1. The central axiom
An object worn on the body on Shabbos is permitted if it is a תכשיט (jewelry), מלבוש (garment worn in the normal manner) or רפואה (treatment attached). It is forbidden מן התורה — chayav chatas — if it is משא (a burden). The whole siman boils down to classifying each object into one of these 4 boxes.
2. The key concepts condensed
| Concept | Definition | Application |
|---|---|---|
| הוצאה | Transferring from one domain to another, or 4 amos in the רה״ר | The 39th melachah — Shemos 16:29 |
| דרך מלבוש | "In the normal manner of wearing" | Criterion of permissibility |
| תכשיט | Jewelry / ornament | Permitted if well secured |
| משא | Burden, load | Forbidden מן התורה — chayav chatas |
| שמא יפול ויביאנו | "Lest it fall and be carried" | Rabbinic gezeirah on removable jewelry |
| ביטול לבגד | Object nullified to the garment | Sewn/attached → treated as part of the beged |
3. Hierarchy of cases — from permitted to chayav chatas
4. Decision tree
5. The heart of the siman: the gezeirah שֶׁמָּא יִפּוֹל
The most delicate point of the whole siman is not the משא — an object carried by hand is forbidden מן התורה, that is obvious. The real difficulty is the intermediate category: an object that is truly a תכשיט or a מלבוש, hence permitted מן התורה, and which Chazal nevertheless forbade מדרבנן for fear it would fall and then be carried by hand — שֶׁמָּא יִפּוֹל וְיָבוֹא לְהָבִיא אַרְבַּע אַמּוֹת בִּרְשׁוּת הָרַבִּים.
Why does this gezeirah not strike every object?
The logic of Chazal is psychological, not mechanical. The gezeirah only targets objects that the person is likely to remove themselves in the street. Hence the classic rule: lavish jewelry that the woman removes to show a friend falls under the gezeirah; a plain man's ring, which there is no reason to remove, does not. The criterion is therefore not "can the object fall?" but "does the user have a usual reason to detach it?".
The limit case: where does the gezeirah stop?
This is where the siman is decided. Three dividing lines to remember:
- Well-secured jewelry vs removable. A wristwatch firmly buckled is not at risk of voluntary manipulation; a precious bracelet that one undoes to admire — yes.
- Man vs woman. The gezeirah is applied more broadly to feminine adornment, because women "display" their jewelry more — direct nafka mina on the ring and the necklace.
- תכשיט vs רפואה. An attached treatment (bandage, splint) does not fall under the gezeirah: one does not remove a bandage to display it; it remains permitted as long as it heals.
6. Mnemonic "תמ"ר משא"
ת — Takhshit (תכשיט): well-secured jewelry → permitted
מ — Malbush (מלבוש): garment worn normally → permitted
ר — Refu'ah (רפואה): bandage, treatment → permitted
מ — Massa (משא): burden → forbidden, chayav chatas
— If you can classify the object, you know the halacha.
7. Pitfalls to avoid
8. Practical contemporary cases
| Situation | Category | Conduct |
|---|---|---|
| Mechanical wristwatch | תכשיט / מלבוש | Permitted |
| Smartwatch (Apple Watch) | Multi-problem: electricity, writing, כתב | Forbidden |
| Eyeglasses / sunglasses | Utilitarian תכשיט | Permitted (consensus) |
| Tissue / Kleenex in hand or pocket | משא | Forbidden outside an eruv |
| Tissue tied to pants | מלבוש (nullified to garment) | Permitted |
| Key on key-ring pendant | Utilitarian תכשיט (machlokes) | Per poskim — Rama permits |
| Cast / splint / bandage | רפואה | Permitted (seif 22, 51) |
| Backpack / pocket kippah | משא | Forbidden outside an eruv |
| Umbrella | משא (= ohel + carrying) | Absolutely forbidden |
9. Final synthesis table
| Element | Detail |
|---|---|
| Topic of the siman | Hotzaah — objects worn on the body on Shabbos |
| Number of seifim | 51 (one of the longest in Hilchos Shabbos) |
| Mishnah Berurah | 182 entries |
| Biblical source | אַל יֵצֵא אִישׁ מִמְּקֹמוֹ (Shemos 16:29) |
| Main Talmudic source | Masechet Shabbos ch. 6 (במה אשה) and ch. 17 |
| Halachic categories | תכשיט / מלבוש / רפואה / משא (seif 7) |
| Penalty | Chayav chatas מן התורה for משא; patur aval asur for תכשיט שאין דרך |
| Practical decision | Without an eruv: only what is clearly מלבוש or well-secured תכשיט |
10. The practical commandments of Siman ש"א
Going out on Shabbos — checklist
- Check the eruv of your area before each outing.
- Ask yourself the 4 boxes: תכשיט / מלבוש / רפואה / משא?
- If it's משא outside an eruv — don't go out with it.
- Garments כדרך מלבוש — not folded on shoulder, not in a bag.
- No running on Shabbos (seif 1) — except for a davar mitzvah.
- Removable jewelry on women: caution and consult a Rav.
- For pilpul — see Level 2 — Lamdan.
- For the Chabad shitah — see Level 4 — Daas HaRav.
