Translation: two pots, one permitted and one forbidden, and before him two pieces, one permitted and one forbidden — if the piece is of a rabbinic prohibition, such as the fat over the sciatic nerve, and they fell into one another, they are permitted, for we attribute and say that the forbidden fell into the forbidden and the permitted into the permitted; and this even if the permitted in the pot does not exceed what lay before it. And likewise if there was only one pot of ritually slaughtered meat, and one of those two pieces fell into it and it is unknown which — we attribute that the permitted one fell, even if the permitted does not exceed the forbidden. Or if there was only one piece of a rabbinic prohibition and two pots, one permitted and one forbidden, and it is unknown into which it fell — here too we attribute leniently.

1. Introduction to the sugya — the foundation of תולין and שאני אומר

↩ Detailed explanation (level 1)

The foundation — תולין and שאני אומר, and its source in יבמות פ״ב

The foundation of the siman is the din of תולין — to attribute: when a forbidden piece and a permitted piece fell into two pots, one permitted and one forbidden, or when a single piece fell into one of two pots, we attribute the fall and say that the forbidden went to the side of the forbidden. The root of the din is the braisa the gemara cites concerning terumah:

Translation: two baskets, one of chullin and one of terumah, and before them two se’ah, one of chullin and one of terumah; they fell into one another — they are permitted, for I say: the terumah fell into the terumah and the chullin into the chullin. The basis of the leniency is therefore ספק דרבנן לקולא, together with the sevara of שאני אומר, “for I say”.

Why specifically a rabbinic prohibition (ש״ך ס״ק א׳–ב׳): the whole leniency of תולין is said only for a rabbinic prohibition — such as the fat over the sciatic nerve, the very example the Mechaber gives. The Shach states the reason: « דספק דרבנן קי״ל לקולא » (ש״ך יו״ד קי״א ס״ק א׳) For a Torah prohibition, by contrast, the doubt goes toward stringency, and one attributes leniently only if there is a majority of permitted matter — that will be seif ג׳. And the Shach adds that a prohibition whose root is in the Torah, such as the cheese of non-Jews, also falls under this rule: « וגבינה של עובד כוכבים וכיוצא בו אפילו איסור שיש להם עיקר בדאורייתא כ״כ הרשב״א בת״ה » (ש״ך יו״ד קי״א ס״ק ב׳)
The gader of שאני אומר (ט״ז ס״ק א׳): This is not nullification in a majority, but a way of conducting a doubt: we attribute, that is, we read the state of doubt leniently, saying that the forbidden piece presumably went where it is forbidden in any case. The Taz returns to this at the end of that same ס״ק, to say that any doubt in which one can say שאני אומר is lighter than an ordinary doubt — his words are quoted in section 3.

2. The three cases of seif

↩ Detailed explanation (level 1)

The Mechaber counts three cases, and all three are permitted in a rabbinic prohibition, even without a majority of permitted matter.

The three cases:
The caseThe pictureThe din
(א) Two pots + two pieces A permitted pot and a forbidden pot; a permitted piece and a forbidden piece fell into them Permitted — we attribute the forbidden to the forbidden and the permitted to the permitted
(ב) One pot of shechted meat + two pieces One of the two pieces fell in, and it is unknown which Permitted — we attribute that the permitted one fell
(ג) A single forbidden piece + two pots A single piece of rabbinic prohibition; two pots, one permitted and one forbidden, and it is unknown into which it fell Permitted — here too we attribute leniently
Two pots: lighter or heavier? (ש״ך ס״ק ו׳, anchored on the בד״א of seif ב׳) The Shach first observes that the Tur’s wording comes from the Toras HaBayis HaKatzar, and that the רשב״א, in Toras HaBayis HaArokh, does not appear to say so: « כל זה הוא לשון הטור מת״ה אבל קשה לי דמדברי הרשב״א בתה״א לא משמע כן » (ש״ך יו״ד קי״א ס״ק ו׳) From this he draws the distinction: in the case of two pots, where it is certain that a prohibition fell there and only the “which” is unknown, one needs at least חד בחד according to רבי יוחנן — « אלמא דדוקא בב׳ קדרות משום דבודאי נפל שם איסור אלא שאין ידוע לאיזו בעינן חד בחד לר׳ יוחנן » (ש״ך יו״ד קי״א ס״ק ו׳) — whereas in the case of two pieces and one pot, where one may say nothing fell into the pot at all, it is permitted even if the forbidden predominates, like the two mortars of the תוספתא (its text is quoted in section 9). And the רא״ה, in Bedek HaBayis, is more lenient still: « והרא״ה בב״ה שם חולק על הרשב״א וס״ל דאפילו בב׳ קדרות שרי אפילו האיסור רבה על ההיתר משום ספיקא דרבנן לקולא » (ש״ך יו״ד קי״א ס״ק ו׳)
Prohibitions that forbid in the least amount (ש״ך ס״ק ג׳, in the name of the נמוקי יוסף): the נמוקי יוסף writes that regarding severe prohibitions that are not nullified, one does not say שאני אומר even in a rabbinic prohibition, so long as there is no majority of permitted matter: « דאפשר דלענין איסורי משהו החמורים לא אמרינן שאני אומר אפילו באיסורי דרבנן בפחות מרוב » (ש״ך יו״ד קי״א ס״ק ג׳)
Recognisable pieces or not (ש״ך ס״ק ד׳): the Shach specifies how case (ב) is to be read — the two pieces were distinct and recognisable before they fell: « נראה דכאן מיירי דהב׳ חתיכות היו ניכרות בפני עצמן קודם נפילתן איזה מהן של היתר ואיזה מהן של איסור » (ש״ך יו״ד קי״א ס״ק ד׳) for had they first been mixed with one another, each would already be treated as a body of prohibition, and one would no longer say ספק דרבנן לקולא: « דאי נתערבו מתחלה חד בחד א״כ כיון דאתחזק איסור בב׳ חתיכות כל א׳ וא׳ דיינינן ליה כגופו של איסור ותו לא אמרינן ספקא דרבנן לקולא » (ש״ך יו״ד קי״א ס״ק ד׳)

3. A rabbinic measure and שאני אומר — lighter than siman 66

↩ Detailed explanation (level 1)

This is one of the sharpest chiddushim of the siman, and it is the Taz, at ס״ק א׳, who carries its whole weight.

The Taz’s question (ס״ק א׳): seifim ג׳ and ד׳ will teach that a Torah prohibition, once it is already nullified in the majority by Torah law and only the threshold of sixty remains rabbinic, also admits of תולין. Yet in siman 66 the Taz laid down the opposite rule: in such a doubt one is not lenient, and the matter is treated as a certain Torah prohibition. He raises the contradiction himself: « ולכאורה יש להקשות על מה שכ׳ בסימן זה דאם ספק נפל איסור דאוריית׳ מותר בשיעור דרבנן וזה סותר הכלל שאמרנו בסי׳ ס״ו ס״ד דבזה א״א מקילין אלא הוה כודאי דאורייתא » (ט״ז יו״ד קי״א ס״ק א׳)
The Taz’s answer — שאני אומר is not an ordinary doubt: he answers that the leniency here does not come from the doubt as such but from the sevara of שאני אומר, and that the gemara in פרק הערל says so expressly: a doubt in which one can say “no prohibition fell here at all” is lighter. « דכאן ההיתר מכח שאני אומר ובהדיא אמרינן בפ׳ הערל שזכרתי בסמוך דכל ספק שיש בו לומר שאני אומר לא נפל כאן איסור קיל טפי » (ט״ז יו״ד קי״א ס״ק א׳)
The yesod — the two layers of the prohibition:
In every prohibition that is nullified in a majority one must distinguish:

• the body of the prohibition — nullified in a majority by Torah law, in מין במינו as in dry with dry;
• the measure of nullification — the sixty which the Sages required as a stringency.

When the doubt bears only on that rabbinic measure, it remains a ספק דרבנן and goes toward leniency: that is where the whole permission of תולין comes from, and it is the root of the Taz’s words about siman 66.

4. The conditions of תולין — the prohibition does not predominate, Torah prohibition, מין במינו

↩ Detailed explanation (level 1)

The text of the Mechaber (seifim

Translation: ב׳ — all the foregoing, in which one attributes leniently even without the permitted predominating over the forbidden, holds only where the forbidden likewise does not predominate over the permitted; but if the forbidden predominates over the permitted, one does not attribute leniently. ג׳ — if the prohibition was of the Torah, one does not attribute leniently to say it fell into the forbidden, until the permitted predominates over the forbidden enough to nullify it within itself by Torah law. ד׳ — if the permitted predominates over the forbidden enough to nullify it by Torah law, one attributes leniently. How so? Two pots, one of ritually slaughtered meat and one of neveilah, and a piece of neveilah fell into one of them: if the permitted in the permitted pot slightly exceeds the piece of neveilah, one attributes leniently, since by Torah law a kind in its own kind is nullified in a majority, and it is the Sages who required sixty. If the two pots were of one kind and the prohibition of another kind, one does not attribute leniently until the permitted exceeds the forbidden by sixty.

The three degrees of the condition:
The situationThe measure requiredSource
Rabbinic prohibition, the forbidden does not predominate (seif ב׳) One attributes even without a majority of permitted (חד בחד) מחבר ס״א–ב׳
Torah prohibition (seif ג׳) A majority of permitted is required, enough to nullify it by Torah law מחבר ס״ג · ש״ך ס״ק ח׳
מין במינו (seif ד׳) Any majority at all — for by Torah law a kind in its own kind is nullified in a majority מחבר ס״ד · ט״ז ס״ק ג׳
מין במינו and אינו מינו (ט״ז ס״ק ג׳): the Taz explains that the same rule holds where there is both like and unlike: one mentally removes what is not of the kind, as though it were not there, and the kind then predominates over the prohibition and nullifies it, as at siman 98: « הוא הדין מין במינו ואינו מינו דאמרינן סליק שאינו מינו כאלו אינו ומינו רבה עליו ומבטלו כדאיתא סי׳ צ״ח » (ט״ז יו״ד קי״א ס״ק ג׳) And the Shach says the same on seif ג׳: a bare majority suffices only in מין במינו. « כלומר במין במינו דוקא סגי ברוב לחוד כדבסמוך ס״ד » (ש״ך יו״ד קי״א ס״ק ח׳)
How is “the forbidden predominates” to be pictured? (ט״ז ס״ק ב׳, ש״ך ס״ק ז׳) The Taz asks: since one knows the amount of permitted matter in the pot and the amount of the prohibition, let us look whether the pot’s contents have increased — we would then know for certain that the prohibition fell in! « אין להקשות כיון שיודע שיעור ההיתר שבקדירה והאיסור א״כ נחזי אם נתרבה ההיתר שבקדירה מכמות שהיה בודאי שם נפל האיסור » (ט״ז יו״ד קי״א ס״ק ב׳) His answer: the one who knows that the forbidden was the larger heard it from another, and he himself does not know how much permitted matter there was to begin with. « י״ל שזה יודע בבירור שהיה באיסור יותר כגון ששמע מאחר דבר זה אבל הוא אינו יודע כמה הוא שיעור ההיתר בעצמו אם היה כ״כ הרבה כמו שיעור ההיתר עכשיו או אם פחות מזה עד שעם האיסור שנפל שם נעשה כ״כ הרבה » (ט״ז יו״ד קי״א ס״ק ב׳) And the דרישה pictures it otherwise, in dry matter: two pieces, one large and one small, of which one at least knows that the small one is not the forbidden piece.

5. A piece fit to be served, in doubt — the kula of the Taz

↩ Detailed explanation (level 1)
The question: a piece fit to be served to guests is an important item, and it is not nullified even in a thousand — that is siman 101. Here too, in the doubt as to which pot it fell into, neither nullification nor תולין should help: an important item is before us!
The Taz’s answer (ס״ק ה׳, in the name of the ר״ן) — in doubt one is lenient: the Taz writes, on the words “until the permitted exceeds by sixty” of seif ד׳, that the matter speaks precisely of a piece fit to be served: the Sages did not apply its stringency in a doubt.
The yesod — importance against doubt:
The rule of an item that is not nullified — a piece fit to be served, a בריה, an item that is counted — operates in a certain mixture: since the important item is mixed in, it does not dissolve. But in our siman the doubt does not bear on the nullification; it bears on the fall itself. There the rule ספק דרבנן לקולא prevails, and even the important item is judged permitted.

6. Two permitted pots —

↩ Detailed explanation (level 1)

The text of the Mechaber (seif

Translation: there were two permitted pots, and before them two pieces, one permitted and one forbidden; one fell into this pot and one into that — both are forbidden, even in a rabbinic prohibition, if neither of them contains enough to nullify the prohibition; but if one of them contains enough to nullify the prohibition, both are permitted.

The yesod —
Here both pots are permitted, and a forbidden piece fell into one of them. One would like to attribute and declare one of them permitted; but that is impossible, for by permitting one you forbid the other out of what was permitted to it — and the Shach puts the question in the gemara’s own terms: « מאי חזית דאסרת להאי דלמא איפכא » (ש״ך יו״ד קי״א ס״ק י״א) Both are therefore forbidden: unlike seif א׳, there is here no side of prohibition to which the fall can be attached.
Even when one is smaller (ש״ך ס״ק י״א, against the או״ה): the או״ה held that one may attribute the fall to the small pot and thereby permit the large one. The Shach refuses: either way you forbid one of them out of what was permitted to it, and מאי חזית. « אין בידינו להתיר הגדולה ולומר דהאיסור לתוך הקטנה נפל » (ש״ך יו״ד קי״א ס״ק י״א) And when one of the two contains enough to nullify, the reason for the leniency is not a ממה נפשך but, once again, שאני אומר — the Shach says so at ס״ק י״ב: « שאני אומר האיסור נפל לתוך אותו שיש בה כדי לבטל » (ש״ך יו״ד קי״א ס״ק י״ב) He immediately draws the limit, and it holds for the whole siman: « והיינו דוקא באיסור דרבנן אבל בדאורייתא לא אמרינן שאני אומר דהספק דאורייתא לחומרא » (ש״ך יו״ד קי״א ס״ק י״ב)

7. Successive falls — known and unknown

↩ Detailed explanation (level 1)

The text of the Mechaber and the Rama (seif

Translation: there were two permitted pots, a prohibition fell into one of them and it is known into which, and then a prohibition again fell into one of them and it is unknown into which — I say: the second fell into the place of the first prohibition. But if a prohibition fell into one of them and it is unknown into which, and afterwards a prohibition fell into one of them and it is known into which — both are forbidden. Rama’s gloss: and this specifically where there is not sixty to nullify the prohibition that fell there; but if there was sixty to nullify it, it is as though no prohibition fell there at all (Beis Yosef in the name of the Rashba).

The two pictures:
The orderThe dinThe reason
Known, then unknown The second pot stays permitted; only the one already affected is forbidden I say: the second fell where the first fell (מחבר ס״ו)
Unknown, then known Both are forbidden The first had already cast doubt on both (ש״ך ס״ק ט״ו)
The reason for the distinction (ש״ך ס״ק ט״ו): when the second fall is uncertain but the first is known, one pot is already certainly forbidden, and the second fall is attached to it. When the order is reversed, the Shach refuses the symmetrical reasoning: « ואין אומרים למקום שנפל האיסור האחרון נפל גם הראשון » (ש״ך יו״ד קי״א ס״ק ט״ו)
How far does this leniency reach? (ש״ך ס״ק י״ד) The ב״ח wished to extend the seif even to a Torah prohibition. The Shach is astonished, for the gemara in the first chapter of פסחים is explicit: one does not say שאני אומר in a Torah prohibition. « ואני תמה היאך אפשר לומר בדאורייתא » (ש״ך יו״ד קי״א ס״ק י״ד) He ends by explaining what the seif really teaches — a Torah prohibition whose threshold alone is rabbinic — and concludes: « אבל באיסור דאורייתא ממש ודאי אין תולין להקל » (ש״ך יו״ד קי״א ס״ק י״ד)

8. Everything enters the doubt — the joining of the pots

↩ Detailed explanation (level 1)

The text of the Mechaber and the Rama (seif

Translation: there were two permitted pots, a prohibition fell into one of them and it is unknown into which, neither of them contains enough to nullify the prohibition but the two together do — both join to nullify it. And more: even one in the house and one in the upper storey, they join; and the same holds up to a hundred. In what case? When both belong to one man, for whatever belongs to one man is destined to become mixed; but if they belong to two men, they do not join. Rama’s gloss: there are those who are stringent and hold that even with one man one should not be lenient; and where there is loss there is room to permit with one man, but he shall not eat it until he has mixed them together, for then the prohibition is already nullified (in the name of the Maharish, in Issur ve-Hetter HaArokh, rule 26).

The yesod — whatever has entered the doubt:
Since I do not know into which pot the prohibition fell, both pots are taken together into the doubt of the prohibition. And the Shach states the rule in a line: « שכל שנכנס בספק מחמת איסור מצטרף לבטלו » (ש״ך יו״ד קי״א ס״ק ט״ז) They therefore join one another to nullify the prohibition in sixty, although neither can do so alone — and up to a hundred, and even one in the house and one in the upper storey, as the seif says.
The condition “one man” — destined to become mixed: the whole joining depends on the pots being destined to become mixed: since all belongs to one man, they will in the end come to be mixed, and we judge them now as though they already were. The Taz says so in so many words: « דכיון שעתידים להתערב חשבינן כאלו כבר נתערבו » (ט״ז יו״ד קי״א ס״ק י׳) With two men, by contrast, they are not destined to become mixed, each keeping his own — and that is the knot of the machlokes of the Rishonim treated in the next section.
The Rama’s ruling — יש מחמירין and the case of loss (ט״ז ס״ק ט׳): the Rama brings those who are stringent and do not permit even with one man; where there is loss one permits with one man, but he shall not eat until he has mixed the pots. The Taz gives its provenance: « בד״מ כ״כ בשם או״ה סוף כלל כ״ו בשם מהרי״ש » (ט״ז יו״ד קי״א ס״ק ט׳)

9. Machlokes of the רמב״ן and the רשב״א — two people and the joining

↩ Detailed explanation (level 1)

This is one of the tightest machlokos in the whole law of mixtures, and the Shach returns to it from ס״ק י״ג to ס״ק כ׳.

The root of the machlokes:
ShitaTwo people coming one after the otherSource
One permits each of them and attributes that the prohibition fell into the other’s pot, even if neither contains enough to nullify
Even with two men there is no leniency except through nullification; without it, to forbid one of them out of what was permitted to him is a

The Shach first sets out the position of the רמב״ן —

« דס״ל דבשל ב׳ בני אדם ובאו לישאל בזה אחר זה אפילו אין בשום אחד מהן לבטל אנו מתירין לכל א׳ וא׳ ותולין דבשל חבירו נפל » (ש״ך יו״ד קי״א ס״ק י״ג)

— and he rules, in that same ס״ק, referring forward to ס״ק י״ט:

« העיקר כהרמב״ן » (ש״ך יו״ד קי״א ס״ק י״ג)

At ס״ק י״ט he gives the proof: so it emerges from the first chapter of פסחים (the case of the two paths, where one is lenient when each asks separately) and from the end of the chapter האשה שנתארמלה in כתובות.

« דאפילו בשניהם של היתר תולין להקל באיסור דרבנן כשבאו זא״ז » (ש״ך יו״ד קי״א ס״ק י״ט)
The gemara of the two paths (פסחים י׳ ע״א): this is the mishna the gemara compares with the heap of chametz and the two searched houses: « שְׁנֵי שְׁבִילִין. דִּתְנַן: שְׁנֵי שְׁבִילִין, אֶחָד טָמֵא וְאֶחָד טָהוֹר, וְהָלַךְ בְּאֶחָד מֵהֶן וְעָשָׂה טְהָרוֹת » (פסחים י׳ ע״א) And there lies the distinction between one who asks separately and those who ask together: « אִם נִשְׁאֲלוּ זֶה בִּפְנֵי עַצְמוֹ וְזֶה בִּפְנֵי עַצְמוֹ — טְהוֹרִין.
The chakira — חתיכה נעשית נבילה against the joining (ש״ך ס״ק י״ז): the ב״ח objects: for us, who hold חתיכה נעשית נבילה in all prohibitions, the affected piece itself becomes forbidden, and the joining can no longer help. « כתב הב״ח דהיינו דוקא למ״ד דלא אמרינן חנ״נ רק בבשר וחלב ולא בשאר איסורים אבל לדידן דקי״ל חנ״נ בכל האיסורים אין מועיל צירוף » (ש״ך יו״ד קי״א ס״ק י״ז)
The Shach’s answer — “as though it were already mixed” (ס״ק י״ז): since it is unknown where the prohibition fell, no determinate piece has become neveilah; everything being equally in doubt and destined to be mixed, one views the whole as already mixed — and the Shach brings a proof for this from the מגיד משנה.
The rejection of the “one fall / two falls” distinction (ט״ז ס״ק ו׳): the פרישה, in the name of the מהרש״ל, and the ב״ח wished to distinguish between seif ה׳, where there are two falls, and seif ז׳, where there is only one: « ובפרישה כתב בשם רש״ל דהכא שאני שיש ב׳ נפילות אחד היתר ואחד איסור וזה גרע טפי מהא דלקמן שאין שם אלא נפילה אחת » (ט״ז יו״ד קי״א ס״ק ו׳) The Taz sets this distinction aside on the strength of the תוספתא of the two mortars, which the רשב״א himself raises against the case of two falls — proof that in his eyes the two pictures do not differ: « היו לפניו שתי מדוכות אחת של חולין ואחת של תרומה ונתן מאחת מהן ואין ידוע מאיזה מהן נתן הריני אומר משל חולין נתן » (ט״ז יו״ד קי״א ס״ק ו׳) His conclusion is plain: « אלא ודאי שאין חילוק זה כלל ועיקר לפי האמת » (ט״ז יו״ד קי״א ס״ק ו׳)
“Destined to become mixed” — two kinds (ט״ז ס״ק ח׳): the Taz limits the joining: when the two permitted foods are forbidden with one another — one of meat, the other of cheese — they do not join. « דאם הב׳ מיני היתר אסורים בתערובות כגון הא׳ בשר והב׳ גבינה אין מצטרפין לבטלו » (ט״ז יו״ד קי״א ס״ק ח׳) And he adds, in the name of the מהרש״ל, that the same holds of two foods that are simply not destined to be mixed: « וכתב רש״ל דאם הם אינם עומדים להתערב כגון שהא׳ נתבשל במתיקות והב׳ בקיוהא אינם מצטרפים » (ט״ז יו״ד קי״א ס״ק ח׳)

And for practice — ask your Rav.

The objection of the רא״ה — joining only where there is no taste (ש״ך ס״ק כ׳): the Shach brings the רא״ה in Bedek HaBayis: these leniencies were said only in a rabbinic prohibition, or in a Torah prohibition whose measure is rabbinic, or in dry with dry, where there is no taste. « לא נאמרו קולות הללו אלא באיסורי דרבנן או באיסור תורה ושיעורי דרבנן וכן יבש ביבש דלית בה טעמא » (ש״ך יו״ד קי״א ס״ק כ׳) But where the prohibition gives taste, or is apt to give taste, the pots do not join — and that even in a rabbinic prohibition: « אבל היכא דאית בה טעמא ודאי כל היכא דיהיב טעמא או שראוי ליתן טעם כגון לח בלח במין במינו ואין ס׳ לא אמרינן ביה הני קולי אפילו באיסורי דרבנן » (ש״ך יו״ד קי״א ס״ק כ׳) That is why the Shach, commenting on the Rama’s words “and where there is loss”, concludes that one should permit only where the loss is great, precisely because the רא״ה disputes the matter: « וכן נראה בדין דאין להתיר אלא במקו׳ הפ״מ דהא הרא״ה בבדק הבית…
The פתחי תשובה — the שמן רוקח and the three pots (פ״ת ס״ק ב׳): the פתחי תשובה brings from the שמן רוקח that one attributes even to a pot that is forbidden only by doubt, and gives the picture: « שהיו עומדים ג׳ קדרות של היתר ונפל איסור דרבנן לאחד מב׳ קדרות מהם ובקדרה שלישית עדיין לא היה שום ספק ואח״ז נפל איסור דרבנן לאחד מהקדרות ונולד לנו ספק בקדרה שלישית ועל אחד מהראשונות » (פתחי תשובה יו״ד קי״א ס״ק ב׳) But if the first doubt became known only after the second, the matter requires deliberation, and he is lenient only where the loss is great: « אך אם לא נודע הספק הראשון עד אחר שנולד השני יש להתיישב בדבר ובהפ״מ יש להקל » (פתחי תשובה יו״ד קי״א ס״ק ב׳)
The פתחי תשובה — the שער המלך on the chazaka (פ״ת ס״ק א׳): on the words “the pieces” of seif א׳, the פתחי תשובה brings the שער המלך, who parts from the פרי חדש on two points and from the Shach on one. Against the פרי חדש, who held that even recognisable pieces constitute an איתחזק איסורא, he sides with the Shach: « דמה שכתב הפר״ח דאף בשהחתיכות ניכרות בפ״ע מיקרי איתחזק איסורא בזה נראה עיקר כהש״ך » (פתחי תשובה יו״ד קי״א ס״ק א׳) But he is more lenient than the Shach: even where the pieces are not recognisable and there is therefore איתחזק איסורא, he attributes leniently, because the pot itself retains a chazaka of permission. « דאפילו בשאין החתיכות ניכרות דאיתחזק איסורא תלינן לקולא » (פתחי תשובה יו״ד קי״א ס״ק א׳)

10. Chakira and nafka mina for practice

↩ Detailed explanation (level 1)
The overall chakira of the siman: when does one attribute leniently, and when do the pots join to nullify?
Nafka minos for practice, as the Mechaber and his apparatus set them out:
  1. A rabbinic prohibition that fell into one of two pots, one permitted and one forbidden, without knowing which: one attributes leniently (Mechaber seif
  2. That the forbidden does not predominate is a condition; and in a Torah prohibition a majority of permitted is required to nullify it by Torah law (seifim
  4. Two permitted pots — מאי חזית, both forbidden, unless one of them contains sixty (seif ה׳).
  5. The joining — two pots, even one in the house and one in the upper storey, join for the sixty with one man; and according to those who are stringent, he first mixes them (seif
And for practice — ask your Rav.

Table — the pictures of doubt and their din

The picture of doubt The outcome Source
Two pots (permitted and forbidden) + two pieces, rabbinic prohibition Permitted — one attributes the forbidden to the forbidden
One permitted pot + two pieces Permitted — one attributes that the permitted one fell
The forbidden predominates over the permitted One does not attribute leniently
One attributes as soon as there is any majority
A piece fit to be served, in doubt One is lenient —
Two permitted pots מאי חזית → both forbidden מחבר ס״ה · ש״ך ס״ק י״א
Successive falls (known then unknown) The second stays permitted — the second fell where the first fell
Everything has entered the doubt (one man) They join for the sixty, even up to a hundred

Table — the central machlokos of the siman

SubjectFirst shitaSecond shita
Two pots as against one pot רשב״א in Toras HaBayis — in two pots one needs at least חד בחד (ש״ך ס״ק ו׳) רא״ה in Bedek HaBayis — permitted even if the forbidden predominates (ש״ך ס״ק ו׳)
A rabbinic measure and שאני אומר ט״ז — lighter than the Torah doubt of siman 66 (ס״ק א׳) נמוקי יוסף — in prohibitions that forbid in the least amount one does not attribute (ש״ך ס״ק ג׳)
Two people coming one after the other רמב״ן — one attributes and permits each; and that is the essence of the halakha (ש״ך ס״ק י״ג, י״ט) רשב״א — without nullification there is no leniency (ש״ך ס״ק י״ג, י״ט)
חתיכה נעשית נבילה as against the joining ב״ח — since we hold חנ״נ everywhere, joining no longer helps (ש״ך ס״ק י״ז) ש״ך and ט״ז — one views the whole as already mixed, and חנ״נ does not prevent it (ש״ך ס״ק י״ז; ט״ז ס״ק י׳)
The joining with one man מחבר — they join, even one in the house and one in the upper storey (ס״ז) רמ״א — יש מחמירין; and where there is loss he first mixes them (ס״ז, ט״ז ס״ק ט׳)
The joining where there is taste מחבר / רשב״א — they join רא״ה — not where the prohibition gives or may give taste (ש״ך ס״ק כ׳)
Pieces that are not recognisable ש״ך — there is איתחזק איסורא and one is not lenient (ס״ק ד׳) שער המלך — one attributes nonetheless, since the pot has a chazaka of permission (פ״ת ס״ק א׳)

Table — the sources of the sugya

Gemara: יבמות פ״ב ע״א — the two baskets of chullin and terumah, the source of שאני אומר · פסחים י׳ ע״א — the two paths and the heap of chametz, the source of the leniency where each asks separately · and the Shach further refers to כתובות כ״ו (ס״ק י״ט).
