1. The central Axiom

Siman 310 in one sentence.
Closure of the muktzeh block (simanim 308-309-310) with 9 key cases: (1) rules per Rabbi Shimon on machmas mi'us = permitted; (2) no edible food is muktzeh except exception; (3) introduces hachana mei-erev Shabbat and nolad; (4) rules mixed basis by importance. Golden rule: הוקצה למקצת השבת — הוקצה לכל השבת.

2. Key concepts

ConceptDefinitionApplication
מוקצה מחמת מיאוס"Muktzeh by disgust"Halacha per R. Shimon = permitted
הכנה מערב שבת"Preparation from before"Without directed intent = muktzeh
נולד"Born Shabbat"Egg laid, fruit fallen = absolute muktzeh
דחה בידיים + לא חזו"Set aside + not edible"The 2 criteria of food muktzeh
הוקצה למקצת השבת"Set aside for part"= for the whole Shabbat
בסיס לאיסור ולהיתר"Mixed basis"By relative importance

3. Hierarchy

1. Edible food (date, almond) → freely permitted.
2. Useful but repulsive object → permitted (R. Shimon).
3. Food in transformation, intentionally set aside (drying figs) → muktzeh.
4. Egg laid / fruit fallen / ash formed Shabbat (nolad) → absolute muktzeh.
5. Basis with muktzeh + heter → by importance.

4. Decision tree

Q1: Is it edible food now?
If YES → permitted.
If NO → is it nolad?
If YES → absolute muktzeh.
If NO → was it prepared (hachana) before Shabbat?
If YES → permitted. If NO → muktzeh.

5. Basis l'heter v'l'isur — the dual-load object

The most delicate case is the basis supporting both a permitted object and a forbidden object (seif 8). A tray carrying food and coins: is the tray muktzeh?

The decisive criterion: relative importance

Everything depends on which of the two is primary (חשוב) in the owner's eyes:

The heter is primary (food matters more than coins) → tray not muktzeh.
The isur is primary (coins matter more) → tray becomes basis.
Equal importance, or doubt → stringent: tray is muktzeh (Mishnah Berurah).

The edge case: moment of placement

Basis status crystallizes at the onset of Shabbat. For the heter to "save" the tray, the permitted object must have been placed before Shabbat with intent to remain. A heter placed during Shabbat does not retroact: a tray that was basis in the morning remains so all day — הוקצה למקצת השבת — הוקצה לכל השבת.

Reasoning to remember: basis is not a third category — it is a permitted object contaminated by the load it bears. As soon as the heter it carries is deemed more important, contamination doesn't take: the tray returns to being a simple utensil.

6. Mnemonic "הנ"מ"

הHachana (הכנה) — directed preparation before Shabbat.

נNolad (נולד) — born Shabbat = absolute muktzeh.

מMi'us (מיאוס) — disgust = permitted (R. Shimon).

— Plus the meta principle: "הוקצה למקצת השבת = הוקצה לכל השבת".

7. Pitfalls

Pitfall 1 — Eggs laid Shabbat: nolad. Absolute muktzeh.
Pitfall 2 — Fruits picked Shabbat: nolad. Absolute muktzeh.
Pitfall 3 — Ashes from fire: nolad. Don't move.
Pitfall 4 — Tray with currency and food: by importance.
Pitfall 5 — Over-relying on Rama for non-Jew: with us (Jews), hachana stands.

8. Modern practical cases

10. The practical directives of Siman 310

Closure of the muktzeh block — final checklist

  1. Edible foods on Shabbat = not muktzeh.
  2. Muktzeh machmas mi'us = permitted (Rabbi Shimon).
  3. Nolad (egg, fruit, ash) = absolute muktzeh.
  4. Hachana mei-erev Shabbat necessary.
  5. Basis l'heter v'l'isur = by importance; doubt → muktzeh.
  6. Hachana doesn't apply to non-Jew (Rama).
  7. "Hoktzah l'miktzas Shabbat = hoktzah l'chol Shabbat".
  8. In doubt on edge case → ask the Rav.
