1. שורש הסימן — קנס, and what it changes in practice

This siman does not say which wine is forbidden. It begins with wine that already is, and asks what a Jew may earn around it — by hiring himself out, renting his beast, his boat or his cellar, carrying another man’s barrels, serving, interpreting, guarding. Seven seifim, and they form a descent: what the Jew receives grows thinner at each step, and the prohibition holds — until the seventh, which overturns everything.
The line of Gemara that grounds the siman. The Gemara proposes two grounds and refutes them — the extension of the benefit prohibition, then the idol’s תופס דמיו — retaining only a third:
« אָמַר רַבִּי אֲבָהוּ אָמַר רַבִּי יוֹחָנָן: קְנָס הוּא שֶׁקָּנְסוּ חֲכָמִים בַּחֲמָרִין וּבְיֵין נֶסֶךְ » (עבודה זרה ס״ב ע״א)
So it is not the money that is bad: it is a man who is penalised. Three practical consequences follow at once. (א) The penalty is personal. (ב) It reaches assets that in themselves never become forbidden — land, an animal. (ג) It can be lightened, and the Rama lightens it for his age: one does not lighten a status, one lightens a penalty.
The Rambam sets out the exception. The rule is that the price of something forbidden in benefit is permitted; wine is excepted, and a rabbinic stringency added stam yeinam to the exception.

And the Shach immediately dismisses the reading that would make the sabbatical year the model — and the stake is not theoretical: it is from there that the Bach derived a permission.

How to read this level. Every statement is anchored either in the text of the Shulchan Arukh and its nossei kelim (Shach, Taz, Baer Hetev, Pitchei Teshuva), or in a named and verifiable source (Gemara Avodah Zarah, Tosafot, Rambam, Tur, Beit Yosef). On Yoreh De'ah there is no Mishnah Berurah (which comments only on Orach Chaim) and no Shulchan Arukh HaRav — the Admour HaZaken did not write Yoreh De'ah. The Pitchei Teshuva comments on this siman only once, on the word “pouring” in seif 5: he will be heard there, and nowhere else. The Arukh HaShulchan is not cited: his text on this siman is not accessible to us, and one does not cite what one cannot verify. The Baer Hetev, by contrast, comments on the siman in ten ס״ק and rules in two places — he will be heard. Where a question runs beyond the siman, this level says so and stops: halakha lema'asse goes through your Rav.

שלא להשתכר ביין נסך ולא לעשות ממנו סחורה. ובו ז׳ סעיפים:

The Mehaber’s list is not decorative: it covers personal labour, the beast, the vehicle and the premises. The last — מרתיפו — weighs most today, and it is also the one the Taz returns to in order to say that the Rama’s leniency does not reach it.

What the Shach adds, and it governs practice. The question arises not only once the wage is pocketed: it arises before accepting. And this holds even for stam yeinam, despite the Rama’s gloss.

Tosafot had already written it on the sugya itself: the Gemara’s question concerned only the bedi’eved.
« לכתחלה ודאי אסור להשתכר בסתם יינם כדאמרינן לעיל… דלא שרי לדרוך עם העובד כוכבים בגת אי לא ציירי לידיה אלא מיבעיא ליה אם השכר מותר בדיעבד או לא » (תוספות עבודה זרה ס״ב ע״ב ד״ה שכרו לסתם יינן)
למעשה Before accepting work, a rental or storage whose object is forbidden wine, the question is not “what will I do with it afterwards?” but “may I take this on?”. For actual yayin nesekh the siman’s answer is no. For stam yeinam the Rama lightens the consequence, but the Shach maintains the limit at the outset. For a real case, שאל את רבך.

4. מה עושים במעות ובפירות — the fate of what was received (seif 1)

« ואם נטל ממנו מעות בשכרו שוחק וזורה לרוח או מטיל לים » (שו״ע יו״ד קל״ג:א)
« נתן לו פירות יוליכם לים המלח או ישרפם ויקבור העפר בבית הקברות » (שו״ע יו״ד קל״ג:א)
Why two different places. The Taz gives the reason, and it is purely practical: what remains identifiable can be found again.
« פי׳ שוחק ומטיל לים וסתם ים משמע כל ים ואין צריכין ים המלח כמו דצריך גבי פירות לפי שהפירות הם בעין ובסתם ים הולכין ספינות ושמא ימצאם אחד ויהנה מהם » (ט״ז יו״ד קל״ג ס״ק א)
The Rambam is briefer, and the Beit Yosef notes it: he prescribes only the Dead Sea for money, and does not mention a cemetery for the ash.

The reason for the cemetery, and the two schools. The Beit Yosef: nobody sows there. Tosafot: nobody digs there for fertiliser. The Taz plainly prefers the second, and says so without hedging.

למעשה The criterion common to both schools is the risk that a third party still benefits. A controlled landfill from which nobody retrieves anything satisfies both; an open-air dump satisfies neither. For a real stock, the question of place therefore comes before the question of method — שאל את רבך.

The criterion is contractual, and the Gemara frames it as a question of civil law. Could the renter demand a discount if he gave up placing his flask? No — so the flask is not in the price.

למעשה The question to ask of a real contract is simple: would the price drop if the wine were not on board? If yes, the wine is in the contract and we are in seif 1. If no, we are in seif 2. Neither volume, nor value, nor contact decides — the invoice does.

The most disputed point of psak in the siman. The Tur sets out the two camps: the Raavad, who allows a remedy — taking the value of the forbidden barrel to the Dead Sea — and the Ramban, who refuses it because a lump contract does not divide.

The Beit Yosef counts the votes and concludes — and his final word, והכי נקטינן, is a decision, not a report.

The Shach adopts and seals it, giving two distinct reasons — the structure of the lump contract, and the fact that the forbidden barrel may have been the cause of the hiring.

The Taz nonetheless reopens the file, first setting aside two readings — the Perisha’s in the Maharshal’s name, and the Bach’s — before giving his own.

The Taz’s position, exactly. The Raavad’s remedy stands, but it can operate only after the wage has been received: before that, everything received afterwards will be received in the forbidden state, and what one had taken to the Dead Sea would change nothing.
The line. The Shach has the Beit Yosef and the majority of decisors with him, and the Baer Hetev reports him as such in the siman: for a lump contract there is no remedy. The Taz is a serious and argued position, but a minority one and strictly bounded. One does not rely on it on one’s own initiative — ולמעשה שאל את רבך.

For the second wording, by contrast, no remedy is needed: it suffices to leave the corresponding share with the non-Jew and take the rest.

7. פחות משוה פרוטה — the threshold and its lekhatchilah limit (seif 3)

« שאם היה פחות משוה פרוטה מותר בדיעבד » (שו״ע יו״ד קל״ג:ג)
The threshold comes from the Rashba, cited by the Tur, and his proof is drawn from an entirely different passage — the last hammer-blow that completes an idol.
« וכתב הרשב״א דווקא שיש ביניהן שוה פרוטה משכר יי״נ אבל פחות משוה פרוטה כגון ששכרו להעביר מאה חביות בחמשים פרוטות והיתה אחת מהן של יי״נ מותר » (טור יו״ד קל״ג)
The Shach contests the proof — without withdrawing the threshold, and that is precisely why it holds only after the fact.

And the lekhatchilah limit is explicit twice: in the Mehaber’s own text, and in the Shach, who extends it below the threshold.

למעשה The threshold is a way out for what has already happened, never a structure to be built. Billing line by line so as to stay under the threshold, or splitting a contract for that reason, is exactly what the Mehaber forbids by ולכתחילה אסור לעשות כן.

Two characterisations, in a single line of the Taz: is gratitude a good that is seized, or is there nothing to seize and the beit din is punishing?

למעשה The practical point is the same on both readings: waiving the wage does not put one outside the siman. A free service done for a supplier, a hand lent “for the relationship,” a free delivery: seif 4 aims at them expressly. What varies between the two readings is the measure of the pledge — and that belongs to the beit din.

And for the crier the Beit Yosef names both reasons at once — the benefit drawn from the wine, and the wish that it survive until it has been cried through the whole town.

The Maharam’s word, cited by the Beit Yosef, and it makes the practical division: pouring yayin nesekh is forbidden; pouring our own wine for them is permitted.

Here, and only here, does the Pitchei Teshuva intervene in the whole siman — on the word “pouring,” to bring the Radbaz: it is proper to be stringent even with stam yeinam. This is where the Rama’s leniency meets its sharpest resistance.

The Taz explains why the Mehaber no longer speaks of gratitude here: the depositor expressly excluded it. Nothing remains but the wish — and it suffices.

And the ground is not benefit. The Ran, in Rashi’s name, cited by the Beit Yosef: a Jew is commanded to abolish idolatry; he therefore cannot want it to survive. That is why the Rama’s gloss, which lightens a penalty, does not touch this seif.

11. ממעט בתיפלה — being paid to destroy (seif 7)

« ישראל ששכרו עובד כוכבים לשבר לו חבית של יין נסך אע״פ שרוצה בקיומם שלא ישתברו מאליהם עד שישברם הוא ויטול שכרם שכרו מותר ותבא עליו ברכה מפני שממעט בתיפלה » (שו״ע יו״ד קל״ג:ז)
The question and the answer are in the Gemara — and the answer is a blessing.

The Beit Yosef gives the definition seif 6 lacked, and it is the one to keep in practice: it is not the wish that is forbidden, but the wish turned toward return or toward sale.
« שאע״פ שהוא רוצה בקיומם שלא ישתברו מאליהם עד שישברם הוא ויטול שכרם כל למעט תיפלה ש״ד כלומר דלא מיתסר רוצה בקיומו אלא כשהוא רוצה בקיומו כדי להשיב לבעליו או עד שימכור אבל רוצה בקיומו עד שיאבדנו הוא בידיו לא חשיב רוצה בקיומו » (בית יוסף יו״ד קל״ג)
למעשה A Jew engaged to destroy a stock of forbidden wine — to pour it out, have it destroyed, organise its disposal — may take the assignment and be paid for it. The siman expressly praises him. Hauling the same stock to a warehouse, by contrast, falls under seif 6.

12. בזמן הזה — the Rama’s gloss and its three limits

« ועיין לעיל סימן קכ״ג דבזמן הזה מקילין לענין היתר הנאה מסתם יינם ולכן אין להחמיר באלו הדינים רק ביין נסך גמור » (רמ״א יו״ד קל״ג:א)
First limit — the Shach: nothing changes at the outset.
« מיהו לכתחלה ודאי אין להשכיר עצמו או ביתו וכליו לסתם יינם וכן כתב ב״י בשם א״ח בשם מהר״מ ע״ש » (ש״ך יו״ד קל״ג ס״ק ד)
Second limit — the Taz, through the Maharam of Padua: only one thing changed with the age.
« בתשובת מהר״ם פדווא״ה סי׳ ע״ו מביא הגהות מרדכי שאסור להשכיר מרתף שלו לעובד כוכבים להשים בו יין נסך ואין חילוק בין בזמן הזה לזמן חכמי התלמוד אלא לענין ליקח יין נסך בחובו ולמזוג לעובד כוכבים יין נסך אסור אבל מיין שלנו מותר למזוג להם » (ט״ז יו״ד קל״ג ס״ק ג)
Third limit — the Pitchei Teshuva, in the Radbaz’s name: on pouring, it is proper to be stringent even with stam yeinam.

The formula to keep: the Rama lightens the consequence, not the undertaking. A benefit already come is no longer treated with the severity of actual yayin nesekh; what one decides to undertake remains held by the siman. And seif 6, whose ground is not a penalty but the obverse of a mitzvah, is not lightened at all.

What this level does not do. It does not say whether a particular contract is a lump contract or a string of contracts, nor whether a given payment is compensation or a price — these are characterisations of fact, and they belong to the Rav who sees the document. It says which questions arise, in what order, and what answers the siman attaches to each. ולמעשה שאל את רבך.
