Daat HaRav — The Alter Rebbe's Shulchan Aruch on Siman 310

The shita of the Alter Rebbe on the 20 seifim of muktzeh laws — closure of the muktzeh block. Conceptual framework: hachana as principle of designation.

Why a Level 4 dedicated to the Alter Rebbe? The Alter Rebbe's Shulchan Aruch is not a commentary on the Mechaber — it is an autonomous and complete Shulchan Aruch, combining halacha + ta'amei hamitzvos + inner dimension.

For Chabad, the Alter Rebbe is the final posek.

The laws of muktzeh on Shabbos — and it contains 20 seifim:

It has already been explained in siman 308 that muktzeh mei-chamas mi'us (muktzeh because of repulsiveness) is permitted; therefore a stick on which one hangs fish to dry them, even though it is repulsive — it is permitted to move it:

Anything fit for eating on Shabbos has no law of muktzeh, even if it stands for trade, such as dates, almonds and other fruits that stand to be taken elsewhere for trade — it is permitted to eat from them on Shabbos.

And even if he actively set them aside (dachah osam beyadayim) from eating them on Shabbos, such as wheat that he sowed in the ground — it is permitted to eat from them on Shabbos if they have not yet taken root. Likewise eggs that were placed under a hen to raise chicks — it is permitted to move them. And likewise dates picked before ripening and gathered into baskets, where they ripen by themselves — it is permitted to eat from them before their ripening is complete.

And likewise all kinds of fruits that are placed in the drying place (muktzeh) to dry them — it is permitted to eat from them before they dry. Except for dried figs (gerogros) and raisins (tzimukim), which it is forbidden to eat or move once placed to dry, until they have completely dried, because they become malodorous in the meantime and are not fit for eating once they have stayed there a little, until they have completely dried; therefore they are forbidden on Shabbos on account of muktzeh.

Needless to say if they are entirely unfit, for then they are worse than any muktzeh, since they are like stones and earth, and even designation (hazmanah) while it was still day does not avail for them, as will be explained. But even if they are fit-and-not-fit — some people eat them and some do not — they are nevertheless forbidden on account of muktzeh: since he actively set them aside, they do not leave their state of being set aside (dechiyah) until they are entirely fit.

And they are not like other things he actively set aside, which are permitted; for although he actively set those aside, he nevertheless did not remove his mind from them entirely. This is not so with dried figs and raisins that he set out to dry: since he knew that they would become malodorous, he set his mind entirely away from them until they would completely dry and be well prepared, fit for everyone. And although now, on Shabbos, he changes his mind to eat them — they do not become prepared (muchanim) thereby, since they were muktzeh by his intent from the beginning of Shabbos, as will be explained: for anything set aside by a person's intent at bein hashemashos is set aside for the whole of Shabbos:

Of what does this speak? Of the dried figs and raisins of a Jew; but the dried figs and raisins of a non-Jew are permitted even if they are fit-and-not-fit, for there is no law of muktzeh regarding [items] of a non-Jew, because everything is prepared with him: the non-Jew does not set anything aside and his mind is on everything; and since it is prepared for one person, it is prepared for everyone.

Of what does this speak? Of a detached thing; but something attached that was detached on Shabbos — even if it belongs to a non-Jew who detached it for himself, and even if the non-Jew had in mind while it was still day to detach these fruits on Shabbos, for example if he heard the non-Jew say on Erev Shabbos “Tomorrow I will detach these fruits,” and even if they are fruits whose ripening is complete, for which preparation (hachanah) is effective even while they are still attached, as will be explained in siman 318 — they are nevertheless forbidden in eating and in tiltul on account of the decree of fallen fruits (peiros ha-noshrin) that will be explained in siman 322, as will be explained in siman 325.

And a thing that still required trapping (tzeidah) while it was still day, and the non-Jew trapped it on Shabbos — even if he had in mind to trap it on Shabbos, his intent avails nothing, for the matter does not depend on him; and it is forbidden on Shabbos on account of muktzeh, for since it was not in the possession of any person at all, it is not among what is prepared:

Every object that was forbidden in tiltul at bein hashemashos, and on Shabbos the thing causing its prohibition went away — for example, an object that was muktzeh at bein hashemashos on account of a prohibition, that is, because of some prohibition it was forbidden to eat and was not fit for anything at bein hashemashos, so that it was muktzeh and forbidden in tiltul, and on Shabbos the prohibition departed from it and it became fit — it is nevertheless forbidden to move it throughout all of Shabbos.

Of what does this speak? When a person actively set it aside, that is, the person actively caused its prohibition — for example, a lamp that he lit while it was still day and that went out after bein hashemashos, and oil remained in it: this oil was set aside by human action from being fit on Shabbos, for when he lit it, it became forbidden to make use of it on Shabbos on account of the prohibition of extinguishing. Therefore it is forbidden to make use of it even after the lamp has gone out and the prohibition has departed: since at bein hashemashos, which is the beginning of the entry of Shabbos, it was muktzeh by the intent of the person, who set it aside by his intent when he caused its prohibition — it is set aside for the whole of Shabbos:

Similarly, an object that was not fit at bein hashemashos on account of itself and not because of any prohibition, and became fit after nightfall — it is forbidden in tiltul throughout all of Shabbos if it was set aside by human action from being fit at bein hashemashos; for example, dried figs and raisins that were not fit at bein hashemashos and on Shabbos dried completely and became fit: since at bein hashemashos they were muktzeh by the intent of the person, who set them aside by his intent when he brought them in to dry them — they are set aside for the whole of Shabbos:

But an object that was muktzeh at bein hashemashos against a person's will — has not been set aside for all of Shabbos. For example, an object that was muktzeh on account of a prohibition that came about by itself and not through human causation, and after nightfall the prohibition departed — there is no longer any muktzeh in it, even though when bein hashemashos arrived he removed his mind from it entirely and did not expect at all that the prohibition would depart on Shabbos. For example, live animals, which are muktzeh on Shabbos on account of the prohibition of slaughter, and he slaughtered them on Shabbos for a sick person who fell ill that day — it is permitted for a healthy person to eat from them raw, even though he removed his mind from them when bein hashemashos arrived on account of the prohibition of slaughter, since it is a prohibition that comes by itself and not through human causation. And likewise in every similar case:

And all this concerns an object that was muktzeh throughout bein hashemashos; but an object that was fit at bein hashemashos even partially alone and afterward became spoiled in such a way that it became forbidden in eating or in tiltul — whether it became spoiled by itself or was set aside by human action — and afterward was restored again — has returned to its permitted state. And we do not say: since it was set aside and became forbidden already for part of Shabbos, it is set aside for the entire remainder of Shabbos; for we say this only when it was set aside at the beginning of the entry of Shabbos, which is bein hashemashos, for then it is set aside for a whole day; but when it was not set aside until afterward, so that there is not a whole day here — it is not set aside for the remainder of the day, for there is no muktzeh for half a Shabbos, whether regarding the prohibition of eating or the prohibition of tiltul:

Dried figs and raisins that were muktzeh because they were not fit, and when bein hashemashos arrived they had already dried and were fit for eating — even though the owners did not know at all at that time that they had dried, and afterward it became known to them that at bein hashemashos they were already dry — are permitted in eating; for from the outset, when they set them aside and removed their minds from them, they set them aside only until they would dry, and they have dried and become prepared while it was still day:

Dried figs and raisins that have partially dried, such that they are fit-and-not-fit — some people eat them and some do not — if he designated them for eating while it was still day, it is permitted to eat from them on Shabbos: since he revealed his intent that they are fit for him, they have left the category of muktzeh. And if not — it is forbidden: since he did not reveal his intent, they remain in their state of being set aside, in which they were muktzeh from the outset, when they were not fit for any person.

But if he designated for eating dried figs and raisins that are not fit at all — his designation avails nothing, for this is like designating a stone for eating:

Anything that it is forbidden to move — it is forbidden to place a utensil beneath it so that it should fall into it, even if he intends to shake it out afterward, because this renders the utensil forbidden in tiltul as long as the muktzeh is inside it, and he thus nullifies a utensil from its readiness (mevatel kli mei-heichano); and it is forbidden to nullify a utensil from its readiness even temporarily, except in a case of great loss, as was explained in simanim 265 and 266.

But it is permitted to invert a utensil over it, for by this he does not render the utensil forbidden in tiltul. Provided only that the utensil does not touch the muktzeh: for although muktzeh is permitted to be merely touched, even with one's hands, as long as one does not move it, as was explained in siman 308, nevertheless here, where placing the utensil on the muktzeh is for the sake of the muktzeh — even touching by means of the utensil is forbidden.

And some dispute this and say that the Sages cautioned that the utensil should not touch the muktzeh only when the muktzeh is something that moves through the touch of the utensil, such as an egg and the like, so that he ends up moving it by means of the utensil; and they permitted moving by means of another object only for the sake of a permitted thing, as will be explained in siman 311:

Every object forbidden in tiltul that was placed while it was still day upon a permitted object with the intent that it remain there on Shabbos — such that the permitted object became a basis (basis) to the forbidden one and became forbidden in tiltul like it, as was explained in siman 309 — and after nightfall the forbidden object was taken off the permitted one: it is nevertheless forbidden to move it throughout all of Shabbos. For example, a bed on which he placed coins while it was still day with the intent that they remain there on Shabbos, and after nightfall the coins were taken off it by a non-Jew or a minor — it is forbidden to move it throughout all of Shabbos: since it was set aside at bein hashemashos by the intent of the person, who made it a basis to a forbidden thing — it is set aside for the whole of Shabbos.

But if the coins were not on it at bein hashemashos, but afterward a non-Jew or a minor placed them on it — even if they placed them with the consent of the Jew, so that it was set aside by his intent from moving them as long as the coins are on it — it is nevertheless permitted to move it if the coins were taken off it, since it was not muktzeh at bein hashemashos.

But while the coins are on it, it is forbidden to move it, on account of the prohibition of moving the coins that are on it. But it is permitted to tilt it and shake it and make the coins fall off it, and to move it afterward to wherever he wishes. And if he needs its place — he moves it with them on it, as was explained in siman 309 regarding a thing that did not become a basis to a forbidden thing; for this one too did not become a basis to a forbidden thing, since the forbidden thing was not on it at bein hashemashos, as was explained in simanim 265 and 266:

And all this concerns a bed that is not designated for coins, or even if he designated it for coins but has not yet ever placed coins on it, for by thought alone it does not become forbidden. But if he designated it for coins and performed an act with it, placing coins on it once, even on a weekday — it is forbidden to move it on Shabbos even for the sake of its use or its place. And it is not like other utensils designated for forbidden work, which it is permitted to move for the sake of their use or their place, because people are not particular about them against using them for another, permitted use; but this bed, designated for coins — a person is particular about it and designates a place for it, so as not to move it for another use, and it is thus similar to muktzeh because of financial loss (muktzeh mei-chamas chesron kis), which it is forbidden to move even for the sake of its use or its place, as was explained in siman 308.

And some dispute this and permit moving it for the sake of its use or its place, like other utensils designated for forbidden work.

And one should be stringent in accordance with the first opinion. Therefore one should not move a coin-purse even though he removed the coins from it while it was still day, unless he performed an act with it, that he opened it from below and removed it from its designation:

And nevertheless, a coin-purse sewn into a garment — since the essence of the garment is for wearing — if he removed the coins from there, he may wear the garment, for the purse is nullified relative to it. And even in the purse itself it is permitted to put something inside it or to take from it, for its being set aside is only because a person is particular about it against using it for another use, and here we see that he is not particular about it (and this requires examination: if so, it should be permitted entirely):

And even if there are coins inside [the purse] — there is no prohibition except to wear the garment, by decree lest one forget and go out with it into a public domain, as was explained in simanim 301 and 303; but it is permitted to move the garment.

And even if he placed the coins in the purse with the intent that they remain there also on Shabbos, so that the purse became a basis for them — the garment nevertheless did not become a basis for them, since the coins are not on the main body of the garment; and it is the permitted thing that he moves with his hands, while the forbidden thing moves along with it by itself, through indirect moving (tiltul min ha-tzad), in which there is no prohibition when he is not moving for the sake of the forbidden thing but for the sake of the permitted thing, as will be explained in siman 311.

But it is forbidden to put his hand into the purse if he placed the coins in it with the intent that they remain in it also on Shabbos, for the purse became a basis for them:

And all this concerns a purse whose mouth alone is sewn to a hole in the garment, with [the purse itself] hanging entirely; but if it is entirely hung along its length on the garment — the whole garment becomes a basis for the coins in the purse, like the purse itself, for it is all one.

And even if he placed the coins in the purse with the intent of taking them out of it before Shabbos and forgot to take them out while it was still day, so that not even the purse itself became a basis for them — nevertheless, if it is possible to shake the coins out of the purse, he must shake them out first, and afterward he may move the garment to any place he wishes, just as if the coins had been on the main body of the garment, where he would have had to shake them off first, as was explained in siman 309 regarding coins on a cushion.

And even with a purse that hangs entirely — they permitted moving the garment only when it is sewn to the garment (for then it is nullified relative to the garment, and the garment does not become forbidden in tiltul on its account). But if a purse full of coins is tied to the garment, since the purse is a utensil in its own right — (it is not nullified relative to the garment, and therefore) it is forbidden to move (the whole) garment if he placed the coins in the purse with the intent that they remain there also on Shabbos (for the purse became a basis for them, and the garment for the purse that is tied to it and hangs on it).

And even if the coins were taken from the purse (or the purse from the garment) after nightfall — it is forbidden to move (the whole) garment throughout all of Shabbos (since it became a basis at bein hashemashos).

And if he placed them with the intent of taking them before Shabbos and forgot to take them while it was still day — he must shake the coins out of the purse if it is possible to shake them out, and afterward he may move the garment to any place he wishes, if he does not intend [to move it] for the sake of the coins, in order to put them away, as was explained in siman 309.

And likewise, if there are coins in a box (teivah) inside the table — it is forbidden to move the table except in the manner that was explained, unless there is on the table, while it was still day, something permitted in tiltul, for then the table became at bein hashemashos a basis to issur and heter, and it is permitted to move it in the manner that will be explained:

It has already been explained in siman 309 that a utensil that has become a basis to issur and heter — it is permitted to move it. And this is provided that the permitted item is more important than the forbidden item; but if the forbidden item is more important than the permitted item — the heter is nullified relative to the issur, and it is forbidden even to shake off the issur, as if it were a basis to the issur alone, where it is forbidden even to shake off, as was explained there.

And if the permitted item is not important to him because of his great wealth, even though it is important to everyone — it is not called important, for everything follows the owner, as was explained in siman 308; see there all the details of this law:

And even if the permitted item is more important: if it is possible to shake off the issur alone — one must first shake it off, and afterward move the utensil with the heter to the place he wishes. And if it is impossible to shake off the issur alone without the heter — he shakes off the heter too along with it, if there is no loss in shaking it off, and afterward he takes the heter alone and returns it to the utensil if he wishes, as was explained there.

And if it is in such a way that, if he shakes off the heter too, he will not afterward be able to take the heter alone — for example, a fire-pan (machtah) on which there is, from while it was still day, ash that is permitted to move because it is fit to cover spittle or excrement with it, and there are also on it pieces of wood or coals that are forbidden in tiltul, and he needs to move the ash to another place to cover with it, and if he shakes it off together with the pieces and the coals he will not afterward be able to take the ash alone with his hands, for example if they are small pieces or small coals, so that it is impossible to take the ash without them — it is permitted to move the fire-pan as it is, with the ash, the pieces and the coals, to the place he wishes.

Of what does this speak? When he needs the ash; but if he needs only the fire-pan itself — he should not move it as it is, but should shake off the ash, the pieces and the coals in their place, since there is no loss in shaking them off, and take the fire-pan alone:

And all this is when the heter was there with the issur while it was still day, such that at bein hashemashos the utensil became a basis to issur and heter; and even if after nightfall the heter was taken from there — the utensil did not become a basis then, since it was not a basis at bein hashemashos, as was explained above.

But if at bein hashemashos the issur alone was on it, and after nightfall the heter too was placed on it — this avails nothing: since at bein hashemashos it was a basis to the issur alone, it became forbidden for the whole of Shabbos:

Ash (efer) is only permitted in tiltul if it was produced from fire kindled while it was still day; but if it was produced from fire kindled on Shabbos — it is forbidden on account of nolad, as will be explained in siman 498. And if ash from a fire kindled on Shabbos became mixed with ash of the previous day — it is nullified by the majority, if it had never yet been recognizable on its own, as will be explained there:

A box containing things permitted in tiltul and coins — if the coins are not the main item — it is permitted to move it as it is, according to the conditions that have been explained:

Unique chiddushim of the Rebbe on this siman

חידוש א — mi'us that becomes useful (310:1-5)

Chiddush א — mi'us that becomes useful (310:1-5)

Status can change

The Rebbe's chiddush: a repulsive object that becomes useful changes status. The criterion is functional, not absolute.

Practical consequence: for a bothersome trash can, one can take it out on Shabbat (case of disturbance).
