📜 The text of the Shulchan Aruch — 10 seifim

The Hebrew below is the Shulchan Aruch itself, copied as it stands, seif by seif. The passages Sefaria sets in small type inside a seif and which the word הגה introduces are the glosses of the Rama — there are four of them, at seifim 1, 3, 4 and 6. The other small-type passages do not carry that mark: the parenthesis opened by פי׳ at seif 3 is a lexical note, and the two parentheses of seif 6 together with the cross-reference of seif 8 are asides whose author this page does not name. Under each seif, an English condensation — not a translation: the clause-by-clause rendering is at level 1.

summary: the siman's heading, then the first rule: a board, or anything else used to stop up a window, may be used even if it is neither tied nor hanging — provided one thought of it before Shabbos. A reed used to close a door asks for more: an act of fitting. A bolt driven into the threshold asks for more still: a tie. Rama's gloss: an object so fitted becomes a utensil whose use is permitted, and may be carried.

summary: everything said above about the bolt assumes an intact threshold. If the threshold has worn through so that the bolt pierces the ground beneath, that is building, and one may not lock with it.

summary: the yard behind the houses, not in constant use: a door, a reed mat, a breach closed with thorns. What decides is the hinge-pin — present, or merely former. Rama's gloss: all the more so if the pin is still there, provided one does not return it to its socket. With neither pin nor trace of one, one may not close, unless the thing is raised off the ground; and an opening in constant use may be closed even with no pin and even dragging.

summary: a door made of a single board, or with no threshold, lifted out when opened: one may not close with it, even if it has a pin. Rama's gloss: made of several boards, it is permitted.

summary: the chest, the box and the cupboard whose opening is on the side and which have two pins: if the lower one has come right out, one may not put it back, lest one drive it in; partly out, one pushes it. If the upper one has come out, even pushing is forbidden.

summary: the bed of parts: one neither reassembles nor tightens it, and one who drove it home owes a hatas. If it is of the kind that stays loose, it is permitted outright, provided one does not tighten. A cup of parts may be taken apart and put back; and there is one who gives the cup the regime of the bed. Rama's gloss: if the usage is to tighten it, the prohibition holds even when it happens to be loose.

summary: a beam that has broken: one may prop it with bed-poles, which are a utensil — not so as to raise it, which would be building, but so that it does not sink further; and only if the prop stays loose.

summary: a bench one of whose legs has slipped out: one may not put it back; and to rest the slipped side on another bench, there is one who forbids.

summary: the general rule of the siman: one who drives wood into wood, whether with a nail or by the wood itself, until they become one — that is a toladah of boneh.

summary: a courtyard sodden with rainwater: one may scatter straw on it, and this is not “adding to the building” — provided one does it with a change, from the upturned bottom of the basket, and not by hand.

1. Opening the sugya — boneh and soser in utensils

The talmudic source

Two passages carry the whole siman, and it is worth taking them in the order in which they enter. The first is the mishnah of the pekak ha-chalon, the window-stopper, where Rabbi Eliezer requires the object to be both tied and hanging, and the Sages do not:

The lamdan stops at once: what exactly is this machlokes about? The gemara answers, and its answer is what stops one from reading the siman as a matter of ohel:

In other words, making a temporary tent is forbidden by all; the machlokes is only about adding to a tent that already exists:

What that shift changes. The window is cut into a wall already built; stopping it up is therefore never making a tent, at most adding to one. The Shulchan Aruch takes up that very reason in the words of seif 1 — ולא אמרינן דהוי כמוסיף על הבנין (שו״ע או״ח שי״ג:א) — and that is why the siman will never again argue about ohel, but only about boneh: is this building, or using a utensil?

The second passage is that of the kaneh, the reed which the householder has fitted for opening and closing:

Rabban Shimon ben Gamliel is lenient: the fitting is enough, with no tie — and it is he whom the halachah follows:

The same page gives the third term of the scale, the nagar — the bolt driven into the threshold:

Rashi gives its material definition, the one the Mechaber will take up:

2. The underlying chakira — stopping up an opening: building, or using?

The chakira that governs the siman

Stopping up a window, closing a door — what is the nature of that act?

Everything therefore turns on toras keli: if the object has received the status of a utensil, the first branch falls away.

The yesod: three degrees of “toras keli”

Why does the window-stopper need only a thought from the day before, the reed an act of fitting, and the bolt a tie?

The answer is in seif 1 itself, and it is graded: the more the object resembles building, the stronger the act required to confer toras keli upon it. The Mechaber says it of the reed —

— and then of the bolt, one notch above, because it is driven downward into the threshold:

The Shulchan Aruch HaRav names the criterion that governs the scale, and it is not resemblance but bittul — whether or not the object is left abandoned in place:

Hence the consequence he draws himself, which turns the leniency of seif 1 against the man who never opens his window:

3. The shitos of the Rishonim — the toras keli of the bolt

Rashi. For an object to become a “keli”, it must be fit for some other use. That is how the Mechaber reports his shitah, and it is in the Shulchan Aruch that this developed wording is to be read:

On the daf itself Rashi is brief: he glosses the word of the beraisa with a single word, no more.

The developed form — turning olives over, cracking nuts — therefore reaches us through the Mechaber, who gives it in Rashi's name; we report it as he gives it, and we do not go looking for it in a ד״ה that does not carry it.

Rabbeinu Tam. He disagrees: there is no need for the object to serve anything else. That it was fitted and prepared for this task is enough — the designation itself confers toras keli.

The Mishnah Berurah sets the two shitos side by side and says what both are aiming at: taking the object out of the regime of construction.

Rambam. The degrees of the bolt are with him in Hilchos Shabbos, chapter 26: a bolt whose head bears a קְלֻסְטְרָא — a thick mass — carries in itself the proof that it is a utensil.

And one that has none, which is pulled out and laid in a corner, has nothing to plead for it:

The general principles of which the siman is the application are read elsewhere, in chapter 22: that one who drives home is liable on account of boneh (that is seif 9), that there is neither building nor demolishing in utensils (that is seif 6), and that adding to a temporary tent is permitted (that is seif 1).

The reason of the hinge-pin, and who gives it. Seif 3 distinguishes doors by the hinge-pin, and the Taz reports the taam in the name of the Raavad: what is not in frequent use is closed with the intention that it stay so for a long while, and that makes it a lasting tent.

The Taz immediately adds that Rashi hangs the reason on something else — on the makeshift character of the door itself. The two reasons do not yield the same consequence, and the Taz draws the Raavad's:

4. The sugya of the hinge-pin (seif 3)

Seif 3 ranks “doors” by the hinge-pin, and that ranking is the whole seif:

CaseWhat seif 3 rules
A door that has its pin nowone may close — provided one does not put the pin back in its socket (Rama's gloss)
A door that once had a pin (and no longer has)one may close — it is still visible that it is a door
A door that never had a pinone may not close — unless it is raised off the ground
An opening used for going in and out at all timesone may close, even with no pin and even dragging

The Mechaber himself gives the reason for the second line — a former pin leaves a trace that makes it seen that the thing is a door:

And the fourth line dispenses with a pin because the usage supplies it:

The Mishnah Berurah explains both ends of the scale. For the opening in constant use, it is common knowledge that removes the appearance of building:

And for the yard behind the houses it is the reverse: what is opened only at long intervals takes on the appearance of an addition to the building.

5. From the Beis Yosef to the Mechaber — the march of the 10 seifim

The march of the siman. The siman is not divided into chapters, and we ascribe to no one a plan he did not write: what follows is a reading of the ten seifim as they stand.
Where the Beis Yosef is named in the siman. The Beis Yosef is not cited by the Mechaber, but he is cited three times by the Rama, who signs three of his four glosses with his name: ב״י והרמב״ם at seif 1, and ב״י at seif 3 and at seif 4. The Taz, at his ס״ק ה, cites him in turn, on the doors of what is attached to the ground.

6. The glosses of the Rama

The Rama sets four glosses on this siman — at seifim 1, 3, 4 and 6 — and two of them govern what follows.

7. Central machlokos

Machlokes 1 — what confers toras keli (seif 1).

Machlokes 2 — the stopper laid on the roof-skylight because of a corpse (מ״ב ס״ק א).

Machlokes 3 — the dragging door with no pin (seif 3).

Machlokes 4 — on what account is one liable for the bed of parts (seif 6)? The Mechaber writes ואם תקע חייב חטאת (שו״ע או״ח שי״ג:ו), without naming the melachah. The Taz names it, and it is not boneh:

The Mishnah Berurah brings both headings, and the second one is indeed boneh:

The stake is not verbal: the Rambam lays down that אֵין בִּנְיָן בְּכֵלִים (רמב״ם הלכות שבת פרק כ״ב הלכה כ״ו), and yet seif 6 imposes a chatas. Naming makeh be-patish clears the contradiction; naming boneh forces one to say that an object made complete escapes the rule. The Mishnah Berurah refers to siman 314, seif 1, and to the Vilna Gaon — and the question stays open here.

8. The psak of the Acharonim — Mishnah Berurah, Taz, Magen Avraham, Shulchan Aruch HaRav

The Magen Avraham. On the first word of the siman he brings the teshuvah of הר״י הלוי at length and does not let it pass: he objects that the poskim never recorded such a novelty.

And on seif 6 he draws from the bed of parts a consequence for the cups of his own day, made of two pieces with a screw thread:

The Taz. His ס״ק ב limits the prohibition of seif 2: what is forbidden is that the bolt should dig a fresh hole in the ground; a socket prepared in advance does nothing of the sort.

His ס״ק ה carries the heaviest consequences. Starting from the Beis Yosef on the doors of what is attached to the ground, he concludes that removing them is soser and putting them back boneh, both of them carrying a chatas, and he protests against a practice of his time:

The Mishnah Berurah (56 ס״ק). On seif 1 it is lenient about the condition of the prior thought: an object one has already used even once has already received toras keli, and needs nothing more.

On seif 5 it extends to the iron pin of our cupboards the concern that applied to the wooden one:

And on seif 10 it names the criterion that runs under the whole siman — bittul: straw is permitted because one does not abandon it there, sand and gravel are forbidden because one does.

The Shulchan Aruch HaRav (the Alter Rebbe, siman 313, divided into 25 seifim). He says in plain terms what the Mechaber lets be understood: it is the thought that brings toras keli down upon the object, and it is that which makes it carriable.

And he gives the criterion in a few words — not resemblance, but the fact that the object is not abandoned in place: see section 2 above, where he is quoted.

9. Practical nafka minos

Where the chakira is seen. What follows reports the criteria of the siman and the places where they are met today; this page rules on none of these cases, and a real case goes before a Rav.

10. Summary of the sugya and the line of the halachah

What siman 313 holds together:

  1. The sugya is built on the pekak ha-chalon and on the kaneh (שבת קכ״ה ע״ב and קכ״ו ע״א), and the gemara there shifts the question from the tent to the addition to a tent.
  2. Boneh and soser arise for movable objects too — that is seif 9, and the rest depends on it.
  3. Toras keli — an object that is a utensil, its use is not construction.
  4. Three degrees: stopper (a thought) / reed (an act of fitting) / bolt (a tie).
  5. A bolt that pierces the ground is building outright, and that is the whole of seif 2.
  6. The hinge-pin is the sign that makes the door seen; putting it back is building, and the Rambam says so of the upper pin in every circumstance.

What the siman leaves in hand. The ordinary use of a door, a window or a shutter already installed belongs to the regime of the utensil. What the siman watches is elsewhere: assembling, putting a pin back, the bolt that digs into the ground, and tightening. Anything that brings electricity into play raises a different question, which this siman does not treat.
