The Non-Jew Away from His House Who Then Came on Shabbos
1 seif in the Shulchan Aruch of the Mechaber, with no gloss of the Rema; 3 in the Shulchan Aruch HaRav, under its own numbering (Level 4). A non-Jew lives in a courtyard with two Jews: when does he not prevent their eruv, and what is to be done if he comes, or dies, on Shabbos? The seif answers: when he is away from his house, he does not forbid, and they make the eruv (for the distance, the seif refers to siman 371); if he came on Shabbos, he forbids, and the eruv is void — they then rent from him, and one renounces in favor of the other, and the one who remains alone is permitted; and all the more so if he dies on Shabbos: on the case this “all the more so” refers to, the commentators diverge (Level 2).
