Minchah the chazzan repeats the Amidah aloud; in the evening he does not.
The talmudic root The question was already a dispute among the Tannaim:
« תפלת ערבית רבן גמליאל אומר חובה רבי יהושע אומר רשות אמר אביי הלכה כדברי האומר חובה ורבא אמר הלכה כדברי האומר רשות » (ברכות כ״ז ע״ב). And the Gemara tells the episode in which it broke out:
« מעשה בתלמיד אחד שבא לפני רבי יהושע אמר לו תפלת ערבית רשות או חובה אמר ליה רשות » (ברכות כ״ז ע״ב).
The reason the Rambam gives
« ואינו חוזר להתפלל בקול רם ערבית לפי שאין תפלת ערבית חובה » (רמב״ם הלכות תפילה וברכת כהנים פרק ט הלכה ט), and he continues:
« לפיכך לא יברך ברכות לבטלה שאין כאן אדם שנתחיב בהם כדי להוציאו ידי חובתו » (רמב״ם הלכות תפילה וברכת כהנים פרק ט הלכה ט). summary: the repetition exists to discharge one who cannot pray; if nobody is obligated, repeating it would be blessings said for nothing.
The Mishnah Berurah's wording
« שאין תפלת ערבית חובה רק מצוה ולא נתחייב בה אדם שיצטרך הש״ץ להוציאו ידי חובתו » (משנה ברורה, מ״ב רל״ז:א). summary: Arvit is a mitzvah, not an obligation that would create a man in need of being discharged.
The Prisha's wording
« לפי שאינה חובה ואין בב״ה מי שנתחייב בה שיהא צריך להוציאו » (פרישה או״ח רל״ז). summary: there is nobody in the synagogue so obligated in it that he would need to be discharged.
The two-pronged argument The Beit Yosef reports it in the name of the Rashba:
« ואפילו לדברי הגאונים שאמרו שאם התפלל פעם אחת קבלה עליו חובה אם התפלל בקי הוא ואין ש״צ מוציאו ואם אינו בקי ולא התפלל פטור הוא » (בית יוסף או״ח סימן רל״ז). The Machatzit haShekel says the same:
« כיון שהתפלל פ״א ע״כ הוא בקי ואין צריך לש״ץ ואם אינו בקי ע״כ לא התפלל בשום פעם » (מחצית השקל על אורח חיים רל״ז:א). summary: either way — either he has already prayed Arvit, in which case he knows how to pray and does not need the chazzan; or he cannot pray, in which case he has never prayed and is not obligated.
C. האידנא דקבעוה חובה — what changed, and what did not
What changed The Rambam writes it himself elsewhere:
« ואין תפלת ערבית חובה כתפלת שחרית ומנחה ואף על פי כן נהגו כל ישראל בכל מקומות מושבותיהם להתפלל ערבית וקבלוה עליהם כתפלת חובה » (רמב״ם הלכות תפילה וברכת כהנים פרק א הלכה ו). summary: by law Arvit is not obligatory like the other two prayers; but all Israel, everywhere, took up the practice of saying it and accepted it upon themselves as an obligatory prayer.
And yet the repetition did not return
« ואפילו האידנא דקבעוה חובה מ״מ לא אלים מנהגא לשויוה חובה כדי לאטרוחי צבורא להחזיר הש״ץ התפלה » (משנה ברורה, מ״ב רל״ז:א). summary: the force of a custom does not reach so far as to impose the burden of a repetition on the congregation.
The Bach's principle
« כיון דמדינא אינה חובה אלא רשות ולכן לא תיקנו מתחלה שיחזור הש״ץ תפלת ערבית אע״פ שאח״כ נהגו וקבעוה חובה מ״מ התקנה במקומה עומדת » (ב״ח או״ח סימן רל״ז). summary: no repetition was instituted for Arvit at the outset; the later custom did not undo that institution — it stands as it was laid down.
The same in the Eliyah Rabbah He first defines the scope of that acceptance:
« פירוש דוקא כשאומרים פעם אחת הוא דקיבלו לחובה אבל כשלא אמרו מעולם לא » (אליה רבה רל״ז:ג), and then cites the Lechem Chamudot:
« והאידנא דקבעו חובה אפילו לא התפלל כלל מכל מקום לא אלים מנהגא לשוויה חובה כדי לאטרוחי ציבורא להחזיר השליח ציבור התפילה » (אליה רבה רל״ז:ג).
The Arukh haShulchan
« אין חזרת שליח הציבור בתפלת ערבית לפי שהיא רשות » (ערוך השלחן רל״ז:ג), and he adds:
« ואפילו לכמה מהראשונים שכתבו שכבר קבלנו עלינו כולנו לחובה, מכל מקום לעניין חזרת שליח הציבור לא קבלנו עלינו » (ערוך השלחן רל״ז:ג). He closes with a reserved remark:
« אך באמת יש טעמים נסתרים על מה שאין חזרת שליח הציבור בלילה » (ערוך השלחן רל״ז:ג).
And according to the kabbalists The Kaf haChaim reports:
« והמקו׳ אומרים שעל דרך האמת חזרה בערבית אין לה מקום » (כף החיים רל״ז:ו), after giving the plain reasoning:
« דאם הוא בקי אין הש״ץ מוציאו ואם אינו בקי תפלת ערבית רשות ואיהו אכתי לא שוייה אנפשיה חובה דלא ידע לצלויי » (כף החיים רל״ז:ו). In practice, one follows one's Rav.
D. סדר תפלת ערבית — the order of the service according to the Tur
The order the Tur describes
« ואומר ש״צ ברכו ועונין ברוך ה׳ המבורך וקורין ק״ש וברכותיה ויראו עינינו וקדיש ומתפללין הציבור בלחש » (טור או״ח סימן רל״ז), then:
« ואין הש״ץ מחזיר התפלה » (טור או״ח סימן רל״ז), and finally:
« וכתב הרמב״ם ז״ל הטעם לפי שאינה חובה ואומר קדיש ונפטרין לבתיהן לשלום » (טור או״ח סימן רל״ז). summary: ברכו, the Shema and its blessings, יראו עינינו, a kaddish, the silent Amidah — and one goes home.
What does not take place at night The Arukh haShulchan sums it up:
« ואין אומרים קדושה בלילה, ורק שליח הציבור אומר קדיש שלם » (ערוך השלחן רל״ז:ג). summary: no kedushah at night, since there is no repetition aloud to carry it.
The מזמור before the service The Mishnah Berurah reports the custom:
« נהגו בקצת מקומות לומר שיר המעלות הנה ברכו וכו׳ קודם מעריב משום דאמרינן רגיל לקרות קורא דצריך לקרות שמע מתוך ד״ת » (משנה ברורה, מ״ב רל״ז:ב), and gives its reason:
« והא דאמרינן מזמור זה יותר מאחרים משום דכתיב ביה העומדים בבית ה׳ בלילות » (משנה ברורה, מ״ב רל״ז:ב).
A limit to that custom The Eliyah Rabbah sets it:
« ולפי זה נראה כשנמשכה מנחה עד הלילה ומתפללין מיד מעריב אין אומרים המזמור » (אליה רבה רל״ז:ד). summary: if Minchah was said just before, one is already coming out of words of Torah, and the reason for the psalm falls away.
The verses and the half-kaddish The Arukh haShulchan describes what is said before ברכו:
« לפי שהלילה נמשלה לצרות לכן מחננים לו יתברך שיהיה מעוזינו בעת צרה » (ערוך השלחן רל״ז:ב), then:
« ואומרים חצי קדיש, ודווקא כשיש עשרה שאמרו אלו הפסוקים » (ערוך השלחן רל״ז:ב). The Kaf haChaim notes the widespread usage:
« והמנהג הפשוט עכשיו לומר קדיש קודם והוא רחום » (כף החיים רל״ז:ג), and reports from the Sha'ar haKavanot:
« דצ״ל ב׳ פעמים ברכו אחד קודם תפלה ואחד אחר תפלה » (כף החיים רל״ז:ב). In practice, one follows one's Rav.
After the service The Tur reports a custom:
« וכתב עוד שבערב אחר שגומרין תפלת ערבית נוהגין לומר פטום הקטורת שאומרים אותו זכר למקדש וקטורת היה גם בערב » (טור או״ח סימן רל״ז), and immediately marks its limit:
« אבל השיר שהיו אומרים במקדש אין לומר בערב שלא היו אומרים אותו במקדש בערב » (טור או״ח סימן רל״ז).
E. והוא רחום — why this verse opens the evening service
The first reason — there is no offering in the evening
« סדר תפלת ערבית אומר והוא רחום ותיקנו לאומרו לפי שבשחרית ומנחה יש תמידין שמכפרין אבל ערבית שאין תמיד לכפר תקנו לומר והוא רחום » (טור או״ח סימן רל״ז). summary: in the morning and the afternoon the tamid atones; in the evening there is no offering, and so atonement is asked for through the verse.
The second reason — the malkot
« ויש אומרים לפי שנהגו ללקות ערבית לאחר שחטאו כל היום ובמלקות מתכפר להם לכך נהגו לומר אחר המלקות והוא רחום » (טור או״ח סימן רל״ז). summary: it was the custom to receive the disciplinary lashes in the evening, after a full day of sin.
The third reason — the count of the words
« וגם מפני שאומרים אותו ג״פ בשעת המלקות כי יש בו י״ג תיבות הרי לג׳ פעמים ט״ל תיבות כמנין המלקות » (טור או״ח סימן רל״ז). summary: thirteen words in the verse, said three times — thirty-nine, the number of the lashes.
The Bach gathers up the first
« כיון שאין בערבית תמיד לכפר תקינו לומר פסוק והוא רחום לבקש ממנו יתברך שהוא ברחמיו יכפר עון » (ב״ח או״ח סימן רל״ז).
The Kol Bo's reason, reported by the Beit Yosef
« לעולם לא לן אדם בירושלים ובידו עון שתמיד הבקר מכפר עונות הלילה ותמיד הערב מכפר עונות היום » (בית יוסף או״ח סימן רל״ז), and from there:
« ולכך תיקנו ערבית ושחרית לחלות פני המקום שיכפר עונותינו יומם ולילה » (בית יוסף או״ח סימן רל״ז). He finally adds:
« ועוד שכל היום אדם חוטא ובערב צריך אדם לומר כפרה על חטאו » (בית יוסף או״ח סימן רל״ז).
The Arukh haShulchan and the Eliyah Rabbah The Arukh haShulchan takes up the first reason:
« לפי שבשחרית ומנחה יש תמידין שמכפרין ולא כן בערבית » (ערוך השלחן רל״ז:א). The Eliyah Rabbah draws a consequence from it for Shabbat:
« ולכן אין אומרים בשבת, כי יש לרשעים מנוחה בגיהנום בשבת ואין שולטים » (אליה רבה רל״ז:א). Elsewhere he notes why ברכו is said at night as by day:
« לפיכך אומרים ברכו בלילה כמו ביום » (אליה רבה רל״ז:ב).
F. ואין נופלין על פניהם — the Rema's gloss
The gloss
« ואין נופלין על פניהם לאחר ערבית » (רמ״א או״ח רל״ז:א). summary: after Arvit one does not say tachanun.
What the Tur reported In the name of Rav Sar Shalom Gaon:
« שמותר ליפול על אפים לבקש רחמים אחר תפלת ערבית אפילו בציבור » (טור או״ח סימן רל״ז), and he added the testimony of a usage:
« וכן המנהג בבבל שנופלין על פניהם בערבית חוץ מערב שבת » (טור או״ח סימן רל״ז). summary: in Bavel they did fall upon their faces at Arvit, except on the eve of Shabbat.
The Rema's answer In the Darkhei Moshe:
« והמנהג אינו כן וכ״כ האגור ויש בו טעם ע״פ הקבלה » (דרכי משה או״ח רל״ז). The Bach writes the same:
« המנהג אינו כן וכ״כ האגור ואיכא טעם נכון ע״פ הקבלה » (ב״ח או״ח סימן רל״ז), and the Magen Avraham refers to both:
« וכן כ׳ האגור וכן נכון על פי הקבל׳ » (מגן אברהם רל״ז:א).
What the Prisha says
« אחר תפלת ערבית ורמ״א כתב שאין ליפול » (פרישה או״ח רל״ז), and:
« ובאגור כתב שאין ליפול בלילה אפי׳ בחול ויש בו סוד ע״פ הקבלה » (פרישה או״ח רל״ז). On the eve of Shabbat she observes:
« משמע דוקא בערבית לא היו נופלים הא במנחה היו נופלים בע״ש שלא כמנהגנו » (פרישה או״ח רל״ז).
The reach of the rule
« ואפילו התפללו ערבית מבע״י אין נופלין דכבר שויא לילה » (משנה ברורה, מ״ב רל״ז:ב), and:
« ואפילו תפלה שהוא מתפלל לשם תשלומין של תפלת מנחה ג״כ אין ליפול » (משנה ברורה, מ״ב רל״ז:ב). The Kaf haChaim gathers both:
« ואפילו התפללו ערבית מבע״י אין נופלין דהא כבר שויא לילה וכן תשלומין מנחה בערבית אין ליפול לאחר ערבית » (כף החיים רל״ז:ז).
The siman where the general rule is laid down
« אין נפילת אפים בלילה ובלילי אשמורת נוהגים ליפול על פניהם שהוא קרוב ליום » (שו״ע או״ח קל״א:ג). summary: no נפילת אפים at night; the practice of saying it in the pre-dawn watches rests on the fact that that hour is already close to day.
Practical cases
Case 1 — A weekday Arvit minyan
Situation: Arvit is prayed with ten men. After the silent Amidah someone asks why the chazzan does not begin again aloud as he does at Minchah.
Conduct: This is exactly the seif:
« אין ש״צ חוזר התפלה בתפלת ערבית » (שו״ע או״ח רל״ז:א). The reason is the Rambam's:
« לפיכך לא יברך ברכות לבטלה שאין כאן אדם שנתחיב בהם כדי להוציאו ידי חובתו » (רמב״ם הלכות תפילה וברכת כהנים פרק ט הלכה ט). And the Mishnah Berurah adds that present-day practice changes nothing:
« ואפילו האידנא דקבעוה חובה מ״מ לא אלים מנהגא לשויוה חובה כדי לאטרוחי צבורא להחזיר הש״ץ התפלה » (משנה ברורה, מ״ב רל״ז:א). In practice, one follows one's Rav.
Case 2 — A latecomer arrives after ברכו
Situation: someone reaches the synagogue after the chazzan has already said ברכו and the Shema has begun. May ברכו be said again for him?
Conduct: The Tur reports Rav Amram Gaon's position:
« כתב רב עמרם שש״צ יכול להפסיק אחר שחתם בא״י המלך בכבודו ולומר ברכו בשביל ב״א שבאו בין הפרקים ולא שמעו ברכו » (טור או״ח סימן רל״ז), with its reason:
« ונותן טעם לדבריו כיון שבלא״ה מפסיקין בפסוקים אין חוששין להפסיק » (טור או״ח סימן רל״ז). The Tur objects:
« ואני כתבתי למעלה שאין להפסיק אלא במה שתיקנו הראשונים » (טור או״ח סימן רל״ז). The Beit Yosef resolves it:
« אפשר דאין ליזהר מלהפסיק אלא בדברים שאינן מענין תפלה אבל ברכו כיון שהוא מענין התפלה שפיר דמי » (בית יוסף או״ח סימן רל״ז). And so the Shulchan Arukh rules in the preceding siman:
« וכן יכול לומר ברכו להוציא מי שלא שמע ולא הוי הפסק » (שו״ע או״ח רל״ו:ב). In practice, one follows one's Rav.
Case 3 — Arvit was prayed before nightfall
Situation: the minyan said Arvit early, before nightfall; and one still has to make up the Minchah Amidah. Does one say tachanun?
Conduct: No, in both cases. The Mishnah Berurah:
« ואפילו התפללו ערבית מבע״י אין נופלין דכבר שויא לילה » (משנה ברורה, מ״ב רל״ז:ב), and:
« ואפילו תפלה שהוא מתפלל לשם תשלומין של תפלת מנחה ג״כ אין ליפול » (משנה ברורה, מ״ב רל״ז:ב). The Kaf haChaim rules the same:
« ואפילו התפללו ערבית מבע״י אין נופלין דהא כבר שויא לילה וכן תשלומין מנחה בערבית אין ליפול לאחר ערבית » (כף החיים רל״ז:ז). The general rule is in siman 131:
« אין נפילת אפים בלילה ובלילי אשמורת נוהגים ליפול על פניהם שהוא קרוב ליום » (שו״ע או״ח קל״א:ג). In practice, one follows one's Rav.
