Halakhah lema'aseh — the practical ruling

From the ruling of the Mehaber and the Rama, through the decisions of the Taz, the Shach,
the Beer Hetev and the Pitchei Teshuvah, down to today’s tank and barrel

Subject:

⚠ Level notice:
This level is not “Daat HaRav”: the Shulchan Aruch HaRav
(the Alter Rebbe) does not cover Yoreh De'ah, hence not Siman 135.
It is a level of practical ruling: what one does, and whom to ask.

How to read this level. Every statement here rests either on the text of the Shulchan Aruch and its commentators (Taz, Shach, Beer Hetev, Pitchei Teshuvah), or on a named and checkable posek (Rambam, Tur, Beit Yosef, the gemara of Avodah Zarah). On Yoreh De'ah there is no Mishnah Berurah (which comments only on Orach Chaim) and no Shulchan Aruch HaRav (the Alter Rebbe did not write Yoreh De'ah). The Arukh HaShulchan is not cited here: its text on this siman is not accessible to us, and one does not cite what one cannot check. Siman 135 has sixteen seifim — the count announced in the heading (ובו ט״ז סעיפים) and the actual count of the text. Where the question goes beyond the siman, this level says so and stops: halakhah lema'aseh goes through your Rav.

📜 The text of the Shulchan Aruch — seif

Before any table, the reason that makes this siman lighter than the general law of prohibitions — and the one thing whose absence overturns everything.

What the vessel took in is not a cooked taste. The gemara formulates it in rejecting the objection from chametz:
From this, and from this alone, comes the whole lightened regime of the siman: cold water, time, a peel — where other prohibitions would demand a hag‘ala.
The Shach names the mechanism, in the name of the Levush
The water does not wash: it weakens. That is why three times are needed, and fresh water each time.
What this changes for you. The first question before a vessel is not “what is it made of?” but “was the wine in it hot, and how long did it stay?” If the answer is “hot”, or “a full day”, this siman no longer answers and one must ask. If the answer is “cold, and briefly”, only then does one open the table of materials.

The siman reads in three blocks: the materials (1 to 6), the use (7 to 10), the remedies (11 to 16). Here is the map, with what each seif decides.

BlockSeifimWhat is decided there
The materialא — וGlass, metal, stone, wood, leather, earthenware, natron, glazes
The useז — יStorage or carriage, and what storage requires
The remediesי״א — ט״זRinsing, emptying, peeling, kiln, hag‘ala, twelve months
The Rama intervenes nine times, on eight seifim: 1, 4, 6, 9, 11, 12 (twice), 13 and 15. None of these glosses is decorative — the one on seif 6 restricts the entire siman, the one on seif 9 gives it its unit of measure.

The first sorting, and the most profitable: most cases are settled here.

The Mehaber’s ruling for passing use
Five materials, one requirement: rinse. And the Mehaber adds that it makes no difference who used it first.
The two ends of the scale At one end glass, which absorbs almost nothing; at the other leather, which absorbs enough for pitch to drive the wine in.
Between the two, everything else is ranked by porosity — and it is the same scale that governs seif 8.
What this changes for you. Modern equipment is almost all glass, stainless steel or smooth material — that is, at the lenient end of the scale. The practical question has therefore moved: it bears much less on the material than on the use (seifim 7 to 9) and on the duration of contact.

The lightest remedy, and its three exact conditions.

The number, and the liquid
Three times: this is Rabbenu Tam’s reading of the gemara on cups, and the Mehaber adopts it. With water, not with wine — even if one is willing to lose that wine.
And if one did not rinse at all?
The Shach reports that the Levush permitted rinsing with wine after the fact, and he rejects it for the emptying; the Taz concludes that one does not forbid after the fact even without any rinsing. Two distinct leniencies, not to be confused.
What this changes for you. A glass, a decanter, a corkscrew, a funnel: three rinsings with water, and the matter is closed. The only check to make beforehand is that of seif 9: is the object made for wine to stand in it? If so, move to the next chapter.

The heaviest category of the siman, and the one that decides nearly all cellar equipment.

The ruling, in one line
Two opposite clauses: a stringency — even a moment’s use affects the vessel — and a leniency — pitch adds nothing here.
Which materials? Three opinions, and the ruling
The Mehaber rules like the widest circle — וכן ראוי לנהוג — hence stone and metal included; glass stays outside the field by all opinions.
What this changes for you. A vat, a tank, a barrel, a cistern — anything made for wine to stand in it — requires a three-day emptying, not a rinsing, whatever the material, except glass. And the stringency of seif 7 is broader than expected: it holds even if the non-Jew used it only for a moment.

A coating changes the regime of the vessel — but not every coating, and not in every case.

Three seifim, three decisions
Pitch is scraped off or made good by an emptying; a pitch plug does not count; nor does wax.
The limit: what peeling the pitch does not redeem
For a storage vessel, scraping the pitch is not enough: an emptying is required. And according to the Taz, so long as the pitch is in place no thermal treatment redeems either.
What this changes for you. Before a coated vessel — enamelled, glazed, resined, waxed — the question is not “is it clean?” but “does this coating let things through?” Seif 6 gives the method of examination, and it is visual:
An intact surface brings one back to metal; a cracked surface brings one back to bare clay. And if the inside cannot be seen, the Taz warns: one does not presume.

The whole siman offers remedies; two lines alone have none. Identifying them is the first caution.

The one vessel with no way out
Three “evens” pile up in the Mehaber’s line: even twelve months, even without storage, even if a Jew used it first. It is the most absolute formulation in the siman.
What natron is, and what it is not
Rashi identifies it with alum; the Shach notes that the Rambam refutes that identification. The practical point is not the mineral’s name but its property: an earth that drinks and is never sated. In practice today, a porous unvitrified material is treated with this caution.
Earthenware: where hesitation remains
The Bach is lenient for the already-sated jar; the Shach is strict as long as it is not. In practice, since one can almost never date the saturation of an old piece, the question returns to that of the duration of contact — and there it is settled.
What this changes for you. An amphora, an unglazed jar, porous pottery, uncoated concrete: these are the only objects in the siman before which the right answer may be “it is no longer used”. Do not apply to them, by analogy, the leniencies that hold for steel and glass.

The protocol, and the three mistakes that void it.

The text of the protocol
The case where the water does not reach everything
A soft vessel does not stand full to the brim. The seif gives two concrete solutions — an added rim, or inverting it in a full vessel — and the rule behind them: what the water does not reach, it does not purge.
Water poured off too early: the disagreement, and what one does
The practical line: at the outset, one begins the three days again; after the fact, where the vessel has already been used, the Taz permits relying on the Rashba and completing the missing hours.
What this changes for you. Three mistakes void the emptying, and they are the three that are made: not filling to the brim, not renewing the water, and counting hours instead of days. As for the Rama’s fast route — the brine — it exists, but read the corrected proportion:
Two thirds salt, one third water — and brine dense enough for an egg to float in it. At a lower concentration the operation is worthless, and the Tur already said so.

Three alternative routes when emptying is impracticable — and their conditions.

Hag‘ala, and the practice of glowing stones
The condition the Taz maintains
What the Rama eases is the contact — a rolling instead of an immersion; what he does not ease is the source of the heat. The water must come from a keli rishon.
The kiln, and time
The criterion of the kiln is not the flame but the crossing. And the last remedy asks for nothing at all — except waiting.
What this changes for you. For a barrel that can neither be filled with water for three days nor immersed, the practice described by the Rama is the solution — provided the water comes from a keli rishon. And for equipment no longer needed, the simplest route is waiting: twelve months. But count them correctly:
Lunar months of twenty-nine days, that is three hundred and forty-eight days and not three hundred and sixty-five.

One point of the siman is undecided, and the Beer Hetev reports both views without choosing. It is also the most frequent one today.

The Perishah’s position, reported by the Shach
The Taz’s refusal
And the Shach’s reply in his נקודות הכסף
His distinction is measured: the vessel in question is not pitched, and the decree on mere contact does not go so far as to require an emptying.
What this changes for you. The question arises every day: a non-Jewish employee handles an empty but still-moist storage vessel without pouring anything into it. The Taz equates it with a use; the נקודות הכסף do not, at least for an unpitched vessel. The Beer Hetev reports both and does not decide. Conduct: where one can, one follows the Taz and performs the emptying; where one cannot, and especially where the loss is substantial, there is whom to rely on — but one asks, one does not decide alone. The Taz moreover draws from it a very concrete preventive instruction: when the lees left at the bottom of a cask are sold, it is the Jew who must take them out himself.

Three situations fall outside the siman. Recognising them prevents applying a leniency where it does not hold.

First exit — heat
All the lightness of the siman falls away: earthenware has no remedy left, the other materials pass to ordinary hag‘ala.
Second exit — a stay of a full day
The Shach leaves the question in צריך עיון; the Noda biYehudah, reported by the Pitchei Teshuvah, rules that emptying still suffices. Do not rely on this leniency without asking.
Third exit — the winepress implements
The Taz writes it in his very first word, and the Shach repeats it: these implements belong to siman 138 and are more severe, because wine passes through them constantly. A press, a trough, a must pump are not handled by the table of siman 135.
What this changes for you. Three questions to ask before opening the table: was it hot? did the wine stay a full day? does the object belong to the winepress? Three possible “yes” answers, and each sends one elsewhere — to the general law of prohibitions, to an undecided dispute, or to siman 138.

Five situations where the siman applies as it stands, and one where it does not.

Stainless tanks and vessels. Metal, hence rinsing for passing use (seif 1); but once they are made for wine to stand in them, seif 8 places them in the severe category — וכן ראוי לנהוג — and a three-day emptying is required. That steel is not porous changes nothing: the siman makes that exception only for glass.
Oak barrel. This is the case of seif 15 almost literally: wood, storage, sometimes coated. Three routes open — a three-day emptying (seif 12), hag‘ala in a keli rishon (seif 15), or the practice of glowing stones described by the Rama. If it is coated, begin with the peeling: according to the Taz nothing redeems while the coating is in place.
Bottles, glasses, decanters. Glass is the only material that seif 8 exempts by all opinions, and the Shach gives the reason: it does not drink. Three rinsings with water suffice, even for a bottle in which wine stayed a long time — subject to the two boundaries of chapter 11.
Glazed pottery, stoneware, earthenware. Look first at the surface, as in seif 6: intact and smooth, the piece is handled as metal; crazed, as bare clay; green, it has no remedy. If the inside is not visible — a narrow neck — the Taz warns against presumption.
Hoses, pumps, filters, funnels. Seif 2 and seif 9 treat them as objects of carriage, not of storage. But note the Taz’s limit: the winepress implements do leave this siman and are more severe (siman 138). A cellar hose and a press hose are not judged alike.
What this siman does not settle. It says nothing of the status of the wine itself — that is siman 123 and what follows; nothing of nullification in sixty — that is siman 137; nothing of the winepress implements — that is siman 138; and nothing of heated wine — that is the general law of prohibitions. It treats one thing only: what remained in a wall, and how to get it out.
