summary: an important item forbids, within its own kind, in any quantity whatever; these are seven named items, to which living creatures are added. Everything else, even if it is customarily counted, is nullified by the ordinary measure. The Rama adds that whatever is always counted is not nullified, and that this is the practice — and then lays down the key to the whole siman: this non-nullification is only rabbinic, so a doubt about it goes to leniency. The siman opens, finally, on what its heading announces: a doubt of tereifa that arose in meat.

1. Opening the sugya — siman 110, the foundation of the laws of doubt

↩ Detailed explanation (level 1)

The foundation — a siman that founds the laws of doubt

Siman 110 is the founding siman for the laws of doubt within the laws of mixtures. Its heading announces « דין ספק טריפות שאירע בבשר » (שו״ע יו״ד ק״י — the siman heading) — but what it actually treats reaches far beyond that title, and the reader should know it from the start. Four foundations are examined here: (a) davar chashuv, what is not nullified even in a thousand (seifim 1–2); (b) כל קבוע כמחצה על מחצה against כל דפריש מרובא פריש, the law of the majority and the law of the fixed (seifim 3–5); (c) what has separated from an important mixture — deliberately or of itself (seifim 6–7); (d) safek sfeka — when two doubts permit and when they do not join (seifim 8–10). What binds it all together: what becomes of a doubt where neither the majority nor nullification comes to the rescue?
Three distinct instruments. Three mechanisms must be kept apart, and nothing permits confusing them — nullification in a majority or in sixty (the forbidden item disappears inside the mixture), majority (we follow the greater number in a doubt — כל דפריש), and safek sfeka (two doubts that permit because neither of them can be resolved). Davar chashuv disables the first; kavua disables the second; a doubt born in the body itself disables the third. All three share one root: a factor that strips the ordinary permission of its force.
The sources of the sugya, as the commentaries of this siman name them. For כל קבוע the Shach points to two precise places — Bava Kamma 44b and Kesubos 15a, which his sentence names in parentheses — and to a verse:

The verse is that of the murderer who lies in wait — « וְאָ֤רַב לוֹ֙ וְקָ֣ם עָלָ֔יו » (דברים י״ט:י״א) — from which the Sages derived, in a capital doubt, that a forbidden thing left in its place is judged not by the majority but as half and half. And the Shach adds at once that this rule cuts both ways, to be lenient and to be strict:

2. דבר חשוב ודבר שבמנין — the seven items and the egg

↩ Detailed explanation (level 1)

This is the foundation of the siman: what is an "important item" that is not nullified even in a thousand, and why?

The chakira — what is the gader of this "importance"? Why should the force of nullification give way before an important item? A majority of permitted matter does nullify a forbidden one! Three readings present themselves: (a) seven items only — a closed list, the one the Mechaber enumerates; (b) every living creature, whose importance is its own; (c) according to the Rama, every דבר שבמנין, anything always sold by count rather than by estimate. The question is not decorative: it decides whether importance is a property of the thing or a property of how people handle it.
R. Yochanan and Reish Lakish — how to read "דבר שבמנין" (ט״ז ס״ק א):
ShitaReading of the mishnaWhat follows for the egg
R. Yochanan, according to R. Meir Only what is never sold other than by count; the egg, sometimes sold by the basketful, is nullified
Anything customarily counted; the egg is not nullified
The Mechaber, at the head of the siman Only a davar chashuv is not nullified; a davar shebeminyan is
The Rama ("and so is the practice") What is always counted is not nullified

The Taz explains the division through the example of the egg itself:

The Shach and the Taz do not come out on the same side. The Shach reads the Rama's "always" literally — on which the egg would be nullified; he then reports that the Maharshal and the Bach hold the stricter view, and that such is the practice. The Taz, for his part, dwells on the fact that the whole matter is rabbinic and draws a practical consequence from it.
The foundation — davar chashuv is only rabbinic, so its doubt goes to leniency.
The Rama states the principle, and the Shach states its exact reach: what goes to leniency is a doubt about the importance itself, and not every doubt in the siman.
The Mechaber writes that a davar chashuv forbids « דבר חשוב אוסר במינו בכל שהוא » (שו״ע יו״ד ק״י:א) — "within its own kind". The Shach notes that the whole seif is taken from the Rambam, and that the Rama, in his Toras Chatas and in his gloss at siman 101, ruled otherwise; he then wonders why the Rama annotated nothing here.
A davar chashuv is forbidden in benefit too (ש״ך ס״ק ב). The Shach establishes that an important item that is not nullified is not nullified as regards benefit either, and reports from Tosafos, in the name of the Yerushalmi, the remedy: to sell the whole to a non-Jew while deducting the price of the forbidden part it contains — and only where there is no concern that he will resell it to a Jew.
Importance is local and dated. The Mechaber closes the seif by measuring importance against the usage of the place and the time: the seven items were named only because they forbid everywhere, and the same holds for whatever resembles them elsewhere.

Hence the dispute the Pitchei Teshuva (ס״ק א) reports about the egg: the Minchas Yaakov, in the name of the Taz, is lenient in a case of substantial loss; the Teshuva Me'ahava refuses, and holds that nowadays the egg remains forbidden even there.

3. Living creatures are nullified once slaughtered

↩ Detailed explanation (level 1)

The text of the Shulhan Arukh —

summary: living creatures mixed with others and then slaughtered lose their importance and are nullified — provided the slaughter was done inadvertently; and the Rama restricts this to small animals, those one does not serve a guest with once slaughtered.

The foundation — an importance that holds only while alive.
The animal's importance lies in its being a whole, living creature. Once slaughtered, it is no longer "a living creature" but a piece of meat, and it is nullified in the majority. Hence the two conditions the text carries: the slaughter « בעלי חיים שנתערבו באחרים ונשחטו בטל חשיבותן ובטלין והוא שנשחטו בשוגג » (שו״ע יו״ד ק״י:ב) — inadvertent, so that no one may arrange to nullify a forbidden item on purpose; and the Rama's restriction to small animals.
Two distinct importances (ט״ז ס״ק ב). The Taz shows that the importance of a living creature is not that of a piece one serves a guest with (the חתיכה הראויה להתכבד of siman 101): the first falls with the slaughter, the second can take over if the animal is large. That is why the gloss specifies "small". There are therefore two gates of importance, and the small slaughtered animal has passed out of both. The Taz first reports the Maharshal's answer — which distinguishes a flayed animal from an unflayed one — and then gives his own.

4. The nine shops —

↩ Detailed explanation (level 1)

The text of the Shulhan Arukh —

summary: nine shops sell ritually slaughtered meat and one sells neveila; he bought from one of them without knowing which — it is forbidden, since whatever is fixed in its place counts as half and half. But meat found in the market, or in a non-Jew's hand, is permitted: what separated, separated from the majority. The Mechaber adds that this is the law of the Torah, and that the Sages nevertheless forbade. The Rama refers to siman 63 and sets the limit of "separated before us".

The foundation — the fixed against the separated.
Two opposite laws stand in a single seif:

• « שכל קבוע כמחצה על מחצה דמי » (שו״ע יו״ד ק״י:ג) — a forbidden item left in its place is judged as half and half, and the majority does not carry it, so that the purchase is forbidden even though nine shops out of ten are kosher.
• « דכל דפריש מרובא פריש » (שו״ע יו״ד ק״י:ג) — what has already separated is followed by the majority: it is from the majority that it separated, so it is permitted.

And the Mechaber himself marks the gap between the written law and the rabbinic prohibition.
Separated before us or out of our sight (רמ״א ס״ג). The Rama restricts: the rule of the separated holds only where the separation did not happen under our eyes. If we saw it, or if we saw the non-Jew take the piece, it is as though he had taken it by hand from the fixed — and the status of kavua returns. The whole difference between "the meat found" and "the meat we saw taken" lies there.
Meat that passed out of sight (see siman 63). Even though "the meat found" is permitted by the law of the Torah, the Sages forbade meat that disappeared from view and was then found again, lest it had been exchanged. This is a rabbinic stringency treated at siman 63, to which the Rama expressly refers from our seif. We decide nothing here: see there, and ask your Rav.

5. A majority of shops, and a mixture — does a safek sfeka work on something kavua?

↩ Detailed explanation (level 1)

This is one of the sharpest divergences in the siman: does a safek sfeka permit when the first doubt is a doubt of kavua?

The text of the Shulhan Arukh —

summary: a majority of shops sell ritually slaughtered meat and a minority neveila; he bought from one of them without knowing which, and then the piece was mixed with others and is no longer recognisable — for the Mechaber it is nullified in the majority on the ground of safek sfeka; the Rama reports those who forbid, and concludes that such is the practice.

The root of the divergence — a safek sfeka upon something kavua:
ShitaMajority of shops + mixtureSource
The Mechaber The piece is nullified in the majority, on the ground of safek sfeka: a doubt about the shop, then a doubt about the piece
The Rama ("there are those who forbid") The first doubt is a doubt of kavua, hence forbidden by the law of the Torah; the mixture adds no second doubt, it is merely a mixture — and that is not called a safek sfeka
The chakira — what is a genuine "second doubt"? The Mechaber sees in the two events — from which shop, then which piece — two independent doubts. The Rama objects that the first doubt is already a Torah prohibition: the mixture then adds nothing as to the existence of the prohibition, it only asks where it is. This is exactly the rule that will return at seif 9, under the name of a doubt born in the body itself.
Majority of shops or majority of meat (פתחי תשובה ס״ק ב, in the name of the Beis Efraim). The entry is anchored on seif 3, on the words "the meat found", and not on our seif; we read it here because it illuminates the same division. The question is this: does one follow the number of shops or the quantity of meat sold? The Beis Efraim does not decide one way only — he distinguishes two cases.

6. Meat from the makulin — before and after

↩ Detailed explanation (level 1)

The text of the Shulhan Arukh —

summary: one who bought meat at the stall — even a piece one serves a guest with — and a tereifa was found there without the tereifa pieces being recognisable, everything he took before the discovery is permitted; from then on, taking is forbidden, even a piece one does not serve a guest with.

The foundation — before / after.
A tereifa was found at the stall, and it is not recognisable.

• Before the discovery: the doubt did not fall upon the fixed, it arose after the piece had separated from it, and the majority of the stall is kosher → permitted.
• From then on: whoever would take now would be taking from the fixed → forbidden, and even a piece one does not serve a guest with, because not everyone knows the difference.
Kavua of the Torah and rabbinic kavua (ט״ז ס״ק ג). The entry is anchored on seif 4, but its entire subject is the stall of our seif: the Taz begins by questioning the Mechaber, and then distinguishes two kinds of fixed. In the first, the forbidden item is present and recognisable in its place — these are the nine shops, and there כל קבוע holds by Torah law. In the second, everything in the stall would be nullified in the majority by the written law, and it is the Sages who gave it the status of the fixed. The nafka mina for doubts is considerable.
The Pitchei Teshuva on this seif (ס״ק ד–ה). On the word "permitted" he reports the very concrete case of the Mahari"t — a butcher who slaughters seven animals at home, takes two out to the stall and half of a third, the other half staying at home, and then a needle is found and no one knows in which animal; and on the word "forbidden" he refers to the Tiferes Tzvi and the She'ilas Yaavetz. We do not decide this case: it is given as the place where the Taz's distinction is put to the test.

7. פירש במתכוין and פירש ממילא — the Rashba against the Rosh

↩ Detailed explanation (level 1)

The text of the Shulhan Arukh —

summary: living creatures and other important items mixed into permitted matter are not nullified even in a thousand; if one separated from the majority after the mixture became known, it is forbidden — and that is when it was separated deliberately, but if it separated of itself it is permitted. The Rama restricts the prohibition to where only part was separated and forbidden items remain in their place, adds that the last two remain forbidden, and closes with the egg found among the hens.

פירש ממילא — the Rashba against the Rosh (ש״ך ס״ק ל״ג–ל״ז):
ShitaSeparated of itself from an important mixtureSource
The Rashba Permitted — the fixity is already undone, so we follow the majority as with anything separated; and the same holds if all of it scattered, even before our eyes
The Rosh and many poskim Forbidden — even separated of itself, because everything is mingled here and the forbidden item is not recognisable on its own, unlike the nine shops

The Mechaber ruled like the Rashba; the Rama joined to it the restriction that comes from the Rosh — forbidden items must have remained in their place. And the Shach further reports, in the Rosh's name, that as long as the mixture was not yet known the matter is permitted even for the one who forbids what separated of itself.

The foundation — deliberately against of itself.
A mixture of important items, which are not nullified. If one of them separates after the mixture became known: separated deliberately, it is forbidden, for that is like taking from the fixed in its place; separated of itself, it is permitted, for we follow the majority. The reason for the division: in taking by hand he selects from the fixed; in a spontaneous separation, what separates ordinarily separates from the majority.
All of it scattered, and the last two The Rama restricts: the prohibition of "separated deliberately" holds only if part alone was separated and forbidden items remained in place — there we fear he may take from the fixed. But if all of it was separated together and nothing remained in its place, what then separated is permitted: there is no longer a fixed to draw from. The last two, however, remain forbidden — those are genuinely half and half. And the Shach explains, in the Rashba's name, that everything scattering before our eyes amounts to separating out of our sight.
Nafka mina — the egg and the majority of hens. A tereifa hen was mixed among kosher ones and an egg is found among them: the egg is permitted. The hens themselves are important and are not nullified, but the egg is not a living creature: it is a separate thing, which is nullified in the majority, and for it we follow the majority of the hens. The mother's importance does not pass to the egg. And in practice — ask your Rav.

8. Eaten / fallen into the sea — two by two

↩ Detailed explanation (level 1)

The text of the Shulhan Arukh —

summary: something not nullified because of its importance — a living creature, a whole creature, a piece one serves a guest with, something that will find its permission — was mixed in, and one of them was eaten inadvertently, or fell of itself into the sea so that it was lost from the world: all the rest is permitted, for we suppose that the forbidden one is the one that went. But the rest is eaten only two by two; one by one is forbidden. The Rama adds that one person shall not eat them all, and that even two people shall not eat them all at once.

The foundation — "the forbidden one has gone".
An important thing was mixed in, and one of the mixture was eaten inadvertently or lost from the world: we suppose that it is the forbidden one that went, and all the rest is permitted. But they are eaten only two by two: in each pair, either way, at least one is permitted — there was only one forbidden item, so both cannot be it. One by one is forbidden: that one may be the forbidden one.
"Lost from the world", and nothing less The Shach, in the Rashba's name, states the condition in its strict form: as long as the thing still exists in the world, why should we say that it was that one which was the forbidden one? On the contrary — the forbidden one is in the majority. The permission therefore holds only if the forbidden item has gone out of existence.
The Taz does not accept the received explanation (ט״ז ס״ק ח). The Beis Yosef explained the gap between "eaten" and "fallen into the sea" thus: we penalise the inadvertent because of the deliberate only where a person acted — hence for the fall into the sea, not for what was eaten. The Taz declares himself troubled by this, because the explanation contradicts a responsum of the Rosh, and he concludes in the other direction: we must fear that someone will deliberately feed the forbidden item to a dog or a non-Jew. The question remains open here as it remains open with him.
Two by two, four by four The Shach, resting on Rashi in Zevachim, draws the general rule: if two were lost, one eats four by four; if three, six by six. The size of each group follows the number of those lost. And he notes that on the plain sense of Tosafos and the Rosh, two by two could be eaten by one person, provided he does not eat them all at once — the Rama's formulation comes from the Beis Yosef reading the Tur, and the Shach holds it not binding; see also siman 140.

9. Two and three mixtures — the safek sfeka of dilution

↩ Detailed explanation (level 1)

Here begins the heart of the study of safek sfeka: how the dilution of a mixture gives birth to a second doubt.

The text of the Shulhan Arukh —

summary: something not nullified because of its importance was mixed with others; from that mixture one fell into two others, and from the three one fell into two others — these last are permitted. But if one from the first mixture fell into a thousand, all are forbidden. The Rama adds that one person shall not eat them all, distinguishes a certain prohibition from a doubtful one, and reports those who refuse safek sfeka for something that will find its permission.

The foundation — two or three mixtures.
An important forbidden item was mixed in; one of the mixture falls into two others, and from the three one falls into two others → the last are permitted, because the one from the first mixture was nullified in the majority. But if one from the first mixture falls into a thousand, all are forbidden: there is only a mixture there, not a second doubt.
Where the requirement of three mixtures comes from — Rabbeinu Tam against Rabbeinu Yitzchak
ShitaWhat he holdsSource
Rabbeinu Tam The gemara's "mixed into a thousand" speaks only of an egg certainly laid on Yom Tov; if it is the doubt that was mixed in, that is a safek sfeka and it is permitted — two mixtures suffice
Rabbeinu Yitzchak In such a case it is not a safek sfeka; three mixtures are needed, as with orlah in Zevachim
A certain prohibition: three mixtures; a doubtful one: two (רמ״א ס״ח). The Rama rules by distinguishing: for a certain prohibition the dilution must pass through three mixtures before a safek sfeka is born; but if what was mixed in is already a doubt of prohibition — a doubt already present in the thing itself — two mixtures suffice, the first doubt being given and the dilution producing the second. The number of mixtures required therefore depends on how many doubts are already present in the object. This is precisely Rabbeinu Tam's position, which the Taz has just reported.
Something that will find its permission, within a safek sfeka
Shitaדשיל״מ within a safek sfekaSource
"There are those who say" — the Rama A safek sfeka does not permit it, since it will find its permission of itself; and it is good to be strict where there is no need
The Taz He finds the Rama's gloss difficult, and reports the Ran, who permits a safek sfeka in a rabbinic
The Shach He hesitates to be lenient outside a substantial loss, and holds that in a rabbinic matter one does not say, for a דשיל״מ, that the doubt goes to leniency וצ״ע אם יש להקל בזה שלא במקום הפסד מרובה כיון דגדולי הפוסקים סוברים כן (ש״ך יו״ד ק״י ס״ק נ״ח)
The Tzlach / Noda BiYehuda (reported by the Pitchei Teshuva) The stringency applies only to what had no presumption of permission; what did have one, its rabbinic doubt is permitted even in a

10. A doubtful tereifa mixed in · a tereifa lung — the doubt born in the body itself

↩ Detailed explanation (level 1)

The text of the Shulhan Arukh —

summary: a doubtful tereifa that was mixed with others — all are forbidden until there is enough permitted matter to nullify the forbidden one (if it is of the kind that is nullified), because the first doubt arose in the body itself and cannot be permitted by a safek sfeka. The Rama gives another reason, and then sets out the converse case: two doubts bearing on the very existence of the prohibition and known together permit everywhere, even against a presumption of prohibition.

The foundation — a doubt born in the body itself is not untied by a safek sfeka.
The doubt arose in the piece itself — tereifa or kosher — and the mixture adds no doubt as to the existence of the prohibition, only as to where it is. There are therefore not two independent doubts; a mere mixture does not make a safek sfeka. This is the very rule of seif 4.
The chakira — two doubts bearing on the existence of the prohibition (רמ״א ס״ט). The Rama sets out the converse case: if both doubts bear on whether there is a prohibition here at all, and they became known together, the safek sfeka permits everywhere — even in a Torah matter, even in the body of the prohibition, and even against a presumption of prohibition. His example: a bird whose wing was broken or dislocated, with a doubt whether it was before the slaughter or after; and if before, perhaps the lung was not punctured. Two doubts, so we permit.
The rules of safek sfeka — when two doubts join
The conditionThe explanationSource
One body, one subject Both doubts must bear on the prohibition itself, and not one on the body and the other on a mere mixture
The first doubt is not already a Torah prohibition The Shach goes further than the Rama: even if both doubts became known together, once the first is a Torah prohibition it is not a safek sfeka

And the Shach gives the two underlying reasons that make the ס״ס fall: the doubts are not of one subject, or they are not of one body.

Presumption of prohibition, and the examination of the lung On the presumption of prohibition, the Shach supports the Rama in the name of a responsum of the Rashba: the safek sfeka works even there. But on the Rama's last words — that one need not be concerned about being able to check by examining the lung — the Shach does not follow: he reports that the Rashba, in his chiddushim, requires the examination wherever verification is possible, and he writes that so it appears to him too, with a proof. He adds that if a defect is seen in the internal organs, no safek sfeka holds. This is one of the places in the siman where the gloss and its commentator do not go the same way; we decide nothing — ask your Rav.
The Pitchei Teshuva on the rules of rabbinic doubt (ס״ק ט״ו). The divergence he reports is substantive, and it runs in this direction: the Pri Chadash disputes the Shach and is lenient — even where the matter has a Torah basis and there is a presumption of prohibition, the rabbinic doubt goes to leniency; the Shaar HaMelech refutes the Pri Chadash at length and upholds the Shach in his stringency.

The text of the Shulhan Arukh —

summary: a tereifa lung found among kosher lungs, the examiner having said that he knew that adhesion, and the tereifa lung having been mixed by mistake among the kosher ones — if there was no confusion among the animals, the animals are permitted.

The foundation — no confusion among the animals.
The tereifa lung, which the examiner recognised by its adhesion, was mixed by mistake among the kosher lungs. As long as there was no confusion among the animals themselves, each lung is still attached to its own animal and the animals are permitted: the doubt bears only on the lungs that were mixed, not on the bodies. The lungs were mingled, the animals were not — and that is the condition of the permission.

11. The chakira of safek sfeka and its practical nafka mina

↩ Detailed explanation (level 1)
The chakira that holds the whole siman: when is the ordinary force of permission — nullification, majority, doubt — disabled, and what restores it?
What this yields for study — and what remains open:
  1. A davar chashuv and a davar shebeminyan are not nullified (רמ״א ס״א); but a doubt about the importance itself goes to leniency, because the matter is rabbinic (רמ״א ס״א; ש״ך ס״ק י׳). The Taz draws from this that one may rely on those who permit in a case of loss (ט״ז ס״ק א); the Shach reports that the practice is stringency (ש״ך ס״ק ט׳), and the Pitchei Teshuva reports both. The question is not settled here.
  2. כל קבוע כמחצה על מחצה (מחבר ס״ג); and what separated out of our sight follows the majority and is permitted (מחבר ורמ״א ס״ג).
  3. A safek sfeka does not permit when the first doubt is a kavua or a doubt born in the body (רמ״א ס״ד וס״ט); but two doubts bearing on the existence of the prohibition and known together do permit, even against a presumption of prohibition (רמ״א ס״ט; ש״ך ס״ק ס״ד).
  4. Separated of itself: permitted, like the Rashba, and so the Mechaber (מחבר ס״ו); separated deliberately while forbidden items remain in place: forbidden, unless all of it scattered (רמ״א ס״ו) — and the Rosh, with many poskim, forbids even what separated of itself (ש״ך ס״ק ל״ו).
  5. For something that will find its permission, the Rama refuses the safek sfeka and advises stringency where there is no need (רמ״א ס״ח); the Taz finds this difficult and reports the Ran (ט״ז ס״ק י״א); the Shach upholds the stringency (ש״ך ס״ק נ״ח–נ״ט). Here too nothing is settled here.
  6. On whether the lung must be examined when there is a safek sfeka, the Rama's gloss and the Shach do not go the same way
And in practice — ask your Rav.
