דין איסור שינה בתפילין
🌱 Introductory level · Beginners
✦ ❖ ✦
After teaching the respect due to the tefilin and how to conduct oneself when one must part from them (siman 43), the Shulchan Aroukh here, in a single seif, settles a concrete case: may one sleep while wearing the tefilin? As long as they are on the head or the arm, it is forbidden to sleep with them, even a light sleep (שינת עראי). Yet there are leniencies: if he placed a סודר (cloth) on them and no woman is with him, he may take a light sleep — head between the knees, seated ; if they are wrapped in his hand (כרוכין בידו), even a deep sleep (שינת קבע) is permitted ; and the Rama adds: in their נרתק (case), it is permitted in every case. Hebrew text, fluent English translation and explanations of the single seif, with a section of practical cases.
The tefilin are objects of קדושה that require a clean body (גוף נקי) and a present mind: one guards against any בזיון and any היסח הדעת (see siman 43). Now sleep is a state in which a man no longer controls himself: he might let out wind (הפחה) or come to an emission (קרי), and the קדושה of the tefilin would be impaired. The Shulchan Aroukh therefore teaches, in this single seif, when it is forbidden to sleep in tefilin and which means — a סודר, the head between the knees, the tefilin wrapped in the hand or placed in their נרתק — nonetheless permit a measure of rest. We study here at the level of principle; for personal conduct, one refers to the custom and to the ruling of the Rav.

A. איסור שינה בתפילין — the ban on sleeping in tefilin (single seif)
Original text (single seif)
כל זמן שתפילין בראשו או בזרועו אסור לישן בהם אפילו שינת עראי.
As long as the tefilin are on his head or on his arm, it is forbidden to sleep with them, even a light sleep (שינת עראי).
שֵׁנָה בִּתְפִלִּין — “sleeping in tefilin” — during sleep, a man no longer controls his body; he might let out wind (הפחה) or come to an emission (קרי), whereas the tefilin require a clean body (גוף נקי). To sleep in them would also be a בזיון of their קדושה. That is why, as long as they are on the head or arm, it is forbidden to sleep with them.
שְׁנַת עֲרַאי — “light sleep” — the שינת עראי is a brief doze, a half-sleep from which one easily wakes, as opposed to שינת קבע (a deep, settled sleep). The seif teaches that, as long as the tefilin are in place, even this light sleep is forbidden — all the more so a deep sleep.
What this seif says:
The case: the tefilin are on the head or on the arm (בראשו או בזרועו).
The rule: it is forbidden to sleep with them.
How far:even a light sleep (שינת עראי), and all the more a deep sleep.
The seif in one sentence: as long as the tefilin are on the head or arm, one does not sleep with them — not even a brief doze — for sleep endangers the clean body and the respect owed to their sanctity.
B. סודר · ראשו בין ברכיו — the leniency: light sleep permitted (single seif)
Original text (continuation of the seif)
אלא אם הניח עליה סודר ולא היתה עמו אשה ישן בהם שינת עראי, וכיצד הוא עושה מניח ראשו בין ברכיו והוא יושב וישן.
Unless he placed a סודר (cloth) on them and no woman was with him: he may sleep with them a light sleep. And how does he do it? He places his head between his knees, seated, and sleeps thus.
סוּדָר — “the cloth” — the סודר is a fabric placed over the tefilin. It is not a בזיון (as a burden would be), but a covering that shields the קדושה and separates during rest. With this סודר, and provided no woman is with him, a light sleep becomes permitted.
רֹאשׁוֹ בֵּין בִּרְכָּיו — “his head between his knees” — so as not to slip into a deep sleep, he does not lie down: he stays seated and places his head between his knees. This uncomfortable posture ensures that the sleep will remain light (עראי) and that he will wake quickly — this is the manner (כיצד) the seif indicates.
What this seif says:
Two conditions: a סודר placed on the tefilin andno woman with him.
What is permitted: a light sleep (שינת עראי) only.
How:seated, the head between the knees, so as not to fall deeply asleep.
The seif in one sentence: with a סודר on the tefilin and no woman beside him, a brief doze is permitted — but seated, the head between the knees, so that the sleep stays light.
C. כרוכין בידו · אוחזן · נרתק — wrapped in the hand, and the case (seif + הגה)
Original text (continuation of the seif and הגה — Rama)
If the tefilin were wrapped in his hand (כרוכין בידו), it is permitted to sleep with them even a deep sleep (שינת קבע); but if he holds them in his hand without their being wrapped, it is forbidden to sleep with them, even a light sleep. Rama: and this only when he holds them without their נרתק (case); but in their נרתק, it is permitted in every case. (Beit Yossef in the name of the Baal haItour)
כְּרוּכִין בְּיָדוֹ — “wrapped in his hand” — when the tefilin are no longer on the head or arm but wrapped (bound) in the hand, they are held firmly and away from the body. The risk lessens, and one may sleep even a deep sleep (שינת קבע).
אוֹחֲזָן בְּיָדוֹ — “holding them in hand” · נַרְתִּיק — “the case” — if he merely holds them in his hand without their being wrapped, he might drop them while asleep: forbidden even a light sleep. The Rama specifies that this is when he holds them without the נרתק (the case that contains them); but when they are in their נרתק, the fear of falling and of disrespect vanishes, and it is permitted in every case.
What this seif says:
Wrapped in the hand (כרוכין): even a deep sleep (שינת קבע) is permitted.
Held without being wrapped (אוחזן):forbidden even a light sleep — lest they fall.
Rama — in the נרתק: placed in their case, it is permitted in every case.
The seif in one sentence: the more the tefilin are protected and away from the body — wrapped in the hand, then placed in their נרתק — the more rest is permitted; merely held in the hand, they risk falling, and one does not sleep with them.
Practical cases
Case 1 — Dozing off during the morning prayer in tefilin
Situation: during the morning prayer or study, still in tefilin, fatigue sets in and one is about to doze off. What may be done?
Conduct: as long as the tefilin are on the head or arm, it is forbidden to sleep with them, even a light sleep (שינת עראי) (single seif). If one truly must rest a moment, it is permitted only under two conditions — a סודר placed on them and no woman beside him — and only seated, the head between the knees, so the sleep stays light. In practice, the main care is not to fall asleep in tefilin; for a concrete case, one asks the Rav.
Case 2 — Taking a nap and keeping the tefilin
Situation: one wishes to rest or take a real nap (שינת קבע) without fully removing the tefilin. Is that possible?
Conduct: for a deep sleep (שינת קבע), the tefilin must not remain on the head or arm. Two ways permit it: holding them wrapped in the hand (כרוכין בידו), or — more simply — placing them in their נרתק (case), which the Rama permits in every case. By contrast, holding them in the hand without their being wrapped and without a case is forbidden, for they may fall. For practice, one asks the Rav.
Case 3 — Respect and the clean body (קרי, קדושה)
Situation: why, at bottom, does one not sleep with the tefilin? What does this siman teach us about the respect owed to their sanctity?
Conduct: the tefilin are objects of קדושה that require a clean body (גוף נקי). In sleep, a man no longer controls himself: he might let out wind (הפחה) or come to an emission (קרי) — especially if a woman is beside him. That is why one removes the tefilin or interposes a covering (סודר, נרתק) before resting, so they be neither disgraced nor borne by a body that is not clean. For the exact boundary between what is permitted and what is not in a real case, one asks the Rav.
