📜 The text of the Shulchan Arukh — 4 seifim

The siman has four seifim. The first two carry the heart of the sugya and are reproduced here; seif ג is read at section 9 and seif ד at section 13.

1. Opening of the sugya — the brayta of שבת י״ט.

The wording of the brayta

Rashi's glosses on the brayta

One must begin by measuring what Rashi does here — and what he does not do. He gives no reason at all for the prohibition. He glosses three expressions, and only three: the verb מפליגין, the words ופוסק, and the clause ומצור לצידן. The whole debate over the why of the brayta will therefore be born among the Rishonim who come after him, and it is the Tur and then the Beit Yosef who will set it in order.

« מפליגין - מפרישין מן היבשה לים… » (רש״י שבת י״ט. ד״ה מפליגין) — Rashi explains the verb by its plain sense: to separate oneself from dry land.

« ופוסק - עם הנכרי ע״מ לשבות ואין צריך לשבות » (רש״י שבת י״ט. ד״ה ופוסק) — the stipulation is made with the non-Jew; and Rashi already notes that he need not in fact rest.

« ומצור לצידן - אין אלא מהלך יום ובע״ש היה שם יום השוק כדאמרינן בפסחים במקום שנהגו (פסחים דף נ:) » (רש״י שבת י״ט. ד״ה ומצור לצידן) — the distance from Tyre to Sidon is only a single day's travel, and Rashi adds whence we know the market day fell there on the eve of Shabbat: from the sugya in Pesachim.

The central dispute — רבי and רשב״ג

Two positions in the brayta:

The Tur rules like רשב״ג and says so in so many words: « רשב״ג אומר א״צ לפסוק והלכה כמותו » (טור אורח חיים רמ״ח). The Mechaber, however, keeps the stipulation in the body of seif א — ופוסק עמו שישבות — that is, the position of רבי. The Beit Yosef had already noted that the Rambam too does not follow the Tur here: « ומ״ש רבינו דהלכה כרשב״ג אין כן דעת הרמב״ם שבפרק כ״ד ופ״ל פסק כת״ק » (בית יוסף אורח חיים רמ״ח).

Chakira: what is the גדר of this פסיקה? Three ways of conceiving it:

a) First way: it strips the non-Jew of his standing as agent — he will no longer be the שליח of the Jew for desecrating Shabbat.

b) Second way: it is a matter of public appearance — that none should see the Jew consenting to desecration.

c) Third way: it is the expression of an intention — the Jew declares to himself that he wants no desecration.

This chakira is not idle: it can be measured at one precise place in the siman, where the Acharonim give two opposite answers according to whether the ship or the caravan is at issue. See section 8.

2. The underlying chakira — three explanations of the reason

What is the true reason of the brayta? The Mishnah Berurah opens its commentary on this siman by announcing the plurality at once: « והנה הרבה טעמים נאמרו ע״ז בפוסקים » (משנה ברורה רמ״ח, הקדמה). The Rishonim do not agree on this reason. Three explanations are followed here; others appear elsewhere in the page — the Ramban gives one of his own (section 5), and the Mishnah Berurah attaches to the brayta a further one, that of שט (section 9).

(Rif, Rosh, Rambam)

The Rif, as reported by the Tur — « רב אלפס פי׳ הטעם משום עונג שבת שכל ג׳ ימים הראשונים גופו משתבר ואין רוחו חוזרת עד אחר ג׳ ימים ולכן מתירין בנהרות הנובעים שאינו מצטער » (טור אורח חיים רמ״ח). The body is broken, and the spirit does not return until after three days: it is the experience of the sea voyage that makes the law.
The Beit Yosef — he reports that the Ri and the Rosh set aside the explanation from techumin and retained this one: « והסכימו שהטעם הוא משום ביטול עונג שבת שכל ג׳ ימים הראשונים ה״ל שינוי וסת משום נענוע הספינה ולא יוכלו למעבד עונג שבת » (בית יוסף אורח חיים רמ״ח). And he immediately draws the consequence that explains the leniency for a mitzvah: « והיינו טעמא שלכל דבר מצוה שרי משום דפטירי ממצות עונג שבת דהעוסק במצוה פטור מן המצוה » (בית יוסף אורח חיים רמ״ח).

Explanation II — משום איסור תחומין (the יש מפרשים of the Tur)

The Tur, in the name of the The underlying principle is that there is no techum above ten tefachim: a ship sailing more than ten tefachim above the bed escapes the prohibition. The Beit Yosef traces this reading to Rabbenu Chananel, and the Hagahot Maimoniot give it in the name of Rabbenu Tam.
The Yereim, through the Bach and the Magen Avraham — the ten tefachim are measured from the bottom of the ship to the bed of the river, and the Magen Avraham cites the Sefer Yereim there: « וכ״כ הב״ח בשם ספר היראים (ומ״מ בספר היראים משמע דשרי ביושב למעלה) » (מגן אברהם רמ״ח ס״ק ז). The Mishnah Berurah records the same hesitation: « ויש מתירין כשהוא יושב למעלה מיו״ד טפחים ואין רגליו תלויות למטה מיו״ד טפחים ויש לסמוך על דבריהם כשהוא צריך לכך » (משנה ברורה רמ״ח ס״ק י״ד).

(Raza'h, Rivash)

The Raza'h, as reported by the Ran — the Beit Yosef writes: « והר״ן בפ״ק דשבת כתב טעם אחר בשם הרז״ה דים מקום סכנה הוא וג׳ ימים קודם השבת קמי שבתא מיקרי » (בית יוסף אורח חיים רמ״ח), and he continues: « ונראה כמתנה לדחות את השבת מפני שאין דבר שעומד בפני פקוח נפש » (בית יוסף אורח חיים רמ״ח). To put to sea within the three days is to place oneself where Shabbat will have to be pushed aside.
The Rivash — the Beit Yosef reports his responsum on this reading of the Raza'h at length; the Rama cites him twice in this siman, at seif א and at seif ב, with his reference: ריב״ש סי׳ קנ״ב. The Mishnah Berurah likewise places in this family the explanation from the fear of melachah: « י״א הטעם שמא יצטרך הישראל לעשות מלאכה בעצמו בשבת משום פיקוח נפש דמקום סכנה הוא » (משנה ברורה רמ״ח, הקדמה).

The yesod: these explanations are not variants of one idea — in places they contradict one another, and the Mishnah Berurah shows it by reporting the objection the Rif raises against the other two, and the reason he himself holds: « והרי״ף ס״ל דאי משום חשש מלאכה או תחומין ודאי היה אסור אף קודם ג׳ ימים וגם לדבר מצוה לא היה מותר אלא דעיקר האיסור משום ביטול מצות עונג שבת… And yet the Mishnah Berurah concludes that the Mechaber, while following the Rif at seif ב, also holds at seif ד what the others hold: « והנה המחבר אף שנמשך בס״ב אחר הרי״ף שהעתיק פירושו » (משנה ברורה רמ״ח, הקדמה) — and nevertheless he rules like those who permit before the three days. The final psak therefore aggregates the criteria without merging them.

3. Nafka minos among the explanations

Practical consequences that distinguish the reasons:

CaseBy I (עונג)By II (תחומין)By III (סכנה)
Flowing riverPermitted — no צער (seif ב)Depends on the depthPermitted if there is no danger
Salt sea, deep waterForbidden for 3 daysPermitted — above י׳ טפחיםForbidden
Salt sea, shallow waterForbiddenForbiddenForbidden
Ship moved for non-JewsNo bearing on the צערNo bearing on the measureEases the fear of melachah (seif ב, הגה)

The fourth row is the one that separates them best: the Rama, at seif ב, forbids precisely the ship שיצטרך הישראל לבא לידי מלאכה בשבת (רמ״א אורח חיים רמ״ח:ב), which only makes sense within the third family of explanations.

4. The shitah of the Rif and the Rosh —

The basis of the explanation

This position rests on a fact of experience: in antiquity as in the Middle Ages, the crossing was a physical ordeal. The Tur, reporting the Rif, puts it briefly — the body is משתבר, and אין רוחו חוזרת before three days. After that, a man grows used to it and can once more fulfil עונג שבת.

What confirms this position: the Mechaber himself, at seif ב, gives this reason and no other — « הטעם משום עונג שבת שכל שלשה ימים הראשונים יש להם צער ובלבול » (שולחן ערוך אורח חיים רמ״ח:ב) — and from it he draws at once the distinction between sea and river: « ודוקא למפליגים במים המלוחים אבל בנהרות אין שום צער למפליגים בהם ולפיכך מותר להפליג בהם אפילו בערב שבת » (שולחן ערוך אורח חיים רמ״ח:ב).

Kashya on this position

Kashya 1: if the reason is עונג שבת, why does a mitzvah lift the prohibition? One who travels for a mitzvah will be deprived of עונג exactly as much as one who travels for his own pleasure. The reason should apply to him in precisely the same way.

Kashya 2: if the reason is עונג, it should have been permitted to one accustomed to the sea who does not suffer from it. Why does the law not draw that distinction?

Teretz to the first: this is exactly where the Beit Yosef places the key — « והיינו טעמא שלכל דבר מצוה שרי משום דפטירי ממצות עונג שבת דהעוסק במצוה פטור מן המצוה » (בית יוסף אורח חיים רמ״ח). The Magen Avraham restates it in one line: « ולדבר מצוה שרי שהעוסק במצוה פטור מן המצוה » (מגן אברהם רמ״ח ס״ק ו). And the Mishnah Berurah states the matter outright: « היינו אף דבודאי לא יקיים עונג שבת עי״ז כמ״ש המחבר בס״ב אפ״ה מותר כיון דלצורך מצוה הוא וקי״ל דעוסק במצוה פטור מן המצוה » (משנה ברורה רמ״ח ס״ק א). The prohibition is not lifted because the suffering would vanish: it is lifted because the obligation of עונג no longer rests on that man.

Teretz to the second: the Shulchan Arukh does not rule here according to the individual but according to the setting — salt water or river (seif ב). The criterion is objective, not subjective. The poskim of this siman do not discuss the case of a man hardened to the sea; the question therefore remains open, and there is no ground to decide it here.

5. The explanation from תחומין — and where the Ramban really stands

The basis of the explanation

The יש מפרשים of the Tur ground the prohibition in the din of תחומין. The rule is that there is no techum above ten tefachim (the question is raised at עירובין מ״ג., and the Rishonim divide over its outcome). If the ship sails more than ten tefachim above the bed, there is no prohibition of techumin; if it scrapes the bed, there is.

How the Mechaber sets the measure: « אבל במקום שידוע לנו שמקרקע הספינ׳ לקרקע הנהר פחות מעשר׳ טפחים אסור » (שולחן ערוך אורח חיים רמ״ח:ב). The measure is therefore taken not from the surface of the water but from the bottom of the ship to the bed of the river — and the Magen Avraham ס״ק ז and the Mishnah Berurah ס״ק י״ד discuss the case where the man himself is seated above ten tefachim.

Kashya on this position

Kashya: if the reason is the techum, why does the brayta speak of "three days"? The prohibition of techumin falls on Shabbat itself, not on the eve. » (משנה ברורה רמ״ח, הקדמה) — were it the techum, it would have to be forbidden even well before the three days, and even for a mitzvah; which is why the Rif places the core of the prohibition in the loss of עונג שבת.

Teretz of the Mishnah Berurah: for these poskim the three-day cut does not come from the reason itself but from the calendar — « הוא משום דשלשה ימים קודם שבת מקרי קמא שבתא וחל עליו להזהר שלא יבוא לידי חילול שבת אבל קודם ג׳ ימים דהם מקרי בתר שבת העבר עדיין לא חל עליו אזהרת שבת הבאה ושרי להפליג בהם » (משנה ברורה רמ״ח, הקדמה). The last three days already belong to the Shabbat that is coming; those before belong still to the Shabbat that has passed.

And the Ramban gives a wholly separate reason. The Beit Yosef reports it in the name of the Ran and Rabbenu Yeruham: the prohibition rests on the fact that one appears to be stipulating with the non-Jew for the desecration of Shabbat — « מפני שנראה כמי שמתנה עם העכו״ם לחלל שבת » (בית יוסף אורח חיים רמ״ח). He draws from it a far-reaching consequence: where the ship would have sailed in any case without the Jew, the non-Jew works for himself and nothing appears. As to techumin above ten tefachim, the Beit Yosef ranks the Ramban and the Rashba among the lenient — which forbids making the Ramban a proponent of the explanation from techumin.

6. The explanation from סכנה and פיקוח נפש

The basis of the explanation

For the Raza'h — reported by the Ran, and then by the Beit Yosef — the sea is a מקום סכנה. Within the three days before Shabbat, to embark is to place oneself deliberately where Shabbat will have to be set aside for פיקוח נפש. It is not that the rescue would be forbidden: it is that one has no business arranging in advance the situation that will require it.

The reasoning itself: פיקוח נפש sets Shabbat aside — but the Beit Yosef, citing the Raza'h, gives the turn of the matter: « ונראה כמתנה לדחות את השבת מפני שאין דבר שעומד בפני פקוח נפש » (בית יוסף אורח חיים רמ״ח). It is the very fact that nothing stands before פיקוח נפש that makes deliberate entry into the situation suspect.

What supports this position

Supports for this position, in the apparatus of the siman and in the body of the siman itself:

The Vilna Gaon reads the brayta according to the Raza'h, and says so expressly: «

The Taz gives the division of the calendar on which the whole family rests: «

The Mishnah Berurah takes up that division and draws the obligation from it: « הטעם כמו שכתבנו למעלה דשלשה ימים קודם השבת שייכים לשבת הבא וחל עליו להזהר שלא יבוא לידי חילול שבת » (משנה ברורה רמ״ח ס״ק ח).

Finally, the Rama attached this family to the Rivash in the body of the siman itself, at seif

7. The גדר of דבר מצוה — Rabbenu Tam, the Beit Yosef, the Taz

Rabbenu Tam's broad position

Rabbenu Tam, as reported by the Tur — « ולענין דבר מצוה פר״ת שכל מקום שאדם הולך כגון לסחורה או לראות פני חבירו » (טור אורח חיים רמ״ח), and the continuation: « חשיב הכל דבר מצוה ואין חשובה דבר הרשות אלא כשהולך לטייל » (טור אורח חיים רמ״ח).

The broadening is considerable. Rabbenu Tam reduces דבר הרשות to the pleasure trip alone; everything else — commerce, visiting, livelihood — falls under דבר מצוה. It is the Rama, and not the Mechaber, who brings this position into the Shulchan Arukh, at seif ד and as a יש אומרים: « י״א שכל מקום שאדם הולך לסחורה או לראות פני חבירו חשוב הכל דבר מצוה ואינו חשוב דבר הרשות רק כשהולך לטייל » (רמ״א אורח חיים רמ״ח:ד).

This must be watched closely: that sentence lives in the Rama's gloss, inside seif ד. It is not the Mechaber's: in this siman, the Mechaber does not adopt Rabbenu Tam's extension.

The Beit Yosef's objection — he denies that all the poskim follow Rabbenu Tam, and argues from the consequence: if going to trade were a mitzvah, « א״כ פטרת את כל העולם ממצות… » — whence his conclusion: « אלא ודאי לית להו הא דר״ת » (בית יוסף אורח חיים רמ״ח). And he reports the Rivash to the same effect: « וכ״כ הריב״ש בתשובה שזה שכתב רבינו בשם ר״ת קולא יתירא היא ומ״מ כתב שלעלות לא״י הוי שפיר לדבר מצוה » (בית יוסף אורח חיים רמ״ח).

The Taz's difficulty — and the answer he gives to it

The Taz, on the Rama's words חשוב הכל דבר מצוה, raises a contradiction with the laws of Pesach: « קשה מ״ש מההיא דסי׳ תמ״ד לענין חמץ בביתו דלא חשיב דבר מצוה אלא בהולך למול בנו » (ט״ז אורח חיים רמ״ח ס״ק ה). There, only a mitzvah in the strict sense exempts one from turning back.

The Taz's answer: « וצ״ל דשאני חומרא דחמץ שצריך הרחק׳ יתירה כיון שאדם רגיל בו ע״כ החמירו בו יותר » (ט״ז אורח חיים רמ״ח ס״ק ה). Chametz calls for an exceptional distancing because a man is accustomed to it; the stringency of תמ״ד is its own and does not carry over here. The Taz therefore resolves the difficulty in favour of the Rama's gloss, and does not set himself against Rabbenu Tam.

The chakira at the root of the dispute:

a) First way — for Rabbenu Tam, דבר מצוה denotes whatever is not sheer personal pleasure: what serves others, what secures a livelihood, what answers a duty towards a fellow.

b) Second way — for the Beit Yosef and the Rivash, דבר מצוה keeps its narrow sense: a genuine mitzvah. The proof they bring is methodological — were the broad reading correct, the Rishonim would not have had to look for other reasons to justify the practice of putting to sea on Friday.

Where the decision lies: the Mechaber does not bring Rabbenu Tam's extension; the Rama gives it as a יש אומרים and adds, about the practice that relies on it, « ואין למחות בידן הואיל ויש להם על מי שיסמוכו » (רמ״א אורח חיים רמ״ח:ד). The Mishnah Berurah, which closes the siman, narrows it by exactly as much: « אבל במקום שלא נהגו להקל אין כדאי לכתחלה להקל דכמה פוסקים סוברים דבעינן מצוה גמורה » (משנה ברורה רמ״ח ס״ק ל״ו). The leniency rests on established practice, not on the definition.

8. The sugya of ופוסק עמו שישבות

The dispute of רבי and רשב״ג

PositionMust one stipulate? And if he does not rest?
No, it is not neededאין בכך כלום

The halakhic decision

The Tur rules like

The Rambam, according to the Beit Yosef, rules the other way: « ומ״ש רבינו דהלכה כרשב״ג אין כן דעת הרמב״ם שבפרק כ״ד ופ״ל פסק כת״ק » (בית יוסף אורח חיים רמ״ח).

The Mechaber writes the stipulation into the body of seif א — ופוסק עמו שישבות — and the Taz states at once where it comes from and how far it reaches: « זה דעת הרמב״ם ונ״ל דהך ופוסק לא קאי דוקא על ע״ש אלא אפי׳ קודם שבת תוך ג׳ ימים » (ט״ז אורח חיים רמ״ח ס״ק א).

Chakira: what is the פסיקה at bottom? If one can do without it after the fact, what does it mean?

And here is the measure the siman itself supplies — this is the nafka mina promised at section 1. The Mishnah Berurah answers twice, in opposite senses, according to whether the ship or the caravan is at issue:

On the ship, at seif

On the caravan, at seif

The contrast is too sharp to be accidental, and it is not resolved here: the Mishnah Berurah refers to the Biur Halachah for the caravan. What can be said without adding anything to the source is that the word פסיקה does not cover the same thing in the two seifim, and that any account of the גדר of the פסיקה must answer for that gap.

9. The shitah of the Bahag on קניית שביתה

The Bahag, as reported by the Tur — « ובה״ג כתב אם קנה שביתה בספינה מע״ש מותר ליכנס בה אפילו בשבת » (טור אורח חיים רמ״ח). If a man entered the ship on erev Shabbat and acquired his שביתה there, the ship becomes his Shabbat place: he may enter it on Shabbat itself and put to sea.

The Mechaber adopts this at seif ג: « היכא דמותר להפליג מערב שבת אם נכנס בספינה מערב שבת וקנה בה שביתה אף על פי שמפלגת בשבת מותר » (שולחן ערוך אורח חיים רמ״ח:ג) — with one condition: « והוא שלא יצא מהספינה מעת שקנה שביתה » (שולחן ערוך אורח חיים רמ״ח:ג). And the Mishnah Berurah defines what acquiring שביתה is: « היינו שישב שם כל בין השמשות עד שתחשך » (משנה ברורה רמ״ח ס״ק כ).

The dispute of the Ri and the Bahag

The Ri (Tosafot) disputes the Bahag and forbids even after שביתה has been acquired. The Tur reports it: « ור״י אסר הכל אפילו בתוך התחום מפני שהוא נראה שט על פני המים שהוא אסור » (טור אורח חיים רמ״ח), and Tosafot on the spot say the same, resting it on the case in פרק תולין, from which they infer that even inside the techum, without הערמה, it is forbidden: « אין מפליגין בספינה - אפילו תוך התחום אסור משום שט…

The Bahag permits. The reasoning, as the Mishnah Berurah renders it in the name of this position: « דאל״ה אסור ליכנס בה בשבת מפני שנראה כשט ע״פ המים » (משנה ברורה רמ״ח ס״ק כ״א) — that is, the קניית שביתה removes precisely the appearance of שט, the ship having become his home.

The Mishnah Berurah in fact recalls that this explanation from שט is one of the reasons given for the brayta itself: « וי״א דהטעם שאסרו להפליג בספינה הוא מפני שנראה כאלו צף ושט ע״פ המים בשבת » (משנה ברורה רמ״ח, הקדמה).

Nafka mina: on this dispute hangs the practice of making קידוש in the ship on erev Shabbat, then going home to sleep and returning the next day. The Rama reports it at seif ג, in the second of his two יש אומרים: « וי״א שעושין קידוש בספינה ואח״כ חוזרים לביתם ולנים שם ולמחר חוזרין לספינה ומפליגין כן נהגו בקצת מקומות ואין למחות » (רמ״א אורח חיים רמ״ח:ג).

The sources the Rama himself gives for the practice are ר״ן פ״ק דשבת וריב״ש סי׳ י״ז קכ״א קכ״ב — and the Beit Yosef notes that it was indeed the Ran who put the Bahag's sevara in writing: « ודע שסברא זו דבה״ג כתבה הר״ן בפ״ק דשבת » (בית יוסף אורח חיים רמ״ח).

The Mishnah Berurah moreover restores the קידוש to its exact role — it does not create the שביתה, it publicises it: « אלא שסוברין דלכתחלה נכון לעשות שם ג״כ קידוש ולאכול מעט כדי לפרסם הדבר שקנו שם שביתה » (משנה ברורה רמ״ח ס״ק כ״ד).

10. The sugya of מצור לצידון — the kula of a one-day journey

The wording of the brayta

« וּמִצּוֹר לְצִידֹן — אֲפִילּוּ בְּעֶרֶב שַׁבָּת מוּתָּר. »

This clause of the brayta adds a decisive kula: if the journey is short enough that one can arrive before Shabbat, the crossing is permitted even on Friday morning. Rashi had already given the measure of the journey — אין אלא מהלך יום.

How the Mechaber takes it up

The Mechaber, in the body of seif א — and not in a gloss of the Rama: « ואם הוא דרך מועט כמו מצור לצידון שאין ביניהם כי אם מהלך יום אחד מות׳ להפליג בע״ש בבקר מפני שאפשר שיגיע שם קודם השבת » (שולחן ערוך אורח חיים רמ״ח:א).

The גדר of this kula: if the man can arrive before Shabbat, he steps out of the whole problem — no desecration on his part, no צער of the crossing, no deliberate entry into danger. Such a crossing is simply not included in the prohibition of the brayta.

But the kula is not without limits, and the siman lays some down. One is the hour of departure, which the Mishnah Berurah tightens: « דאם ימשך שעה ושתים על היום אסור דלא יגיע לשם קודם השבת » (משנה ברורה רמ״ח ס״ק י). Another is local custom, which the Mechaber lays down at the close of seif

11. The shitah of the Rambam — Hilkhot Shabbat, chapter 30

The continuation of the same halakhah — « וְלִדְבַר מִצְוָה מַפְלִיג בַּיָּם אֲפִלּוּ בְּעֶרֶב שַׁבָּת.

Three observations, and one chakira:

1. The reason the Rambam gives is that of צער — כְּדֵי שֶׁתִּתְיַשֵּׁב דַּעְתּוֹ עָלָיו — that is, the first of the three explanations, the Rif's.

2. The Rambam does not drop the clause וְאֵינוֹ שׁוֹבֵת: he writes it. He therefore keeps together the requirement to stipulate and the indifference to whether the non-Jew actually rests.

3. On מצור לצידון the Rambam is broader than the brayta suggested: he permits אֲפִלּוּ לִדְבַר הָרְשׁוּת.

The chakira: why does the Rambam require the stipulation, when the Tur rules that רשב״ג dispenses with it? The Beit Yosef puts the question in these terms: « ומ״ש רבינו דהלכה כרשב״ג אין כן דעת הרמב״ם שבפרק כ״ד ופ״ל פסק כת״ק » (בית יוסף אורח חיים רמ״ח). The Taz, for his part, identifies the source of what the Mechaber wrote — « זה דעת הרמב״ם » (ט״ז אורח חיים רמ״ח ס״ק א) — and extends its reach to all three days, and not to Friday alone. The Beit Yosef does not resolve this divergence in the siman; it remains open, and it is what explains why the Mechaber writes a stipulation the Tur held superfluous.

12. The psak of the Acharonim — Taz, Magen Avraham, Vilna Gaon, Mishnah Berurah

Taz

Taz — his ס״ק א traces the Mechaber's stipulation to the Rambam and extends its reach to the three days. His ס״ק ג gives the division of the calendar: « הטעם דג״י קודם השבת שייכים לשבת הבא וקודם לזה שייכים לשבת שעבר » (ט״ז אורח חיים רמ״ח ס״ק ג). His ס״ק ה raises the contradiction with chametz and resolves it in favour of the Rama's gloss.

Magen Avraham

Magen Avraham — on לדבר מצוה of seif א: « אבל בשבת אסור דהא לא יוכל לפסוק עמו שישבות » (מגן אברהם רמ״ח ס״ק א); on Shabbat itself the prohibition stands, even for a mitzvah, since the stipulation is no longer possible. On the counting of the three days: « דהיינו ביום רביעי בשבת אסור » (מגן אברהם רמ״ח ס״ק ב). And on why a mitzvah permits: « ולדבר מצוה שרי שהעוסק במצוה פטור מן המצוה » (מגן אברהם רמ״ח ס״ק ו).

Vilna Gaon

ביאור הגר״א — on seif א he opens precisely on the question of Wednesday: « אפי׳ בספינה. ל״ד קודם דאפי׳ תוך ג״י מותר » (ביאור הגר״א אורח חיים רמ״ח, סעיף א), then sets the Ran and the Raza'h — for whom all three days are forbidden, Wednesday included — against the Rosh, from whom it emerges that Wednesday is permitted, and he invokes the Tosefta and the Yerushalmi: « וכ״ה להדיא בתוספתא הביאו הרא״ש שם דבש״א אף ברביעי » (ביאור הגר״א אורח חיים רמ״ח, סעיף א).

Mishnah Berurah

Mishnah Berurah — the siman carries an introduction, which is unnumbered, followed by thirty-six ס״ק. On Wednesday it does not decide: it reports both sides. « דהיינו ביום רביעי בשבת אסור [מ״א בשם הרבה אחרונים] » (משנה ברורה רמ״ח ס״ק ד) Then, in the same ס״ק: « אבל הגר״א הביא בשם הרבה ראשונים דהג׳ ימים נחשבין עם השבת גופא וביום רביעי מותר » (משנה ברורה רמ״ח ס״ק ד).

A word on this last point, because it is easy to get wrong: the lenient reading of Wednesday is not a personal, isolated position of the Vilna Gaon. The Mishnah Berurah attributes it to him expressly בשם הרבה ראשונים — "in the name of many Rishonim". And the Mishnah Berurah does not choose between the two.

The line of psak

What the siman decides, and on what condition:

Modern nafka minos

What follows is not a psak: siman רמ״ח speaks of the ship and the caravan, and modern cases fall under it only by weighing each of the reasons above. For practice, ask a rav.

1. A long flight on erev Shabbat: the aircraft is far above ten tefachim, which removes the reason from techumin; the צער of the sea crossing is no longer the same, though there is discomfort of another kind; and the question of melachah on arrival remains entirely open. The three reasons therefore do not return the same verdict, and it is the reason one adopts that decides.
2. A night train: this is no הפלגה, and the siman does not treat of it. But one should not conclude that there is no question here at all: the Taz refers to the distinct prohibition of הליכה בקרון at siman ש״ה, on quite another ground — « הטעם דהליכה בקרון אסור בסימן ש״ה מטעם שמא ירד מן הקרון וילך באיסור וזה אין שייך כאן » (ט״ז אורח חיים רמ״ח ס״ק ד).
3. A pleasure cruise: salt water, צער, danger — the three reasons apply together, and this is a דבר הרשות in the narrowest sense, the one Rabbenu Tam himself acknowledged: כשהולך לטייל.
4. Going up to Eretz Yisrael: seif ד treats it expressly as a דבר מצוה — with the condition of the פסיקה recalled above.
5. A business trip by car: neither הפלגה nor שיירא במדבר; the siman says nothing of it. The question of דבר מצוה just read remains, however, the one that governs the debate, as the Mishnah Berurah ס״ק ל״ב recalls in the name of the Magen Avraham: « וכתב המ״א דדוקא כשהלך לדבר מצוה גמורה ולא כשהלך לסחורה » (משנה ברורה רמ״ח ס״ק ל״ב).
