One reads siman 134 as a list of measures, and gets it wrong. It is not a list but a function of three variables, of which quantity is only the last. Kind decides the regime; the direction of the pouring decides who absorbs whom; the calibre of the stream decides whether the mixing is gradual or instantaneous. Volume arises only afterwards — and for wine within its own kind it does not arise at all.

The ḥakira that runs through the siman Is the משהו of wine in wine (a) a particularly demanding measure of ביטול — the same operation as elsewhere, but with a raised threshold — or (b) the very refusal of the operation of ביטול, decreed upon libation wine because of its origin? The first makes the משהו a figure; the second makes it an exclusion. The whole siman reads differently according to which is taken: the exception of ראשון ראשון בטל is unintelligible on the first — why would a raised threshold collapse before a trickle? — and perfectly clear on the second, since where the prohibition no longer exists when the next drop arrives, there is nothing to exclude.

The mishna gives the two regimes without explaining them; the gemara ties them to a fundamental controversy about all the Torah’s prohibitions, then isolates what is peculiar to wine.

Two readings of this rule, and they differ in scope For Rav and Shmuel the rule holds for all the Torah’s prohibitions: within their kind, they all forbid by a משהו. For Rabbi Yoḥanan and Reish Lakish, all are measured by taste, and only tevel and yayin nesekh are exceptions. This is no nuance: on the first reading siman 134 has nothing peculiar to it; on the second it is a named exception.

The reason, in three words And it governs the whole siman: the stringency is not in the chemistry of the mixture but in the origin of the prohibition.

An immediate nafka mina If the stringency rests on the origin and not on the mixture, then it must cease where the origin fades — and that is precisely what the Rama will do in seif 2 for the stam yeinam of our time. His reasoning is therefore no circumstantial softening: it is derived from the very reason the gemara gives for the stringency.

3. הורק ההיתר על האיסור — the Ran’s yesod, and the view it sets aside

The Mehaber does not only say how much: he says in which direction. And the clause that says it is the one most often skipped, though it contains the principle.

The Shach first states the extreme case Even if one pours at once a permitted mass containing sixty times the forbidden drop, it is of no avail.

The principle, in the Ran’s name This is not a rule about wine: it is a rule about mixtures. Holding the place counts for more than arriving.

But there is a second opinion, and the Shach turns it into a measure of loss The Ramban, the Rosh and the Tur hold that even permitted liquid poured into forbidden is saved if it falls at once and there is sixty. The Shach does not rule against them: he reserves them for a case of great loss. This is no hesitation — it is how this siman handles all its evenly balanced disputes.

And the Shach closes his note with the boundary that holds today All this rigour concerns wine actually libated. For stam yeinam he announces already — three seifim before the Rama’s gloss — what custom has retained.

4. צרצור וחבית — the Ran’s question and its answer

The gemara distinguishes a small flask from a barrel. The Ran refuses that distinction as it stands — not because it is false, but because it is not a boundary. His answer changes the nature of the criterion.

« וְדַוְקָא צַרְצוּר קָטָן, דְּלָא נְפִישׁ עַמּוּדֵיהּ, אֲבָל חָבִית דִּנְפִישׁ עַמּוּדֵיהּ — לָא » — עבודה זרה ע״ג ע״א
The Ran’s question, reported by the Shach A container is not a measure. Between the small flask and the barrel there is a continuum, and the Torah is not given in approximations.

The answer, and it shifts everything It is not the size of the vessel that counts but the usage made of it. A vat is emptied with a barrel; what remains in the barrel is therefore bound to come down, and whatever is bound to mix is already reckoned as mixed. The small flask has no such usage: only what has actually fallen is counted.

The nafka mina the answer produces at once If everything turns on what is bound to descend, then interrupting the stream changes the law: what is no longer flowing is bound to nothing. The Shach draws this explicitly from the Ran, and the Beer Hetev retains it.

A textual detail that is not nothing The Mehaber writes צרצור; the Rambam, whom he copies here almost word for word, writes צלצול. The word differs, the thing is the same — and the Mehaber followed the language of the gemara rather than that of his own model.

5. נצוק חבור — why it does not bite here

A difficulty leaps out: if an unbroken stream connects upper to lower, how can the wine left in the vessel be permitted when what fell was nullified? The Ran answers, and the Raavad had answered otherwise.

The Ran’s answer, and the reading he rejects The nitsok does not carry the prohibition upwards: it merely aligns the status of the upper with that of the lower. And the lower, here, has become permitted. The Raavad saved the gemara differently — by positing a stream that breaks of itself — and the Ran sets that reading aside.

And yet the Rama makes the nitsok bite At the end of his gloss on seif 2 the Rama writes that where the mixing occurred through a nitsok, the upper wine is of no help in nullifying. This is no contradiction: the Ran spoke of a prohibition descending and being lost; the Rama speaks of permitted liquid remaining above which one would like to count below. The connection does not carry the prohibition — and no more does it carry the rescue.

The Mehaber said “each successive first amount is nullified” without requiring sixty. The Shach notes that this is not our halakha, and the reason he gives also governs the Rama’s gloss on seif 3.

The ḥakira beneath חוזר וניעור When a drop is nullified, (a) does it disappear — in which case nothing can revive it — or (b) does it remain present and merely neutralised by the mass that dominates it? On the first, accumulation changes nothing; on the second, the sum of the drops becomes a quantity again, and the ratio that neutralised them no longer holds. The whole dispute of seif 3 lies here, and the Shach takes the second.

7. בזמן הזה — the custom, and the Shach’s reservation

The Rama’s gloss on seif 2 is the weightiest line of the siman. It does not only say what is permitted: it reopens the question of what one may profit from.

The Bach draws a conclusion, the Shach refuses it The Bach: since the mixture is nullified, there is nothing left to destroy, and the sale-with-deduction becomes unnecessary. The Shach hesitates, and his argument is methodological: the custom of our time is not a free-standing permission but a door opened by loss. One does not walk through such a door in order to profit.

The Pitchei Teshuva reports the Noda BiYehuda’s attempted rescue The Noda BiYehuda distinguishes: where the prohibition held in the time of the Talmud according to all decisors, the argument from the age is relied on only in a case of loss; but for stam yeinam, which Rabbenu Tam already nullified in sixty, the two reasons are joined. He closes, however, with a sentence of deference that is itself a ruling.

8. סעיף ג׳ — the seif that contradicts itself, and four ways of reading it

This is the central sugya of the siman, and it is not about a law but about a text. The Mehaber permits, then forbids, three lines apart. Four of the greatest commentators answer, and no two answers resemble one another.

The question, as the Rama sets it He does not first seek to reconcile: he states the fact. Then he attributes the disagreement to the decisors — which is to say that the Mehaber set side by side two opinions, not two clauses of one opinion — and he rules.

First reading — the Taz: there is no contradiction, and the Mehaber innovated The Taz devotes to this seif the longest note in the siman, and his tone is that of a discovery. He begins by asserting that not only are the words of the Shulchan Arukh correct, but they would have deserved to be written had they not been there.

The Taz’s answer, in two steps (a) Seifim 1 and 3 are the Rambam’s language, word for word; the disputed clause is an addition of the Mehaber. (b) And that addition is necessary, for within the same kind progressive nullification holds — the taste does not change — whereas in a different kind the prohibition rests on taste alone: accumulating to the point of taste therefore brings it back. The Taz thus recovers the argument Tosafot give for milk poured little by little into a pot.

Second reading — the Bach: the clause refers to the barrel The Bach (“מו״ח ז״ל”, the Taz’s father-in-law) reads “and if the forbidden liquid accumulated” as referring to one who pours from a large vessel whose column is thick — that is, the case of seif 1. The Taz rejects this reading in a few words: it is not what the sentence says.

Third reading — the Shach: a word dropped out of the printed editions The Shach first dismisses the Aḥaronim’s attempts as forced, offers an explanation of his own, then abandons the path of reconciliation for that of textual emendation. It is the most radical position, and it is the one that prevailed.

Fourth reading — the Beer Hetev, who arbitrates and adds He reports the debate, notes that the Nekudot haKesef attacked the Taz, sides with the Shach’s emendation — then slips in, between brackets, a reading of his own, close to the Bach. It is the clearest sign that the sugya was not closed.

A question arises in seif 4 and the Rosh answers it: why does the permitted wine, having become forbidden through the drop, not itself require nullification? His answer is technical — and the Taz shows that it turns against us.

The question If the drop rendered the whole permitted wine forbidden, the mass of water ought to suffice to nullify the whole, not the drop alone. This is the principle of חתיכה נעשית נבילה, transposed to liquids.
The Rosh’s answer, reported by the Taz A thing forbidden only by a משהו does not itself become “nevela”. The reasoning belongs to the regime of the משהו — and that is where the trap closes.

Seif 5 gives a figure unlike any other in the Shulchan Arukh. The Taz seeks its origin, and takes the opportunity to set aside an attractive explanation that would have changed everything.

The reasoning refused One might say: one part of wine equals three parts of water, so six parts of water form a majority against it. The Taz shows this does not hold — the rule of three parts fixes a minimum of dilution, not an equivalence — and draws a methodological rule from it: where the gemara has given a measure, one does not lighten it by inference.

Seif 7 is the counter-test of the whole siman. Two vinegars share no origin, no substance, no taste — and yet they are of one kind. The reason lies in three words of the Shach.

The ḥakira, and it is a general one Is מין (a) a real category — an identity of substance preventing taste from standing out — or (b) a nominal category, fixed by language? Seif 6 and seif 7 set side by side decide for the second: wine and wine vinegar, materially the same product but for a fermentation, are two kinds; grape vinegar and barley vinegar, materially unrelated, are one kind. It is not the substance that makes the kind, it is the name.
A nafka mina, and a daily one The whole modern question of industrial vinegars passes through here. What decides is not the raw material of the product but the name under which it presents itself — and the Shach at once adds that the custom of sixty extends here too.

13. הדחה ובליעה — the clock the siman does not give
