Siman 132 asked what forbidden wine may be worth; siman 133 asks what the work done around it may be worth. The shift looks slight; it changes the nature of the question, because the wage was never the wine. If it is forbidden nonetheless, a reason is needed — and the Gemara looks for one by discarding two hypotheses before conceding that there is none.
The exception that makes the siman possible The general rule is that the price of something forbidden in benefit is permitted. Wine is excepted — twice: wine actually poured in libation by the severity of idolatry, and stam yeinam by a rabbinic stringency laid on top.

The first ground proposed, and refuted If the wine is forbidden in benefit, its wage should be too. Refuted from orlah and kilei hakerem, likewise forbidden in benefit, whose price nonetheless betroths a woman:

The second ground, and refuted That wine “seizes its price,” like an idol. Refuted from the sabbatical year, which does seize its price and yet leaves the worker’s wage permitted under one of the two wordings:
« אֶלָּא, הוֹאִיל וְתוֹפֵס אֶת דָּמָיו כַּעֲבוֹדָה זָרָה. וַהֲרֵי שְׁבִיעִית דְּתוֹפֶסֶת אֶת דָּמֶיהָ, וּתְנַן: הָאוֹמֵר לְפוֹעֵל ״הֵילָךְ דִּינָר זֶה, לְקוֹט לִי בּוֹ יָרָק הַיּוֹם״ — שְׂכָרוֹ אָסוּר » (עבודה זרה ס״ב ע״א)
What remains — and it is the key to the siman
« אָמַר רַבִּי אֲבָהוּ אָמַר רַבִּי יוֹחָנָן: קְנָס הוּא שֶׁקָּנְסוּ חֲכָמִים בַּחֲמָרִין וּבְיֵין נֶסֶךְ » (עבודה זרה ס״ב ע״א)
A קנס. Not a quality of the money, but a penalty aimed at a man. Rabbi Abbahu in the name of Rabbi Yochanan.
The chakira that runs through the siman Is the prohibition on wages (א) an extension of the benefit prohibition — the wage takes the wine’s place and inherits its status — or (ב) a קנס laid on one who turned his labour into money through the forbidden thing? The first makes the wage a forbidden object; the second makes the man a penalised party. Three features of the siman make sense only on the second: land and beast forbidden in benefit though they never become forbidden, the pledge taken from one who received nothing, and the Rama’s leniency for our age — for one does not lighten a status, one lightens a penalty.
The Shach opens the siman on exactly this point He warns that the comparison with the sabbatical year, which comes to mind from the sugya’s very first line, is precisely the one the Gemara rejects:

The Mehaber gives two treatments and two places: money is ground and scattered, or cast into the sea; produce is taken to the Dead Sea, or burnt and its ash buried. Why two regimes, and what does each accomplish?
The Mehaber’s wording

The Rashba, cited by the Beit Yosef: the wage is treated as the idol is treated

The act, then, is not chosen for its practical efficiency: it is borrowed from the treatment of the idol itself.
The Rambam names only the Dead Sea Where the Rashba prescribes grinding and scattering, the Rambam is content with a definitive removal:
« וְכֵן הַשּׂוֹכֵר אֶת הַחֲמוֹר לְהָבִיא עָלָיו יַיִן אוֹ שֶׁשָּׂכַר סְפִינָה לְהָבִיא בָּהּ יַיִן שְׂכָרָן אָסוּר. אִם מָעוֹת נָתְנוּ לוֹ יוֹלִיכֵן לְיָם הַמֶּלַח. וְאִם נָתְנוּ לוֹ בִּשְׂכָרוֹ כְּסוּת אוֹ כֵּלִים אוֹ פֵּרוֹת הֲרֵי זֶה יִשְׂרֹף אוֹתָן וְיִקְבֹּר הָאֵפֶר כְּדֵי שֶׁלֹּא לֵהָנוֹת בּוֹ » (רמב״ם הלכות מאכלות אסורות פרק י״ג הלכה ט״ז)
and note that he does not require a cemetery for the ash either.
Two gedarim of destruction(א) שחיקה — annihilation. One mimics the idol’s fate: what served the forbidden thing must cease to exist as a thing. The Rashba’s position.
(ב) הרחקה — putting beyond reach. It is enough that nobody can benefit any more. The position the Rambam’s wording suggests.
The nafka mina is read in the place: if it is annihilation, any sea will serve once the coin is ground; if it is removal, one needs a place from which nothing returns.
The Taz decides by the place, and his answer amounts to a definition

The criterion is thus the state of the thing after the act. A ground coin is no longer a coin: an ordinary sea suffices. A fruit stays a fruit: the Dead Sea is needed, from which nothing is fished out. Destruction is no rite; it is a measure of the risk of benefit.
Nafka mina A wage paid by bank transfer, which no act can “grind.” On the first gedar it would have to be made materially non-existent — which no longer means anything. On the second, as the Taz frames it, it suffices that it be put beyond any possibility of return. That is the reading that keeps the siman applicable.
3. בית הקברות — the Taz against the Beit Yosef (seif 1)
The ash of the burnt produce must be buried in a cemetery. The Mehaber says so without a reason. The Beit Yosef proposes one; the Taz finds it unnecessary, and faults him for ignoring what Tosafot had already written.
The Beit Yosef’s reason: a place nobody sows
« ומשמע לי דבדווקא נקט בי קברי דאי בדוכתא אחרינא חיישינן שמא יבאו ישראל לזרוע זרעיו שם ונמצא נהנה אבל בי קברי אין אדם עשוי לזרוע » (בית יוסף יו״ד קל״ג)
Tosafot’s reason: a place nobody digs in Tosafot raise two successive worries — that the ash be dug up while still ash, then that it be taken as fertiliser once it has turned to earth — and dismiss both by the nature of the place:
« ונראה שצריך לקברן מעט בעומק פן יבא לחטט אחריהם ולאחר שנעשו עפרא אין לחוש שמא יקחום לזבל בהם דאין דרך לחטט אחר הקברים משום זבל » (תוספות עבודה זרה ס״ב ע״ב ד״ה ולקברינהו בעינייהו)
The Taz’s double kashya He first wonders that the Beit Yosef did not follow Tosafot:
« דשם אין עשוי לזרוע כן כתב ב״י טעם למה הצריכו בית הקברות ותמוה לי למה לא כתב כמו שכתבו התוס׳ שם » (ט״ז יו״ד קל״ג ס״ק ב)
then he redoubles, faulting the Beit Yosef for seeking a reason of his own devising:
« וקשה לי על הב״י למה לא הלך ג״כ בדרך זה ולמה לו לחפש טעם מלבו » (ט״ז יו״ד קל״ג ס״ק ב)
What the divergence covers The two reasons do not target the same danger. The Beit Yosef fears that someone will sow above it — an unintended, future benefit. Tosafot fear that someone will come for the ash — a deliberate, immediate benefit. The first assumes a man who does not know; the second, a man who knows and covets.
Nafka mina Ground nobody cultivates but where people readily dig — a derelict industrial site, an embankment. On the Beit Yosef’s reason it serves; on Tosafot’s it does not. The Taz, preferring Tosafot, will therefore be more demanding about the choice of place.
4. קרקע ובהמה — the proof that this is no din in the object (seif 1)
Seif 1 closes on a clause one reads quickly and that carries great weight: even land or an animal taken as wages are forbidden in benefit — though they never become forbidden, not even if one bowed to them.
The Mehaber’s wording
« אפילו לקח בשכרו קרקע או בהמה שאינם נאסרים בהשתחוה להם ועבדן החמירו בהם לאסרם בהנאה » (שו״ע יו״ד קל״ג:א)
The Shach refers to the siman where the general rule is laid down
« שאינן נאסרין בהשתחוה כו׳. כדלקמן סימן קמ״ה » (ש״ך יו״ד קל״ג ס״ק ג)
The argument, in one line If the prohibition on wages were an extension of the benefit prohibition, it could not reach an object that the benefit prohibition itself does not reach. Land never becomes forbidden; here it does. So it is not the object that is targeted — it is the man. The clause is the best demonstration of the קנס, and it is slipped in at the end of the seif without comment.
Nafka mina What holds for land holds for any asset received in payment that does not perish — premises, a share, a right. The siman does not ask whether the object can “carry” a prohibition: it asks where it came from.
5. שכר שנתקבל קודם המלאכה — the Bach against the Shach
Had the sugya compared yayin nesekh to the sabbatical year, a consequence would follow: the sabbatical year forbids the sale and permits the wage, so one would have to distinguish by when the wage was collected. That is the Bach’s reading — and it is what the Shach dismisses in opening the siman.
The Bach’s position, as the Shach reports it

The Shach’s refutation It is purely textual, and that is its strength: the Gemara does not adopt the comparison with the sabbatical year — it proposes and rejects it, before concluding to a קנס. Reasoning built on a discarded hypothesis cannot yield a halakhah.

The Baer Hetev reports both, and says who has the last word

Nafka mina A wage paid in advance, before the work begins. For the Bach it would remain permitted to others than the worker himself; for the Shach the advance changes nothing — the penalty falls on the one who hired himself out, whatever the payment schedule.
השכיר לו חמורו לרכוב עליו אע״פ שהניח לגינו של יין עליו או שהשכיר לו ספינתו להוליך בה סחורתו אף ע״פ שנותן בה גם מאכליו ומשקיו שכרו מותר כיון שעיקר השכירות לא היה בשביל יין נסך:
6. עיקר השכירות — the test of נכי לי אגרא דלגינתו (seif 2)
Seif 2 permits a wage even though yayin nesekh genuinely travelled on the hired beast. The Mehaber’s phrase — עיקר השכירות — needs defining: by what is the “essence” of a hire measured?
The mishnah, in its second half
« הַשּׂוֹכֵר אֶת הַחֲמוֹר לְהָבִיא עָלֶיהָ יֵין נֶסֶךְ — שְׂכָרָהּ אָסוּר. שְׂכָרָהּ לֵישֵׁב עָלֶיהָ, אַף עַל פִּי שֶׁהִנִּיחַ גּוֹי לְגִינוֹ עָלֶיהָ — שְׂכָרָהּ מוּתָּר » (עבודה זרה ס״ב ע״א)
The Gemara then asks whether the renter has the right to place his flask — and Abaye turns the question round

The Shach turns the question into a criterion
« אע״ג דמן הדין יכול להניח עליו לגינו אפ״ה הואיל שאם לא הניח עליו לגינו אינו יכול לומר לו נכה לי משכר הלגין הרי הוא כאלו לא שכרו לכך. ש״ס » (ש״ך יו״ד קל״ג ס״ק ה)
The reasoning is pure civil law: the flask is a right of the renter, but it is not paid for; giving it up would earn no reduction. What has no price is not in the contract.
The Taz says the same in one line
« הטעם דאם לא יניח הלגין שם לא ינכה משכירתו בשביל זה » (ט״ז יו״ד קל״ג ס״ק ד)
Chakira: to what does the wage prohibition attach?(א) To the thing carried — then the least drop of wine on the donkey should taint part of the price. (ב) To the contract — then only what was bought and sold counts. Seif 2 decides unambiguously for (ב), and Abaye’s test is the instrument: one does not weigh the wine, one interrogates the price.
The Rambam joins this case and that of seif 7 in a single halakhah

Nafka mina A service whose price does not vary with the contents — flat-rate storage by the square metre, transport billed by the kilometre. If the price does not move according to whether there is wine or not, the wine is not in the contract. If it rises because there is wine, it is.

7. קבלנות — the remedy for the single barrel (seif 3)
This is the central sugya of the siman, and the only one where the Shach and the Taz part company outright. A hundred barrels carried for a hundred perutot, one of them holding wine: the wage is forbidden entire. One question remains — is there a remedy?
Tosafot explain why a lump contract does not divide
« ובהא אסרה ברייתא כי לא אמר לו לעיתותי ערב דכל כמה דלא אעברינהו לכולהו לא יהיב ליה מידי הלכך כוליה אגרא שייך ביה כן לשון הקונט׳ » (תוספות עבודה זרה ס״ה ע״א ד״ה הא דאמר ליה)

The Shach adopts the conclusion, and gives two reasons that are not the same

The first is structural: in a lump contract the entire wage is given for each and every barrel, so there is nothing to isolate. The second is causal: without that barrel the hiring might never have happened — the forbidden barrel is then the condition of the whole contract, not a part of its object.
The Taz reopens the file — and parts from two readings before giving his own He first cites the Perisha in the Maharshal’s name, restricting the Raavad’s remedy to a case where the wage has already been received; then the Bach, who extends it to the contrary case:
« בטור כתוב בשם הראב״ד מיהו יש לו תקנה על ידי שיוליך הנאה לים המלח שכר אותו חבית וכתב בפרישה בשם רש״ל דהיינו אם כבר קבלם משמע דכל שלא קבל עדיין אין שייך תקנה זו » (ט״ז יו״ד קל״ג ס״ק ה)
and he refuses both:

The Taz’s own position He rests it on the Terumat HaDeshen: since we rule like Rabbi Eliezer — who allows “taking the benefit to the Dead Sea” even for a barrel mixed among others — the mixture, once made, is no obstacle. What is an obstacle is the timing: before receiving, taking of one’s own to the Dead Sea is useless, since everything he receives afterwards he will receive in the forbidden state. The remedy therefore exists, but only after receipt.
Where they part, exactlyThe Shach (ס״ק ו): there is no remedy at all, because the structure of the lump contract excludes it. The Beit Yosef and most decisors with him.
The Taz (ס״ק ה): the Raavad’s remedy stands, but only once the wage has been collected.
The Baer Hetev, who reports both in the siman, cites the Shach here:

And for the second wording the Taz notes that no remedy is needed at all

It suffices to leave with the non-Jew the peruta of the wine barrel and take the rest: nothing was ever mixed.
Nafka mina A monthly haulage contract discovers after the fact that one delivery carried forbidden wine. For the Shach the whole month’s payment is caught and nothing redeems it. For the Taz, once the sum is received, it remains possible to set aside the corresponding value. Both positions are defensible; level 4 says which is the line, and why.
8. שוה פרוטה — the Rashba’s proof and its refutation (seif 3)
The Mehaber sets a threshold: below a peruta’s worth of forbidden wage, the whole remains permitted — after the fact. Where does this threshold come from, appearing nowhere in the baraita?
The Tur, in the Rashba’s name

The source of the reasoning: the last hammer-blow A Jew who built a house of idolatry has his wage permitted, because what completes the work — the last blow — is not worth a peruta:

That is: Tosafot there do not rest the permission on the peruta threshold but on the non-Jew’s indifference to the last blow; and from their wording it would even follow that in matters of idolatry a sum below a peruta would be forbidden.

What the objection leaves standing The Shach does not reject the threshold: the Mehaber wrote it, and he does not withdraw it. He rejects the proof. What remains is a threshold whose foundation is weaker than it looks — which explains two things: that it holds only after the fact, and that the Mehaber immediately adds ולכתחילה אסור לעשות כן.
The Taz’s צריך עיון If the wage of yayin nesekh is among the things requiring a peruta, why does the mishnah of perek haZahav, which lists five, not count it?

The answer is that of the Nekudot HaKesef: the tanna listed without claiming to be exhaustive — תנא ושייר.
And the Shach closes the seif on the lekhatchilah limit

Even below the threshold, one does not arrange matters that way in advance.
Seif 4 is the shortest of the siman and the most disquieting: the Jew has received nothing, and the beit din nonetheless seizes a value equal to what he would have earned. What exactly is being seized?
The source, cited by the Beit Yosef in the Rashba’s name

(א) טובת הנאה: the non-Jew’s gratitude is an assessable good; a real benefit is seized, simply a non-monetary one.
(ב) קנסא בעלמא, per the Maharshal: there is nothing to seize; the beit din punishes one who put himself at the service of the forbidden thing.
Three nafka minot(א) If it is a benefit, the seizure is measured by its value — that is, by what the gratitude is worth; if a fine, by the wage he would have earned. (ב) If a benefit, there must have been gratitude: a service done for an ungrateful man would escape. If a fine, gratitude is irrelevant. (ג) A קנס by nature does not pass on: heirs are not caught; a benefit, by contrast, is found in the estate.
Seif 6 decides indirectly The Taz (ס״ק ט) explains there that the non-Jew expressly said he would owe no gratitude — and the prohibition stands. Were gratitude the sole reason, nothing would be left of it. The siman therefore knows two distinct springs: gratitude in seif 4, the bare wish in seif 6.
לא יהא ישראל משמש ומוזג לעובד כוכבי׳ ביין נסך וכן אסור להיות תורגמן לעובד כוכבים למכור יין נסך וכן אסור ליתן יין בכלי ביד עובד כוכבים המכריז להטעימו שכיון שנגע בו העובד כוכבים נעשה יין נסך וכשמכריזו ומטעימו (ס״א ומראהו וכן הוא בב״י ובכל בו) נהנה הישראל מיין נסך:
The last three seifim no longer speak of money at all. They describe services rendered, guarding for free, and finally a paid destruction — and they hold together by a single notion, which seif 7 shows is not what one supposed.
The interpreter: it is not the wine he touches, it is the sale he enables
« וכן אסור להיות תורגמן לעובד כוכבים למכור יין נסך » (שו״ע יו״ד קל״ג:ה)
and the Beit Yosef, in the Rashba’s name, supplies the characterisation:

The crier to whom the cup is handed

Two reasons overlap here, and the Beit Yosef names both: the Jew benefits from yayin nesekh, and he wants the goods to survive until they have been cried through the whole town.
The true ground of רוצה בקיומו — and it does not lie in the notion of benefit
« וטעמא דרוצה בקיומו אסור כתב הר״ן בשם רש״י דהיינו משום דכיון דישראל מצווה לבטל עכו״ם אסור לו להיות רוצה בקיומה » (בית יוסף יו״ד קל״ג)
The Ran, in Rashi’s name: a Jew is commanded to abolish idolatry; he therefore cannot want it to survive. The prohibition is no longer a variety of benefit — it is the reverse of a mitzvah.
Seif 6, and the Taz’s precision
« אפילו אמר לו העובד כוכבים שמור בחנם חבית זו של יין נסך אע״פ שפטור אם נשברה או נאבדה מכל מקום מיצר הוא אם תשבר או תאבד מתוך שמירתו ורוצה הוא בקיומו ואסור » (שו״ע יו״ד קל״ג:ו)
« והא דלא אמר הטעם שיחזיק לו טובה על זה כמ״ש סעיף ד׳ נ״ל דעובד כוכבים אומר לו בפירוש מתחילה שלא יחזיק לו טובה בשביל זה » (ט״ז יו״ד קל״ג ס״ק ט)
The kashya seif 7 puts to seif 6 The man paid to smash the barrels also wants them to hold — at least until his blow. The literal sense of רוצה בקיומו fits him exactly. Why is he not forbidden?
« וְיָתְבִי וְקָא מִיבַּעְיָא לְהוּ: שְׂכָרוֹ לִשְׁבּוֹר בְּיֵין נֶסֶךְ מַהוּ? מִי אָמְרִינַן כֵּיוָן דְּרוֹצֶה בְּקִיּוּמוֹ — אָסוּר, אוֹ דִלְמָא כֹּל לְמַעוֹטֵי תִּיפְלָה שַׁפִּיר דָּמֵי » (עבודה זרה ס״ג ע״ב)
The Gemara’s answer, and its criterion
« אָמַר רַב נַחְמָן: יִשְׁבּוֹר, וְתָבֹא עָלָיו בְּרָכָה » (עבודה זרה ס״ג ע״ב)
and the Beit Yosef draws from it the definition seif 6 lacks:
« שאע״פ שהוא רוצה בקיומם שלא ישתברו מאליהם עד שישברם הוא ויטול שכרם כל למעט תיפלה ש״ד כלומר דלא מיתסר רוצה בקיומו אלא כשהוא רוצה בקיומו כדי להשיב לבעליו או עד שימכור אבל רוצה בקיומו עד שיאבדנו הוא בידיו לא חשיב רוצה בקיומו » (בית יוסף יו״ד קל״ג)
The complete gedarרוצה בקיומו is not “wishing the thing not to break.” It is wishing it to survive as a usable thing — to be returned, or sold. Where the wish has no horizon but destruction, it is not merely permitted: it is blessed.
Nafka mina A Jew charged with hauling a stock of forbidden wine to a destruction facility obviously wants nothing to spill on the way. On the Beit Yosef’s gedar that wish belongs to seif 7 and not to seif 6: its horizon is annihilation. If instead the mission is to haul it to a warehouse, we are in seif 6.
11. יסוד — three registers of benefit in a single siman
What gives siman 133 its unity is not its subject — seven scenes with no apparent connection — but the fact that it runs, in order, through three ways of drawing an advantage from something forbidden, each thinner than the last.

Why the order is the right one Each seif removes something from the one before. Seif 4 removes the money and the prohibition holds. Seif 6 removes the gratitude and the prohibition still holds. Seif 7 removes nothing at all — the wage is there, the wish is there — and the prohibition falls. So it is never the quantity of benefit that decides: it is what the benefit is turned toward.
Back to the chakira The registers do not rest on one principle, and that is why the Rama’s gloss does not carry them away together. The first is a קנס — it can be lightened, and the Rama lightens it for his age. The third is not a קנס but the obverse of a mitzvah — and nothing in the gloss touches it. That is exactly what the Shach (ס״ק ד), the Taz (ס״ק ג) and the Pitchei Teshuva (ס״ק א) each recall, on a different point of the siman.
