1. שורש הסימן — קנס, דמי היזק, ורוצה בקיומו

This siman does not say which wine is forbidden. It starts from wine that already is — and that is still worth money. Its question is one of the circulation of value: what may still pass from forbidden wine into a Jew's hand, and on what account? Seven seifim, and they form a ladder: at each rung the Jew stands further from the wine, and we ask whether the distance is enough.
The line of Gemara on which the whole siman rests. The Gemara proposes two foundations and refutes them — extending the ban on benefit, then the idol's תופס דמיו — keeping only a third: « קְנָס הוּא שֶׁקָּנְסוּ חֲכָמִים בַּחֲמָרִין וּבְיֵין נֶסֶךְ » (עבודה זרה ס״ב ע״א) So it is not the money that is tainted: a man is being penalised. Three practical consequences follow at once — the penalty is personal, it presupposes an act deserving penalty, and it is measured by the harm it prevents.
The Rambam sets out the exception. The general rule is that the price of something forbidden for benefit is permitted; wine is the exception, and it is a rabbinic stringency laid over a biblical one.

The Shakh names the reason exactly where the consequence appears. Where the Meḥaber writes that the money is forbidden to the owner of the wine — and to him alone — the Shakh supplies the word:
« משום קנס כדאית׳ ברבינו ירוחם שהביא הב״י וכן באשר״י שם » — ש״ך יו״ד קל״ב ס״ק ד

How to read this level. Every statement here is anchored either in the text of the Shulḥan Arukh and its nossei kelim (Shakh, Taz, Beer Hetev), or in a named and verifiable source (Gemara Avodah Zarah, Tosafot, Rambam, Tur, Beit Yosef). On Yoreh De'ah there is no Mishnah Berurah (which comments only on Oraḥ Ḥayyim) and no Shulḥan Arukh HaRav — the Admour HaZaken did not write Yoreh De'ah. The Pitḥei Teshuvah does not comment on this siman: there is nothing to report from it. The Arukh HaShulḥan is not cited here: its text on this siman is not accessible to us, and one does not cite what one cannot check. The Beer Hetev, on the other hand, comments on the siman in twenty-one notes, and rules in two places: we shall hear him. Where the question outgrows the siman, this level says so and stops: halakhah lema'asseh goes through your Rav.

2. פסק המחבר והרמ״א — the map of the seven seifim

Siman 132 has seven seifim — the count announced in the heading (ובו ז׳ סעיפים) and the real count of the text. The Rama intervenes in four of them, and always for the same reason. Here is the overall map as it emerges from the text itself.

3the barrel received as wagesSo long as they have not accepted it as wages they may ask for its value; once accepted it is forbidden. Rama: see siman 123 — nowadays it is permitted even after acceptance.
4feeding non-Jewish workersHe must not serve them yayin nesekh. An open account at a tavern is permitted; a dinar advanced and frozen until performance is forbidden; a dinar given to be spent freely is permitted. Rama: one who hosts a non-Jew may send his servant to buy for them.
5the king's share“Appease the king for me” is permitted, even though the non-Jew pays in yayin nesekh and is reimbursed; “be in my place to give to the king” is forbidden.
6the lord's storehouse“Here are four zuz, enter in my place in the storehouse” is forbidden; “here are four zuz, deliver me from the storehouse” is permitted.
7the recovered debtA non-Jewish debtor who sells on his own and brings the money — permitted. But if he was told beforehand “wait until I sell”, it is forbidden, since the Jew wants the forbidden thing to endure. Rama: יש אומרים that this holds only where he cannot be paid elsewhere; and nowadays there is no need to be strict about stam yeinam.

👈 What to notice in this map

  1. The Rama intervenes in only four seifim — 1, 2, 3 and 7 — and each time with the same gloss. He does not touch seifim 4, 5 and 6, which do not depend on the question of the age: there the wine was never the Jew's.
  2. The Meḥaber does not answer him, and the silence is no oversight: in siman 123 he lays down the opposite without any qualification as to the age, and siman 132 is its working out.
  3. The nossei kelim temper from both sides: the Shakh narrows the reach of the Rama's gloss, and in one place he tightens the Meḥaber's letter (ס״ק י״א). These are two distinct movements and must not be conflated.

3. הנוגע שאסר — what the wrongdoer may pay (seif 1)

« מותר ליקח דמיו מאותו העובד כוכבים שאסרו או אותו העובד כוכבים ימכרנו ויתן דמיו לישראל » — שולחן ערוך יו״ד קל״ב:א
Why this is permitted, though the wine is forbidden for benefit. Because it is not a sale. The Jew hands over nothing: he claims what was destroyed. The Taz puts the scene into words, and his sentence must be read to the end — the sum claimed is that of kosher wine, that is, the value that existed before the mishap.

Two extensions, and they are practical. (1) Even where the non-Jew refuses to pay until he has the wine — which looks in every way like barter — it is still compensation. (2) Even where he acted unwittingly and would owe nothing at civil law, he caused the loss, and that suffices.

The limit, and it is decisive in practice. The Beit Yosef wondered that seif 2 forbids the money of wine spoiled during a sale, while the opening of the siman permits taking money from the same non-Jew; he left the question open. The Shakh answers, and his answer draws the line: once the two were already engaged in a sale, the payment is booked against the price and not against the damage.

4. מכר בהקפה — the money of a sale, and to whom it is permitted (seif 1)

« אם נתן לו המעות קודם שיתן לו הישראל היין המעות אסורים בהנאה … יש מי שאומר שאף על פי שלבעל היין שמכרו אסורים בהנאה לאחרים מותרים » — שולחן ערוך יו״ד קל״ב:א
Two orders, two rulings. Paid in advance, the payment is the price of forbidden wine and the ban reaches everyone; the Taz says so plainly. Delivered first, meshikhah has already transferred ownership, and what is handed over afterwards no longer attaches to the forbidden thing.

But the Meḥaber writes יש מי שאומר, and that is not nothing. The Shakh explains why — Rabbenu Yeruḥam had reported a contrary view — then lists the camps: the Rosh, the Mordechai and Tosafot in the Ri's name permit; the Ramban and the Ran (and Rashi, per the Ran) forbid; Rabbenu Yeruḥam did not decide. And he closes with a measure rather than a camp.

The Beer Hetev copies the Shakh and sharpens the wording — he specifies that even the permission to others is reserved to a case of great loss:

👈 And here is why this remains a live question

One might object that the debate is academic, since nowadays stam yeinam is not forbidden for benefit. The Shakh anticipated the objection, and his answer shifts the subject: « ואע״ג דלא נ״מ ביי״נ דקי״ל דשרי בהנאה בזמן הזה מכל מקום נ״מ למכר עבודת כוכבים ומשמשיה » (ש״ך יו״ד קל״ב ס״ק ג) Everything said here therefore stands in full force for objects of worship and their accessories — upon which no leniency of the age bears at all. It is the one place in the siman where the Rama's gloss changes nothing whatever.

The Taz, for his part, disputes where the יש מי שאומר belongs. He shows that the permission to others is a תלמוד ערוך — the Gemara about shevi'it — and that it is the seller's prohibition that is inferred, from orlah.

5. המוכר יינו — פסק ומדד and the vessel procedure (seif 2)

« פסק עד שלא משך דמיו מותרים שמשפסק סמכה דעתו ומשמשך קנה ויין נסך אינו נעשה עד שיגע בו נמצא בשעת מכירה היה מותר » — שולחן ערוך יו״ד קל״ב:ב
The mechanism, in three links. פסק settles the will; משך transfers ownership; and the wine is caught only on contact. Result: at the moment the sale took effect the wine was still permitted, and the money is not that of a forbidden thing. This is the Rambam's language, which the Meḥaber copies.

The most important practical disagreement in the seif. If the Jew watched the wine throughout and knows for certain there was no contact, is the money saved? The Beit Yosef says yes; the Darkhei Moshe, the Derishah and the Baḥ say no — because a Jew does not guard wine that is no longer his, and that is a fact of structure, not of persons. The Shakh reports both, in that order.

The procedure where one cannot rely on the natural order. If one pours into a non-Jew's vessel bearing wine residue, or into a Jewish vessel he is holding, one must take payment before measuring. The Taz gives the technical reason: for a non-Jew money is a full mode of acquisition.

The Tur turns this into instructions, and his gift clause is no flourish: it guarantees that handing over the money actually transfers, without depending on delivery.

And if it has already been done? The Rama releases the whole batch after the fact, save the value of the residue; and the Shakh rejects the objection that would see here a deliberate nullification of a prohibition.

A refinement that often recurs in practice. A lifting done in order to acquire settles everything in advance; a lifting done in order to measure acquires nothing.

The Beer Hetev resolves the difficulty the Shakh left open. The Shakh had wondered how acquisition can take place on entering the vessel's airspace while the non-Jew is jolting it. The Beer Hetev answers: so long as the wine is still in the air, the acquisition is already complete and the jolting has nothing to seize.

6. חבית בשכרן — the barrel received as wages (seif 3)

« אם עד שלא קבלוה בשכרם מותר שיאמרו לו עד שאתה שולח לנו חבית זו תהא שלך ותתן לנו דמים כנגדה … ואם משקבלוה בשכרם אסור » — שולחן ערוך יו״ד קל״ב:ג
Everything hangs on one sentence, and on the moment it is spoken. The workmen do not say “take this barrel back” — taking back presupposes having had. They say: let it remain yours, and give us its value instead. The point is to prevent the barrel from having been theirs for even a second, for what one owns and then claims the price of, one is selling.

And the margin is wider than one supposes. The mishnah said משנכנסה לרשותן, which one would readily read as a physical fact — the barrel arrived at their place, and that settles it. The Shakh cuts this short: a courtyard does not acquire against its owner's will. Delivery alone does nothing; acceptance does everything.

The Rama's gloss, and the bound the Shakh sets on it — reproduced word for word by the Beer Hetev:

7. פועלים ודינר — feeding non-Jewish workers (seif 4)

« מי ששכר פועלים עובדי כוכבים ופסק להם מזונות אסור להשקותם יין נסך ואם אמר להם צאו ושתו מחנוני פלוני ואני פורע אם לא הקדים לו דינר מותר אע״פ שייחד לו דינר והוא בעין ביד בעל הבית אבל אם הקדים לו דינר אסור » — שולחן ערוך יו״ד קל״ב:ד
The liberating principle, and it comes from the Gemara. A personal obligation — even an enforceable one, even towards a shopkeeper who extends credit — forbids nothing so long as it fastens on no determinate asset. So Rava establishes, and so the Rambam copies.

What changes everything: the advanced dinar. Rav Pappa isolates the case, and the Meḥaber gives its exact shape — an earmarked deposit, frozen until performance.

And here the ruling divides. The Meḥaber follows the Rashba: apart from an earmarked deposit, a dinar given to be spent freely creates only an obligation, and the atnan analogy shows it. The Tur objects: from the moment of the advance the wine belongs to the Jew at the keeper's, who distributes it on his behalf. The Shakh rules with the Tur by dismantling the analogy — at the moment of the act the lamb was already outside the giver's domain, which is not the case here.

The Beer Hetev rules explicitly, and that is rare: he writes that the Tur's words are the main view.

The Rama's gloss, its reason and its limit. The Rama permits sending one's servant to buy for non-Jewish guests; the Taz supplies the Kol Bo's reason; the Shakh narrows the opening to a servant, and notes that the same errand asked of another Jew falls back under רוצה בקיומו; and the Beit Yosef himself hesitates, since a servant's hand is his master's.

Two seifim, one rule: the wording names the actor. The source is a single line of Rav, immediately set against a baraita that seems to say the opposite — and the reconciliation is purely verbal.

The Shakh locks both sides, and these are his two most useful notes in practice. On one side: even if the Jew could not possibly discharge the levy other than in wine, “appease him” remains permitted, because he did not say to give wine. On the other: even if he could have discharged it otherwise, “be in my place” is forbidden by all.

The strict view the Meḥaber did not adopt, and which one should know. For a יש אומרים in the Tur the window closes once the administration enters the quota in the Jew's name: after that no formula saves anything. Both the Shakh and the Beer Hetev report it.

9. גביית חוב ורוצה בקיומו — the creditor who waits (seif 7)

« ישראל שהיה נושה בעובד כוכבים מנה והלך ומכר אלילים ויין נסך והביא לו דמיהם הרי זה מותר ואם אמר לו קודם שימכור המתן לי עד שאמכור אלילים או יין נסך שיש לי ואביא לך אע״פ שהוא סתם יינם ומכר והביא לו הרי זה אסור מפני שהישראל רוצה בקיומו כדי שיפרע ממנו חובו » — שולחן ערוך יו״ד קל״ב:ז
The Jew does nothing — and that is the point. He does not sell, buy or instruct. He waits. The ground of the prohibition is therefore not an act but a disposition: רוצה בקיומו. The baraita and its explanation take two lines.

Two Rishonim limit the baraita, and they are not measuring the same thing. For the Ri the ban catches a benefit: it lapses once the creditor can be paid elsewhere. For the Raavad it catches a contribution: what counts is the power to press the debtor and the choice not to. The Rama adopted the first, as a יש אומרים.

The yesod that explains why the whole siman touches only the Jew. Tosafot ask why money in a non-Jew's hand is not itself caught, and answer from a verse: the rule that makes an idol “seize its price” is addressed to Israel, not to the Bnei Noaḥ. Money is therefore never tainted in itself; it is judged by what a Jewish hand did with it.

The symmetrical case, and the dispute among Aḥaronim it carries. When does the money of an object of worship remain forbidden in the non-Jew's hand? The Taz, in the Tur's name, restricts it to where the sale funds the purchase of such objects — and he concedes that this departs from the general rule of הזמנה לאו מלתא. The Baḥ would abstain even in doubt; the Derishah distinguishes wine from idols. The Shakh and the Beer Hetev report both without deciding.

10. בזמן הזה — where the line runs between the two psikot

Here siman 132 becomes a question of ruling tradition, and it must be stated precisely. The disagreement is not about what the siman teaches — the seven seifim are accepted on both sides — but about the premise that keeps them live. That premise is not laid down here: it is laid down in siman 123, and the Rama there refers expressly to our siman. The two texts must therefore be read together.

The Meḥaber, in siman 123, lays down the premise with no qualification as to the age.

What follows for siman 132: on this ruling the seven seifim are live law. The seller must take payment before measuring; the workman loses his barrel once he has accepted it; the creditor who said “wait” may not receive. None of this is reduced to a case of loss, because the question of loss does not arise: the ban on benefit stands.
The Rama, in the same place, reports the contrary view — and reports it as a יש אומרים.

But the Rama himself sets the boundary in the next sentence — and it is the sentence most often skipped. He distinguishes rescuing a loss from trading for gain, which is forbidden lekhatḥilah; then he adds that some are lenient even in that, and that it is better to be strict. And it is exactly at the end of that sentence that he refers to siman 132.

In our siman the same gloss is planted four times — in seifim 1, 2, 3 and 7 — and the broadest of the four is the one in seif 2, which invokes custom as well:

And it is on that very sentence that the Shakh sets two bounds. The first is temporal — lekhatḥilah one must take care; the second is substantive — where there is no loss one does not permit, even nowadays. The Beer Hetev copies it word for word.

👈 Where exactly the line runs — four statements and no more

  1. On the facts there is no disagreement. All agree that wine actually poured in libation is forbidden for benefit, and that the question concerns only stam yeinam and contact.
  2. The Meḥaber's ruling knows no clause about the age in this chapter: siman 132 applies there as written, and the unit of measure is benefit.
  3. The Rama's ruling does know such a clause, but the Rama himself bounds it — trading for gain remains forbidden lekhatḥilah, and he adds וטוב להחמיר — and it is bounded again by the Shakh and the Beer Hetev: take care lekhatḥilah, and without loss one does not permit. The unit of measure becomes loss.
  4. And there remains a field the clause does not touch at all: objects of worship and their accessories, as the Shakh writes expressly in ס״ק ג. There the two traditions meet again.

This level does not decide between them, and it cannot. The question is not who is right: it is a question of belonging — the Meḥaber for Sephardi communities, the Rama for Ashkenazi ones — and of how your Rav reads the Shakh's two bounds. What is settled without him is only the facts: is this wine actually poured in libation, or stam yeinam? A loss already incurred, or a hoped-for gain? An act still to be done, or one already done? Gather those three and the question becomes askable. The answer is given at your Rav's.

11. מקרים מודרניים — siman 132 today

The five tools of the siman. (1) Where the money comes from — price, compensation, debt, release (seifim 1 and 3). (2) The order of the kinyanim — what came before what (seif 2). (3) Acceptance — was the thing mine, even for an instant (seif 3). (4) Earmarking — is the money attached to a specific asset (seif 4). (5) The wording — what exactly did I say (seifim 5, 6 and 7). What is not in this siman: what makes wine forbidden (simanim 123-131), and the status of cooked wine (siman 123).

Lema'asseh. Before asking, gather the facts the siman requires, in this order: which wine (actually poured in libation, or stam yeinam); where the money comes from (price, compensation, debt, release); what came before what (price, pull, payment, measuring, acceptance); what was said, word for word; is there a loss, and what kind; is it done or still to be done. With these six the question becomes askable. Without them no table can answer — and with them, it is your Rav who answers.

⚖ What to take away from this siman

  1. The siman's prohibition is a קנס, and the Gemara says so after rejecting two other explanations. It is therefore personal, it presupposes an act deserving penalty, and it is measured by the harm it prevents.
  2. Compensation is not a price — even where the wrongdoer owed nothing at law. But if a sale was already under way over that wine, Shakh ס״ק י״א reverses the classification.
  3. In a sale the order decides. Price before the pull; money before measuring; goods before payment. And the Tur's procedure exists precisely for cases where the natural order will not do.
  4. What one never owned one cannot sell, and an unaccepted delivery acquires nothing — a courtyard does not acquire against its owner's will.
  5. A personal obligation forbids nothing; an earmarking does. That is the whole difference between the open account and the frozen dinar. On the free dinar the text and its commentators part ways, and the Beer Hetev rules with the Tur.
  6. The wording is part of the act, and material possibility makes no difference: the Shakh locks it both ways, in ס״ק ל״ד and ל״ה.
  7. The Rama's gloss changes the unit of measure, not the ladder. The Meḥaber measures in benefit, the Rama and the Shakh in loss — and the Shakh sets two bounds that must not be lost: take care lekhatḥilah, and without loss one does not permit.
  8. And there remains ground the leniency of the age does not touch at all: objects of worship and their accessories (ש״ך ס״ק ג).
  9. And for any real case — a stock, an indemnity, an advance, a debt — halakhah lema'asseh goes through your Rav: consult your Rav.
