1. The axiom: a fine, not a status of the money
The starting point:
Simanim 123 to 131 asked when wine becomes forbidden; siman 132 asked what may still be received of its value. Siman 133 changes plane again: the wine is forbidden, and there is work around it. A labourer carries it, a donkey transports it, a cellar houses it, a server pours it, a guard watches it. The siman’s question is therefore: what may a Jew receive for work done on a forbidden thing?
Seven seifim, and they read as a descent: at each seif what the Jew receives is thinner — money, then gratitude, then a bare wish — and the prohibition still holds. Until the seventh, where everything is overturned.
The Gemara discards two grounds before settling on a third, and it is the third that must be kept: « אָמַר רַבִּי אֲבָהוּ אָמַר רַבִּי יוֹחָנָן: קְנָס הוּא שֶׁקָּנְסוּ חֲכָמִים בַּחֲמָרִין וּבְיֵין נֶסֶךְ » (עבודה זרה ס״ב ע״א).
The Shach opens his commentary on exactly this point, to dismiss the reading that would make the sabbatical year the model: « כלומר דל״ת כדקס״ד מעיקרא דש״ס ר״פ בתרא דעבודת כוכבים דהוי בעי למימר דיי״נ דמי לשביעית דמכירה אסור ושכרו מותר אלא לא דמי לשביעית אלא משום קנס החמירו ביי״נ דשכרו ג״כ אסור כדמסיק ש״ס התם » (ש״ך יו״ד קל״ג ס״ק א).

💡 The guide: do not ask here whether the wine is forbidden — it is so by hypothesis. Ask what the Jew receives, and on what account. Wherever the siman looks severe, what he receives is the consideration for work done on the forbidden thing; wherever it looks lenient, the consideration is for something else.
2. The 3 reflex questions
■ 1. WHAT IS IT THE PRICE OF? Does what the Jew receives pay for work done on the wine, or for work in which the wine was merely a passenger? That is the question of seif 1 against seif 2 — and it is settled by the contract, never by the volume carried.
↓ if it really is the price of work on the wine: the question becomes one of wording
■ 2. HOW WAS THE ENGAGEMENT WORDED? A lump contract — “a hundred barrels for a hundred perutot” — makes the wage one block, and the forbidden portion takes it whole. A piece rate — “each barrel for a peruta” — reaches only its own share. The work is the same; the sentence spoken at hiring decides.

■ 3. WHAT DOES HE WANT, AND TOWARD WHAT? In the last three seifim there is no money left. There remains the gratitude he earns (seif 4), then the bare wish that the thing hold (seif 6). And seif 7 shows that this wish is judged neither by its object nor by its intensity, but by what it is aimed at.
On the first question, the Mehaber’s formula: « השכיר לו חמורו לרכוב עליו אע״פ שהניח לגינו של יין עליו או שהשכיר לו ספינתו להוליך בה סחורתו אף ע״פ שנותן בה גם מאכליו ומשקיו שכרו מותר כיון שעיקר השכירות לא היה בשביל יין נסך » (שו״ע יו״ד קל״ג:ב).
On the second, the baraita: « הַשּׂוֹכֵר אֶת הַפּוֹעֵל, וְאָמַר לוֹ: ״הַעֲבֵר לִי מֵאָה חָבִיּוֹת בְּמֵאָה פְּרוּטוֹת״, וְנִמְצֵאת חָבִית שֶׁל יֵין נֶסֶךְ בֵּינֵיהֶן — שְׂכָרוֹ אָסוּר. חָבִית חָבִית בִּפְרוּטָה, וְנִמְצֵאת חָבִית שֶׁל יֵין נֶסֶךְ בֵּינֵיהֶן — שְׂכָרוֹ מוּתָּר » (עבודה זרה ס״ה ע״א).
On the third, Rav Nachman’s answer: « אָמַר רַב נַחְמָן: יִשְׁבּוֹר, וְתָבֹא עָלָיו בְּרָכָה » (עבודה זרה ס״ג ע״ב).
⚠ The methodological error to avoid: beginning by asking “did the Jew touch the wine?”. That is never this siman’s question — in all seven seifim, contact plays no part. The siman does not judge a touch: it judges a consideration, in the broadest sense, down to a bare wish.

💡 Read the “what he receives” column top to bottom: money, then an asset, then nothing, then a bare wish — and the prohibition holds at every step. Then look at the last row: the wage is back, full and entire, and the prohibition has fallen. That is the proof that the siman does not measure a quantity of benefit.
4. What is done with what was received (seif 1)
The Mehaber prescribes two treatments and does not say why: « ואם נטל ממנו מעות בשכרו שוחק וזורה לרוח או מטיל לים » (שו״ע יו״ד קל״ג:א).
And for produce: « נתן לו פירות יוליכם לים המלח או ישרפם ויקבור העפר בבית הקברות » (שו״ע יו״ד קל״ג:א).

⚖ The Taz explains the difference of place, and his answer amounts to a definition
« פי׳ שוחק ומטיל לים וסתם ים משמע כל ים ואין צריכין ים המלח כמו דצריך גבי פירות לפי שהפירות הם בעין ובסתם ים הולכין ספינות ושמא ימצאם אחד ויהנה מהם » (ט״ז יו״ד קל״ג ס״ק א)
The criterion is therefore not ritual: it is the state of the thing after the act, and the risk that a third party might still benefit.
💡 To remember: the Rambam, on the same cases, writes only the Dead Sea for money and does not mention a cemetery for the ash —
« וְכֵן הַשּׂוֹכֵר אֶת הַחֲמוֹר לְהָבִיא עָלָיו יַיִן אוֹ שֶׁשָּׂכַר סְפִינָה לְהָבִיא בָּהּ יַיִן שְׂכָרָן אָסוּר. אִם מָעוֹת נָתְנוּ לוֹ יוֹלִיכֵן לְיָם הַמֶּלַח. וְאִם נָתְנוּ לוֹ בִּשְׂכָרוֹ כְּסוּת אוֹ כֵּלִים אוֹ פֵּרוֹת הֲרֵי זֶה יִשְׂרֹף אוֹתָן וְיִקְבֹּר הָאֵפֶר כְּדֵי שֶׁלֹּא לֵהָנוֹת בּוֹ » (רמב״ם הלכות מאכלות אסורות פרק י״ג הלכה ט״ז)
. The Mehaber follows the Rashba here, cited by the Beit Yosef, who prescribes treating the wage as one treats the idol itself.
5. עיקר השכירות — when the hire was not “for the wine” (seif 2)
Seif 2 permits a wage even though wine genuinely travelled: « השכיר לו חמורו לרכוב עליו אע״פ שהניח לגינו של יין עליו או שהשכיר לו ספינתו להוליך בה סחורתו אף ע״פ שנותן בה גם מאכליו ומשקיו שכרו מותר כיון שעיקר השכירות לא היה בשביל יין נסך » (שו״ע יו״ד קל״ג:ב).
The Gemara supplies the test, and it is pure civil law: « אָמַר אַבָּיֵי: נְהִי דְּלָגִין דִּינָא הוּא לְאוֹתוֹבֵי, מִיהָא אִי לָא מוֹתֵיב לֵיהּ, מִי אָמְרִינַן לֵיהּ: נַכִּי לֵיהּ אַגְרָא דִּלְגִינָתוֹ » (עבודה זרה ס״ה ע״א).
⚖ The Shach turns it into a usable criterion
« אע״ג דמן הדין יכול להניח עליו לגינו אפ״ה הואיל שאם לא הניח עליו לגינו אינו יכול לומר לו נכה לי משכר הלגין הרי הוא כאלו לא שכרו לכך. ש״ס » (ש״ך יו״ד קל״ג ס״ק ה)
and the Taz says it in one line:
« הטעם דאם לא יניח הלגין שם לא ינכה משכירתו בשביל זה » (ט״ז יו״ד קל״ג ס״ק ד)

6. The two wordings of the contract (seif 3)
Nothing changes in the work done; everything changes in the sentence spoken at hiring: « העבר לי מאה חביות של שכר במאה פרוטות ונמצאת אחת מהן יין שכרו כולו אסור כיון שיש ביניהם שוה פרוטה משכר היין נסך » (שו״ע יו״ד קל״ג:ג).
And in the other wording: « ואם אמר לו העבר לי כל חבית בפרוטה ונמצא ביניהם חבית של יין שכר חבית של יין אסור והשאר שכרו מותר ולכתחילה אסור לעשות כן » (שו״ע יו״ד קל״ג:ג).

— the second wording saves after the fact; one does not arrange it in advance. And the Shach adds that this holds even below the peruta threshold:
« ולכתחלה אסור לעשות כן. אפילו אין ביניהם ש״פ. ב״י בשם הרשב״א » (ש״ך יו״ד קל״ג ס״ק ח)

7. Is there a remedy? The Shach / Taz machloket
This is the most disputed point of psak in the siman. The Tur sets out the two camps — the Raavad, who allows a remedy, and the Ramban, who refuses it — and the Beit Yosef counts the votes: « ולדברי הרמב״ן הסכימו הרשב״א והר״ן ז״ל וכך הם דברי הרמב״ם ז״ל בפי״ג וכ״נ שהוא דעת הרי״ף ז״ל שכתב סתם דשכרו אסור ולא חילק בדבר וכ״נ מדברי רש״י שכתבתי בסמוך והכי נקטינן » (בית יוסף יו״ד קל״ג).

⚖ The Shach’s line
« ולא מהני הולכת הנאה לים המלח כדלקמן סימן קל״ד דהכא כיון שקבלנות היא כולי אגרא אחדא וחדא יהיב ליה וגם אפשר שאלו הודיעו מתחלה שאין מעביר לו אותו חבית שמא לא היה שוכרו כלל כן הסכימו רוב הפוסקים וכ״פ ב״י והאחרונים » (ש״ך יו״ד קל״ג ס״ק ו)
Two distinct reasons: the lump contract gives the whole wage for each barrel (structure), and without that barrel the hiring might never have happened (causation).
💡 The practical line: the Shach has the Beit Yosef and the majority with him, and the Baer Hetev reports him as such. The Taz remains a serious position, resting on the Terumat HaDeshen, but it is a minority one and strictly bounded — after the wage has been received. For a real case, it is for the Rav to say whether it may be relied on.
8. שוה פרוטה — the threshold and its limit
The threshold comes from the Rashba, cited by the Tur: « וכתב הרשב״א דווקא שיש ביניהן שוה פרוטה משכר יי״נ אבל פחות משוה פרוטה כגון ששכרו להעביר מאה חביות בחמשים פרוטות והיתה אחת מהן של יי״נ מותר » (טור יו״ד קל״ג).
His proof is drawn from an entirely different passage: « אֶלָּא אָמַר רַבָּה בַּר עוּלָּא: לֹא נִצְרְכָה אֶלָּא בְּמַכּוֹשׁ אַחֲרוֹן. עֲבוֹדָה זָרָה מַאן קָא גָרֵים לַהּ? גְּמַר מְלָאכָה, וְאֵימַת הָוְיָא גְּמַר מְלָאכָה? בְּמַכּוֹשׁ אַחֲרוֹן. מַכּוֹשׁ אַחֲרוֹן לֵית בֵּיהּ שָׁוֶה פְּרוּטָה » (עבודה זרה י״ט ע״ב).
⚠ The Shach contests the proof without withdrawing the threshold
« זה למד מהרשב״א מעבודת כוכבים… גבי מכוש אחרון לית ביה ש״פ ולפי מה שכתבו התוס׳ שם אין ראייה ואדרבה משמע מדבריהם דאפי׳ פחות משוה פרוטה אסור בעבודת כוכבים אלא דהתם היינו טעמא דעובד כוכבים אינו מקפיד אמכוש אחרון » (ש״ך יו״ד קל״ג ס״ק ז)
That is why the threshold holds only after the fact: the Mehaber writes מותר בדיעבד, and never otherwise.

The answer is that of the Nekudot HaKesef: תנא ושייר — the tanna listed without claiming to say everything.
9. Working for free, and the pledge (seif 4)
The shortest seif of the siman, and the most surprising: « היה עושה עמו ביין בחנם ממשכנים מנכסיו כנגד שכרו » (שו״ע יו״ד קל״ג:ד).

Either gratitude is a good that is seized; or, with the Maharshal, there is nothing to seize and the beit din punishes.

10. Serving, interpreting, offering a taste (seif 5)
Three acts, no payment in wine, and yet three prohibitions: « לא יהא ישראל משמש ומוזג לעובד כוכבי׳ ביין נסך » (שו״ע יו״ד קל״ג:ה).
The interpreter: « וכן אסור להיות תורגמן לעובד כוכבים למכור יין נסך » (שו״ע יו״ד קל״ג:ה).
⚖ The Beit Yosef supplies the interpreter’s characterisation
« שאסור לישראל ליטול שכר להיות תורגמן למכור סתם יינם ואפילו שכרו סתם להיות לו תורגמן והנכרי הוא שמוכר היין אסור שהרי הוא רוצה בקיומו והרי הוא כסרסור שעל ידי שהוא תורגמן לנכרי מוכר היין » (בית יוסף יו״ד קל״ג)
He is a broker: it is not the wine he touches, it is the sale he makes possible.
💡 The siman’s most contemporary practical point: the Pitchei Teshuva, in his one intervention, places it here, on the word “pouring”:
« עבה״ט של מהרי״ט ז״ל ועיין בתשובת הרדב״ז ח״א סימן כ״ב שכתב דראוי להחמיר אף בסתם יינם עיין שם » (פת״ש יו״ד קל״ג ס״ק א)
— the Radbaz holds that one should be stringent even with stam yeinam, precisely where the Rama’s gloss might have lightened matters.
11. רוצה בקיומו — guarding for free (seif 6)
Nothing is received, no liability is taken, and the prohibition holds: « אפילו אמר לו העובד כוכבים שמור בחנם חבית זו של יין נסך אע״פ שפטור אם נשברה או נאבדה מכל מקום מיצר הוא אם תשבר או תאבד מתוך שמירתו ורוצה הוא בקיומו ואסור » (שו״ע יו״ד קל״ג:ו).
⚖ The Taz explains why the reason changes between seif 4 and seif 6
« והא דלא אמר הטעם שיחזיק לו טובה על זה כמ״ש סעיף ד׳ נ״ל דעובד כוכבים אומר לו בפירוש מתחילה שלא יחזיק לו טובה בשביל זה » (ט״ז יו״ד קל״ג ס״ק ט)
Gratitude was expressly excluded by the depositor. All that remains is the wish — and it suffices.
💡 The true ground is not benefit:
« וטעמא דרוצה בקיומו אסור כתב הר״ן בשם רש״י דהיינו משום דכיון דישראל מצווה לבטל עכו״ם אסור לו להיות רוצה בקיומה » (בית יוסף יו״ד קל״ג)
— the Ran, in Rashi’s name: a Jew is commanded to abolish idolatry, and so cannot want it to remain. It is the reverse of a mitzvah, not a variety of benefit.
12. ממעט בתיפלה — smashing the barrels (seif 7)
The reversal, and it is complete: « ישראל ששכרו עובד כוכבים לשבר לו חבית של יין נסך אע״פ שרוצה בקיומם שלא ישתברו מאליהם עד שישברם הוא ויטול שכרם שכרו מותר ותבא עליו ברכה מפני שממעט בתיפלה » (שו״ע יו״ד קל״ג:ז).
The question is asked by four Sages sitting together: « וְיָתְבִי וְקָא מִיבַּעְיָא לְהוּ: שְׂכָרוֹ לִשְׁבּוֹר בְּיֵין נֶסֶךְ מַהוּ? מִי אָמְרִינַן כֵּיוָן דְּרוֹצֶה בְּקִיּוּמוֹ — אָסוּר, אוֹ דִלְמָא כֹּל לְמַעוֹטֵי תִּיפְלָה שַׁפִּיר דָּמֵי » (עבודה זרה ס״ג ע״ב).
And Rav Nachman rules: « אָמַר רַב נַחְמָן: יִשְׁבּוֹר, וְתָבֹא עָלָיו בְּרָכָה » (עבודה זרה ס״ג ע״ב).
⚖ The Beit Yosef gives the definition seif 6 lacked
« שאע״פ שהוא רוצה בקיומם שלא ישתברו מאליהם עד שישברם הוא ויטול שכרם כל למעט תיפלה ש״ד כלומר דלא מיתסר רוצה בקיומו אלא כשהוא רוצה בקיומו כדי להשיב לבעליו או עד שימכור אבל רוצה בקיומו עד שיאבדנו הוא בידיו לא חשיב רוצה בקיומו » (בית יוסף יו״ד קל״ג)
It is not the wish that is forbidden: it is the wish turned toward return or sale. Turned toward destruction, it is blessed.
13. The Rama’s gloss, and its three limits
A single intervention in the whole siman: « ועיין לעיל סימן קכ״ג דבזמן הזה מקילין לענין היתר הנאה מסתם יינם ולכן אין להחמיר באלו הדינים רק ביין נסך גמור » (רמ״א יו״ד קל״ג:א).

💡 The formula: the Rama lightens the consequence, not the undertaking. A benefit already come is no longer treated with the severity of actual yayin nesekh; what one decides to undertake tomorrow remains held by the siman.
14. The 6 golden rules
- Do not ask what the wine is worth — ask where what you receive comes from. The wine is forbidden by hypothesis throughout the siman.
- The wage prohibition is a קנס. It aims at a man, not a thing — which is why it reaches even land, which never becomes forbidden.
- The wine is not in the contract because it travels — it is in it if it is in the price. The test: would the bill drop without it?
- The wording fixes the extent. Lump contract: the whole wage. Piece rate: only the corresponding share.
- Receiving nothing is no way out. Gratitude is a benefit (seif 4); so is a bare wish (seif 6).
- A wish is judged by its horizon. Toward return or sale: forbidden. Toward destruction: blessed.
15. Mnemonic — « ש.כ.ר »
ש · כ · ר — three letters, three reflexes, and it is the very word the siman carries in its heading.
ש — שכר. What is what you receive the price of? Work done on the forbidden thing, or work in which the forbidden thing was merely a passenger?
כ — כיצד נשכר. How was the engagement worded? One block, or a string of small contracts? The answer fixes the extent of the prohibition.
ר — רצון. If he receives nothing, what does he want — and toward what does that wish tend? Toward preservation, or toward destruction?
💡 How to use it: set the three letters in order. ש — the price of what? כ — worded how? ר — what does he want, and to what end? If all three answers are clear, the case is already filed in one of the tables above.
