Siman 123 asked which wine is affected. Siman 124 asks something else entirely: who affects it, and by what act. This is the siman of contact — and it is built, from the first seif to the last, on a single architecture: two distinct prohibitions (drinking and benefit), three grades of toucher, three conditions of the act. Nothing in it concerns the wine itself.

The yesod — two prohibitions, never one:
Every difficulty in the siman flows from the fact that “the wine is forbidden” covers two prohibitions with neither the same cause nor the same measure. The Taz says it in one line: « דכבר נתבאר דאיסור שתייה הוא משום בנותיהן ואיסור הנאה הוא משום עבודת כוכבים מ״ה כל שאינו עובד עבודת כוכבים אין כאן איסור הנאה » (ט״ז יו״ד קכ״ד ס״ק ד). The ban on drinking is a social barrier — משום בנותיהן; the ban on benefit is a ban of idolatry. Hence the rule that governs the whole siman: every defect in the act or in the toucher lowers the case by one degree — נחתינן חד דרגא — and never by two.

The siman opens with the weakest case there is: a non-Jewish child who cannot name idolatry. The Mechaber writes that he forbids only for drinking. This half-measure is no compromise: it is the conclusion of a sugya in which Rav himself was forced to spell out his own words.

The chakira: why does the infant forbid anything? Two branches. (א) Because he possesses, like any non-Jew, an idolatrous intent — in which case the exemption from the benefit-ban needs explaining. (ב) Because a decree was made on his touch on account of the adult: the infant himself is nothing, but wine a non-Jew has stirred must not look permitted. So Tosafot read it: « דבמגע תינוק ושכשכו איכא למיגזר אטו גדול אבל נפל לבור מוכחא מלתא דאניס לא שייך למגזר מידי » (תוספות עבודה זרה נ״ז ע״א ד״ה תינוק בן יומו).
The Shach names the source (ש״ך יו״ד קכ״ד ס״ק א): « אפילו תינוק בן יומו עושה יי״נ בשתייה וכן הוא בפוסקים ». He thereby fixes the ruling against the Geonim cited by Tosafot, who ruled like Shmuel: the infant forbids nothing at all.
Where exactly does the line of the “adult” fall? The Tur is not satisfied with the gemara's criterion: « לא מגע של כל הנכרים אסרו בהנאה אלא דווקא בגדול שיודע בטיב כו״ם ומשמשיה דהיינו כל שזוכר ומזכיר בפיו כו״ם ומשמשיה » (טור יו״ד קכ״ד). The word בפיו is an addition — it is absent from the Tosefta the phrase is drawn from. The Taz analyses it at length: the Perisha attaches זוכר to thought, he attaches בפיו to both verbs, and concludes: « ולשון מזכיר פירושו שנותן לב להזכיר וע״כ לא נקט בש״ע אלא ומזכיר לחוד » (ט״ז יו״ד קכ״ד ס״ק א).
Nafka mina: a child who knows idolatry but never names it. For the Perisha he is already “grown” — knowledge suffices. For the Taz, no: he must mention it, and deliberately. The Mechaber himself decided by retaining only one verb — שאינו מזכיר — as the Taz expressly notes.

Two men stand at the same point on the spectrum, and yet everything separates them. The ger toshav has accepted the seven commandments and will stop there. The convert circumcised but not immersed is on the road to Israel, and has not arrived. Which of the two is nearer? The answer depends on what one measures.

The Shach's kashya (ש״ך יו״ד קכ״ד ס״ק ד): the Rama writes “some are lenient even about the touch of a ger toshav.” The word אפילו implies the unimmersed convert would remain forbidden. But, objects the Shach, nobody holds that: Tosafot and the Rosh expressly permit both. Hence « ויותר נראה דה״ק הרב ויש מקילין אפילו במגע גר תושב כ״ש בגר שמל וקבל עליו כל המצות ».
The answer he rejects, and the one he keeps: he first weighs the Ran's sevara — the unimmersed convert is worse than a ger toshav, « דגר תושב מקבל מהשתא וגר שמל ולא טבל אינו מקבל אלא לאחר טבילה » — so the Rama would have narrowed the leniency on purpose. Then he rejects it: better to read אפילו as an a fortiori. One circumcised upon accepting all the mitzvot is nearer still than one who stops at seven.
The chakira beneath the dispute: what strips a non-Jew of the power to make wine nesech? (א) A present acceptance — he has renounced idolatry here and now; that is the Ran's reading, and the ger toshav wins. (ב) A belonging in formation — he has already left his people to enter Israel; that is the Shach's reading, and the circumcised convert wins. The Bach, quoted by the Shach, pushes the first branch to its limit: « נראה דאפילו בקבל עליו בלבד שלא לעבוד עבודת כוכבים מגעו שרי בהנאה ולא נקט ז׳ מצות אלא לאורויי דאפ״ה אוסר מגעו בשתייה » (ב״ח, מובא בש״ך יו״ד קכ״ד ס״ק ב).
Nafka mina, and a distant consequence: if acceptance is what counts, it is enough that a man renounced idolatry — without the seven commandments — for his touch no longer to forbid benefit; that is precisely the Bach's thesis. The Taz draws a concrete application: « וכ׳ רש״ל דהקראים דינם כגר תושב ומותר לשתות עמו ישראל » (ט״ז יו״ד קכ״ד ס״ק ב).

Three consecutive seifim for one problem: a man no longer quite a non-Jew and not yet a Jew. Each answers with a different criterion — immersion, circumcision, the mother's immersion — and there the Shach writes one of the frankest לא ידעתי in all of Yoreh De'ah.

Twelve months, or at once? Rav Nachman in Shmuel's name teaches: « הַלּוֹקֵחַ עֲבָדִים מִן הַגּוֹיִם, אַף עַל פִּי שֶׁמָּלוּ וְטָבְלוּ — עוֹשִׂין יֵין נֶסֶךְ עַד שֶׁתִּשְׁקַע עֲבוֹדָה זָרָה מִפִּיהֶם » — and he gives the term: « וְכַמָּה? אָמַר רַבִּי יְהוֹשֻׁעַ בֶּן לֵוִי: עַד שְׁנֵים עָשָׂר חֹדֶשׁ » (עבודה זרה נ״ז ע״א). The beraita refutes it, and the Mechaber rules: once circumcised and immersed they no longer forbid, even if the names of idols have not left their mouths.
Why the slave is a case apart (תוספות עבודה זרה נ״ז ע״א ד״ה עד שתשתקע): Tosafot keep the twelve-month rule for the slave alone, since he does not convert wholeheartedly — אימת רבו עליו — whereas « אבל עובדי כוכבים שמלים וטובלים מרצונם ולדעתם נשתקע שם עבודת כוכבים מפיהם מיד ומותר מגען ביין מיד ». The Taz rebuilds his whole reading of the Tur on this distinction, even positing a word dropped from the printed text (ט״ז יו״ד קכ״ד ס״ק ב).
The Shach's לא ידעתי מנ״ל (ש״ך יו״ד קכ״ד ס״ק ח): the Mechaber writes in seif 4 that the adults among maidservants' sons forbid the wine for drinking. The Shach stops short: « לא ידעתי מנ״ל הא דהא כיון דלא טבלו עדיין עובדי כוכבים הן ומגען אוסר אפילו בהנאה דקי״ל אינו גר עד שימול ויטבול ». A man not immersed is a full non-Jew; his touch ought to forbid benefit too. And he marshals against the Mechaber the Ran, the Rashba, Tosafot, the Tosefta and the Rambam.
Tosafot's answer — why the slave is not an ordinary non-Jew: « ואומר ר״י דשאני טומאה דחשו חכמים להפסד טהרות אבל לענין כל שאר דבריהם קי״ל דאינו גר עד שימול ויטבול » (תוספות עבודה זרה נ״ז ע״א ד״ה גדולים אין קטנים לא). Impurity is a field where the Sages feared the loss of טהרות; elsewhere the rule stands. The Shach draws the phrase that sums up the exception: « דשאני עבדים שאין לבן לשמים אלא מאימת רבן מתיהדים » (ש״ך יו״ד קכ״ד ס״ק ח).
Does circumcision suffice for the child? (seif 4, end) The Rashba holds a maidservant's small son forbids nothing, even uncircumcised; the Ra'ah and the Ramah require circumcision. The Beit Yosef reads the Rambam as also requiring mila, so the Mechaber writes כיון שמלו. Both Shach and Taz refuse that reading, the Taz head-on: « ותמהני מאד מהיכן משמע ליה לב״י מדברי הרמב״ם כן », closing with the Tosefta the Tur had not seen: « דודאי אין כח לחלוק על תוספתא » (ט״ז יו״ד קכ״ד ס״ק ג).
Seif 5 and its hidden yesod: if the maidservant immersed for slavery, her son needs no immersion — Rashi writes so on the beraita, the Ran and the Nimukei Yosef follow. The Shach draws the exact consequence (ש״ך יו״ד קכ״ד ס״ק י): « כיון דלא בעי טבילה הוה ליה כישראל משוך בערלתו ». In other words the child is not “a non-Jew exempted from immersion” but a man whose status is already acquired, lacking only an outward sign.
Nafka mina — and the limit the Shach himself sets: « מיהו תינוק עובד כוכבים דלאו בן שפחה הוא אפי׳ מל עושה יי״נ בשתיה כל זמן שלא טבל » (ש״ך יו״ד קכ״ד ס״ק ט). The leniency of seif 4 rests on servile descent, not on childhood: a circumcised non-Jewish child with no bond of servitude stays under the drinking-ban of seif 1.

Seifim 6 and 7 are the keystone of the siman. They do not decide a case: they state the conversion rule between the two prohibitions. Without them, half the rulings that follow would look arbitrary.

The Rambam's rule as written: « כָּל מָקוֹם שֶׁנֶּאֱמַר בְּעִנְיָן זֶה שֶׁהַיַּיִן אָסוּר אִם הָיָה עַכּוּ״ם שֶׁנֶּאֱסַר הַיַּיִן בִּגְלָלוֹ עוֹבֵד עַכּוּ״ם הֲרֵי הוּא אָסוּר בַּהֲנָיָה. וְאִם אֵינוֹ עוֹבֵד עַכּוּ״ם הֲרֵי הוּא אָסוּר בִּשְׁתִיָּה בִּלְבַד » (רמב״ם הלכות מאכלות אסורות פרק י״א הלכה ח). Seif 6 transposes it; seif 7, opened by יש מי שאומר, applies it in reverse — and it is a יראה לי of the Rambam himself: « יֵרָאֶה לִי שֶׁכָּל מָקוֹם שֶׁאָמַרְנוּ בְּעִנְיָן זֶה בְּיַיִן שֶׁלָּנוּ שֶׁהוּא אָסוּר בִּשְׁתִיָּה וּמֻתָּר בַּהֲנָיָה מִפְּנֵי צַד נְגִיעָה שֶׁנָּגַע בּוֹ הָעַכּוּ״ם כְּשֶׁהָיָה הָעַכּוּ״ם עוֹבֵד עַכּוּ״ם » (רמב״ם הלכות מאכלות אסורות פרק י״ג הלכה י״א).
Why “יש מי שאומר” over a halakha of the Rambam? The Mechaber uses that phrase when a single authority holds a point. Here the reason is visible in the source: the Rambam did not receive it, he deduced it — יראה לי. The Shach maps its reach (ש״ך יו״ד קכ״ד ס״ק י״א): wherever the siman says “permitted for benefit, forbidden for drinking on account of a form of touching,” a non-idolater will render the wine permitted even for drinking.
The underlying chakira: are the two prohibitions (א) two degrees of one ban — a strong and a weakened one — or (ב) two independent bans, one about social closeness and one about idolatry, that merely coincide? The Taz's formulation (ט״ז יו״ד קכ״ד ס״ק ד) decides for the second branch, and it is what makes sense of a non-idolater still being forbidden for drinking: his daughter's people did not change because his worship did.
Nafka mina — and it is the heaviest in the siman: may two leniencies be combined? The Shach says no, flatly: « מיהו היכא דמותר מן הדין בהנאה משום שאינו עובד עבודת כוכבים כגון קטן וגר תושב וכה״ג… אף לדידן אסור בשתייה אף במקום הפסד » (ש״ך יו״ד קכ״ד ס״ק ע״א). A non-idolater plus an unintentional touch do not make wine permitted for drinking, because the second relief has nothing left to relieve — the first already spent the one-degree descent.

Seif 8 sets side by side two exactly opposite men: the Jew who has erased the sign of the covenant, and the apostate who has kept it. The first forbids nothing; the second forbids everything. The reason is one line of the Shach, and that line is the organising principle of the whole siman.

The yesod (ש״ך יו״ד קכ״ד ס״ק י״ד): « דניסוך אינו תלוי במילה רק בעובד עבודת כוכבים וזה שנמשכה ערלתו לבו לשמים ». The power to make wine nesech is neither a bodily attribute nor a defect of belonging: it is a capacity tied to worship. Hence: the מָשׁוּךְ, whose heart stayed turned to Heaven, cannot pour a libation; the mumar, whose body still bears the covenant, can.

The Shach's chiluk — a migo, not trust (ש״ך יו״ד קכ״ד ס״ק ט״ו): « אבל היכא דאינו ידוע שהיה מומר אע״ג דאינו ידוע ג״כ שהיה ישראל נאמן לומר תשובה עשיתי במגו דאי בעי אמר מעולם לא המיר וישראל הוא ». Credibility does not reward repentance: it flows from his having been able to keep silent. Where the apostasy is notorious that migo collapses — and the Rashba is right.
Seif 9 and the anussim — two questions, not one: the Mechaber says they are not believed about their own wine, even under oath, but are believed about others'. The Rama adds what the Mechaber had not said: ואין אוסרין יין במגען. The distinction is sharp — credibility and capacity to render nesech are two different things. The Beit Yosef's kashya: if touch alone does not suffice, why did Tosafot and the Rosh need to explain that the man in the etrog sugya was occupied? It would have been enough to say he did not stir. The Beit Yosef concludes that for them touching alone forbids benefit.
The Shach's answer (ש״ך יו״ד קכ״ד ס״ק כ): he turns the question around. The Beit Yosef assumed a difference between the hand going in and coming out; in fact « אלא ודאי כך לי שכשוך דהכנסה כשכשוך דהוצאה ». If the entry did not forbid, it is not because entering does not stir, but because he was busy retrieving his etrog. An agitation, or a real agitation? The Beit Yosef hesitates; the Rashba decides in Mishmeret HaBayit: « דלא מצינו הפרש בין שכשוך רב לשכשוך מועט אלא הכל אסור » (מובא בט״ז יו״ד קכ״ד ס״ק ו). And the Machoza sugya confirms it in fact: the man only wanted to know whether it was wine, « הֲוָה יָתֵיב חַמְרָא בְּדַוְולָא, שְׁדָא בֵּיהּ יְדֵיהּ שַׁיכְשֵׁךְ בֵּיהּ » (עבודה זרה נ״ז ע״ב) — and the wine was forbidden for benefit.

Yet in seif 23 he rules like the Raavad, who adds precisely a new טירדא. The Taz: « והיאך כתב כאן שאין לך אלא מה שאמרו חכמים והלא אנו מוסיפין עליהם ומ״ש הוספה זו מהוספה אחרת ».
The Shach attacks from the opposite side (ש״ך יו״ד קכ״ד ס״ק ס״ג): he contests not the Rama's consistency but his ruling. Two neighbouring seifim, two nearly identical gestures, two opposite results. The non-Jew clasps a cracked barrel: permitted for benefit. He lays his hand over a hole: all the wine above it is forbidden for benefit. The difference hangs on one word — prevent.

The sugya: « וְהָנֵי מִילֵּי דִּפְקַעָה לְאוּרְכַּהּ, אֲבָל לְפוּתְיַיהּ — אֲפִילּוּ בִּשְׁתִיָּה שְׁרֵי. מַאי טַעְמָא? מַעֲשֵׂה לְבֵינָה קָעָבֵיד » (עבודה זרה ס׳ ע״ב). The Taz explains why the lengthwise crack still forbids drinking (ט״ז יו״ד קכ״ד ס״ק כ״ב): « דכשהכלי שלם לא שייך נוגע דכל נוגע ע״י ד״א היינו שהנוגע מביא ד״א בשעת הנגיעה ליין » — the intact barrel is already a container, whereas the cracked barrel has parted from the wine, and the non-Jew brings it back.

The source: Rav Papa distinguished the skin from the tub — « כּוּבָּא: מַלְיָא — אֲסִיר, דִּלְמָא נָגַע. חַסִּירָא — שְׁרֵי, דְּלָא נָגַע » — and Rav Ashi concludes: « זִיקָא, בֵּין מַלְיָא וּבֵין חַסִּירָא — שְׁרֵי, מַאי טַעְמָא? אֵין דֶּרֶךְ נִיסּוּךְ בְּכָךְ » (עבודה זרה ס׳ ע״א). Seif 27 and the Tur's protocol: a Jew must place the tow; the non-Jewish craftsman only tightens it with a knife. The Shach wonders at it — why, if contact through an object without intent is permitted? The Taz answers (ט״ז יו״ד קכ״ד ס״ק ל״ה): the leniency of mediated contact holds after the fact, not at the outset.
