1. שורש הסימן — what this siman decides, and what it does not
This siman does not say which wine is forbidden. It starts from wine that already is, and answers a question of fact: this wine has run somewhere — what becomes of whatever it ran into? The practical answer never begins with a figure. It begins with three findings: of what kind is that which received the wine; in which direction the pouring took place; and through what stream. Volume comes only afterwards, and in the strictest case it does not come at all.
Two regimes, and they must be kept apart throughout.יין נסך ממש — wine actually poured in libation — remains forbidden for benefit and has no threshold within its kind. סתם יינם — a non-Jew’s ordinary wine — has always had an economic way out, and the Rama’s gloss on seif 2 adds to it, for Ashkenazi practice, nullification in sixty. Every practical decision in this siman is read in terms of this pair.

3. יין ביין — the measure, and the direction of the pouring (seif 1)

The rule, and its limit in the next sentence. The משהו is real, but it holds only in one configuration: permitted wine poured onto the forbidden. The Mehaber says so himself, and this is the clause that gets skipped.

The foundation, and it settles every disputed case. The Shach in the Ran’s name: what occupies the place counts for more than what arrives. Hence a drop at the bottom forbids a barrel poured over it, and a barrel standing in place absorbs the drop.

Two practical detours, to be known before ruling.(1) In a case of great loss, the Shach permits relying on the Ramban, the Rosh and the Tur, for whom even permitted liquid poured at once onto the forbidden is saved if there is sixty. (2) If the stream was interrupted, the wine left in the vessel is no longer bound to what fell — and only what actually descended is measured.

The Mehaber’s ruling, and the Rama’s. The Mehaber maintains the Talmud’s measure: משהו for drinking, with the economic way out through sale. The Rama reports the view that nullifies in sixty and adds the decisive phrase — and such is the custom. It is the clearest dividing line in the whole siman, and it is no nuance of period: it changes conduct.

But the Shach at once closes part of the door. His argument is not a stringency: it is a reading of the reason. The leniency of our time was born of a case of loss; it cannot therefore serve to draw a knowing profit from what fell. The Bach concluded the opposite; the Beer Hetev reports both and leans to the Shach.

And the Pitchei Teshuva gives the practical conduct. The Noda BiYehuda distinguishes the cases and closes with two sentences that are themselves a lesson in ruling: where there is no loss at all, one does not dispute the Shach; but a decisor who did permit — his ruling is not overturned.

The boundary not to be crossed the other way. The custom of sixty concerns a liquid mixed into a liquid. A significant barrel remains a counted object, and the Pitchei Teshuva recalls that it is not nullified in a majority, even nowadays. The Rama himself was lenient about containers only for the small and unimportant ones.

5. מים ויין — taste, and the contradiction resolved (seif 3)

The seif contradicts itself, and this has practical bearing. It permits progressive nullification, then says that the forbidden accumulated to the point of taste forbids. The Rama states the fact and rules; the Taz defends the text; the Shach concludes a word dropped from the editions. But whichever reading is taken, the practical result is the same — and that is what to hold on to before a real case.

And the practical consequence not to be missed. The Shach writes elsewhere that sixty is required against everything that fell, failing which the prohibition reawakens. In other words: one does not count drop by drop, one counts the cumulative total. This is the rule that decides repeated pourings and gradual mixing in production.

6. רואין וששה חלקים — the measure of water (seifim 4–5)

Two regimes, and the Mehaber separates them expressly. For wine actually libated, the water must have come first. For stam yeinam, it counts even if it came at the end. The Taz notes that this middle way is the Mehaber’s own decision, between the Rambam’s stringency and the Rosh’s leniency.

The most important practical limit in the siman. Six parts apply only in water. In wine, or in a dish where wine improves, we return to sixty. Confusing the two is the costliest mistake one can make here.

And if the dilution does not suffice. The Rama opens the sale to a non-Jew with the value of the forbidden deducted — and extends it to anything forbidden by a משהו bought from a non-Jew. With a restriction easily forgotten: do not dispose of it in bulk, for the goods would return to a Jewish market.

7. חומץ — two seifim that answer one another (seifim 6–7)

The operative rule, and it is counter-intuitive. Kind is read neither off the raw material nor off the process, but off the name of the product. A vinegar is of the kind of a vinegar, whatever its origin; wine is not of the kind of its own vinegar. This is exactly the question raised today by an industrial vinegar.
A remark of the Taz, which lightens a frequent case. In the Rashba’s name: vinegar spoils the taste of wine — and there are those who prefer vinegar. The remark is brief, but it explains why this seif is judged by taste and not by principle.

8. נפל על אוכלין — rinsing and absorption (seifim 8–11)

The siman’s only numerical dispute, and it decides everything in practice. How long may one wait before rinsing? The Taz relies on the Tur and requires a very short delay. The Shach, and after him the Nekudot haKesef reported by the Beer Hetev, give twenty-four hours, by analogy with all cold contact. It is the widest gap in the siman between two decisors, and it bears on a measurable fact.

And the Taz’s restriction on the sale. The remedy of selling to a non-Jew — for the pressed grapes as for the bread — is open only for stam yeinam. For wine actually libated, the Taz in the Maharshal’s name rules out the remedy.

Two operative rules, and the second is often forgotten.(1) A taste that spoils does not forbid. (2) But order matters: what first improved remains forbidden, even if later cooking makes it spoiling. One therefore judges the state of the mixture at the moment it was made, not at the moment one looks at it.

Why a spice is nullified although it exists precisely to give taste. The Rama answers by separating the object of the prohibition: it is not the spice that is forbidden but what it drank. Sixty is therefore counted against the absorbed wine, not against the spice.
And the Shach issues the warning that decides most concrete cases. An ingredient may be spoiled in itself and become improving again in the dish. Taste must therefore be assessed where the dish is eaten, and not in the spice jar.

10. משקי עובדי כוכבים — the seif that speaks of today (seif 13)

This seif speaks not of an accident but of a process. The question is therefore not “is there wine in it?” but “is it customary to put some in?”. And the Rama’s answer at once sets the decisive criterion: does this wine, in this product, improve or spoil?

The production rule the Pitchei Teshuva draws from it. His responsum concerns a distillery where meat is added to correct a taste. The principle he applies holds for any manufacture: one does not bring about a mixture oneself while relying on its nullification, even if the proportion would suffice at once.

11. מקרים מודרניים — siman 134 today
A vat of kosher wine into which non-kosher wine has run. Put the three questions in order before any calculation: did the non-kosher wine fall into the vat, or was the vat poured onto it? Was the transfer a trickle or a wide pipe? And is it wine actually libated or stam yeinam? Only then does the question of sixty arise — and for one who follows the Rama, in the terms of his gloss on seif 2.
A vinegar, a mustard, a sauce containing wine vinegar. Seif 7 governs: two vinegars are of one kind, whatever their raw material. The stricter regime therefore applies in principle — tempered, according to the Shach, by the custom of sixty in our time. The question to ask the manufacturer is not “what is this vinegar made of?” but “is there wine vinegar in it?”.
A flavouring, a sauce base or a stock that has absorbed wine. This is the Rama’s gloss on seif 12, almost as it stands: one counts not against the ingredient but against the wine it carries. And the Shach’s warning governs the rest: if that wine improves the finished dish, it does not matter that it seems spoiled in the bottle.
Wine spilt on fruit, grain or pulses. The question is no longer measure but entry. Fruit with intact skin is rinsed; opened fruit or a cracked seed has absorbed. And on the delay one follows one’s Rav between the Taz and the Shach — that gap is the one that most often decides.
A commercial drink or product containing wine by recipe. This is seif 13. The decisive fact is not the quantity but the usage of manufacture, and one then examines what the wine does to the product. And the Pitchei Teshuva’s reminder holds for all production: one does not manufacture while relying in advance on nullification.
None of these cases is settled by reading alone. The kind of the product, the actual order of operations, the flow rate of a transfer and whether the wine improves or spoils are matters of fact — and they decide. Establish the facts, then put them to your Rav.
