summary: one who boils many eggs in their shells should not take them out of the water in which they were cooked until they have cooled, or else pour cold water over them to cool them and take them out afterwards — because we fear that a chick may be found in one of them, and that, were he to take them out before they cooled, the one containing the chick would be left with the last ones and would forbid them, there no longer being sixty to nullify it. The Rama’s gloss: if he did not do so but poured them all into a dish and one of them is found to be tereifa, there are those who forbid everything, out of fear that the tereifa was left at the end; the same applies to small fish among which a non-kosher fish is found and which were not poured out at once. And there are those who permit in every case, for we do not presume an issur so as to say that it was left without sixty — and this is the main ruling. And even according to those who forbid, the vessels in which they were cooked are not forbidden, for we leave the vessel in its presumption.
1. Opening the sugya — boiling eggs and the order of removal
The foundation — “it would be left with the last ones and would forbid them”
The foundation of the siman is a fear about facts: when many eggs are boiled in their shells, one of them may contain a chick — or a drop of blood — and so be forbidden. As long as they are all in the pot, the forbidden egg is nullified by the other eggs and the water, which make up sixty against it. But if they are taken out one by one, while still hot, we must fear that this very one will be left last: the others having gone, there is no longer sixty to nullify it, and it comes back to forbid what remains and the water with it.
The Mechaber’s remedy is not to count differently but to stop the exchange of taste: cool them first, or pour cold water on them, and only then take them out — for in the cold there is no more emission or absorption that could forbid.
« המבשל ביצים הרבה בקליפתן לא יוציאם מהמים שנתבשלו בהם עד שיצטננו » (שו״ע יו״ד ק״ז:א)
« או יתן עליהם מים צוננים לצננם ואחר כך יוציאם » (שו״ע יו״ד ק״ז:א)
« משום דחיישינן שמא ימצא באחת מהן אפרוח » (שו״ע יו״ד ק״ז:א)
The root of the fear — what is left last. The danger is not the absorption of the issur as such but the order of removal. While everything is mixed, the issur is nullified; but taking them out one by one brings us back to a state in which there was a majority a moment ago and there is none at the end — for the last egg may be the forbidden one, alone and with nothing to nullify it. The Mechaber says so in his own words:
« שמא היתה נשאר אותה שיש בה אפרוח עם האחרונות והיתה אוסרתן לפי שלא היה נשאר שם ששים לבטלו » (שו״ע יו״ד ק״ז:א) Cooling is therefore the mechanism that halts the emission before the ratio turns around.
The Rama’s gloss (הגה). If this precaution was not taken and everything was poured into a dish, and one of the eggs is found to be tereifa:
« ואם לא עשה כן אלא עירה אותן לקערה ונמצא אחת מהן טרפה יש אוסרין הכל » (רמ״א יו״ד ק״ז:א) and the reason for this stringency is the same fear, carried to its end:
« דחיישינן שמא הטרפה נשאר לבסוף ולא היה ששים בקדרה לבטל ונאסר מה שבקדרה וחוזר ואוסר כל מה שבקערה » (רמ״א יו״ד ק״ז:א) The Rama extends the case to small fish among which a non-kosher fish is found, when they were not poured out at once:
« וכן בדגים קטנים שנמצא דג טמא בקערה ולא עירה כלם בפעם אחת אל תוך הקערה » (רמ״א יו״ד ק״ז:א) He then brings the lenient opinion, gives its motive, and rules:
« ויש מתירין בכל ענין… דלא מחזקינן איסור לומר דנשאר האיסור בלא ס׳… וכן עיקר » (רמ״א יו״ד ק״ז:א) And he adds that even according to the strict opinion the vessels are not forbidden:
« ואפילו לדעת האוסרים אין לאסור הכלים שנתבשלו בו דמעמידין הכלי על חזקתו » (רמ״א יו״ד ק״ז:א)
2. The chakira behind “there are those who permit” — the two motives
This is the heart of the siman: on what does the leniency of “there are those who permit” rest, and why does it carry two reasons that do not say the same thing?
The chakira — what permits, when one did not cool them? If one took them out or poured them without keeping to the order, and one of the eggs is found forbidden, on what grounds do we permit the rest? Is it because we do not presume that the issur was left last — a doubt about the facts — or because by strict law the single forbidden item is nullified in the dry majority — a real nullification?
The two motives, as the Shach disentangles them (ס״ק א). The Shach first sets out the strict position, that of the Riva and those who follow him:
« דריב״א וסייעתו שהביאו הסה״ת והמרדכי סוף פא״ט » (ש״ך יו״ד ק״ז ס״ק א) whose fear is factual: the non-kosher fish may remain at the bottom as the gravy diminishes.
« דחוששין שמא נשאר הדג טמא בצד מטה בסוף כשמתמעט הרוטב ע״י עירוי » (ש״ך יו״ד ק״ז ס״ק א) He then sets out the position of R. Baruch, author of Sefer HaTeruma, to which all the poskim subscribe:
« ודעת ר׳ ברוך בעל סה״ת וסייעתו » (ש״ך יו״ד ק״ז ס״ק א) « מ״מ בטלים ברוב לפי שדרך להיות הרבה דגים קטנים דיש רוב נגד אותן שנאסרו » (ש״ך יו״ד ק״ז ס״ק א) and he specifies that what permits here is nullification in the dry, once the gravy has been poured off:
« א״כ לא נתערבו אלא ביבש ובטלים ברוב » (ש״ך יו״ד ק״ז ס״ק א) Finally he brings the position of R. Shimshon, which is of a wholly different order:
« ודעת ר״ש שהביא הסמ״ג והגהת ש״ד ר״ס נ׳ דמתיר מטעם דתלינן דאיסור ברובא איתא » (ש״ך יו״ד ק״ז ס״ק א)

Strict — we fear that the issur was left at the end without sixty, and everything is forbidden
R. Baruch, author of Sefer HaTeruma
Permits in fish, since they are numerous and the few that became forbidden are nullified in the majority, and do not come back to forbid the others by contact
R. Shimshon
Permits because we attach the issur to the majority — and this is the motive the Rama adopts
The root of the difference between the two motives. The nafka mina is large: the motive of nullification in the dry requires a real majority of permitted against forbidden, and without a majority there is no leniency. R. Shimshon’s motive, on the other hand, does not count: it attaches the issur to the majority, where it is most likely to be found.
But the Shach refuses to conclude from this that R. Shimshon dispenses with a majority. He holds, on the contrary, that a majority is needed for him as well:
« נראה דעכ״פ בעינן שיהיו אותן של צד מעלה הרוב » (ש״ך יו״ד ק״ז ס״ק א) and he infers, against the usual reading, that in eggs R. Shimshon too would forbid:
« ואם כן בביצים דאסר ר״ב מטעם שאין רגילין להיות רוב אף לר״ש אסור » (ש״ך יו״ד ק״ז ס״ק א) He even says expressly that he does not understand the opposite reading of the Maharshal:
« ולא אבין מ״ש מהרש״ל פרק ג״ה סי׳ מ״ד דלר״ש מותרים אף הביצים » (ש״ך יו״ד ק״ז ס״ק א) As to the ruling, the Shach concludes that all the poskim follow the path of R. Baruch:
« ולענין דינא הנה כל הפוסקים הנ״ל עומדים בשטת ר״ב » (ש״ך יו״ד ק״ז ס״ק א) It is out of this difference of reading that the asymmetry of eggs and fish arises, set out in the next section. We report, and we do not rule.
3. The asymmetry of eggs and fish — why fish are permitted and eggs forbidden
The chiddush of the Taz (ס״ק ד) and of the Maharshal — the law of eggs is not the law of fish.
The kushya — if fish are permitted, why be strict with eggs? In both cases there is a single forbidden item among many, taken out one by one. The Taz answers that the difference does not lie in the nature of the issur but in the ratio of numbers — and hence in which motive one adopts.
The answer of the Taz (ס״ק ד) and of the Maharshal. The Taz first establishes that the motive written by the Rama is R. Shimshon’s, and that according to him eggs too would be permitted:
« הטעם דכתב כאן רמ״א דלא מחזקינן איסור כו׳ הוא טעם הרב רבינו שמשון שמביא בסמ״ג ולפ״ז אף בביצים מותרים » (ט״ז יו״ד ק״ז ס״ק ד) But a second motive runs through the Semag and the Tur, and that one holds only for fish:
« דהיינו דמתיר בדגים לפי שאותן מעט דגים שנאסרו בקדירה בטלים ברוב תערובות אח״כ ואין חוזרים ואוסרים השאר » (ט״ז יו״ד ק״ז ס״ק ד) and it cannot hold for eggs, since it is not usual to cook enough of them to make a majority:
« ולפי זה יש לאסור בביצים כיון דאין רגילות לבשל ביצים כ״כ ביחד שיהא עשרים או שלשים ביצים שנאסרו בטלים ברוב תערובות של היתר » (ט״ז יו״ד ק״ז ס״ק ד) The Maharshal, holding that it is this second motive that is adopted, draws from it the stringency in eggs:
« וכתב רש״ל פג״ה סימן מ״ד מדזכר הטור הטעם השני כוותיה קי״ל ויש להחמיר בביצים » (ט״ז יו״ד ק״ז ס״ק ד) and the Taz concludes like him:
« על כן נראה להחמיר כדעת רש״ל דבביצים אסור ובדגים מותר כל זמן שאפשר שיש ס׳ נגד המעט מים שנשאר בקדרה » (ט״ז יו״ד ק״ז ס״ק ד)
What the Taz writes about the nature of the issur in the egg. The Taz states in so many words that the issur — the chick or the blood — is not of the same species as the eggs around it:
« דכאן בביצה שיש בה אפרוח או דם הוה מין באינו מינו דהאיסור הוא אינו מינו עם הביצים » (ט״ז יו״ד ק״ז ס״ק ד) and the Shach says the same on his side:
« ונראה דכל הנך פוסקים מיירי במין בשאינו מינו שהדג טמא אינו מינו וכן הביצת אפרוח או ביצה של טפת דם הוא אינו מינו עם שאר הביצים » (ש״ך יו״ד ק״ז ס״ק א) This must be kept in mind, for it is from here that the Shach’s answer about what “enters the doubt” will come in section 4.
The Taz at ס״ק א–ג. The Mechaber’s warning concerns only the first instance, and not the accomplished fact:
« דדוקא לכתחלה קמזהיר ובדיעבד מותר כיש מתירין שזכר רמ״א » (ט״ז יו״ד ק״ז ס״ק א) If the eggs were not poured into a dish but only the boiling water was poured off, there is reason to forbid, the forbidden egg possibly lying at the bottom of the pot:
« דאם לא עירה אותן לקערה אלא נשארו בקדירה ועירה הרותחין מהן ג״כ אסור דשמא היתה ביצה האסורה בשולי הקדירה » (ט״ז יו״ד ק״ז ס״ק ב) And where there is doubt about the manner of pouring, one is strict:
« ואם יש ספק בדבר אם עירה בפעם אחת משמע בטור להחמיר וכן כתב או״ה » (ט״ז יו״ד ק״ז ס״ק ג)
Nafka mina — it is the ratio of numbers that decides. As long as the forbidden item is one among a clear majority, as with small fish, it is nullified; when the number of cooked items is small, as with eggs, there is no nullification, and the fear of what is left last remains. The asymmetry therefore lies not in the nature of the issur but in the quantity — and, according to the Shach, it holds even for R. Shimshon’s motive. And for practice — ask your Rav.
4. Iruy and the thickness of a peel — and the species of the non-kosher fish
The foundation — iruy counts as a first vessel, and forbids only the thickness of a peel.
Pouring the boiling water off the pot is treated as a first vessel as regards stringency:
« דעירוי ככלי ראשון » (ש״ך יו״ד ק״ז ס״ק א) and what it forbids is measured:
« הכל אסור אף לר״ב כדי קליפה דעירוי מבשל כדי קליפה » (ש״ך יו״ד ק״ז ס״ק א) The Shach adds that according to the Beit Yosef himself a peel is required in any case, and that the dispute is only about forbidding everything:
« ונ״ל דס״ל לב״י דקליפה עכ״פ בעינן ולא נחלקו אלא לאסור הכל » (ש״ך יו״ד ק״ז ס״ק א) The Taz states the same rule of iruy (ס״ק ד): דעירוי ככלי ראשון(ט״ז יו״ד ק״ז ס״ק ד). See also siman 105.
“Everything enters the doubt” — a lenient argument, and the Shach’s answer. The Shach examines the position of the Torat Chatat, which is lenient, and begins by conceding that its argument looks sound: since we hold like the Rashba and the Tur at siman 111 that everything enters the doubt, why should not everything here join together to nullify?
« כיון דקי״ל כהרשב״א והטור ס״ס קי״א דהכל נכנס בספק ולמה לא יצטרף כאן הכל לבטל » (ש״ך יו״ד ק״ז ס״ק א) His answer is that the poskim of our siman are speaking of one species within another — the non-kosher fish, the chick, the drop of blood, not being of the species of what surrounds them — and that in such a case the rule does not apply:
« והלכך במין בשאינו מינו כיון דאיכא למיקם אטעמא מתחלה לא נכנס הכל בספק » (ש״ך יו״ד ק״ז ס״ק א) « דהכא גם הרשב״א והטור מודים דאין מצטרפין » (ש״ך יו״ד ק״ז ס״ק א) So “everything enters the doubt” is, in the Rashba and the Tur, a ground for leniency; the Shach does not deny it, he limits its field.
The non-kosher fish — same species or not (ס״ק א). The Shach further supports his reading with the criterion of the name, which the Rama lays down at siman 98:
« דאזלינן בתר שמא דפשיטא דדג טמא דאית ליה שמא באפי נפשיה דהוי מין באינו מינו » (ש״ך יו״ד ק״ז ס״ק א) The non-kosher fish bearing a name of its own, it is judged as another species — and the laws of nullification change accordingly.
5. We leave the vessel in its presumption — the vessels are not forbidden
Even for those who are strict about the food, one is not strict about the vessels. And the reason for this is a great chiddush.
The foundation — the presumption of the vessel.
Although there are those who forbid the eggs or the fish, the vessels in which they were cooked are not forbidden:
« ואפילו לדעת האוסרים אין לאסור הכלים שנתבשלו בו דמעמידין הכלי על חזקתו » (רמ״א יו״ד ק״ז:א) For the doubt concerns what was left last without sixty; as for the vessel, its presumption is that it was not rendered forbidden.
How long the vessel stays in its presumption (ש״ך ס״ק ב).

The Rama’s formulation
The vessel remains in its presumption, with no condition of delay
The Maharil, brought by the Shach
The vessel is permitted only after twenty-four hours, the absorbed taste being spoiled by then and the doubt becoming rabbinic
The Shach’s inference — the proof that a Torah prohibition is at stake. The Shach refers to the responsum of the Maharil, who gives several reasons for distinguishing the food from the vessel:
« עיין בתשובת מהרי״ל סימן קס״ב שכתב הרבה טעמים לחלק בין המאכל לכלי » (ש״ך יו״ד ק״ז ס״ק ב) then notes the condition of delay the Maharil lays down there:
« וכתב שם דנראה דלא התיר הכלי אלא אחר מעל״ע משום דהוה ספיקא דרבנן דנטל״פ » (ש״ך יו״ד ק״ז ס״ק ב) and draws his conclusion: if the Maharil needed the twenty-four hours for the doubt to become rabbinic, then without them the prohibition at issue is of Torah standing.
« ומזה ראיה דהסמ״ג והפוסקים מיירי באיסור דאורייתא » (ש״ך יו״ד ק״ז ס״ק ב)And for practice — ask your Rav.
6. Blood of eggs and brine of non-kosher fish, rabbinic — precisely through salting
Chakira — of the Torah or of the Sages? Are the blood found in eggs and the brine of non-kosher fish forbidden by the Torah or by the Sages? For the blood of eggs does not have the status of full blood, and brine is not the fish itself. On the answer hangs the fate of every doubt in the siman.
What the Shach and the Pitchei Teshuva rule (ס״ק א). The Pitchei Teshuva refers to the end of the Shach’s ס״ק א and states its conclusion:
« עש״ך סוף סק״א מ״ש דהא דציר דגים טמאים דרבנן היינו דווקא ע״י מליחה ולא על ידי בישול » (פת״ש יו״ד ק״ז ס״ק א) « ועיין מ״ש מזה לעיל סימן פ״ג ס״ק ה׳ בשם תשובת נו״ב » (פת״ש יו״ד ק״ז ס״ק א) The Shach, at the place referred to, writes the distinction in so many words:
« דוקא ציר ע״י מליחה הוא מדרבנן משא״כ טעם ע״י בישול דיוצא עיקר הטעם והלחלוחית » (ש״ך יו״ד ק״ז ס״ק א) and supports it from the Mahara”i: a non-kosher fish pickled with a kosher fish is forbidden by Torah law, the brine and the moisture coming out in full.
« דדג טמא שכבשו עם הדג טהור אסור מדאוריית׳ שאז יוצא עיקר הציר והלחלוחית » (ש״ך יו״ד ק״ז ס״ק א) He also notes that the Semag, for his part, holds the blood of eggs to be a Torah prohibition:
« דסבירא ליה לסמ״ג דדם ביצים דאורייתא » (ש״ך יו״ד ק״ז ס״ק א)
The Taz ס״ק ה — the blood of eggs, and the spoon. The Taz refers to siman 66 for the status of the blood of eggs:
« ולענין עיקר הדין שכתב או״ה דקי״ל דם ביצים דרבנן כבר נתבאר בסימן ס״ו סעיף ד׳ » (ט״ז יו״ד ק״ז ס״ק ה) and recalls the middle path the Rama traces there:
« הכרעת רמ״א דכל היכא די״ל חד בתרי בטל אז סמכינן אמ״ד דם ביצים דרבנן אבל בלאו הכי אנו מחמירין כמ״ד דם ביצים הוא דאורייתא » (ט״ז יו״ד ק״ז ס״ק ה) He adds — and this is the door onto the second seif — that even according to the lenient opinion one is strict if each egg was taken out with the same spoon:
« ואפילו לדעה זו יש להחמיר אם בישל ביצים הרבה בקדירה והיה ביניהם אחת שהיא אסורה והוציא כל א׳ בכף אחת דיש לחוש שמא הוציא האסורה בראשונה ונאסר הכף ממילא נאסרו האחרים אח״כ » (ט״ז יו״ד ק״ז ס״ק ה) for R. Shimshon’s leniency rests on the issur being in the majority, which can no longer be said here:
« דהא דאמרי׳ לא מחזקינן איסורא כו׳ היינו מטעם דאמרינן איסורא ברובא איתא » (ט״ז יו״ד ק״ז ס״ק ה) The Nekudot HaKesef, on this same ס״ק ד of the Taz, simply refer to the Shach: עיין בש״ך סק״א נתבאר הכל על נכון(נקודות הכסף יו״ד ק״ז).
summary: a fly and the like, of those repulsive things from which a person’s soul recoils, found in a dish — he throws it out and the dish is permitted, for the emission of these spoiled things does not forbid. The Rama’s gloss: such is the widespread custom; although there are those who are strict, the words of those who are lenient are the main ruling, and the custom is not to be changed. And if one took a non-kosher fish out of the pot with the spoon, or some other thing that does not spoil, it is forbidden to put the spoon back into the pot; and if one did put it back, sixty are required in the pot against the issur, and not against the whole spoon. But if a little of the food was on the spoon with the issur and the spoon was put back, sixty are required against that little food as well, since it became neveila on the spoon.
7. The fly and the repulsive thing — the taste that spoils
The foundation — what a repulsive thing gives off does not forbid.
« זבוב וכיוצא בו מדברים המאוסים שנפשו של אדם קצה בהם שנמצא בתבשיל זורקן והתבשיל מותר » (שו״ע יו״ד ק״ז:ב) and the reason is given in the seif itself:
« שאין פליטת דברים אלו הפגומים אוסרת » (שו״ע יו״ד ק״ז:ב) This is the rule of the taste that spoils: what gives only a bad taste does not forbid, even though that taste really enters the dish. The Shach refers, for the whole subject, to the end of siman 104: ע״ל ס״ס ק״ד ועיין מ״ש בס״ס זה(ש״ך יו״ד ק״ז ס״ק ג).

The Mechaber and the Rama
The words of those who are lenient are the main ruling, such is the widespread custom, and it is not to be changed
The Maharam of Padua and the Maharshal, in the Shach
The custom is to be strict; one is lenient in case of great loss or pressing circumstance, and in vinegar or beer all forbid
The Shach’s astonishment (ס״ק ז). The Shach first notes that the Rama sided with the Mechaber:
« ולענין אי זבוב אוסר בטעמו הסכים הרב להמחבר וסייעתו » (ש״ך יו״ד ק״ז ס״ק ז) then expresses his astonishment, the poskim who forbid being many, and reports the contrary custom:
« וכ״כ מהר״ם פדוואה דכן נוהגין » (ש״ך יו״ד ק״ז ס״ק ז) He then indicates where one may be lenient:
« מיהו במקום הפסד מרובה או שעת הדחק וכה״ג נראה דעת מהר״ם פדוואה בתשובה להתיר וכ״פ הב״ח » (ש״ך יו״ד ק״ז ס״ק ז) and where none is lenient:
« מיהו בחלא ושיכרא לכ״ע אסור וכמו שנתבאר בס״ס ק״ד » (ש״ך יו״ד ק״ז ס״ק ז)
Pitchei Teshuva (ס״ק ב) — on the widespread custom. On the Rama’s words “such is the widespread custom”, the Pitchei Teshuva refers to the responsum of the Radbaz:
« עיין בתשובת רדב״ז החדשות סי׳ מ״ז » (פת״ש יו״ד ק״ז ס״ק ב) The Rama himself writes:
« וכן המנהג פשוט אף על גב דיש מחמירין דברי המקילין עיקר » (רמ״א יו״ד ק״ז:ב) « ואין לשנות המנהג » (רמ״א יו״ד ק״ז:ב)
8. The law of the spoon — that a vessel does not become neveila
The second half of the seif — the spoon that brought up an issur, and the question of “a piece becomes neveila” in a vessel.
The foundation — no “piece become neveila” in a vessel.
« ואם לקח עם הכף דג טמא מן הקדירה או שאר דבר שאינו פוגם אסור להחזיר הכף לקדרה » (רמ״א יו״ד ק״ז:ב) « ואם החזירו צריך ס׳ מן הקדירה נגד האיסור ולא נגד כל הכף » (רמ״א יו״ד ק״ז:ב) and the Rama gives his reason in parentheses:
« דלא אמרינן גבי כלי חתיכה נעשית נבילה » (רמ״א יו״ד ק״ז:ב) A vessel is not a “piece” that would become neveila in its entirety; the sixty are therefore measured only against the issur it carries. The Shach adds that the spoon is not helped by what it contains itself: אע״פ דיש בכף ס׳ נגד האיסור דאין משערינן בכלי בס׳(ש״ך יו״ד ק״ז ס״ק ד) — and he refers to siman 92, seif 5.

The text of the Shach (ס״ק ה). « והיינו דוקא בכלי של עץ ומתכות חדש אבל בישן או של חרס אפילו חדש דעת הרב לעיל סימן צ״ח ס״ה » (ש״ך יו״ד ק״ז ס״ק ה) « דיש להחמיר דנ״נ וצריך ששים נגד כל הכף » (ש״ך יו״ד ק״ז ס״ק ה)
The little food that became neveila on the spoon (ש״ך ס״ק ו). If a little of the food was on the spoon with the issur and the spoon was put back, sixty are required against that little food as well; the Rama writes it in so many words:
« אבל אם היה מעט מן התבשיל עם האיסור בכף והוחזר לקדירה צריך ס׳ גם נגד מעט התבשיל דהרי נעשה נבילה בכף » (רמ״א יו״ד ק״ז:ב) The Shach defines its scope:
« משמע דאפילו הוחזר לקדרה עם הכף אינו צריך אלא ששים נגד מעט התבשיל אם הוא יותר מן האיסור דנ״נ אבל א״צ ס׳ גם נגד כל הכף » (ש״ך יו״ד ק״ז ס״ק ו) and then raises a difficulty that he does not resolve, ending on a “this requires examination”:
« וקשה דכיון דידעי׳ דהיה מעט תבשיל עם האיסור בכף א״כ מאן לימא לן דאין כל הכף בלוע מאיסור דנהי דלא נעשה נבילה מ״מ לא ידעינן כמה בלע וכ״פ באו״ה וצריך עיון » (ש״ך יו״ד ק״ז ס״ק ו) It is reported here because it is asked, and it is not resolved.
Nafka mina — the spoon as a first vessel as regards stringency (ש״ך ס״ק ז). The spoon taken boiling out of the pot is treated as the pot itself:
« דאנו מחזיקין הכף ההיא שעתא כמו הקדרה עצמה מאחר שהוציאה עתה מהקדרה רותחת וחשיב כלי ראשון לחומרא » (ש״ך יו״ד ק״ז ס״ק ז) This is the source of the precaution: not to put it back, lest it give back to the pot what it has absorbed. And for practice — ask your Rav.
The overall chakira of the siman. How do we permit a mixture one of whose items is forbidden, when they are taken out one by one? And what force is there in what a repulsive thing gives off?
What is left last — a fear born of the order of removal; its remedy is cooling, or pouring out at once.
The two motives — we do not presume an issur (R. Shimshon, adopted by the Rama) against nullification in a dry majority (R. Baruch); and according to the Shach a majority is required in both.
The asymmetry of eggs and fish — fish are numerous and are nullified; eggs make no majority (the Maharshal, the Taz).
The vessels — in their presumption; and for the Maharil, only after twenty-four hours.
The fly and the spoon — a spoiling taste does not forbid; and of a spoon we do not say “become neveila”, unless it is old or of earthenware.
Nafka mina lema‘aseh (according to the ruling of most Acharonim).
One who boils many eggs in their shells should not take them out one by one while they are hot: he should cool them, or pour them out at once (מחבר ס״א).
If he did not take care and one is found forbidden — there are those who permit, and this is the main ruling, for we do not presume an issur (רמ״א ס״א).
In fish there is more room for leniency, since they are nullified in the majority; in eggs there is reason to fear, for want of a majority (מהרש״ל, ט״ז ס״ק ד); and after the fact the Taz is lenient (ט״ז ס״ק א).
The vessels remain in their presumption, and for the Maharil after twenty-four hours (ש״ך ס״ק ב).
A fly or a repulsive creature in a dish — one throws it out and the dish is permitted, the taste being spoiled (מחבר ס״ב); and for those who are strict, in case of great loss (ש״ך ס״ק ז).
A spoon that brought up an issur that does not spoil — one should not put it back; and if one did, sixty against the issur (and against the whole spoon if it is old or of earthenware).
Fear that the issur is left last and forbids; remedy: cooling
Having poured everything into the dish, and one is found tereifa
There are those who forbid; and there are those who permit — and this is the main ruling
Small fish among which a non-kosher fish is found
They are nullified in the dry majority — permitted, because they are numerous
Eggs — with no majority
No nullification in the majority — there is reason to be strict
Pouring off the boiling water
Like a first vessel — forbids only the thickness of a peel
The vessels in which they were cooked
In their presumption; for the Maharil, after twenty-four hours
A fly or a repulsive thing in the dish
One throws it out, and the dish is permitted — the taste spoils
A spoon that brought up an issur and was put back
Sixty against the issur alone — a vessel does not become neveila
