This siman is the second half of a single halakha. Siman 103 deals with נותן טעם לפגם in food — a prohibited item that fell into permitted food and spoiled its taste. Siman 122 deals with the same heter in vessels — prohibited matter absorbed into the wall of a pot that spoiled by itself, through the mere passage of time. That is the whole difference: a pgam that comes from a mixture, and a pgam that comes from waiting.
The source: the beraita in the last chapter of Avoda Zara. The whole sugya begins from a machloket of Tannaim:
« אחד נותן טעם לפגם ואחד נותן טעם לשבח אסור דברי רבי מאיר רבי שמעון אומר לשבח אסור ולפגם מותר » (עבודה זרה ס״ז ע״ב)
Two sources, two lines of reasoning. R. Meir learns from גיעולי עובדי כוכבים: the Torah did forbid an absorption that is itself spoiled, so a pgam permits nothing:
« מאי טעמא דרבי מאיר גמר מגיעולי גוים גיעולי גוים לאו נותן טעם לפגם הוא ואסר רחמנא » (עבודה זרה ס״ז ע״ב)
R. Shimon cuts the derivation at its root: גיעולי עובדי כוכבים prove nothing, for the Torah forbade only a pot used that same day —
« לא אסרה תורה אלא קדירה בת יומא דלא לפגם הוא » (עבודה זרה ס״ז ע״ב)
And R. Meir answers that even a same-day pot is slightly spoiled, and it was nonetheless forbidden:
« קדירה בת יומא נמי אי אפשר דלא פגמה פורתא » (עבודה זרה ס״ז ע״ב)
The yesod — the whole siman hangs on one question.
Tosafot show that there are not two debates here but one: whether a pgam permits, and what a בת יומא is, are the same question seen from two sides:
« והא בהא תליא מ״ד נותן טעם לפגם אסור סבר דקדירה בת יומא פגמה פורתא ומאן דשרי פגם סבר דלא פגמה כלל » (תוספות עבודה זרה ס״ז ע״ב ד״ה ואידך קדירה בת יומא)
That is why the Mechaber opens with the rule (seif 1) and moves at once to the measure of time (seif 2): the rule without the measure says nothing.
The Gemara's ruling, at the end of the sugya:

The chakira. What exactly is the heter of נותן טעם לפגם? Two branches. (א) A היתר שבטעם: the prohibited matter remains intact and keeps its name, only that a spoiled taste is not a taste and does not forbid the mixture. (ב) A הפקעת השם: once spoiled, the name נבילה has left it, and there is no prohibition at all. The second branch rests on R. Shimon's own derasha, that only what is still fit to eat is called נבילה. The difference is not verbal: it decides the status of the pot itself, and the fate of an amount so small that it can never impart taste.

A second chakira, which governs seifim 3 and 4: «אינה בת יומא» does not describe the pot but the bli'a inside it. Is the waiting a סיבה — time is what spoils — or a סימן — time shows that it is already spoiled? The nafka mina follows at once: the sharp food that restores the taste to שבח (seif 3), and meat-and-milk, where heating water within twenty-four hours restarts the count (seif 4). If time is a cause, it is hard to see how a spoiled taste becomes good again; if time is only a sign, the sign can be contradicted by the facts.
The condition the Rambam sets in the general rule of pgam:
« אבל אם פגם זה האסור למתר והפסיד טעמו הרי זה מתר. והוא שיהיה פוגם מתחלה ועד סוף » (רמב״ם הלכות מאכלות אסורות פרק ט״ו הלכה כ״ח)
It comes from the conclusion of the sugya, which restricts the Tannaitic machloket to a case where the pgam is present from the start:
« אלא לאו שמע מינה בפגם מעיקרא מחלוקת שמע מינה » (עבודה זרה ס״ח ע״ב)
Nafka mina — פגם מעיקרו applied to vessels. For food the Mechaber ruled like the Rambam: « במה דברים אמורים שפוגם מתחילתו ועד סופו אבל אם השביח ולבסוף פוגם או פוגם ולבסוף השביח אסור » (שו״ע יו״ד ק״ג:ב). For vessels, a pot that is not בת יומא is a perfect פוגם מעיקרו: at the very moment it imparts its taste it is already spoiled. The underlying lesson: the pgam is not measured at the moment of eating but at the moment the taste is given. For practice — ask your Rav.

The Gemara says «בת יומא», “of that day”, and not “within twenty-four hours”. From that nuance of language grew one of the great machlokot of the siman — and on it depends the measure of time we still keep today.
Rashi and Rabbenu Tam: one night is enough.

The difficulty: the argument proves too much. Rabbenu Tam supports his view from the עיבור צורה of kodashim — a night takes food out of its form. Tosafot object: with nothar it is precisely the end of the night, עמוד השחר, that is decisive; one would then have to say that a pot used just before nightfall becomes פגומה at dawn. To avoid that consequence they require the pot to have stood the whole night without cooking — while still not requiring a full מעת לעת.
The Rosh's position: the heter, with a reservation. The Rosh works through the sugya at length, rules like his teachers that a night suffices, but adds an explicit reservation which is exactly what survived in halakha: since we do not know what precisely causes the spoiling — the beginning of the night, its end, or the whole of it — one who requires a full מעת לעת is not being needlessly strict but properly cautious. The Acharonim took hold of that reservation, and the Mechaber fixed it as the halakha.

Nafka mina. A pot in which prohibited food was cooked in the late afternoon and which then stood all night: for Rashi and Rabbenu Tam it is no longer בת יומא by morning; for the Mechaber it remains so until the same hour the next day. Since the entire debate concerns a rabbinic law (by Torah law נותן טעם לפגם is permitted), there is room for leniency in a pressing case — but the plain halakha follows the Mechaber. 4. גזירה אטו בת יומא — food permitted, pot forbidden
The source of the decree:
« מכאן ואילך לישתרי גזירה קדירה שאינה בת יומא משום קדירה בת יומא » (עבודה זרה ע״ו ע״א)
The kushya. If a decree was made, the food cooked in the pot should be forbidden too; if not, the pot itself should be permitted. How did the Sages separate the vessel from its contents, when the source of the prohibition is one and the same?
Tosafot's answer — and this is the whole yesod:
« ויש לתת טעם מה ראו להתיר המאכל ולאסור הקדרה לפי שהקדרה היה בה איסור גמור תחלה אבל המאכל לא נבלע בו איסור מעולם » (תוספות עבודה זרה ע״ו ע״א ד״ה מכאן ואילך לשתרי)
The yesod — two degrees of proximity to the prohibition.
The pot is a כלי שהיה בו איסור גמור: a decree upon it makes sense, since no one knows exactly when the twenty-four hours elapsed. The food is היתר שלא נגע בו איסור מעולם: one does not decree upon pure permitted food because of a spoiled vessel. This is a constant rule throughout the siman: the decree fastens on the object that carried the prohibition, never on what comes after it. From it flow the two practical formulas of the siman — “forbidden לכתחלה, permitted בדיעבד” (seif 6), and “if he transgressed and used them, it is permitted”.
The Rambam says the same thing in terms of Torah law and rabbinic law:
« ולא אסרה תורה אלא קדרה בת יומה בלבד הואיל ועדין לא נפגם השמן שנבלע בקדרה. ומדברי סופרים לא יבשל בה לעולם » (רמב״ם הלכות מאכלות אסורות פרק י״ז הלכה ב)
And he concludes: « ואם לקח ובשל בהן מיום שני והלאה התבשיל מתר » (רמב״ם הלכות מאכלות אסורות פרק י״ז הלכה ב) — food permitted, vessel forbidden, exactly as Tosafot have it.
Three nafka minot from this gader:
Hagala without sixty when the vessel is not בן יומו, since what it releases is itself spoiled.
The spoon: a vessel that is not בן יומו dipped into a dish בדיעבד — the dish stays permitted, and the spoon needs a hekhsher.
Pesach pots, subject of a dispute between Rav and Shmuel: « אמר רב קדירות בפסח ישברו ואמאי לשהינהו אחר הפסח וליעבד בהו שלא במינן » (פסחים ל׳ ע״א) — and the halakha follows Shmuel, who does not break them: proof that a vessel becomes permitted again through waiting.

5. איסור בעין — prohibited matter stuck to the wall
The chakira. Is the status of “not בן יומו” a rule about the בליעה — only what is absorbed into the wall spoils with time — or about the שמנונית itself, so that any prohibited grease, whether absorbed or merely stuck to the surface, spoils from one day to the next? The question arises from the reading of a single beraita at the end of Avoda Zara, and the greatest Rishonim divided over it.

The Raavad's proof, and why it decides the matter. The Raavad relies on the sugya of the radish cut with a knife: there the entire prohibition is nothing but congealed grease on the surface of the blade, and it nonetheless forbids — so what lies on the surface does not spoil. The Beit Yosef reports that the Rashba was troubled by the sugya of the קורט של חלתית: there too ordinary knives are involved, with grease congealed on their surface, and yet the Gemara implies that נותן טעם לפגם would have sufficed to permit were it not for the sharpness of the chiltit. His teacher Rabbenu Yona answered him that this chiltit was sold in a shop, and a shopkeeper wipes his utensils — so there was no surface grease there at all.
The Mechaber's ruling and the Rama's way out. The Mechaber brings the position of the Raavad and the Rashba as a יש אומרים which is the halakha: as long as the vessel was not properly rinsed, waiting achieves nothing. The Rama adds an escape: if there is sixty against the stuck grease alone, everything is permitted, since what is inside the wall is already spoiled and needs no annulment. The two gedarim thus live side by side: what is absorbed is treated as spoiled, what is stuck as an intact prohibition requiring sixty.
Two directions, not one. Sharpness acts upon a spoiled taste — but one must distinguish sharpness present at the moment of pelita from sharpness present at the moment of bli'a. The Rama writes both in one breath and separates them expressly: if one now cooks a sharp dish in a prohibited pot that is not בת יומא, the sharpness restores the taste to שבח and the dish is forbidden; but if the prohibited food itself was sharp and the pot then waited twenty-four hours, yesterday's sharpness achieves nothing.
The chakira behind the distinction. Is sharpness a כוח מוציא — it draws out of the wall a taste that lay dormant there — or a כוח משביח — it repairs the spoiled taste itself? If it draws out, it should work even when it came first; if it improves, it makes sense that yesterday's sharpness does nothing to what spoils today. The Rama's wording decides: « דאין החריפות הראשון משוי ליה לשבח » — sharpness is what confers the name שבח, and it acts only in its own time.
The Shach spells out the cases and reduces them to one rule — one counts the twenty-four hours from the cooking that left a taste of שבח, not from the sharp food:
« וה״ה אם בישל דבר חריף בקדירה של איסור שאינו ב״י ואח״כ שהה מע״ל משנתבשל בו הדבר חריף מותר » (ש״ך יו״ד קכ״ב ס״ק ב)
and conversely:

Nafka mina. A prohibited pot that is not בת יומא in which one cooks a soup made mostly of vinegar: forbidden. The same pot with an ordinary dish containing a little spice: permitted — « אבל לא מחשב התבשיל חריף משום מעט תבלין שבו ». Everything turns on the proportion, not on the presence of the spice. 7. בשר בחלב — חתיכה נעשית נבילה and the restarted count
The kushya. Water heated in a meat-and-milk pot is pure permitted matter, and at most absorbed a spoiled taste. How does this water itself become a “prohibition” that opens a fresh count of twenty-four hours? And why does this rule apply only to meat-and-milk and not to other prohibitions?
The Taz's answer: there are two rules here, not one.
« הטעם דבבשר בחלב אמרינן חתיכה עצמה נעשית נבילה ע״כ הוין אלו המים נבילה כולן מכח בליעת איסור בשר בחלב שיש בקדירה כבר ונתנה טעם במים » (ט״ז יו״ד קכ״ב ס״ק ב)
And he immediately concludes: « אבל בשאר איסורי׳ לא אמרינן חתיכה עצמה נעשית נבילה כמ״ש סימן ק״ג » (ט״ז יו״ד קכ״ב ס״ק ב)
The yesod — a pgam does not block חתיכה נעשית נבילה.
The rule of חתיכה נעשית נבילה does not depend on whether the taste improves, but on the specific action of meat meeting milk, which generates a new prohibition. That is why water with a spoiled taste itself becomes «נבילה» and restarts the count. Hence a fine distinction: the pgam strips the prohibition of its power to forbid, and does not strip meat-and-milk of its power to create a new prohibition. This is the root of the Rama's gloss in siman 103, which extends the principle to other prohibitions according to what we hold in that matter.
Nafka mina. A meat-and-milk pot that is בת יומא in which water was heated in the evening: the next morning it is still בת יומא, because the count begins from the heating of the water. In a pot of נבילה the same heating changes nothing, and the count continues from the cooking of the prohibited food itself. The Rama adds there that if a night passed between the cooking of the meat and that of the milk, this rule no longer applies. For practice — ask your Rav.

The wine absorbed in the jar is minute; and since one only puts permitted liquid in abundance into it, it can never come to impart taste — hence permitted even לכתחלה.
The Tur's קל וחומר, and it bites:
« ואינו נראה להתיר מק״ו דאפי׳ קדרה שאינה בת יומא שהיא מותרת אסורה משום גזירה אטו בת יומא כ״ש באותו כלי עצמו » (טור יורה דעה סימן קכ״ב)
In other words: if a decree was made about a pot that is itself permitted, all the more should one decree about a vessel where the prohibition is genuinely present and only quantity prevents it from acting.
The Beit Yosef's answer: two decrees that are not alike.
« אין כאן קושיא כלל דלא דמי להדדי דע״כ לא שרי הרשב״א אלא לפי שאינו מצוי להשתמש באותו כלי בדבר מועט וכל דבר שאינו מצוי אין חוששין לו » (בית יוסף יורה דעה סימן קכ״ב)
And he adds: « ומה ענין זה לקדרה בת יומא ושאינה בת יומא שאדם עשוי לבשל בזו ובזו » (בית יוסף יורה דעה סימן קכ״ב)
The chakira: what is אין מבטלין איסור לכתחלה? If it is an intrinsic prohibition attached to the act of annulling, the difficulty is real: here there is no annulment at all, since the prohibited matter will never impart taste. If it is a גזירה שמא ירבה, the Rashba's distinction is understandable: in a large vessel there is no reason to fear that it will be used for a small quantity. The Mechaber himself leans to the first branch in closing the seif: « שאין מבטלין איסור לכתחלה אפילו איסור מועט ואפילו איסור הבלוע » — there is therefore an act of annulment even for absorbed matter invisible to the eye.

The chakira — the root of everything that follows in the siman. «סתם כלי עובד כוכבים הם בחזקת שאינם בני יומן»: is this a factual chazaka — most vessels in the world are not used every day, which would make it a certainty rather than a doubt; or a ספק ספיקא — not a statement of fact but a way of resolving two doubts? Everything that follows — the prohibition לכתחלה, the knife, the non-Jew's word, the deposited vessel — is only a consequence of this alternative.
The second branch, in the Tur's language in the name of the Rosh:

The decisive proof is seif 7. Were this a factual chazaka peculiar to non-Jews' vessels, our own could not be assimilated to it. Yet the Tur immediately continues: « ולפי זה ה״ה נמי כלים שלנו שהוא ספק ספיקא תלינן להקל » (טור יורה דעה סימן קכ״ב) — the reason therefore lies in the resolution of doubts, not in a factual finding. That is what the Mechaber records in seif 7.

First nafka mina — why it is forbidden לכתחלה. If the chazaka is a ספק ספיקא, it goes without saying that one does not use the vessel at the outset. This is the Shach's own wording:
« ומה״ט אסור לבשל לכתחלה בכלים של עובדי כוכבים דליכא אלא חדא ספיקא דקדרה שאינה ב״י אסור לכתחלה » (ש״ך יו״ד קכ״ב ס״ק ד) For practice — ask your Rav.
10. הסכין והנאמנות — the sugya in Chullin and the Acharonim
The great objection to the chazaka. If their ordinary vessels are not בני יומן, why was a non-Jew's knife forbidden? For an explicit sugya says:
« השוחט בסכין של גוים רב אמר קולף ורבה בר בר חנה אמר מדיח » (חולין ח׳ ע״ב)
Three answers among the Rishonim, as the Beit Yosef records them:
A first answer — « שכיון שהסכין תשמישו תדיר חיישינן לבן יומו » (בית יוסף יורה דעה סימן קכ״ב). The chazaka is built on infrequent use; where use is constant it has no purchase.
The Ramban rejects this and concludes that even for a knife the ordinary case is not בן יומו, and that the sugya in Chullin speaks of a knife known to be so.
The Rosh — « התם מיירי בידוע שהוא בן יומו אי נמי בשוחט לכתחלה ע״מ להדיח או לקלוף דדוקא בדיעבד התירו נותן טעם לפגם » (בית יוסף יורה דעה סימן קכ״ב).
The difference between the two answers is finer than it looks. The answer «תשמישו תדיר» eats into the chazaka itself: there would be vessels that do not enjoy it. The Rosh's answer leaves it intact and shifts the sugya in Chullin to לכתחלה alone. A considerable nafka mina follows: on the first answer, a knife already used בדיעבד remains forbidden; on the Rosh's, it is permitted, since בדיעבד they did permit נותן טעם לפגם.

The Taz's argument: one chazaka against another. He answers the Maharshal with a question of principle — why follow the chazaka of the vessel rather than that of the dish? In his words:
« מאי חזית דאזלינן בתר חזקת הכלי זיל בתר חזקת התבשיל שמבשל בתוכה שיש לו חזקת כשרות » (ט״ז יו״ד קכ״ב ס״ק ד)
He compares it to the sugya of the nicked slaughtering knife, where it was ruled «סכין איתרעי בהמה לא איתרעי»: here the dish suffers no ריעותא at all, so its chazaka stands.
And yet the Taz limits himself:
« אכן נראה לי דאם העובד כוכבים אומר כן לפי תומו מעצמו בלי שום שאלה ונראין הדברים שלא נתכוין על ישראל אז יש להחמיר ולאסור התבשיל » (ט״ז יו״ד קכ״ב ס״ק ד)
The machloket is therefore not about credibility as such, but about when his statement becomes a ריעותא that cancels the second doubt.
The chakira. Does the prohibition to cook in a pot that is not בת יומא attach to the cheftsa — to the dish itself, in which case what another person does is not included — or to the gavra, so that a man may not bring such a cooking about, and one who orders it transgresses too? The Rashba ruled for the second branch, and learned it from a sugya in Chullin.
The source of the proof: the dough given to the neighbour.
« ואם אמר לה עשי לי משליכי חושש לשאור ותבלין שבה משום שביעית ומשום מעשר » (חולין ו׳ ע״א)
and the Gemara explains it:
« שאני התם דכיון דקאמר לה עשי לי משליכי כמאן דעריב בידים דמי » (חולין ו׳ ע״א)
The Rashba's קל וחומר. There the case is a mixture of demai, something entirely permitted, and nonetheless once he said “make it for me from what is yours” it is as though he had mixed it with his own hand. All the more so here, where the pelita of a vessel that is not בן יומו is forbidden לכתחלה: one who tells a non-Jew “cook for me” is like one who annuls a prohibition לכתחלה. That is what the Mechaber writes: « שכל האומר בשל לי הרי הוא כאלו בישל בידיו ».
Two reservations the Mechaber himself records:
Craftsmen — « ואפשר שעל ידי הרקחים (או שאר אומנים) מותר שכל האומנים מיחדים כלים נקיים למלאכתם כדי שלא יפגמו אומנותם » (שו״ע יו״ד קכ״ב:ו). This heter rests on a state of affairs, not on a principle — so it changes with place and time.
The בעל נפש — « ובעל נפש יחוש שדברים אלו מביאים לידי טהרה ונקיות » (שו״ע יו״ד קכ״ב:ו). The phrase is not a mere stringency: it concedes that the heter stands in law, and teaches that it costs something in the sanctity of the meal.

The gader of לכתחלה and בדיעבד in the Rama's gloss. The Rama fixes the two extremes here. Water heated by the non-Jew in order to knead with it: the benefit has not yet begun, so it is מקרי לכתחלה and forbidden. But something already made by the non-Jew for his own purposes which a Jew then buys from him: that is מקרי דיעבד and permitted. The Shach infers that water heated to be drunk may be drunk, « דלענין זה מקרי דיעבד ומותר כמו שאר דברים הנקחין מן העובדי כוכבים » (ש״ך יו״ד קכ״ב ס״ק ה).
The kushya. A forbidden vessel mixed among others can always be made permitted by hagala. It is therefore a דבר שיש לו מתירין, and such a thing is not annulled even in a thousand! Why then did the Rashba rule that it is annulled in a majority?
The general rule in the sugya:
« כל איסורין שבתורה בין במינן בין שלא במינן בנותן טעם חוץ מטבל ויין נסך » (עבודה זרה ע״ג ע״ב)
The Gemara there asks why tevel forbids במשהו, and answers that it is because «כהיתירו כך איסורו» — and not because it has מתירין. From there the whole discussion begins.

The yesod — “מתירין that come of themselves”.
The Rashba's language as the Tur records it defines the rule precisely: « שכל שאין מתירין שלו באין מאיליהן וצריך לפזר מעותיו ולהוציא הוצאות במתירין אינו בכלל שיש לו מתירין » (טור יורה דעה סימן קכ״ב). The criterion is thus not the possibility of the heter but its ease: the heter must come by itself, with the passing of time, and not through labour and money.
Nafka mina between the two definitions. For Rabbenu Tam the criterion is monetary loss: any expense at all disqualifies a דבר שיש לו מתירין. For the Ramban it is substantial loss taken from the permitted side itself — having to treat all the vessels in order to permit one. Hence: a metal vessel whose hagala is easy and cheap comes close to a דבר שיש לו מתירין for the Ramban, and does not for Rabbenu Tam. The Shach notes that the seif is a duplicate: « כפול לעיל סי׳ ק״ב ס״ג ושם נתבאר ע״ש » (ש״ך יו״ד קכ״ב ס״ק ז). For practice — ask your Rav.
יש ליזהר מלהניח בבית עובד כוכבים כלי סעודה דחיישינן שמא ישתמש בהם:

13. כלי ישראל ביד עובד כוכבים — the Taz against the Shach
The great kushya of this seif. If a ספק ספיקא suffices to permit the non-Jew's own vessel, how was Rabbenu Tam more stringent about a Jew's knives taken to the craftsman than about the non-Jew's own vessels? A ספק ספיקא is effective everywhere in the Torah!
The root of the ruling in the Mordechai, as the Taz copies it:
« ולפי זה כשמוליכין הסכינים להשחיזן בבית האומן ומחזירן בו ביום ליכא האי טעמא דספק ספיקא משום דבו ביום החזירן » (ט״ז יו״ד קכ״ב ס״ק ח)
hence: « וכן אור״ת דצריך שילך הישראל להשחיזה והיה מחמיר בהן יותר מכלי עובד כוכבים עצמם » (ט״ז יו״ד קכ״ב ס״ק ח)
The Taz's chidush: deliberately, or by forgetting.
« ונראה לע״ד דכל ס״ס דמותר בדיעבד היינו אחר שנעשה ס״ס אבל ישראל זה שמניח במזיד סכין שלו בבית עובד כוכבים וסומך על מה שיהיה ס״ס בזה ראוי להחמיר » (ט״ז יו״ד קכ״ב ס״ק ח)
There is thus no weakness in the power of a ספק ספיקא, but a penalty on one who deliberately placed himself in doubt. In this way the Taz resolves the internal contradiction in the Mordechai between Rabbenu Tam and the responsum of R. Shimshon of Bonburg: the former speaks of one who leaves the vessel there on purpose, the latter of one who forgot.

The Shach's reasoning: two kinds of vessels, not two kinds of doubt. The Shach distinguishes: wine vessels know no category of בן יומו and שאינו בן יומו at all, so Rabbenu Tam's stringency there is necessary and contradicts nothing; but for a cauldron, whose whole prohibition lies in a bli'a that spoils, all agree with R. Shimshon of Bonburg. Here is the latter's language as he cites it: « ואימור לא נשתמש בה איסור ועוד דאפי׳ נשתמש בה הוה ליה פגומה שאינה ב״י » (ש״ך יו״ד קכ״ב ס״ק ח). The two pillars of horaa therefore differ not on the facts but on how to read the Mordechai.
A sharp nafka mina — the end of the Rama's gloss. The Rama writes « ובמקום צורך יש להקל בדיעבד », and the Taz opposes him explicitly:
« כבר נתבאר שלענין הלכה לא קיימא לן כן » (ט״ז יו״ד קכ״ב ס״ק ט)
The Shach, for his part, upholds the Rama and goes further: if the vessel remained twenty-four hours with the non-Jew, one may even use it לכתחלה. Since the Taz and the Shach differ even about the בדיעבד, one should be lenient only after consulting. For practice — ask your Rav.
“Half a day” or “a brief moment” — and the Taz's measure. The Rama wrote that half a day requires hagala, and that a brief while is no cause for concern. The Taz objects from siman 136, where even one hour requires a hekhsher, and answers that there is no machloket here but a measure relative to the nature of the vessel:
« אלא העיקר שכל דבר לפי עניינו במידי דדרכו להשתמש תדיר אפילו דרך עראי כגון כלי של יין שאדם עשוי לשתות בכל שעה » (ט״ז יו״ד קכ״ב ס״ק ז)
whereas for a cooking vessel or a table knife — « שאין דרך להשתמש בו אלא בשעת אכילה » (ט״ז יו״ד קכ״ב ס״ק ז) — a substantial period is needed, on the order of half a day.
סעיף י׳ — קערות ששלח ישראל לעובד כוכבים עם מאכל ושהו שם אם ניכר בהם המאכל ששלח הישראל בתוכם מותר ואם לאו אסור אם רגילים להדיח הכלים בחמין דחיישינן שמא הודח עם כלי איסור:

הגה ויש מחמירים ואומרים שאינו נאמן ואין ליקח כלים מן העובד כוכבים רק כשמוכר הרבה כלים וקונה כלי בין הכלים (רשב״א בשם ר׳ יונה) וכן נוהגין לכתחלה אבל במקום הדחק כגון שנתארח בבית עובד כוכבים ואין לו כלים נוהגין כסברא הראשונה וכן עיקר ועיין לקמן סימן קל״ז:
סעיף י״ב — יש מי שאומר שקערות הבאות מעבר לים שקערורות ירקרקות או אדמדמות אסור להשתמש בהן לעולם בחמין מפני שאינן חדשות שהעובדי כוכבים משתמשים בהם ואינו ניכר:
14. מסיח לפי תומו — the siman closes on its own chazaka
The yesod — the circle closes.
Why is a non-Jew believed when he says offhandedly that the vessels are new? Because only a rabbinic prohibition is at stake — and that is so precisely because of the chazaka laid down in seif 6. Here is the Shach's language:
« נ״ל דה״ט דכיון דסתם כלים של עובד כוכבים אינן ב״י א״כ ליכא אלא איסור דרבנן ועובד כוכבים מסל״ת נאמן באיסור דרבנן » (ש״ך יו״ד קכ״ב ס״ק י)
The chakira that opened the siman therefore decides its close: had it been merely a factual chazaka, there would be no heter of מסיח לפי תומו here at all.

Why “following the majority” works here. Rabbenu Yona's distinction is not about credibility but about the source of the knowledge. From a man who sells many vessels one buys on the strength of a rov, and his testimony is not needed at all; from a man with a single isolated vessel, one has nothing but his mouth. On this reading, the Mechaber permitted on the strength of מסיח לפי תומו because he holds that such testimony suffices for a rabbinic prohibition — exactly as the Shach explains.
Seif 12 — a chazaka with no end. Greenish or reddish bowls that come from overseas are forbidden for hot use forever. This is the one irreducible case in the siman, and its reason is clear: here the chazaka runs the other way — we know they are not new and nothing can be discerned in them. There is therefore no room either for a ספק ספיקא or for a wait of twenty-four hours, since no one knows when they were used. For practice — ask your Rav.
15. חקירה ונפקא מינה — eight practical consequences
The central chakira of the siman, in one sentence: Is נותן טעם לפגם a heter of circumstance — or a statement of fact? (א)היתר במקרה: the prohibition exists and keeps its name, but in this particular case it imparts no taste. It is then understandable that a decree was made about it, that one may not annul it לכתחלה, and that the pot remains forbidden. (ב)קביעת מציאות: there is no prohibition left at all, the name נבילה having departed. But then why the decree, and why forbid annulling it?
Eight practical nafka minot in the siman:
לכתחלה and בדיעבד — on branch (א) the decree against a pot that is not בת יומא is obvious; on (ב) it is difficult (seif 2).
The food and the pot — why the dish was permitted and the vessel forbidden (seif 2, and תוספות עבודה זרה ע״ו ע״א).
The measure of time — one night for Rashi and Rabbenu Tam, מעת לעת for the Mechaber (seif 2).
Prohibited matter on the surface — the absorbed spoils, the stuck does not (seif 3).
דברים חריפים — sharpness at the moment of pelita restores שבח, sharpness that preceded does not (seif 3).
Meat and milk — חתיכה נעשית נבילה restarts the count of twenty-four hours (seif 4).
A minute amount in a large vessel — permitted לכתחלה for the Mechaber, not adopted by the Taz and the Shach (seif 5).
A Jew's vessel left with a non-Jew — for the Taz forbidden even בדיעבד if returned the same day; for the Shach one may be lenient (seif 9).

Summary of the yesod.
The whole siman moves between two poles — the פגם, an immense leniency that permits what is absorbed in any vessel in the world, and the חשש, the stringency charged with guarding the border of that leniency. Rishonim and Acharonim did not divide over the heter itself — all rule like Rava, נותן טעם לפגם מותר — but over how far it reaches: as far as matter stuck to the wall (seif 3), as far as a large vessel (seif 5), as far as a vessel entrusted to another (seif 9), as far as the testimony of a man who is not credible (seif 11). And all these answers derive from one question: what exactly happens to a prohibition at the moment it spoils.
