This siman teaches the laws of the בית הכסא (the privy) for the ק״ש: an old privy (בית הכסא ישן) remains forbidden even after the excrement is removed — unless it has מחיצות (partitions) and no bad smell reaches; a place merely designated (הזמינו) is forbidden within but permitted facing it; the doubt about the designation; the pit on a slope (חפירה במדרון) where everything falls at once, deemed כסתום דמי; and the covered perforated bench (ספסל נקוב). Hebrew text, fluent English translation and explanation of the ה׳ seifim, with a section of practical cases.

Our Sages taught (ברכות כ״ו.): בית הכסא שאמרו — אף על פי שאין בו צואה — the privy they spoke of (as a place forbidden for reciting) applies even though there is no excrement in it. This is the yesod of the siman: the place itself, called בית הכסא, is מאוס (repugnant) and forbidden for reciting, whether or not excrement is actually present. We study here at the level of principle; for personal conduct, one refers to the custom and to the ruling of the Rav.

📑 Study outline

A. The ה׳ seifim — בית הכסא ישן (séif 1), הזמינו ולא נשתמש (séif 2), ספק ההזמנה (séif 3), חפירה במדרון (séif 4), ספסל נקוב (séif 5)
1. Practical case — an old, cleared-out privy: the role of the מחיצות
2. Practical case — a place merely designated
3. Practical case — the perforated bench (ספסל נקוב) covered and without a הגרף
+ Comprehension questions and going further

A. The privy (בית הכסא) and the ק״ש — the ה׳ seifim

בֵּית הַכִּסֵּא — the privy — the siman distinguishes several states of the place: the old privy (בית הכסא ישן, already used), which remains forbidden because the place is מאוס even after the excrement is removed — unless it has מחיצות; a place merely designated (הזמינו) but not yet used; the pit on a slope (חפירה במדרון) where the excrement falls at once far off, deemed כסתום דמי (as if sealed); and the perforated bench (ספסל נקוב). In all of these the question is one: does this place bear the status of a בית הכסא facing which one may not recite?

Séif 1 — בית הכסא ישן: the old privy

Séif 1: it is forbidden to recite facing an old privy (בית הכסא ישן), even if the excrement was removed from it (אפילו פינו ממנו הצואה). And it seems to the Mechaber that this is when it has no partitions (כשאין לו מחיצות); but if it has partitions (יש לו מחיצות), even though it contains excrement, one recites facing it adjacent to it (קורא כנגדו בסמוך), and need not be concerned, as long as no bad smell (ריח רע) reaches him.
The core point: the place called בית הכסא is מאוס — repugnant in itself. That is why it remains forbidden to recite facing it even after the excrement has been removed. The Mechaber adds his own view (ויראה לי): this holds when it has no מחיצות (partitions that form a domain of their own); but with מחיצות, one may recite adjacent to it, the only reservation being the absence of ריח רע (a bad smell).

Séif 2 — הזמינו: the place merely designated

Séif 2: if they designated a place for a בית הכסא (הזמינו) and it has not yet been used (ועדיין לא נשתמש בו) — it is permitted to recite facing it (מותר לקרות כנגדו), but not within it (אבל לא בתוכו).
The mere designation (הזמנה) already creates a certain status, lighter than actual use: since the name of בית הכסא is called upon the place, one does not recite within it (בתוכו). But since it has not yet been used, the designation alone does not forbid facing it (כנגדו): there it is permitted.

Séif 3 — ספק ההזמנה: the doubt about the designation

Séif 3: if he said "this room will be a בית הכסא" and said about another room "and this one too" (וגם זה) — their status is the same (דינם שוה). But if he said about the second "and this room" (ובית זה) without saying "and this one too" — the second is a doubt (ספק): did he designate it for that or not? Therefore one does not recite in it from the outset (אין קורין בו לכתחלה), but if he recited in it (ואם קרא בו) — he has fulfilled his obligation (יצא).
Everything turns on the wording. "וגם זה" ("and this one too") clearly extends the designation: the same status. But "ובית זה" ("and this room") is ambiguous — perhaps a mere mention, not a designation. Hence a ספק: out of caution, one does not recite in it לכתחילה; but בדיעבד, if one did recite, יצא, for the doubt does not undo a recitation already performed.

Séif 4 — חפירה במדרון: the pit on a slope

Séif 4: a privy that is a pit (בחפירה), whose opening is four cubits (ד׳ אמות) distant from the depression, made on a slope (במדרון) so that the excrement rolls and falls at once far off, and likewise the urine descends at once into the depression (הגומא) — it is as if sealed (כסתום דמי), and it is permitted to recite there if there is no bad smell, and one also does not urinate outside the depression. Rem"a: but if one does sometimes urinate outside it — it is forbidden to think words of Torah there, all the more so to recite the קריאת שמע.
A pit made on a slope (במדרון) where everything — excrement and urine — falls immediately into the depression and far off is treated as sealed (כסתום דמי): nothing remains exposed. One may therefore recite there, on two conditions: no ריח רע, and one does not urinate outside the depression. The Rem"a (הגה) rules that if one sometimes urinates outside the depression, it is forbidden even for הרהור (thinking Torah), כל שכן (all the more so) for the ק״ש.

Séif 5 — ספסל נקוב: the perforated bench

Séif 5: people who have a perforated bench (ספסל נקוב) upon which they relieve themselves — it is permitted to recite the קריאת שמע facing it (כנגדו), since there is no excrement on the hole (אין הצואה על הנקב), the container (הגרף) is not under the hole, and moreover the hole is always covered with a board (מכוסה תמיד בדף). And anyone who recites in a place where one may not recite (מקום שאין קוראין) — goes back and recites again (חוזר וקורא).
Three reasons permit reciting facing the perforated bench: (1) אין הצואה על הנקב — no visible excrement on the hole; (2) אין הגרף תחת הנקב — the container (the pot) is not beneath it; (3) הנקב מכוסה תמיד בדף — the hole is always covered with a board. The siman closes with a general rule: whoever recited where one may not recite חוזר וקורא — he goes back and recites again.
The siman in one sentence: an old privy remains forbidden facing it even after the excrement is removed (unless it has מחיצות, with no ריח רע); a place merely designated (הזמינו) is forbidden בתוכו but permitted כנגדו; in the doubt about the designation, אין קורין לכתחילה ואם קרא יצא; a pit on a slope where everything falls at once is כסתום דמי (permitted, unless there is ריח רע or urine outside the depression); and the covered ספסל נקוב, with no הגרף beneath it, is permitted כנגדו.

Practical cases

Case 1 — An old, cleared-out privy

Situation: a room served as a privy, then was cleaned and cleared out. May one recite the ק״ש facing it?
Conduct: the place bears the name בית הכסא and remains מאוס: in principle it is אסור to recite facing it, even after the excrement has been removed. The Mechaber's distinction: if it has מחיצות, one may recite adjacent to it as long as there is no ריח רע. For the practical application (modern toilets, plumbing, flushing), one follows one's Rav.

Case 2 — A place merely designated

Situation: a room was designated to become a privy, but has not yet been used. May one recite within it, or facing it?
Conduct: since it was הזמינו (designated), the name of בית הכסא is already called upon it: one does not recite within it (בתוכו). But as long as it has not been used, the designation does not extend outside it: facing it (כנגדו) it is permitted. And in a case of doubt about the designation, אין קורין לכתחילה, but if one recited — יצא. For the details, one follows one's Rav.

Case 3 — The perforated bench (ספסל נקוב)

Situation: a clean perforated bench, whose hole is covered by a board, with no pot beneath it. May one recite the ק״ש facing it?
Conduct: yes — מותר לקרות כנגדו, once the three conditions hold: אין הצואה על הנקב (no excrement on the hole), אין הגרף תחת הנקב (no container beneath it), and הנקב מכוסה תמיד בדף (the hole always covered). And the general reminder: whoever recited in a forbidden place חוזר וקורא. For borderline cases, one follows one's Rav.

Comprehension questions

Check your understanding:
  1. Why does the old privy remain forbidden facing it even after the excrement is removed (séif 1)?
  2. What distinction does the Mechaber introduce with the מחיצות (séif 1)?
  3. A place merely designated (הזמינו): why בתוכו אסור but כנגדו מותר (séif 2)?
  4. What makes the pit on a slope deemed כסתום דמי, and what does the Rem"a rule (séif 4)?
  5. What are the three reasons one recites the ק״ש facing the ספסל נקוב (séif 5)?
