1. שורש הסימן — one man’s word against another man’s property

Four seifim only, and yet this siman stands on the fault line of halakhic evidence law. Everywhere else עד אחד נאמן באיסורין comes to permit: a man says the piece is permitted fat, and one eats. Here the same witness comes to forbid — and what he forbids is not his own but his fellow’s wine. Two forces meet: the נאמנות granted to a single witness in matters of issur, and the חזקה that shields the owner — the wine’s חזקת היתר and the possessor’s חזקת ממון. The whole siman is the map of that collision.

The classic formulation — and its limiting clause The Gemara states the single witness’s נאמנות and in the same breath fences it in: « אימור דאמרינן עד אחד נאמן באיסורין כגון חתיכה ספק של חלב ספק של שומן דלא איתחזק איסורא » (גיטין ב׳ ע״ב) The paradigm case of the single witness is a case without a חזקה. Our whole siman explores what happens when a חזקה is present — and worse, when it belongs to someone other than the speaker.
Where does this נאמנות come from? The Gemara looks for a verse and then gives it up: « אלא סברא היא מידי דהוה אחתיכה ספק של חלב ספק של שומן ואתא עד אחד ואמר ברי לי דשומן הוא דמהימן » (יבמות פ״ח ע״א) A סברא, not a verse. Hold on to that word: it governs everything that follows.
And yet, the opposite pole In the very sugya of our siman a man is believed against another’s interest, and Rabbi Yoḥanan rules with a phrase that no longer speaks of סברא at all: « הכי אמר רבי יוחנן משום רבי יוסי: מה אעשה שהתורה האמינתו » (גיטין נ״ד ע״ב) התורה האמינתו — the language of an instituted הימנותא, not of a common-sense inference. Both formulations come from the same hand.
The ḥakira that runs through all four seifim (א) הימנותא. The Torah granted the single witness in matters of issur a claim to truth — “כל מקום שהאמינה תורה עד אחד הרי הוא כשנים.” It establishes reality, and therefore forbids exactly as it permits. (ב) A סברא of בירור. There is no עדות here at all, only information, accepted because nothing opposes it. Once a חזקה — or the owner’s own mouth — stands against it, the information has nothing to bite on. Seifim 1 and 2 are branch (ב); seif 3 hesitates; and the Shach, as we shall see, pulls both ways at once.

2. עד אחד נאמן באיסורין — a Torah הימנותא or a סברא of בירור?

The question is not academic: the whole siman turns on the answer. If the Torah instituted the נאמנות, it does not retreat before the owner’s mouth. If it is a סברא, it yields to whatever balances it.

Tossafot look for a verse after all — and the difficulty it raises is precisely ours: « ואם תאמר אם כן אפילו איתחזק איסורא נמי ואמר ר״י נדה נהי שעכשיו ראתה מכ״מ לא איתחזק איסורא שתראה לעולם » (תוספות יבמות פ״ח ע״א ד״ה ברי לי דשומן דמהימן) If the source is וספרה לה לעצמה — the nidda believed about herself — the נאמנות ought to hold even against a חזקה. The Ri answers that the nidda herself is no case of חזקת איסור. That is: even the verse speaks only where nothing stands against it.
The Rosh, quoted by the Beit Yossef, draws the consequence « הא דעד אחד נאמן באיסורים ה״מ לסמוך עליו להתיר דגמרינן מוספרה לה לעצמה אבל להחמיר לא מחמרינן ע״פ עד אחד » (בית יוסף יו״ד קכ״ז, בשם הרא״ש פרק אלו מגלחין) This is the direct source of seif ג׳. The verse founds only a power to permit.
The Shach turns the table over If the witness is believed to wrench a thing out of its חזקת איסור — the stronger act — how should he not be believed to forbid, which is the weaker? « דהא ודאי אי נאמן להתיר כ״ש דנאמן לאיסור » (ש״ך יו״ד קכ״ז ס״ק ט״ז) The Shach devotes the siman’s longest ס״ק to this, marshalling the Rashba, the Ran, the Ritva, the Nimukei Yosef, the Raavan, the Raavad and the Rambam, and concludes that this is the עיקר — notwithstanding the wording of seif ג׳, which is kept only out of חומרא.
Nafka mina A man says of another’s barrel that it was handled. The owner is absent, says nothing, can say nothing. On branch (א) — הימנותא — the barrel is simply forbidden. On branch (ב) there is nothing at all: no owner’s mouth to hang on, no חזקה to displace, hence no נאמנות whatever. This is exactly what the Shach will say in ס״ק י״ד about wine whose owners are elsewhere.

3. כל שבידו נאמן — which בידו is meant?

The whole sugya begins with a beraita about the worker who laboured at his employer’s טהרות, and with two rival readings of Abbaye’s answer. This is no quarrel over words: the two readings yield two different theories of נאמנות.

The beraita « היה עושה עמו בטהרות ואמר לו טהרות שעשיתי עמך נטמאו… נאמן. אבל אמר לו טהרות שעשיתי עמך ביום פלוני נטמאו… אינו נאמן » (גיטין נ״ד ע״ב) One difference only: “now” against “on such a day.” The Gemara asks what underlies it.
The two answers « מאי שנא רישא ומאי שנא סיפא? אמר אביי: כל שבידו נאמן » (גיטין נ״ד ע״ב) and Rava’s, which the Tour, the Rosh and the Mehaber adopt: « רבא אמר: כגון דאשכחיה ולא אמר ליה ולא מידי ולבתר הכי אשכחיה ואמר ליה » (גיטין נ״ד ע״ב)
Two readings of בידו (א) בידו לטמא. He could, at this very moment, defile or forbid the thing; he is therefore believed by a מיגו — why would he lie when he could simply act? That is Rashi’s, Rabbenu Tam’s and the Rashba’s reading. (ב) בידו לשמור. It was entrusted to him: in this matter he is as the owner himself, and a man is believed about what is his. No מיגו at all. That is the Rosh’s and the Mordekhi’s reading, and it is the Tour’s wording.
The Tour’s wording « אם הוא בידו כגון שנתנו בידו לשומרו נאמן » (טור יו״ד קכ״ז) Five words — כגון שנתנו בידו לשומרו — and they settle the ḥakira. The Mehaber omitted them.
The Rosh says expressly that this is no מיגו « ומפרש אביי טעמא הואיל וברשותו הן הרי הן כשלו ונאמן עליהן ולאו מטעמא דאי בעי מטמא להו » (רא״ש מסכת גיטין פרק הניזקין סימן י״ג) and he proves it from תרומה: one who can separate on another’s behalf is thereby “as the owner,” even when separating from what is not his. « אלא כיון שבידו לתקנו הוי כבעליו ואפילו תרם משל חבירו » (רא״ש מסכת גיטין פרק הניזקין סימן י״ג)
The Shach sets the two readings face to face — and notes that the Beit Yossef chose « ל׳ הטור כגון שנתנו בידו לשומרו ור״ל דל״ת דבידו היינו בידו לנסכו אלא דהיינו שנתנו בידו לשומרו והוי כבעליו עליו ולא מטעם מיגו » (ש״ך יו״ד קכ״ז ס״ק א) The Beit Yossef, the Shach observes, did not bring the Rosh and the Mordekhi and gave Rashi, Rabbenu Tam and the Rashba without discussion — whence, perhaps, the omission of the Tour’s five words in the Shulḥan Arukh.
Nafka mina — and a very concrete one Cooked wine can no longer become יין נסך. The guardian of a barrel of cooked wine says it was handled before the cooking. On reading (ב) he is still the guardian and is believed; on reading (א) he has no מיגו at all, for today he could do nothing. The Shach draws the ruling: « ועפ״ז יש לדון במי שאומר לחבירו על יין מבושל שלו שנתנסך קודם הבישול אינו נאמן » (ש״ך יו״ד קכ״ז ס״ק א)
Where the category of בידו itself comes from Not here: the Gemara, seeking a basis for the single witness’s נאמנות, runs into טבל and answers with בידו. « האי טבל היכי דמי? אי דידיה משום דבידו לתקנו » (יבמות פ״ח ע״א) Which shows that בידו is not a species of נאמנות but its opposite: where there is בידו one need not believe a witness — one observes a power.

4. בפעם ראשון שמצאו — why the first moment decides

Rava’s answer founds a strange rule: the same man, saying the same thing, is believed the first time he meets the owner and no longer the second. The Mehaber adopts it as it stands.

לשון מרן « האומר לחבירו נתנסך יינך אם הוא בידו נאמן ואפילו אם אינו עתה בידו שכבר הוחזר לבעלים אם בפעם ראשון שמצאו אמר לו נתנסך יינך נאמן אפי׳ אם הבעל מכחישו » (שו״ע יו״ד קכ״ז:א) Note the decisive words: אפי׳ אם הבעל מכחישו. This is the only place in the siman where a single witness forbids another’s property against the owner’s word.
And its opposite, immediately after « אבל אם אינו בידו ולא אמר כן לבעל בפעם ראשון שראהו וא״ל אחר כך אינו נאמן אם הבעל מכחישו » (שו״ע יו״ד קכ״ז:א)
Why the first moment? Two explanations offer themselves, and they do not yield the same rulings. (א) One who keeps silent at the first meeting contradicts himself: had he known, he should have spoken to keep his fellow from an issur, and his initial silence is a ריעותא in his own testimony. (ב) The first meeting prolongs the שמירה: until he has rendered account he is still the guardian, hence still “as the owner”; afterwards he is only a passer-by.
The Rosh holds the second — and his phrasing speaks for itself: « אפי׳ דבר שאינו ברשותו עתה אי בזימנא קמייתא דאשכחיה א״ל עדיין נקרא בעליו ומהימן » (רא״ש מסכת גיטין פרק הניזקין סימן י״ג) עדיין נקרא בעליו: the title still attaches to him. The נאמנות of seif ג׳ — אדם נאמן על שלו — is already here, in seif א׳, in disguise.
The Rashba, brought by the Beit Yossef, restricts the whole rule to the worker alone « ולא נאמרו דברים הללו אלא בפועל דכיון שקבל עליו לעשותם בטהרה » (בית יוסף יו״ד קכ״ז) for the worker had accepted the duty; an ordinary witness, however, was under no obligation to speak at once: « אבל ע״א דעלמא ודאי נאמן שמא לא נזכר בשעה ראשונה דלא עליה רמיא או שלא רצה להעיד לו ולבתר כן נמלך ואמר לו » (בית יוסף יו״ד קכ״ז) This is precisely explanation (א) — the initial silence is a ריעותא only for one on whom the duty to speak lay. The Shach in ס״ק ג will say this is the clearest שיטה in the ש״ס.
The Darkhei Moshe’s kushia on the Rashba If the ordinary witness is believed only when the owner is silent, what difference can there be between the first meeting and the second? Silence is silence, and it is an admission in both.
The Taz’s answer — and it is subtle Without the rule, the owner could explain his silence quite differently: “you already saw me and said nothing; what you throw at me today is mere jest, so I did not trouble to reply.” « ולי נראה דלא קשה מידי דהוי אמינא שיכול הבעל לומר כיון שכבר ראית אותי ולא אמרת לי דבר לאפרושי מאיסורא ועכשיו אתה אומר לי אין זה אלא דרך שחוק והיתול ועל כן לא חששתי להשיבך » (ט״ז יו״ד קכ״ז ס״ק ב) In other words: the rule of the first moment is here not a condition of the witness’s נאמנות but a condition of the force of the owner’s silence. The Taz shifts the subject of the ruling — a reversal, and it governs what follows.
A nafka mina brought by the Shach And if the two dispute the very fact of whether he spoke at the first meeting? The Rama, in his responsa, rules for the owner: « כתב הרב בתשוב׳ סי׳ ס״ו דאם הבעל מכחישו ואמר שלא א״ל בפעם הראשון ודאי הבעל נאמן » (ש״ך יו״ד קכ״ז ס״ק ד) Which is entirely coherent: the exceptional נאמנות of the first moment is an exception, and the one who invokes it must establish its conditions — against a חזקה that needs no proof.

5. שתיקה כהודאה — admission, or mere reliance on the witness?

When none of that is present — the thing is no longer in his hand, he did not speak at the first moment — one door remains: the owner is silent. The Mehaber at once closes it with a condition, and that condition betrays a theory.

לשון מרן « או אומר איני יודע אבל אם שתק שתיקה כהודאה דמיא » (שו״ע יו״ד קכ״ז:א) and, a few lines later, the condition: « והוא שיאמר לו נתנסך יינך בפניך או שאמר ליה ידעת דרגלים לדבר » (שו״ע יו״ד קכ״ז:א)
The source: the sugya of אכלת חלב « אמר אביי: אמר לו עד אחד אכלת חלב והלה שותק נאמן » (קידושין ס״ה ע״ב) and Tossafot there already impose the condition the Tour and the Mehaber will adopt: « וצריך נמי לפרש והלה שותק דאמר לו העד אכלת חלב והיה לך לידע והוא שותק » (תוספות קידושין ס״ה ע״ב ד״ה אמר לו עד אחד אכלת חלב)
The Tour makes it a rule « והא דשתיקה כהודאה דוקא כשאמר לו נתנסך בפניך או שאמר לו ידעת דרגלים לדבר אבל בענין אחר לא הוי שתיקה כהודאה » (טור יו״ד קכ״ז)
What is that silence worth? (א) A full הודאה. By keeping silent the owner has conceded the fact. The wine is then forbidden by his own mouth, and the witness has no further role. (ב) A support. Silence proves nothing in itself; it only shows that the interested party himself finds the claim plausible, and it is that plausibility which gives the testimony purchase. The witness remains the subject of the ruling; the silence merely removes the obstacle.
Tossafot expressly choose branch (ב) « כיון דשתיק נראה לו אמת ויודע קצת שיש רגלים לדבר אבל ליכא למימר הודאה ממש שיודע ודאי שכן הוא כיון שהוא שותק » (תוספות יבמות פ״ח ע״א ד״ה דשתיקה כהודאה דמיא) and they prove it two ways: were it a full הודאה, the Gemara would not have said “the witness is believed”; and the blind man in Kiddushin could not have known for certain in any case.
First nafka mina — the Mehaber’s אמתלא Seif א׳ allows the owner, after keeping silent, to revisit that silence: « ואם שתק ואח״כ הכחישו ואמר מה ששתקתי תחילה לא בשביל שהודיתי אלא להתיישב ולחשוב בלבי לזכור אם הוא אמת נאמן » (שו״ע יו״ד קכ״ז:א) A full הודאה cannot be retracted. That the אמתלא works proves the silence was never more than a support — and the Shulḥan Arukh thus ruled like Tossafot without saying so.
Second nafka mina — the Shach derives a whole ruling from it Why does the contradiction of another witness destroy a silence that is not his? Because that silence was only reliance on the first witness — and the reliance collapses once the first witness is challenged: « דכיון דאין שתיקתו הודאה גמורה אלא שיודע קצת רגלים לדבר וסומך אדברי העד » (ש״ך יו״ד קכ״ז ס״ק י״ג)
The underlying ma’hloket: is בפניך required? If the silence is only reliance, the party must be able to know; hence the condition בפניך or ידעת דרגלים לדבר. If the witness is believed of himself, the condition falls: even silence out of ignorance suffices to remove the obstacle. « דאי לאו הכי לא הוי שתיקה כהודאה דהא דשותק משום שאינו יודע בירור הדבר » (ש״ך יו״ד קכ״ז ס״ק ט״ז)

The Rambam on whom the Shach leans His formulation is perfectly sharp: the silence — and nothing else — carries the ruling, and denial overturns it absolutely. « מי שאמר לו עד אחד נטמאו טהרותיך והלה שותק הרי זה נאמן והרי הן טמאות. ואם הכחישו ואמר לא נטמאו הרי הן בחזקתן עד שיעידו שנים » רמב״ם הלכות מטמאי משכב ומושב פרק י״ג הלכה ח עד שיעידו שנים — that is: against the owner’s word two witnesses are needed. One never had that power. The Shach will make this the siman’s central argument.
A precision of the Shach that gets overlooked The אמתלא helps the owner only if he afterwards contradicts. If he merely says “I do not know,” the witness is believed — by all opinions. « נ״ל דוקא אם מכחישו אח״כ אבל אם אמר ליה אח״כ איני יודע ומה ששתקתי תחלה לא מפני שהודיתי כו׳ העד נאמן לכ״ע » (ש״ך יו״ד קכ״ז ס״ק י״ז)

6. איני מאמינך — the נאמנות the listener grants, and withdraws

Here is the most disconcerting halakha of the siman, and the key to its whole theory: the Rama teaches that we coach the owner in a sentence. Three words, and the wine stays permitted.

The Rama’s gloss « ומלמדי׳ אותו לכתחלה שיאמר איני מאמינך ואז לכ״ע שרי דבעלים נאמנים על שלהם » (שו״ע יו״ד קכ״ז:א) The reason given is בעלים נאמנים על שלהם — the owner is believed about what is his. But note: he asserted nothing about the facts. He only withdrew his credence.
The moral difficulty, and it is blunt If the man inwardly believes his informant, how can we coach him to declare the opposite? The Rama goes that far: « ואם הבעלים אומרים איני מאמינך אע״ג דבלבו מאמין לו כבי תרי אין להחמיר » (שו״ע יו״ד קכ״ז:א)
The Shach rejects this reading — and refounds the whole halakha Rabbenu Tam cannot have meant that a man should lie: “how would he be quit before Heaven?” It must be read otherwise — not “I do not believe you,” but “for this matter you are not to me as two”: « אלא ר״ת ה״ק דאפילו אי מהימן ליה כב׳ יכול לומר איני מאמינך כלומר לדבר זה לא מהימנת לי כב׳ » (ש״ך יו״ד קכ״ז ס״ק ט״ו) and he names the act performed: « אלא כיון דאמר איני מאמינך בטליה לנאמנותיה » (ש״ך יו״ד קכ״ז ס״ק ט״ו)
The yessod בטליה לנאמנותיה — he cancelled his נאמנות. A נאמנות conferred by the Torah cannot be cancelled; one does not “withdraw” credence from two witnesses. That this one can be cancelled proves it came not from the Torah but from the listener: it was he who, by relying on the witness, gave him purchase on his wine. The Rama therefore teaches not to lie but not to confer. Branch (ב) of the opening ḥakira wins outright here.
The Shach fences the practice, and strictly One teaches before the witness speaks, and teaches him to answer תוך כדי דיבור; one never teaches him to deny. « פי׳ מלמדים אותו קודם שא״ל העד שכשיבא העד ויאמר לו יאמר לו מיד תוך כדי דיבור איני מאמינך ואין מלמדין אותו להכחישו דהיאך ילמדוהו לשקר » (ש״ך יו״ד קכ״ז ס״ק י״א)
The Taz: outside yayin nesekh the words do not suffice The Rama limited the leniency — ודוקא ביין נסך. The Taz recalls those who refuse it everywhere, and the verse they invoke: « כי יש חולקין וס״ל דכל שהוא מאמין בלבו שאומר אמת אין מועיל מה שמכחישו ועל זה נאמר ויראת מאלהיך » (ט״ז יו״ד קכ״ז ס״ק א) ויראת מאלהיך — the verse of matters entrusted to the heart. Which is to say: at this point the question has left the law of evidence for the conscience.

7. עד אחד בהכחשה — which of the two is nullified?

The Rama lays down three rules in a row that seem to contradict one another, and the Shach devotes the siman’s densest ס״ק to them. Everything hangs on an ambiguity in the Rashba’s wording.

The Rama’s three clauses « ואם אין הבעלים מכחישין אותו אף על פי שמכחישו אחר לא מהני… מאחר שהבעלים שם ושותקין אבל אם אין הבעלים שם מהני » (שו״ע יו״ד קכ״ז:א) and immediately after, a position that seems to undo it: « ויש מי שכתב דעד אחד בהכחשה לאו כלום הוא » (שו״ע יו״ד קכ״ז:א)
Of whom are we speaking? עד אחד בהכחשה is perfectly equivocal: is it the contradicting witness who counts for nothing — in which case the wine stays forbidden — or the contradicted one, in which case it becomes permitted again? The Levush reads it the first way, and even gives a reason: the Torah made the first witness as two.
The Shach proves the opposite three ways First from the Gemara itself, where the phrase clearly denotes the contradicted witness: « אלא לאו בעד אחד! ותסברא? עד אחד בהכחשה מי מהימן? » (קידושין ס״ה ע״ב) next, because the Rashba’s questioner had never mentioned a second witness; and last, because the continuation of the responsum — והכא אפי׳ שלא בפניו — would have no link to what precedes. The phrase therefore means: a single witness contradicted by the owner counts for nothing, for a single witness rises only for an oath.
The principle the Shach places under the whole siman He had already written it in ס״ק ג, and it is the weightiest sentence of the chapter: « לא מיסתבר כלל דעד א׳ יהא נאמן להכחיש הבע״ד ולהפסיד ממונו » (ש״ך יו״ד קכ״ז ס״ק ג) and he draws the consequence for reading the sugya: « והשטה המחוורת בש״ס היא שטת הראב״ד והרשב״א דמפרשים הך דאמרינן בהנזקין דאי אשכחי׳ וא״ל מיד נאמן בשותק ומחלקין בין פועל דגרע מעד דעלמא » (ש״ך יו״ד קכ״ז ס״ק ג) This is the nerve of the siman: the single witness’s נאמנות collides with חזקת ממון, and the ממון prevails. לא יקום עד אחד באיש — one witness does not rise against a man.
And a second, purely structural reason When two witnesses contradict each other only the חזקה remains — and the wine’s חזקה is permission: « ועוד יש כאן סברא גדולה להתיר משום די״ל אוקי גברא להדי גברא ואוקי חמרא בחזקת היתירא דמעיקרא » (ש״ך יו״ד קכ״ז ס״ק י״ד)
בבת אחת or בזה אחר זה — and why it changes everything If the two come together, they cancel out. But if the first has already been accepted, he has become “as two,” and the second can do nothing: אין דבריו של אחד במקום שנים. « מיהו כל זה כשבאו הב׳ עדים בבת אחת אבל בזא״ז כיון שכבר נתקבל עדות הא׳ » (ש״ך יו״ד קכ״ז ס״ק י״ד) This reopens the ḥakira in a new form: at what moment does the Torah make the single witness “as two” — the moment he speaks, or only once a beit din has received him? The Shach’s צריך עיון on the Rama’s first clause That another witness’s contradiction avails nothing when the owners are present and silent, the Shach cannot locate: not in the Haggahot Maimoniyot where the Darkhei Moshe places it, nor anywhere else — only in the Issur ve-Heter in the name of the Semag. And he objects from the mishna in Keritot, where a second witness’s contradiction does exempt from the offering.
The last line of seif א׳ — a laboratory experiment Two partners, one testimony, two reactions: « אחד שאומר לשני שותפים נתנסך יינכם ואחד שותק והשני מכחישו לזה ששותק אסור ולשני ולכל העולם שרי » (שו״ע יו״ד קכ״ז:א) The same wine, in the same barrel, at the same hour: forbidden to one, permitted to the other and to the whole world. A fact does not divide like that; a relation of credence does. Proof, if proof were wanted, that what the witness produces is not a state of the wine but a bond between him and the one who listens.

8. מגו במקום עדים ושוייה אנפשיה — two regimes in one mouth

In the middle of seif א׳ the Rama inserts a rule that is no longer evidence law at all, and which yet explains half the rulings of the siman.

The gloss « מ״מ מאחר שמכחיש העדים הוה ליה מגו במקום עדים ואינו נאמן אפילו בדבר איסור » (שו״ע יו״ד קכ״ז:א) and immediately the reversal: « מ״מ לדידיה אסור משום דשוייה אנפשיה חתיכה דאיסורא » (שו״ע יו״ד קכ״ז:א)
Two ways for a mouth to forbid (א) By נאמנות. He reports a fact; he is believed; the wine is objectively forbidden — to him, to the owner, to everyone. (ב) By שוייה אנפשיה. He is not believed at all; but his declaration binds him, like a נדר. The prohibition is no longer a state of the object but a tie upon the person. The wine stays permitted to the whole world and remains forbidden to him.

Nafka minot A man says his neighbour’s wine was handled; the neighbour denies it. (1) The neighbour drinks it — permitted. (2) The witness drinks it — forbidden. (3) The witness buys the barrel — it stays forbidden to him, for this is not credence but self-binding. (4) The witness sells it to a third party — permitted to the buyer; and the price is not money of issur, since no objective issur ever existed.
And the point that makes it all cohere Why does the מיגו fall here? The Rama says so: because it is במקום עדים. Yet in seif א׳ the “עדים” that crush the מיגו are sometimes the owner’s bare חזקת ממון — the Shach says so expressly and refers to Ḥoshen Mishpat. Which closes the siman on itself: it is one and the same principle, לא יקום עד אחד באיש, that brings down both the נאמנות and the מיגו.

The Shach: this is no principle but a ממה נפשך There is no case in which a lone witness would need to be “not believed to forbid.” If nothing is established, the thing is already forbidden by doubt without him. And if permission is established, it is seif א׳ that rejects him — on account of the חזקה, not on account of the direction of the testimony. « דממ״נ היכא דלא איתחזק לא איסור ולא היתר אסור מספק בלא העד והיכא דאיתחזק היתרא אין העד נאמן לאסור » (ש״ך יו״ד קכ״ז ס״ק כ״ג)
What, then, is left of the maxim? It stands in open tension with the Shach’s כל שכן in ס״ק ט״ז: if a single witness can wrench a thing out of its חזקת איסור, all the more should he be able to place it there. The Shach takes this as proof that the maxim is kept only לחומרא — one does not lighten on the Rashba’s authority, and there is no reason to lighten on the Rosh’s either.
The nafka mina the Shach finds anyway Where nothing is established the thing is indeed forbidden by doubt — but forbidden as a doubt. The gloss « מיהו יש אומרים דבדבר דאיכא לברורי כגון שאומר לו אחד בא ואראך עובד כוכבים מנסך יינך צריך לחוש לדבריו » (שו״ע יו״ד קכ״ז:ג) Note the verb: לחוש, not נאמן. This is no longer a question of credence but a duty to go and look.
The Shach: this is an explicit Gemara It should not have been written as a יש אומרים: the Gemara says it of the בעל מום and the מקוה. And it goes further than the Rama: even an owner who denies does not exempt one from verifying; and Tossafot add: even where another witness contradicts. « ואביי אמר: לעולם דקא מכחיש ליה ודקאמרת אמאי מהימן דאמר ליה שלח אחוי » (קידושין ס״ו ע״ב)
The yessod This whole siman is a long enquiry into what one must believe. Here the halakha refuses the question: where one can go and look, one need not decide whether one believes. The single witness is neither believed nor dismissed — he is followed. The distinction between נאמנות and בירור, glimpsed in section 2, becomes here a practical rule.
The Taz draws the consequence, and it is liberating Since everything rests on verification, one must actually go with him — and if one goes and finds nothing, no prohibition remains at all. No residue of doubt. « פירוש שצריך לילך עמו אבל אם הלך עמו ולא מצאו אין כאן איסור כן נראה לי פשוט » (ט״ז יו״ד קכ״ז ס״ק ה)

12. אתחזק איסורא — the Taz against the Rama on בשר שאינו מנוקר

The Rama gives two examples of a thing “established in prohibition.” The second sets off the most violent page of the Taz in the whole siman.

The Taz’s kushia טבל is wholly forbidden before it is corrected — a genuine חזקת איסור. But a piece of unporged meat is not forbidden: what is forbidden in it are the sinews and fats; the rest was permitted before the porging as after, merely unseparated. And the Taz produces a proof from practice Every day, everywhere, one takes the word of a man who says meat is porged, and eats — even though the man holding it could not porge it himself. If the gloss were right, that entire practice would be forbidden. The Taz adds that the item is found neither in the Mordekhi nor in the Asheri, but only in the Ran.
The Shach saves the gloss — by an exact formulation The חזקת איסור is not a property of the place but of the object under judgment. In the butcher’s shop the prohibition is established; in this piece it is not. « דאע״ג דאיתחזק איסורא במקום הזה מ״מ בהאי חתיכה לא אתחזק איסורא שם » (ש״ך יו״ד קכ״ז ס״ק כ״ז)
The ḥakira laid bare Is a חזקת איסור a state of the world or a position in an argument? (א) A state: the object stands in prohibition until a fact removes it. (ב) A position: the חזקה only says where reasoning about the question at hand begins; change the question — “this piece” rather than “this meat” — and the חזקה changes with it. The Taz holds (ב) and breaks the gloss; the Shach holds (ב) too, but cuts the question differently.
The Taz’s תקנה — elegant and perfectly legal Since a man is believed about what is his, even against a חזקת איסור: let the piece be given or sold to the witness himself. It becomes his, he is believed about it, and he hands it back. « ומ״מ גם לזה יש תקנה שיתננה או ימכרנה לזה המעיד עליה שאז נאמן עליה כיון שהיא שלו » (ט״ז יו״ד קכ״ז ס״ק ו) Which reveals, in return, what אדם נאמן על שלו really is: not an owner’s privilege but a consequence of what the siman established from seif א׳ — one who has power over the thing does not need to be believed.

The siman closes with those who are not witnesses. And the way it treats them is the best commentary on everything that came before.

The woman « ואשה נאמנת בדבר איסור לומר תקנתיו » (שו״ע יו״ד קכ״ז:ג) but not everywhere: « אין אשה נאמנת דאשה דעתה קלה להקל » (שו״ע יו״ד קכ״ז:ג)
The Shach brings it all back to one principle She is not believed qua witness — that would be impossible against a חזקת איסור. She is believed because she is the one who did it, or because the thing is hers: precisely the בידו of seif א׳. « והיינו היכא דבידה לתקנו או שהוא שלה דאל״כ לא עדיפא מעד אחד דאינו נאמן הואיל ואיתחזק איסורא » (ש״ך יו״ד קכ״ז ס״ק כ״ט) and he adds a criterion that is no longer juridical at all but empirical — the burden of the task: « וכן דבר שיש בו טרחא אין הנשים נאמנות דנשים עצלניות הן » (ש״ך יו״ד קכ״ז ס״ק ל)
The minor The Rama lays down the rule, from the Rivash: « קטן אין לו דין עד להיות נאמן באיסורין » (שו״ע יו״ד קכ״ז:ג) and the Beit Yossef gives the reason in the Rivash’s own words — not “he lies,” but “he is not an עד”: « אין הקטן נאמן לאסור היין שהוא בחזקת היתר דעד אחד נאמן באיסורים אמרו ולא קטן » (בית יוסף יו״ד קכ״ז)
And yet the Shach restores much to him Where the witness’s נאמנות does not operate — where it is בידו — the minor can do everything, in both directions: « מיהו היכא דהוא בידו הקטן נאמן אפילו להוציא דבר מחזקתו להתיר או לאסור » (ש״ך יו״ד קכ״ז ס״ק ל״א) and he specifies, in the Rivash’s own name, the exact boundary: « אבל במה שאין בידו אין הקטן נאמן להוציא דבר מחזקתו להיתר או לאיסור » (ש״ך יו״ד קכ״ז ס״ק ל״א) The minor, in other words, is not a weak witness: he is not a witness at all. Where the ruling requires no testimony, his incapacity weighs nothing.
And the whole of seif ד׳ « דברים שאין בהם חזקת איסו׳ אלא חששא שמא יחליפנו עובד כוכבים או יגע בו יש מי שאומר שסומכין על הקטן מכיון שבא לכלל דעת שמירה » (שו״ע יו״ד קכ״ז:ד) Its source, the Ritva quoted by Rabbenu Yeruḥam in the Beit Yossef, uses exactly the same words: « אבל דברים שאין בהם חזקת איסור אלא חששא שמא יתחלף או שיגע נכרי סומכין עליו מכיון שבא לכלל דעת שמירה » (בית יוסף יו״ד קכ״ז)
The פסולי עדות, and the non-Jew The Rama opens wide: « וכל הפסולי עדות כשרים לענין איסורים אם לא שחשוד לאותם דברים » (שו״ע יו״ד קכ״ז:א) but the Shach shows that the Ran, cited as the source, says the opposite as soon as it is a matter of forbidding another’s property — and his reason is the reason of the whole siman: the נאמנות rests on the owner’s reliance, and one does not rely on a disqualified man. « אבל בפרק האומר מיירי בהדיא בבא לאסור של חבירו כגון לומר נתנסך יינך דאז אינו נאמן אלא גם מכח שתיקת הבעל דין שסומך על דברי העד הכשר » (ש״ך יו״ד קכ״ז ס״ק כ׳) As for the non-Jew, the Shach makes it a rule without exception, and the image is striking: « ונקוט האי כללא בידך דלעולם סלק עדותו של עובד כוכבים כמאן דליתיה ואין דבריו מעלין או מורידין בשל אחרים » (ש״ך יו״ד קכ״ז ס״ק כ׳)
And the two brothers One last line of the Rama, seemingly trivial: « ב׳ אחים אינם אלא כעד אחד לענין איסורים » (שו״ע יו״ד קכ״ז:א) The Rashba, from whom it comes, specifies that this holds בין לקיים דבר בין לענין הכחשה. Two relatives therefore never make two witnesses — which presupposes that the נאמנות of seif א׳ is indeed testimonial in nature, with its rules of fitness. The siman keeps both its faces to the end.
The yessod of the siman The four seifim pass through four different titles for acting on another’s wine, and only one of them is testimony. Seif א׳: the hand — he who holds is as the owner. Seif ב׳: the price — he who pays out of his own pocket is believed by what he loses. Seif ג׳: the חזקה — what decides is not the witness but the starting position. Seif ד׳: the guarding — a child capable of guarding suffices where no witness was wanted but a guardian. The siman opens with the question “is one believed to forbid another’s wine?” and closes by showing that almost always the answer depends not on the credence given to a man but on the place he occupies with respect to the thing. לא יקום עד אחד באיש — one does not rise against a man; but he who holds the thing has no need to rise.
