The preceding simanim protected a liquid. This one protects a
container. One must therefore begin with the question the siman never asks explicitly: on what exactly does
the decree bear, and what is forbidden when nothing is certain?
The Gemara — Rava, and the word that decides At the end of Avodah Zarah the Gemara does not
argue: it reports a practice, that of Rava himself, and draws a rule from it.
« רָבָא כִּי הֲוָה מְשַׁדַּר גּוּלְפֵי לְהַרְפַּנְיָא, סָחֵיף לְהוּ אַפּוּמַּיְיהוּ וְחָתֵים לְהוּ אַבִּירְצַיְיהוּ. קָסָבַר: כׇּל דָּבָר שֶׁמַּכְנִיסוֹ לְקִיּוּם, אֲפִילּוּ לְפִי שָׁעָה — גְּזַרוּ בֵּיהּ רַבָּנַן. » (עבודה זרה ע״ד ע״ב)
Note the form: it is not the wine that is at issue, it is דבר שמכניסו לקיום — a category of vessel. The whole siman is an unfolding of those three words.
The siman’s ḥakira: what does the decree produce?(א) A presumption of
fact — the Sages ruled that a wine vessel that has passed through non-Jewish hands is deemed to have been
used; the doubt is converted into certainty, and the consequence is a genuine status of prohibition on the
vessel. (ב) An a priori precaution — the Sages only forbade allowing it; where the
deed is done, we fall back into ordinary doubt, and a rabbinic doubt is treated leniently. The whole casuistry
of the siman — one seal or two, the kashering, the fate of what has already been poured in — depends on which
branch is taken.
Each branch has its master, and the Beit Yosef names them. For the first, he reads the Tur
thus:
« ומשמע לרבינו דגזרו ביה היינו לומר שצריך הכשר כאילו ודאי הכניס בו יין » (בית יוסף יו״ד קל״ו)
For the second, he reports the Ran in the name of the Ra’ah in the name of the Ramban:
« אבל הר״ן כתב בשם הרא״ה שאמר בשם הרמב״ן רבו דכי אמרינן אפילו לפי שעה גזרו ביה רבנן היינו לחוש לכתחילה » (בית יוסף יו״ד קל״ו)
And he gives the exact consequence for the case where the transgression has already occurred:
« ואפילו אם איתא דרמא ביה חמרא לא מיתסר אלא משום גזירה בעלמא מקילין בספיקא דסגי ליה בהדחה » (בית יוסף יו״ד קל״ו)
Immediate nafka mina A cask that comes back without its seal, about which nothing is known. On
(א), the full kashering of siman 135 is required. On (ב), a mere rinsing — הדחה —
would suffice, since we are only in doubt about a decree. The Mechaber does not rule on this point; the Rama
does — and that is what gives his gloss its whole weight.

2. חותם אחד או חותם בתוך חותם — two readings of a single act
The Mechaber rules for one seal and reports the requirement of
two. But where does that requirement come from? It comes from no new rule at all: it comes from how one reads
the two Aramaic verbs that describe what Rava did to his jars.
The Tur sets out both views and rules on neither
« השולח כלי ביד נכרי צריך להחתים שכל כלי ששהה ביד נכרי אפילו שעה אחת צריך הכשר כפי ההכשר שצריך אילו היה ישן בבית הנכרי ובא לקנותו ממנו » (טור יו״ד קל״ו)
« ורש״י כתב שצריך חותם בתוך חותם והריב״ם כתב שדי בחותם אחד » (טור יו״ד קל״ו)
The ma’hloket and its textual spring
It bears not on the halakha but on the reading of a practice. Rashi reads two
closures where others read only one, applied to two distinct openings.
Rashi: two closures, one over the other
« כך מבואר מדבריו שפי׳ סחיף להו אפומייהו כופה אותן שוליהן למעלה ופיהן למטה משום חב״ח » (בית יוסף יו״ד קל״ו)
The others: a single closure, but on each of the jar’s two openings
« אבל אחרים פירשו סחיף להו אפומייהו דמהדק דיקולא אפומייהו והיינו חותם אחד וחתים לה אבירצייהו דהיינו באותו נקב קטן שמשם מוציאים היין וכל זה אינו אלא חותם אחד » (בית יוסף יו״ד קל״ו)
And the Tosafot, in the very case of our siman
« וכ״נ מדברי התוס׳ דבחותם א׳ סגי שכתבו שמעינן מהכא דישראל השולח חבית ריקנית בבית הנכרי מעיר לעיר כדי לתקן צריך לחותמה מבפנים בגחלת או באבר רכה שהיא כאבר סיד כדי שיהא ניכר אם הנכרי נותן לתוכה יין והכי נקטינן » (בית יוסף יו״ד קל״ו)
Kushya If a seal suffices elsewhere, why should it not suffice here? In simanim 118 and 130 a
single seal is accepted even where substitution is feared. The fear there is graver — the wine itself is at
stake — and yet less is demanded. That is precisely backwards.
Terutz — the Ran, reported by the Shach: what is measured is not the gravity but the gain
« ול״ד לדלעיל סימן קי״ח וק״ל דביין מבושל או חומץ שרי בחותם אחד כיון דליכא למיחש לניסוך » (ש״ך יו״ד קל״ו ס״ק ב)
« דהתם אין העובד כוכבים יכול להחליפו אלא ביין מבושל או בחומץ שהוא גרוע ממנו מעט שאם היה שבחו של זה מרובה ממנו היה חלופו ניכר ומיתפס עליו כגנב ומשום שבחא פורתא לא טרח ומזייף אבל כאן משום תשמיש מרובה טרח ומזייף. הר״ן » (ש״ך יו״ד קל״ו ס״ק ב)
There, the forger would gain only a slight difference in quality, and he would be exposed if the difference
were large: משום שבחא פורתא לא טרח ומזייף. Here he would gain the entire use
of a cask for a whole journey — and for that, yes, he takes the trouble to remake a seal.
What this terutz establishes, and it reaches beyond the siman The strength of a seal is not a
property of the seal: it is a ratio between the difficulty of forging it and the benefit it guards. The same
material device therefore protects unequally according to what it encloses. That is why simanim 118, 130 and
136 give three different answers to what looks like the same question.
Nafka mina — and it is decided After the fact, does one seal suffice according to the one who
requires two? The Bach answers yes, and the Shach reports him without contradicting:
« כתב הב״ח ובדיעבד כדאי הם המתירין בחותם א׳ לסמוך עליהם וע״ל סימן ק״ל ס״ב » (ש״ך יו״ד קל״ו ס״ק א)
The Ba’er Hetev joins the two limbs — the reason and the conclusion — in a single entry:
« הטעם דמשום תשמיש מרובה טרח ומזייף וכתב הב״ח דבדיעבד כדאי הם המתירים בחותם א׳ לסמוך עליהם וע״ל סימן ק״ל ס״ב » (באר היטב יו״ד קל״ו ס״ק א)
Here the ḥakira of §1 becomes operative. If the decree creates a
presumption, one hour suffices. If it is only a precaution, the elapsed hour leaves nothing but a doubt.
The strict branch: the Tur, the Rosh, Rabbenu Yeruḥam
« ושהה אפילו שעה אחת ביד העובד כוכבים צריך הכשר כפי ענין כו׳ טור » (ש״ך יו״ד קל״ו ס״ק ג)
« וכן מפרש ג״כ הרא״ש פא״מ גבי נודות העובד כוכבים גרודים חדשים מותרין ישנים מזופפים אסורים כו׳ » (ש״ך יו״ד קל״ו ס״ק ג)
« וכ״כ ר׳ ירוחם דצריך הכשר אפי׳ לא שהה בידו אלא לפי שעה » (ש״ך יו״ד קל״ו ס״ק ג)
Where the line runs
The Shach lists the holders of each camp, and names the opponents without
circumlocution.
« וגם הב״ח הביא עוד פוסקים דסוברים כן ודלא כהרא״ה ור״ן » (ש״ך יו״ד קל״ו ס״ק ג)
The Bach wished to go further still and to read in the Tosafot and the Semak that kashering is required
even after the fact. The Shach refuses that step:
« ולפע״ד אין להם הכרע ואדרבה יותר יש לפרש לשונם דלכתחל׳ קאמרי ע״ש » (ש״ך יו״ד קל״ו ס״ק ג)
Kushya The Bach then offers an elegant way out: let the Jew simply leave the vessel standing
twenty-four hours, after which the absorbed taste becomes spoiling
(נותן טעם לפגם) and everything would be permitted, even a priori. Why refuse?
Terutz — the Shach: the category of נ״ט לפגם does not apply to wine
« דיכול הישראל להשהותם מע״ל ואחר כך מותרין אף לכתחלה דנ״ט לפגם הוא כו׳ הוא תמוה » (ש״ך יו״ד קל״ו ס״ק ג)
« דדוקא בקדרות וקערות שעמדו בבית העובד כוכבים קאמר הרא״ה דמשהה אותם מעל״ע אבל בכלי היין לא שייך נ״ט לפגם אפילו ישהנו כמה ימים וכדלקמן סימן קל״ז » (ש״ך יו״ד קל״ו ס״ק ג)
The Ra’ah’s reasoning concerned pots and bowls; a wine vessel does not deteriorate — on the contrary, ageing
improves it. The Shach refers for this to siman 137, where the principle is stated in so many words.
יסוד The rest that saves a kitchen utensil does not save a wine cask, and for a reason that is
not juridical but physical: כל שמתיישנים נ״ט לשבח. It is the one place in the block
where the nature of the material directly governs the halakha.
This is the siman’s only head-on opposition, and it bears on the
most frequent case: the vessel one has already used without kashering it.
Two positions, one text
Rama — אבל אם כבר עבר והשתמש בו אין לאסור
בדיעבד, and he refers to siman 122. Taz — the very reference is a mistake: it is in
siman 122 that he demonstrated the opposite.
« לעיל סי׳ קכ״ב סעיף ט׳ הארכנו דלא קי״ל כן אלא אף בדיעבד אסור » (ט״ז יו״ד קל״ו ס״ק ב)
And the Ba’er Hetev sets the disagreement down explicitly, extending the Taz’s position to all vessels:
« גם פסק דאפילו בדיעבד יש לאסור בכל הכלים דלא כרמ״א וע״ל סי׳ קכ״ב ס״ט » (באר היטב יו״ד קל״ו ס״ק ב)
Kushya on the Rama If he holds that the vessel must be kashered — and he says so in
the first half of his own gloss — how can what was poured into it remain permitted? Either the vessel is
forbidden and its contents with it, or it is not, and the kashering is a mere recommendation.
Terutz — the Shach separates the decree from its object
« דכיון דלא היה ביד עובד כוכבים אלא לפי שעה א״כ ודאי לא נבלע איסור בכלי וגם לא נשתמש בו בודאי ודי שגזרו שהכלי צריך הכשר דלפי שעה חשיב כמכניסו לקיום אבל ודאי בדיעבד המאכל מותר » (ש״ך יו״ד קל״ו ס״ק ג)
The key lies in the words ודי שגזרו שהכלי צריך הכשר: the decree stops at the vessel.
It does not say that wine stood in it; it says that a storage vessel is not carried about without a mark. The
contents themselves are judged on the facts — and the facts are doubtful.
Nafka mina Three questions, and they must never be merged: must the vessel be kashered? (yes,
no one disputes it); is what was poured into it lost? (Rama no, Taz yes); and may one go on using it without
kashering? (no, on both views).
5. איזה הכשר — what the Taz takes away from the gloss
The Shach refers; the Taz delimits. The Shach is content with an address:
« ועל הדרך שנתבאר סי׳ קל״ה: » (ש״ך יו״ד קל״ו ס״ק ד)
The Taz, for his part, reads the Rama’s formula closely —
כפי ענין ההכשר אם היה של עובד כוכבים — and refuses to extend it:
« פי׳ אם היה של עובד כוכבים מתחילה וקנאו ישראל ממנו ואין בכלל זה כלי חרס דאם תחילת תשמישו ביד עובד כוכבים צריך עירוי אע״פ שאין מכניסו לקיום ואילו בזה שהיה תחלה של ישראל א״צ אלא כמבואר סימן קל״ה סעיף ד׳ » (ט״ז יו״ד קל״ו ס״ק א)
Secondary ḥakira: earthenware(א) The law of vessels follows use:
what is not put to storage is treated lightly, whatever the material. (ב) It follows
matter: earthenware absorbs differently, and its first use determines everything. The Taz rules for
(ב) on this precise point — דאם תחילת תשמישו ביד עובד כוכבים צריך עירוי אע״פ שאין מכניסו
לקיום — and that is why he excludes earthenware from the Rama’s gloss.
Nafka mina An earthenware vessel belonging to a Jew, shipped without a seal: its kashering
falls under siman 135 seif 4, not under the regime of a vessel acquired from a non-Jew. The whole distinction
lies in the word מתחילה — to whom the vessel first belonged.
6. חביות גדולות — the exception and its limits
The source: the Sefer haTerumah, by way of the Tur
« ובספר התרומה התיר לשלוח חביות של עץ גדולים לבית נכרי אומן יום או יומים לתקנם דבכלי גדול כזה אין רגילין להשתמש בו לפי שעה » (טור יו״ד קל״ו)
The reason is not a dispensation but a measurement. The permission does not rest on leniency:
it rests on the fact that the presumption ceases to be plausible. A container of that size is not filled for
two days — hence אין רגילים להשתמש בו לפי שעה, hence the very ground of the decree is
lacking. It is a reasoning of fact, not of law.
How far does the permission go?
Two limits are discussed: the duration, and the degree of recommendation.
« ומיהו כתבו דמ״מ טוב להחמיר ונראה מדבריהם דלא שרי להשהות אלא יום או יומים אבל בא״ח כתב בשם ר״י דאפי׳ זמן מרובה שרי להשהות בבית האומן » (בית יוסף יו״ד קל״ו)
The Beit Yosef thus records three positions: the Tosafot and the Mordechai permit but prefer stringency; their
language suggests a limit of a day or two; the Orchot Chaim, in the name of the Ri, permit even a long stay.
The Shach does not debate the duration — he recalls the principle:
« מיהו כתבו יש פוסקים דלכתחלה יש ליזהר בכל מאי דאפשר וכ״כ האחרונים » (ש״ך יו״ד קל״ו ס״ק ה)
And the Ba’er Hetev places it to the account of the Acharonim:
« מיהו כתבו יש פוסקים דלכתחלה יש ליזהר בכל מאי דאפשר וכן כתבו האחרונים » (באר היטב יו״ד קל״ו ס״ק ג)
Nafka mina A vat left with a craftsman for a week rather than two days. On the Beit Yosef’s
reading of the Tosafot the permission does not cover this case; on the Orchot Chaim’s, it does. And on both
readings the Shach maintains that a priori one guards oneself as far as one can.
7. יסוד הסימן — הכל תלוי בשיעור הריווח
כלל הסימן :
אין החותם מחיצה, ואף לא ראיה — אלא סימן שכוחו נמדד כנגד
שבחא שיפיק המזייף. במקום ששכרו מועט —
משום שבחא פורתא לא טרח ומזייף — די בחותם אחד ; ובמקום ששכרו מרובה, שהוא
תשמיש מרובה — טרח ומזייף, וצריך יותר. ומשגזרו על הכלי

Three lines to take away.(1) The decree bears on the vessel, not on
its contents — which is what allows the Rama to require kashering and yet not condemn the food.
(2) The number of seals is measured by the forger’s gain, not by the gravity of the
prohibition. (3) Time does not heal a wine cask: it improves it, and that is exactly why it
does not save it.
