1. Opening the sugya — what a דבר שיש לו מתירין is

↩ Detailed explanation (Level 1)

The starting point — the egg born on Yom Tov

The yesod of the siman is the דבר שיש לו מתירין (in short, דשיל״מ): a thing that needs no nullification at all in order to become permitted, since it will become permitted by itself after a time. The paradigm case is the ביצה שנולדה ביום טוב (שו״ע יו״ד ק״ב:א), forbidden on the festival and permitted the next day with nothing done to it. Such a thing, once mixed into others, is not nullified even in a thousand — whether the egg is whole or beaten, and even where there is a doubt about the day it was laid. But all of this holds only מין במינו; mixed into another species, it is nullified in sixty.
The source of the din — ביצה ד׳. : the root of דשיל״מ is the gemara in Beitza, about an egg born on Yom Tov that fell into a thousand others: all of them are forbidden. Rav Ashi there states the rule in its general form.
From there the rule was extended to every prohibition destined to become permitted after a time (Shabbat, Yom Tov, shemitta, hekdesh that will be redeemed, and the rest). The Mechaber takes the egg as his first example because that is where the din was stated at its source.
The Rama's gloss — לבנו בה מאכל or לתקן הקדרה : the Rama adds that if the egg was used to whiten a dish, or was put into the pot to improve it, it is not nullified.
The Rama himself refers to What this addition presupposes — and it is the Taz and the Shach at ס״ק ו who will say it explicitly — is that whatever is given in order to improve a dish counts as its own species: the question of מין במינו is therefore taken up below.

2. The yesod of the din — mid'oraita

↩ Detailed explanation (Level 1)

This is the root of the whole siman, and the Taz puts all his weight on it in his very first ס״ק.

The chakira — why is a דשיל״מ not nullified, even in a thousand? Mid'oraita, a prohibited item that falls into permitted food of the same species is nullified by majority — חד בתרי בטל (ט״ז יו״ד ק״ב ס״ק א) — from "אחרי רבים להטות". Why then is it not nullified here even in a thousand?
The Taz's answer (ס״ק א) — a rabbinic stringency: the Taz explains, in the name of Rashi on Beitza, that mid'oraita the nullification does take effect, and there is no Torah prohibition here at all; it is the Sages who added their stringency.
In other words: since it is in your power to wait and eat the thing in full permission after a time, you have no licence to acquire it now by way of nullification, which is a permission obtained through a prohibition.
The yesod — nullification is a door not needed here:
The root of the matter: nullification by majority is a way out of necessity — the Sages (and the Torah) allowed a prohibition to be dissolved in a majority of permitted matter because there is no other way. But in a דבר שיש לו מתירין there is another way: to wait. The Shach formulates the principle in the very words the gemara uses elsewhere.
It follows that the whole stringency of דשיל״מ rests not on the importance of the prohibition but on the existence of a permission still to come.
The Taz (ס״ק ב) — "בין שלימה בין טרופה": the Taz points out that a whole egg is in any case a דבר שבמנין (siman 86), which is not nullified. Where, then, is the novelty of דשיל״מ for a whole egg? He answers that the novelty is that it also carries the stringency of דשיל״מ, with a consequence for the case of doubt.

3. The stringency of דשיל״מ even in doubt

↩ Detailed explanation (Level 1)

The Mechaber's words (end of seif 1)

The difficulty: a doubt in a rabbinic prohibition is resolved leniently, and the prohibition of the egg on Yom Tov is rabbinic; so is the prohibition against nullifying a דשיל״מ. One would therefore expect a lenient ruling — yet the Mechaber writes that even in doubt they are forbidden.
The Taz's answer (ס״ק ג) — דשיל״מ is heavier than other things that are not nullified: the Taz distinguishes דשיל״מ from the other cases of non-nullification, where the doubt is permitted.
The dividing line, as the Taz draws it:
Nafka mina — even a doubt in a rabbinic prohibition: from the Taz (ס״ק ג) a great principle emerges — in a דשיל״מ one does not follow the rule safek derabanan lekula. As long as it is possible to wait and eat the thing in permission, one does not permit by way of nullification, even in doubt. And for practice — ask your Rav.

↩ Detailed explanation (Level 1)

The Mechaber's words (end of seif 1)

The stringency of דשיל״מ therefore applies only מין במינו (an egg among eggs); mixed into another species, it returns to the ordinary din and is nullified in sixty.

The yesod — why specifically
The Shach (ס״ק ד) explains: the whole stringency does not come from the prohibition itself, but from the fact that a permission will come; and when the mixture was made with another species, the future permission does not bear the name of the forbidden thing.
The Shach adds that for a בריה or a חתיכה הראויה להתכבד there is no difference between מינו and שאינו מינו — and that is precisely what shows that the stringency of דשיל״מ is of another order.
By name or by taste — Shach ס״ק ג : the Shach establishes that the criterion of "its own species" is the name and not the taste, and he grounds it in Rava.
CaseThe din according to the ShachSource
Same name, different taste מין במינו — not nullified ש״ך ס״ק ג
Same taste, different name שלא במינו — nullified ש״ך ס״ק ג, from Rava
The Taz (ס״ק ה) and the Ran on the blood of the bull and the goat: the Taz first brings the reason he had given in siman 101 — the future permission bears the name of the mixture, not of the prohibition — and he is not satisfied with it.
He then wonders why the Ran's reason (Nedarim 52) was not brought here. The Ran starts from the verse « ולקח מדם הפר ומדם השעיר »: although the blood of the bull is more abundant, Scripture still calls the mixture the blood of the goat — a sign that מין במינו there is no nullification, for what resembles its like does not weaken it but strengthens it. The Sages do not derive the rule for forbidden and permitted from there, because there one item is forbidden and the other permitted — except, precisely, in a דשיל״מ:
The Taz ends by writing that this reason of the Ran is entirely correct.
"Improving the pot" = מין במינו (Taz ס״ק ו, Shach ס״ק ו): this is what illuminates the Rama's gloss on seif 1. The Taz compares it to water and salt in dough, in the name of Tosafot.
The Shach says the same in the name of the Mahara"i:
The Taz warns against over-extending this: the reasoning holds here, for דשיל״מ, and one may not conclude that everywhere whatever improves the pot is מין במינו — for where everything depends on taste, something that imparts taste from outside its species keeps the stringency of שלא במינו.

5. The two conditions of the מתיר — certain to come, or in his power

↩ Detailed explanation (Level 1)

The Mechaber's words (seif 2)

The chakira — which "מתיר" is enough to make a דשיל״מ? The whole yesod rests on a permission being available. But when can one truly say that it is? Does any possibility suffice, or is certainty required, or control?
The two conditions, as seif 2 sets them out:
ConditionExplanationExample
(a) עתיד לבא על כל פנים the מתיר will come in any case, by itself, with no act the Yom Tov egg, certainly permitted after the festival — this is the Taz's example at ס״ק ז
(b) בידו לעשותו בלא הפסד the מתיר is in his power, and he can obtain it without financial loss asking a sage about a vow (seif 4)
The egg of a ספק טריפה — why it is not a דשיל״מ: it satisfies neither (a) nor (b): the מתיר is not certain to come — perhaps the hen is a טריפה and the egg will never be permitted — and neither is it in his power. Yet the Acharonim noted that one aspect of דשיל״מ remains: the Tzemach Tzedek (responsum 69), cited by the Pitchei Teshuva (ס״ק ד), answers the questioner that a partial permission will certainly come.
The Pitchei Teshuva adds that the Pri Chadash and the Minchat Yaakov concluded likewise, and he further brings the discussion of the Pri Megadim and of Rabbi Akiva Eiger (responsum 65) about one who vows not to eat a נבילה — where Rabbi Akiva Eiger reconsiders his first suggestion and leaves the matter בצריך עיון.
The Shach (ס״ק ז) — why "יש מי שאומר": the Shach is puzzled by the Mechaber's phrasing, which is the phrasing of a single, isolated opinion.
He then brings a proof from the Shas at the beginning of Beitza, where the gemara assumes that the egg of a ספק טריפה is not a דשיל״מ — and he does not resolve his own question: he leaves it open.

6. A vessel is not a דשיל״מ — it costs money

↩ Detailed explanation (Level 1)

The Mechaber's words (seif 3)

The chakira — at first sight the vessel is a perfect דשיל״מ: a vessel that has absorbed a prohibition — it is in his power to render it permitted by הגעלה. It should therefore not be nullified, even in a thousand. Why does the Mechaber rule that it is nullified by majority?
The Rashba's answer, as the Mechaber brings it — it costs money: the second condition requires that the מתיר be in his power without loss. Here, הגעלה must be paid for — wood, labour, the work itself. Since the מתיר does not come without loss, the vessel leaves the category of דשיל״מ and is nullified by majority. That is the sense of "וכל כיוצא בזה": every מתיר that costs money.
The Shach (ס״ק ח) — the views on this reason:
ViewWhat it says about the reason of "expense"Source
The Maharshal the reason was unnecessary: in any case the permission does not come by itself through the passage of time, so there is no דשיל״מ at all ש״ך ס״ק ח, who disputes him
The Maharil (responsum 194) he disputes the Rashba: the cost of הגעלה is only a small loss — so the vessel remains a דשיל״מ and is not nullified. The Shach writes that one should be concerned for his words where the loss is not great ש״ך ס״ק ח
The Ra'ah, and the Shach's practical conduct: the Shach further brings the Ra'ah (בדק הבית, folio 128b), who gives the Rashba a different reason: wherever the prohibition is discernible there is no nullification, and since the prohibition can be drawn out by הגעלה, it is as though it were discernible.
The Shach then adds a stringent practice: to wait until the vessels are no longer
Unlike another view he brings, the Shach holds that it is forbidden to use even each one of them separately before twenty-four hours have passed. The Taz (ס״ק ח), for his part, asks why the Rashba needed this reason of expense at all.
And for practice — ask your Rav.
Pitchei Teshuva (ס״ק ו) — the Maharshal defended: the Pitchei Teshuva brings the Beit Yaakov (responsum 110), who justifies the Maharshal against the Shach's objection: vows are different, since there is a mitzva in dissolving them.
He adds Rabbi Akiva Eiger's question on the Shach, and a reasoning of his own: following the Tzelach and the Noda Biyhuda, the rule of דשיל״מ concerns only eating — what I eat today I shall not eat tomorrow — and not use, since one can use the vessel today as well as tomorrow.

7. The chakira of seif 4 — is the taste nullified?

↩ Detailed explanation (Level 1)

This is the great chakira of the siman, and the whole of seif 4 rests on it.

The words of the Mechaber and the Rama (seif 4)

The overall chakira — what exactly is it, in a דשיל״מ, that is not nullified? Does the status attach to the body of the prohibition — so that only its substance escapes nullification — or to the prohibition as such, so that even the taste it left behind is not nullified? This is the machloket of the Rama and the Shach, and several dinim hang on it.
The Rama and the Shach — טעמו בטל or not:
ViewThe taste of a Source
The Rama only the prohibition בעין or its ממשות is not nullified; its taste is nullified רמ״א ס״ד ; ט״ז ס״ק ט
The Shach even the taste is not nullified מין במינו — from the Shas in Nedarim, the Yerushalmi, Tosafot, the Rosh and the Ran ש״ך ס״ק ט–י
The Taz (ס״ק ט) — "אבל טעמו בטל": the Taz explains that the stringency bears only on the body of the prohibition; the taste it gave off, having no substance left, is not weighty enough to forbid on account of דשיל״מ.
The word "אוחו" is the spelling of the edition Sefaria follows, for "אותו"; it is copied as it stands. The Taz distinguishes this case from that of seif 1: there, the egg was put into the pot precisely in order to give it flavour.
The Shach (ס״ק ט–י) — he disputes: the Shach holds that even the taste is not nullified מין במינו, and he relies on the gemara in Nedarim, the Yerushalmi, Tosafot, the Rosh and the Ran; the daf reference printed in the Shach (דף צ״ח) matches no folio of Nedarim, which has only 91 — the usual reading is נדרים נ״ב.
He examines at length whether one should distinguish the case where the body of the prohibition remained in the mixture from the case where it was removed whole, and he finally refuses the distinction — for in any event « עד שאתה אוכלו באיסור תאכלנו בהיתר » (ש״ך יו״ד ק״ב ס״ק ט). He finally brings the Ba"ch in the same direction.
On the Rama's side, the Pitchei Teshuva brings the Pnei Aryeh, who upholds him against the Ba"ch and the Shach.
Nafka mina — a dish in which only the taste of the prohibition remains: a dish into which a דשיל״מ fell, of which only the taste remains (the prohibited item itself having been removed or dissolved): for the Rama it is nullified in sixty; for the Shach and the Ba"ch it is not nullified, and one should be stringent. The question remains disputed among the Acharonim. And for practice — ask your Rav.

↩ Detailed explanation (Level 1)

The Rama's words (continuation of seif 4)

The difficulty — "אין איסורו מחמת עצמו": a piece of meat not salted within three days is forbidden for cooking, because of the blood it holds, but it remains permitted for roasting. It therefore has a מתיר, and should be a דשיל״מ that is not nullified. Why does the Rama rule that it is nullified?
The Rama's answer — its prohibition does not come from itself: the piece is not forbidden in itself, but only because of the blood absorbed in it. A prohibition that lies not in the body of the thing but in what it absorbed does not enter the category of דשיל״מ, and is nullified. The Rama adds a further general rule: any prohibition that was not discernible before the mixture is nullified even though it is a דשיל״מ — the paradigm case being grapes pressed on Shabbat whose juice runs into clear wine.
The Taz's conclusion (ס״ק י):
The Taz devotes his longest passage to this clause. He disputes the Rama's reason — showing that the Terumat HaDeshen, on whom the Rama relies, did not give that reason — and asks what ground there could be for denying the status of דשיל״מ to an absorbed prohibition, once a permission exists. He then argues a fortiori from the mishna in Bikkurim, and concludes:
That is: wherever the permission of a prohibition essentially runs through nullification, that nullification does not operate in a The Taz notes that the Maharshal writes the same — to read this conclusion the other way round, as though it removed such cases from the category of דשיל״מ, is an error that must be flagged.
The Shach (ס״ק י) disputes the Rama as well: the Shach writes that all the Acharonim took issue with the Rama's distinction: once there is a דשיל״מ, it makes no difference whether the prohibition is absorbed or not, since in the end a permission exists.
At ס״ק י״א, however, the Shach indicates that the unsalted piece is in any case not a דשיל״מ — but for an entirely different reason from the Rama's: for roasting it was never forbidden at all.
On the other side, the Pitchei Teshuva (ס״ק ח) brings the Pnei Aryeh, who upholds the Rama while limiting his scope to cases where the absorbed prohibition is not of the same species as that into which the mixture was made.
The Taz (ס״ק י״א) — "שלא היה ניכר": grapes from which wine runs on Shabbat into clear wine that was there before Shabbat: although there is a דשיל״מ here, it is nullified, because the prohibition never appeared separately before it was mixed.
The Taz underlines the difference from the unsalted piece: there the prohibition was known, since the piece was forbidden; here there was no prohibition at the outset.
Pitchei Teshuva (ס״ק ח) — the unsalted piece among the Acharonim: the Pitchei Teshuva brings the Teshuva MeAhava (part one, responsum 3), who wonders at the Acharonim's position and shows, in the name of the Rambam, Rashi and the Ran, that even where the permission does not bear on what was forbidden one is within דשיל״מ — while himself concluding leniently for the unsalted piece mixed into others, since this is, as he writes, only a stringency of the Geonim. The Noda Biyhuda (at responsum 6 of the same collection) rejects his proofs and endorses the Acharonim's lenient ruling; the Pri Megadim writes likewise.

9. A vow · chametz on Pesach · one who cooks on Shabbat

↩ Detailed explanation (Level 1)

The Rama's words (end of seif 4)

A vow = דשיל״מ לדידיה (Taz ס״ק י״ב): one who vowed against a thing and saw it mixed into others: for him it is a דשיל״מ, since he can ask a sage and have his vow dissolved — this is the second condition of seif 2: the מתיר is in his power, without loss.
The Pitchei Teshuva (ס״ק י) specifies, in the name of the Brit Avraham, the Maharit and Rabbi Akiva Eiger (end of responsum 65), that the Rama wrote "לדידיה" deliberately: the one who can dissolve must be the one to whom the thing is forbidden.
Pitchei Teshuva (ס״ק י) — an oath is not a vow: the Pitchei Teshuva brings the Beit Yaakov, followed by the Teshuva MeAhava: an oath is not a דשיל״מ, even though it can be dissolved, because there is no mitzva to have it dissolved as there is for a vow.
The Pri Megadim wrote the contrary, in his introduction to the laws of Pesach, that דשיל״מ applies to an oath as well; the Chavot Yair (responsum 131) deals with a mixed case of his own. The question is not closed.
Chametz on Pesach — a machloket:
ViewIs chametz on Pesach a דשיל״מ?Source
The Mordechai (the Rama's first view) a thing that had a permission and became forbidden again is not a
The Rambam ("ויש חולקין") chametz on Pesach is a דשיל״מ — and the Maharshal writes that this is the main view ט״ז ס״ק י״ג ; ש״ך ס״ק י״ג–יד
The Shach (ס״ק י״ג–יד) — the particular gravity of chametz: the Shach adds a distinction that must not be confused with the previous one: if chametz is not nullified on Pesach even outside its own species, that is not on account of דשיל״מ but because of the particular gravity of this prohibition, as the Rambam writes.
There are therefore two superimposed questions: whether chametz is a דשיל״מ, and how far the particular stringency of the prohibition of chametz reaches.
One who cooks on Shabbat (Shach ס״ק ט״ו): one who cooks on Shabbat deliberately — the food is forbidden to him for ever, while it is permitted to others after Shabbat.
By the Rama's rule, since the thing never becomes permitted again to the one to whom it is forbidden, it is not a דשיל״מ. The Pitchei Teshuva (ס״ק י״ב) brings the Magen Avraham (siman 308): the Rama speaks of a mixture that occurred after Shabbat; if it occurred on Shabbat itself, the food is forbidden to the one who cooked it, since the status of דשיל״מ had taken effect for others.
Pitchei Teshuva (ס״ק א) — כל דפריש : in a mixture of דשיל״מ, do we say kol deparish meruba parish — whatever separates out comes from the majority? The Sidduro shel Shabbat concludes that we do not, and the Tzemach Tzedek (responsum 69) as well as the Magen Avraham (siman 513) go the same way.
In the same ס״ק, however, the Pitchei Teshuva refers to the Tzelach, who brings a proof to the contrary — that we do say כל דפריש in a דשיל״מ — and he adds that such appears to be the view of the Chavot Yair (siman 133). The question is therefore divided.

10. Chakira and practical nafka mina

↩ Detailed explanation (Level 1)
The overall chakira of the siman: what is the reason for דשיל״מ, and when does it apply?
Practical nafka mina — what the siman puts at stake:
  1. A דשיל״מ is nullified neither in a thousand nor in doubt — but only מין במינו; outside its species it is nullified in sixty (Mechaber, seif 1).
  2. The מתיר must be certain to come or in his power without loss; the egg of a ספק טריפה is nullified (Mechaber, seif 2) — yet the Shach leaves his question בצריך עיון.
  3. A vessel that absorbed a prohibition is nullified by majority, because הגעלה costs money (Mechaber, seif 3); the Shach brings the Maharil, for whom that expense is slight, and writes that one should take his words into account where the loss is not great.
  4. Taste alone: nullified for the Rama, not nullified for the Shach and the Ba"ch; the Pnei Aryeh upholds the Rama (seif 4).
  5. A vow is a דשיל״מ לדידיה; chametz on Pesach is a machloket (Mordechai / Rambam); one who cooks on Shabbat is not a דשיל״מ.
And for practice — ask your Rav.

The reason "cost of הגעלה" (seif 3) Maharshal — unnecessary: there is no דשיל״מ at all Maharil — the expense is slight, so the vessel remains a דשיל״מ (ש״ך ס״ק ח)
The taste of a דשיל״מ מין במינו Rama — טעמו בטל (and the Pnei Aryeh upholds him) Shach and Ba"ch — even the taste is not nullified
