1. שורש הסימן — the reversal of מירתת

Simanim 128 to 130 built an edifice of guarantees — yichud, escort, seal, double seal. Siman 131 lays down no new rule: it changes one single fact in the scene, the ownership of the wine, and the whole edifice collapses. To understand this siman is to understand that all those guarantees were never more than one.

The mishnah that carries the whole siman At the end of perek Rabbi Yishmael the mishnah sets out the case and gives its two criteria at once — the door and the city. « בְּעִיר שֶׁיֵּשׁ בָּהּ גּוֹיִם וְיִשְׂרְאֵלִים — מוּתָּר, בְּעִיר שֶׁכּוּלָּהּ גּוֹיִם — אָסוּר, עַד שֶׁיֵּשֵׁב וּמְשַׁמֵּר » (עבודה זרה ס״א ע״א) Note the shape of the rule: it speaks neither of a vessel, nor of a closure, nor of contact. It speaks of a city. The criterion is sociological before it is material.
The Rambam names the spring — twice, and in both directions For a Jew’s wine lodged with a non-Jew he writes what holds the latter back: « מִפְּנֵי שֶׁהָעַכּוּ״ם מְפַחֵד תָּמִיד וְאוֹמֵר עַתָּה יִכָּנֵס לְבֵיתוֹ פִּתְאֹם וְיִמְצָא אוֹתִי בְּתוֹךְ בֵּיתוֹ » רמב״ם הלכות מאכלות אסורות פרק י״ג הלכה א And for our own case he writes exactly the opposite: « שֶׁכֵּיוָן שֶׁהַיַּיִן שֶׁל עַכּוּ״ם וּבִרְשׁוּתוֹ אֵינוֹ מְפַחֵד לְזַיֵּף וּלְהִכָּנֵס לַבַּיִת » רמב״ם הלכות מאכלות אסורות פרק י״ג הלכה ג Two halakhot, two owners, and one word that flips: מְפַחֵד.
The Taz says it in one line, and it is the line to remember « שאין עובד כוכבים מרתת מליגע כיון שהוא שלו מה שאין כן ביין של ישראל ברשות עובד כוכבים דמותר בחת״ח או בחותם אחד בדיעבד דמרתת טפי » (ט״ז יו״ד קל״א ס״ק ג) The same seal, the same cellar, the same man — and two opposite regimes, according to the name on the deed.
The chakira of the siman: what is a חותם? (a) A מחיצה — a material barrier: the seal blocks access, and its force is proportional to its strength. On this reading two seals are necessarily better than one, everywhere and always. (b) A סימן — a mark: the seal blocks nothing, it merely makes a break-in visible; its force is therefore entirely borrowed from the eye that will notice it. On this reading, a seal in a place no one will ever look at is worth nothing at all. Siman 131 decides for (b), and that is its one and only thesis. All its consequences — the neighbour who dispenses with a seal, the two seals that do not dispense with a guard, the window that only counts by day — follow mechanically.
Immediate nafka mina Wine sealed with two seals, in a room to which no one ever has the key and which no one ever enters. On (a) it is guarded; on (b) it is not. The Mehaber writes: אסור אפילו בחותם תוך חותם עד שיהא ישראל יושב ומשמר. There is no other way to read that sentence.

2. גדר המטהר — two branches, one status

The Mehaber opens with two cases and treats them as one. Why join them, when in one there was a sale and in the other there was not?

The Tur defines the word first « המטהר יינו של נכרי פירוש שישראל עושה יינו של נכרי בהכשר » (טור יו״ד קל״א) “ Purifying ” has nothing ritual about it here: it means producing according to the rules. The subject of the verb is the Jew; the object remains the non-Jew’s wine.
Why the two branches are equivalent In the first, the wine has been sold but the price is unpaid: the seller can therefore hold the goods back. In the second, it has not been sold at all. Legally these two situations differ; but from the standpoint of מירתת they are identical, since in both cases the non-Jew can still dispose of the wine. The siman’s criterion is therefore not formal ownership: it is de facto control.
Kashya If de facto control is what counts, what of a partial payment? The wine is no longer entirely his, but neither has it entirely left his hand.
Teirutz — the Shach builds the answer on the share « ולא פרע לו מעות. היינו שלא פרע לו כלום אבל אם פרע לו מקצת בענין שיש לישראל חלק ביין » (ש״ך יו״ד קל״א ס״ק א) The stringency of the siman applies only where nothing has been paid. As soon as a partial payment gives the Jew a real share in the wine, we fall back into the regime of a Jew’s wine deposited with a non-Jew — key and seal, and a single seal after the fact.
The Pitchei Teshuva sharpens the condition, and rules out a methodological error He reports that a partial payment does not suffice if the seller can still discharge himself by returning the money; he must be obliged to deliver wine to the value of the sum. Then, against the questioner, he rejects the idea that the matter would be settled by the law of acquisition: « דהכא אין הטעם משום דינא דקנין כמו במכירת חמץ ובכור והיתר שביתת בהמה דהכא הכל תליא במרתת » (פתחי תשובה יו״ד קל״א ס״ק א) The phrase הכל תליא במרתת is the best summary of this siman ever written.
Nafka mina A deposit paid on a lot of kosher wine left with the producer. If the deposit entitles the buyer to a quantity of wine, the lot falls under siman 130; if the producer can refund and keep his wine, it falls under siman 131 — and two seals will not save it.

3. ישראל הדר בחצר — guard, or domain?

This is the most surprising result in the siman: a Jew who lives in the courtyard permits the wine with no seal at all, whereas two seals do not permit it elsewhere. On what exactly does this leniency rest?

The baraita, and Rabbi Yochanan’s correction The baraita taught that key and seal are required; Rabbi Yochanan has it recited otherwise: « אֲמַר לֵיהּ רַבִּי יוֹחָנָן לְתַנָּא, תָּנֵי: אַף עַל פִּי שֶׁאֵין מַפְתֵּחַ וְחוֹתָם בְּיָדוֹ — מוּתָּר » (עבודה זרה ס״א ע״ב)
The Rambam gives the reason, and it is psychological « מִפְּנֵי שֶׁהָעַכּוּ״ם מְפַחֵד תָּמִיד וְאוֹמֵר עַתָּה יִכָּנֵס לְבֵיתוֹ פִּתְאֹם וְיִמְצָא אוֹתִי בְּתוֹךְ בֵּיתוֹ » רמב״ם הלכות מאכלות אסורות פרק י״ג הלכה א It is not surveillance that protects, it is the unpredictability of the entrance.
Chakira: what is the neighbour’s status? (a) He is a שומר — a full guard, merely exempted from staying on the spot, as the mishnah allows for any guard. (b) He is no guard at all: his presence transforms the place, which ceases to be a pure רשות עובד כוכבים. The first reading attaches the leniency to a person, the second to a space.
The Shach decides for (a), and says it in eight words « והישראל דר בחצר. דחשיב כמו שומר דסגי ביוצא ונכנס כן כתבו הפוסקים » (ש״ך יו״ד קל״א ס״ק ב) He is counted as a guard; and from then on the general rule of the guard applies to him — דסגי ביוצא ונכנס.
Nafka mina between (a) and (b) The Jewish neighbour goes away for a month and announces his departure. On (b) the place remains what it was and nothing changes. On (a) he is a guard — and the Shach then applies to the guard the rule of siman 129: « ויוצא ונכנס. אע״פ ששהה זמן רב אם לא הודיעו שמפליג » (ש״ך יו״ד קל״א ס״ק ט). What breaks the leniency is not the length of the absence, it is the announcement.

4. דר באותה העיר — one Jew, or many?

The Mehaber writes אם דר ישראל באותה העיר — in the singular. Does a single Jew really suffice to make a city a watched city?

What the machloket reveals It is not a quarrel about numbers: it bears on the nature of the risk. For the Beit Yosef what deters is the existence of a possible witness; for the Rashba, its probability. In other words: is מירתת a legal state or a calculation? And the very same question returns two lines later, in the clause about peddlers — where the Mehaber sides with the calculation, since he requires that the city not be closed.
The Shach’s ruling, in two steps « ויש להחמיר במקום שאין הפסד אבל בהנאה נראה דשרי אף שלא במקום הפסד » (ש״ך יו״ד קל״א ס״ק ג) He holds the Rashba weighty enough to forbid drinking outside a case of loss — and not weighty enough to forbid benefit. This is the decision structure of the whole siman: two thresholds, not one.
A kashya from the seif itself If Jews living in the city suffice, why does the Mehaber then write that, if the room does not open onto the street, it is forbidden even though a Jew lives in the city?
Teirutz Because the two conditions are cumulative and do not measure the same thing: the city supplies possible witnesses, the open door supplies the path by which they will see. Remove one, and the other is of no further use. The Shach notes it in a word: « אף על פי שישראל דר בעיר. ואפילו הרבה ישראלים » (ש״ך יו״ד קל״א ס״ק ח) Even many of them do not redeem a closed door.

5. פתח פתוח לרשות הרבים — the door as a measuring instrument

Rav Yosef’s three equivalents « אָמַר רַב יוֹסֵף: וְחַלּוֹן כִּרְשׁוּת הָרַבִּים דָּמֵי, וְאַשְׁפָּה כִּרְשׁוּת הָרַבִּים דָּמֵי, וְדִיקְלָא כִּרְשׁוּת הָרַבִּים דָּמֵי » (עבודה זרה ס״א ע״א) Three things with no common property, except that each draws someone at a moment that cannot be foreseen.
The Tur explains the palm tree — and goes beyond the obvious reason « לא מיבעיא אם יש בו פירות שירא הנכרי שמא יעלה עליו ללקט פירותיו » (טור יו״ד קל״א) The Tur adds that a palm tree with no fruit has the same effect, since one may climb it for some other use. The Gemara sees in this a dispute between Rav Acha and Ravina, and the ruling follows the lenient view.
The Rambam puts the open door beside the public domain itself « הָיָה יַיִן זֶה הַטָּהוֹר שֶׁל עַכּוּ״ם מֻנָּח בִּרְשׁוּת הָרַבִּים אוֹ בְּבַיִת הַפָּתוּחַ לִרְשׁוּת הָרַבִּים וְיִשְׂרָאֵל הוֹלְכִים וְשָׁבִים מֻתָּר » רמב״ם הלכות מאכלות אסורות פרק י״ג הלכה ה Note how the halakha ends: and Jews come and go. For the Rambam too, the door counts only for the passage.

The Taz widens the reach of the window, and gives the reason One might have thought, as in siman 128, that only what is visible through the opening is protected. The Taz refuses the parallel: « אבל הכא אמרינן חזקה לא נכנס כלל דמרתת שמא יראוהו נכנס ויוצא או יראוהו מן הדרך כניסתו ויציאתו » (ט״ז יו״ד קל״א ס״ק ד) There, the non-Jew had certainly gone in; here he does not go in at all — for what would be seen is not his act but his entering. So the whole room is protected, and not merely the line of sight.
Nafka mina A cellar of which only part lies in the line of the door. On the reasoning of siman 128, only that part would be covered. On the Taz’s reasoning here, the whole room is. And the Rama’s gloss adds the only boundary the siman knows: the window counts only by day.

6. רשות עובד כוכבים אחר — do we worry about גומלין?

Depositing the wine with another non-Jew: is that leaving the owner’s domain, or is it merely a move within the same world? The Gemara hesitates, and the machloket of Rishonim that comes out of it puts the Rambam on one side and almost everyone else on the other.

The mishnah, and two ways of reading Rabbi Shimon ben Elazar The Gemara asks whether his phrase רשות גוים אחת היא comes to be lenient or stringent. On the lenient reading, it is the Tanna Kamma who is stringent and Rabbi Shimon who is lenient: « רַבִּי שִׁמְעוֹן בֶּן אֶלְעָזָר אוֹמֵר: בַּמֶּה דְּבָרִים אֲמוּרִים? בִּרְשׁוּתוֹ, אֲבָל בִּרְשׁוּת גּוֹי אַחֵר — מוּתָּר, וְלָא חָיְישִׁינַן לְגוֹמְלִין » (עבודה זרה ס״א ע״ב) And a baraita comes to support the opposite reading — the one in which Rabbi Shimon is the stringent voice: « אָמַר רַבִּי שִׁמְעוֹן בֶּן אֶלְעָזָר: כׇּל רְשׁוּת גּוֹיִם אַחַת הִיא מִפְּנֵי הָרַמָּאִין » (עבודה זרה ס״א ע״ב)

What really separates the two camps For the Rambam, the unity of non-Jewish domains is a presumption of solidarity: they will do one another favours. For the Rosh and the Rashba, the solidarity must be established, not presumed — hence the Mehaber’s criterion, which forbids only where the depositary is in fact subject to the owner. It is again the same alternative as in the previous section: a legal state against a calculation.
The case that supplies the rule: Rava on the house of Parzak Rufila « אֲמַר לְהוּ רָבָא: אַדְּרַבָּה, אֲפִילּוּ לְמַאן דְּאָמַר לָא חָיְישִׁינַן לְגוֹמְלִין, הָנֵי מִילֵּי הֵיכָא דְּלָא מִירְתַת מִינֵּיהּ, אֲבָל הָכָא, כֵּיוָן דְּמִירְתַת מִינֵּיהּ — מְחַפֵּי עֲלֵיהּ זְכוּתָא » (עבודה זרה ס״א ע״ב) This is the exact foundation of the Mehaber’s כפוף תחת יד: it is not kinship or friendship that ruins the deposit, it is dependence.

7. חותם בתוך חותם — the central machloket of the siman

The double seal is, in the whole block, the universal solution. Here it meets its one failure — and a long chain of Rishonim and Acharonim asks whether that failure is really necessary.

The Tur sets the two camps face to face « ובספר התרומות התירו בחותם תוך חותם » (טור יו״ד קל״א) And he adds at once that his own father, the Rosh, forbade it in his pesakim.
The Rashba reports the opposing consensus, and the Beit Yosef follows it « וכתב הרשב״א בתשובה שכך היא הסכמת הגאונים והר״מ והרא״ש שיינו של נכרי שטיהרו ישראל ונתנו בחצר שהנכרי דר שם אין לו תקנה ואפי׳ בכמה חותמות אלא כשישראל יושב ומשמר » (בית יוסף יו״ד קל״א) ואפי׳ בכמה חותמות — not two, but as many as you like. This is the point at which the siman’s thesis becomes irreversible.

The Shach explains the Baal haTerumot’s logic — and it is coherent « אפילו ביינו של עובד כוכבים ברשותו של עובד כוכבים שדר שם ואין הישראל דר שם ועיר כולה עובדי כוכבים משום דחב״ח הוי כשומר שם » (ש״ך יו״ד קל״א ס״ק י״ד) The opposing view is therefore not absurd: it holds that the double seal is a guard. What separates it from the Rosh is not an assessment of facts but a definition — is a seal a substitute for presence, or only its auxiliary?
The Bach’s kashya, reported by the Shach Since nowadays any contact by a non-Jew, even deliberate, forbids only drinking (siman 123), and here there is merely a doubt of contact — why not rely on the Sefer haTerumot as far as permitting drinking?
The Shach’s teirutz, in two steps He answers first that the leniency of siman 124 applies only to what is permitted by strict law, whereas here one permits only by relying on a minority view — two leniencies do not add up. Then he partly concedes: « ומכל מקום בהפסד מרובה אפשר דיש להתיר בשתיה וכדברי הב״ח » (ש״ך יו״ד קל״א ס״ק ט״ו) And he adds, for all three simanim at once, the remark that shifts the whole debate: « ודע דבכל הסימן וכן בכל סימן קכ״ט וק״ל דחיישינן שמא נגע בו עובד כוכבים היינו דוקא במקום דאיכא למיחש שמא נגע בו לשתות או להחליף או לשום הנאה אחרת » (ש״ך יו״ד קל״א ס״ק ט״ו)
The Taz, by contrast, tightens the Rama’s leniency rather than widening it He recalls that the Ran permitted only in a specific case — a non-Jew who could compel the Jew to take the wine — and in order to avert a financial loss. Then he expressly refuses the further step: « ומו״ח ז״ל כתב דלדידן אפי׳ בשתייה מותר כיון דספק מגע הוא ולא נראה להקל בזה » (ט״ז יו״ד קל״א ס״ק ה) « רק לענין לקנותו לכתחלה להרויח בו מותר כמו שכתבתי כנלע״ד פשוט » (ט״ז יו״ד קל״א ס״ק ה)
Practical nafka mina A lot left unsupervised in a cellar closed with two seals, in a country with no Jewish community. According to the Rama one sells it and the money is good; one does not drink it. According to the Bach, and where the loss is substantial according to the Shach, one may go as far as drinking it. According to the Taz, no — but one may buy it outright in order to resell it at a profit.

Seif 2 permits what seif 1 forbade: wine alone, for several days, in non-Jewish hands. The difference is neither the closure nor the duration — it is in the carrier’s accounts.

Rabbenu Tam’s reason, in the Tur « אבל כשמוליך יין למרחוק בטורח גדול והוצאה מרובה וגם קנה אותו חש לטרחו ולהוצאתו ולא יזייף » (טור יו״ד קל״א) Three cumulative factors: the labour, the expense, and the fact of having bought. The Taz takes them up one by one: « בטור בשם ר״ת נתן טעם לזה שלא החמירו במטהר יינו של עובד כוכבים אלא בגדל בכרמו שלא טרח בו כ״כ ולא הוציא עליו הוצאות » (ט״ז יו״ד קל״א ס״ק ו)
Chakira: by what is מירתת measured? (a) By ownership — the wine is his, so he does not fear. (b) By investment — by what he would lose if the wine became unsaleable. Seif 1 seems to say (a); seif 2 clearly says (b), since there too the wine is theirs, and yet it is permitted. The right reading unifies them: ownership was only an index of zero investment.
The Bach’s kashya, reported by the Shach If the reason is the investment, one seal should suffice here as elsewhere. Why does the Mehaber expressly write חותם בתוך חותם?
Teirutz « וכתב הב״ח דאע״ג דמדינא להט״ו אין חילוק בין חותם א׳ לב׳ חותמות מכל מקום לא שרי הכא אלא בחב״ח כדמשמע בתוספות » (ש״ך יו״ד קל״א ס״ק ט״ז) The Bach grants the principle and nevertheless holds to the letter: the leniency of seif 2 is an exceptional one, and it was granted in the exact terms in which it was formulated.

The last gloss of the siman raises a textual problem, and the two great commentators answer it by opposite methods: the Taz emends the text, the Shach saves it. It is the finest page of method in the siman.

The difficulty The Rama writes that a Jew and a non-Jew made kosher, in partnership, the wine of another non-Jew. But the Rashba’s responsum from which he draws the case speaks of wine belonging jointly to the Jew and the non-Jew, deposited with a third party. And if the wine belongs to a third party, the case is more stringent than ordinary מטהר, not more lenient.

The underlying reason, on which both agree « דהכא שאני דכיון דאית לישראל שותפות בעובד כוכבים מרתת ונתפס עליו כגנב » (ש״ך יו״ד קל״א ס״ק י״ח) Once the Jew has a share, the non-Jewish partner becomes again someone who could be accused. It is once more, in a third form, Rava’s criterion.
And a remark of the Shach on the key He observes that the Rama requires the key in the Jew’s hand only in order to obtain a double seal; but on our practice, where one seal suffices after the fact, the key is needed only to permit the matter from the outset. The gloss therefore reads as an instruction lechatchila, not as a condition of validity.

The phrase that folds it all together, and it belongs to an Acharon « דהכא אין הטעם משום דינא דקנין כמו במכירת חמץ ובכור והיתר שביתת בהמה דהכא הכל תליא במרתת » (פתחי תשובה יו״ד קל״א ס״ק א) The Pitchei Teshuva here rules out the most tempting error: to think the question would be settled by the law of acquisition, as with the sale of chametz or of a bekhor. No: here, everything depends on the fear.
And a modern consequence, reported by the same The Chatam Sofer, cited at s.k. 2, writes that one who comes back and sees his own seal and recognises it by a distinctive mark escapes the ordinary stringency of מטהר: « שכ׳ דהיכא דחוזר ורואה חותמו ומכירו בט״ע שהוא הוא לית ביה חומרת מטהר יינו של עובדי כוכבים דעלמא » (פתחי תשובה יו״ד קל״א ס״ק ב) That fits the siman’s whole thesis: what was missing was not the closure but the eye — and a seal one comes back to verify is a deferred eye.
